Depuis 70 ans, les avocats peuvent créer des structures d’exercice pour exercer en commun la profession d’avocats. Depuis 1990, la grande innovation réside dans la possibilité pour les avocats de structurer leur activité au moyen de sociétés commerciales particulières, les sociétés d’exercice libéral (SEL), dont l’objectif est la préservation de l’indépendance et de la déontologie des professionnels qui exercent en son sein. En 2015, les avocats sont autorisés à avoir recours aux sociétés commerciales de droit commun (SA, SAS, SARL), sauf (...) celles qui confèrent à leur associé la qualité de commerçant (SNC et SCA). Ce dispositif vient d’être réformé par la très récente ordonnance no 2023-77 du 8 février 2023 qui soulève la difficile distinction entre les SEL et les sociétés de droit commun. L’étude de cette distinction met en lumière la caractéristique de ces sociétés, l’exercice en commun d’une profession libérale réglementée, dont le régime juridique est posé par des règles professionnelles d’ordre public. Sixteen years after Kim’s seminal paper offering a welcomed analysis of the emergence concept, I propose in this paper a needed extension of Kim’s work that does more justice to the actual diversity of emergentism. Rather than defining emergence as a monolithic third way between reductive physicalism and substance pluralism, and this through a conjunction of supervenience and irreducibility, I develop a comprehensive taxonomy of the possible varieties of emergence in which each taxon—theoretical, explanatory and causal emergence—is properly identified and (...) defined. This taxonomy has two advantages. First, it is unificatory in the sense that the taxa it contains derive from a common unity principle, which consequently constitutes the very hallmark of emergentism. Second, it can be shown that the emergence taxa it contains are able to meet the challenges that are commonly considered as being the hot topics on the emergentists’ agenda, namely the positivity, the consistency and the triviality/liberality challenges. If we consider heritage as a process of exhibiting the past and the present to present these for future observers then encyclopedias are good candidates for assessing what constitutes heritage. We propose to study the Fluxion entries in British encyclopaedias over a long period of time. With the help of this corpus of more than thirty articles, it will then be possible to identify several markers that contribute to making mathematics a heritage object—a reference to history, sources of inspiration and (...) bibliographical references. Starting with the observation that there exist contradictory claims in the literature about the relationship between vitalism and emergentism—be it one of inclusion or, on the contrary, exclusion–, this paper aims at disentangling the vitalism–emergentism knot. To this purpose, after having described a particular form of emergentism, namely Lloyd Morgan’s emergent evolutionism, I develop a conceptual analysis on the basis of a distinction between varieties of monism and pluralism. This analysis allows me to identify and characterize several forms of vitalism (...) and emergentism, and a subsequent comparison between these forms constitutes the occasion for a clarification of the relationship between both doctrines. The architects of the modern synthesis banned essentialism from evolutionary theory. This rejection of essentialism was motivated by Darwin’s theory of natural selection, and the continuity of evolutionary transformation. Contemporary evolutionary biology witnesses a renaissance of essentialism in three contexts: “origin essentialism” with respect to species and supraspecific taxa, the bar coding of species on the basis of discontinuities of DNA variation between populations, and the search for laws of evolutionary developmental biology. Such “new essentialism” in contemporary biology must be (...) of a new kind that accommodates relational (extrinsic) properties as historical essences and cluster concepts of natural kinds. (shrink)

There has been a massive advocacy movement over the last 15 years that has sought to advance the case of religion into view of decision-makers in the international development sector. This advocacy effort has been dispersed and not centrally organised, and is made up of the efforts of multiple development actors, religious institutions, researchers and others. This article shows how this advocacy approach has been highly successful in increasing acceptance of the fact that religion is relevant to development, and religious (...) communities and institutions make contributions to the development effort - and this acceptance can now be seen at the highest levels. However, the article highlights several challenges that have come with this advocacy approach. It therefore supports urgent reflection on the direction of this advocacy going forward and suggests that major and uncomfortable adaptations might now be required. (shrink)

