In 2009, with the enactment of the Lisbon Treaty, the Charter of Fundamental Rights of the European Union entered into force. Under Article 8 of the Charter, for the first time, a stand-alone fundamental right to data protection was declared. The creation of this right, standing as a distinct right to the right to privacy, is undoubtedly significant, and it is unique to the European legal order, being absent from other international human rights instruments. This commentary examines the parameters of (...) this new right to data protection, asking what are the principles underpinning the right. It argues that the right reflects some key values inherent in the European legal order, namely: privacy, transparency, autonomy and nondiscrimination. It also analyses some of the challenges in implementing this right in an era of ubiquitous veillance practices and Big Data. (shrink)

Hojjat Soofi successfully developed a novel dementia-specific model of human flourishing.1 Based on a modified version of Nussbaum’s account of dignity (ie, the theoretical framework of the capabilities approach), and integrated with Kitwood and Bredin’s empirically informed list of indicators of well-being for people with dementia (ie, the field of empirically informed ethics), this model provides guidance on how to actually care for people with dementia in real-life practices, according to the moral requirements of respect for dignity. More specifically, we (...) deem the contributive value of the model to be threefold. (1) It is a successful specification and contextualisation of Nussbaum’s original list of capabilities in the context of dementia care. (2) The table clearly distinguishes between dementia-specific capabilities and their possibly dementia-related progressive deprivation (ie, the internal conditions), and the possible external setbacks or facilitators for human flourishing. (3) The model is proposed as being open to include new and additional insights from further empirical research on what forms of caregiving do (or do not) align with respect for the dignity of people with dementia. In our commentary, we want to focus on the source of dignity, that is, the locus and starting point of our moral requirements on which the author takes an explicit stance. First of all, by being founded on the list of dementia-specific capabilities, Soofi’s model places the source of our moral requirements of respect for the dignity of people with dementia within the persons themselves, ‘having some of the basis capabilities listed’ (p.6). Continental Philosophy of Social Science demonstrates the unique and autonomous nature of the continental approach to social science and contrasts it with the Anglo-American tradition. Yvonne Sherratt argues for the importance of an historical understanding of the Continental tradition in order to appreciate its individual, humanist character. Examining the key traditions of hermeneutic, genealogy, and critical theory, and the texts of major thinkers such as Gadamer, Ricoeur, Derrida, Nietzsche, Foucault, the Early Frankfurt School and Habermas, she also contextualizes contemporary (...) developments within strands of thought stemming back to Ancient Greece and Rome. Sherratt shows how these modes of thinking developed through medieval Christian thought into the Enlightenment and Romantic eras, before becoming mainstays of twentieth-century disciplines. The goal of this dissertation is two-fold. It is, first, to reconstruct Kant's argument against self-murder, and, second, to analyze the function of the principle of self-preservation of reason with regard to the prohibition of self-murder. I argue that self-murder is contrary to the principle of self-preservation of reason and violates the trustee-relationship between the homo phaenomenon and the homo noumenon. The analysis shows that moral self-preservation in Kant is a rational principle which serves to secure the possibility of moral (...) faith and self-perfection. ;In the first part of the dissertation, I provide a comprehensive analysis of Kant's argument against self-murder by examining all of the relevant statements in his works, the Nachlass, as well as the lectures recorded by Herder, Powalski, Collins, and Vigilantius. Since self-murder violates a perfect duty to oneself, key-topics of the analysis are: the dual status of the duty of self-preservation as both inner duty of right and duty of virtue, the right and end of humanity, as well as Kant's model of self-possession in terms of proprietas. The analysis makes clear that self-murder destroys the moral self and must be distinguished from sacrificing one's life in order to preserve one's moral integrity. ;In the second part of the dissertation, I interpret the duty of self-preservation and the prohibition of self-murder in the context of Kant's doctrine of the faith of reason and the principle of self-preservation of reason. I first provide an overview of the debate on self-preservation and its implications for an understanding of modern rationality and summarize the different meanings of -preservation in Kant. I then argue that the "principle of self-preservation of reason" consists in what Kant calls "the maxim of healthy reason" and that it grounds the faith and the unity of reason. Against the background of this analysis, I interpret the trustee-relationship between the homo phaenomenon and the homo noumenon as a model of moral self-obligation. Entrusting the homo phaenomenon to the homo noumenon, I contend, means to entrust life to practical reason and to subject oneself to the moral law. (shrink)

