Die „Bürden des Urteilens anzuerkennen und ihre Konsequenzen zu akzeptieren“ (Rawls 1998, 120 Anm.) stellt für Rawls, neben der Bereitschaft zur fairen Kooperation, eine der zwei grundlegenden Tugenden des öffentlichen Vernunftgebrauchs dar. Die Bürden des Urteilens oder der Urteilskraft repräsentieren die epistemischen Voraussetzungen eines vernünftigen Pluralismus. Sie sollen erklären, warum ein Pluralismus von Überzeugungen nicht nur wahrscheinlich, sondern geradezu erwartbar und unvermeidlich ist.

This volume collects selected papers delivered at the 15th Conference of the International Society for Utilitarian Studies, which was held at Karlsruhe Institute of Technology in July 2018. It includes papers dealing with the past, present, and future of utilitarianism – the theory that human happiness is the fundamental moral value – as well as on its applications to animal ethics, population ethics, and the future of humanity, among other topics.

In diesem Beitrag sollen zentrale Spielarten und Familienverwandte des Liberalismus vorgestellt sowie auf zentrale Herausforderungen eingegangen werden, die sich dem Liberalismus als politischer Theorie gegenwärtig stellen. In diesem Beitrag sollen zum einen zentrale Spielarten und Familienverwandte von Rawls’ Liberalismus vorgestellt werden. Dabei handelt es sich um den Links- und Rechtslibertarismus, den Neoliberalismus sowie den Nationalliberalismus. Zum anderen sollen mit dem gesellschaftlichen Pluralismus, dem Verhältnis zur Demokratie und der Umweltzerstörung wichtige Herausforderungen thematisiert werden, mit denen sich der politische Liberalismus heutzutage konfrontiert (...) sieht. Es gilt als eines der einflussreichsten Werke der politischen Philosophie des 20. Jahrhunderts und kann nach wie vor als konstruktiver Beitrag zu aktuellen Diskussionen um Verteilungsgerechtigkeit gesehen werden. Mit seinem zweiten Hauptwerk Politischer Liberalismus hat er die Debatte eröffnet, wie wir unter Bedingungen einer pluralistischen Gesellschaft (...) auf vernünftige Weise gemeinsam leben können. John Rawls ist im 20. Jahrhundert sicherlich einer der bedeutendsten praktischen Philosophen. Seine Werke und die damit verbundene Begriffs- und Theoriebildung haben viele Traditionslinien philosophischer Klassiker der Moderne aufgegriffen, synthetisiert und neu ausgelegt. Mit seinem Nachdenken über Gerechtigkeit prägt er bis heute viele philosophische Debatten, sei es in positiver Bezugnahme oder negativer Abgrenzung.

The method of reflective equilibrium (MRE) is a method of justification popularized by John Rawls and further developed by Norman Daniels, Michael DePaul, Folke Tersman, and Catherine Z. Elgin, among others. The basic idea is that epistemic agents have justified beliefs if they have succeeded in forming their beliefs into a harmonious system of beliefs which they reflectively judge to be the most plausible. Despite the common reference to MRE as a method, its mechanisms or rules are typically expressed (...) in a metaphorical or simplified manner and are therefore criticized as too vague. Recent efforts to counter this criticism have been directed towards the attempt to provide formal explications of MRE. This paper aims to supplement these efforts by providing an informal working definition of MRE. This approach challenges the view that MRE can adequately be characterized only in the negative as a set of anti-essentialisms. I argue that epistemic agents follow MRE iff they follow four interconnected rules, which are concerned with a minimalistic form of foundationalism, a minimalistic form of fallibilism, a moderate form of holism, and a minimalistic form of rationality. In the critical spirit of MRE, the corresponding working definition is, of course, provisional and revisable. In general, the aim is to contribute to a reflective equilibrium (RE) concerning MRE. If it is successful, this working definition provides a better grasp of the most basic elements of the method and thereby enhances our understanding of it. (shrink)

