This thesis explores the role and nature of intuition in philosophical inquiry. Appeals to intuition have either been used as evidence for or against philosophical theories or as constitutive features of judgement. I attempt to understand our uses of intuition by appealing to tacit knowledge. The hope is to elicit a picture of intuition as being practical and explanatory. Our reliance on intuition is warranted if we understand it as an expression of tacit knowledge.

Testimony is of epistemic and practical significance. It is of epistemic significance because majority of what we know and believe comes from being told. It is of practical significance because our agency can be undermined, bypassed, or overridden owing to systemic prejudices sustained by oppressive social or cultural practices and subsequently our routes to knowledge are either hindered or distorted. Things get more complicated when we introduce and examine how groups and other collectives testify and are recipients of testimony. For (...) instance, group speakers are typically said to represent and reflect the view of the group they are speaking on behalf of. But sometimes because of these oppressive practices, a group speaker’s assertion may deprive or impair its members’ ability to perform certain actions through speech. This dissertation examines the intersection between testimony, collective phenomena, and epistemic harms. One aim is to argue for a view on the nature of testimony that can accommodate various ways collectives testify and are recipients of testimony. In particular, I argue and present a view of testimony as a norm-governed joint activity involving individual or collective participants that commit themselves to a common aim of collaboration. Another aim is to present an epistemology of testimony that tracks our ordinary testimonial practices. In this regard, I argue for a norm view where we have reason to believe what we’re told because of the rules or norms that govern our communicative exchanges. A final aim is to explore the mechanism by which collective speech ensues in an epistemic harm driven by social identity prejudices. I argue for a form of silencing that is distinctive of groups insofar as the silencing occurs because of group dynamics. I call the mechanism underlying this form of silencing “representational impairment”. This dissertation, I hope, will motivate and inspire others to pursue philosophical projects at these intersections and in this spirit, I end by offering suggestions on areas of further development and future direction. What makes someone responsible for a crime and therefore liable to punishment under the criminal law? Modern lawyers will quickly and easily point to the criminal law's requirement of concurrent actus reus and mens rea, doctrines of the criminal law which ensure that someone will only be found criminally responsible if they have committed criminal conduct while possessing capacities of understanding, awareness, and self-control at the time of offense. Any notion of criminal responsibility based on the character of the offender, (...) meaning an implication of criminality based on reputation or the assumed disposition of the person, would seem to today's criminal lawyer a relic of the 18th Century. In this volume, Nicola Lacey demonstrates that the practice of character-based patterns of attribution was not laid to rest in 18th Century criminal law, but is alive and well in contemporary English criminal responsibility-attribution. Building upon the analysis of criminal responsibility in her previous book, Women, Crime, and Character, Lacey investigates the changing nature of criminal responsibility in English law from the mid-18th Century to the early 21st Century. Through a combined philosophical, historical, and socio-legal approach, this volume evidences how the theory behind criminal responsibility has shifted over time. The character and outcome responsibility which dominated criminal law in the 18th Century diminished in ideological importance in the following two centuries, when the idea of responsibility as founded in capacity was gradually established as the core of criminal law. Lacey traces the historical trajectory of responsibility into the 21st Century, arguing that ideas of character responsibility and the discourse of responsibility as founded in risk are enjoying a renaissance in the modern criminal law. These ideas of criminal responsibility are explored through an examination of the institutions through which they are produced, interpreted and executed; the interests which have shaped both doctrines and institutions; and the substantive social functions which criminal law and punishment have been expected to perform at different points in history. Si son inspiration est cartesienne, Malebranche y soutient d'emblee une theorie originale de la connaissance, de la verite et de la causalite: notamment la these de la vision en Dieu des idees et l'analyse des causes de l'erreur. Plus qu'une theorie de la connaissance, c'est donc une theorie complete de l'esprit humain et de ses multiples fonctions (...) que nous livre l'ouvrage. Cette nouvelle edition de la Recherche de la verite donne a lire pour la premiere fois dans un format accessible a tous, un texte majeur de la pensee moderne, heritier de l'age classique et annonciateur des Lumieres: les textes sont etablis a partir des deux dernieres editions de 1700 et 1712 revues par Malebranche lui-meme, et des trois premiers volumes des oeuvres Completes publiees sous la direction d'Andre Robinet; l'orthographe a ete modernisee. La ponctuation a fait l'objet d'une revision systematique; les textes cites en langue etrangere ont ete traduits ou retraduits, et leurs references mises a jour afin de tenir compte des editions les plus recentes. Enfin, le lecteur trouvera, dans ce premier volume, une presentation eclairante de cette oeuvre par Jean-Christophe Bardout, offrant ainsi des grilles de lecture et de comprehension de cet ouvrage majeur du XVIIe siecle, qui n'avait jusqu'alors fait l'objet d'aucune etude specifique. In this paper, we investigate how certain types of predicates should be connected with certain types of degree scales, and how this can affect the events they describe. The distribution and interpretation of various degree adverbials will serve us as a guideline in this perspective. They suggest that two main types of degree scales should be distinguished: (i) quantity scales, which are characterized by the semantic equivalence of Yannig ate the cake partially and Yannig ate part of the cake; quantity (...) scales only appear with verbs possessing an incremental theme (cf. Dowty 1991); (ii) intensity scales, which are characterized by degree modifiers (e.g., extremely, perfectly) receiving an intensive interpretation; intensity scales typically occur with verbs morphologically related to an adjective (to dry). More generally, we capitalize on a typology of degree structures to explain how degrees play a central role with respect to event structure. (shrink)

