In a series of ten preregistered experiments (N=2043), we investigate the effect of outcome valence on judgments of probability, negligence, and culpability – a phenomenon sometimes labelled moral (and legal) luck. We found that harmful outcomes, when contrasted with neutral outcomes, lead to increased perceived probability of harm ex post, and consequently to increased attribution of negligence and culpability. Rather than simply postulating a hindsight bias (as is common), we employ a variety of empirical means to demonstrate that the outcome-driven (...) asymmetry across perceived probabilities constitutes a systematic cognitive distortion. We then explore three distinct strategies to alleviate the hindsight bias and its downstream effects on mens rea and culpability ascriptions. Not all are successful, but at least some prove promising. They should, we argue, be taken into consideration in criminal jurisprudence, where distortions due to the hindsight bias are likely considerable and deeply disconcerting. (shrink)

The potential capacity for robots to deceive has received considerable attention recently. Many papers explore the technical possibility for a robot to engage in deception for beneficial purposes (e.g., in education or health). In this short experimental paper, I focus on a more paradigmatic case: robot lying (lying being the textbook example of deception) for nonbeneficial purposes as judged from the human point of view. More precisely, I present an empirical experiment that investigates the following three questions: (a) Are ordinary (...) people willing to ascribe deceptive intentions to artificial agents? (b) Are they as willing to judge a robot lie as a lie as they would be when human agents engage in verbal deception? (c) Do people blame a lying artificial agent to the same extent as a lying human agent? The response to all three questions is a resounding yes. This, I argue, implies that robot deception and its normative consequences deserve considerably more attention than they presently receive. (shrink)

Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see that my (...) objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. This paper addresses the question of what we can legitimately say about things in themselves in Kant's critical doctrine. Many Kant scholars believe that Kant allows that things in themselves can be characterized through the unschematized or ‘pure’ concepts of our understanding such as ‘substance’ or ‘causality’. However, I show that on Kant's view things in themselves do not conform to the unschematized categories : the pure categories, like space and time, are merely subjective forms of finite, discursive cognition. Most contemporary philosophers of action agree on the following claims. Firstly, the possibility of deviant or wayward causal chains poses a serious problem for the standard-causal theory of action. Secondly, we can distinguish between different kinds of deviant causal chains in the theory of action. In particular, we can distinguish between cases of basic and cases of consequential deviance. Thirdly, the problem of consequential deviance admits of a fairly straightforward solution, whereas the possibility of basic deviance constitutes a separate and (...) difficult problem that requires its own solution. I will argue that the problem of basic deviance is no more troublesome than the problem of consequential deviance, as a solution to the former is implicit in the standard solution to the latter. In this paper, I argue that many arguments from expert opinion are strong arguments. Therefore, in many cases it is rational to rely on experts since in many cases the fact that an expert says that p makes it highly likely that p is true. I will defend this claim by providing 5 arguments that illuminate and elaborate on 5 crucial claims about expertise. In this way, I aim to undermine recent attempts to establish a rampant scepticism about arguments from (...) expert opinion. (shrink)

Benjamin Libet's empirical challenge to free will has received a great deal of attention and criticism. A standard line of response has emerged that many take to be decisive against Libet's challenge. In the first part of this paper, I will argue that this standard response fails to put the challenge to rest. It fails, in particular, to address a recent follow-up experiment that raises a similar worry about free will (Soon, Brass, Heinze, & Haynes, 2008). In the second part, (...) however, I will argue that we can altogether avoid Libet-style challenges if we adopt a traditional compatibilist account of free will. In the final section, I will briefly explain why there is good and independent reason to think about free will in this way. (shrink)

