En este trabajo se propone, en primer lugar, un análisis informal de las principales ideas de la concepción filosófica de Carlos Alchourrón en torno a la naturaleza de los lenguajes derrotables, en especial de los lenguajes normativos. Esta concepción que, a su vez, conforma el trasfondo de sus propuestas en el ámbito de la lógica de condicionales derrotables, supone que la derrotabilidad es un rasgo que se ubica en la dimensión pragmática del lenguaje. Se discuten sus consecuencias con relación a (...) diversas cuestiones, teniendo en cuenta la tesis de Alchourrón según la cual las proposiciones y las normas son el significado de las expresiones usadas en contextos definidos. En segundo lugar, se sostiene que lo que Alchourrón denomina "concepción disposicional de la derrotabilidad", en su artículo "Sobre Derecho y Lógica" representa -al menos en lo que respecta al ámbito normativo- un cambio sustancial de su idea de la derrotabilidad. Esta modificación supone, en relación a las normas, adoptar una versión de la teoría disposicional del valor. Se sostiene que, sin embargo, la nueva propuesta no es plausible, porque no puede superar a lo que puede ser denominado "el problema del límite de las disposiciones", por un lado, ni tampoco "el problema de la indeterminación necesaria", por el otro. The purpose of this paper is, in the first place, to provide an informal analysis of the main ideas of Carlos Alchourrón' s philosophical conception about the nature of defeasible languages, and in particular about that of normative languages. This conception, which constitutes also the background for his proposals in the field of the logic of defeasible conditionals, assumes that defeasibility belongs to the pragmatic dimension of language. Its consequences in relation to several questions are discussed, taking into account Alchourrón' s thesis according to which propositions and norms are the meaning of the expressions used in defined contexts. Secondly, it is maintained that what Alchourrón denominates "dispositional conception of defeasibility" in his article "On Law and Logic" represents a substantial change of his ideas about defeasibility, at least in what concerns the normative field. As far as norms are concerned this modification entails the adoption of a version of the dispositional theory of the value. Nevertheless, it is argued that this new proposal is not plausible because it cannot solve neither what can be called the "problem of the limit of dispositions" nor the "problem of the necessary indetermination". We would like to open some questions here about the institutional and cultural conditions of anything that might be called cultural studies or multiculturalism. By introducing cultural studies and multiculturalism many intellectuals aim at a more democratic culture. We share this aim. In this essay, however, we would like to argue that the projects of cultural studies and multiculturalism require: a more international model of cultural studies than the dominant Anglo-American versions; renewed attention to the institutional environments of cultural studies; (...) and a questioning of the relations between multiculturalism and identity politics. We seek less to “fix” these problems than to provide a critical analysis of the languages, the methods of criticism, and the assumptions about identity, culture, and politics that present the problems to us. Because the thickets entangling what our group calls cultural studies are so deeply rooted in Western academia, which to a large degree constitutes our own group, the counterexample of cultural criticism in other contexts can be more than usually instructive. We begin by considering the position of cultural studies in China, since our group includes a number of Chinese intellectuals, on whose experience the following section is largely based. The Chicago Cultural Studies Group began meeting in June 1990. Una concepción tradicional de la argumentación jurídica considera que se debe resolver casos jurídicos a través de subsunción y deducción. Hugo Zuleta disputa esta posición, rechazando así la "concepción puente" de las normas, la que fue defendida en particular por Carlos Alchourrón y Eugenio Bulygin. Según la "concepción puente" la norma condicional incluye una modalidad deóntica solo en su consecuencia, mientras su antecedente consiste en un enunciado descriptivo. En cambio, Zuleta propone la "concepción insular", que pone la modalidad deóntica (...) adelante del condicional ). Discutiré estas concepciones, evaluando su adecuación en distintos ámbitos de aplicación. En particular, defenderé la tesis de que la crítica a la "concepción puente" tiene razón en cuanto se trata de conflictos normativos. Así, la "concepción