The purpose of this study was to explore how Chinese Football Super League (CSL) referees’ physical performance and decision-making distance varied according to match type and match halves. Data from 107 matches played by top-4 ranked and bottom-4 ranked teams during 2018–2019 CSL seasons were collected. Level of matches was classified into three groups: (a) upper-ranked (top-4) teams against top-4 teams, (b) top-4 teams against lower-ranked teams (bottom-4), and (c) bottom-4 teams against bottom-4 teams. Two-way ANOVA and Scheirer-Ray-Hare (...) test were used to examine the statistical differences of referees’ physical and spatial related distance variables among different match levels and halves. The Euclidean distance to the ball at the following three variables were statistically different among three match types: clearance (p= 0.03,ER2= 0.03), running with the ball (p= 0.01,ER2= 0.04), and shot off target (p= 0.04,ER2= 0.03). In addition, referees’ distance to the ball at three events were statistically different between both match halves: pass (p< 0.001,r= 0.69), reception (p< 0.001,r= 0.76), and running with the ball (p< 0.001,r= 0.77). The total running distance was statistically different between both match halves (p= 0.001,d= 0.05). The findings indicated that although CSL referees showed little difference in physical performance when officiating matches of three competitive levels and two halves, distinct rhythms of competitions determined that they needed to adjust running strategies to maintain proper distance to the ball. This study implied that the CSL referees’ match performance was affected by the teams’ style of play and match status. (shrink)

As vaccines against COVID-19 are scarce, many countries have developed vaccination prioritisation strategies focusing on ethical and epidemiological considerations. However, public acceptance of such strategies should be monitored to ensure successful implementation. In an experiment withN=1379 German participants, we investigated whether the public’s vaccination allocation preferences matched the prioritisation strategy approved by the German government. Results revealed different allocations. While the government had top-prioritised vulnerable people (being of high age or accommodated in nursing homes for the elderly), participants preferred exclusive (...) allocation of the first available vaccines to medical staff and personnel caring for the elderly. Interestingly, allocation preferences did not change when participants were told how many individuals were included in each group. As differences between allocation policies and public preferences can affect trust in the government and threaten the social contract between generations, we discuss possible strategies to align vaccination prioritisations. This paper draws an earlier book (with Evans and Higgins) entitled _Bad Call: Technology’s Attack on Referees and Umpires and How to Fix It_ (hereafter _Bad Call_) and its various precursor papers. These show why it is that current match officiating aids are unable to provide the kind of accuracy that is often claimed for them and that sports aficianados have been led to expect from them. Accuracy is improving all the time but the notion of perfect accuracy is (...) a myth because, for example, lines drawn on sports fields and the edges of balls are not perfectly defined. The devices meant to report the exact position of a ball—for instance ‘in’ or ‘out’ at tennis—work with the mathematically perfect world of virtual reality, not the actuality of an imperfect physical world. Even if ball-trackers could overcome the sort of inaccuracies related to fast ball speeds and slow camera frame-rates the goal of complete accuracy will always be beyond reach. Here it is suggested that the purpose of technological aids to umpires and referees be looked at in a new way that takes the viewers into account. (shrink)

The ability to recover from official match-play across a single and multiple matches is often considered a key factor in subsequent performance for modern professional basketball. The aims of this study were to: explore the differences in match performances between different match congestion cycles ; and identify the key performance indicators discriminating between winning and losing during different match congestion cycles. The current study indicated that scoring close to or very far away was significantly greater for (...) winning matches separated by 1- and 2-days of rest compared to consecutive matches. Additionally, shooting efficiency, and attaining Defensive Rebounds and Steals, were significant offensive and defensive KPIs that differentiated winning and losing teams. Similarly, opponent quality and match pace were important situational variables that affected match outcome during different match congestion cycles. While match location had an impact on winning following 1- and 2-days of rest, it had no impact for back-to-back matches. The current results will support coaches' offensive, defensive and recovery strategies during various match congestion cycles for a greater probability of winning NBA matches. (shrink)

This study explores the relationship between the scoring structure and the win or loss of a badminton match, while providing quantitative analytic data using binary entropy to determine the uncertainty of said win or loss. Scoring structure data were collected from the official match records of the top 16 events of the World Badminton Championships from 2006 to 2020 as collection objects and were analyzed by means of notational analysis. Our entropy analysis showed that the main factor affecting (...) the certainty of win or loss in men’s singles, men’s doubles and mixed doubles comes from the number of leading points, and in women’s singles and women’s doubles from whether the current point is closer to the match point. Our binary-entropy analysis based on scoring structure showed that, to maintain high uncertainty so that players stay competitive, the scoring points of two sides should differ in less than 5; in addition, the decisive factors for victory strongly depend on gender, also justifying research results of previous studies. The aims of this study were to analyze the peak physical demands in elite futsal by quantifying the most demanding scenarios of match play and to identify the differences between playing positions and the seasonal trend for five different rolling average time windows. The most demanding scenarios of external load from distance, speed, acceleration, and deceleration variables were obtained from 14 elite futsal players using a local positioning system during 15 official matches in the premier Spanish Futsal League. The (...) results showed an extremely large effect of the time window for all dependent variables in all positional groups. Another important finding of this study was that, in regard to the seasonal trend, only defenders reported clear moderate-large positive trends for high-speed running efforts, high-acceleration efforts, and high-deceleration efforts. Finally, moderate-large individual differences in player means for all dependent variables and clear differences between games for most dependent variables were found, suggesting how likely contextual factors may exert an influence on how “demanding” the most demanding scenarios are. The findings of this study provide coaches and strength and conditioning coaches further knowledge of the peak physical demands in elite futsal competition. This valuable information may lead to a more precise position-specific training prescription. (shrink)

In this paper I look at the reasons for implementing VAR and the effect that it has had on the fans of soccer (football) in particular. I begin with a discussion of why VAR has been adopted in sports in general and in soccer specifically. I then discuss the notion of ‘flow sports’ and try to develop at taxonomy for classifying sports in terms of the relative importance of flow. Following this, I discuss the effect of VAR implementation on flow (...) sports in general before examining the effect of VAR on the fan experience in soccer, a game which I characterize as one of the purist examples of team flow sports. Finally, I discuss the effect of VAR on the fan experience of flow when watching sports. My main contention is that VAR, at least in its current forms, represents an erosion of the flow experience in matches which impoverishes the fan experience. In light of the perceived benefits of VAR for match officiating, I doubt that it will be going away anytime soon. The best that we can hope for is that it evolves so as to cause minimal disruption to the flow in flow sports. (shrink)

The role of the ‘enforcer’ in elite-level sports contests is a familiar one. Simply, the role involves establishing or restoring a ‘moral balance’ to the sporting encounter when it is absent – usually when match officials are thought to be failing to apply the laws/rules of the game. How the enforcer secures this outcome is more morally contentious as it may involve deliberate violations of the laws/rules of the sport. In this paper we consider the role of the (...) enforcer in rugby union. First we interrogate some of the extant sports ethics literature and explore the notion of ‘fairness’ in the well-played game, including the role of the enforcer. Second, we illustrate conceptually how the ethos of elite sport as a moral discourse creates a theoretical platform from which to assess the intervention of an enforcer. Third, we address the role of match officials as members of the practice community from an institutional sense (what the international governing body for rugby union makes explicit) and from an empirical sense (what actually occurs or might occur) in the circumstances that precipitate the intervention of ‘enforcers’. We conclude that the conceptual tension between the laws and the spirit (ethos) of the game is reflected in the choices facing players when playing the game. (shrink)