Cancer survivors are at risk for poor subjective well-being, but the potential beneficial effect of daily spiritual experiences is unknown. Using data from the second and third wave of the Midlife in the United States study, we examined the extent to which daily spiritual experiences at baseline moderate the association between subjective well-being at baseline and approximately 10 years later in cancer survivors. Regression analyses, controlled for age, educational attainment, and religious/spiritual coping, showed that daily spiritual experiences moderated the association (...) between life satisfaction at baseline and follow-up. Specifically, high spiritual experiences enhanced life satisfaction over time in cancer survivors with low life satisfaction at baseline. Also, daily spiritual experiences moderated the association between positive affect at baseline and follow-up, though this moderating effect was different for women and men. In this article I argue that Adorno makes an internal critique of instrumental reason. I depict Adorno's notion of instrumental reason by showing how he combines Freud's materialistic epistemology with his own German Idealist inheritance. Background: Within nursing, the concepts of home and homelike have been used indiscriminately to describe characteristics of healthcare settings that resemble a home more than an institution. Objectives: The aim of this study was to investigate the concept of home ( hem in Swedish). The main questions were as follows: What does the concept of home entail etymologically and semantically? Of what significance is the meaning of the concept to caring science and nursing? Design and methods: This study had a (...) qualitative design with a hermeneutical approach guided by Gadamer. Eriksson’s model of concept determination was partly used to determine the etymology and semantics, the essence and epistemic category of the concept of home. In this study, etymological dictionaries and 17 Swedish language dictionaries published between 1850 and 2001 were investigated. Ethical consideration: In all parts of this study, ethical guidelines have been followed concerning both gathering data from dictionaries and other sources and during the interpretation of these sources. Findings: The home, framed as the ethos of caring, can be drawn as a three-dimensional picture where the three dimensions have a common core, enclosed and inviolable. Symbolically, the picture of home can be seen as the ethos of the human being’s innermost room, the human being’s manner of being and the tone expressed in the external or abstract room where the human being lives and interacts with others. Conclusion: Based on the findings in this study, we conclude that home as ethos is an inner ethical dimension within the human being. Human beings who are in contact with their ethos, the self, feel at home and dare to follow the voice of their heart. Nurses who experience at-homeness have an ability to invite the patient into a caring relationship. The home and the feeling of being at home have significant meaning in terms of human beings’ health and well-being. (shrink)

Contemporary international law separates the international justice of war from the domestic justice of society, but empirically, there is a correlation between democratic governance and military effectiveness, which could have a number of causes. A contemporary reconstruction from _The Seven Military Classics_ of Chinese military philosophy offers potential lessons for how domestic virtues may yield military and geopolitical victory. This chapter reconstructs arguments from the seven treatises into a collective an amalgamated conception of “good governance” that weaves together military strategy (...) and virtue ethics and maintains that good governance at home actually wins wars abroad. A reconstructed classical Chinese conception of “good governance” presents theoretical and ethical challenges, but also offers viable justicial content for contemporary jus ad bellum considerations beyond sovereign self-defense or human rights. It presents a way of instantiating the sprawling conception of human rights that falls short in contemporary discourse. (shrink)

John Rawls’s writings on just war, though limited, shed important light on the ethics of political violence. This chapter explores Rawls’s contribution to just war theory, paying particular attention to how he differs from his contemporary, Michael Walzer, as well as from future methodological sympathizers, the “revisionists,” who also turn to analytical philosophy to draw insights about just war. In contrast to the “revisionists,” however, Rawls does not take the reductive individualist turn. Rather, he extends the original position that defines (...) the domestic setting to peoples inhabiting the international level. This assumption sets the stage for his theorizing about just war, which tracks closely with Kant (on democratic peace theory) and Walzer (on supreme emergency), while offering insights into just war against “outlaw” states, individual conscientious objection in response to unjust wars, and the role that just war tenets might play in setting the stage for peace. Ultimately, Rawls’s thinking about the place of political collectives in the international domain offers insights for better navigating the methodological disagreements between traditional and revisionist views of just war from a largely untapped but analytically rigorous, perspective. Die logische Frage ist eine der zentralsten, wenn nicht gar die zentralste Fragestellung der Philosophie des 19. Jahrhunderts. In ihr kristallisiert sich das Selbstverständnis der Philosophie, ihr Anspruch auf eine Deutungshoheit, ihre Stellung zu den ‚anderen‘ Wissenschaften. In seiner subjektiven Logik formuliert Hegel den Anspruch das „verknöcherte Material“ der klassischen Logik wieder in Bewegung zu bringen, um eine Neubestimmung der Logik und ihres Verhältnisses zu den Einzelwissenschaften zu ermöglichen. Die vorliegende Arbeit sucht Hegels subjektive Logik in den Kontext der das (...) 19. Jahrhundert prägenden Logikreformdiskussion zu stellen. Es soll dabei nicht darum gehen, das Schicksal der Philosophie an das Schicksal der Hegelschen Philosophie zu knüpfen, wohl aber um die Möglichkeit, Hegelsche Argumente innerhalb der Philosophie als einer immer noch aktuellen Zeit- und Streitfrage am Leben zu erhalten. Die Erörterung der logischen Frage schließt deshalb mit einer Hegelschen Antwort ab, die einen Ausblick auf eine kritische Naturphilosophie eröffnen soll. (shrink)