In the current article and contrary to a widespread assumption, I argue that Humeanism and ontological emergence can peacefully coexist. Such a coexistence can be established by reviving elements of John Stuart Mill’s philosophy of science, in which an idiosyncratic account of diachronic emergence is associated with extensions of the Humean mosaic and the correlative coming into being of new best system laws, which have the peculiarity of being temporally indexed. Incidentally, this reconciliation of Humeanism and emergence allows for conceiving (...) the autonomy of the special sciences in an interesting way, consistently with the reductionist ideal of a unified science. Efficiency principles are increasingly called upon to study features of human language and communication. Zipf's law of abbreviation is widely seen as a classic instance of a linguistic pattern brought about by language users’ search for efficient communication. The “law”—a recurrent correlation between the frequency of words and their brevity—is a near-universal principle of communication, having been found in all of the hundreds of human languages where it has been tested, and a few nonhuman communication systems as well. The standard (...) explanation for the law of abbreviation derives from pressures for efficiency: speakers minimize their cumulative effort by using shorter words for frequent occurrences. This explanation, we argue here, fails to explain why long words exist at all. It also fails to explain why the law of abbreviation, despite being robust, is systematically weakened by many short and rare words. We propose an alternative account of the law of abbreviation, based on a simple cultural evolutionary model. Our model does not require any pressure for efficiency. Instead, it derives the law of abbreviation from a general pressure for brevity applying to all words regardless of their frequency. This model makes two accurate predictions that the standard model misses: the correlation between frequency and brevity is consistently weak, and it is characterized by heteroskedasticity, with many short and rare words. We argue on this basis that efficiency considerations are neither necessary nor sufficient to explain the law. (shrink)

Contemporary pain literature increasingly acknowledges the need of a multidimensional approach to pain, which accounts for its complex biological, psychological and social components. This is reflected in the recently revised definition of the International Association for the Study of Pain (IASP) and some contemporary philosophical positions. This paper addresses the need to offer a theoretical approach that integrates the biopsychosocial and qualitative multidimensionality of pain by developing the “social grounding view of pain”. My focus is on seeking a multidimensional philosophical (...) approach that accounts not only for its complex biological and psychological aspects but also and specifically does justice to its social dimension. I draw from some of the most recent multidimensional theoretical and methodological approaches that attempt to account for the social component of pain, including enactivism and interpretative phenomenological analysis (IPA), to propose the advancement of the social grounding view, which has a particular focus on socially shared linguistic concepts in relation to the meaning and modulation of pain. More specifically, the social grounding view is based on the argument that the meaning of the experience of pain is determined in part by socially shareable linguistic concepts habitually associated with pain. I test this view against empirical cases drawn from pain neuroscience education (PNE) and try to demonstrate how the modification of the linguistic concepts of pain could be used effectively to modulate its experience. The biennial DEON conferences are designed to promote interdisciplinary cooperation amongst scholars interested in linking the formal-logical study of normative concepts and normative systems with computer science, artificial intelligence, linguistics, philosophy, organization theory and law. In addition to these general themes, DEON 2016 encouraged a special focus on the topic "Reasons, Argumentation and Justification.".