Law enforcement officials often turn to DNA identification methods to detect—and rule out—possible offenders. Every state operates its own database of convicted offenders' DNA profiles; some states store profiles of arrested people, too. The Federal Bureau of Investigation maintains a national database of profiles submitted by laboratories across the country.A few years ago, officials came up with a new way to use DNA profiles in forensic identification. Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses to let (...) them speak in our name, and challenges the derogatory messages expressed through a mechanism I call derogatory pedestalling: the glorification or honoring of certain individuals or ideologies that can only make sense when members of a targeted group are taken to be inferior. It was said that you could find a Jesuit behind most of the scientific accomplishments of the seventeenth or eighteenth centuries. The idea was not far from the truth because Athanasius Kircher of Rudjer Josip Bošković proved to be among the best. But Jesuit studies seem to have passed their peak and it is (...) time to research the early modern science successes of other religious orders. The Parisian Franciscan Marin Mersenne with his worldwide correspondence was the German-Roman Jesuit Kircher’s match and several other Franciscans were not less important. Therefore it is time to give the Franciscan scientists of the past centuries the fame they deserve.We celebrated the 800th anniversary of the Franciscan order in the year 2009. The Franciscans of Ljubljana were mentioned for the first time in 1242 as already established and resident in Ljubljana, soon after the establishment of Franciscan order. Later they were unable to survive the protestant challenge in 1569,1 when almost all citizens of Ljubljana accepted Luther’s Christianity. Although they never really left Ljubljana, the Franciscans officially returned to Ljubljana after several decades.Between the years 1646 and 1660 the Augustinian church of Annunciation of Our Lady was erected on behalf of the Baron Konrad Ruessenstein from the Upper Carniola castle Strmol. The front walls were finished in 1700, and half of a century later the famous Italian sculptor Francesco Robba made the main altar. The Emperor Josef II suppressed the Ljubljana Augustinians in 1784 and somewhat later gave their friary and church to their Franciscan neighbors from the opposite side of Ljubljanica River. The Barons Ruessensteins were not offended by the change and still took care for the church. The Baron Alexis Ruessenstein gave his important alchemical manuscripts to the new friary owners, the Franciscans.2After the death of the Emperor Josef II, Gabriel Gruber’s best student Jožef Marija Šemerl redesigned a former Franciscan Friary for a Lyceum. Gruber, who later became the General of the Jesuit Order, was among the best engineers in Habsburg Monarchy. Clinical ethics support services are developing in Europe. They will be most useful if they are designed to match the ethical concerns of clinicians. We conducted a cross-sectional mailed survey on random samples of general physicians in Norway, Switzerland, Italy, and the UK, to assess their access to different types of ethics support services, and to describe what makes them more likely to have used available ethics support. Respondents reported access to formal ethics support services such as clinical ethics (...) committees (23%), consultation in individual cases (17.6%), and individual ethicists (8.8%), but also to other kinds of less formal ethics support (23.6%). Access to formal ethics support services was associated with work in urban hospitals. Informal ethics resources were more evenly distributed. Although most respondents (81%) reported that they would find help useful in facing ethical difficulties, they reported having used the available services infrequently (14%). Physicians with greater confidence in their knowledge of ethics (P = 0.001), or who had had ethics courses in medical school (P = 0.006), were more likely to have used available services. Access to help in facing ethical difficulties among general physicians in the surveyed countries is provided by a mix of official ethics support services and other resources. Developing ethics support services may benefit from integration of informal services. Development of ethics education in medical school curricula could lead to improved physicians sensititity to ethical difficulties and greater use of ethics support services. Such support services may also need to be more proactive in making their help available. (shrink)