The ArgumentContemporary natural sciences succeed remarkably well in ensuring a relatively continuous transmission of their cognitively relevant traditions and in creating a widely shared background consensus among their practitioners – hermeneutical ends seemingly achieved without hermeneutical awareness or explicitly acquired hermeneutical skills.It is a historically specific – emerging only in the nineteenth century – cultural organization of the Author-Text-Reader relation which endows them with such an ease of hermeneutical achievements: an institutionally fixed form of textual and intertextual practices, normatively posited (...) ways of adequate reception and criticism, etc. The same organization also explains a number of their often-discussed epistemic and cultural characteristics: their depersonalized objectivity, the social closure of their discourse and their reduced cultural significance, the shallow historical depth of their activated traditions, etc.The cognitive structure and the social function of contemporary natural sciences are intimately interwoven with a set of sui generis cultural relations that are partially fixed in the textual characteristics of their literary objectivations. A comparative hermeneutical analysis of natural sciences as a specifically constituted and institutionalized cultural genre or discourse-type brings into relief those contingent cultural conditions and relations to which some of their fundamental epistemological characteristics are bound, or at least with which they are historically closely associated. Curiosity is a wonder of the human mind. It goes to the heart of modernity, as a driving force for learning, novel insights, and innovation, both for individuals and communities. In societies dependent on science and development, finding out what promotes or hampers curiosity and wonder in school curricula and science education is accordingly essential. In this conceptual article, I suggest a framework for curiosity-based science education and I explore options for its wellbeing and development during preschool, preadolescence, and adolescence. In preschool, curiosity and wonder are triggered by perceptive beauty rather than by facts, and a method emphasizing maximism as a complementary factor in preschool science education is proposed. In prepuberty, curiosity is encouraged by exploring the diversity of the world. Facts and clear-cut knowledge constitute a firm foundation for scientific thinking. In high school, curiosity is ignited by means of a better balance between models and phenomenology. Criticism has arisen over the one-sided use of models in high school science education, which limits scientific thinking to frameworks defined by the actual model. Possible solutions to maintain students’ curiosity and ideas to improve the balance between phenomenology and models are discussed. (shrink)

In "Kant on Freedom and Rational Agency", I aim to give a comprehensive interpretation and a qualified defense of Kant’s doctrine of freedom as a systematic conception of rational agency. -/- Although my book follows Kant in focusing on the idea of free will as a condition of moral agency, it denies that moral freedom of will is the only relevant (transcendental) type of freedom. Human beings also exercise absolute freedom of thought (intellectual autonomy) in their theoretical cognition. Moreover, our (...) creation and appreciation of beauty requires our freedom of imagination. I consider these three varieties of free agency both in their own rights and in their systematic connections, by examining how they differ from and yet relate to each other. On this basis, my interpretation shows that and why for Kant transcendental freedom is the proper anchor ("cardinal point") of all meaningful, rational human activity: our moral efforts to become more virtuous and to make the world a better place; our theoretical efforts to understand, explain and predict the world; and our aesthetic engagement with the world of beauty, both artistic and natural. -/- Additionally, "Kant on Freedom and Rational Agency" illuminates Kant's intricate, multifaceted account by considering the various metaphysical, semantic, epistemological and normative dimensions of Kantian freedom and by revealing their systematic interconnections. One significant benefit of tracing these links is that by doing so we can arrive at a charitable view of how Kant seeks to justify the belief in moral freedom of will. -/- For many commentators, Kant's appeal to a moral ‘fact of reason’ as our basis for believing in supersensible free will is an abject philosophical failure or a lapse into dogmatic rationalism. By contrast, I show that Kant justifies our belief in free will through a rather powerful, two-pronged argumentative strategy. First, he constructs a practical-moral proof of free will via the fact of reason doctrine. Second, he provides a theoretical defense of this moral proof against challenges arising from a naturalistic worldview. The linchpin of this defense is his argument that naturalistic cognizers must presuppose their epistemic freedom of thought as a necessary condition of all objective theoretical (including naturalistic) cognition. Since epistemic freedom of thought and moral freedom of will are both species of transcendental freedom, naturalists cannot (coherently) debunk our practical self-conception as transcendentally free moral agents. The appeal to epistemic freedom of thought provides no positive grounds for believing in a free moral will; but it shields our moral self-awareness (which does provide such grounds) against its most prominent detractors. -/- This defense strategy (among other aspects of Kant’s view that I examine in my book) shows that a significant part of Kant’s legacy is his abiding potential to challenge and provide alternatives to a naturalistic philosophical worldview (held by the “defender of an omnipotent nature”) according to which the mechanistic order of nature engulfs all metaphysical reality and (thereby) our entire humanity. In The Crisis of the European Union Jürgen Habermas claims that the constituent power in the EU is shared between the community of EU citizens and the political communities of the member states. By his own account, Habermas arrives at this concept of a dual constituent subject through a rational reconstruction of the genesis of the European constitution. This explanation, however, is not particularly illuminating since it is controversial what the term ‘rational reconstruction’ stands for. Adaptation by means of natural selection depends on the ability of populations to maintain variation in heritable traits. According to the Modern Synthesis this variation is sustained by mutations and genetic drift. Epigenetics, evodevo, niche construction and cultural factors have more recently been shown to contribute to heritable variation, however, leading an increasing number of biologists to call for an extended view of speciation and evolution. An additional common feature across the animal kingdom is learning, defined as the ability to (...) change behavior according to novel experiences or skills. Learning constitutes an additional source for phenotypic variation, and change in behavior may induce long lasting shifts in fitness, and hence favor evolutionary novelties. Based on published studies, I demonstrate how learning about food, mate choice and habitats has contributed substantially to speciation in the canonical story of Darwin’s finches on the Galapagos Islands. Learning cannot be reduced to genetics, because it demands decisions, which requires a subject. Evolutionary novelties may hence emerge both from shifts in allelic frequencies and from shifts in learned, subject driven behavior. The existence of two principally different sources of variation also prevents the Modern Synthesis from self-referring explanations. (shrink)

