This essay bridges together social network and institutional perspectives to examine how women on boards, by breaking up directors’ homophilous networks, contribute to board effectiveness. It proposes that through real and symbolic representations, women enhance perceptions of the board’s instrumental, relational, and moral legitimacy, leading to increased perceptions of the board’s trustworthiness which in turn fosters shareholders’ trust in the firm. Envisioning the gender diversification of boards as an event of institutional change, this article considers the critical role of shareholder (...) activists and legislative support from the SEC in the deinstitutionalization of old boys’ networks and the reinstitutionalization of gender diverse boards. Is language understanding a special case of social cognition? To help evaluate this view, we can formalize it as the rational speech-act theory: Listeners assume that speakers choose their utterances approximately optimally, and listeners interpret an utterance by using Bayesian inference to “invert” this model of the speaker. We apply this framework to model scalar implicature (“some” implies “not all,” and “N” implies “not more than N”). This model predicts an interaction between the speaker's knowledge state and the listener's interpretation. (...) This paper argues that an exchange between Paolo Prodi and Giorgio Agamben on the role of the sacred in European constitutional history can inform the study of early modern history of political thought. Prodi, in his history of the sworn oath (sacramentum), and Agamben, in his history of the curse (sacer esto) and the accursed, or outlaw (homo sacer), explored how these sacred threats and promises, though not purely legal expressions themselves, underpinned the legal order. Through a study of three (...) sixteenth-century legal humanists’ views of the Roman laws concerning these sacred oaths and curses (the sacratae leges), this paper describes a similar interest in exploring the connection between the sacred and the legal order. It concludes that the idea of the commonwealth in the sixteenth century was a complex of legal and para-legal techniques, symbols, and structures in addition to the more frequently studied restoration of classical virtue theory. This paper also provides an edition and translation of Guillaume Budé's discussion of the Roman law of banishment [D. 48.19.2], which was the first legal commentary to assemble the materials relating to the homo sacer. This book addresses some basic questions about intrinsic value: What is it? What has it? What justifies our beliefs about it? In the first six chapters the author defends the existence of a plurality of intrinsic goods, the thesis of organic unities, the view that some goods are 'higher' than others, and the view that intrinsic value can be explicated in terms of 'fitting' emotional attitudes. The final three chapters explore the justification of our beliefs about intrinsic value, including coherence (...) theories and the idea that some value beliefs are warranted on the basis of emotional experience. Professor Lemos defends the view that some value beliefs enjoy 'modest' a priori justification. There is a long tradition in moral philosophy which maintains that a necessary condition for moral goodness is that one act from a sense of duty. Kant is perhaps the best known and most discussed representative of this view, but one finds others prior to Kant, such as Butler and Price, and Kant's contemporaries, such as Reid, expressing similar ideas. Price, for example writes, ". . . what I have chiefly insisted on, is, that we characterize as virtuous no actions (...) flowing merely from instinctive desires, or from any principle except a regard to virtue itself.'' The man had fallen in the hospital recovery room while attempting to put on his pants, readying himself to return home after an outpatient procedure. The case seemed so pedestrian at first. The emergency department charge nurse was annoyed; she called it a dump. “They’re sending a patient from the PACU to the ER!” she fumed. “Why can’t they take care of their own problems up there? Isn’t this a hospital?”I could relate to the gut aversion to having yet another (...) patient in an already busy emergency department. The case did not fit our usual model. Despite its increasing popularity across management disciplines, stakeholder theory holds an important shortcoming in terms of its guidance for understanding the heterogeneity of stakeholder interests, claims, and behavior toward firms. Specifically, scholars note the inadequacy of generic categories of stakeholders in providing a realistic portrait of the groups and individuals that interact with the firm, opening the theory to much criticism for a ‘simplistic’ and ‘meaningless’ stakeholder concept. In face of this challenge, recent research is pointing to social identity as (...) a mechanism to refine our understanding of stakeholders as names-and-faces, however we argue that despite the advancements offered by the social identity approach, it too presents limitations in its ability to guide managers in prioritizing stakeholder claims. Building on these nascent efforts to offer much needed nuance to a theory of stakeholder identification and prioritization, this paper draws from new advances in the management literature and offers status as an attribute that helps explain and predict how managers accord attention to their various constituents. We set forth five propositions connecting stakeholder status to the attention stakeholders receive from managers. We argue that status is a superior attribute of stakeholder identification and prioritization because it accounts for groups and individuals’ uniqueness within broad categories of stakeholders in a dynamic way, reconciles the dual nature of stakeholders as holding simultaneously a social and an economic identity in their claim toward the firm, and provides a plausible explanation of, and intuitive guidance to, how managers accord attention to their firm’s stakeholders. In this 2004 book, Noah Lemos presents a strong defense of the common sense tradition, the view that we may take as data for philosophical inquiry many of the things we ordinarily think we know. He discusses the main features of that tradition as expounded by Thomas Reid, G. E. Moore and Roderick Chisholm. For a long time common sense philosophers have been subject to two main objections: that they fail to give any non-circular argument for the reliability of (...) memory and perception; and that they pick out instances of knowledge without knowing a criterion for knowledge. Lemos defends the appeal to what we ordinarily think we know in both epistemology and ethics and thus rejects the charge that common sense is dogmatic, unphilosophical or question-begging. Written in a clear and engaging style, this book will appeal to students and philosophers in epistemology and ethics. (shrink)