insular" puede tener una aplicación importante en la teoría de los principios, que trata justamente del análisis de normas en conflicto. The traditional conception of legal argumentation is that legal cases are resolved by means of subsumption and deduction. Hugo Zuleta disputes this position, rejecting the "bridge conception" of norms, which was defended in particular by Carlos Alchourrón and Eugenio Bulygin. According to the "bridge conception", the conditional norm includes a deontic modality only in its consequence, whilst the antecedent consists of a descriptive sentence. By contrast, Zuleta defends the "isle conception", which puts the deontic modality in front of the conditional ). I will discuss these conceptions, assessing their adequacy in distinct fields of application. In particular, I will defend the thesis that the critique of the "bridge conception" is correct in the case of norm conflicts. El desarrollo del derecho penal internacional y el carácter taxativo de las obligaciones de los Estados no ha evitado, sin embargo, que el procesamiento a los perpetradores de crímenes masivos sea considerado a menudo como una tarea imposible, irrealizable e incluso no (...) siempre deseable. En este artículo se analizan las críticas al instrumento jurídico-penal como el mecanismo adecuado para enfrentar la violencia colectiva en el ámbito de la justicia transicional.ABSTRACT: According to the rules of international law, States, in the face of the most serious crimes, have an inescapable obligation, to their own citizens, but also to the international community, to investigate, prosecute and punish those responsible. The development of international criminal law and the binding character of States' obligations have not, however, prevented the prosecution of perpetrators of mass crimes from being often considered an impossible, unrealizable and even not always desirable task. Resumen: La psicología como saber constituido recibe una importante problematización a partir del texto ¿Qué es la psicología? del filósofo francés Georges Canguilhem (1904-1995). Su crítica se refuerza cuando consideramos el concepto de vida explorado por el autor, es decir, como algo precario y errante. Así, se revela un impasse epistémico de la psicología: la fragilidad en aprehender lo viviente como creador de normas, dada su precariedad esencial. La psicología, al ignorar la comprensión de la vida en estos términos sugeridos (...) por Canguilhem, convierte al psicólogo en un instrumento al servicio de la patologización de las formas singulares de la existencia. Abstract: Psychology as a field of knowledge receives an important problematization from the text What is Psychology? by the French philosopher Georges Canguilhem (1904-1995). His criticism is strengthened when we consider the concept of life explored by the author, that is, as something precarious and errant. Thus, an epistemic impasse in psychology is revealed: the fragility of apprehending the living as a creator of norms, given its essential precariousness. Psychology, by ignoring the understanding of life in these terms suggested by Canguilhem, turns the psychologist into an instrument at the service of the pathologization of the singular forms of existence. Resumen Las interfaces cerebro-computadora (ICCs) son tecnologías que proveen herramientas para la comunicación entre el ser humano y las computadoras. Dado que las nuevas técnicas asociadas a ICCs podrían influir en la autorregulación emocional, la memoria autobiográfica, el sentido del yo, la identidad, la autonomía, la autenticidad y las atribuciones de responsabilidad presentan importantes objeciones éticas. Entender las consecuencias a largo plazo de estas nuevas tecnologías puede ser difícil. Por lo tanto, los aspectos éticos vinculados a las ICCs necesitan ser (...) continuamente revisados a la par de los avances técnicos en el área. El personalismo ontológicamente fundado se ha formalizado como un camino de reflexión que tiene como referencia una antropología que defiende el valor de la vida física corpórea, la relación libertad-responsabilidad y la adecuada interacción individuo y sociedad y brinda pautas éticas que permitan formular normas de conducta acordes con la dignidad de la persona humana. Por lo tanto, en este artículo se aplican los principios de la bioética personalista al ámbito de las ICCs, de modo tal de dar directrices generales para la acción que puedan contribuir a elaborar un juicio ético acerca del desarrollo y uso de estas neurotecnologías. Abstract Brain-computer interfaces (BCIs) are technologies that provide tools for communication between humans and computers. Since the new techniques associated with BCIs could influence emotional self-regulation, autobiographical