Many developing and transitional countries have grown faster than advanced countries in the past decade, resulting in a shift in the distribution of world income in their favor. China is now the second largest economy in the world, behind the United States and ahead of Japan. As the relative economic weight of China and several others has come to match or exceed that of the middle-ranking G7 economies, the world economy has shifted from “unipolar” toward “multipolar,” less dominated by (...) the G7. How is this change being translated into changes in authority and influence within multilateral organizations like the G20, the World Bank, and the International Monetary Fund? Alarm bells are ringing in G7 capitals about G7 loss of influence. According to a WikiLeaks cable from the senior U.S. official for the G20 process, from January 2010, “It is remarkable how closely coordinated the BASIC group of countries [Brazil, South Africa, India, China] have become in international fora, taking turns to impede US/eu initiatives and playing the US and EU off against each other.” This essay suggests that the shift in power is much smaller than the headlines or private alarm bells suggest. The United States remains the dominant state, and the G7 states together continue to exercise primacy, but now more fearfully and defensively. China is split between asserting itself as “the wave of the future” and defending itself as too poor to take on global responsibilities. The combination of G7 defensiveness and emerging states’ jealous guarding of sovereignty produces a spirit of Westphalian assertion in international fora, or “every state for itself.” On the assumption that the world economy is in a transitional period, the article suggests reforms in the G20 and the World Bank that would boost their role and legitimacy as multilateral organizations in a more multipolar world. Increasingly artists have become political activists. Their work has taken on the shape of a criminal investigator. Where does this turn toward forensics come from? How do we understand it as a aesthetic practice? The words investigative and aesthetics seem like an uneasy match. But this book claims that expanded aesthetic practices can powerfully reshape our approach to the question of truth. Shifts in technology and new ways of thinking together offer a means of searching for facts and understanding (...) them anew. This book proposes that the current period is defined by new forms of "aesthetic power" composed both by sensing, detection and prediction and the torrential proliferation of images and data. To evade and oppose this form of state-corporate domination we can learn to join the dots between traces within our interwoven digital, built and natural environments. Investigative aesthetics can also enable new collaborative forms of verification. Rather than rely on official expertise it calls for an open process that combines the perspectives of communities exposed to state or corporate violence with those of artists, activists and scientists. This new practice takes place equally in the field, the art studio as in the scientific laboratory, online and in the streets, as it strives towards the construction of a new "common sensing". Pessimism is a lyrical failure of philosophical thinking, each attempt at clear and coherent thought, sullen and submerged in the hidden joy of its own futility. The closest pessimism comes to philosophical argument is the droll and laconic “We’ll never make it,” or simply: “We’re doomed.” Every effort doomed to failure, every (...) project doomed to incompletion, every life doomed to be unlived, every thought doomed to be unthought. Pessimism is the lowest form of philosophy, frequently disparaged and dismissed, merely the symptom of a bad attitude. No one ever needs pessimism, in the way that one needs optimism to inspire one to great heights and to pick oneself up, in the way one needs constructive criticism, advice and feedback, inspirational books or a pat on the back. No one needs pessimism, though I like to imagine the idea of a pessimist activism. No one needs pessimism, and yet everyone—without exception—has, at some point in their lives, had to confront pessimism, if not as a philosophy then as a grievance—against one’s self or others, against one’s surroundings or one’s life, against the state of things or the world in general. There is little redemption for pessimism, and no consolation prize. Ultimately, pessimism is weary of everything and of itself. Pessimism is the philosophical form of disenchantment—disenchantment as chanting, a chant, a mantra, a solitary, monophonic voice rendered insignificant by the intimate immensity surrounding it. In pessimism, the first axiom is a long, low, funereal sigh. ~*~ We’re Still Doomed. No one has time for pessimism. After all, there are only so many hours in a day. Whatever our temperament, happy or sad, engaged or disengaged, we know pessimism when we hear it. The pessimist is usually understood as the complainer, forever pointing out what is wrong with the world without ever once offering a solution. But more often than not pessimists are the quietest of philosophers, submerging their own sighs within the lethargy of discontent. What little sound it makes is of interest to no one—“I’ve heard it all before,” “tell me something I don’t know,” sound and fury, signifying nothing. In raising problems without solutions, in posing questions without answers, in retreating to the hermetic, cavernous abode of complaint, pessimism is guilty of that most inexcusable of Occidental crimes—the crime of not pretending it’s for real. Pessimism fails to live up to the most basic tenet of philosophy—the “as if.” Think as if it will be helpful, act as if it will make a difference, speak as if there is something to say, live as if you are not, in fact, being lived by some murmuring non-entity both shadowy and muddied. Had it more self-assurance and better social skills, pessimism would turn its disenchantment into a religion, possibly calling itself The Great Refusal. But there is a negation in pessimism that refuses even such a Refusal, an awareness that, from the start, it has already failed, and that the culmination of all that is, is that all is for naught. Pessimism tries very hard to present itself in the low, sustained tones of a Requiem Mass, or the tectonic rumbling of Tibetan chant. But it frequently lets loose dissonant notes at once plaintive and pathetic. Often, its voice cracks, its weighty words abruptly reduced to mere shards of guttural sound. ~*~ Maybe It’s Not So Bad, After All. If we know pessimism when we hear it, this is because we’ve heard it all before—and we didn’t need to hear it in the first place. Life is hard enough. What you need is a change of attitude, a new outlook, a shift in perspective... a cup of coffee. If we have no ears for pessimism, this is because it is always reducible to something as reliably mutable as a voice. If pessimism is so frequently disparaged, it is because it brings everyone down, determined as it is to view each day as a bad day, if only by virtue of the fact that it is not yet a bad day. For pessimism the world is brimming with negative possibility, the collision of a bad mood with an impassive world. In fact, pessimism is the result of a confusion between the world and a statement about the world, a confusion that also prevents it from fully entering the hallowed halls of philosophy. If pessimism is so often dismissed, this is because it is often impossible to separate a “bad mood” from a philosophical proposition (and do not all philosophies stem from a bad mood?) The very term “pessimism” suggests a school of thought, a movement, even a community. But pessimism always has a membership of one—maybe two. Ideally, of course, it would have a membership of none, with only a scribbled, illegible note left behind by someone long forgotten. But this seems unrealistic, though one can always hope. ~*~ Anatomy of Pessimism. Though it may locate itself at the margins of philosophy, pessimism is as much subject to philosophical analysis as any other form of thought. Pessimism’s lyricism of failure gives it the structure of music. What time is to the music of sorrow, reason is to a philosophy of the worst. Pessimism’s two major keys are moral and metaphysical pessimism, its subjective and objective poles, an attitude towards the world and a claim about the world. For moral pessimism, it is better not to have been born at all; for metaphysical pessimism, this is the worst of all possible worlds. For moral pessimism the problem is the solipsism of human beings, the world made in our own image, a world-for-us. For metaphysical pessimism, the problem is the solipsism of the world, objected and projected as a world-in-itself. Both moral and metaphysical pessimism are compromised philosophically; moral pessimism by its failure to locate the human within a larger context, and metaphysical pessimism by its failure to recognize the complicity in the very claim of realism. This is how pessimism makes its music of the worst, a generalized misanthropy without the anthropos . Pessimism crystallizes around this futility—it is its amor fati , rendered as musical form. ~*~ Melancholy of Anatomy. There is a logic of pessimism that is fundamental to its suspicion of philosophical system. Pessimism involves a statement about a condition . In pessimism each statement boils down to an affirmation or a negation, just as any condition boils down to the best or the worst. With Schopenhauer, that arch-pessimist, the thinker for whom the philosopher and the curmudgeon perfectly overlap, we see a no-saying to the worst, a no-saying that secretly covets a yes-saying (through asceticism, mysticism, quietism), even if this hidden yes-saying is a horizon at the limits of comprehension. With Nietzsche comes the pronouncement of a Dionysian pessimism, a pessimism of strength or joy, a yes-saying to the worst, a yes-saying to this world as it is. And with Cioran yet another variation, futile yet lyrical, a no-saying to the worst, and a further no-saying to the possibility of any other world, in here or out there. With Cioran one approaches, but never reaches, an absolute no-saying, a studied abandonment of pessimism itself. The logic of pessimism moves through three refusals: a no-saying to the worst (refusal of the world-for-us, or Schopenhauer’s tears); a yes-saying to the worst (refusal of the world-in-itself, or Nietzsche’s laughter); and a no-saying to the for-us and the in-itself (a double refusal, or Cioran’s sleep). Crying, laughing, sleeping—what other responses are adequate to a life that is so indifferent? ~*~ Cosmic Pessimism. Both moral and metaphysical pessimism point to another kind, a pessimism that is neither subjective nor objective, neither for-us nor in-itself, and instead a pessimism of the world-without-us. We could call this a cosmic pessimism ... but this sounds too majestic, too full of wonder, too much the bitter aftertaste of the Great Beyond. Words falter. And so do ideas. And so we have a cosmic pessimism, a pessimism that is first and last a pessimism about cosmos , about the necessity and possibility of order. The contours of cosmic pessimism are a drastic scaling-up or scaling-down of the human point of view, the unhuman orientation of deep space and deep time, and all of this shadowed by an impasse, a primordial insignificance, the impossibility of ever adequately accounting for one’s relationship to thought—all that remains of pessimism is the desiderata of affects—agonistic, impassive, defiant, reclusive, filled with sorrow and flailing at that architectonic chess match called philosophy, a flailing that pessimism tries to raise to the level of an art form (though what usually results is slapstick). ~*~ Song of Futility. An ethics of futility pervades pessimism. Futility, however, is different from fatality, and different again from simple failure (though failure is never simple). Failure is a breakage within the heart of relations, a fissure between cause and effect, a fissure hastily covered over by trying and trying again. With failure, there is always plenty of blame to go around; it’s not my fault, it’s a technical difficulty, it’s a miscommunication. For the pessimist, failure is a question of “when,” not “if”—failure as a metaphysical principle. Everything withers and passes into an obscurity blacker than night, everything from the melodramatic decline of a person’s life to the banal flickering moments that constitute each day. Everything that is done undone, everything said or known destined for a kind of stellar oblivion. When scaled up in this way, failure becomes fatality. Fatality is the hermeticism of cause and effect. In fatality, everything you do, whatever you do, always leads to a certain end, and ultimately to the end—though that end, or the means to that end, remain shrouded in obscurity. Nothing you do makes a difference because everything you do makes a difference. Hence the effects of your actions are hidden from you, even as you deceive yourself into thinking that, at last, this time you will outwit the order of things. By having a goal, planning ahead, and thinking things through carefully, we attempt, in a daily Prometheanism, to turn fatality to our advantage, to gain a glimpse of an order that seems buried deeper and deeper in the fabric of the universe. But even fatality has its comforts. The chain of cause and effect may be hidden from us, but that’s just because disorder is the order we don’t yet see; it’s just complex, distributed, and requires advanced mathematics. Fatality still clings to the sufficiency of everything that exists... When fatality relinquishes even this idea, it becomes futility. Futility arises out of the grim suspicion that, behind the shroud of causality we drape over the world, there is only the indifference of what exists or doesn’t exist; whatever you do ultimately leads to no end, an irrevocable chasm between thought and world. Futility transforms the act of thinking into a zero-sum game. ~*~ Song of the Worst. At the center of pessimism lies the term pessimus , “the worst,” a term as relative as it is absolute. The worst is about as bad as it gets, “the worst” as “the best” in disguise, shrouded by the passage of time or the twists and turns of fortune. For the pessimist, “the worst” is the propensity for suffering that gradually occludes each living moment, until it eclipses it entirely, overlapping perfectly in death... which, for the pessimist, is no longer “the worst.” Pessimism is marked by an unwillingness to move beyond “the worst,” something only partially attributable to a lack in motivation. In pessimism “the worst” is the ground that gives way beneath every existent—things could be worse, and , things could be better. “The worst” invariably implies a value judgment, one made based on scant evidence and little experience; in this way, pessimism’s greatest nemesis is its moral orientation. Pessimism’s propositions have all the gravitas of a bad joke. Perhaps this is why the true optimists are the most severe pessimists—they are optimists that have run out of options. They are almost ecstatically inundated by the worst. Such an optimism is the only possible outcome of a prolonged period of suffering, physical or metaphysical, intellectual or spiritual. But does this not also describe all the trials and tribulations of each day—in short, of “life?” It seems that sooner or later we are all doomed to become optimists of this sort (the most depressing of thoughts...) ~*~ Song of Doom. Rather than serving as a cause for despair, gloom and doom are the forms of consolation for any pessimist philosophy. Neither quite affects nor quite concepts, gloom and doom transform pessimism into a mortification of philosophy. Doom is not just the sense that all things will turn out badly, but that all things inevitably come to an end, irrespective of whether or not they really do come to an end. What emerges from doom is a sense of the unhuman as an attractor, a horizon towards which the human is fatally drawn. Doom is humanity given over to unhumanity in an act of crystalline self-abnegation. Gloom is not simply the anxiety that precedes doom. Gloom is literally atmospheric, climate as much as impression, and if people are also gloomy, this is simply the by-product of an anodyne atmosphere that only incidentally involves human beings. Gloom is more climatological than psychological, the stuff of dim, hazy, overcast skies, of ruins and overgrown tombs, of a misty, lethargic fog that moves with the same languorousness as our own crouched and sullen listening to a disinterested world. In a sense, gloom is the counterpoint to doom—what futility is to the former, fatality is to the latter. Doom is marked by temporality—all things precariously drawn to their end—whereas gloom is the austerity of stillness, all things sad, static, and suspended, a meandering smoke hovering over cold lichen stones and damp fir trees. If doom is the terror of temporality and death, then gloom is the horror of a hovering stasis that is life. At times I like to imagine that this realization alone is the thread that connects the charnel ground Aghori and the graveyard poets. ~*~ Song of Spite. There is an intolerance in pessimism that knows no bounds. In pessimism spite begins by fixing on a particular object of spite—someone one hardly knows, or someone one knows too well; a spite for this person or a spite for all of humanity; a spectacular or a banal spite; a spite for a noisy neighbor, a yapping dog, a battalion of strollers, the meandering idiot walking in front of you on their smart phone, large loud celebrations, traumatic injustices anywhere in the world regurgitated as media blitz, spite for the self-absorbed and overly performative people talking way too loud at the table next to you, technical difficulties and troubleshooting, the reduction of everything to branding, spite of the refusal to admit one’s own errors, of self-help books, of people who know absolutely everything and make sure to tell you, of all people, all living beings, all things, the world, the spiteful planet, the inanity of existence... Spite is the motor of pessimism because it is so egalitarian, so expansive, it runs amok, stumbling across intuitions that can only half-heartedly be called philosophical. Spite lacks the confidence and the clarity of hatred, but it also lacks the almost cordial judgment of dislike. For the pessimist, the smallest detail can be an indication of a metaphysical futility so vast and funereal that it eclipses pessimism itself—a spite that pessimism carefully places beyond the horizon of intelligibility, like the experience of dusk, or like the phrase, “it is raining jewels and daggers.” ~*~ Song of Sleep. A paraphrase of Schopenhauer: what death is for the organism, sleep is for the individual. Pessimists sleep not because they are depressed, but because for them sleep is a form of ascetic practice. Sleep is the askesis of pessimism. If, while sleeping, we have a bad dream, we abruptly wake up, and suddenly the horrors of the night vanish. There is no reason to think that the same does not happen with the bad dream we call “life.” ~*~ Song of Sorrow. Nietzsche, commenting on pessimism, once castigated Schopenhauer for taking things too lightly. He writes: ...Schopenhauer, though a pessimist, really —played the flute. Every day, after dinner: one should read his biography on that. And incidentally: a pessimist, one who denies God and the world but comes to a stop before morality—who affirms morality and plays the flute... what? Is that really—a pessimist? We know that Schopenhauer did possess a collection of instruments, and we also know that Nietzsche himself composed music. There is no reason to think that either of them would ever banish music from the Republic of philosophy. But Nietzsche’s jibes at Schopenhauer are as much about music as they are about pessimism. For the pessimist who says no to everything and yet finds comfort in music, the no-saying of pessimism can only be a weak way of saying yes—the weightiest statement undercut by the flightiest of replies. The least that Schopenhauer could’ve done is to play the bass. I’m not a big fan of the flute, or, for that matter, wind instruments generally. But what Nietzsche forgets is the role that the flute has historically played in Greek tragedy. In tragedy, the flute ( aulos ) is not an instrument of levity and joy, but of solitude and sorrow. The Greek aulos not only expresses the grief of tragic loss, but it does so in a way that renders weeping and singing inseparable from each other. The classicist Nicole Loraux calls this the mourning voice . Set apart from the more official civic rituals of funerary mourning, the mourning voice of Greek tragedy constantly threatens to dissolve song into wailing, music into moaning, and the voice into a primordial, disarticulate anti-music. The mourning voice delineates all the forms of suffering—tears, weeping, sobbing, wailing, moaning, and the convulsions of thought reduced to an elemental unintelligibility. In the collapsed space between the voice that speaks and the voice that sings, pessimism discovers its mourning voice. Pessimism: the failure of sound and sense, the disarticulation of phone and logos . Have we rescued Schopenhauer from Nietzsche? Probably not. Perhaps Schopenhauer played the flute to remind himself of the real function of the mourning voice—sorrow, sighs, and moaning rendered indistinguishable from music, the crumbling of the human into the unhuman. Failure par excellence of pessimism. ~*~ Song of Nothing. In Buddhist thought, the First Noble Truth of existence is encapsulated in the Pali term dukkha , conventionally translated as “suffering,” “sorrow,” or “misery.” The Buddhist teachings are clear, however, that this is an objective claim, and not simply one point of view among others. Existence is suffering and sorrow—and yet this is not, the teachings tell us, a pessimistic attitude. It is likely that Schopenhauer, reading the Buddhist texts available to him, recognized some filiation with the concept of dukkha . But dukkha is a multi-faceted term. There is, certainly, dukkha in the usual sense of the suffering, strife, and loss associated with living a life. But this is, in turn, dependent on the finitude and temporality of dukkha , existence as determined by impermanence and imperfection. And this ultimately points to the way in which both suffering and finitude are grounded by the paradoxical groundlessness of dukkha as a metaphysical principle—the insubstantiality and the emptiness of all that is. Beyond what is worse to me, beyond a world ordered for the worst, there is the emptiness of dukkha as an impersonal suffering... the tears of the cosmos. In this context, it is easy to see how Schopenhauer’s pessimism attempts to compress all the aspects of dukkha into a nothingness at the core of existence, a Willlessness coursing through the Will. Though one thing for certain is that with Schopenhauer we do not find the “ever-smiling” countenance of Buddhism—or do we? The texts of the Pali Canon also contain lists of the different types of happiness—including the happiness of renunciation and the strange happiness of detachment. But Buddhism considers even the different types of happiness as part of dukkha , in this final sense of nothingness or emptiness. Perhaps Schopenhauer understood Buddhism better than he is usually given credit for. Thus the experiment of Schopenhauer’s philosophy—the point at which a Western pessimus and an Eastern dukkha overlap or exchange glances. Empty sorrow, a lyricism of indifference. The result is a strange, and ultimately untenable, nocturnal form of Buddhism. ~*~ Cioran once called music a “physics of tears.” If this is true, then perhaps metaphysics is its commentary. Or its apology. ~*~ Pessimism would be more mystical were it not for its defeatism. Mysticism is much too proactive for the pessimist, and pessimism too impassive even for the mystic. At the same time, there is something enviable about mysticism—despite its sufferings. There is a sense in which pessimists are really failed mystics. ~*~ You, the Night, and the Music. In a suggestive passage, Schopenhauer once noted that, “music is the melody to which the world is the text." Given Schopenhauer’s view on life—that life is suffering, that human life is absurd, that the nothingness before my birth is equal to the nothingness after my death—given all this, one wonders what kind of music Schopenhauer had in mind when he described music as the melody to which the world is text—was it opera, a Requiem Mass, a madrigal, or perhaps a drinking song? Or something like Eine kleine Nachtmusik , a little night music for the twilight of thought, a sullen nocturne for the night-side of logic, an era of sad wings sung by a solitary banshee. Perhaps the music Schopenhauer had in mind is music eliminated to non-music. A whisper would suffice. Perhaps a sigh of fatigue or resignation, perhaps a moan of despair or sorrow. Perhaps a sound just articulate enough that it could be heard to dissipate. ~*~ Teach me to laugh through tears. ~*~ Pessimism always falls short of being philosophical. My back aches, my knees hurt, I couldn’t sleep last night, I’m stressed-out, and I think I’m finally coming down with something. Pessimism abjures all pretenses towards system—towards the purity of analysis and the dignity of critique. We didn’t really think we could figure it out, did we? It was just passing time, taking a piss, something to do, a bold gesture put forth in all its fragility, according to rules that we have agreed to forget that we made up in the first place. Every thought marked by a shadowy incomprehension that precedes it, and a futility that undermines it. That pessimism speaks, in whatever voice, is the singing testimony to this futility and this incomprehension—take a chance and step outside, lose some sleep and say you tried... ~*~ Is there a music of pessimism? And would such a music be audible? ~*~ The impact of music on a person compels them to put their experience into words. When this fails, the result is a faltering of thought and language that is itself a kind of music. Cioran writes: “Music is everything. God himself is nothing more than an acoustic hallucination.” ~*~ If a thinker like Schopenhauer has any redeeming qualities, it is that he identified the great lie of Western culture—the preference for existence over non-existence. As he notes: “If we knocked on the graves and asked the dead whether they would like to rise again, they would shake their heads.” In Western cultures it is commonly accepted that one celebrates birth and mourns death. But there must be a mistake here. Wouldn’t it make more sense to mourn birth and celebrate death? Strange though, because the mourning of birth would, presumably, last the entirety of that person’s life, so that mourning and living would the be same thing. ~*~ To the musical idea of the harmony of the universe corresponds the philosophical principle of sufficient reason. Like the music of mourning, pessimism gives voice to the inevitable breakdown of word and song. In this way, music is the overtone of thought. ~*~ The Patron Saints of Pessimism. The patron saints of pessimism watch over suffering. Laconic and sullen, the patron saints of pessimism never seem to do a good job at protecting, interceding, or advocating for those who suffer. Perhaps they need us more than we need them. Lest we forget, there do exist patron saints of philosophy, but their stories are not happy ones. There is, for instance, the fourth century Saint Catherine of Alexandria, or Catherine of the Wheel, named after the torture device used on her. A precocious fourteen year old scholar, Catherine was subject to continual persecution. After all forms of torture failed—including the “breaking wheel”—the emperor finally settled for her decapitation, a violent yet appropriate reminder of the protector of philosophers. There are also patron saints of music and musicians, but theirs too are sad stories. In the second century, Saint Cecilia was also subject to persecution and torture. As she knelt to receive the blade that would separate her head from her body, she ardently sang a song to God. It took three attempts before she was fully decapitated, all the while she continued, perhaps miraculously, to sing. Does pessimism not deserve its own patron saints, even if they are unworthy of martyrdom? But in our search, even the most ardent nay-sayers frequently lapse into brief moments of enthusiasm—Pascal’s love of solitude, Leopardi’s love of poetry, Schopenhauer’s love of music, Nietzsche’s love of Schopenhauer, and so on. Should one then focus on individual works of pessimism? We could include Kierkegaard’s trilogy of horror— Sickness Unto Death , The Concept of Dread , and Fear and Trembling —but all these are undermined by their fabricated and unreliable authors. Besides, how can one separate the pessimist from the optimist in works like Unamuno’s The Tragic Sense of Life , Shestov’s Postetas Clavium , or Edgar Saltus’ under-read The Philosophy of Disenchantment ? Even in cases where the entire corpus of an author is pessimistic, the project always seems incomplete—witness Cioran’s trajectory, from his first book, On the Heights of Despair , to the last unpublished notebooks of acrid and taut aphorisms. And this is to say nothing of literary pessimism, from Goethe’s sorrowful Werther, to Dostoevsky’s underground man, to Pessoa’s disquiet scribbler; Baudelaire’s spleen and ennui, the mystical Satanism of Huysmans and Strindberg, the hauntologies of Mário de Sá-Carniero, Izumi Kyoka, H.P. Lovecraft, grumpy old Beckett... even the great pessimist comedians. All that remains are singular, perhaps anomalous statements of pessimism, a litany of quotes and citations crammed into fortune cookies. Patron saints are traditionally named after a locale, either a place of birth or of a mystical experience. Perhaps the better approach is to focus on the places where pessimists were forced to live out their pessimism—Schopenhauer facing an empty Berlin lecture hall, Nietzsche mute and convalescent at the home of his sister, Wittgenstein the relinquished professor and solitary gardener, Cioran grappling with Alzheimer’s in his tiny writing alcove in the Latin Quarter. ~*~ There’s a ghost that grows inside of me, damaged in the making, and there’s a hunt sprung from necessity, elliptical and drowned. Where the moving quiet of our insomnia offers up each thought, there’s a luminous field of grey inertia, and obsidian dreams burnt all the way down. ~*~ If pessimism has any pedagogical value, it is that the failure of pessimism as a philosophy is inextricably tied to the failure of pessimism as voice. I read the following, from Shestov’s The Apotheosis of Groundlessness : When a person is young he writes because it seems to him he has discovered a new almighty truth which he must make haste to impart to forlorn humankind. Later, becoming more modest, he begins to doubt his truths: and then he tries to convince himself. A few more years go by, and he knows he was mistaken all round, so there is no need to convince himself. Nevertheless he continues to write, because he is not fit for any other work, and to be accounted a superfluous person is so horrible. (shrink)

