This paper outlines an approach for comparing Edmund Husserl’s late historical-teleological reflections in the Crisis of the European Sciences with Michel Foucault’s archaeology of discursive formations in his Archaeology of Knowledge, with a particular emphasis on the notion of an “historical apriori.” The argument is that each conception of historical reflection complements the other by opening up a depth dimension that moves beyond the traditional limits of the philosophy of history. In Husserl, the concept of the lifeworld fixes the parameters (...) of a “deep history” as the horizon of anonymous subjective comportment, while in Foucault the concept of the archive delimits an alternative deep history of the anonymous production of discursive formations. Together, Husserl and Foucault represent two important moments of the radicalization of the theme of history in twentieth century philosophy, one seeking to extend the limits of transcendental philosophy, the other contesting the domain of the transcendental altogether. Julian Dodd has characterized the default position in metaphysics as meta-ontologically realist: the answers to first-order ontological questions are thought to be entirely independent of the things we say and think about the entities at issue. Consequently, folk ontologies are liable to substantial error. But while this epistemic humility is commendable where the ontology of natural kinds is concerned, it seems misplaced with respect to social kinds since their ontology is dependent upon the human social world. Using art and art-kinds (...) as paradigmatic examples of social kinds, I argue that meta-ontological realism sets conditions that are too strict to apply to social kinds. Nevertheless, I argue that we should not be too quick to embrace the conclusion that our folk theories of social kinds cannot err substantially. By modelling the reference of social kind-terms on that of natural kind-terms, it becomes clear that in both cases, our sole epistemic privilege lies in our ability to pinpoint the subject of our inquiries. This paper critically examines several game theoretic interpretations of Hobbes' state of nature, including Prisoner's Dilemma and Assurance Game, and argues instead that the best matrix is that of a combination of the two, an Assurance Dilemma. This move is motivated by the fact that Hobbes explicitly notes two distinct personality types, with different preference structures, in the state of nature: dominators and moderates. The former play as if in a Prisoner's Dilemma, the latter play as if in an Assurance (...) Game. But when meeting one another, the Assurance Dilemma represents their differing strategies, and can explain various other features of Hobbes' state of nature, as well as a key informational role played the Sovereign. ABSTRACT In establishing National Bioethics Organisations (NBOs), liberal democracies seek to acknowledge the diversity of strongly held ethical positions and the imperative to engage in public debate about important bioethical decisions. NBOs are typically given a range of responsibilities, including contributing to and stimulating public debate; providing expert opinion on relevant issues for policy deliberations; and developing public policy. The state is now found to have an interest in areas previously thought to be a matter of individual choice. NBOs can (...) provide one way of opening up public debate to allow the diversity of views to be heard in a manner that is well‐informed, articulate and responsive to both expert and ‘lay’ public views. We draw on debates in political theory about democratic decision‐making and on the policy making roles of some key NBOs. We are particularly interested in examining the capacity of NBOs to meet the democratic ideal of effective participation by the public, or citizenry, especially by those who are directly affected by the policies, in the development of effective public policy. We provide a basic framework for policy development involving NBOs that can begin to meet this ideal, a process of ‘contested deliberation’. (shrink)

This paper considers the legislative debates in Australia that led to the passage of the Research Involving Human Embryos Act (Cth 2002) and the Prohibition of Human Cloning Act (Cth 2002). In the first part of the paper, we discuss the debate surrounding the legislation with particular emphasis on the ways in which demands for public consultation, public debate and the education of Australians about the potential ethical and scientific impact of human embryonic stem cells (hESC) research were deployed, and (...) the explicit and implicit framing of the scope of public consultation. We then ask whether, given the calls for public consultations, debate and understanding, current work in democratic theory could be helpful in analysing the process of policy-making in these areas. In particular, we canvass the literature relating to aggregative and deliberative models of democracy for processes that support the legitimacy of policy. We identify features of the debate that reflect the appeal of deliberative approaches as well as some of the possible hurdles or limitations to developing deliberative democratic approaches to policy in ethically contentious areas. Fundamental aspects of human use of the environment can be explained by game theory. Game theory explains aggregate behaviour of the human species driven by perceived costs and benefits. In the ‘game’ of global environmental protection and conservation, the stakes are the living conditions of all species including the human race, and the playing field is our planet. The question is can we control humanity's hitherto endless appetite for resources before we irreparably harm the global ecosystem and cause extinction of (...) even more species? The central problem is that some proportion of the individuals or groups will behave selfishly. The inducement for using more than a fair share, or ‘cheating’, increases as that resource becomes rarer, thus the benefits of cheating increase. In addition, the total number of people is increasing, so the proportion of cheaters must decrease to even keep total resource use constant. Cost benefit analysis of the effect of regulation and incentives on potential cheaters may provide a rational approach to controlling environmental problems. While it is debatable that environmental values are constant across cultures, communal use of resources seems to follow global rules. Cooperative use and punishment of those who use more than their share appear to be ubiquitous in human societies. Schemes for controlling human impact on the global environment must take into consideration basic behaviours including development of social norms and the positive feedback created because resources become more valuable with increasing rarity leading to more incentive for consumption. The increasing popularity of local food consumption can be attributed to the heightened awareness of food safety concerns, carbon emissions produced from food transportation, and an understanding of how large corporations’ obtain their food supplies. Although there is increasing discussion on both the local and organic food movement independently, there is not a wide availability of literature examining the motivations and perceptions of consumers with regard to farmers’ markets. Issues such as perceptions about what type of food consumers are purchasing (...) at markets, nor the main motivations for frequenting such establishments are discussed. Therefore the purpose of this study was to determine consumer motivations, benefits, and perceptions of farmers’ markets. Using the case study location of Toronto, Canada, this study surveyed 300 participants during the fall of 2011. Findings indicated that the main purpose for visiting famers’ markets is not solely to fulfill grocery needs. Quality of products offered and the ability to support the local community were the primary motivators to visit the markets. (shrink)