memory, sense of self, identity, autonomy, authenticity, and attributions of responsibility present important ethical objections. Understanding the long-term consequences of these innovative technologies can be difficult. Therefore, the ethical aspects linked to BCIs need to be continuously reviewed in line with technical advances in the area. Ontologically grounded personalism has been formalized as a path of reflection that has as its reference an anthropology that defends the value of corporeal physical life, the relationship between freedom and responsibility, and the appropriate interaction between the individual and society. This approach provides ethical guidelines for the formulation of norms of conduct in accordance with the dignity of the human person. Therefore, in this article, the principles of personalist bioethics are applied to the field of BCIs, in order to provide general guidelines for action that can contribute to the elaboration of an ethical judgment about the development and use of these neurotechnologies. Los sistemas jurídicos se presentan a menudo como conjuntos de derechos, que las normas ponen en vigor. En este artículo trato de aclarar el concepto de derecho subjetivo de acuerdo con los diferentes matices en los que, de hecho, se interpreta tal idea. En efecto, si el derecho se mira desde el punto de vita del legislador, el deseo de hacer que cierta acción sea efectivamente accesible para el titular del derecho correspondiente admite diferentes grados o niveles de intensidad, y (...) cada uno de ellos puede representarse mediante diferentes configuraciones de deberes y competencias. El primer nivel, el más débil de todos, es la permisión negativa: hacer p no está prohibido. En el segundo nivel, el legislador considera el tema y lo juzga bastante importante para emitir una norma que expresamente garantice a los ciudadanos la permisión de hacer p. En el tercer nivel, aun sin una permisión explícita, el legislador quiere impedir a la autoridad delegada prohibir p. Prohíbe, pues, a dichas autoridades emitir una norma que incluya esa prohibición. En el cuarto nivel o grado, el superior trata de impedir a la autoridad delegada desobedecer aquel propósito. Para hacerlo, establece que la prohibición de p está fuera de la competencia de cualquiera de sus delegados. En el quinto, el hecho de que p está permitido y no puede prohibirse no es bastante para el legislador, que insiste en que el sujeto que desee hacer p no se vea estorbado por terceros. En el sexto nivel, el legislador reconoce que, aun si nadie opone un obstáculo a p, algunas personas no son por sí mismas capaces de llevar a cabo esa acción. Para resolver esta última dificultad, el legislador establece, para todos los sujetos, o para algunos de ellos en cierta situación favorable, o aun para alguna autoridad delegada, la obligación de dar ayuda efectiva a cualquier persona que desee hacer p pero encuentre alguna dificultad para ello. Individualizados y definidos esos seis niveles de intensidad de derechos, pueden proponerse ejemplos para cada nivel. El propósito de este trabajo no es mantener ni cambiar las prioridades existentes, ni tampoco negar la importancia de los derechos ni proponer que los tribunales los ignoren. Es mostrar la realidad operativa de los derechos, comparada con el énfasis diverso que se les atribuye en el discurso político, que ahora es profundamente recibido en el campo jurídico. El análisis de los niveles expuestos puede ser una herramienta útil para comprender ciertas dificultades del discurso jurídico comparado con su práctica. Legal systems are often presented as sets of rights, and legal norms operate to ensure these rights. In this paper, I try to clarify the concept of right according to the different shades in which, as a matter of fact, the idea of a right is interpreted. As a matter of fact, if law is seen from the point of view of the legislator, the will to make a certain action effectively accessible by the bearer of the corresponding right admits different degrees or levels of intensity, and each of those levels can be represented by a different configuration of duties or competences. The first level, the weakest of them all, is represented by negative permission: doing p is not forbidden. At the second level, the legislator has considered the matter and deemed it important enough to enact legislation expressly granting citizens the permission to do p. In the third level, even without a superior explicit permission, the legislator wants to prevent a delegate authority to prohibit p. So, she forbids such authorities from enacting a norm which includes that prohibition. In the fourth level or degree, the superior tries to prevent the delegate authority