The study is aimed to test the governing-law anchor in the comparative analysis of legal terminology to harmonize the clash of legal cultures in legal translation. It is considered as an adjustment to a juritraductological approach to legal translation which invites legal translators to merge the tools of jurilinguistics, comparative law and traductology in the comparative analysis of legal concepts before selecting a suitable translation solution (Monjean-Decaudin, in: Research methods in legal translation and interpreting, Routledge, 2019). Rather than (...) transposing a text from a source law system to a target law system, legal translators are believed to operate in the bi-semiotic environment of two legal cultures as navigators of their recipients toward understanding the legal concepts under the governing law of the document. To this end a comparative conceptual analysis, that correlates with the parametrization method (Matulewska in Stud Logic Gramm Rhetor 45:161–174, 2016), should be anchored in the analysis of the source law concepts (Šarčević in New Approach to Legal Translation, Kluwer Law International, The Hague, 2000). First, the componential and taxonomic analyses were used to identify conceptual markers/parameters of source concepts to serve as tertia comparationis for the subsequent search of their functional equivalents in the target legal culture. Source concepts and their functional equivalents were subsequently subject to a comparative componential analysis aimed to reveal a degree of their match based on which coinage operations were activated in selecting suitable translation strategies. We hypothesized that the change in the governing-law perspective would trigger changes in translation solutions. The governing-law-anchored process of comparative analysis was detailed and exemplified by the analysis of the conceptual field of Homicide in the Slovak law, English law, and the US Model Penal Code. This book offers a 'genealogical' explanation of law's normativity. The term 'genealogical' conveys a commitment to a non-metaphysical type of enquiry. While it explains how law, as a normative phenomenon, comes about, it does not seek to ground law's normativity in anything but the context of social interaction giving rise to it. Legal normativity is brought about on a daily basis. Whether in revolutionary circumstances or in the quotidian need for judges, lawmakers or citizens to balance law's demands with those (...) of morality or prudence, our ability to bind ourselves through law ultimately depends on our capacity to articulate a better way of living together, and to commit ourselves to it. These efforts of assessment and articulation depend, in turn, on our conception of normative agency. Assert the need to trace the truth of ethical judgments to some independent moral 'facts' conditioning their objectivity, and you will get a different understanding of what it is we are doing when we dispute law's authority in the name of moral values. Tracing the truth of moral judgements back to our own social practices not only affects the nature of disagreement; it also dramatically increases our responsibility when, as lawmakers, judges, or citizens we 'take the law into our own hands' and confront it with our moral expectations. This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. Recent research suggests that women react to idealized female models in advertising as they would react to real-life sexual rivals. Across four studies, we investigate the negative consequences of this imaginary competition on consumers’ mate-guarding jealousy, indirect aggression, and drive for thinness. A meta-analysis of studies 1–3 shows that women exposed to an idealized model report more mate-guarding jealousy and show increased indirect aggression, but do not report a higher desire for thinness. Study 4 replicates these findings and reveals that (...) the main driver of aggression is the sexually provocative attitude of the model, rather than her thin body size. The ethical implications of these findings for advertising are discussed in light of recent concerns about female bullying, online, and in the workplace. (shrink)

This paper aims to highlight the role played by uncertainties in global justice theories. It will start by identifying four kinds of uncertainties that could potentially have an impact on the nature, content and very existence of global duties: first, uncertainties regarding the causes of global injustices; second, uncertainties regarding the consequences of global justice initiatives; third, uncertainties pertaining to the 'imperfect' character of certain global duties; and fourth, uncertainties regarding the conduct of others. It will discuss each of these (...) uncertainties in turn, with particular attention to their normative implications, their distinctively 'global' source, and the possibility of their being addressed. Les parlers ruraux abondent en métaphores associées à la parole, notamment à la façon dont elle est fabriquée et produite dans cet ouvroir miniature qu’est la bouche. Deux séries de représentations semblent en réalité s’opposer : un modèle technique qui assimile la parole aux activités textiles d’une part (filer, coudre), aux gestes des petits artisans d’autre part (raboter, étamer, limer) ; un modèle organique qui associe la parole à la sécrétion salivaire (baver) et à l’excrétion (« chier sur, faire des (...) crottes »). Ces deux ensembles de représentations servent à opposer une parole féminine et une parole masculine tout en définissant la norme de chacune d’elles. L’étude met en évidence la portée symbolique de la parole féminine qui, nouant le lien entre la passé et le présent, filant le temps cyclique de la communauté, s’identifie avec la dynamique calendaire ; elle montre aussi la complémentarité que cette parole entretient sur le plan symbolique avec la parole des hommes qui, associée à l’excrétion, à la croissance et à la maturation des végétaux et aux gestes qui tranchent et ouvrent, semble figurer la succession des cycles qui doivent à un moment s’ouvrir les uns sur les autres et l’inévitable transformation de toute chose vivante. The 2008 crisis has revived debates on the relevance of laissez-faire, and thus on the role of the State in a modern economy. We study when the property that a field is dense in its real and p-adic closures is elementary in the language of rings and deduce that all models of the theory of algebraic fields have this property.

We extend the characterization of extremal valued fields given in [2] to the missing case of valued fields of mixed characteristic with perfect residue field. This leads to a complete characterization of the tame valued fields that are extremal. The key to the proof is a model theoretic result about tame valued fields in mixed characteristic. Further, we prove that in an extremal valued field of finitep-degree, the images of all additive polynomials have the optimal approximation property. This fact can (...) be used to improve the axiom system that is suggested in [8] for the elementary theory of Laurent series fields over finite fields. Finally we give examples that demonstrate the problems we are facing when we try to characterize the extremal valued fields with imperfect residue fields. To this end, we describe several ways of constructing extremal valued fields; in particular, we show that in every ℵ1saturated valued field the valuation is a composition of extremal valuations of rank 1. The present work finds in Heidegger's 'being towards death' the basis for theological-philosophical thinking. Only the one who embraces 'being towards death' has the courage to think and poetize. This thinking, in turn, makes 'being towards death' possible, and in this circular movement of thinking and being the mystery of being reveals itself and yet remains hidden.
