In our contemporary world, the rights of nature have become an important legal device for environmental protection. Some of the most influential rights of nature frameworks can be found in non-Western contexts and have been strongly influenced by ecocentric accounts of nature. This article addresses the question of whether rights of nature can be implemented in Western contexts as well, focusing in particular on Europe. It first examines ecocentric justifications of the rights of nature and discusses two possible non-ecocentric alternatives. (...) In der Studie geht Matthias Neuber der Frage nach, in welchem Verhältnis das Konzept des Realismus und der logische Empirismus des Wiener Kreises, eine der dominanten Strömungen der deutschsprachigen theoretischen Philosophie des frühen 20. Jahrhunderts, zueinander stehen. Diese Fragestellung ist in der philosophiehistorischen Forschung bislang nur am Rande behandelt worden. Das ist umso erstaunlicher, als die neuere wissenschaftsphilosophische Realismusdebatte gerade durch den logischen Empirismus maßgeblich mitbestimmt worden ist. Der Autor geht aber noch einen Schritt weiter: Er begründet in dem (...) Band die These, dass es innerhalb des logischen Empirismus selbst Strömungen gab, die mit dem wissenschaftlichen Realismus kompatibel sind. Damit bezieht er eine Gegenposition zum Mainstream in der Deutung der wissenschaftsphilosophischen Realismusdebatte des 20. Jahrhunderts, denn der versteht den wissenschaftlichen Realismus als Gegenprogramm zum logischen Empirismus. Neuber liefert mit seiner philosophiehistorischen Studie nicht weniger als eine Neubewertung des Verhältnisses von Realismus und logischem Empirismus. Anosognosia for visual deficits—cases where significant visual deficits go unnoticed—challenges the view that our own conscious experiences are what we know best. We review these widespread and striking failures of awareness. Anosognosia can occur with total blindness, visual abnormalities induced by brain lesions, and eye diseases. We show that anosognosia for visual deficits is surprisingly widespread. Building on previous accounts, we introduce a framework showing how apparently disparate forms of anosognosia fit together. The central idea is that, to notice a (...) deficit, individuals need to form expectations about normal vision, compare expectations and visual input, and judge any mismatch at the metacognitive level. A failure in any of these three steps may lead to unawareness of visual deficits. (shrink)

A major part of philosophical work is engagement with argumentative texts. Engaging with an argumentative text involves correctly identifying the arguments presented in this text. In the context of teaching philosophy in school, the difficulty of correctly identifying arguments in philosophical texts is often underestimated. In this paper, I focus on one specific problem with argument identification that has been neglected in philosophy didactics thus far: the problem that there are many non-argumentative phenomena in an argumentative text that are easily (...) misidentified as expressing (part of) an argument. It is easy to fall for such phenomena if one is not aware of this problem, thereby misinterpreting the author’s intentions. The integration of ethics into the day-to-day work of research and innovation is an important but difficult challenge. However, with the Aachen method for identification, classification and risk analysis of innovation-based problems an approach from an engineering perspective is presented that enables the integration of ethical, legal and social implications into the day-to-day work of R&I practitioners. AMICAI appears in particular capable of providing a procedural guidance for R&I practitioners based on a method established in engineering science, breaking down the (...) object of consideration into partial aspects and prioritizing the innovation-based problems in dependence of potential risk. This enables the user to apply AMICAI continuously during all stages of the research and development process and to analyze and choose between certain sociotechnical alternatives. In this way, problems that affect ethical, legal, and social aspects can be understood, reflected and considered in the mostly technically focused R&D process. The paper gives a general guidance about AMICAI by describing principles and assumptions, providing the steps of analysis and application aids, giving an example application, explaining the necessary adjustments of AMICAI compared to the methodical basis of failure mode, effects, and criticality analysis and discussing the advantages and limits. AMICAI’s simple applications can stimulate interdisciplinary cooperation in the R&D process and be a starting point for the development of an “open RRI risk analysis platform” allowing society to evaluate innovation-based problems. In this article, I draw on the Mesoamerican institution of community offices (cargo) to support the view that political authority should be based on both political legitimacy and political expertise. I argue that the Mesoamerican tradition of cargos allows for a notion of political expertise that one acquires by rendering a service to one’s community. This expertise could be made a prerequisite for political representation without being vulnerable to several charges that have been levelled against epistocracy.

Die meisten Ethik- und Philosophie-Lehrpläne sehen vor, dass Schüler/innen die Grundlagen der Moralphilosophie kennen und verstehen. Im vorliegenden Beitrag nennen und erläutern wir einige Probleme, die der Erreichung dieses Ziels entgegenstehen. Eines dieser Probleme – die Vermischung unterschiedlicher Fragen – illustrieren wir an einer konkreten Lehreinheit. Anschließend skizzieren wir schädliche Folgen dieses Problems und deuten mögliche Wege zu seiner Beseitigung an.