from disobeying its purpose. In order to do so, it establishes that the prohibition of p is out of the competence of any of its delegates. In the fifth degree, the fact that p is permitted and cannot be forbidden is not enough for the legislator: she insists that the subject willing to do p shall not be prevented from it by third persons. In the sixth level, the legislator acknowledges that, even if nobody opposes an obstacle to p, some willing persons are not individually able to perform such behaviour. In order to solve this last difficulty, the legislator establishes an obligation, for every subject, or for some of them in a certain favourable situation, or even for a delegate authority, of giving an effective help to any person willing to perform p but finding some obstacle to do so. Once individuated and defined those six levels of intensity of rights, some examples of each degree may be proposed. The aim of this paper is not to maintain or to change the present priorities, nor to deny the importance of rights or encourage courts to ignore them. Its purpose is to show the operative reality of rights, compared with the different emphasis they are attributed to within the political discourse, presently deeply received in the legal field. The analysis of the levels exposed above may be a useful tool to understand some difficulties of the legal discourse when compared to the legal practice. (shrink)

This paper examines the ways Merleau-Ponty and Nancy think about light, a central theme in Western philosophy closely tied with form and intelligibility. The first section of this paper points out that each thinker replaces the “highest moment of light,” where it is relieved of its weight and materiality, with darkness, where light instead emerges from some apophantic depth indissociable from the material. The second section of this paper gives a critique of darkness in Nancy from Merleau-Ponty’s perspective. According to (...) the latter’s view, Nancy’s claim that darkness is distinct from the structures of intentionality and instead has to do with a presentation of the inappropriable fact of things would be untenable. The difference between the thinkers relates to how each thinks about negation after their very similar critiques of light and form. Still, I argue, the same critique of presentation in Nancy ought to also be applied to Merleau-Ponty, or at least to the usual way he is thought to favour the sensible instead of intelligibility. In the third section of this paper I consider one of Merleau-Ponty’s phrases, “there is no painting before painting,” a statement I take to be about how explicit formal structures, and thus also light and line, comes from a sensible register that does not lack variation and is not totally “deformed,” to use Nancy’s word that describes the homogeneity of a sensible field. Cet essai examine les différentes façons qu’ont Merleau-Ponty et Nancy de penser la lumière, un thème central de la philosophie occidentale, et qui est étroitement lié avec les idées de forme et d’intelligibilité. La première section montre que les deux penseurs remplacent le « plus haut moment de la lumière », qui est sans poids ni matérialité, par l’obscurité, si bien que la lumière émerge d’une profondeur apophantique indissociable de la matérialité. La deuxième section propose un critique de l’obscurité chez Nancy d’une perspective merleau-pontienne. Pour Merleau-Ponty, l’affirmation de Nancy selon laquelle l’obscurité se distingue des structures de l’intentionalité et a plutôt affaire à la présentation du fait inappropriable de la chose serait tout à fait intenable. La différence entre les deux penseurs concerne la façon dont chacun pense la négation à partir d’une critique similaire de la lumière et de la forme. J’avance pourtant que la même critique de la présentation chez Nancy devrait aussi être appliquée à Merleau-Ponty, ou du moins à la façon dont il est habituellement vu comme préférant le sensible contre l’intelligible. Dans la troisième section, j’évalue la phrase de Merleau-Ponty, « la peinture n’existe pas avant la peinture », phrase qui selon moi concerne la façon dont les structures formelles explicites, et donc la forme et la ligne, proviennent d’un registre sensible qui n’est pas sans variations et donc pas totalement « déformé », pour utiliser le mot que Nancy emploie pour décrire l’homogénéité du champ sensible.Questo articolo prende in esame i modi in cui Merleau-Ponty e Nancy riflettono sulla luce, un tema centrale nella filosofia occidentale e strettamente connesso a quelli della forma e dell’intelligibilità. La prima sezione dell’articolo mostra come entrambi i pensatori sostituiscano “il più alto momento della luce”, che la libera dal suo peso