Recently, this process is highly required because of the large number of available documents on the internet and the ability to copy and paste the text of relevant documents with simply Control+C and Control+V commands. The proposed solution is to investigate and develop an easy, fast, and multi-language support plagiarism detector with the easy of one click to detect the document plagiarism. This process will be done with the (...) support of intelligent system that can learn, change and adapt to the input document and make a cross-fast search for the content on the local repository and the online repository and link the content of the file with the matching content everywhere found. Furthermore, the supported document type that we will use is word, text and in some cases, the pdf files –where is the text can be extracting from them- and this made possible by using the DLL file from Word application that Microsoft provided on OS. The using of DLL will let us to not constrain on how to get the text from files; and will help us to apply the file on our Delphi project and walk throw our methodology and read the file word by word to grantee the best working scenarios for the calculation. In the result, this process will help in the uprising the documents quality and enhance the writer experience related to his work and will save the copyrights for the official writer of the documents by providing a new alternative tool for plagiarism detection problem for easy and fast use to the concerned Institutions for free. As nation-states make greater efforts to regulate the flow of people on the move—refugees, economic migrants, and international travelers alike—advocates of DNA profiling technologies claim DNA testing provides a reliable and objective way of revealing a person’s true identity for immigration procedures. This article examines the use of DNA testing for family reunification in immigration cases in Finland, Germany, and the United States—the first transatlantic analysis of such cases—to explore the relationship between technology, the meaning of family, and immigration. Drawing (...) on our analyses of archival records, government documents, and interviews with immigration stakeholders, we argue that DNA testing is not conclusive about the meaning of family. While the technology may facilitate decision making for both would-be immigrants and state officials, our study shows hesitancy among the latter to let DNA testing make the final determination. We introduce the concept of social validity—whether the interpretation of test results matches social or political meanings in a given local context—in order to make sense of the complexities and challenges of DNA testing in practice. We show that DNA testing is not just a technology of belonging or a way to claim citizenship rights. It may also enable exclusion and denial of rights. (shrink)