It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. Pp. 422 + viii. $44.50 (hardbound). Is there a rational justification for believing that God, as understood by traditional Western theism, exists? Richard M. Gale uses the tools of analytic philosophy to address some aspects of this question. He intentionally avoids any discussion of inductive arguments which (...) would try to show that the existence of God is the " only possible explanation " of some observable feature of the universe, and concentrates instead on arguments which more generally discuss whether or not belief in God is rationally justified (pp. 3, 241). His book is in some ways a response,to philosophers such as William Alston and Alvin Plantinga who have used analytic philosophy in defense of the theistic claim that God exists. Gale offers a more sbptical account of the ability of reason to justify belief in God. He views his work as beneficial to theism, however, in that it may lead believers to adopt a conception of God which is " more adequate " for inspiring worship and obedience than the traditional notion (p. 3). Before considering " theological arguments " in favor of the existence of God, Gale analyses a number of " atheological " arguments against it. The arguments fall into two categories, epistemological and pragmatic. Epistemological arguments are concerned with justifying any claim to knowledge that God does or does not exist. Pragmatic arguments try to show that belief (or disbelief) in the existence of God is justified by the moral benefits that accrue from it. With the exception of the last chapter, the entire book is devoted to epistemological arguments. Gale views his atheological arguments as " thought experiments " which test the internal consistency of the traditional understanding of various divine attributes and so lead us to improve the logical consistency of our understanding of God. When the traditional under· standing of some divine attribute is shown to involve logical incongruities, the theist is invited to go " back to the drawing board and redesign the particular divine attribute that is the focus of the argument " (p. 3). Atheological arguments are presented first so that the redesigned divine attributes can inform the subsequent analysis of theological arguments in favor of God's existence. Gale is willing to redesign a good number of divine attributes on the basis of often familiar and sometimes rather shaky atheological arguments. The traditional understanding of divine omnipotence, for in· stance, is tested in Chapter 1, using Gale's version of the well known 318 BOOK REVIEWS dilemma of whether an omnipotent God could create a stone so heavy that God could not lift it. Since it is necessary that God ls omnipotent and since it is necessary that an omnipotent being can do anything, it is necessary that God can do anything. Thus, " it is necessary that God can create a stone so heavy that God cannot lift it." But if it is necessary that God can create a stone so heavy that God cannot lift it, then it is possible that there is something that God cannot do. So it is not necessary that God can do anything. Thus we come to the contradiction that it is both necessary and not necessary that God can do anything (p. 18). Gale sees that his premise, " it is necessary that God can create a stone so heavy that God cannot lift it," itself involves a self-contradiction and is equivalent to saying that the omnipotent God can act in such a way that the omnipotent God is simultaneously not the omnipotent God (20). What he fails to see is that attributing to God any action that falls short of perfect activity (e.g., immoral action) involves the same self-contradiction. Nor does he seem to realize that self-contradictory statements of this sort are simply nonsensical. Being devoid of meaning, they can tell us nothing about what God can or cannot do, and so in no way require us to restrict or qualify God's omnipotence. Not seeing the senselessness of self-contradictory statements, Gale embarks on a program of reforming or qualifying the traditional notion of divine omnipotence... (shrink)

In Australia, Human Research Ethics Committees (HRECs) have a vital role to play—as the primary institutional mechanism for ethical review of research—in protecting research participants, and promoting ethical research. Their ability to act effectively in this role is currently threatened by the limited support they receive and their burgeoning workloads. In this discussion paper, I trace some of the factors contributing to what I describe as a resource crisis in human research ethics. I suggest a review of the working of (...) HRECs to canvas a range of alternatives which might serve to redress this crisis, so as to ensure the continued effectiveness of HRECs in protecting participants and promoting ethical research. Miller (1956) identified his famous limit of 7 ± 2 items based in part on absolute identification—the ability to identify stimuli that differ on a single physical dimension, such as lines of different length. An important aspect of this limit is its independence from perceptual effects and its application across all stimulus types. Recent research, however, has identified several exceptions. We investigate an explanation for these results that reconciles them with Miller’s work. We find support for the hypothesis that the (...) exceptional stimulus types have more complex psychological representations, which can therefore support better identification. Our investigation uses data sets with thousands of observations for each participant, which allows the application of a new technique for identifying psychological representations: the structural forms algorithm of Kemp and Tenenbaum (2008). This algorithm supports inferences not possible with previous techniques, such as multidimensional scaling. (shrink)