e dalla sua materialità, con l’oscurità, in cui invece la luce emerge da una profondità apofantica indissociabile dalla sfera materiale. La seconda sezione offre una critica del concetto di oscurità in Nancy dal punto di vista di Merleau-Ponty. Secondo una prospettiva merleau-pontiana, la tesi di Nancy che l’oscurità sia distinta dalle strutture dell’intenzionalità e sia invece connessa a una presentazione dell’aspetto inappropriabile delle cose sarebbe insostenibile. La differenza tra i due pensatori riguarda il modo in cui ciascuno di essi elabora l’idea di negazione, a partire da due analisi della luce e della forma molto simili. Tuttavia, come cerco di mostrare, la stessa obiezione all’idea di presentazione in Nancy dovrebbe essere applicata anche a Merleau-Ponty, o quantomeno al modo in cui di norma si ritiene egli prediliga il sensibile piuttosto che l’intelligibile. Nella terza sezione, prendo in esame una frase di Merleau-Ponty, “non c’è pittura prima della pittura”, che a mio avviso si riferisce a come le strutture formali esplicite, e dunque anche la luce e la linea, provengano da un registro sensibile che non è privo di variazioni e che non è totalmente “deformato”, per impiegare un termine di Nancy che descrive l’omogeneità di un campo sensibile. RESUMO O semioticista Iuri Lótman escreveu contribuições decisivas no campo da semiótica da literatura. No entanto, ao longo dos anos 70 passa a ampliar seu universo de interesses para além do texto literário, trazendo contribuições para os estudos do cinema, das artes plásticas e mesmo das normas de etiqueta da nobreza russa. Neste artigo pretendo introduzir as contribuições de Lótman no campo da semiótica da cena e demonstrar como o semioticista russo realiza reflexões importantes em um campo até então pouco (...) explorado dentro dos estudos semióticos. Ao analisar o caráter do espaço teatral, as relações entre texto e código, o papel da semiótica teatral e do ensemble cênico, Lótman retoma o caminho aberto pelo Círculo Linguístico de Praga e antecipa flancos de interesse que só recentemente seriam explorados pela semiótica teatral. ABSTRACT The semiotician Yuri Lotman wrote decisive contributions to the field of semiotics of literature. However, throughout the 1970s he expanded his universe of interests beyond the literary text contributing to the study of cinema, fine arts and even Russian nobility’s code of behavior. In this article, I introduce Lotman’s writings in the field of theatre semiotics to demonstrate how the Russian semiotician brings important considerations to a field until then underexplored within semiotic studies. His reflections on the nature of the theatrical space, on the relations between text and code, on the role of theatre semiotics, and on the theatrical ensemble enlarged the path opened by the Linguistic Circle of Prague and anticipate discussions that only recently started to be explored by the semiotics of theatre. The paper analyses the problem of workload quotas for district court judges in relation to the standard statutory work time duration. The problem is set against the general tendency of increase in the number of cases brought before courts each year. District courts as the courts of first instance are faced with an ever growing flow of cases. With regard to civil cases, the numbers are increasing especially in the field of the law of obligations (disputes in relation to (...) sale, loan, credit, consumer credit, lease contracts, as well as contracts for the provision of services, etc.). As far as criminal cases are concerned, the numbers are increasing especially in the fields of robbery, theft, in particular car theft, disturbance of public order and other crimes. In these circumstances, it is extremely important to conduct the analysis of the activity of courts in order to obtain a picture of the current situation with regard to the workload of courts and judges. District courts deserve special attention. Uneven distribution of workload among courts and judges is often the reason for the increase of the number of cases where a final decision (judgement) is reached later than 6 months after the start of proceedings. This was pointed out in the Overview of Activities of the Lithuanian Courts and their Self-Governance Institutions (2009–2010), as well as in the report of the National Courts Administration (2010). Those documents underline the importance to analyse the workload of district court judges for the purposes of optimising work organisation, setting the number of judges, distribution of resources, evaluation of judges’ activity, etc. The said analysis is crucial in order to avoid exceeding working time quotas and excessive workload of judges. At present, the workload