This article examines the relationship between globalization, care and migration, with specific reference to the ‘global care chain’ concept. The utility of this concept is explored in the light of its current and potential contributions to research on the international division of reproductive labour and transnational care economies. The article asserts the validity of global care chain analysis but argues that its present application to migrant domestic care workers must be broadened in order that its potential may be fully realized. Accordingly, five ways in which the concept could be more broadly applied are outlined and applications of this expanded framework are illustrated through a case study of nurse migration in the Irish context. Finally, the discussion considers future directions for empirical and theoretical research into global care chains and suggests various lines of enquiry. (shrink)

In this article, I identify “spontaneity” as a significant but poorly-analyzed term in social theory and description through an overview of tensions between varying technical accounts of spontaneity in research literature. In contrast to conceptually-slippery “realist” accounts of spontaneity, I argue for viewing spontaneity ethnomethodologically, i.e., as a contextually-emergent social practice. I suggest two directions for future applications of this approach: first, an ethnomethodological approach to rhetorical analysis of unanalyzed use of the term “spontaneity” in research literature, and second, observational (...) studies of improvisational theatre, a social practice in which orientation toward the production of spontaneity by participants is criterial to the identity of the practice. Most physics theories are deterministic, with the notable exception of quantum mechanics which, however, comes plagued by the so-called measurement problem. This state of affairs might well be due to the inability of standard mathematics to “speak” of indeterminism, its inability to present us a worldview in which new information is created as time passes. In such a case, scientific determinism would only be an illusion due to the timeless mathematical language scientists use. To investigate this possibility it is necessary (...) to develop an alternative mathematical language that is both powerful enough to allow scientists to compute predictions and compatible with indeterminism and the passage of time. We suggest that intuitionistic mathematics provides such a language and we illustrate it in simple terms. (shrink)