Orff-Schulwerk has become a foundational element of U.S. music education. Often positioned as an open, exploratory, and approachable form of music teaching and learning, it is associated with developing musicianship and, importantly, creativity. This article, drawing from a curriculum studies approach, considers the epistemologies, histories, and entanglements that produce Orff-Schulwerk and position it in this way. To do so, the article reviews an archive of method books, writing from Orff-Schulwerk pedagogues, and instrument designs. It then places these artifacts alongside the (...) intellectual foundations through that, in part, their modes of thought and action are constructed. In the process, this article traces how Orff-Schulwerk has been produced and given a particular sensibility through modes of thought largely outside of music such as cognitive science and German body culture. As a result, Orff-Schulwerk and the object of twenty-first century music curriculum become visible as not simply direct translations of creative, musical exploration into curriculum. Rather, Orff-Schulwerk is a distinct ontological object produced through ideas and desires that often have less to do with music and more to do with governing people in modernity. In doing so, the article seeks to question and develop understandings surrounding the foundations of classroom practice and research. (shrink)

This article proposes a new model of human concept learning that provides a rational analysis of learning feature‐based concepts. This model is built upon Bayesian inference for a grammatically structured hypothesis space—a concept language of logical rules. This article compares the model predictions to human generalization judgments in several well‐known category learning experiments, and finds good agreement for both average and individual participant generalizations. This article further investigates judgments for a broad set of 7‐feature concepts—a more natural setting in several (...) ways—and again finds that the model explains human performance. (shrink)

We investigate the formal cause of diagrams, initially realizing that diagrams have no obvious form. It is argued their form is to mimic expert perspectives. This perspective provides a organizational structure that represents the relations important in understanding the worldly situation. We then shift to a study of how we are to understand an expert perspective. Using the distinction between intuitive and formal logic, logica utens versus logica docens, we identify games of habituation: games of focus and distraction. The skills (...) required for games of focus and distraction are phenomenological in regulating the way we see, i.e., how we approach and analyze different situations. This unique phenomenological skill is characteristic of diagrammatic reasoning. (shrink)

Definitions of syncopation share two characteristics: the presence of a meter or analogous hierarchical rhythmic structure and a displacement or contradiction of that structure. These attributes are translated in terms of a Bayesian theory of syncopation, where the syncopation of a rhythm is inferred based on a hierarchical structure that is, in turn, learned from the ongoing musical stimulus. Several experiments tested its simplest possible implementation, with equally weighted priors associated with different meters and independence of auditory events, which can (...) be decomposed into two terms representing note density and deviation from a metric hierarchy. A computational simulation demonstrated that extant measures of syncopation fall into two distinct factors analogous to the terms in the simple Bayesian model. Next, a series of behavioral experiments found that perceived syncopation is significantly related to both terms, offering support for the general Bayesian construction of syncopation. However, we also found that the prior expectations associated with different metric structures are not equal across meters and that there is an interaction between density and hierarchical deviation, implying that auditory events are not independent from each other. Together, these findings provide evidence that syncopation is a manifestation of a form of temporal expectation that can be directly represented in Bayesian terms and offer a complementary, feature‐driven approach to recent Bayesian models of temporal prediction. I defend the view that there are organic unities mainly by presenting examples of organic unities. I also defend the view against two objections. The first objection appeals to the notion of an evaluatively incomplete state of affairs. The second objection holds that the intrinsic value of a state of affairs can be different in different contexts. I argue that neither objection provides a compelling reason for rejecting these examples.

