Phenomenology has long been one of the basic theoretical and methodological approaches in sports philosophy. Among the many varieties of philosophical phenomenology, phenomenological sports research mainly uses the approaches of Edmund Husserl, Martin Heidegger and Maurice Merleau-Ponty. Another phenomenological author who has so far remained almost completely unknown to international sports philosophy is German philosopher Hermann Schmitz (1928–2021). Schmitz named his phenomenological approach “New Phenomenology” since he had broken with some basic assumptions of ‘old’ phenomenology (e.g. neither (...) construing his phenomenology as a philosophy of consciousness nor conducting a view of the essence) and also discovered new areas of phenomena (e.g. felt body, atmospheres, expansive and directional space). Moreover, Schmitz considered his New Phenomenology to be an empirically oriented science. This article aims to introduce Schmitz’s approach into the international discussion on sports philosophy. In particular, it is shown how New Phenomenology is an enrichment for phenomenological sports research. To that end, the article outlines the basic idea and central components of New Phenomenology. The main focus rests on four concepts, whose analytical potential is illustrated using selected sports phenomena: felt-bodily experiences, (transhuman) felt-bodily communication, private and common atmospheres, as well as situations as an ontological concept and empirical phenomenon. This provides an outline of the program for a “New Phenomenology of sports”. This article examines the phenomenon of atmosphere in the aesthetics of the German philosopher Gernot Böhme. It explores the connection between his ideas and those of Hermann Schmitz’s “New Phenomenology” and Martin Heidegger’s ontology. The atmosphere is analyzed through Schmitz’s concepts: the space of human corporeality, and the categories of “contraction” (Enge) and “expansion” (Weite)). Key points of Schmitz’s phenomenology are identified: the absolute space of the felt body, its independence from geometric space; the description of (...) the body's dynamics through bodily impulses and vectors of “contraction” (Enge) and “expansion” (Weite)); the critique of the internal arrangement of feelings; the understanding of feelings and atmospheres as external “forces.” Böhme illustrates illustrated this concepts using the example of the sublime atmosphere in the temple space. Through light and shadow, silence and lines, the atmosphere of the sublime is created. It captivates, astonishes, and directs human corporeality towards spaciousness, providing a perception of the dynamics of human corporeality. Böhme’s description of the atmosphere includes the problem of the subject perceiving the atmosphere. The phenomenon of atmosphere is understood based on the concepts of mood and disposition of a person, derived from Martin Heidegger’s concept of Dasein. Mood is revealed in two ways: as the attunement, the tonality of a person’s own place, and as the tonality of the places in which they reside. It is concluded that perceiving the atmosphere means perceiving the mutual attunement between a person and the world. The final point is the analysis of the concept of ecstasies in Böhme’s aesthetics. The transition from Schmitz’s concept of semi-things to the problem of ecstasies is shown. Ecstasies in Böhme’s aesthetics describe a special space where various qualities of things spread. The radiance of light, the filling of the space with color, the play of light and shadow, the weight of sound—these qualities create an atmosphere. The mood of the place is created by the manifestation of these things, their “resonance,” giving a special aesthetic to the space. It is concluded that the perception of atmosphere includes: the perception of the place of the living body, affected by the mood of the place; the perception of one’s own relationship to the place, the world, and oneself; the perception of how the place reveals its own resonance and mood through the ecstatic properties of things and their ability