La publication des "Cahiers" redonne une actualité brûlante à la question qui divise épigones et détracteurs du penseur allemand : comment continuer à philosopher avec Heidegger sans tenir compte d'une éventuelle contamination de cette philosophie par l'idéologie nazie? Par une analyse sans concession des "Cahiers", en se concentrant sur les Réflexions (tenues par Heidegger de 1931 à 1941) (...) mais tout en cherchant à en dégager les éléments proprement philosophiques, cet ouvrage invite à une approche équilibrée, quitte à "penser avec Heidegger, contre Heidegger", comme le suggérait Jürgen Habermas dès le début des années 1950. Il montre notamment comment l'auteur d'Etre et temps, en inventant une nouvelle forme de philosopher, a poursuivi et prolongé dans ces carnets la critique de la modernité telle qu'elle a été formulée par la "révolution conservatrice" allemande et par Oswald Spengler, le théoricien du déclin de l'Occident. It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality. In recent years much research has been undertaken regarding the feasibility of the human uterine transplant as a treatment for absolute uterine factor infertility. Should it reach clinical application this procedure would allow such individuals what is often a much-desired opportunity to become not only social mothers, or genetic and social mothers but mothers in a social, genetic and gestational sense. Like many experimental transplantation procedures such as face, hand, corneal and larynx transplants, UTx as a therapeutic option falls firmly (...) into the camp of the quality of life transplant, undertaken with the aim, not to save a life, but to enrich one. However, unlike most of these novel procedures – where one would be unlikely to find a willing living donor or an ethics committee that would sanction such a donation – the organs to be transplanted in UTx are potentially available from both living and deceased donors. In this article, in the light of the recent nine-case research trial in Sweden which used uteri obtained from living donors, and the assertions on the part of a number of other research teams currently preparing trials that they will only be using deceased donors, I explore the question of whether, in the case of UTx, there exist compelling moral reasons to prefer the use of deceased donors despite the benefits that may be associated with the use of organs obtained from the living. L'objet de cet article est d'examiner en quoi la phrase nominale existentielle : (a) "Lecture pendant toute la matinée" (b) "Lecture d'un poème" (c) "Lecture" peut être concernée par la distinction aspectuelle télique / atélique. Nous avons examiné les phrases qui, notamment à cause du type d'expression nominale employé, renvoient à un événement, un processus ou un état. Celles qui renvoient à un événement sont téliques, les autres sont atéliques, comme dans le cas des expressions verbales. Nous avons étudié les (...) énoncés nominaux qui comportent un circonstant (a) pouvant influer sur l'aspect télique ou atélique de l'énoncé et les énoncés qui renferment uniquement un groupe nominal, comme en (b), ou un simple nom comme en (c). Il ressort de cette étude i) que le caractère télique ou atélique d'une phrase nominale existentielle dépend non seulement du type de nom utilisé, mais aussi de facteurs syntaxiques (circonstant, complément, adjectif et déterminant du nom) voire contextuels (l'énoncé précédent); ii) que la phrase nominale existentielle impose certaines contraintes d'emploi, notamment par rapport aux déterminants, ce qui peut freiner l'observation de la télicité pour certains groupes nominaux. In the last two decades an increasing number of musicians, musicologists and philosophers in the United States of America have dealt with questions of philosophy of music on a phenomenological basis. F. Joseph Smith certainly deserves mention as one of the first and most innovative of these authors. Sections 1 and 2 of the paper sketch a portrait of Smith against the background of the current situation in America, where there is a strong awareness of the need to overcome the (...) present limits imposed by historical musicology in order to develop a new phenomenological approach. Section 3 expounds Smith 's critique against traditional theory of musical form and his attempt to redefine musical form on the basis of Husserl's treatise on passive synthesis. This, in the author's opinion, is Smith 's most important contribution to a phenomenologically oriented philosophy of music. Finally, section 4 tries to draw some critical conclusions concerning Smith 's work, with special regard to the merits and demerits of his idea of phenomenology as applied to music. (shrink)

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

When attempting to determine which of our acts affect future generations and which affect the identities of those who make up such generations, accounts of personal identity that privilege psychological features and person affecting accounts of morality, whilst highly useful when discussing the rights and wrongs of acts relating to extant persons, seem to come up short. On such approaches it is often held that the intuition that future persons can be harmed by decisions made prior to their existence is (...) mistaken as identity is a most fragile thing with even the smallest differences in the conditions under which we procreate affecting not the interests of distinct future persons, but the identities of those who will come to exist in the future. Within this paper I reject this view, holding that a subscription to these two accounts need not result in the conclusion that virtually all acts relating to possible persons are permitted. Further, I argue that such accounts may in fact allow a great deal more scope for the determination of prenatal harms than accounts of personal identity that privilege physical features. Finally, by interpreting claims regarding causal identity such as Parfit’s Time Dependence Claim in terms of Counterpart Theory I suggest that a solution to the non-identity problem can be found in the acceptance of, as relevant in prenatal cases, three kinds of objective similarity relations: Biological, Environmental and Decisional counterpart relations. Human cognition and behavior are dominated by symbol use. This paper examines the social learning strategies that give rise to symbolic communication. Experiment 1 contrasts an individual-level account, based on observational learning and cognitive bias, with an inter-individual account, based on social coordinative learning. Participants played a referential communication game in which they tried to communicate a range of recurring meanings to a partner by drawing, but without using their conventional language. Individual-level learning, via observation and cognitive bias, was sufficient (...) to produce signs that became increasingly effective, efficient, and shared over games. However, breaking a referential precedent eliminated these benefits. The most effective, most efficient, and most shared signs arose when participants could directly interact with their partner, indicating that social coordinative learning is important to the creation of shared symbols. Experiment 2 investigated the contribution of two distinct aspects of social interaction: behavior alignment and concurrent partner feedback. Each played a complementary role in the creation of shared symbols: Behavior alignment primarily drove communication effectiveness, and partner feedback primarily drove the efficiency of the evolved signs. In conclusion, inter-individual social coordinative learning is important to the evolution of effective, efficient, and shared symbols. (shrink)