of district court judges is calculated in accordance with the regulation adopted by the Courts Council in 2004 (as amended in 2005) and it reflects the number of standard cases (civil, criminal cases and cases of administrative offences) as well as other types of procedural documents dealt with by a judge within a period of one month. However, there are no quotas set for judge’s workload with regard to the duration of the statutory work time. The quotas for separate procedural stages (preparation for hearings, hearings, adoption of decision (judgement), other procedural actions that a judge performs while administering justice) are inexistent. The calculation does not take into account whether those standard cases are heard by a single judge or by a panel of judges, the complexity of a particular case is neither reflected. Establishing quotas for district court judges and other court clerks (judge assistants, secretaries, etc.) should consist of legal, organisational-procedural and technical-economical activity. The Ministry of Justice of the Republic of Lithuania, the National Courts Administration, the Courts Council as well as chairmen and experienced judges of district courts should play an active part in the process of establishing quotas. The sociological work of Elias is studied, together with his characteristic outcast position, typical of judaism at the end of the century. From such judaic root stems the metapolitical approach observed in the process of civilization from the platform of a Human Genre already assume as formed and defined by the civilized conscience. The idea of a metapolitical (extraterritorial) platform is determined, and its possible historical and political efficiency. Finally, the work focuses on the limits of the civilization process, contrasting (...) N. Elias and G. Bueno conceptions on the issue. Hence a third alternative which observs such limit of history and its superation in the “antropological field” – through the a structural, technoscientific and objective development of society – springs as a source from where the “ultramoderne spirit” described at the end of the issue finds its origins. In this paper, we discuss the prevailing view amongst philosophers and many mathematicians concerning mathematical proof. Following Cellucci, we call the prevailing view the “axiomatic conception” of proof. The conception includes the ideas that: a proof is finite, it proceeds from axioms and it is the final word on the matter of the conclusion. This received view can be traced back to Frege, Hilbert and Gentzen, amongst others, and is prevalent in both mathematical text books and logic text books.

Drawing on an analysis of German national cybersecurity policy, this paper argues that cybersecurity has become a key site in which states mobilize science and technology to produce state power. Contributing to science and technology studies work on technoscience and statecraft, I develop the concepts of “territorialization projects” and “digital territory” to capture how the production of state power in the digital age increasingly relies on technoscientific expertise about information infrastructure, shifting tasks of government into the domain of computer scientists (...) and network engineers. The notion of territorialization projects describes states’ ongoing struggle to mobilize science and engineering in order to transform globally distributed information infrastructure into bounded national territory and invest it with patriotic meaning: making digital territory. Digital territory, in other words, is nationalized information infrastructure: it includes building and monopolizing infrastructure as well as normative ideas about nation—who is a digital citizen, and who isn’t; or what constitutes “good” and “bad” digital citizens. Nationalizing information infrastructure and placing statecraft into the hands of scientists and engineers might indicate an emerging form of “techno-nationalism”—a combination of nationalist and technocratic tendencies—raising urgent questions for STS scholarship to investigate the consequences of territorialization projects for justice, democracy, and civic life. On March 8, 1987, the Sandinista Liberation Front published its statement on the relation of women's struggles to the Nicaraguan revolution. The author argues that this official statement is consistent with the views of modern feminists on some key points relating to the need to eliminate women's double day, promote women's self-organization, and wage an ideological struggle against sexism if women's subordination is to be eliminated. The author believes that the Sandinista Front's emphasis on ideological struggle and political organization represents (...) an important