This study explores both the negotiating styles and moral reasoning processes of business people and governmental officials in Taiwan, so as to provide a footing for outsiders when negotiating with Taiwanese over environmental concerns. Findings imply that Taiwanese business people and governmental officials can and will reason both at the conventional level and at the postconventional level of moral judgment. But, results of this study also indicate that Taiwanese negotiating styles do not necessarily match their levels of (...) moral reasoning. With respect to pollution concerns, Taiwanese seem unwillingly to accept responsibility as autonomous individuals. Instead, responsibility is accepted when mandated by the law. (shrink)

Abstract Aim: The COVID-19 infection is transmitted either by human-to-human contact, social-physical contact, and respiratory droplets or by touching items touched by the infected. This has triggered some conflicted behaviors such as stigma, violence, and opposite behavior applause. The aim of this study is to explore several newspaper articles about stigma, violence, or insensitive behavior against healthcare professionals and to analyze the reason for these behaviors during these COVID-19 pandemics. Method: The website of the Turkish Medical Association "Press Releases News" (...) and online newspaper articles have been scanned using keywords and have been classified and analyzed according to the content of articles between the periods of March 11 to April 28, 2020. This is a qualitative study with content analysis. No official ethical permission was obtained as the study was conducted through open access internet news sites. Result: 16 reports were selected from online reports that matched the keywords of the study. 13 of these reports included desensitization, violence, lack of precaution, stigmatization, and applause, and 3 reports included doctors’ statements. After being categorized, content analyses were conducted. Conclusion: This study revealed the necessity of a multi-faceted evaluation of the problems faced by healthcare professionals who are at the forefront of the COVID-19 outbreak. This study has a primary role in the detection, diagnosis, and treatment of the pandemic and reveals that doctors are trying to fulfill their duties in an ethical framework despite stigmatized behavior. Authorities should provide various supports to protect healthcare professionals before, during, and after the epidemic for the success of the COVID-19 outbreak struggle. (shrink)

Urban inclusive green growth (UIGG) refers to the synergetic enhancement of the economy, the environment, and the society in a city. Achieving such enhancement requires addressing a series of problems in the development of urbanization, such as unemployment, lack of access to education, insufficient medical resources, inequity, and environmental pollution. As firms are critical to city development and urbanization, whether they practice corporate social responsibility (CSR) plays a crucial part in UIGG. In this study, we focus on Chinese cities as (...) examples of UIGG and Chinese listed companies as CSR engagers, employing matched data on Chinese listed companies and cities to investigate how CSR affects UIGG. Specifically, the empirical results of a high-dimensional fixed effect model indicate that CSR significantly promotes UIGG. This finding remains valid after a set of robustness checks, including instrumental variable (IV) regression. CSR can promote UIGG by positively influencing enterprises’ economic performance, innovation, and employment. To promote firms’ substantive CSR actions, the government of Jiangsu Province, China, launched a pilot policy for CSR promotion by issuing an official guidance document, which can be considered a quasi-natural experiment to test the causality between CSR and UIGG. We find that the CSR pilot significantly promoted UIGG. The heterogeneity test results indicate that the influence of CSR on UIGG varies based on the audit company, the nature of the enterprise, and the structure of corporate leadership. (shrink)