Die philosophiehistorischen Betrachtungen versuchen jeweils, das Konzept eines realen Humanismus ins Bewusstsein gegenwärtiger praktischer Philosophie zu rufen. Verbindendes Motiv der Beiträge ist dabei ein kritisch verstandener Materialismus, der ohne weltanschauliche Versicherungen auskommt und den leibhaftigen Menschen in den Fokus der Betrachtung rückt. So verstandene Gesellschaftskritik orientiert sich an Gewährsmännern Kritischer Theorie wie etwa Hegel und Marx sowie Schopenhauer, (...) Nietzsche und Freud. The objective of this thesis – Reflective Equilibrium as a Form of Life – is to contribute to the deepening of understanding of the method of reflective equilibrium – a method of internal epistemic justification. In the first part of the study, four paradigmatic conceptions of the method will be analyzed in order to carve out a conceptual core: The ones by John Rawls – who coined the name of the method – Norman Daniels, Michael DePaul and Catherine Elgin. (...) I will argue that the conceptual core of the method contains four elementary rules: 1) A minimalistic fallibilism, 2) a moderate holism, 3) a minimalistic rationality, and 4) a weak foundationalism. Compliance with these rules is necessary and jointly sufficient for any epistemic procedure of justification to be in accordance with the method of reflective equilibrium. The second part of the study is intended to answer some of the open questions concerning this definition of the conceptual core of the method. It will be argued that the a minimalistic fallibilism, as a very central element of the method, is justified since there is no belief whose truth is transparent to an epistemic agent. Even if it were the case that such beliefs exist, there would be attractive options of retreat which provide a quasi-universal justification of minimalistic fallibilism. It will also be argued that all alternative methods of justification are either compatible with the method of reflective equilibrium or are not justified. While a metajustification of the method – understood as a justification of the method employing the method itself – is on the one hand not completely satisfactory, as it presupposes the acceptance of the method before it is justified, it is epistemically acceptable on the other hand, since it allows for a critical inquiry and is open-ended. It will be pointed out that a moderate foundationalism can be justified by the method for some specific area of inquiry insofar as basic beliefs can be identified. Yet, the default-position of the method is only a weak foundationalism (often also termed “coherentism”). With regard to the possibility of a formal interpretation of the method with which one could specify key terms used in the definition of the conceptual core, I will sketch general ways such a formalization might take. However, I will argue that the informal interpretation of the method has priority over any formal interpretation. In the third and concluding part of the study, I will present the claim that one should interpret the method of reflective equilibrium as a form of life. This means that the method is at least implicitly accepted by some epistemic agents: they have developed a disposition and ability to act according to the method. This interpretation of the method can be related to the notion of critical thinking, which, as a civic virtue and educational ideal, is subject of empirical research and practical application. A possible misunderstanding with respect to the method of reflective equilibrium as a form of life should be avoided: To interpret the method as a form of life does not indicate that it must be a comprehensive form of life. Acknowledging it in private life is optional. According to the proposed understanding of the method it is primarily a public and political form of life. (shrink)