to fill the entire space. Von dieser Sicht machten sich die Teilnehmer des im Mai 2006 am Historischen Kolleg veranstalteten Kolloquiums über den Koran frei. Die in diesem Band veröffentlichten Beiträge zeigen auf bisweilen überraschende Weise, dass der Koran als ein erstrangiges Zeugnis der vorderasiatischen Religionsgeschichte der Spätantike zu gelten hat. [Text is in German] Unsere Gegenwart scheint mehr und mehr Umbruechen zu unterliegen. Eine Innovation folgt der naechsten, Traditionen gelten schnell als ueberholt, moderne Trends werden altmodisch. Dieser permanente Wandel verlaeuft in unserer Wahrnehmung immer rasanter. Auch bei einem Blick in die Vergangenheit scheinen Umbrueche, neue Ideen und Erfindungen zu ueberwiegen und in staendigen Wertverschiebungen zu resultieren. Aber was ist mit den bestaendigen Dingen? Nicht nur Veraenderungen schaffen Werte, sondern auch Bestaendigkeit. Dabei stellt sich nicht nur die Frage, welche Werte (...) durch Kontinuitaet entstehen, sondern auch welche Werte sie bedingen. Traditionen sind identitaetsstiftend. Sie gehoeren zum kulturellen Gedaechtnis, bilden oftmals eine Basis fuer Innovationen und haben dadurch eine eigene Bedeutung im Hinblick auf Veraenderungen. Kontinuitaeten zu erkennen, ist in einer Welt im stetigen Wandel ein schwieriges Unterfangen und auch im Rueckblick nicht unproblematisch, vor allem wenn die Akteure selbst nicht mehr zu sprechen sind. Aber ein Blick auf die materielle Kultur erlaubt Aufschluesse ueber Bestaendigkeit. Von Menschen gefertigte Objekte sind Traditionstraeger, sie beherbergen die Ideen und Wertvorstellungen ihrer Gestalter und bleiben ueber Zeit und Raum hinweg erhalten. The Limits of Change umfasst Beitraege aus Archaeologie, Philosophie und Ethnologie, die sich auf unterschiedliche Weise mit der Thematik der Kontinuitaet auseinandersetzen und den Sachverhalt kritisch beleuchten. The following text is the first ever translation into English of a writing by German phenomenologist Hermann Schmitz (*1928). In it, Schmitz outlines and defends a non-mentalistic view of emotions as phenomena in interpersonal space in conjunction with a theory of the felt body’s constitutive involvement in human experience. In the first part of the text, Schmitz gives an overview covering some central pieces of his theory as developed, for the most part, in his massive System of (...) Philosophy, published in German in a series of volumes between 1964 and 1980. Schmitz’s System is centred on the claim that the contemporary view of the human subject is the result of a consequential historical process: A reductionist and ‘introjectionist’ objectification of lived experience culminating in the ‘invention’ of the mind (or ‘soul’) as a private, inner realm of subjective experience and in a corresponding ‘grinding down’ of the world of lived experienced to a meagre, value-neutral ‘objective reality’. To counter this intellectualist trend, Schmitz puts to use his approach to phenomenology with the aim of regaining a sensibility for the nuanced realities of lived experience—hoping to make up for what was lost during the development of Western intellectual culture. Since both this text and the overall style of Schmitz’s philosophising are in several ways unusual for a contemporary readership, a brief introduction is provided by philosophers Jan Slaby and Rudolf Owen Müllan, the latter of whom translated Schmitz’s text into English. The introduction emphasises aspects of Schmitz’s philosophy that are likely to be of relevance to contemporary scholars of phenomenological philosophy and to its potential applications in science and society. In this paper I outline the PAIR account of joint attention as a perceptual-practical, affectively charged intentional relation. I argue that to explain joint attention we need to leave the received understanding of propositions and propositional attitudes and the picture of content connected to it behind and embrace the notions of subject mode and position mode content. I also explore the relation between joint attention and communication.