Negative subjective reports such as “I didn’t see the stimulus” can be interpreted as indicating either that the subject didn’t see the stimulus, or as indicating that, while the subject did see the stimulus, the strength of sensory signals associated with the stimulus fell below a conservative criterion for answering “seen”. Determining which of these two interpretations is correct is the criterion problem. I present two ways in which researchers can solve this problem. But there’s more. What I call the (...) “new criterion problem” consists in determining whether criteria effects reflect perceptual changes, or changes in response strategy. Through case studies, I argue that this new version of the problem can be solved as well, although there is currently no systematic way to solve it. I conclude that criterion problems do not constitute good reasons for skepticism about the scientific study of consciousness. (shrink)

Drawing on corpora from West Africa and Iceland, the article presents a fieldwork-based comparative exploration of ‘things that place names do’. Treating toponyms as performative elements of culture, we have observed striking parallels as well as differences in the uses of place names in both regions. Place names communicate spatial orientation; play an important role in the commemoration of people and events; mark claims of possession; support the construction of identity; sacralize landscapes; and voice moral reprimands. They can provide entertainment, (...) by, for instance, inscribing ridicule into the land. They subvert as well as affirm hierarchies and power structures, and even play a role in interethnic conflict. Equally, they can become nuclei of storytelling, providing starting points for the invention of narratives. Showing the range of functions that place names can assume in two very different geographical contexts, the article presents a heuristic illustration of the potential of fieldwork-based approaches for toponomastic research. Like many other philosophical disciplines, ethics is sometimes highly abstract. And many key notions of the discipline are vague, ambiguous or both. Abstractness, vagueness, and ambiguity invite confusion. My objective in this paper is to draw attention to a serious problem that, despite being widespread, has so far remained largely unrecognized: the confusion of different questions in teaching ethics. This confusion occurs, for example, when a philosopher’s viewpoint is presented as an answer to one question, but in fact, the philosopher (...) is addressing a different question with that viewpoint. In the first part of this paper, I will present and clarify several ethical questions that are often confused, and point out damaging consequences that the confusion of such questions entails. In the second part, I will demonstrate the confusion of ethical questions by drawing attention to cases of confused teaching of Schopenhauer’s ethics. Finally, for those interested, I outline how Schopenhauer’s ethics could be taught without confusion. (shrink)

ArgumentIn this paper we comparatively explore three claims concerning the disciplinary character of economics by means of citation analysis. The three claims under study are: (1) economics exhibits strong forms of institutional stratification and, as a byproduct, a rather pronounced internal hierarchy; (2) economists strongly conform to institutional incentives; and (3) modern mainstream economics is a largely self-referential intellectual project mostly inaccessible to disciplinary or paradigmatic outsiders. The validity of these claims is assessed by means of an interdisciplinary comparison of (...) citation patterns aiming to identify peculiar characteristics of economic discourse. In doing so, we emphasize that citation data can always be interpreted in different ways, thereby focusing on the contrast between a “cognitive” and an “evaluative” approach towards citation data. We consider the problem of learning argumentation frameworks from a given set of labelings such that every input is a σ-labeling of these argumentation frameworks. Our new algorithm takes labelings and computes attack constraints for each argument that represent the restrictions on argumentation frameworks that are consistent with the input labelings. Having constraints on the level of arguments allows for a very effective parallelization of all computations. An important element of this approach is maintaining a representation of all argumentation frameworks (...) that satisfy the input labelings instead of simply finding any suitable argumentation framework. This is especially important, for example, if we receive additional labelings at a later time and want to refine our result without having to start all over again. The developed algorithm is compared to previous works and an evaluation of its performance has been conducted. (shrink)

We give an overview of the algebraic and model-theoretic aspects of this differential field and report on our efforts to understand its elementary theory.

The question as to whether and how their validity can be justified is - on the other hand - a bone of contention. Is this based on legal positivism alone? Or can human rights be understood as moral rights amenable to a kind of justification capable of convincing the skeptic? If so, can such arguments be derived from the tradition of natural law or be defended (...) by means of the laws of reason? Does this require anthropological or metaphysical assumptions - or do discourse-theoretical premises suffice? This volume, which specifically latches onto the traditions of legal positivism, natural and rational law, systematically juxtaposes these questions in a bid for reconciliation. Das Jahrbuch nimmt mit „Tod und Sterben“ ein zentrales Thema des anthropologischen Diskurses auf: Die Abkehr von religiösen Weltdeutungen und die zunehmende Individualisierung und Flexibilisierung vieler Lebensbereiche prägen nicht nur gesellschaftliche Einstellungen zum Tod und zum Sterben; auch die konkreten Praxen, wie heute gestorben und wie der Toten gedacht wird, haben sich gewandelt und zu einer Pluralisierung von Todesbildern geführt. Wo vormals tradierte Riten den Umgang mit Sterben und Tod strukturierten, stehen den Einzelnen gegenwärtig unterschiedlichste Formen der „Gestaltung“ des Sterbens, (...) der Bestattung und des Andenkens zur Wahl.