In this paper I argue for a doctrine I call ?infallibilism?, which I stipulate to mean that If S knows that p, then the epistemic probability of p for S is 1. Some fallibilists will claim that this doctrine should be rejected because it leads to scepticism. Though it's not obvious that infallibilism does lead to scepticism, I argue that we should be willing to accept it even if it does. Infallibilism should be preferred because it has greater explanatory power (...) than fallibilism. In particular, I argue that an infallibilist can easily explain why assertions of ?p, but possibly not-p? (where the ?possibly? is read as referring to epistemic possibility) is infelicitous in terms of the knowledge rule of assertion. But a fallibilist cannot. Furthermore, an infallibilist can explain the infelicity of utterances of ?p, but I don't know that p? and ?p might be true, but I'm not willing to say that for all I know, p is true?, and why when a speaker thinks p is epistemically possible for her, she will agree (if asked) that for all she knows, p is true. The simplest explanation of these facts entails infallibilism. Fallibilists have tried and failed to explain the infelicity of ?p, but I don't know that p?, but have not even attempted to explain the last two facts. I close by considering two facts that seem to pose a problem for infallibilism, and argue that they don't. (shrink)

Building on contemporary research in embodied cognition, enactivism, and the extended mind, this book explores how social institutions in contemporary neoliberal nation-states systematically affect our thoughts, feelings, and agency. Human beings are, necessarily, social animals who create and belong to social institutions. But social institutions take on a life of their own, and literally shape the minds of all those who belong to them, for better or worse, usually without their being self-consciously aware of it. Indeed, in contemporary neoliberal societies, (...) it is generally for the worse. In The Mind-Body Politic, Michelle Maiese and Robert Hanna work out a new critique of contemporary social institutions by deploying the special standpoint of the philosophy of mind—in particular, the special standpoint of the philosophy of what they call essentially embodied minds—and make a set of concrete, positive proposals for radically changing both these social institutions and also our essentially embodied lives for the better. What is given to us in conscious experience? The Given is an attempt to answer this question and in this way contribute to a general theory of mental content. The content of conscious experience is understood to be absolutely everything that is given to one, experientially, in the having of an experience. Michelle Montague focuses on the analysis of conscious perception, conscious emotion, and conscious thought, and deploys three fundamental notions in addition to the fundamental notion of content: the (...) notions of intentionality, phenomenology, and consciousness. She argues that all experience essentially involves all four things, and that the key to an adequate general theory of what is given in experience lies in giving a correct specification of the nature of these four things and the relations between them. Concessive knowledge attributions (CKAs) are knowledge attributions of the form ‘S knows p, but it’s possible that q’, where q obviously entails not-p (Rysiew, Nous (Detroit, Mich.) 35:477–514, 2001). The significance of CKAs has been widely discussed recently. It’s agreed by all that CKAs are infelicitous, at least typically. But the agreement ends there. Different writers have invoked them in their defenses of all sorts of philosophical theses; to name just a few: contextualism, invariantism, fallibilism, infallibilism, and that the knowledge (...) rules for assertion and practical reasoning are false. In fact, there is a lot of confusion about CKAs and their significance. I try to clear some of this confusion up, as well as show what their significance is with respect to the debate between fallibilists and infallibilists about knowledge in particular. (shrink)

The ontological nature of works of music has been a particularly lively area of philosophical debate during the past few years. This paper serves to introduce the reader to some of the most fertile and interesting issues. Starting by distinguishing three questions – the categorial question, the individuation question, and the persistence question – the article goes on to focus on the first: the question of which ontological category musical works fall under. The main thesis of this paper is that John McDowell (in his Mind and World) tries to occupy a position that is not coherently statable; namely, that facts have objects and properties as constituents and are yet identical with true (Fregean) Thoughts. This position is contrasted with two other identity theories of truth: the robust theory, in which true propositions are identified with facts (which are understood to have objects and properties as constituents); and the modest theory, in which facts (...) are identified with true Fregean Thoughts. Michelle Kosch examines the conceptions of free will and the foundations of ethics in the work of Kant, Schelling, and Kierkegaard. She seeks to understand the history of German idealism better by looking at it through the lens of these issues, and to understand Kierkegaard better by placing his thought in this context. Kosch argues for a new interpretation of Kierkegaard's theory of agency, that Schelling was a major influence and Kant a major target of criticism, and that both (...) the theory and the criticisms are highly relevant to contemporary debates.
