American legal scholar MacKinnon held that using consent as the legal criterion to draw the line between rape and intercourse would evade the issue of male dominance in heterosexual relations. Feminist lawyers in the Netherlands and England and Wales translated the insight that rape has to do with inequality between the sexes in alternative definitions of rape. They also struggled to get these alternative definitions incorporated in law. However, in the Netherlands as well as in England and Wales, feminist proposals (...) to broaden the concept of coercion or non-consent to include submission met with serious obstacles from within the legal system. This article describes the process the feminist proposals to redefine coercion or non-consent in rape law went through in the Netherlands and in England and Wales. It tries to answer the following question: To what extent can the obstacles in this process of forming a broad definition of coercion be attributed to what MacKinnon called the inherent fallocentrism of law? The neural basis of developmental changes in transitive reasoning in parietal regions was examined, using voxel-based morphometry. Young adolescents and adults performed a transitive reasoning task, subsequent to undergoing anatomical magnetic resonance imaging brain scans. Behaviorally, adults reasoned more accurately than did the young adolescents. Neural results showed less grey matter density in superior parietal cortex in the adults than in the young adolescents, possibly due to a developmental period of synaptic pruning; improved performance in the reasoning task was negatively (...) correlated with grey matter density in superior parietal cortex in the adolescents, but not in the adult group; and the latter results were driven by the more difficult trials, requiring greater spatial manipulation. Background Informed consent is a requirement for all research. It is not, however, clear how much information is sufficient to make an informed decision about participation in research. Information on an online questionnaire about childhood development was provided through an unfolding electronic participant sheet in three levels of information. Methods 552 participants, who completed the web-based survey, accessed and spent time reading the participant information sheet (PIS) between July 2008 and November 2009. The information behaviour of the participants was investigated. (...) The first level contained less information than might be found on a standard PIS, the second level corresponded to a standard PIS, and the third contained more information than on a standard PIS. The actual time spent on reading the information provided in three incremental levels and the participants' evaluation of the information were calculated. Results 77% of the participants chose to access the first level of information, whereas 12% accessed the first two levels, 6% accessed all three levels of information and 23% participated without accessing information. The most accessed levels of information were those that corresponded to the average reading times. Conclusion The brief information provided in the first level was sufficient for participants to make informed decisions, while a sizeable minority of the participants chose not to access any information at all. This study adds to the debate about how much information is required to make a decision about participation in research and the results may help inform the future development of information sheets by providing data on participants' actual needs when deciding about questionnaire surveys. Introduction Research supports the efficacy of both a remedial consent procedure ) and a motivational consent procedure for improving recall of informed consent to research. Although these strategies were statistically superior to standard consent, effects were modest and not clinically significant. This study examines a combined incentivised consent and CF procedure that simplifies the cognitive task and increases motivation to learn consent information.Methods We randomly assigned 104 individuals consenting to an unrelated host study to a consent as usual condition or (...) an incentivised CF condition . All participants were told they would be quizzed on their consent recall following their baseline assessment and at 4 monthly follow-ups. ICF participants were also informed that they would earn $5 for each correct answer and receive CF as needed.Results Quiz scores in the two conditions did not differ at the first administration ; however, ICF scores were significantly higher at each subsequent administration .Conclusions The ICF procedure increased consent recall from 72% to 83%, compared with the CAU condition in which recall decreased from 69% to 59%. This supports the statistical and clinical utility of a combined remedial and motivational consent procedure for enhancing recall of study information and human research protections. (shrink)

