The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

When is choice affected by subliminal messages? This question has fascinated scientists and lay people alike, but it is only recently that reliable empirical data began to emerge. In the current paper we bridge the literature on implicit motivation and that on subliminal persuasion. We suggest that motivation in general, and implicit motivation more specifically, plays an important role in subliminal persuasion: It sensitizes us to subliminal cues. To examine this hypothesis we developed a new paradigm that allows powerful tests (...) of subliminal influences as well as stringent assessments of subliminality. The results of two experiments suggest that implicit motivation can enhance the effects of subliminal priming on choice. (shrink)

The problems of diversity and pluralism have always been serious challenges to the stability of European societies. In the course of its history Europe elaborated various important ways of accommodation of differences, including toleration, respect and recognition. This article is devoted to discussion of the relations among them both in analytical and historical perspectives. I argue that toleration has always been based on a certain kind of respect and distinguish three main paradigms of the relations among these concepts. Then I (...) proceed to a discussion of the particular forms these paradigms took in European intellectual history and to an analysis of their applicability to the most important problems of contemporary society. I argue that pluralism and the complexity of contemporary society require pluralism in the modes of justifying toleration. (shrink)

The notions of perceptual normativity and optimality have generated much discussion in the last decade or so in the literature on Merleau-Ponty. Husserl’s position on the topic has been far less extensively investigated. Surprisingly, however, Husserl wrote a great deal about the question of perceptual optimality. Not only are there a considerable number of important passages scattered throughout the manuscripts, the archive also contains a few important full texts on precisely this issue. Given the role of fulfillment for Husserl’s concept (...) of intentionality, this should not really come as a surprise, since the teleological nature of the fulfillment structure terminates in an experience of the optimum. Hence, however marginal this topic might seem at first glance, reflecting on it rapidly leads us to the heart of Husserl’s project and sheds further light on his conception of intentional experience. During the Zimbabwean crisis, millions crossed through the apartheid-era border fence, searching for ways to make ends meet. Maxim Bolt explores the lives of Zimbabwean migrant labourers, of settled black farm workers and their dependants, and of white farmers and managers, as they intersect on the border between Zimbabwe and South Africa. Focusing on one farm, this book investigates the role of a hub of wage labour in a place of crisis. A close ethnographic study, it addresses the complex, (...) shifting labour and life conditions in northern South Africa's agricultural borderlands. Underlying these challenges are the Zimbabwean political and economic crisis of the 2000s and the intensified pressures on commercial agriculture in South Africa following market liberalization and post-apartheid land reform. But, amidst uncertainty, farmers and farm workers strive for stability. The farms on South Africa's margins are centers of gravity, islands of residential labour in a sea of informal arrangements. Intensity profiles of emotional experience over time have been found to differ primarily in explosiveness and accumulation. However, the determinants of these temporal features remain poorly understood. In two studies, we examined whether emotion regulation strategies are predictive of the degree of explosiveness and accumulation of negative emotional episodes. Participants were asked to draw profiles reflecting changes in the intensity of emotions elicited either by negative social feedback in the lab or by negative events in daily life. In addition, trait, (...) and state usage of a set of emotion regulation strategies was assessed. Multilevel analyses revealed that trait rumination was positively associated with emotion accumulation. State rumination was also positively associated with emotion accumulation and, to a lesser extent, with emotion explosiveness. These results provide support for emotion regulation theories, which hypothesise that rumination is a central mechanism underlying the maintenance of negative emotions. (shrink)