New techniques have made genome modification cheaper, easier, and faster than before, leading to a boom in research—both “basic” research and research applied to many species, and to germlines as well as somatic cells, with especially strong interest in biomedical uses. Given the scope and potential power of this work, it is vital that people be provided with accurate information about what is being done or proposed, and why. Such information is crucial to their making good decisions both in their (...) private roles as patients and in their public roles as citizens. From the Preface. In preparing the present treatise, I have kept in view the need of collegians and of graduate students in the universities, and endeavored to furnish them with a satisfactory hand-book on Induction. The few pages in popular treatises on Deductive Logic usually allotted to this co-ordinate branch being utterly inadequate and disproportionate, and thereby greatly underrating its extent and importance, should be replaced by a separate treatise comprehending at least the essential elements of Induction, and opening the (...) way for its full investigation and application. In the hope of supplying this want, I offer to students well advanced in the schools the work in hand. Special students engaged in the pursuit of physical science, who have not enjoyed a full course in Logic, need a compact hand-book on Induction, in order to gain a clearer insight into the principles of the methods they are employing, and thus to avoid a waste of energy, and the discouragement of blunders in the dark. To this class of students, also, and to the general reader who desires a clearer knowledge of his own mental processes and of those of the scientist skilled in the discovery of truth, my work is hopefully addressed. With these ends in view, I have earnestly tried, first of all, to be true in matter, then clear and distinct in its treatment. Whoever is acquainted with the literature of the subject will recognize my helps, and will, at the same time, accord to me some fair measure of independence. A profusion of illustration has been used, drawn largely from the humbler departments of knowledge, yet in many cases taken from the physical sciences, not for display, but for service, avoiding recondite examples, the purpose being to teach, not physics, but Logic. The text in the larger type is for the tyro. The many marginal notes, which have been added with much pains, are for the scholarly reader who desires further information. The abundant references to authorities not only indicate my own sources, but will serve to direct those interested to wider fields. As some acquaintance with Deduction is prerequisite to the understanding of Induction, I have ventured to make references to my "Elements of Deductive Logic," the companion of the present work, also a few to " The Theory of Thought," and to my " Elements of Psychology." I ask indulgence for these references, trusting that the bad taste will be neutralized by their helpfulness to those who may have the books at hand.... (shrink)

The question of stakeholder salience has recently resurfaced in the suggestion that the ethical foundations of corporate cultures result in stakeholder cultures that largely explain how firms allocate resources among stakeholders. The present article seeks to complement this novel approach to understanding stakeholder management by adding insights from the multilevel influences that create the corporate culture in the first place, and ultimately affect managers in their stakeholder decisions. This article draws on cultural theory to examine how the individuals who compose (...) firms present group and grid solidarity that results in cultural biases in the corporate culture. These cultural biases—individualism, hierarchy, fatalism, and egalitarianism—are then paired with the stakeholder cultures they enable, and inferences are extracted concerning the salience managers are likely to accord to various classes of stakeholders as a result. Future research and managerial implications stemming from this new view on stakeholder management conclude this article. (shrink)

An earthy smell seeps from the cinderblock room, and a fan in the corner rattles as it circulates the heat. My eyes cross trying to read the square black numbers on the thermometer. I feel achy and tired. I would not be so nervous about the result except that I have been caring for Ebola patients in West Africa.