Citing of previous publications is an important factor in knowledge development. Because of the great amount of publications available, only a selection of studies gets cited, for varying reasons. If the selection of citations is associated with study outcome this is called citation bias. We will study determinants of citation in a broader sense, including e.g. study design, journal impact factor or the funding source of the publication. As a case study we assess which factors drive citation in the human (...) literature on phthalates, specifically the metabolite mono phthalate. A systematic literature search identified all relevant publications on human health effect of MEHP. Data on potential determinants of citation were extracted in duplo. Specialized software was used to create a citation network, including all potential citation pathways. Random effect logistic regression was used to assess whether these determinants influence the likelihood of citation. 112 Publications on MEHP were identified, with 5684 potential citation pathways of which 551 were actual citations. Reporting of a harmful point estimate, journal impact factor, authority of the author, a male corresponding author, research performed in North America and self-citation were positively associated with the likelihood of being cited. In the literature on MEHP, citation is mostly driven by a number of factors that are not related to study outcome. Although the identified determinants do not necessarily give strong indications of bias, it shows selective use of published literature for a variety of reasons. (shrink)

Background: Studies of sexual conditioning typically focus on the development of conditioned responses to a stimulus that precedes and has become associated with a sexual unconditioned stimulus (US). Such a sexually conditioned stimulus (CS) provides the opportunity for feed-forward regulation of sexual behavior, which improves the efficiency and effectiveness of the sexual activity. Objective and Design: The present experiments were conducted to provide evidence of such feed-forward regulation of sexual behavior in laboratory studies with domesticated quail by measuring how many (...) fertilized eggs were produced by the female after the sexual encounter. During the conditioning phase, male and female quail received a conditioned stimulus paired with the opportunity to copulate with each other. Results: Sexual conditioning increased the number of eggs that were fertilized as a consequence of copulation, especially if both the male and the female were exposed to the sexual CS. This conditioned fertility effect occurred with a range of CS durations and CS types. The conditioned fertility effect also occurred in situations involving sexual competition. When two males copulated with the same female, DNA fingerprinting showed that the male whose sexual encounter was signaled by a sexual CS was responsible for most of the resulting offspring. Sexual conditioning also reduced the first-male disadvantage in fertilization that occurs when two males copulate with the same female separated by several hours. Another significant finding was that sexual conditioning attenuated the usual drop in fertilization rate that occurs when the same male copulates with two females in succession. Conclusion: These results show that sexual conditioning increases the number of offspring that are produced in both isolated male-female encounters and in situations that involve two males copulating with the same female or one male copulating with more than one female. By increasing fertilization rates, sexual conditioning can alter genetic transmission across generations and shape evolutionary change. BackgroundKnowledge development depends on an unbiased representation of the available evidence. Selective citation may distort this representation. Recently, some controversy emerged regarding the possible impact of swimming on childhood asthma, raising the question about the role of selective citation in this field. Our objective was to assess the occurrence and determinants of selective citation in scientific publications on the relationship between swimming in chlorinated pools and childhood asthma.MethodsWe identified scientific journal articles on this relationship via a systematic literature search. The (...) following factors were taken into account: study outcome (authors’ conclusion, data-based conclusion), other content-related article characteristics (article type, sample size, research quality, specificity), content-unrelated article characteristics (language, publication title, funding source, number of authors, number of affiliations, number of references, journal impact factor), author characteristics (gender, country, affiliation), and citation characteristics (time to citation, authority, self-citation). To assess the impact of these factors on citation, we performed a series of univariate and adjusted random-effects logistic regressions, with potential citation path as unit of analysis.ResultsThirty-six articles were identified in this network, consisting of 570 potential citation paths of which 191 (34%) were realized. There was strong evidence that articles with at least one author in common, cited each other more often than articles that had no common authors (odds ratio (OR) 5.2, 95% confidence interval (CI) 3.1–8.8). Similarly, the chance of being cited was higher for articles that were empirical rather than narrative (OR 4.2, CI 2.6–6.7), that reported a large sample size (OR 5.8, CI 2.9–11.6), and that were written by authors with a high authority within the network (OR 4.1, CI 2.1–8.0). Further, there was some evidence for citation bias: articles that confirmed the relation between swimming and asthma were cited more often (OR 1.8, CI 1.1–2.9), but this finding was not robust.ConclusionsThere is clear evidence of selective citation in this research field, but the evidence for citation bias is not very strong. The orthodox view of logic takes for granted the central importance of logical principles. Logic, and thus logical reasoning, is to be understood as a system of rules or principles with universal application. Let us call this orthodox view logical generalism. In this paper we argue that logical generalism, whether monist or pluralist, is wrong. We then outline an account of logical consequence in the absence of general logical principles, which we call logical particularism.