The purpose of the study is to test the pedagogical potential of design and research activities in the context of the formation of research independence of cadets of a military higher educational institution through experimental work. The article reveals the technological aspect of the implementation of design and research activities by cadets of a military university. Scientific novelty lies in the identification and verification of the effectiveness of the pedagogical conditions that contribute to the formation of research independence of cadets (...) of a military higher educational institution. The article presents the author's edition of the thematic focus and content of the design and research assignments. As a result of the study, the empirical method proved the effectiveness of the revealed pedagogical conditions on the process of forming the research independence of cadets of a military higher educational institution. The seed system is a major component of traditional management of crop genetic diversity in developing countries. Seed flows are an important part of this system. They have been poorly studied for minor Andean crops, especially those that are propagated vegetatively. We examine the seed exchanges of Oxalis tuberosa Mol., a vegetatively propagated crop capable of sexual reproduction. We studied the seed exchanges of four rural communities in Candelaria district at the international and local levels, emphasizing the spread of new (...) sexually-produced genotypes through these exchanges. Interviews with 44 farmers generated socioeconomic, agronomic, crop diversity and seed exchange information, and data on the potential incorporation of new sexually-produced genotypes in the crop germplasm. We interviewed merchants to evaluate the input and output of genetic diversity in the communities studied. Results showed a positive effect of the farmers’ wealth on the diversity cultivated and on seed exchanges. Most seed exchanges occurred at market, creating a distinction between cash and self-consumption landraces. Cash landraces were intensively exchanged; self-consumption landraces were isolated at the farmer level and prone to genetic drift and complete loss. Merchants exported seeds of cash landraces across Bolivia and into Peru and Argentina. New sexually produced genotypes are less incorporated into cash landraces than in self-consumed landraces. However, new genotypes incorporated into cash landraces are diffused faster and better, being more intensively exchanged. We propose conservation strategies that can be applied to other vegetatively propagated and minor Andean crops. (shrink)

In philosophical debates about immigration, one of the most prominent arguments asserts that a state’s citizenry has a right to unilaterally control its territorial borders by virtue of its right to self-determination. This is the self-determination argument. The present article demonstrates that this argument is internally undermined by the Coercion Principle, according to which all persons subjected to coercive political power are entitled to an equal say in exercising that power. First, whichever way the self-determination argument identifies the relevant self-determining (...) self, it is bound to rely on the Coercion Principle. Specifying the self politically involves appealing to the Coercion Principle, as it is a core principle of democratic theory. Alternatively, specifying a pre-political self fails to circumvent this problem, as a similar issue arises further down the argumentative line, when inferring the right to unilaterally control borders from the right to self-determination. Finally, since border controls coerce would-be immigrants, this reliance on the Coercion Principle renders the self-determination argument self-defeating. (shrink)

While much research has focused on the effects of ethical and unethical leadership, little is known about how followers come to perceive their leaders as ethical or unethical. In this article, we investigate the co-creation of ethical and unethical leadership perceptions. Specifically, we draw from emerging research on moral congruence in organizational behaviour and empirically investigate the role of congruence in leaders’ and followers’ moral foundations in followers’ perceptions of ethical and unethical leadership. By analysing objective congruence scores from 67 (...) leader–follower dyads by means of polynomial regression with surface response analysis, we find partial support for our theoretically derived predictions. Significant effects were revealed for the fairness, loyalty, and authority moral foundations but not for the care and sanctity moral foundations. We discuss theoretical and practical implications of these findings. (shrink)

Il n’est pas question de demander si celui-ci la possède ou non, de résoudre le problème et de prouver la solution. У статті розглянуто проблему людської гідності за доби Просвітництва (на прикладі філософії І. Канта) у контексті сучасного філософського дискурсу проблеми. Зазначено, що подальший розвиток суспільства формує запит на правову соціально-орієнтовану державу, де надаються та забезпечуються широкі права та свободи для усіх громадян (незалежно від національності, віросповідання, культури, матеріального стану), що зрештою стає важливою засадою осмислення та буття людської гідності. Йдеться про право громадянина висловлювати свою думку та громадянську позицію, а завдання влади забезпечувати широкий спектр прав та свобод, які визначаються І. (...) Кантом як моральні (природні). Ось чому звернення сучасних філософів та дослідників до філософії І. Канта, його тлумачення природи людини, її прав та свобод, що зумовлене певною схожістю доби Просвітництва та сучасного етапу розвитку суспільства. Означена подібність втілилася у низці факторів, що створюють нову картину світу, а саме: кардинальні зміни політичного, соціального та економічного устрою; традиційного людського буття та життєвого світу; швидкість та глобалізм сучасних трансформацій не тільки у виробничих сферах, а й у соціально-побутових, морально-етичних та суспільно-політичних відносинах. Наголошено, що названі процеси втілюються у моральному (природному) та адміністративному праві і суттєво впливають на свободи та рівність усіх членів суспільства; самостійність дій кожного члена спільноти як громадянина; відсутність патерналізму на рівні взаємин громадянин-суспільство-влада. Таким чином, представлена І. Кантом етично-правова концепція людської гідності знаходить розуміння та застосування в концептах аргументативної та екологічної етики, етики відповідальності у прагненні до створення таких владних структур, за яких суспільний консенсус досягається через аргументований діалог усіх членів суспільства та колективну відповідальність за дії. Таким чином цілісна реконструкція роздумів І. Канта про людину, її гідність та свободу, засвідчує органічну приналежність української філософії до європейського інтелектуального та філософського контексту розуміння загальнолюдських морально-етичних норм, прав і свобод. According to the influential “expressive” argument for hate speech laws, legal restrictions on hate speech are justified, in significant part, because they powerfully express opposition to hate speech. Yet the expressive argument faces a challenge: why couldn't we communicate opposition to hate speech via counterspeech, rather than bans? I argue that the expressive argument cannot address this challenge satisfactorily. Specifically, I examine three considerations that purport to explain bans’ expressive distinctiveness: considerations of strength; considerations of directness; and considerations of complicity. (...) These considerations either fail to establish that bans are expressively superior to counterspeech, or presuppose that bans successfully deter hate speech. This result severely undercuts the expressive argument's appeal. First, contrary to what its proponents suggest, this argument fails to circumvent the protracted empirical controversies surrounding bans’ effectiveness as deterrents. Second, the expressive argument appears redundant, because bans are expressively distinctive only insofar as hate speech is already suppressed. (shrink)