Starting from the basic premises of Schank's notion of indexing in story telling and the representational approach of language, this paper investigates whether fairy tales create initial indexes for children, that may be re-indexed later in adult life, by reshaping their pre-existing experiences. More specifically, it focuses on the way fairy tales present several concepts already familiar to children, and whether this representation matches children’s pre-existing experiences. The data collected comes from several of Grimm Brothers' fairy tales and consists of (...) a corpus of 62839 word tokens. The fairy tales included were thematically related to general areas of everyday experience: femininity, blackness, whiteness, day, night, being young, ageing. The following semantically contradictory lexical pairs were examined in the expanded concordance, in relation to their collocations and semantic associations: old - young, woman - maiden, day - night, white - black. These were then compared with an adults’ and a children’s dictionary to check whether the collocations, semantic associations of the selected words as portrayed in the data, matched the societally accepted meanings found in dictionaries. The comparison indicated that, although the connotative meanings were included in the majority of denotative meanings that make up words' definitions in the adult dictionary examined, only five of them matched the connotative meanings of the words examined in the data. This essay introduces a tension between the public Wittgenstein’s optimism about knowledge of other minds and the private Wittgenstein’s pessimism about understanding others. There are three related reasons which render the tension unproblematic. First, the barriers he sought to destroy were metaphysical ones, whereas those he struggled to overcome were psychological. Second, Wittgenstein’s official view is chiefly about knowledge while the unofficial one is about understanding. Last, Wittgenstein’s official remarks on understanding themselves fall into two distinct categories that don’t (...) class='Hi'>match the focus of his unofficial ones. One is comprised of those remarks in the Investigations that challenge the thought that understanding is an inner mental process. The other consists primarily of those passages in PPF and On Certainty concerned with the difficulty of understanding others without immersing oneself into their form of life. In its unofficial counterpart, Wittgenstein focuses on individuals, rather than collectives. The official and the unofficial sets of remarks are united in assuming a distinction between understanding a person and understanding the meaning of their words. The freedom and right to associate carries distinct meanings in different systems of industrial relations, giving rise to distinct institutions. Where bargaining is based on grassroots association, rates of membership in trade unions and coverage of collective agreements are low. Where bargaining is actively endorsed by the state, high rates of membership are matched by considerable coverage. Over the last two decades, some countries, four of which are studied here, have gone through a process that I designate as hybridization, in (...) which a gap emerges between a rapidly declining rate of membership and persistent relatively high level of coverage. The Article accounts for the growing gap between coverage and membership and its implications. On the basis of extensive interviews with trade union officials, organizers, works councils’ members, Labor Chamber representatives, academics and journalists in the four countries, the Article further seeks to document and explain new organizing practices at two levels. First, why do unions seek to organize, despite persistent power accorded to collective agreements by the state? Second, which strategies are used for current recruitment and organizing practices? The discussion highlights the ongoing tension that is folded in the meeting of institutions that are aimed at sustaining the centralized system of bargaining and social partnership, with the dynamics that are characteristic of raising membership levels. Some best practices that seek to address this tension are identified, but are also characterized as difficult to emulate and extend as a general practice. (shrink)

I was on sabbatical in Germany that year. On return I learned from many people that I had missed a great opportunity for an authentic encounter with a living Buddhist thinker who understood Christianity very well. Fortunately, he visited Claremont again, although more briefly, and this time I was able to take advantage (...) of his visit.I was, and am, convinced that Whiteheadians have much to gain from the encounter with Buddhists. At one level we can grasp and assimilate the idea of dependent origination or pratitya samutpada quite easily. For Whitehead too the ultimate reality consists in the many becoming one. For Whitehead human experience is an example of this reality and, indeed, that example is the one he most fully analyzed.On the other hand, we Whiteheadians incline to objectify the whole process. More often than with Whitehead himself, we are describing a process that is going on objectively out there. Abe taught me the difference. He liked to distinguish the perspective of the swimmer battling against the current in dangerous waters and observers on the bank. To understand that all unit events are instances of dependent origination is one thing; to experience oneself in that way is quite another. And what is especially important is to recognize that experiencing oneself is not objectifying one’s past or imagining oneself in the eyes of an observer. It is embodying the absolutely immediate, ever-changing reality that is experience now.Whitehead never thought of his ontological analysis as having direct religious importance. For him, as part of the understanding that all things are perpetually perishing, it constituted the ultimate threat to the meaningfulness of life. The religious dimension came as a response to this threat.For Abe, of course, the full existential realization of what we are, is in itself salvific in the sense of healing. It puts an end to guilt, defensiveness, and attachment, and it makes us wholly acceptant of whatever is. It leads to, or perhaps is, enlightenment, expressing itself in wisdom and compassion. Given the history of Buddhism, one must accept the profound truth in this affirmation, although, given the history of Buddhism, one must also recognize that matters are never as simple as this formulation sounds.I have spoken personally of an example of what and how I learned from Abe. I am proud of the extent to which, especially because of Abe’s gifts as a teacher, my purpose was fulfilled.Appreciating the truth of Buddhism, and agreeing with Abe that Christian theology through the centuries has been distorted by clinging to substantialist modes of thought, I was particularly eager to engage him in a dialogue about the relation of Buddhism and Christian process theology, in particular a Christian process theology that recognized and appreciated the spiritual value of Buddhist enlightenment. Since Abe felt that Buddhists had something to learn from Christianity about social ethics, the suggestions of Christian theology, including its process form, for modifications or developments of Buddhism were not wholly lost on him. He supervised two dissertations by Buddhists on this topic, of which I was the official advisor, one by a Zen Buddhist (Chris Ives) and the other by a Pure Land Buddhist (John Ishihara, now Yokota). He criticized fellow Buddhists in our dialogue group for not being as open to learning from their Christian dialogue partners as these partners were open to Buddhist insights. In short he supported real dialogue, always ready to share his wisdom, and encouraging openness to further development of Buddhism.None of us is perfect, or, at least, none of us fulfills what someone else would see as perfection. We compared the punitiveness of two groups following a manipulation in which participants were either able to cheat on a simple number-matching task, by taking more money then they rightfully earned, or prevented from doing so on the same task. After completing the task, participants read a number of small vignettes of politicians who had acted questionably, and then were asked to rate the scenarios on both how wrong the behavior was and how much punishment it deserved. Participants given the (...) opportunity to cheat with impunity were significantly less punitive when judging questionable behavior on the part of elected officials. (shrink)

This study explores the role that news coverage plays in the allocation of Japanese development aid. Conceptually, it is expected that democratic foreign policy officials, including those working in bureaucratic governmental structures will try to match the magnitude of their actions with what they expect is the public's perception of the importance of the recipient. News media salience serves an easily accessible indicator of that domestic political importance and, in the case of foreign aid, this suggests that higher (...) levels of news coverage of a less-developed country will lead to higher aid commitments. The statistical analysis demonstrates that the level of news coverage is a statistically significant factor in Japanese aid distributions. More significantly, the analysis demonstrates that separating grant aid from other forms of aid is critical for the empirical examination of the determinants of Japanese aid. (shrink)