break with more economistic, orthodox Marxist approaches to analyzing the condition of women and has important implications for Marxist feminism. This paper consists of three main sections. In the first section, we consider how early attempts at understanding the relationship between mathematics and philosophy in Leibniz’s thought were often made within the framework of grand reconstructions guided by intellectual trends such as the search for “the ideal of system”. In the second section, we proceed to recount Leibniz’s first encounter with contemporary mathematics during his four years of study in Paris presenting some of the earliest mathematical successes which he made (...) there. In particular, we argue that recently published letters and papers reveal how his youthful mathematical reflexions were deeply intertwined with important philosophical insights that, in turn, acted as guiding ideas for his mathematical research. Finally, in the third section, we situate the central themes of the essays of the present volume within the new understanding of the interrelations between philosophy and mathematics in Leibniz’s thought briefly indicated in the opening section. Nurse leaders, including clinical nurse educators, who exercise stewardship at the point of service, may facilitate practising nurses' articulation of their shared value priorities, including respect for persons' dignity and self-determination, as well as equity and fairness. A steward preserves and promotes what is intrinsically valuable in an experience. Theories of virtue ethics and discourse ethics supply contexts for clinical nurse educators to clarify how they may facilitate nurses' articulation of their shared value priorities through particularism and universalism, as well (...) as how they may safeguard nurses' self-interpretation and discursive reasoning. Together, clinical nurse educators and nurses may contribute to management decisions that affect the point of service, and thus the health care organization. (shrink)

While discussions of dissolving the hyphen between Marxism and feminism were put on the back burner in the United States and England in the 1980s, the author argues that changes in Latin America during the same decade favor a possible convergence of contemporary Marxist and feminist theory and practice. These conditions include the emergence of a second-wave feminist movement in many Latin America countries, the central role of women in contemporary social movements, and an internal critique within Latin American Marxism. Key issues pointing toward a convergence of thinking include a reevaluation and redefinition of democracy, the concept of “a plurality of social subjects” or potential revolutionary actors, the importance of autonomy for popular movements in relation to political parties and the state, and a new understanding of the importance of daily life in the struggle for socialism. Una de las medidas del Ministerio de Educación del Perú frente a la emergencia sanitaria mundial COVID 19; fue decretar de forma inmediata la continuidad del servicio en la modalidad de educación a distancia; generándose una crisis propia del proceso de adecuación y tránsito a una nueva forma de enseñar. El objetivo fue: Determinar el nivel de percepción de los docentes de educación básica, respecto a su trabajo pedagógico en esta modalidad. Obteniéndose entre otros resultados, una percepción regular (56.8%) en (...) la dimensión: competencias necesarias para el manejo de herramientas virtuales indispensables para desempeñarse en esta nueva modalidad. El interés en las potencialidades inexploradas del alumno de educación preescolar, así como de los recursos clásicos y contemporáneos inexplotados en este nivel educativo basan la presente investigación. Este artículo describe, analiza y expone los resultados al aplicar el cuento como una estrategia didáctica sistematizada que posibilita procesos de aprehensión al concepto de negociación y su uso en la resolución de conflictos en alumnos de 3º. de preescolar de la ciudad de San Luis Potosí. La selección minuciosa de una obra, (...) su lectura y reflexión en el grupo focal fue el punto de partida de la investigación organizada en tres fases: exploración, identificación y concienciación. Los alumnos trabajaron bajo consignas fundamentales, desarrollaron procesos metacognitivos y colaboraron entre sí para la obtención de un fin común. A la luz del juicio de expertos entre otros instrumentos de validez y confiabilidad de datos se deja ver el impacto favorable de esta estrategia en el aprendizaje, la imperante necesidad de innovación en las prácticas pedagógicas actuales y los alcances del uso de un recurso tan cercano pero olvidado como lo es el cuento.