In this paper I want to introduce and defend what I call the "subject mode account" of collective intentionality. I propose to understand collectives from joint attention dyads over small informal groups of various types to organizations, institutions and political entities such as nation states, in terms of their self-awareness. On the subject mode account, the self-consciousness of such collectives is constitutive for their being. More precisely, their self-representation as subjects of joint theoretical and practical positions towards the world – (...) rather than as objects of such positions – makes them what they are. Members of such collectives represent each other as co-subjects of such positions and thus represent the world from the point of view of the collective. (shrink)

Frege argued for the force-content distinction not only by appealing to the logical and fictional contexts which are most closely associated with the “Frege point", but also based on the fact that an affirmative answer to a yes-no question constitutes an assertion. Supposedly this is only intelligible if the question contains a forceless thought or proposition which an affirmative answer then asserts. Against this I argue that this fact more readily supports the view that questions operate on assertions and other (...) forceful acts themselves. Force is neither added to propositions as on the traditional view, nor is it cancelled as has recently been proposed. Rather higher-level acts such as questioning, but also e.g. conditionalizing, embed and present assertoric or directive acts that are forceful and committal, while suspending commitment to them. The Frege point confounds different varieties of force and the question whether something is merely presented for consideration with the question what is so presented. Force is representational: through assertoric and directive force indicators subjects non-conceptually present positions of theoretical or practical knowledge, while interrogative acts indicate positions of wondering which strive for such knowledge. This paper discusses Raimo Tuomela's we-mode account in his recent book "Social Ontology: Collective Intentionality and Group Agents" and develops the idea that mode should be thought of as representational. I argue that in any posture – intentional state or speech act – we do not merely represent a state of affairs as what we believe, or intend etc. – as the received view of 'propositional attitudes' has it –, but our position relative to that state of affairs and thus (...) ourselves. That is, we represent the subject through what I call "subject mode" and its position through what I call "position mode". I argue that the key to understanding collective intentionality is to understand how we represent others as co-subjects of positions rather than as their objects. This is shown on various levels of collective intentionality. On the non-conceptual level of joint attention we experience others as co-subjects who we attend with rather than to and who we are at least also disposed to act jointly with. On the conceptual level of the we-mode we represent others as co-subjects of positions of knowledge, intention, belief and shared values. Organizations and thus group agents in Tuomela's sense I propose to understand in terms of what I call "role mode", that is, in terms of the positions individuals and groups take as occupants of certain roles, for example, as committee members, or as chancellor of Germany. I try to show how this account, while very much in the spirit of Tuomela's, can avoid his fictionalism about group agents and some other problems of his account, while steering between the Scylla of excessive individualism and the Charybdis of extreme collectivism. Raimo Tuomela’s most important contribution to the philosophy of collective intentionality was his development of the notion of the we-mode. In my chapter I extend the notion of we-mode to that of role-mode, the mode in which individual and collective subjects feel, think and act as occupants of roles within groups and institutional structures. I focus on how being in role-mode is manifest in the minds of subjects and on the following points. First, I argue that both we-mode and role-mode (...) are best thought of as further modifications of I-consciousness, respectively we-consciousness. Second, role-mode is further characterized by the fact that subjects will take positions as role occupants that they won’t take as mere individuals, or we-mode group members, or in other roles. Third, such divergences are only possible against a background of agreements between positions taken in different modes. Fourth, such divergences are also grounded in decision making procedures and the accessibility and admissibility of sources of evidence. Fifth, role-mode goes all the way down, that is, it is also manifest in how subjects feel, move and comport themselves when they occupy their roles. To put it into fashionable jargon, it is embodied and enacted. (shrink)

