This article briefly reviews concerns related to the “cultural colonialism” of applying Western biomedical models of research ethics to non-Western groups. The feasibility of alternate ethical models is discussed and found wanting. In practical terms, many academic researchers in the United States are funded by federal agencies and are required to adhere to Title 45, Part 46 of the Code of Federal Regulations , legislation that is clearly grounded in the Western biomedical research tradition. Consequently, the question is not whether (...) this system of ethics should be applied but rather how it can be applied most sensitively, appropriately, and wisely. Total knee arthroplasty (TKA) is a commonly implemented elective surgical treatment for end-stage osteoarthritis of the knee, demonstrating high success rates when assessed by objective medical outcomes. However, a considerable proportion of TKA patients report significant dissatisfaction postoperatively, related to enduring pain, functional limitations, and diminished quality of life. In this conceptual analysis, we highlight the importance of assessing patient-centred outcomes routinely in clinical practice, as these measures provide important information regarding whether surgery and postoperative rehabilitation interventions have effectively remediated (...) patients’ real-world “quality of life” experiences. We propose a novel precision medicine approach to improving patient-centred TKA outcomes through the development of a multivariate machine-learning model. The primary aim of this model is to predict individual postoperative recovery trajectories. Uniquely, this model will be developed using an interdisciplinary methodology involving non-linear analysis of the unique contributions of a range of preoperative risk and resilience factors to patient-centred TKA outcomes. Of particular importance to the model’s predictive power is the inclusion of a comprehensive assessment of modifiable psychological risk and resilience factors that have demonstrated relationships with TKA and other conditions in some studies. Despite the potential for patient psychological factors to limit recovery, they are typically not routinely assessed preoperatively in this patient group, and thus can be overlooked in rehabilitative referral and intervention decision-making. This represents a research-to-practice gap that may contribute to adverse patient-centred outcomes. Incorporating psychological risk and resilience factors into a multivariate prediction model could improve the detection of patients at risk of sub-optimal outcomes following TKA. This could provide surgeons and rehabilitation providers with a simplified tool to inform postoperative referral and intervention decision-making related to a range of interdisciplinary domains outside their usual purview. The proposed approach could facilitate the development and provision of more targeted rehabilitative interventions on the basis of identified individual needs. The roles of several modifiable psychological risk and resilience factors in recovery are summarised, and intervention options are briefly presented. While focusing on rehabilitation following TKA, we advocate for the broader utilisation of multivariate prediction models to inform individually-tailored interventions targeting a range of health conditions. From the beginning the French philosopher Claude Lefort has set himself the task of interpreting the political life of modern society-and over time he has succeeded in elaborating a distinctive conception of modern democracy that is linked to both historical analysis and a novel form of philosophical reflection. This book, the first full-scale study of Lefort to appear in English, offers a clear and compelling account of Lefort's accomplishment-its unique merits, its relation to political philosophy within the Continental tradition, and (...) its great relevance today. Much of what passes for political philosophy in our day is merely politicized philosophical concepts, a distinction author Bernard Flynn underscores as he describes the development of Lefort's truly political philosophy-its ideas formed in response to his own political experience and to the work of certain major figures within the tradition of political thought. Sartre and Foucault were two of the most prominent and at times mutually antagonistic philosophical figures of the twentieth century. And nowhere are the antithetical natures of their existentialist and poststructuralist philosophies more apparent than in their disparate approaches to historical understanding. In Volume One of this authoritative two-volume study, Thomas R. Flynn conducted a pivotal and comprehensive reconstruction of Sartrean historical theory. This long-awaited second volume offers a comprehensive and critical reading of the Foucauldian counterpoint. A history, theorized (...) Foucault, should be a kind of map, a comprehensive charting of structural transformations and displacements over time. Contrary to other Foucault scholars, Flynn proposes an "axial" rather than a developmental reading of Foucault's work. This allows aspects of Foucault's famous triad of knowledge, power, and the subject to emerge in each of his major works. Flynn maps existentialist categories across Foucault's "quadrilateral," the model that Foucault proposes as defining modernist conceptions of knowledge. Deliberative democracy entails a commitment to deciding political questions on their merits. To that end, people engage in an exchange of reasons in a shared endeavour to arrive at the right answer or the best judgement they can make in the circumstances. Of course, in practice a shared judgement may be impossible to reach. Yet while compromise may seem a natural way of dealing with the disagreement that deliberation leaves unresolved – for example, some deliberative theorists argue that a willingness (...) to compromise manifests respect for the considered views of others, even as we continue to disagree with them – the relationship between deliberation and compromise is not as straightforward as one might think. To explain why, this paper contrasts conflicts of judgement with conflicts of preference, interest and value to show why greater attention needs to be paid to the character of the decision to be made. This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. We present and defend a Thomistic cosmological argument that runs independently of the principle of sufficient reason, sidestepping perhaps two of the most recurrent objections to cosmological reasoning: (a) the possibility of brute facts (i.e., that not everything needs an adequate explanation of its existence) and (b) the accusation of the composition fallacy. Drawing upon the work of Barry Miller, we show that any contingent entity like Thumper the rabbit, upon metaphysical analysis, is either a contradictory structure and therefore an (...) impossible existent or else points towards an extrinsic cause for the unity of its really distinct metaphysical parts (namely, its essence and its existence). This conclusion enables the inference that only an uncaused cause with no really distinct metaphysical parts can ultimately produce anything with really distinct metaphysical parts. Sartre and Foucault were two of the most prominent and at times mutually antagonistic philosophical figures of the twentieth century. And nowhere are the antithetical natures of their existentialist and poststructuralist philosophies more apparent than in their disparate approaches to historical understanding. A history, thought Foucault, should be a kind of map, a comparative charting of structural transformations and displacements. But for Sartre, authentic historical understanding demanded a much more personal and committed narrative, a kind of interpretive diary of moral (...) choices and risks compelled by critical necessity and an exacting reality. Among philosophers, the question about strategic fouls has been whether they are ethically justified in light of our best conception of sport. This paper proposes a different defense. I argue that many strategic fouls should be excused even if we regard them as unjustified. I first lay out a partial defense of the assumptions that playing to win cannot be subordinate to playing skillfully and that winning has value that cannot be accounted for in terms of the skill that produces (...) it. I then argue that the logic of competitive play structures practical reason such that it is unreasonable to require even an ethical competitor always to subordinate the aim of winning to ethical standards within the game. Some ethical failures should be excused. The argument implies limits on the excusing conditions. I discuss these limits in some detail, showing that they fit patterns in the common acceptance of strategic fouls. I then address possible objections. In conclusion I argue that the logic of excuse rather than justification explains a common reaction to strategic fouls, resolving what might otherwise appear to be a contradiction in that reaction. A survey of university students tested whether committing animal abuse during childhood was related to approval of interpersonal violence against children and women in families. Respondents who had abused an animal as children or adolescents were significantly more likely to support corporal punishment, even after controlling for frequency of childhood spanking, race, biblical literalism, and gender. Those who had perpetrated animal abuse were also more likely to approve of a husband slapping his wife. Engaging in childhood violence against less powerful (...) beings— animals—may generalize to the acceptance of violence against less powerful members of families and society—women and children. Not all intellectual property rights grant the right to exclude that is indicative of “property rules,” as that term was used by Guido Calabresi and A. Douglas Melamed in their seminal article. Some intellectual property rights are “liability rules,” in which the right holder has an entitlement to compensation for use of the protected invention, not a right to preclude the use. Although patent laws normally grant a right to exclude others from use of the protected invention as a default, (...) most countries’ laws allow the government to convert the patent property rule into a liability rule through a compulsory license. It has been noted, for example, that by the end of the 1950s, the U.S. had issued compulsory licenses covering 40 to 50 thousand patents, including substantial portions of the patent portfolios of AT&T, General Electric, IBM, and Xerox. The U.S. Supreme Court recently expressed a willingness to accept liability rules over injunctions in some patent infringement cases. (shrink)