Social norms have played a key role in the evolution of human cooperation, serving to stabilize prosocial and egalitarian behavior despite the self-serving motives of individuals. Young children’s behavior mostly conforms to social norms, as they follow adult behavioral directives and instructions. But it turns out that even preschool children also actively enforce social norms on others, often using generic normative language to do so. This behavior is not easily explained by individualistic motives; it is more likely a result of (...) children’s growing identification with their cultural group, which leads to prosocial motives for preserving its ways of doing things. Young children interpret some acts performed by adults as normatively governed, that is, as capable of being performed either rightly or wrongly. In previous experiments, children have made this interpretation when adults introduced them to novel acts with normative language (e.g. ‘this is the way it goes’), along with pedagogical cues signaling culturally important information, and with social-pragmatic marking that this action is a token of a familiar type. In the current experiment, we exposed children to novel actions with no (...) normative language, and we systematically varied pedagogical and social-pragmatic cues in an attempt to identify which of them, if either, would lead children to normative interpretations. We found that young 3-year-old children inferred normativity without any normative language and without any pedagogical cues. The only cue they used was adult socialpragmatic marking of the action as familiar, as if it were a token of a well-known type (as opposed to performing it, as if inventing it on the spot). These results suggest that – in the absence of explicit normative language – young children interpret adult actions as normatively governed based mainly on the intentionality (perhaps signaling conventionality) with which they are performed. Two experiments examined the restriction of referential domains during unscripted conversation by analyzing the modification and online interpretation of referring expressions. Experiment 1 demonstrated that from the earliest moments of processing, addressees interpreted referring expressions with respect to referential domains constrained by the conversation. Analysis of eye movements during the conversation showed elimination of standard competition effects seen with scripted language. Results from Experiment 2 pinpointed two pragmatic factors responsible for restriction of the referential domains used by speakers to design (...) referential expressions and demonstrated that the same factors predict whether addressees consider local competitors to be potential referents during online interpretation of the same expressions. These experiments demonstrate, for the first time, that online interpretation of referring expressions in conversation is facilitated by referential domains constrained by pragmatic factors that predict when addressees are likely to encounter temporary ambiguity in language processing. Human social life is structured by social norms creating both obligations and entitlements. Recent research has found that young children enforce simple obligations against norm violators by protesting. It is not known, however, whether they understand entitlements in the sense that they will actively object to a second party attempting to interfere in something that a third party is entitled to do — what we call counter-protest. In two studies, we found that 3-year-old children understand when a person is entitled (...) to do something, and so they actively defend this person’s entitlement against unjustified interference from second parties. In some cases, they even enforce second-order entitlements, for example, in the case of ownership where an owner is entitled to entitle others to use the owner’s property. (shrink)

Human adults incline toward moral objectivism but may approach things more relativistically if different cultures are involved. In this study, 4-, 6-, and 9-year-old children (N = 136) witnessed two parties who disagreed about moral matters: a normative judge (e.g., judging that it is wrong to do X) and an antinormative judge (e.g., judging that it is okay to do X). We assessed children’s metaethical judgment, that is, whether they judged that only one party (objectivism) or both parties (relativism) could (...) be right. We found that 9-year-olds, but not younger children, were more likely to judge that both parties could be right when a normative ingroup judge disagreed with an antinormative extraterrestrial judge (with different preferences and background) than when the antinormative judge was another ingroup individual. This effect was not found in a comparison case where parties disagreed about the possibility of different physical laws. These findings suggest that although young children often exhibit moral objectivism, by early school age they begin to temper their objectivism with culturally relative metaethical judgments. Karl Leonhard Reinhold publizierte Ende der 1780er-Jahre eine Reihe von Schriften, mit denen er beanspruchte, Immanuel Kants geschmackstheoretische Ausführungen der Kritik der Urteilskraft zu antizipieren. Ziel dieser Studie ist eine bis dato nicht vorgenommene umfassende kontextualisierende Analyse dieser frühen ästhetischen Ansätze, die u. a. auf das Schöne und die Kunst appliziert werden. Reinhold diskutiert die seiner Ansicht nach einseitigen Lustkonzeptionen von Dubos, Pouilly, Wolff, Mendelssohn, Sulzer und Helvétius, welche er mit seiner eigenen Theorie des Vergnügens ergänzt. Die Empfindungstheorie Ernst Platners (...) wird als ein holistischer Zugang gewürdigt. Reinholds Ausführungen nehmen Kants Geschmackskritik zwar nicht vorweg, doch sind sie mit dieser vereinbar und können als ihr vergnügens- und triebtheoretisches Fundament angesehen werden. Platners Einfluss ist dabei nur einer von vielen und verblasst neben dem von Kants Epistemologie und Ethik. Die Originalität von Reinholds Reflexionen liegt v. a. in einer transzendentalphilosophischen Aufwertung der Sinnlichkeit in ästhetischen Belangen und einem Vorläufermodell des freien Spiels der Erkenntniskräfte als einer starken und leichten Beschäftigung der Vorstellungskraft. It is well known that John Stuart Mill repeatedly acknowledges Harriet Taylor Mill's substantial contribution to On Liberty. After her death, however, he decides to publish the book under his name only. Are we justified in continuing this practice, initiated by JSM, of refusing unequivocal co-authorship status to HTM? Drawing on stylometric analyses, we make a preliminary case that JSM did not write On Liberty all by himself and that HTM had a hand in formulating it. Drawing on plausible standards (...) for authorship ascription, we further point out that authorship status requires, in addition to a substantial contribution, the approval by all contributors. We discuss potential reasons to assume that HTM did not approve the published version of On Liberty and would have objected to including her name on the title page. Recently proposed models of risky choice imply systematic violations of transitivity of preference. This study explored whether people show the predicted intransitivity of the two models proposed to account for the certainty effect in Allais paradoxes. In order to distinguish “true” violations from those produced by “error,” a model was fit in which each choice can have a different error rate and each person can have a different pattern of preferences that need not be transitive. Error rate for a choice (...) is estimated from preference reversals between repeated presentations of the same choice. Results showed that few people repeated intransitive patterns. We can retain the hypothesis that all participants were transitive. (shrink)

