When multiple individuals interact in a conversation or as part of a large crowd, emergent structures and dynamics arise that are behavioral properties of the interacting group rather than of any individual member of that group. Recent work using traditional signal processing techniques and machine learning has demonstrated that global acoustic data recorded from a crowd at a basketball game can be used to classify emergent crowd behavior in terms of the crowd's purported emotional state. We propose that the description (...) of crowd behavior from such global acoustic data could benefit from nonlinear analysis methods derived from dynamical systems theory. Such methods have been used in recent research applying nonlinear methods to audio data extracted from music and group musical interactions. In this work, we used nonlinear analyses to extract features that are relevant to the behavioral interactions that underlie acoustic signals produced by a crowd attending a sporting event. We propose that recurrence dynamics measured from these audio signals via recurrence quantification analysis (RQA) reflect information about the behavioral dynamics of the crowd itself. We analyze these dynamics from acoustic signals recorded from crowds attending basketball games, and that were manually labeled according to the crowds' emotional state across six categories: angry noise, applause, cheer, distraction noise, positive chant, and negative chant. We show that RQA measures are useful to differentiate the emergent acoustic behavioral dynamics between these categories, and can provide insight into the recurrence patterns that underlie crowd interactions. Future population growth is uncertain and matters for climate policy: higher growth entails more emissions and means more people will be vulnerable to climate-related impacts. We show that how future population is valued importantly determines mitigation decisions. Using the Dynamic Integrated Climate-Economy model, we explore two approaches to valuing population: a discounted version of total utilitarianism (TU), which considers total wellbeing and is standard in social cost of carbon dioxide (SCC) models, and of average utilitarianism (AU), which ignores population size (...) and sums only each time period’s discounted average wellbeing. Under both approaches, as population increases the SCC increases, but optimal peak temperature decreases. The effect is larger under TU, because it responds to the fact that a larger population means climate change hurts more people: for example, in 2025, assuming the United Nations (UN)-high rather than UN-low population scenario entails an increase in the SCC of 85% under TU vs. 5% under AU. The difference in the SCC between the two population scenarios under TU is comparable to commonly debated decisions regarding time discounting. Additionally, we estimate the avoided mitigation costs implied by plausible reductions in population growth, finding that large near-term savings ($billions annually) occur under TU; savings under AU emerge in the more distant future. These savings are larger than spending shortfalls for human development policies that may lower fertility. Finally, we show that whether lowering population growth entails overall improvements in wellbeing—rather than merely cost savings—again depends on the ethical approach to valuing population. Carroll (1991) encouraged researchers in Social Issues Management (SIM) to continue to measure Corporate Social Performance (CSP) from a variety of different perspectives utilizing a variety of different measures. In addition, Wolfe and Aupperle (1991) (and others) have asserted that there is no, single best way to measure CSP and that multiple measures and perspectives help develop the field. However, Pfeffer (1993) suggest that a lack of consistent measurement has constrained organization studies (and by implication, the field of social issues (...) management,) in its development as a field. It may be in the best interest of social issues management researchers to try to development a common body of measures and data. Recently, Kinder, Lydenberg and Domini & Co. (KLD — a social choice investment advisory firm) has made available their social performance database. The KLD data have potential to become a widely accepted set of CSP measures. The purpose of this paper is to present a construct validity study comparing the KLD data to other measures of CSP. (shrink)

In philosophy of logic and elsewhere, it is generally thought that similar problems should be solved by similar means. This advice is sometimes elevated to the status of a principle: the principle of uniform solution. In this paper I will explore the question of what counts as a similar problem and consider reasons for subscribing to the principle of uniform solution.

In this commentary, it is not feasible to provide a comprehensive analysis of each of the articles; and I have not attempted to do so. Instead, for each article, I have selected specific issues and arguments on which to comment.