Dans cet article, je montre que quatre normes de rationalité associées aux intentions peuvent être déduites de normes similaires s’appliquant aux acceptations en contextes délibératifs, un type d’état mental apparenté mais irréductible aux croyances par lequel un agent tient certains faits pour acquis lorsqu’il délibère. Je montre que cette approche, que je nomme le pragmatisme hybride, évite certaines limitations de l’approche la plus prisée dans la littérature, le cognitivisme, et qu’en comparaison avec les approches purement pragmatistes, principales rivales du cognitivisme, (...) le pragmatisme hybride rend mieux justice à nos intuitions relatives aux normes associées aux intentions. Je montre enfin que le pragmatisme hybride permet d’expliquer comment les intentions influencent le raisonnement pratique, et de ce fait, comblent un vide important dans les théories contemporaines.In this paper, I show that four normative requirements on rational intentions follow from similar requirements on acceptations in deliberative contexts, a type of mental state close but irreducible to beliefs by which agents take some facts for granted in deliberation. I show that this approach, which I call hybrid pragmatism, avoid shortcomings of cognitivism, one of the most prominent one in the literature. I show furthermore that in comparison with purely pragmatist approaches, the main rivals of cognitivism, an hybrid form of pragmatism makes better justice to our intuitions regarding the sources of the normative requirements on rational intentions, and that it allows for understanding how intentions influence practical reasoning. The proper sensible criterion of sensory individuation holds that senses are individuated by the special kind of sensibles on which they exclusively bear about (colors for sight, sounds for hearing, etc.). H. P. Grice objected to the proper sensibles criterion that it cannot account for the phenomenal difference between feeling and seeing shapes or other common sensibles. That paper advances a novel answer to Grice's objection. Admittedly, the upholder of the proper sensible criterion must bind the proper sensibles –i.e. colors– (...) to the common sensibles –i.e. shapes– so as to account for the visual phenomenal character of shapes. But, as Grice rightly objected, neither association, nor ontological dependence will do –I spend some time isolating why dependence is a bad answer here, basically because the dependence of shape on colors is generic, and that genericity is arguably not part of the phenomenal content of perception. -/- Grice is wrong, however, to think that once association and dependence have been rebutted, there is no other way to attach color to extension. The right way to connect proper and common sensibles is rather trivial, although it seems to have been widely neglected: proper sensibles FILL common ones. To see a shape, by contrast to feeling it, is to perceived as filled by some color. To feel a shape, is to perceive it as, say, filled by pressure. Filling in is the phenomenal connection between proper and common sensibles. -/- One important corollary of that proposal is that proper sensibles –color, pressure, noise, taste...– have to belong to the category of stuffs, in the sense of uncountable entities. Against the widespread view that colors are properties, which have countable instances, the last part of the paper argues that colors are phenomenal stuffs, which fill some visual area. One commits a category mistake in asking: "How many tropes/instances of this determinate redness is there on that ladybird". One should rather ask "How much of this determinate redness is there on that ladybird". (shrink)

The relatively late acceptance of Darwinism in German biology and paleontology is frequently attributed to a lingering of Lamarckism, a persisting influence of German idealistic Naturphilosophie and Goethean romanticism. These factors are largely held responsible for the vitalism underlying theories of saltational and orthogenetic evolutionary change that characterize the writings of many German paleontologists during the first half of the 20th century. A prominent exponent of that tradition was Karl Beurlen, who is credited with having been the first German paleontologist (...) to present a full-fledged theory of saltational evolution and orthogenetic change. A review of Beurlen's writings reveals motives and concerns far more complex, however, and firmly rooted in contemporary völkisch thought and Aryan Science. Beurlen's mature theory of evolution can indeed be understood as his own contribution to Aryan Geology and Biology, tainted as it was with National-Socialist ideology. Evolutionary biologists of the time who opposed the theories of Beurlen and likeminded authors, i.e., idealistic morphology, typology, saltational change, orthogenesis and cyclism did so on Darwinian principles, which ultimately prevailed. But at the time when the battle was fought, their adherence to the principle of natural selection was likewise ideologically tainted, namely in terms of racial theory. National-Socialist ideology was unable to forge a unity of evolutionary theory in Germany even amongst those of its proponents who endorsed this ideology. (shrink)

Touch seems to enjoy some epistemic advantage over the other senses when it comes to attest to the reality of external objects. The question is not whether only what appears in tactile experiences is real. It is that only whether appears in tactile experiences feels real to the subject. In this chapter we first clarify how exactly the rather vague idea of an epistemic advantage of touch over the other senses should be interpreted. We then defend a “muscular thesis”, to (...) the effect that only the experience of resistance to our motor efforts, as it arises in effortful touch, presents us with the independent existence of some causally empowered object. We finally consider whether this muscular thesis applies to the perception of our own body. (shrink)

This paper is devoted to the proof of the following upward categoricity theorem: Let K be a tame abstract elementary class with amalgamation, arbitrarily large models, and countable Löwenheim-Skolem number. If K is categorical in ‮א‬₁ then K is categorical in every uncountable cardinal. More generally, we prove that if K is categorical in a successor cardinal λ⁺ then K is categorical everywhere above λ⁺.