I argue against the claim that it is trivial to state that Sidgwick used the method of wide reflective equilibrium. This claim is based on what could be called the Triviality Charge, which is pressed against the method of wide reflective equilibrium by Peter Singer. According to this charge, there is no alternative to using the method if it is interpreted as involving all relevant philosophical background arguments. The main argument against the Triviality Charge is that although the method of (...) wide reflective equilibrium is compatible with coherentism (understood as a form of weak foundationalism) as well as moderate foundationalism, it is not compatible with strong foundationalism. Hence, the claim that a philosopher uses the method of wide reflective equilibrium is informative. In particular, this is true with regard to Sidgwick. (shrink)

Mit einer virtuellen Welt kann sehr Verschiedenes und Mannigfaltiges assoziiert werden, unter anderem ein weiterer schillernder Begriff: Die Utopie. Sind nun virtuelle Welten allesamt Utopien? Oder müsste man vielmehr umgekehrt die Utopie als eine besondere virtuelle Welt hervorheben? Dass es überhaupt einen engen Zusammenhang zwischen den beiden Begriffen gibt, scheint nicht einmal selbstverständlich: Es gibt ihn sicherlich nicht, wenn man unter einer virtuellen Welt lediglich ein mit Hilfe von Computertechnik generiertes Szenario und unter einer Utopie schlicht und einfach eine der (...) Wirklichkeit unangemessene Wunschvorstellung versteht oder aber die Utopie als die literarische Konzeption einer für ideal befundenen Gesellschaftsform begreift und ideengeschichtlich demgemäß mit Platons „Staat“ beginnen lässt. Damit das begriffliche Verhältnis zwischen den heute durchaus auch im allgemeinen Sprachgebrauch verwurzelten Ausdrücken „Utopie“ und „Virtualität“ untersucht werden kann, soll der Versuch unternommen werden, anschaulich zu machen, wie sie verwendet werden könnten. In Anarchie, Staat, Utopia aus dem Jahre 1974 legte Robert Nozick eine libertäre Staatstheorie dar, die er auch als Utopie verstanden wissen will. Ist nun diese Selbst-Etikettierung berechtigt? Hierzu möchte ich sowohl Nozicks Auffassung von einer Utopie betrachten, als auch nach einem sinnvollen Utopie-Begriff suchen, dem ein als utopisch bezeichneter Text zu genügen hat. Dabei werde ich hauptsächlich den Blick auf Thomas Morus’ genre-prototypischen Text über die Insel Utopia richten. Neben der Frage, ob Nozicks Staatstheorie als Utopie bezeichnet werden sollte, (...) möchte ich zum Schluß versuchen, eine Antwort auf die Frage zu finden, warum sich Nozick eines Begriffs bedient, der im allgemeinen Sprachgebrauch durchaus nicht immer positiv verstanden wird. We agree with Pickering & Garrod's (P&G's) proposal that dialogue is an important empirical and theoretical test bed for models of language processing. However, we offer two cautionary notes. First, the enterprise will require explicit computational models. Second, such models will need to incorporate both joint and separate speaker and hearer commitments in ways that go beyond priming and alignment.