How can people function appropriately and respond normatively in social contexts even if they are not aware of rules governing these contexts? John Searle has rightly criticized a popular way out of this problem by simply asserting that they follow them unconsciously. His alternative explanation is based on his notion of a preintentional, nonrepresentational background. In this paper I criticize this explanation and the underlying account of the background and suggest an alternative explanation of the normativity of elementary social practices (...) and of the background itself. I propose to think of the background as being intentional, but nonconceptual, and of the basic normativity or proto-normativity as being instituted through common sensory-motor-emotional schemata established in the joint interactions of groups. The paper concludes with some reflections on what role this level of collective intentionality and the notion of the background can play in a layered account of the social mind and the ontology of the social world. In this paper I propose three steps to overcome the force-content dichotomy and dispel the Frege point. First, we should ascribe content to force indicators. Through basic assertoric and directive force indicators such as intonation, word order and mood, a subject presents its position of theoretical or practical knowledge of a state of affairs as a fact, as something that is the case, or as a goal, as something to do. Force indicators do not operate on truth- or satisfaction evaluable (...) entities as on the traditional view, but complete and unify them. Second, higher-level acts such as interrogative, logical and fictional acts create higher-level unities that may suspend commitment to the assertions and directions they operate on. But they do not cancel their force, but transfer the meaning of force indicators into the new unities they create. For example, in the context of asking a theoretical or practical question, the assertoric or directive force indicator now presents the kind of knowledge the subject is seeking. Third, the Frege point conflates different varieties of force. We neither need Frege’s assertion sign, nor Hare’s neustic, nor Hanks’s cancellation sign, but only ordinary force indicators and interrogative, logical and fictional markers. Propositions are not forceless contents to which a subject commits by forceful acts, but forceful acts put forward by higher-level acts which may suspend commitment to them. (shrink)

In this paper I criticize theory-biased and overly individualist approaches to understanding others and introduce the PAIR account of joint attention as a pragmatic, affectively charged intentional relation. I argue that this relation obtains in virtue of intentional contents in the minds of the co-attenders, and – against the received understanding of intentional states as propositional attitudes – that we should recognize what I call “subject mode” and “position mode” intentional content. Among the extensive literature on the first Critique, very few commentators offer a thorough analysis of Kant's conception of inner sense. This is quite surprising since the notion is central to Kant's theoretical philosophy, and it is very difficult to provide a consistent interpretation of this notion. In this paper, I first summarize Kant's claims about inner sense in the Transcendental Aesthetic and show why existing interpretations have been unable to dissolve the tensions arising from the conjunction of these claims. (...) Secondly, I present my own reconstruction of Kant's model of inner sense, relying essentially on Kantian considerations found in the B-version of the Transcendental Deduction. My main idea is that inner sense, for Kant, is a passive faculty that gets affected by the understanding performing its figurative synthesis on material given in outer sense. Clinical ethics support services are experiencing a phase of flourishing and of growing recognition. At the same time, however, the expectations regarding the acceptance and the integration of traditional CES services into clinical processes are not met. Ethics rounds as an additional instrument or as an alternative to traditional clinical ethics support strategies might have the potential to address both deficits. By implementing ethics rounds, we were able to better address the needs of the clinical sections and to develop a (...) more comprehensive account of ethics quality in our hospital, which covers the level of decisions and actions, and also the level of systems and processes and aspects of ethical leadership. This paper argues that to account for group speech acts, we should adopt a representationalist account of mode / force. Individual and collective subjects do not only represent what they e.g. assert or order. By asserting or ordering they also indicate their theoretical or practical positions towards what they assert or order. The ‘Frege point’ cannot establish the received dichotomy of force and propositional content. On the contrary, only the representationalist account allows a satisfactory response to it. It also allows (...) us to give a more satisfactory analysis of the speech act of inviting a joint commitment and to answer two important questions Bernhard Schmid has raised about group speech acts, namely whether there are 1st person plural forms of Moore’s paradox and of 1st person authority. After outlining why the notion of conscious control of action matters to us and after distinguishing different challenges to that notion, the contribution focuses on the challenge posed by the literature on unconscious goal pursuit. Based on a conceptual clarification of the notion of consciousness, I argue that the understanding of consciousness in that literature is too restricted. The hypothesis that the behaviors reported can be accounted for by nonconceptual forms of consciousness, such as emotions and motor experiences, rather than (...) by—conscious or unconscious—conceptual level intentions tends to be disregarded, even though it promises to be empirically fruitful. In this paper, I argue that basic forms of collective intentionality such as those involved in atttending, acting and feeling with others essentially involve experiencing and understanding others as co-subjects, that their content is nonconceptual, and that they represent co-subjects and their positions at a level that is prior to the mind-body differentiation.