One main challenge of non-platonist philosophy of mathematics is to account for the apparent objectivity of mathematical knowledge. Cole and Feferman have proposed accounts that aim to explain objectivity through the intersubjectivity of mathematical knowledge. In this paper, focusing on arithmetic, I will argue that these accounts as such cannot explain the apparent objectivity of mathematical knowledge. However, with support from recent progress in the empirical study of the development of arithmetical cognition, a stronger argument can be provided. I will (...) show that since the development of arithmetic is (partly) determined by biologically evolved proto-arithmetical abilities, arithmetical knowledge can be understood as maximally intersubjective. This maximal intersubjectivity, I argue, can lead to the experience of objectivity, thus providing a solution to the problem of reconciling non-platonist philosophy of mathematics with the (apparent) objectivity of mathematical knowledge. In two recent papers in Studies in History and Philosophy of Science Howard Sankey has argued that there is an intimate relationship between Pyrrhonian skepticism and recent approaches to epistemic relativism.Though the general argument and idea of Sankey’s papers is very much appreciated, it is argued that the epistemic relativist’s recourse to the skeptical strategy outlined by the Pyrrhonian is not a good one. This diagnosis gives rise to an objection against the epistemic relativist who argues on the basis of (...) the skeptical strategy that differs from Sankey’s naturalistic response. Furthermore, it can be shown that what is really at stake between epistemic relativism and epistemic absolutism is the question of which criteria there are for variation of epistemic norms and epistemic systems. Rubin and Pearl offered approaches to causal effect estimation and Lewis and Pearl offered theories of counterfactual conditionals. Arguments offered by Pearl and his collaborators support a weak form of equivalence such that notation from the rival theory can be re-purposed to express Pearl’s theory in a way that is equivalent to Pearl’s theory expressed in its native notation. Nonetheless, the many fundamental differences between the theories rule out any stronger form of equivalence. A renewed emphasis on comparative research can (...) help to guide applications, further develop each theory, and better understand their relative strengths and weaknesses. (shrink)

I discuss the difference and the connections between Kant’s notions of cognition (Erkenntnis) and knowledge (Wissen). Unlike knowledge, cognition is a representational state which need not have the propositional structure of a judgments. Even cognitions that have such a structure need not coincide with knowledge, because they might rather have the doxastic status of opinion or faith, or they might be false (whereas knowledge is a certain recognition of truth). I argue that while Kant distinguishes between many different species of (...) cognition, he uses the term ‘knowledge’ univocally across his theoretical and practical philosophy. All knowledge is based upon some kind of cognition that provides the sufficient objective, certain ground for a knowing assent to a proposition. However, not all knowledge must be based upon the demanding type of cognition that is central to Kant’s overall argument in the first Critique, which requires a synthesis of concepts and sensible intuition. We have a lot of determinate knowledge, including knowledge that we possess transcendental freedom of will, that is based upon purely conceptual practical cognition. We can also have some indeterminate philosophical knowledge (e.g. knowledge that there are non-sensible, noumenal beings) that is based upon purely conceptual theoretical cognition. (shrink)