Interdisciplinary collaboration figures centrally in frontier research in many fields. Participants in inter-disciplinary projects face problems they would not encounter within their own disciplines. Among those are problems of mutual understanding, of finding a language to communicate both within projects and with the scientific community and society at large, and of needing to master concepts and methods of different disciplines. We think that a concentrated research and development effort is necessary to analyze, on the one hand, cognitive conditions of successful (...) understanding, communication, and interaction and, on the other, to develop specific tools and methods that support and facilitate inter-disciplinarity both in practice and in educational projects that prepare future generations of professionals within and outside of academia. Those tools need to be developed and their cognitive efficiency measured. (shrink)

In 1972, Kurt Flasch broke new ground with his contentious thesis that Dietrich von Freiberg, as early as 1300, had formulated a theory of productive subjectivity. Flasch argues that Dietrich recognized the object-constituting function of the mind conceived in transcendental terms, much in the same vein as Immanuel Kant’s so-called Copernican Revolution. Despite the ongoing controversy surrounding this thesis, Kant has been noticeably neglected in the relevant scholarly discussion. The following paper will address this oversight through a comparative analysis of (...) Dietrich’s and Kant’s theories on mental constitution and intellect. While there are general similarities between the two philosophers, closer inspection reveals critical discrepancies in their core theoretical constructs. Additionally, their respective methodologies are fundamentally incompatible. Dietrich’s approach does offer a reorientation in medieval thinking, yet its underpinnings of metaphysics and theocentricism clash with the experimental nature of Kant’s transcendental refl ections. Mit dem treffenden Ausdruck "Der wunderbare florentinische Geist" bezeichnet Jacob Burckhardt den Geist der Erneuerung in Florenz zur Zeit der italienischen Renaissance - des Rinascimento. Er revolutionierte die unterschiedlichsten kulturellen Bereiche, wie etwa das politische Denken, Wissenschaft, Technik und Kunst. Dieser Geist wirkt bis heute fort. In seiner vielfältigen Gestalt dient er als Ausgangspunkt, um den Hintergrund der europäischen Kultur zu erkunden.

Der klassische Liberalismus geht davon, dass die Freiheit des einzelnen Menschen ihre Grenze erst an der Freiheit der anderen finden soll. Eingriffe in die Freiheitsrechte müssen gerechtfertigt werden. Im Zentrum der politischen Theorie des Liberalismus steht daher die Aufgabe, die staatliche Rechtsordnung durch vernünftige Gründe zu legitimieren.

While an accurate assessment of risk is always important, it is especially so in pediatric research. Recognizing the pivotal nature of the minimal-risk standard, we set out to determine under what circumstances pediatric magnetic resonance imaging research does or does not meet this standard. We found that while the physical and psychological risks that attend the MRI procedure do not exceed minimal risk, the sedation and contrast enhancement that are sometimes associated with MRI research do, as both exceed the level (...) of risk encountered by typical, healthy children in their everyday experiences. Bei der Interpretation und Bewertung des Gesamtwerkes von Rawls kommt dem Thema Religion eine zentrale Bedeutung zu. Zwei Aspekte sind dafür entscheidend: Zum einen steht die Frage nach der angemessenen politischen Rolle von Religion in der pluralistischen Öffentlichkeit einer demokratischen Gesellschaft in kaum einer anderen politischen Theorie und Philosophie der Gegenwart so stark im Zentrum wie bei Rawls. Religion ist für ihn kein beliebiger Anwendungsfall einer normativen Theorie des Politischen, sondern betrifft als permanentes gesellschaftliches Faktum die methodische Grundstruktur einer Theorie (...) des vernünftigen Pluralismus.