Focusing on the interactions between people suffering from neuromuscular diseases and their wheelchairs, the author raises the question of action: how is action made possible for people suffering from neuromuscular diseases? Starting with actor-network theory, the author shows that action not only results from distribution and delegation to heterogeneous entities but emerges from hard and lengthy work that makes the relation between them possible and transforms the entities involved. The author describes this work, called the process of adjustment, as work (...) on the links making a person, his or her body, and his or her world. Through this work, new possibilities of action emerge for the person, but also new abilities; the person’s identity is transformed and shaped. This analysis leads to a particular conception of the person as made up through his or her relations to other entities. (shrink)

Women generally initiate, lead, and constitute the rank and file of environmental justice activism. However, there is little research on why there are comparatively so few men involved in these movements. Using the environmental justice movement in the Central Appalachian coalfields as a case study, we examine the ways that environmental justice activism is gendered, with a focus on how women’s and men’s identities both shape and constrain their involvement in gendered ways. The analysis relies on 20 interviews with women (...) and men grassroots activists working for environmental justice in the coalfields of Appalachia. We find that women draw on their identities as “mothers” and “Appalachians” to justify their activism, while the hegemonic masculinity of the region, which is tied to the coal industry, has the opposite effect on men, deterring their movement involvement. We explore the implications of these findings for understanding the relationship of gender to environmental justice activism. (shrink)

Elle s’accompagne de nombreux autres affects – indignation, culpabilité, amertume, ressentiment, haine, désir de vengeance – devenus les dénominateurs communs d’une globalisation confuse. Violences politiques et terrorismes transnationaux, soulèvements populaires et protestations « indignées » à travers le monde, insurrections armées au long cours, montée des populismes et reflux des nationalismes, regains et consolidations autoritaires, haine de l’« autre », interminables guerres civiles et conflits gelés, rancœurs sociétales nouvelles comme (...) plus anciennes, belligérances numériques inédites… Inexorablement, sous nos yeux, c’est la colère qui semble dévorer une globalisation que d’aucuns qualifiaient autrefois d’« heureuse ». Cet article analyse ce qu’est « être en colère » et tente d’en saisir les rapports complexes au « global ». Assiste-t-on à un phénomène passager ou cet emportement général, visible partout, a-t-il déjà mué en logique durable? De quelle « globalisation » la colère est-elle le nom? (shrink)