Comment interpréter le regain d'intérêt pour les réflexions sur la transcendance, la quête de sens, la morale et l'éthique dans nos sociétés contemporaines? Invités à se prononcer sur cette question, anthropologues, philosophes, politicologues, sociologues et théologiens livrent ici leurs propres analyses de cette problématique par un riche panorama des réflexions sur la sexualité, la mort, la mode, l'art, les jeunes de la rue, les activités extrêmes, la religion et la pop psycho. Recently there has been a strong movement towards reflections about the “geography of reason,” especially among philosophers who deal with postcolonial thinking. There is also a renewed interest among different schools of thought, both analytical and continental, in the ways our “life world,” or “embodiment,” or “situated cognition,” shape our minds and eventually the philosophy we do. As a result, we have seen some recent publications on the nature and import of the concept of “place” by authors such as Edward (...) Casey, Jeff Malpas, and Bruce Janz. In Philosophy in an African place, Bruce Janz introduces the concept of “philosophy-in-place” with the question as to what it is to do philosophy in a particular context of lived experience or, more specifically, what it is to do philosophy in an African place. This paper expands on Janz's “philosophy-in-place” by developing what will be called a “philosophy through place.” It starts with Janz's discussion of the problem of placing philosophy and a philosophy-in-place. Then it attempts to develop an argument for a “philosophy through place” and its implications for considering the place of philosophy in Africa and the challenge it poses to philosophy. (shrink)

This paper takes a hierarchical approach to the question whether species are individuals or natural kinds. The thesis defended here is that species are spatiotemporally located complex wholes (individuals), that are composed of (i.e., include) causally interdependent parts, which collectively also instantiate a homeostatic property cluster (HPC) natural kind. Species may form open or closed genetic systems that are dynamic in nature, that have fuzzy boundaries due to the processual nature of speciation, that may have leaky boundaries as is manifest (...) in lateral gene transfer and introgression, that may be of multiple origins through hybridization, and that may split and merge and split again over time. The identity conditions of species qua individuals will have to be anchored in their history, rather than in their unique evolutionary origin. Species qua historically conditioned HPC natural kinds requires the kind to be mereologically structured, subject to the part-whole relation rather than the membership relation. This implies that there can be more than one kind of natural kinds. (shrink)

Ainslie argues there are two main kinds of willpower: suppression, which is necessarily effortful, and resolve, which is not. We agree with the distinction but argue that all resolve is effortful. Alleged cases of effortless resolve are indeed cases of what Ainslie calls habits, namely stable results of prior uses of resolve.

La plupart des recherches entreprises sur la philosophie de Michel Foucault ont visé jusqu’à maintenant à définir et assigner son travail à une étiquette politique définie. Foucault est pour les uns anarchiste, pour les autres nihiliste ou encore simple militant de gauche. Ce qui est étonnant avec cet effort, c’est que malgré la multiplicité des lectures, elles peuvent toutes se justifier et trouver quelques appuis dans son oeuvre. Par contre, en entreprenant la recherchedu politique de cette façon, c’est-à-dire en posant (...) à Foucault la question programmatique du « ce qu’il faut faire », nous tombons dans un piège que lui-même a toujours souhaité éviter, celui d’« unidimensionnaliser » sa pensée. Mais alors, comment lire son oeuvre sans nous-mêmes appliquer cette morale d’État civil demandant à chaque philosophe ses papiers politiques? En quoi, si nous refusons cette question, la pensée de Foucault peut-elle demeurer une pensée politique? Notre thèse est la suivante : en examinant la manière avec laquelle Foucault ré????léchit le politique dans son cours au Collège de France Le Gouvernement de soi et des autres, nous p ouvons m ontrer c omment, vers la fin de sa vie, il a changé l’angle de la question. En effet, dans ce cours, l’activité politique n’est plus envisagée à partir de la question du « ce qu’il faut faire », mais à partir de l’expérience du pouvoir elle-même, c’est-àdire comment sommes-nous en mesure d’exercer le pouvoir sur les autres. La tâche du philosophe n’est donc plus celle du « donneur de leçon » pense Foucault dans ce cours, mais celle de faire de sa vie un exemple où parole et acte, discours et vérité sont intimement reliés. This article focuses on a project of « predictive medicine » elaborated in the late 1960s by an American dentist, Emanuel Cheraskin. In his views, this new label was meant to name a preventive medicine based on the knowledge of individual pecularities. The analysis of this unknown episode of medical history allows to uncover the prospective dimension of this medicine, and also the ambiguities which are linked to the idea that understanding individual peculiarities could help rethink the preventive approach. Through (...) the study of Cheraskin’s propositions, I want to show that the ambition of providing a new basis to prevention, namely a science of individuals, casts a light on the predictive project. While paying attention to this ambition, rather than to genomic techniques, I hope to open new paths in our understanding of various aspects of contemporary predictive medicine. (shrink)