I examine two related arguments for the claim that if God is omnipotent, God cannot lack abilities such as the ability to do evil or to act irrationally. Both arguments concern the idea that omnipotence is inconsistent with being dominated with respect to abilities. I raise new issues in the formulation of such dominance principles about ability, and attempt to solve them. I also discuss and reject existing objections to these arguments. I conclude that these arguments are promising but not (...) conclusive, and that important work remains to be done in formulating the relevant dominance principles. (shrink)

Children deserve optimal medical care. Although prescription drugs play a prominent and essential role in pediatric health care delivery, health care providers often must make prescribing decisions for their young patients based on imperfect or absent safety and efficacy data for pediatric populations. Until relatively recently, the Food and Drug Administration made surprisingly little effort to improve the quality or quantity of clinical research data for this patient group. Despite recent agency efforts to improve the situation, only one-third of drugs (...) prescribed to children currently have been studied for safety and efficacy in pediatric populations. Moreover, recent agency initiatives to encourage pediatric drug research have generated mixed results and unintended consequences. The complex of issues surrounding the testing and prescribing of prescription drugs used for children will require that pharmaceutical companies, the FDA, and health care providers examine current practices, acknowledge their shortcomings, and consider cooperative, creative solutions. The concept of basic intrinsic value is important for axiology. Michael Zimmerman and Timothy Perrine each present necessary and sufficient conditions for something’s having basic intrinsic value. I argue that neither account is satisfactory. I present two objections to Zimmerman’s view. First, I argue that his view cannot accommodate some widely held and plausible views about the intrinsic value of knowledge and true belief. Second, I argue that it cannot accommodate some plausible views about the intrinsic value of states when (...) one state occurs in virtue of the other. It cannot handle “clusters” of intrinsically valuable states. In the final section, I explain Perrine’s view and argue that his account also cannot accommodate some plausible views about the value of knowledge and true belief. (shrink)

Epistemology or the theory of knowledge is one of the cornerstones of analytic philosophy, and this book provides a clear and accessible introduction to the subject. It discusses some of the main theories of justification, including foundationalism, coherentism, reliabilism, and virtue epistemology. Other topics include the Gettier problem, internalism and externalism, skepticism, the problem of epistemic circularity, the problem of the criterion, a priori knowledge, and naturalized epistemology. Intended primarily for students taking a first class in epistemology, this lucid and (...) well-written text would also provide an excellent introduction for anyone interested in knowing more about this important area of philosophy. I reply to an influential objection to evolutionary debunking arguments against moral realism. According to this objection, our capacity for autonomous rational reflection allows us to grasp moral truths independently of distorting evolutionary influences, so those influences do not prevent us from having moral knowledge. I argue that rational moral reflection is not, in fact, autonomous from evolutionary influences, since it depends on our evolved, pre-reflective grasp of moral properties. I then consider and reject the suggestion that realists can supply (...) an autonomous foundation for rational moral reflection or do without any such foundation. Next, I address the allegation that my arguments have skeptical implications for rational reflection in non-moral domains. Finally, I conclude with a gesture toward a more promising route for realists who oppose debunking arguments. (shrink)

The health co-benefits of CO2 mitigation can provide a strong incentive for climate policy through reductions in air pollutant emissions that occur when targeting shared sources. However, reducing air pollutant emissions may also have an important co-harm, as the aerosols they form produce net cooling overall. Nevertheless, aerosol impacts have not been fully incorporated into cost-benefit modeling that estimates how much the world should optimally mitigate. Here we find that when both co-benefits and co-harms are taken fully into account, optimal (...) climate policy results in immediate net benefits globally, overturning previous findings from cost-benefit models that omit these effects. The global health benefits from climate policy could reach trillions of dollars annually, but will importantly depend on the air quality policies that nations adopt independently of climate change. Depending on how society values better health, economically optimal levels of mitigation may be consistent with a target of 2 °C or lower. (shrink)

There is a very plausible principle linking abilities and possibilities: If S is able to Φ, then it is metaphysically possible that S Φ’s. Jack Spencer recently proposed a class of counterexamples to this principle involving the ability to know certain propositions. I renew an argument against these counterexamples based on the unknowability of Fitch propositions. In doing so, I provide a new argument for the unknowability of Fitch propositions and show that Spencer’s counterexamples are in tension with a principle (...) weaker than the one linking abilities and possibilities.