Figure éminente de la Kulturkritik allemande, c’est-à-dire de la critique de la civilisation moderne, Siegfried Kracauer a rencontré Theodor W. Adorno alors que ce dernier, de quatorze ans son cadet, n’était encore que lycéen. Une amitié s’est nouée à travers le singulier rituel hebdomadaire d’une lecture de la Critique de la raison pure. Ce rituel qui a duré plusieurs années a tissé une durable amitié que des différends théoriques, survenus plus tard, ont néanmoins mise à rude épreuve. Les deux penseurs (...) ne se sont donc jamais perdus de vue et leur correspondance, telle un baromètre, enregistre leurs éloignements stellaires, leurs retrouvailles comme leurs conflits philosophiques. L'Essai sur l'être, traduit ci-dessous pour la première fois en français, fut rédigé par Herder en 1763-1764, pendant ses années d'études à Königsberg, à l'écoute de Kant. Reprenant et discutant certains des arguments développés par Kant dans ses conférences et écrits précritiques consacrés à la métaphysique, Herder pose les bases philosophiques de son œuvre future. L'étude du texte permet de réévaluer la thèse, jadis avancée par Dilthey, selon laquelle le futur protagoniste de Jacobi dans le débat sur le spinozisme infléchit (...) alors la pensée vers un « panthéisme esthétique » dont Hölderlin, Schelling et Hegel se feront plus tard les hérauts: le chemin suivi par la philosophie en Allemagne, après Kant, fut d'abord, effectivement, celui de l'esthétique — mais seulement parce que et dans la mesure où cette discipline fut comprise comme la « science du mode de connaissance et d'exposition sensible » (A. G. Baumgarten). Der Versuch über das Sein, hier erstmals in französischer Übersetzung vorgelegt, wurde von Herder in den Jahren 1763-1764 verfaßt, also während seiner Königsberger Studienjahre, als er regelmäßig die Vorlesungen Kants hörte. In der Aufnahme und in der Auseinandersetzung mit bestimmten Argumenten, die Kant in denjenigen seiner vorkritischen Vorlesungen und Schriften entwickelte, die der Metaphysik gewidmet sind, schuf Herder die philosophischen Grundlagen seines zukünftigen Werkes. Die vorliegende Deutung des herderschen Textes führt zu einer Neubewertung der seinerzeit von Dilthey vorgetragenen These, derzufolge dieser (neben Jacobi) zukünftige Hauptakteur im Pantheismusstreit das philosophische Denken in Richtung auf einen « ästhetischen Pantheismus » gebeugt habe, dessen Herolde später Hölderlin, Schelling und Hegel geworden wären. Der Weg der deutschen Philosophie nach Kant war tatsächlich derjenige der Ästhetik — allerdings nur dann, wenn diese Disziplin als die Wissenschaft, die das Sinnliche wahrnimmt und darstellt (A. G. An Irish Government directive to close colleges amid the Covid-19 pandemic resulted in a switch to emergency remote teaching. Many lecturers unused to practicing online began teaching students who were unfamiliar with online learning. Completion of the semester does not necessarily indicate that it is practicable for a more extended period. This paper queries four aspects of the sustainability of emergency remote teaching: its acceptance by stakeholders; its impact upon student motivation and faculty workload; and its effect upon learning outputs. (...) Questionnaires administered to undergraduate design students and faculty captured their respective experiences of emergency remote teaching. Acceptance of an extended pivot to online learning is not guaranteed, but will surely form a central facet of academic continuity. Increased working hours associated with online teaching endangers the work-life balance of lecturers, yet the same staff must find ways to support student motivation. Faculty’s reduced expectations of student output places strain upon the sustainability of online education founded upon an unplanned pivot. The experience of emergency remote teaching has created an opportunity for all parties to leverage the affordances of online learning – the challenge will be to ensure that all aspects of any extended switch to online are sustainable. Avec sa succession de bouleversements institutionnels, le dix-septième siècle anglais fut un fabuleux terrain d'expérimentation et de réflexion politique d'où surgirent les grandes théories modernes. A cette période, philosophes et acteurs engagés tentèrent de penser, avec une acuité particulière liée aux événements (guerres civiles, régicide, république, dictature), les tensions inhérentes au pouvoir, tout à la fois perçu comme contraignant, tyrannique et libérateur. Quatre d'entre eux ont été retenus : Thomas Hobbes (1588-1679), le théoricien de l’absolutisme, James Harrington (1611-1677), le républicain (...) classique, Algernon Sidney (1623-1683), le martyr whig, John Locke (1632-1704), le père du libéralisme. Le propos de l’ouvrage est de montrer que, par-delà leurs différences, ces quatre penseurs partagent une approche qui constitue le socle commun d’une théorie de l’Etat moderne. Leur doctrine s’affranchit de l’exercice utopique comme de la théorie de la raison d’Etat et se conçoit comme une anatomie du corps politique. Par un examen minutieux des textes, l’auteur cherche à s’écarter de l' interprétation trop « idéologique » sans doute accentuée par les combats de l’histoire. Elle met en évidence un objet philosophique commun aux quatre auteurs, que l’on retrouve au cœur de toute conception moderne du pouvoir. (shrink)

Lo digital descansa en la computación. La programación utiliza algoritmos. Los algoritmos son el conjunto de reglas que resuelven problemas en un número finito de pasos. En este sentido, el mundo digital está regido por cantidades, números, reglas fijas. El grado de libertad parece muy limitado. Por el contrario, la actividad artística y la creatividad descansan en la apertura, la libertad y en experiencias cualitativas. Estas experiencias no solo son vitales para la expresión artística, sino para la vida cotidiana. Los (...) mundos-vitales tecnológicos tal como se representan en tecnologías actuales (por ejemplo, en las casas inteligentes o en la conducción automática) o en la ciencia ficción no parecen dar cabida a estas estructuras abiertas. La filosofía de la tecnología está dividida: muchos sostienen que la tecnología determina en gran medida la cognición humana (como Mark B. N. Hansen, Bernard Stiegle) y, consiguientemente, subordina la cognición humana a las organizaciones maquinales. Otros adoptan una aproximación diferente y reflexionan sobre el potencial creativo de las nuevas tecnologías (Erin Mannig, Jaime del Val). Este artículo discute teorías que abordan la relación humano-máquina en tanto que estructuras complejas que van más allá de la visión distópica del ser humano siendo trascendido o incorporado por la tecnología. Estas aproximaciones son centrales para discutir el futuro del ser humano y la conformación político-cultural de los mundos vitales. Para entender cómo las relaciones humano-máquina pueden considerarse como procesos abiertos y creativos, presento narrativas de cognición corporalizada, ejemplos artísticos de estrategias de performance con sistemas algorítmicos, y finalmente engarzo estos aspectos en un panorama más amplio sobre la conceptualización de la tecnología y la vida humana como un continuo, en vez de una sostenida oposición o un estar determinado por el otro.