The problematics of alienation have played a rather significant role in the discussions\nabout the sense and relevance of Marxism which have taken place in\nthe last twenty years. &dquo;Back to Marx&dquo; was at least one of the main slogans of\nthat ideological/intellectual movement, which evolved both in the East and\nWest from the mid-fifties and which is sometimes referred to as the trend of\n&dquo;humanist&dquo; Marxism. The idea of a &dquo;Marx-Renaissance&dquo; was undoubtedly\ndirected first of all against the completely petrified framework of institutionalized\nMarxism, turned into (...) a &dquo;religion of state&dquo; legitimating the domination\nof a bureaucratic apparatus over the population of East European societies.\nThe &dquo;rediscovery&dquo; and &dquo;rehabilitation&dquo; of the young Marx, the emphasis on\nthe continuity of his thought, meant not only a reintroduction of a number\nof categories, problems and ideas, which were thought fruitful in their critical\ninsight into contemporary conditions and which the impoverished and distorted\nversion of Marxism in official communist ideology (deliberately) failed\nto take into account: it also meant a global challenge to the appropriation of\nthe Marxian tradition by an apologetic ideology, which disguised its positivistic\ncontent through the form of an old-fashioned, dogmatic metaphysics; it\nwas an attempt to recover the critical/emancipatory meaning of this tradition\nwithin the realities of the twentieth century. It was in this context that the\nnotion of &dquo;alienation&dquo; again reappeared -- as a concept through which one\ncould articulate an attitude which was critical simultaneously of Western\ncapitalist and so-called &dquo;socialist&dquo; Eastern societies. Within the framework of\nEast European realities even the rather abstract character of this notion found\nin young Marx, was well suited to the theoretical vagueness and the practical\nlimitations of this new-found leftist criticism of home-societies. What has the self to be like such that introspective awareness of it is possible? The paper asks if Descartes’s idea of an inner self can be upheld and discusses this issue by invoking two principles: the phenomenal transparency of experience and the semantic compositionality of conceptual content. It is assumed that self-awareness is a second-order state either in the domain of experience or in the domain of thought. In the former case self-awareness turns out empty if experience is transparent. (...) In the latter, it can best be conceived of as a form of mental quotation. Various proposed analyses of direct and indirect quotation are discussed and tested regarding their applicability to thought. It is concluded that, on the assumption of compositionality, the inner self is only insofar accessible to awareness as it has an accessible phonological structure, as apparently only inner speech does. Over the past decades, public trust in medical professionals has steadily declined. This decline of trust and its replacement by ever tighter regulations is increasingly frustrating physicians. However, most discussions of trust are either abstract philosophical discussions or social science investigations not easily accessible to clinicians. The authors, one a surgeon-turned-philosopher, the other an analytical philosopher working in medical ethics, joined their expertise to write a book which straddles the gap between the practical and theoretical. Using an approach grounded in (...) the methods of conceptual analysis found in analytical philosophy which also draws from approaches to medical diagnosis, the authors have conceived an internally coherent and comprehensive definition of trust to help elucidate the concept and explain its decline in the medical context. This book should appeal to all interested in the ongoing debate about the decline of trust - be it as medical professionals, medical ethicists, medical lawyers, or philosophers. (shrink)

This volume provides an overview of the most recent developments in empirical investigations of morality and assesses their impact and importance for ethical thinking. It involves contributions of scholars both from philosophy, theology and empirical sciences with firm standings in their own disciplines, but an inclination to step across borders-in particular the one between the world of facts and the world of norms. Human morality is complex, and probably even messy-and this clean distinction becomes blurred whenever one looks more closely (...) at the various components that enable and influence our moral actions and ethical orientations. In that way, morality may indeed be located between facts and norms-and an empirically informed ethics that is less concerned with analytical purity but immerses into this moral complexity may be an important step to make the contributions of ethics to this world more valuable and relevant. This is the second paper in a three-part series on the state of the enhancement debate. We report current trends and give an overview of established positions in the field of neuroenhancement. Unlike a number of articles on the bioethics of enhancement, we try to highlight connections between the contemporary debate and established positions in philosophical ethics. This specific perspective inspired the breakdown of our three-part series into consequentialist, deontological and virtue-ethical arguments.

The past decades’ substantial growth in globalized meat consumption continues to shape the international political economy of food and agriculture. This political economy of meat composes a site of contention; in Brazil, where livestock production is particularly thriving, large agri-food corporations are being challenged by alternative food networks. This article analyzes experiential and experimental accounts of such an actor—a collectivized pork cooperative tied to Brazil’s Landless Movement—which seeks to navigate the political economy of meat. The ethnographic case study documents these (...) livestock farmers’ ambiguity towards complying with the capitalist commodification process, required by the intensifying meat market. Moreover, undertaking an intersectional approach, the article theorizes how animal-into-food commodification in turn depends on the speciesist logic, a normative human/non-human divide that endorses the meat commodity. Hence the article demonstrates how alternative food networks at once navigate confines of capitalist commodification and the speciesist logic that impels the political economy of meat. (shrink)

We propose a multi-step evaluation schema designed to help procurement agencies and others to examine the ethical dimensions of autonomous systems to be applied in the security sector, including autonomous weapons systems.