During his liftime he published 70 books, almost as many pamphlets and over 2,000 articles. The No- Conscription Fellowship: Pacifism and Revolution, 1916-18 is the fouteenth volume in an extensive collection of the writings of Bertrand Russel. This book begins when (...) Russel became the Acting Chairman of the No- Conscription Fellowship very soon after the establishment of the Lloyd George coalition which signaled official British resolve to defeat Germany decisively. This uncompromising determination was matched by the German decision in January of 1917 to initiate unrestricted submarine warfare. The No- Conscription Fellowship: Pacifism and Revolution, 1916-18 contains many short papers reflecting Russel's immediate responses todevelopments in the conflict as seen as from his position as the most important political commentator for the official publication of the NCF, The Tribunal. Today, using a sophisticated publicity, corporations aim to generate an image of respect to the environment in consumer’s minds. These images do not necessarily match with reality. It is called “Greenwashing” when a company amplifies selectively information with an environmental positive connotation aiming to produce a distorted image with a “green” bias. This article pretends to analyze these phenomena and to evaluate their existence, importance and influence on consumer’s decisions through the design of a methodology and piloting it with (...) a population of students. The results point out that the images transmitted by the publicity of five selected corporations contrasts with examples of poor management, and this manipulation affects the perception of the surveyed students. Students of environmental sciences present a slightly higher resistance against Greenwashing because of their formation, but the majority incorporates the official discourse based on corporate public relationship. Dogmen are individuals who fight their pit bulls in matches against other pit bulls. This paper uses neutralization theory to examine the rationalizations of dogmen as they attempt to counter stigma and criminal identity in a world that is becoming increasingly intolerant of dogfighting. To maintain their rationalizations, the dogmen use four recurring techniques : denial of injury; condemnation of the condemners; appeal to higher loyalties; and a defense that says dogmen are good people. The authors conducted interviews with 31 (...) individuals who fight and breed pit bulls and with significant others in the dogfighting enterprise, including Society for the Prevention of Cruelty to Animals officials, veterinarians, and local law enforcement officers. The research also examined newspaper accounts of dogfighting. This article provides some insights into the social construction of reality of individuals who engage in an activity that most of us find reprehensible. As with any criminal/deviant behavior, understanding and subsequent solving of the problem begin with knowledge of the offender's perspective. (shrink)

Introduction: The present study aimed to investigate the effects of two high-intensity interval training shuttle-run-based models, over ten weeks on aerobic, anaerobic, and neuromuscular parameters, and the association of the training load and heart rate variability with the change in the measures in young futsal players. Methods: Eleven young male futsal players participated in this study. This pre-post study design was performed during a typical 10 weeks training period. HIIT sessions were conducted at 86% and 100% of peak speed of (...) the FIET. Additionally, friendly and official matches, technical-tactical and strength-power training sessions were performed. Before and after the training period, all players performed the FIET, treadmill incremental, repeated sprint ability, sprint 15-m, and vertical jump tests, and the HRV was measured. Training load was monitored using the session rating of perceived effort. Data analysis was carried out using Bayesian inference methods. Results: The HIIT86 model showed clear improvements for the peak oxygen uptake, peak speed in the treadmill incremental test, first and second ventilatory thresholds, RSA best and mean times, CMJ, and SJ. The HIIT100 model presented distinct advances in VO2peak, peak speed in the treadmill incremental test, RSA mean time, and CMJ. Between HIIT models comparisons showed more favorable probabilities of improvement for HIIT86 than HIIT100 model in all parameters. TL data and HIIT models strongly explained the changes in the RSA mean and best times, as well as HRV changes, and HIIT models explained positively VO2peak changes. All other changes in the parameters were low to moderately explained. Conclusion: The HIIT86 proved to be more effective for improving aerobic, RSA, and neuromuscular parameters than HIIT100 during a typical 10-week futsal training period. So, strength and conditioning specialists prescribing shuttle-run intermittent exercises at submaximal intensities can manage the individual acceleration load imposed on athlete increasing or decreasing either the set duration or the frequency of change of direction during HIIT programming. Quality-of-life policing, responsive to the concerns of urban communities, presents a profound paradox. On the one hand, the collateral effects of drug use, especially in public and in racially fragmented, low-income communities, result in levels of crime and fear of crime that renders the communities almost uninhabitable; on the other, the collateral effects of policing drug crime, for these same communities, destroy the community's human fabric. A "new" generation of legal scholars have embraced and transformed the Broken Windows model of (...) policing urban communities. These theorists share a "social norms"perspective: they suggest that law's direct threat of imposing sanctions is not the sole means of constraining conduct. A variety of other devices, including non-legal, "social" norms, may supplement the law's coercive power. The social norms "take" on the Broken Windows argument is that public low-level crime undermines the social structures of local communities. Inner city blight sends a distinct message: that community members reject or ignore norms supporting law-abiding behavior in favor of norms supporting law-breaking. Accordingly, social norms theorists advocate empowering police and local communities through a variety of traditional and newly minted public order offenses (such as anti-loitering statutes and youth curfews) as means of attacking high crime in urban and predominantly minority neighborhoods. In this article, I take up the challenge of public order policing. My claim is that the sort of preventative policing social norms theorists advocate can and should be separated from reactive "investigative" policing directed at apprehending criminals. Separating preventative and investigative policing means that the police, as currently constituted, are the wrong people to engage in preventative policing. Instead, the appropriate people include municipal officials with no power to engage in investigation but who have the authority to enforce norms of public order. My proposal is to radically restructure the manner in which we think about the legitimacy of various policing practices and the type of authority the police wield. Our current focus on constitutional remedies for low-level police abuses has failed to ameliorate the justified resentment expressed by individuals and local communities subject to heightened amounts of increasingly invasive policing.The attempt to limit police authority through prospective constitutional (and other) norms that control their ability to search, seize, and interrogate suspects is properly confined to the police's investigative role. Limits do not work to constrain their ability to police public order and engage in crime prevention. Yet even at the investigative stage, the Court has already replaced the rule-based due-process model of authority with a series of role-based exceptions to the Fourth, Fifth, and Sixth Amendments' constitutional requirements. Both role- and rule-based concepts of authority concern the proper scope of legitimate authority. Rule-based authority has its basis in adherence to the content of particular rules; role-based authority is based in the powers afforded individuals in particular roles of public authority. Whereas rule-based authority derives its legitimacy primarily from the government's right to promulgate norms, role-based authority gains legitimacy from the degree to which the official's role is matched to the circumstances triggering authority. BACKGROUND: There is growing interest in the ethics of cluster trials, but no literature on the uncertainties in defining communities in relation to the scientific notion of the cluster in collaborative biomedical research. METHODS: The views of participants in a community-based cluster randomised trial (CRT) in Mumbai, India, were solicited regarding their understanding and views on community. We conducted two focus group discussions with local residents and 20 semi-structured interviews with different respondent groups. On average, ten participants took part in (...) each focus group, most of them women aged 18-55. We conducted semi-structured interviews with ten residents (nine women and one man) lasting approximately an hour each and seven individuals (five men and two women) identified by residents as local leaders or decision-makers. In addition, we interviewed two Municipal Corporators (locally elected government officials involved in urban planning and development) and one representative of a political party located in a slum community. RESULTS: Residents' sense of community largely matched the scientific notion of the cluster, defined by the investigators as a geographic area, but their perceived needs were not entirely met by the trial. CONCLUSION: We examined whether the possibility of a conceptual mismatch between 'clusters' and 'communities' is likely to have methodological implications for a study or to lead to potential social disharmony because of the research interventions, arguing that it is important to take social factors into account as well as statistical efficiency when choosing the size and type of clusters and designing a trial. One method of informing such a design would be to use existing forums for community engagement to explore individuals' primary sense of community or social group and, where possible, to fit clusters around them. The activities and consequences of workplace bullying and harassment have been widely explored in the literature but mainly studied within the scope of individuals or at the team level. Taking a holistic approach, we associate the concept of bullying with firm-level performance as well as stakeholders’ responses in the market. In this paper, we examine whether and how market investors react to the news of corporate harassment by top officials of publicly listed firms in Korea. Using a standard event (...) study methodology and multiple regression analysis with matched sample, we find significantly negative stock price reactions to news of corporate bullying. We also find that the impact is more salient if emotional bullying is involved and discuss both the theoretical and practical implications of these findings. (shrink)

The aim of the article is to point out the problem that started in the 2018 US Open final between Naomi Osaka and Serena Williams. During this final match, there was a conflict between the player S. Williams and the chair umpire C. Ramos, which involved a violation of rules related to coaching during the match. Subsequently, C. Ramos was banned from officiating the Williams sisters' matches at the next 2019 US Open. The authors of the article believe (...) that the tennis organizations USTA and WTA did not judge the dispute between chair umpire C. Ramos and S. Williams in accordance with their rules, as the rules allow for the sanctioning of a player who is coached during a match. While the written rules and their application during play must be taken into consideration, so must the subjective interpretation and application of the rules by a particular umpire. If our arguments are correct, C. Ramos's application of the rules during this game was in no way inconsistent with his past practice or the rules themselves. Thus, C. Ramos was a victim of the entire incident, which was also influenced by the gender narrative after the match. (shrink)