IntroductionBisphenol A is highly debated and studied in relation to a variety of health outcomes. This large variation in the literature makes BPA a topic that is prone to selective use of literature, in order to underpin one’s own findings and opinion. Over time, selective use of literature, by means of citations, can lead to a skewed knowledge development and a biased scientific consensus. In this study, we assess which factors drive citation and whether this results in the overrepresentation of (...) harmful health effects of BPA.MethodsA citation network analysis was performed to test various determinants of citation. A systematic search identified all relevant publications on the human health effect of BPA. Data were extracted on potential determinants of selective citation, such as study outcome, study design, sample size, journal impact factor, authority of the author, self-citation, and funding source. We applied random effect logistic regression to assess whether these determinants influence the likelihood of citation.ResultsOne hundred sixty-nine publications on BPA were identified, with 12,432 potential citation pathways of which 808 citations occurred. The network consisted of 63 cross-sectional studies, 34 cohort studies, 29 case-control studies, 35 narrative reviews, and 8 systematic reviews. Positive studies have a 1.5 times greater chance of being cited compared to negative studies. Additionally, the authority of the author and self-citation are consistently found to be positively associated with the likelihood of being cited. Overall, the network seems to be highly influenced by two highly cited publications, whereas 60 out of 169 publications received no citations.ConclusionIn the literature on BPA, citation is mostly driven by positive study outcome and author-related factors, such as high authority within the network. Interpreting the impact of these factors and the big influence of a few highly cited publications, it can be questioned to which extent the knowledge development in human literature on BPA is actually evidence-based. Hermeneutical injustice, as a species of epistemic injustice, is when members of marginalized groups are unable to make their experiences communicatively intelligible due to a deficiency in collective hermeneutical resources, where this deficiency is traditionally interpreted as a lack of concepts. Against this understanding, this paper argues that even if adequate concepts that describe marginalized groups’ experiences are available within the collective hermeneutical resources, hermeneutical injustice can persist. This paper offers an analysis of how this can happen by introducing the (...) notion of hermeneutical excess: the introduction of additional concepts into collective hermeneutical resources that function to obscure agents’ understanding of the lived experiences of marginalized groups. The injustice of hermeneutical excesses happens not due to hermeneutical marginalization (the exclusion of members of marginalized groups from the construction of hermeneutical resources), but rather hermeneutical domination: when members of dominant groups have been inappropriately included in the construction of hermeneutical resources. By taking as exemplary cases the concepts of “reverse racism” and “non-consensual sex” this paper shows how such excesses are introduced as a kind of defensive strategy used by dominant ideologies precisely when progress with social justice is made. Rather, these sciences provide fresh insight into human agency and updated criteria as well as powerful diagnostic and intervention tools for assessing and altering minds.

Passages from the writings of Immanuel Kant concerning how a person should treat her body are often cited in the present‐day debate about a market for human body parts. In this paper, I demonstrate that this has been a misuse of Kant because unlike those who cite him, Kant was not primarily concerned with prohibiting the sale of body parts. In the first section, I argue that once these particular passages are understood against the background of Kant’s moral philosophy, they (...) indicate he had much broader concerns relating to the correct moral relationship a rational person should have with her body. In the second section, I examine Stephen Munzer’s unusually detailed analysis of these passages, but conclude that like those who have provided less detailed analyses, he also fails fully to understand the rationale for Kant’s various prescriptions and prohibitions concerning the treatment of human body parts, and in doing so misrepresents Kant’s position. Calls to abolish race as a proxy for biology or genetics in clinical care have reached a fever pitch in the latter half of 2020, including articles in the New England Journal of Medicine, and urgent letters from prominent Senators.

