It is a common assumption in ethics that everyone is due equal access to basic human goods. In our modern society, at least since the French Revolution, healthcare is counted along with food, shelter, and security as such a basic good. Anyone suffering from a treatable life-threatening disease can therefore, be seen as having a prima facie claim on medical treatment.

Excellence in the care of hospital patients, particularly those in an intensive care unit, reflects esprit de corps among the care team. Esprit de corps depends on a delicate balance; each clinician must preserve a sense of personal responsibility for “my” patient and yet participate in the collaborative work essential to the care of “our” patient. A harmful imbalance occurs when a physician demands total control of the decision-making process, especially concerning end-of-life treatment options. Although emotional factors may push a (...) physician to claim decision-making exclusivity, compounded by a legal framework that overemphasizes individual responsibility, esprit de corps can be preserved through timely communication among clinicians and a recognition that optimal care for “my” patient requires effective team practice. Previous research has demonstrated electroencephalogram (EEG) changes in response to low-odor concentrations, resulting in near-chance detection. Such findings have been taken as evidence for olfaction without awareness. We replicated and extended previous work by examining EEG responses to water-water control, 0.0001, 0.001, 0.01, and 1 ppm isoamyl acetate (IAA) in water paired with water only. Detection was above chance (>50%) for .001 and above, and alpha decreased only to those concentrations, suggesting that EEG changes corresponded to IAA awareness. However, when (...) correct trial EEGs were compared to incorrect trial EEGs during .001 ppm, right posterior/central alpha decreased during incorrect trials and alpha decreased more globally (including frontal sites) during correct trials. These data may not reflect awareness or unawareness per se. Instead, results are discussed regarding activation of perceptual systems in the posterior region during incorrect trials and the activation of frontal action systems during a subset of correct trials. This article observes that one of the most interesting developments in tort scholarship during recent years has been the emergence of a literature analyzing tort problems from feminist perspectives. The article looks at three of the areas that feminist writers have explored: the possibility of a "reasonable woman" standard as an alternative to the "reasonable man"; the possible recognition of a duty to rescue, which allegedly would be in harmony with feminist ethics; and the issue of how the tort system (...) should respond to types of harms that are disproportionately suffered by women. The article concludes that the feminist discussions of these topics have enriched the discourse of tort. Still, those discussions have been, in significant respects, inadequate. They have failed, for example, to take advantage of the relevant empirical information; and certain key issues relating to legal history and legal theory have remained underdeveloped. (shrink)

This article explores the differences and similarities between China and the West in terms of history.While the term itself is of ancient Greek origin, the "semantic field" of history resonates in many ways with the semantic field covered by the word hi in China. The original Greek usage, derived from Herodotus, means an inquiry into human affairs. The inquiry involved narrative over large stretches of time and space, but many of its main concerns were metahistorical in terms of nineteenth-century western (...) historicism. This is true of Thucydides and later even of Machiavelli. History was a casebook and a "mirror" of metahistorical experiences which could be used in an entirely unhistorical way to shed light on many areas of human ethical, political, and other modes of thought and behavior.The nineteenth-century western "historicist" view of history as a "master narrative" reflecting an irreversible, inexorable process of development shaping the entire destiny of the human race may have some of its roots in the Heilsgeschichte of the Hebrew Bible, particularly in its "progressivist" version. Historicism also implied that human beings were basically formed by their loci within their historical epoch and raised serious questions concerning the role of human agency in human affairs.In China--in contrast to the West--we find particularly in the Confucian stream of thought the early emergence of the idea of a metahistorical ideal order which had been realized within the human sphere in the past. Here the historical problem was the fatal human capacity to fall away from the principles of this normative order . The problem became: why does humanity depart from the good order and to what extent can it be restored?Despite the vastly different framework, we can find in China both the kind of "unhistorical" history which regards history as a reservoir of metahistorical experience in ethical, political, and other aspects of life, and a view which projects something like the image of an inexorable and impersonal historical process involving both the flourishing and decline of the normative order. Within the latter framework we find some dilemmas concerning the role of human agency that we find in post-Enlightenment, western "master narratives.". (shrink)