God and Goodness takes the experience of value as a starting point for natural theology. Mark Wynn argues that theism offers our best understanding of the goodness of the world, especially its beauty and openness to the development of richer and more complex material forms. We also see that the world's goodness calls for a moral response: commitment to the goodness of the world represents a natural extension of the trust to which we aspire in our dealings with human (...) beings. This article addresses the question whether we can know on the basis of folk intuitions that we have character traits. I answer in the negative, arguing that on any of the primary theories of knowledge, our intuitions about traits do not amount to knowledge. For instance, because we would attribute traits to one another regardless of whether we actually possessed such metaphysically robust dispositions, Nozickian sensitivity theory disqualifies our intuitions about traits from being knowledge. Yet we do think we know (...) that we have traits, so I am advancing an error theory, which means that I owe an account of why we fall into error. Why do we feel so comfortable navigating the language of traits if we lack knowledge of them? To answer this question, I refer to a slew of heuristics and biases. Some, like the fundamental attribution error, the false consensus effect, and the power of construal, pertain directly to trait attributions. Others are more general cognitive heuristics and biases whose relevance to trait attributions requires explanation and can be classed under the headings of input heuristics and biases and processing heuristics and biases. Input heuristics and biases include selection bias, availability bias, availability cascade, and anchoring. Processing heuristics and biases include disregard of base rates, disregard of regression to the mean, and confirmation bias. (shrink)

There is a problem of representation and an apparatus of representations that was devised to solve this problem. This paper has two purposes. First, it will show why the problem of representation outstrips the apparatus of representations in the sense that the problem survives the demise of the apparatus. Secondly, it will argue that the question of whether cognition does or not involve representations is a poorly defined question, and far too crude to be helpful in understanding the nature of (...) cognitive processes. Alexander Miller has recently considered an ingenious extension of Frank Jackson and Philip Pettit's account of 'program explanation' as a way of defending non-reductive naturalist versions of moral realism against Harman's explanatory criticism. Despite the ingenuity of this extension, Miller concludes that program explanation cannot help such moral realists in their attempt to defend moral properties. Specifically, he argues that such moral program explanations are dispensable from an epistemically unlimited point of view. I show that Miller's argument for this negative (...) claim is inadequate, and that he has, in spite of himself, identified a promising defence of moral realism. (shrink)