It is widely believed that at least two developments in the last third of the 20th century have given dispositionalism—the view that powers, capacities, potencies, etc. are irreducible real properties—new credibility: (i) the many counterexamples launched against reductive analyses of dispositional predicates in terms of counterfactual conditionals and (ii) a new anti-Humean faith in necessary connections in nature which, it is said, owes a lot to Kripke’s arguments surrounding metaphysical necessity. I aim to show in this paper that necessity is, (...) in fact, of little help for the dispositionalists. My argument makes use of one of the above mentioned counterexamples against Humean reduction: antidotes. Turning the tables, I ask how the dispositionalists themselves can deal with antidotes. The result will be to show that if the dispositionalists are to demystify antidote cases, they must make plausible a conceptualisation of dispositions that does not invoke any kind of necessity. I will cautiously suggest that the anti-Humean link dispositions bring to the world has to be thought of in terms of (Newtonian) forces. (shrink)

Moral progress may be a matter of time scale. If intuitive measures of moral progress like the degree of physical violence within a society are taken as empirical markers, then most human societies have experienced moral progress in the last few centuries. However, if the development of the human species is taken as relevant time scale, there is evidence that humanity has experienced a global moral decline compared to a small-band hunter-gatherer baseline that represents a lifestyle presumed to largely account (...) for 99% of human history. A counter-argument to such a diagnosis of moral decline is the fact that the living conditions of the modern world that emerged since sedentariness and the beginning of agriculture are completely different compared to those of SBHG due to cultural and technological developments. We therefore suggest that two notions of moral progress should be distinguished: a “biological notion” referring to the inherited capacities typical of the evolutionary niche of mammals and that unfold in a specific way in the human species; and a “cultural notion” that relates moral progress to dealing with an increasing diversity of temptations and possible wrongdoings in a human social world whose complexity accumulates in time. In our contribution, we describe these two different notions of moral progress, we discuss how they interact, how this interaction impacts the standards by which we measure moral progress, and we provide suggestions and justifications for re-aligning biological and cultural moral progress. This article applies the tools of experimental philosophy to the ongoing debate about both the theoretical viability and the practical import of partially aggregative moral theories in distributive ethics. We conduct a series of three experiments (N=383): First, we document the widespread occurrence of the intuitions that motivate this position. Our study then moves beyond establishing the existence of partially aggregative intuitions in two dimensions: First, we extend experimental work in such a way as to ascertain which amongst existing versions (...) of partial aggregation (localised vs. global) chimes more fully with moral common sense. Specifically, we document how, in tie-breaking cases, ‘irrelevant goods’ judgments (Kamm) are just as robust as the original aggregative/non-aggregative pair of judgments that constitute partial aggregation. Second, by pairing laypeople’s moral judgments in standard cases with their intuitions about the limits of permissible self-prioritisation, we investigate whether one prominent explanation of why irrelevant claims may not be aggregated (Voorhoeve’s ‘personal prerogative’ argument) can be said to underpin people’s intuitions about the (ir)relevance relation of claims in conflict cases. We close with a discussion of our findings’ practical and theoretical import and highlight avenues for future research. (shrink)

Although we agree that a constructivist approach to emotional experience makes sense, we propose that implicit (visceromotor and somatomotor) emotional processes are dissociable from explicit (attention and reflection) emotional processes, and that the conscious experience of emotion requires an integration of the two. Assessments of implicit emotion and emotional awareness can be helpful in the neuroscientific investigation of emotion.

In a recent article we argued that organizational ecology is not a Darwinian research program. John Lemos criticized our argumentation on various counts. Here we reply to some of Lemos’s criticisms.

Few debates in political theory are challenged as much by the constant change of their empirical subject as those about democracy in the European Union. With A Republican Europe of States, Richard Bellamy responds to the EU’s post-Lisbon era, which has been characterized by the euro crisis, conflicts over migration, the rise of Euroscepticism and Brexit. Keeping an eye on these contextual conditions and the related legal and (...) political transformations, he has developed a general theory of international democracy aimed at securing non-domination between peoples and between citizens and their representatives at the international level, and elaborated its implications for the EU. The result is a distinctive version of demoi-cracy, whose firm centring on the nation-state as the natural locus of democracy is likely to be controversially discussed. In this article, I raise some critical considerations regarding the design of demoi-cratic institutions, the adequate understanding of EU citizenship and the normative credentials of differentiated integration.