Michel Foucault surveyed the history of Western philosophy in terms of the Delphic ‘Know thyself’ and the Socratic ‘care of the self’. The former generates academic philosophy as we know it today whereas the latter conceives of philosophy as a ‘way of life’. At issue are competing notions of ‘truth’ and the philosophical relevance of the discursive/nondiscursive domains. Comparing this account with a similar but distinct reading of the same Greek texts by Greco-Roman historian Pierre Hadot, I underscore the ‘existentialist’ (...) tenor of this distinction and assess the challenges and liabilities of pursuing philosophy as a ‘way of life’. Husserl’s philosophy of culture relies upon a person’s body being expressive of the person’s spirit, but Husserl’s analysis of expression in Logical Investigations is inadequate to explain this bodily expressiveness. This paper explains how Husserl’s use of “expression” shifts from LI to Ideas II and argues that this shift is explained by Husserl’s increased understanding of the pervasiveness of sense in subjective life and his increased appreciation for the unity of the person. I show how these two developments allow Husserl (...) to better describe the bodily expressiveness that is the source of culture. Husserl’s account of culture is thoroughly intentionalistic, but it does not emphasize thought at the expense of embodiment. Culture originates not in an abstract subjectivity, but by persons’ expressing themselves physically in the world. By seeing how Husserl develops his mature position on bodily expressiveness, we can better appreciate the meaningfulness and the bodily concreteness of cultural objects. (shrink)

Only recently have sociologists considered the role of nonhuman animals in human society. The few studies undertaken of battered women and their animal companions have revealed high rates of animal abuse co-existing with domestic violence. This study examines several aspects of the relationship between humans and animals in violent homes. The study explored the role of companion animals in the abusive relationship through in-depth, semi-structured interviews with clients at a battered women's shelter. In particular, the study focused on the use (...) of companion animals by women's violent partners to control, hurt, and intimidate the women; the responses of the animals to the women's victimization; and the role of pets as human surrogates and the resulting symbolic interaction between human and nonhuman family members. The significance of the findings for family violence research and application are discussed, as well as the broader implications for sociological investigation of human-animal interaction. (shrink)

Sociologists have largely ignored the role of animals in society. This article argues that human-animal interaction is a topic worthy of sociological consideration and applies a sociological analysis to one problematic aspect of human-animal relationships - animal cruelty. The article reformulates animal cruelty, traditionally viewed using a psychopathological model, from a sociological perspective.The article identifies social and cultural factors related to the occurrence of animal cruelty.