ABSTRACT One of Murray Edelman’s most important insights was that understanding public ignorance about politics and policy requires an analysis of how symbolic communication and popular culture shape public knowledge and opinion. Approaches that simply dismiss the public as ignorant or idiotic make a similar error as those that simply embrace the modern public as capable of engaging in the work of a competent demos, insofar as both simplify complex social and cultural processes of meaning‐making and comprehension. The problem for (...) those who wish to take Edelman’s insight seriously—a problem that Edelman failed to resolve—is precisely how to study and theorize the public as something less than deliberative and knowledgeable, but more than simply ignorant. There has been a long history of discussion on the usefulness of formal methods in legal settings.1 Some of the recent debate has focussed on foundational issues in statistics, in particular, how the reference-class problem affects legal decisions based on certain types of statistical evidence.2 Here we examine aspects of this debate, stressing why the reference-class problem presents serious difficulties for the kinds of statistical inferences under consideration and the relevance of this for the use of statistics in the courtroom. Hegel thinks the state is so important to our identity that we should be willing to give our lives for it. He characterizes the state as our ethical "substance." It is sometimes inferred from this that he thinks members of a modern state form a tightly-knit, culturally and ethnically homogeneous community. A close reading of his texts shows, rather, that Hegel does not think they must be a "community," or of the same race or ethnicity, or speak the same language, (...) or practice the same religion. I explore Hegel's view of the ties that bind members of a state, arguing that what he thinks members must share are social practices. I conclude by considering whether in his effort to forge a common identity Hegel resorts to ties too weak to justify the claims he makes about the state being our substance, something worth dying for. This article uses Ernst Fraenkel’s concept of the “dual state” as the vehicle for examining the role of “lynch law” as a mode of governance of African Americans in the United States from 1865 to 1940. It begins with a largely jurisprudential inquiry placing my interpretation of Ernst Fraenkel’s distinction between the normative state and the prerogative state in dialogue with a version of American Legal Realism, in which law consists entirely of “moves” such as permissible distinctions and analogies that (...) are treated as acceptable by relevant professional communities. Seen through that lens the distinction between the normative state and the prerogative state thins out. The arbitrariness Fraenkel associates with the prerogative state infects the normative state and the prerogative state is pervaded by norms that aren’t mere simulacra of legal norms. The two kinds of state are different in degree rather than in kind—but differences in degree can matter. Part II uses the revised distinction in a preliminary examination of lynch law in the U.S. South. Lynch law was not an example of Fraenkel’s prerogative state; the norms enforced through lynch law might have been popular versions of norms drawn from the prerogative state. And yet “lynch law” was different not only in content from the rules of law formally applicable to all people in the United States but also in the lived experience of those subject to lynch law. Lynch law might not have been arbitrary in the sense that it had no knowable normative content, but, perhaps because the norms were popular rather than legislated or formal, it was substantially vaguer than the formal law and significantly less able to guide the choices made by those subject to it. Recent social theory that stresses the ‘nonrepresentational’, the ‘more-than visual’, and the relationship between affect and sensation have tended to assume some kind of break or rupture from historical antecedents. Especially since the contributions of Crary and Jay in the 1990s, when it comes to perceiving the built environment the complexities of sensation have been partially obscured by the dominance of a static model of vision as the principal organizing modality. This article returns to some prior historical articulations of the (...) significance of motility in perception, retracing pathways across art history, architectural theory and the history of neuroscience to argue for an alternative model based on the movement of the eye. Along with subsystems that deal with balance and orientation, I offer parallels between spatial motifs of the interior spaces of the body – labyrinths, vestibules, chambers – and those in artefacts and the built environment that contribute to the heightened physicality of the oculomotor subject. There is substantial published evidence showing that countless people enroll each year in ethically deficient clinical trials. Many of the trials are problematic because the quality of the science used to justify their launch may not be sufficiently vetted while many other trials may lack requisite social value. This poses the question: why do people volunteer for them? The answer resides in large part in the fact that informed consent practices have historically masked, rather than disclosed, the information that would (...) alert research candidates to the ethically problematic nature of the trials. The “reasonable person” and “key information” provisions in the revised US Common Rule create the opportunity to correct this historical shortcoming. Two sources are employed to shed light on what the “key information” is that should be disclosed to a “reasonable person”: the original disclosure aims of the Nuremberg Code, as well as an extensive body of meta-research evidence. Those sources jointly support a range of new disclosures in the informed consent process that would unmask the heretofore undisclosed information. The resulting proposed new disclosures pertain to the overall success prospects of clinical trials, the quality of the prior research that both forms the basis of clinical trials and informs assessment of their risks and benefits, the potential social value of clinical trials, and the commercial purposes of clinical trials. This dissertation is concerned with normativity both as an explanatory device in the philosophy of language, logic and epistemology and as a philosophical issue in its own right. Following later Wittgenstein and Sellars, it is argued that language is normative, in the first instance because of the fact that speech acts take place within a structure of social norms and institutions. This fact is then utilized to show that important features of semantic content can be explained in terms of such (...) norms. ;This Sellarsian conception of linguistic usage as the performance of acts within a linguistic game of giving and asking for reasons, leads us to focus on inferential proprieties as central to semantic content. It is, then, natural to look at logical vocabulary, paradigmatically 'entails', as expressing the very normative relations definitive of this content. An idea of Brandom's is developed in providing a formal theory of the inferential content of logical vocabulary. Such normative-inferentialist semantic analyses are developed for a wide range of logical systems. ;A certain conception of justification also falls naturally out of this general theory of language. If asserting is an act performed within a linguistic game, then justification can be thought of as a matter of winning such a game, a successfully defending one's assertion in the face of licensed challenges to it. This account is developed, drawing consequences for the theory of rationality and knowledge. ;The second major issue of the dissertation is the theory of the normative itself and much of the constructive work in the philosophy of language, philosophy of logic and epistemology forms a case study for a particular theory of the normative. On the basis of Wittgensteinian considerations, it is argued that normativity must be understood as resting ultimately on social practice. ;We solve problems of earlier accounts of norms by introducing a novel normative relation between assertions of normative propriety and social practices. Normative assertions do not describe existing social standards, but do nonetheless derive their semantic content from those standards. This argument carried through in detail for cases of logical and epistemic vocabulary in the dissertation. (shrink)