This paper takes an initial but significant step toward penetrating the intricate historiography of the renowned siyin half seal, which appears on 199 surviving or now-lost canonical Chinese paintings and calligraphies. Through a forensic tracking of the siyin art pieces, Ming dynasty court diaries, legal statutes, and other official seals ending in the words si and yin, I refute the dominant twentieth-century theory by arguing that this seal could not have originated from the eunuch-run Dianli jicha si in 1373–84, nor (...) could it have been used by the Ming general Xu Da on the Yuan palace collection as previously hypothesized. The alleged Dianli jicha si characters do not match the siyin seal strokes. New evidence suggests that the siyin seal came into existence after 1385, by which time the Directorate of Ceremonial had superseded the shuttered Dianli jicha si office. Instead of simply dividing the various siyin seal impressions into binary genuine/forged categories as past studies have done, I demonstrate that three types of siyin seals can be considered authentic, all of which were used by different branches of the jingli si. The fact that a half seal was employed suggests that the jingli si registry office followed the kanhe inventory system, which imposed an official seal on the seam of both an inventorying object and its complementary ledger. By deconstructing the siyin historiography, this paper raises new socio-political questions about ownership, censorship, and imperial competition over the siyin-marked art pieces. It also builds a foundation for the further investigation of the role inventory systems played in mapping, defining, and legitimizing the royal power of the Ming dynasty. (shrink)

There is a long tradition within medicine that new disorders are discovered within clinical practice. The original edition of the American Psychiatric Association’s (APA) diagnostic manual (DSM) was based in large part on clinical experience. The recent editions have been governed more heavily by more systematic (...) research (Widiger and Clark 2000), but many of the new additions are still said to come from clinical practice. As described for the development of DSM-III (APA 1980), “if there is general agreement among clinicians, who would be expected to encounter the condition, that there are a significant number of patients who have it and that its identification is important in their clinical work, it is included in the classification” (Spitzer, Sheehy, and Endicott 1977, 3).Clinicians can also be surveyed with regard to their opinions concerning a proposed revision. The ultimate consumers of a diagnostic manual are practicing clinicians and any effort to develop an official nomenclature should consider the opinions of the persons who must use the classification within their clinical practice (First et al. 2004; Sadler 2005). Clinicians can also be surveyed (or studied) with respect to how the diagnostic manual is being implemented. Much of this research has demonstrated that clinicians might be failing to apply the diagnostic manual in a reliable or valid manner (Garb 2005; Kutchins and Kirk 1997).It is perhaps obvious, however, that a diagnostic manual should not be governed primarily by clinical opinion or current clinical practice. The authors of DSM-III (APA 1980) and DSM-III-R (APA 1987) indicated that they would include a new diagnosis within the official nomenclature if a group of clinicians indicated that it was important to their clinical practice (Spitzer et al. 1977). This liberal threshold led to the decision of the DSM-III-R Task Force to include such diagnoses as paraphiliac rapism, self-defeating personality disorder, and sadistic personality disorder despite the lack of systematic research supporting their validity and the likelihood that these new diagnoses would have harmful social and forensic applications (Widiger 1995). These diagnoses no longer even appear within the appendix of DSM-IV-TR (APA 2000) for proposed diagnoses needing further study.The authors of DSM-III avoided opinion surveys because “no one wanted to repeat the scene of the general membership voting on a presumably ‘scientific’ issue, as was done in 1973 on the [End Page 277] issue of the elimination of homosexuality from the DSM-II classification” (Spitzer, Williams, and Skodol 1980, 152). Matters of construct validity should probably be addressed through systematic research rather than through opinion polls. “Qiuchi” 仇池 recurs as an enigmatic proper name in Su Shi’s 蘇 軾 later poetry. While scholars have treated Qiuchi primarily as the poet’s name for strange rocks, I argue that it is in the first place a metaphorical topos for him—it is a heterotopia, a counter-site to reality for this nonconformist. As a poetic image, Su Shi’s Qiuchi is a composite motif that allows for diverse interpretations. It is a hallucinatory dreamscape at the outset; the vision then turns out (...) to be Mount Qiuchi, a historical spot and Daoist “grotto heaven” near Su’s hometown in Sichuan so that Qiuchi becomes a macro-micro-equation of landscape; finally, the poet analogizes his Qiuchi to Tao Qian’s 陶潛 Peach Blossom Spring while denying its transcendency by bringing it down to earth. Qiuchi also inhabits various roles in Su Shi’s different life stages. It appears in matching poems among scholar-officials as the antithesis of bureaucratic service and an expression of longing for seclusion when the poet was in office. During his banishment, the inaccessible Qiuchi is the prototypical home topos and projected on other sites of exile as mirror images, which I call “heterotopia and its paratopia.” In this way, the Qiuchi trope contributes to Su Shi’s self-identity and public image, crystallized in the poet’s posthumous appellation. Confucius is finally rehabilitated. Party dignitaries kneel at his ancestral shrine. The benevolent Confucian is a new image of China for the outside, and for Chinese dealing with the collapse of ideology and the moral fabric of their society. The word tianxia is usually translated “all under Heaven.” It has a complicated history and a complicated contemporary appropriation in a desperate ideology-cum-PR campaign. The tianxia-idea is that China has for millennia been a government of all under heaven. It was such (...) a government in the past, is one today, and offers the whole world its benevolent alternative to liberalism and democracy. More than one contributor to this strong collection of interesting essays suspects that the Confucian revival is an act of desperation. As soft power, Confucianism may be no match for global capitalism. Soft power is not readily synthesized by official campaign. Its genuine source is in everyday life, and the life of ordinary Chinese is without much resonance beyond its borders. The whole world uses Chinese electronics, though almost none but the Chinese read their books, watch their television, or listen to their music. The world’s love affair with China is fixated on the economic numbers and is no less capricious. It has never been clear whether tianxia means a cultural realm without political boundaries, as is urged by modern ideologists, or is just another word for China, which is how modern Chinese dictionaries explain it. On the official account, membership in “all under Heaven” is a matter of shared culture, sustained by affective ties rather than coercion, but it is a culture that values order over freedom, ethics over law, and authority over democracy and human rights. Outsiders worry that tianxia is the cloak of a rising hegemon. However, the important audience for lofty talk of tianxia may be internal. Whether foreigners really trust it may be less urgent than for the Chinese to believe it about themselves. Postsocialist China has no unifying vision and has yet to honestly scrutinize official socialism. The new discourse of tianxia speaks to their need for a vision of their place in the world. The image of a tianxia government of benevolent authority may be more useful for identity within China than for offering the world a viable alternative to democracy and human rights. (shrink)

In recent years, political philosophers have hotly debated whether ordinary citizens have a general pro tanto moral obligation to follow the law. Contemporary philosophers have had less to say about the same question when applied to public officials. In this paper, I consider the latter question in the morally complex context of criminal justice. I argue that criminal justice officials have no general pro tanto moral obligation to adhere to the legal dictates and lawful rules of their offices. (...) My claim diverges not only from the commonsense view about such officials, but also from the positions standardly taken in legal theory and political science debates, which presume there is some general obligation that must arise from legal norms and be reconciled with political realities. I defend my claim by highlighting the conceptual gap between the rigid, generalised, codified rules that define a criminal justice office and the special moral responsibilities of the various moral roles that may underpin that office (such as guard, guardian, healer, educator, mediator, counsellor, advocate, and carer). After addressing four objections to my view, I consider specific contexts in which criminal justice officials are obligated not to adhere to the demands of their offices. Amongst other things, the arguments advanced in this paper raise questions about both the distribution of formal discretion in the criminal justice system and the normative validity of some of the offices that presently exist in criminal justice systems. This paper aims to measure the quality of all Romanian cities’ websites in 2019 and 2022, before and after the disruptive event of COVID-19. Since the official websites are the core instrument of e-governance, the changes in the quality of Romanian cities’ websites reflect the changes in the development of urban e-governance in Romania. The COVID-19 lockdowns and contact restrictions and the moving of most activities into the online environment had the potential to impact the performance of Romanian cities’ websites (...) significantly and catalyze the progress of local e-governance. The quality of Romanian cities’ official websites was measured using an adapted survey instrument proposed by Holzer and Kim and Manoharan, Melitski, and Holzer. The tool covers five critical criteria of website quality or performance: personal data security, usability, content, services, and citizen participation. The research results may seem contrary to expectations: the improvements of websites have been incremental rather than transformational. Although our research provides only a case study, we may assert that the reform of traditional administration remains a step-by-step process. Our study’s main contribution consists in showing that the progress of e-governance is an incremental process even in a situation of emergency that requires the moving of most activities into the online environment. The material offers valuable insights into policy thinking at the time, much of which has a surprising degree of relevance to pressing policy issues during our own time.