The contribution deals with knowledge of what to do, and how, where, when and why to do it, as it is found in a multitude of plans, rules, procedures, maxims, and other instructions. It is argued that while this knowledge is conceptual and propositional, it is still irreducible to theoretical knowledge of what is the case and why it is the case. It is knowledge of goals, of ends and means, rather than of facts. It is knowledge-to that is irreducibly (...) practical in having world to mind direction of fit and the essential function of guiding as yet uncompleted action. While practical knowledge is fundamentally different from theoretical knowledge in terms of mind-world relations, the practical and theoretical domains are still parallel in terms of justificatory and inferential relations, they are like mirror images of one another. It is shown that if this view of practical knowledge is accepted, convincing Gettier cases for practical knowledge can be constructed. An extensive analysis of these cases demonstrates the usefulness of the notions of practical deduction, abduction, and induction. (shrink)

Bunnik and colleagues argued that financial barriers do not promote informed decision-making prior to prenatal screening and raise justice concerns. If public funding is provided, however, it would seem to be important to clarify its intentions and avoid any unwarranted appearance of a medical utility of the testing.

A perceptual realism that is naive in a good way must be naively realistic about world and mind. But contemporary self-described naive realists often have trouble acknowledging that both the good cases of successful perception and the bad cases of illusion and hallucination involve internal experiential states with intentional contents that present the world as being a certain way. They prefer to think about experience solely in relational terms because they worry that otherwise we won’t be able to escape from (...) radical skepticism. I argue that experiential relations to objects require that their subjects be in internal experiential states. But this does not mean that these states are our epistemological starting point which can be known independently of any knowledge of the external world. We do escape the epistemological predicament of radical skepticism because the good cases are primary over the bad ones. But this is not because the good cases alone provide reasons for belief, but because we do not need a reason to think we are in a good case, but do need a reason to think we are not, and such a reason must come from a good case. So bad cases can only be thought of as deviations from good cases. And we can only understand experiences as states with contents distinct from their objects and present in good and bad cases once we understand misrepresentation, that is, bad cases, and therefore only as we ascribe knowledge of the external world to ourselves. Das Gendiagnostikgesetz verbietet seit 2010 die pränatale Diagnostik spätmanifestierender Erkrankungen GenDG). In seiner Begründung bezog sich der Gesetzgeber in Analogie zu internationalen Empfehlungen für den pädiatrischen Bereich vor allem auf das Recht des heranwachsenden Kindes bzw. des späteren Erwachsenen auf Nichtwissen. Mit diesem gesetzlichen Verbot hat Deutschland einen viel diskutierten Sonderweg in der Regulierung genetischer Pränataldiagnostik eingeschlagen. Seither jedoch hat sich nicht nur die Perspektive auf prädiktive Testungen im Kindesalter verändert. In zunehmendem Maße generieren auf das gesamte Genom abzielende Diagnostikangebote (...) auch andere vorgeburtlich genetische Informationen, die – in ähnlicher Weise wie diejenigen zu spätmanifestierenden Erkrankungen eine potenzielle Gefahr für das Recht auf Nichtwissen der späteren Person darstellen. Es soll daher im Rahmen dieses Beitrages überprüft werden, inwiefern das deutsche Diagnostikverbot und dessen Bezug auf das Recht auf Nichtwissen des späteren Kindes eine tragfähige Basis zur Regulierung gendiagnostischer Untersuchungen in der Pränatalmedizin insgesamt darstellt bzw. zukünftig darstellen kann.Untersucht wird der Argumentationsgang des Diagnostikverbotes im Hinblick auf spätmanifestierende Erkrankungen vor dem Hintergrund der Entwicklungen in der prädiktiven Diagnostik. Eine Analyse des normativen Begründungsrahmens zeigt, dass nach wie vor deutlicher Klärungsbedarf hinsichtlich der philosophisch-ethischen Fundierung wie auch hinsichtlich der Interpretation eines Rechts auf Nichtwissen eines Kindes im Kontext von genetischer Diagnostik besteht. Darüber hinaus müssen auch Interessen des Kindes an eventuell möglich werdender pränataler Behandlung oder Prävention von Erkrankungen in die Abwägung miteinbezogen werden.Um zukünftigen Herausforderungen genomischer Pränataldiagnostik und -therapie begegnen zu können, müsste dringend geklärt werden, inwiefern Rechte zukünftiger Personen tatsächlich in der speziellen Situation der Schwangerschaft relevant sein können und mit welchen Pflichten diese für den Gesetzgeber, aber insbesondere auch für zukünftige Eltern und Ärzte einhergehen. How can the law be characterized in a theory of collective intentionality that treats collective intentionality as essentially layered and tries to understand these layers in terms of the