The aim of this paper is to give a critical discussion of Sartre’s concept of sexual desire and its relation to self-identity and freedom. Why Sartre? Sartre is one of very few philosophers who offers a systematic account of sexual desire. He has influenced eminent philosophical concepts of sexual desire held by, for instance, de Beauvoir, Lacan, Foucault, Levinas, Irigaray and Butler, but not much is written about his own notion of sexual desire. This alone is reason to explore Sartre’s (...) view. What makes his view of sexual desire particularly interesting is that it is framed by his theory of freedom. Sartre offers the original, radical notion that freedom is absolute. Because consciousness is never self-identical, he argues, human identity is not fixed. Instead, we are consequently nothing else but what we keep desiring to make of ourselves. He concludes that we are always free to choose our drives and desires, even what seem to be our most enslaving, natural sexual instincts. The question raised in this article, however, concerns what the nature of sexual desire is and how free we really are to choose our sexual desires. I first contextualise Sartre’s view of sexual desire within his notion of desire in general and its relation to instinct, drive, consciousness, freedom and identity. Then, I give a detailed discussion of his analysis of sexual desire, its relation to freedom, and, what Sartre calls its failures. Finally, I discuss a critique of, and alternative to, Sartre’s theory of sexual desire from the perspective of my own notion of heteronomous and autonomous desire and freedom. (shrink)

Broadly speaking, something can be called intermediate for Plato insofar as it occupies a place between two objects, poles, places, time, or principles. But this broad meaning of the intermediate has been eclipsed by the Aristotelian critique of the intermediate objects of the dianoia, so that it has become more difficult to think of the intermediates as functions of the soul. The aim of this paper is to show how, in the Republic, thumos is analogously treated as an intermediate with (...) other kinds of intermediate objects, and tentatively to relate this psychological intermediate in a broader theory with doxa, as its epistemological ground in the course of action. How far can one ascribe a spatial meaning to pain? When I have a pain, for instance, in my leg, how should one understand the “in” in the “pain in my leg”? I argue (contrary to Noordhof) that pain does have a spatial meaning, but (contrary to Tye) that the spatiality of pain is not to be understood in the standard sense of spatial enclosure. Instead, spatiality has a special meaning with regard to pain. By defining pain in phenomenological terms (...) as a disturbed form of bodily perception, I contend that the “in” in “pain in my body” has a dual spatial meaning: firstly, it signifies my internal perceptual relation to a disturbing part of my body; secondly, it denotes the external perceptual relation to my environment that the disturbance forces me to take. Once the spatiality of pain is understood in terms of such a perceptual relation, it is not restricted to localisable hurts, but pertains to all forms of pain, such as affliction and agony. (shrink)

Samuel Johnson claimed to have refuted Berkeley by kicking a stone. It is generally thought that Johnson misses the point of Berkeley's immaterialism for a rather obvious reason: Berkeley never denied that the stone feels solid, but only that the stone could exist independently of any mind. I argue that Johnson was on the right track. On my interpretation, Johnson’s idea is that because the stone feels to resist our effort, the stone seems to have causal powers. But if appearances (...) are to be taken at face value, as Berkeley insists, then the stone has causal powers. I argue that such causal powers threaten not only Berkeley’s view that only minds are active, but also, and more fundamentally, his central claim that sensible things depend on perception. (shrink)