In the last hundred years, the philosophy of natural law has suffered a fate that could hardly have been envisaged by the seventeenth and eighteenth century exponents of its universality and eternity: it has become old-fashioned. The positivists and the Marxists were happy to throw eternal moral ity out of the window, confident that some magic temporal harmony would eventually follow Progress in by the front door. Their hopes may not have been fully realized, but they did succeed in discrediting (...) natural law. What is often not appreciated is the extent to which we have adopted the tenets of the philosophy they despised, borh in the field of politics, and in the field of personal and social ethics, which Barbeyrac called "la science des mreurs" and which the positivists re christened "social science". Consequently, though we live in a world whose freedom, such as it is, is largely a result of the popularization of the philosophy of natural law, and whose conscious and unconscious standards, such as they are, are a result of that philosophy as it became combined with Christianity, the doctrine of natural law is itself for gotten. In view of the oblivion into which it has fallen, natural law is a concept which means little to the average reader. All too often, Montesquieu scholars have traded on this oblivion in order to give an exaggerated picture of his originality. (shrink)

Rejections of Hume’s account of agency as ‘implausible’ and ‘defective’ have not been uncommon in recent commentary, but these responses have been elaborated without acknowledgement that Maine de Biran offered a critique of the Scottish philosopher on this point two centuries earlier. In criticizing Hume, Biran argues that awareness of the power of the will in effort, understood as the relation of will to resistance, is the fundamental fact of all consciousness. This article revisits Biran's critique in the light of (...) a recent defence of Hume and with reference to the first Enquiry's crucial footnote denying that effort can ground the idea of causal power. The article also addresses one of the background motivations for Hume’s sceptical account of agency to which Biran does not respond directly, namely what the first Enquiry presents as the ‘inconsistency’ of the idea of free will as a power removed from all causal determination. I conclude by arguing that Biran cannot offer an adequate response to Hume on this point, and that a fuller, more compelling response can be found in the development of the French spiritualist tradition. The author uses two publications, Fighting Poverty in the US and Europe (Alesina and Glaeser) and Poetry magazine, to underscore the important role that educational institutions play in developing a person’s political philosophy and imagination. European nations, for instance, have better funded social welfare programs than the US because their system of public education incorporates more liberal or left-leaning teachings into their standard curricula. The author sees implications for a more intentional approach to education in the US for those who (...) are interested in changing the food system. If American educational institutions viewed their role as producing food competent citizens, he argues, then we would be more successful in addressing obesity, promoting a more sustainable food system, and even reducing poverty. Food system activists, dieticians and nutritionists, parents, and elected officials should take a more aggressive position with educational institutions to develop programs, services, and curricula capable of achieving these ends. Expertise is a topic that is beginning to receive more attention in the Philosophy of Education and discussions are closely related to the epistemological debate concerning the nature of know-how which has also burgeoned in recent years within ‘mainstream’ epistemology. More specifically, this volume focuses on the relevance of expertise to professional education and practice, with the aim on shedding light on what is involved (...) in professional expertise and the implications of a sound understanding of professional expertise for professional education. Although all contributions have roots in philosophical discussion, there is an element of cross-disciplinarity among them, reflecting the advances that have been made to our understanding of expertise from psychology in particular.