The present article proposes an integration between cultural psychology and developmental science. Such an integration would draw on the cultural-psychology principle of culture-psyche interactions, as well as on the developmental-science principle of person↔︎context relations. Our proposed integration centers on acculturation, which is inherently both cultural and developmental. Specifically, we propose that acculturation is governed by specific transactions between the individual and the cultural context, and that different types of international migrants (e.g., legal immigrants, undocumented immigrants, refugees, asylum seekers, crisis migrants) (...) encounter quite different culture-psyche interactions and person↔︎context relations. We outline the ways in which various acculturation-related phenomena, such as acculturation operating at macro-level versus micro-level time scales, can be viewed through cultural and developmental lenses. The article concludes with future directions in research on acculturation as an intersection of cultural and developmental processes. (shrink)

Business ethics educators have been encouraged to cultivate students’ character, but have received meager instructions for doing so. Additionally, there has been insufficient focus on equipping students with the tools they need to foster their ethical development after completing our courses. In this paper, it is argued that the Jewish spiritual practice of Mussar, whose premise is that individuals can become better versions of themselves by repairing their character traits, can inform business ethics instruction. After presenting the tenets and historical (...) background of Mussar, we provide specific information that will enable business ethics instructors to adapt its tools and techniques in order to put their students on a personalized path of lifelong character improvement. Mucopolysaccharidosis type I (MPS I) is a rare lysosomal storage disorder treated with bone marrow transplantation or enzyme replacement therapy with laronidase, a high-cost orphan drug. Laronidase was approved by the US Food and Drug Administration and the European Medicines Agency in 2003 and by the Brazilian National Health Surveillance Agency in 2005. Many Brazilian MPS I patients have been receiving laronidase despite the absence of a governmental policy regulating access to the drug. Epidemiological and treatment data concerning MPS I (...) are scarce. This study aims to present a demographic profile of Brazilian patients with MPS I, describe the routes of access to laronidase in Brazil, and discuss associated ethical issues relating to public funding of orphan drugs. The application of evidence-based medicine helps clinicians avoid unnecessary procedures and decreases unnecessary harm for future patients while sparing economic burdens. Randomised controlled trials (RCTs) most accurately produce best research evidence. In arthroscopic surgery, however, many procedures have been extensively used without supportive evidence verified with RCTs. In this paper, we introduce two procedures (arthroscopic partial menisectomy for degenerative knees and arthroscopic subacromial decompression for subacromial pain syndrome), where over 30 years of procedure usage has continued prior to garnering evidence (...) for the inefficacy of the procedures. The situations are attributed to the fact that clinical trials in arthroscopic surgeries are challenging given the use of placebo controls. A placebo-control RCT can accurately answer research questions about efficacy and safety of surgical procedures; however, the majority of arthroscopic surgeries in practice have not been rigorously tested against placebo surgeries. This is because preparing surgical placebo controls, known as sham surgeries, are ethically controversial. Also considering that high-quality study results often do not change clinical practice due to insufficient knowledge translation, the benefits of such trials may be uncertain to society at large. Additionally, there are a lack of clear guidelines for conducting arthroscopic placebo surgeries in RCTs. We hope that this article helps drive discussion about appropriate use of placebo surgeries in RCTs to produce the best quality evidence in arthroscopic surgery. (shrink)