The exponential Papapetrou metric induced by scalar field conforms to observational data not worse than the vacuum Schwarzschild solution. Here, we analyze the origin of this metric as a peculiar space-time within a wide class of scalar and antiscalar solutions of the Einstein equations parameterized by scalar charge. Generalizing the three families of static solutions obtained by Fisher, Janis et al. :878. https://doi.org/10.1103/PhysRevLett.20.878, 1968), and Xanthopoulos and Zannias :2564, 1989), we prove that all three reduce to the same exponential metric (...) provided that scalar charge is equal to central mass, thereby suggesting the universal character of such background scalar field. Maxime F. Giguère Cet article propose une nouvelle stratégie pour écarter la conclusion sceptique, mise de l’avant par Thomas Szasz, selon laquelle la psychiatrie est illégitime. La conclusion sceptique repose sur une démarcation radicale entre troubles mentaux et somatiques. Afin de minimiser cette démarcation, Jerome Wakefield emploie une analyse conceptuelle stipulant que les troubles mentaux et somatiques sont tous les deux des dysfonctions préjudiciables. De récentes critiques ont toutefois montré que son analyse bute sur la difficulté pratique de distinguer les (...) fonctions normales des dysfonctions. En raison de ce problème, l’analyse de Wakefield ne permet pas d’écarter la conclusion sceptique. Une nouvelle stratégie ne nécessitant pas de résoudre le problème reconnu par ces critiques s’annonce alors préférable pour écarter la conclusion sceptique. (shrink)

Summary The author is of the opinion that as a result of Alexander the Great’s conquest of Syria, which had been a single administrative entity under the Achaemenids, it was divided into two satrapies – the northern and the southern one. He believes that Menon, son of Cerdimmas, was appointed as the first head of the northern satrapy, to be replaced by Arimmas, who, in his turn, was succeeded by Asclepiodorus, son of Eunicus. Besides, it seems that Andromachus became the (...) first head of the southern satrapy, and after he was killed, Menon, transferred from the north to the south, took his place. Already in Alexander’s lifetime, probably in 329/328, Syria was once again merged into one satrapy. It is unclear who was installed as satrap of the unified region. At any rate, it could not have been Menes, son of Dionysius: the hypothesis that in winter 331/330 he was made satrap of the new province including Syria and Cilicia does not stand scrutiny. In the author’s view, the main task Alexander assigned to Menes was to take control and then to keep open and organized the sea communications with the coast of Syria, Phoenicia and Cilicia, and in the matters concerning these activities Menes was fully independent of the local satraps. Throughout the history of philosophical thinking, ethics has almost never been associated with ontology because the moral approach is about the action while the ontological approach is about the being. The prospective approach confers to moral philosophy a genuine ontological direction, an ontology of the human, since it aims at identifying the problems of (human) existence, which no longer describes “what should be” but mostly “what can be”, thus anticipating the ways of human existence in a future world.The challenges raised (...) by disruptive innovations and the environmental issue require the critical eye of moral philosophy regarding the impact of technological progress is having in redefining the human condition of tomorrow’s society; all the more so as we are facing a regrettable backwardness of moral progress, which does not seem to keep pace with the spectacular changes in science and technology. The wisdom of ethical reflection refers to a feeling of concern for both present and future humanity as a whole,relating not only to immediate reality but, especially, anticipating what might happen.