structure and the format of the representations involved? And can such a theory of collective intentionality open up new perspectives on the law and shed new light on traditional questions of legal philosophy? As a philosopher of collective intentionality who is new to legal philosophy, I want to begin exploring these questions (...) in this paper. I will try to characterize the law in terms of the layered account of collective intentionality that I have introduced in some earlier writings (Schmitz 2013; 2018). In the light of this account I will then discuss a traditional question in the philosophy of law: the relation between law and morality. I begin by giving a brief sketch of the layered account in the next section. Collective intentionality should be understood in terms of experiencing and representing others as co-subjects, rather than as objects, of intentional states and acts on different layers or levels. I distinguish the nonconceptual layer of the joint sensory-motor-emotional intentionality of joint attention and joint bodily action, the conceptual level of shared we-mode beliefs, intentions, obligations, values, and so on, and the institutional level characterized through role differentiation, positions taken in role-mode, e.g. as a judge or attorney, and writing and other forms of documentation. In the third section I introduce a set of parameters for representations such as their degree of richness, of context-dependence, of density and differentiation of representational role and of durability and stability, which can be used to more precisely distinguish different layers. I also put forward the hypothesis that these properties are connected and tend to cluster, and that higher levels can only function and determine conditions of satisfaction against lower level ones. In the fourth and final section I critically discuss the sharp positivistic separation of morality and the law according to which whether something is a law is completely independent of its moral merits. I argue that this only seems plausible if we take an observational stance towards the law, but not towards morality. When we treat them the same way, it rather appears that the moral attitudes of the co-subjects of a society will determine whether and to what extent they will accept its legal order. I conclude by proposing to think of the law as being itself an institutionalized form of morality. (shrink)

Accordingly, physicians tend to perceive the fetus as a patient and understand themselves as having certain professional duties towards it. However, it is far from clear what it means to speak of a patient in this connection. This volume explores the usefulness and limitations of the concept of ¿fetal patient¿ against the background of the recent seminal developments in prenatal or (...) fetal medicine. It does so from an interdisciplinary and international perspective. SchmitzWhen Tzvetan Todorov edited a special issue of the journal Communications on vraisemblance (verisimilitude) in 1968, he described the origin of the concept as follows (I paraphrase):One day during the fifth century B.C., there was a trial in some Sicilian city. Neither the plaintiff nor the defendant could produce witnesses or any other form of evidence to corroborate their version of the events, (...) so they had to convince the judges by the sheer power of their arguments. This was the day the principle of vraisemblance was discovered.Todorov's tongue-in-cheek explanation refers to a concept which in Greek was called. The word combines two aspects that modern logic differentiates: the "objective" meaning of probability (what is probable by the laws of nature) and the "subjective" meaning of plausibility (what the addressee of a message considers plausible). Aristotle's use of the word shows that the Greek concept does not draw a sharp distinction between these two elements.1 Their intricate connection becomes evident in, e.g., his Rhetoric (2.25 1402b14-16) where he defines enthymemes. For they are likely to trust these statements most.Anaximenes thus defines as an attentiveness to the public's assumptions rather than an objective quality inherent in certain facts. In the absence of pre‐established communicative conventions, people create novel communication systems to successfully coordinate their actions toward a joint goal. In this study, we address two types of such novel communication systems: sensorimotor communication, where the kinematics of instrumental actions are systematically modulated, versus symbolic communication. We ask which of the two systems co‐actors preferentially create when aiming to communicate about hidden object properties such as weight. The results of three experiments consistently show that actors who knew the weight (...) of an object transmitted this weight information to their uninformed co‐actors by systematically modulating their instrumental actions, grasping objects of particular weights at particular heights. This preference for sensorimotor communication was reduced in a fourth experiment where co‐actors could communicate with weight‐related symbols. Our findings demonstrate that the use of sensorimotor communication extends beyond the communication of spatial locations to non‐spatial, hidden object properties. (shrink)