En buena medida, este desacuerdo tiene que ver con la relación entre el consentimiento constitutivo y la obligación política. De acuerdo con una interpretación de Suárez, el consentimiento constitutivo no crea obligación política; más bien tal obligación corresponde a la comunidad política en virtud de la clase de entidad que sea. Argumento en contra de esta interpretación de Suárez al proponer que los efectos (...) del consentimiento constitutivo deberían ser comprendidos a la luz del tratamiento que ofrece Suárez de "actos operativos" como votos, promesas y juramentos. Defiendo que muchos de los pasajes de Suárez han sido incorrectamente interpretados como apoyo de una lectura organicista, cuando en realidad corresponden al planteamiento que hace de la causación moral. Speech is a perceptuo-motor system. A natural computational modeling framework is provided by cognitive robotics, or more precisely speech robotics, which is also based on embodiment, multimodality, development, and interaction. This paper describes the bases of a virtual baby robot which consists in an articulatory model that integrates the non-uniform growth of the vocal tract, a set of sensors, and a learning model. The articulatory model delivers sagittal contour, lip shape and acoustic formants from seven input parameters that characterize the (...) configurations of the jaw, the tongue, the lips and the larynx. To simulate the growth of the vocal tract from birth to adulthood, a process modifies the longitudinal dimension of the vocal tract shape as a function of age. The auditory system of the robot comprises a “phasic” system for event detection over time, and a “tonic” system to track formants. The model of visual perception specifies the basic lips characteristics: height, width, area and protrusion. The orosensorial channel, which provides the tactile sensation on the lips, the tongue and the palate, is elaborated as a model for the prediction of tongue-palatal contacts from articulatory commands. Learning involves Bayesian programming, in which there are two phases: specification of the variables, decomposition of the joint distribution and identification of the free parameters through exploration of a learning set, and utilization which relies on questions about the joint distribution. Two studies were performed with this system. Each of them focused on one of the two basic mechanisms, which ought to be at work in the initial periods of speech acquisition, namely vocal exploration and vocal imitation. The first study attempted to assess infants’ motor skills before and at the beginning of canonical babbling. It used the model to infer the acoustic regions, the articulatory degrees of freedom and the vocal tract shapes that are the likeliest explored by actual infants according to their vocalizations. Subsequently, the aim was to simulate data reported in the literature on early vocal imitation, in order to test whether and how the robot was able to reproduce them and to gain some insights into the actual cognitive representations that might be involved in this behavior. Speech modeling in a robotics framework should contribute to a computational approach of sensori-motor interactions in speech communication, which seems crucial for future progress in the study of speech and language ontogeny and phylogeny. No single theory so far proposed gives a wholly satisfactory account of the origin and maintenance of bird-song dialects. This failure is the consequence of a weak comparative literature that precludes careful comparisons among species or studies, and of the complexity of the issues involved. Complexity arises because dialects seem to bear upon a wide range of features in the life history of bird species. We give an account of the principal issues in bird-song dialects: evolution of vocal learning, experimental (...) findings on song ontogeny, dialect descriptions, female and male reactions to differences in dialect, and population genetics and dispersal.We present a synthetic theory of the origin and maintenance of song dialects, one that accommodates most of the different systems reported in the literature. The few data available suggest that large, regional dialect populations are genetically differentiated; this pattern is correlated with reduced dispersal between dialects, assortative mating by females, and male-male exclusion. At the same time, “subdialects” may be formed within regional dialects. Subdialect clusters are usually small and may represent vocal mimicry among a few adjacent territorial males. The relative importance of genetic and social adaptation may contribute to the emergence of subdialects; their distinctiveness may be correlated with the degree of polygyny, for example. Thus, subdialect formation is linked to one theory of the evolution of repertoire size, but data are too fragmentary to examine this idea critically. (shrink)

It is puzzling that Alain Locke and Ernst Cassirer’s philosophies of culture have been little explored. It is my contention that Locke and Cassirer posit a functional logic of value (among other ideas). Both establish the importance of functionality for developing a pluralist understanding of cultural value while also critiquing a lack of social belonging and retreat into mythic consciousness. First, I will present an overview of Locke and Cassirer’s functional logic of value, speculating that the two met at the (...) University of Berlin. Perhaps together they embraced freeing value from validity and vice versa, in the manner that Locke eloquently put it: Neither is the valuable necessarily valid, nor is the valid necessarily valuable. Although we have no evidence of such an encounter, it is difficult to believe that the two did not cross paths. Next, I will explore how both develop pluralist philosophies of culture. Notably, how race consciousness and kinship feelings-judgments add to our understanding and formation of the symbolic forms. In the final section, I will apply Locke and Cassirer’s functional axiologies to address what I call the darker political myths within the United States’ cultural context. Locke and Cassirer’s philosophies of functional value work to resist attempts to make one’s values into absolute or hegemonic ones. Overcoming closed and authoritative forms of mythic consciousness is a worthy endeavor given their current seductiveness and propensity to destroy rather than create cultural values. (shrink)

In a recent paper, Guy Kahane asks whether God’s existence is something we should want to be true. Expanding on some cryptic remarks from Thomas Nagel, Kahane’s informative and wide-ranging piece eventually addresses whether personal anti-theism is justified, where personal anti-theism is the view that God’s existence would make things worse overall for oneself. In what follows, I develop, defend, but ultimately reject the Meaningful Life Argument, according to which if God’s existence precludes the realization of certain goods that seem (...) to an agent to constitute a meaningful life, it is rational for an agent both to believe that personal anti-theism is true and to prefer that God not exist.