Nicole Hassoun here makes a philosophical argument for health, and access to essential medicines, as essential human rights, and she proposes the Global Health Impact system as a way to ensure those rights. She reports how life-saving medicines are inaccessible and costly for the global poor, and that rather than focusing on treatments for critical, deadly global health problems, pharmaceutical companies instead invest in more profitable drugs. To address this problem, Hassoun's proposal will rate pharmaceutical companies based on their medicines' (...) impact on the improvement of global health, and will reward highly-rated medicines with a Global Health Impact label. Logics—that is to say logical systems—are generally conceived of as describing the logical forms of arguments as well as endorsing cer- tain principles or rules of inference specified in terms of these forms. From this perspective, a correct logic is a system which captures only (and perhaps all) of the correct principles, and good—i.e. logical— reasoning is reasoning which at the level of logical form conforms to the principles of a correct logic. In contrast, as logical particularists we reject the (...) idea that logical validity is a property of logical forms or schema, and instead take validity to be a property of particular in- ferences. In this paper we describe and defend this radically different approach to validity, and explore the particularist understanding of the relationship between logical systems and logical reasoning. The face of the world is changing. The past century has seen the incredible growth of international institutions. How does the fact that the world is becoming more interconnected change institutions' duties to people beyond borders? Does globalization alone engender any ethical obligations? In Globalization and Global Justice, Nicole Hassoun addresses these questions and advances a new argument for the conclusion that there are significant obligations to the global poor. First, she argues that there are many coercive international institutions and (...) that these institutions must provide the means for their subjects to avoid severe poverty. Hassoun then considers the case for aid and trade, and concludes with a new proposal for fair trade in pharmaceuticals and biotechnology. While rich countries like the USA and UK are starting to vaccinate their populations against COVID-19, poor countries may lack access to a vaccine for years. A global effort to provide vaccines through the COVAX facility Accelerator) aims to distribute 2 billion vaccinations by the end of next year, but the USA has refused to join and even those rich countries that have joined are entering into bilateral deals with pharmaceutical companies to buy up the supply. Canada, for instance, has (...) already secured enough to vaccinate its entire population nine times over, and the USA, European Union, UK, Australia and Japan can vaccinate their populations between 2 and 8 x.1 Vaccine nationalism is neither ethically justified, nor even in rich countries’ long-term self-interest. No one deserves the luck of their birth and few have much control over their country of residence. So, when there are four ventilators per 12 million people in some low-income and middle-income countries, and people are being buried in cardboard boxes in mass graves, it is simply unconscionable to argue that wealthy countries can keep their vaccines to themselves or even help their populations first.2 Vaccine nationalism fails to respect basic human rights and the people who have them. Moreover, many argue that rich countries have contributed to global poverty through a shared and violent history of colonialism and oppression and profit from instituting, upholding and sustaining coercive rules that often exacerbate, rather than alleviate, global poverty.3 Be that as it may, putting basic health systems in place to ensure everyone can get vaccinated, not only against COVID-19 but a host of other terrible diseases, would better protect even the rich from …. During the fifteenth century the organic body politic metaphor was gradually associated or superseded by a physiological paradigm built on the ancient humoral theory. The new body politic, based on humours rather than on organs, eventually became a dynamic and fluid entity. Authors such as Nicole Oresme or Jean Gerson alleged that the etiology of humoral imbalance had its origins in growing social inequalities; Claude de Seyssel subsequently urged that the cure to restore the humoral balance should focus on creating (...) new hope and bridges for the gifted. Seyssel was able to draw up his pioneering manifesto for social mobility thanks to the new physiological image of the civic body. The present study argues that such a physiological conception transformed anxiety about motion and disarray into a belief that social fluidity was indispensable to the well-being and health of the whole body, but the idea that (social) order and movements are not conflicting, was soon eradicated by new perspectives on nobility constructed on race and blood. Alea, Bluck, Mroz and Edwards examine how the communication of autobiographical stories via face‐to‐face vs. instant message (IM) influences the extent to which social bonds form between strangers. The results of their study show that the in‐person communication of strangers’ autobiographical memories leads to greater engagement and higher empathy rates in the listener of those stories. That is, sharing autobiographical memories face‐to‐face (compared to IM) is positively correlated with positive feelings and closeness in the listener of those stories.

​The traditional datum concerning moral testimony is that it is (epistemically or morally) problematic--or at least more problematic--than non-moral testimony. More recently, some have sought to analyze the issue of moral testimony within a narrower lens: instead of questioning whether moral testimony on the whole is (more) problematic or not, they have instead focused on possible conditions under which moral deference would be legitimate or forbidden. In this paper, I consider two such features: that of uncertainty and a belief in (...) the greater reliability of another agent. I argue that under these conditions agents have a moral obligation not to defer. I argue that this is because uncertainty and judgments of others’ reliability covary with social status and are themselves products of oppressive social hierarchies, in which case moral deference under these conditions would result in many harms, the most significant being that it would itself propagate oppression by perpetuating unjust social hierarchies. In this way, this paper focuses on how unjust social facts can affect our moral epistemology, specifically how social and political factors can affect moral testimony, and is thus an exercise in non-ideal moral epistemology. This paper presents a holistic, contextualised case study of reintegration and trust repair at a UK utilities firm in the wake of its fraud and data manipulation scandal. Drawing upon conceptual frameworks of reintegration and organizational trust repair, we analyze the decisions and actions taken by the company in its efforts to restore trust with its stakeholders. The analysis reveals seven themes on the merits of proposed approaches for reintegration after an integrity violation , and novel insights on the role (...) of organizational identity, “changing of the guard” and cultural reforms alongside procedural modifications. The case further supports the dynamic nature of stakeholder salience across the reintegration process. The study both supports propositions from existing frameworks and suggests novel theoretical extensions for future research. (shrink)

The psychological literature, however, does not provide adequate client-centered treatment directions for those who have affairs and seek psychotherapy for this issue.In an attempt to begin to address this gap in the literature, a descriptive phenomenological psychological study, a method that has the goal of articulating the general structure of an experience, in a pretheoretical manner, was undertaken. Increasingly, functional and evolutionary research has highlighted the important contribution emotion processing makes to complex human social cognition. As such, it may be asked whether neural structures involved in emotion processing, commonly referred to as limbic structures, have been impacted in human brain evolution. To address this question, we performed an extensive evolutionary analysis of multiple limbic structures using modern phylogenetic tools. For this analysis, we combined new volumetric data for the hominoid (human and ape) amygdala and 4 amygdaloid nuclei, (...) hippocampus, and striatum, collected using stereological methods in complete histological series, with previously published datasets on the amygdala, orbital and medial frontal cortex, and insula, as well as a non-limbic structure, the dorsal frontal cortex, for contrast. We performed a parallel analysis using large published datasets including many anthropoid species (human, ape, and monkey), but fewer hominoids, for the amygdala and 2 amygdaloid subdivisions, hippocampus, schizocortex, striatum, and septal nuclei. To address evolutionary change, we compared observed human values to values predicted from regressions run through a) nonhuman hominoids and b) nonhuman anthropoids, assessing phylogenetic influence using phylogenetic generalized least squares regression.Compared with other hominoids, the volumes of the hippocampus, the lateral nucleus of the amygdala, and the orbital frontal cortex were, respectively, 50%, 37%, and 11% greater in humans than predicted for an ape of human hemisphere volume, while the medial and dorsal frontal cortex were, respectively, 26% and 29% significantly smaller. Compared with other anthropoids, only human values for the striatum fell significantly below predicted values. Overall, the data present support for the idea that regions involved in emotion processing are not necessarily conserved or regressive, but may even be enhanced in recent human evolution. (shrink)

This paper considers the question ‘How should institutions enable people to meet their needs in situations where there is no guarantee that all needs can be met?’ After considering and rejecting several simple principles for meeting needs, it suggests a new effectiveness principle that 1) gives greater weight to the needs of the less well off and 2) gives weight to enabling a greater number of people to meet their needs. The effectiveness principle has some advantage over the main competitors (...) including a principle suggested by David Miller in Principles of Social Justice. Miller argues that his principle accounts for the existing data on individuals’ intuitions about meeting needs. The effectiveness principle better accounts for this data. Furthermore, this paper presents a new experiment on intuitions about meeting need that is consistent with the effectiveness principle but not Miller’s principle. (shrink)
