In this paper I investigate the possibility of a dictatorship in the context of Harsanyi's Social Aggregation Theorem. Preliminarily, some propositions about Harsanyi's Theorem are presented using an alternative principle that I name Quasi-strong Pareto, which is the latter part of Strong Pareto. Then I define dictatorship as a requirement that social preference agrees with a dictator's preference or those of members of dictatorial group even if their preferences strictly contradict those of all other people in the society. Conclusively, although (...) in each version of Harsanyi's Theorem with Pareto Indifference, Weak Preference Pareto or Weak Pareto the social utility function may have a form of dictatorship, however if individuals' vNM utility functions are all 'individualistic' and Quasi-strong Pareto is satisfied, then the dictatorship is excluded. We provide two alternative characterizations of the Nash bargaining solution. We introduce new simple axioms, strong undominatedness by the disagreement point, and egalitarian Pareto optimality. First, we prove that the Nash solution is characterized by symmetry, scale invariance, independence of irrelevant alternatives, and strong undominatedness by the disagreement point. Second, we replace the independence of irrelevant alternatives axiom with the sandwich axiom and egalitarian Pareto optimality. This paper replies to Nanay’s response to my recent paper. My suggestions are the following. First, “should” or “ought” does not need to be deontic. Second, etiological theories of function, like provability logic, do not need to attribute modal force to their explanans. Third, the explanans of the homological account of trait type individuation does not appeal to a trait’s etiological function, that is, what a trait should or ought to do. Finally, my reference to Cummins’s notion of function was (...) intended to note that the homological account is permitted to use this non-etiological notion of function. (shrink)

The author proposes that the anonymous letter dated May 19, 1641, which Mersenne delivered to Descartes, should be attributed to Thomas Hobbes. Although the text is known, it is usually considered not so much in itself as for Descartes’s two replies, which contain important clarifications on the proof of God’s existence. Hobbes’ hand is revealed by various thematic, conceptual, and lexical analogies and, above all, by the presence of two doctrines characteristic of his thought: 1) the denial of the existence (...) of intellectual ideas; 2) the assertion that the nature of God can only be described by the proposition “God exists”. Attribution to Hobbes of the May 19 th 1641 letter throws new light on the debate that followed Descartes’s Meditations as well as on Mersenne’s role. (shrink)

This study investigates the meanings of the Japanese low-degree modifiers _kasukani_ ‘faintly’ and _honokani_ ‘approx. faintly’ and the English low-degree modifier _faintly_. I argue that, unlike typical low-degree modifiers such as _sukoshi_ ‘a bit’ in Japanese and _a bit_ in English, they are sense-based in that they not only semantically denote a small degree but also convey that the judge (typically the speaker) measures the degree of predicates based on their own sense (the senses of sight, smell, taste, etc.) at (...) the level of conventional implicature (CI) (e.g., Grice (in: Cole, Morgan (Eds.), Syntax and semantics iii: speech acts, Academic Press, New York, 1975), Potts (The logic of conventional implicatures, Oxford University Press, Oxford, 2005), McCready (Semant Pragmat 3:1–57, 2010. https://doi.org/10.3765/sp.3.8, Sawada (Pragmatic aspects of scalar modifiers. A unique feature of sense-based low-degree modifiers is that they can indirectly measure the degree of non-sense-based predicates (e.g., emotion) through sense (e.g., perception). I show that the proposed analysis can also explain the indirect measurement in a unified way. This paper proposes deep and fundamental structures of communication among persons in a “coexistential” setting. The basic framework for this formalization of communication structures is Leibnizian notions of space and time together with the notion of the Existential Graph by C. S. Peirce and that of the Petri net, more precisely, the occurrence net. The fundamental structures of coexistential communication are then formalized as co-creation of Leibnizian space and time in such a manner that they are used to link the (...) communicated messages, thus establishing the “coexistential atmosphere and field” (“Ba” in Japanese) among the individuals. This framework is then applied to the analysis of theater play communication. Finally, the framework of information edaphology is also introduced to discuss the growth processes of individuals and communities through coexistential communication. (shrink)

The present study investigates the ways in which Japanese speakers negotiate their opinions in conversational interaction. On the one hand, speakers are apt to exaggerate a particular aspect of a given issue in asserting their opinion, on the other hand, they may also incorporate a self-qualification admitting a potential problem in their claim. By expressing their awareness of the problem before it is pointed out by the co-participants, the speakers seem to get license to proffer an exaggerated or overgeneralized claim (...) and to increase their chance of receiving an affiliative response. This study explicates the mechanism through which such a self-qualifying clause emerges in the development of opinion-negotiation sequences. Further, as a contribution to a growing body of research on "interaction and grammar" (Ochs, Schegloff, and Thompson, 1996), this study explores the use of "contrastive" markers, -kedo and demo, in constructing turns and sequences in opinion-negotiation. The data demonstrate these two structurally different types of markers play distinct roles in differentiating and yet conjoining the speakers' assertion and self-qualification. (shrink)

In the half-century history of clinical practice of diagnosing brain death, informed consent has seldom been considered until very recently. Like many other medical diagnoses and ordinary death pronouncements, it has been taken for granted for decades that brain death is diagnosed and death is declared without consideration of the patient’s advance directives or family’s wishes. This essay examines the pros and cons of using informed consent before the diagnosis of brain death from an ethical point of view. As shared (...) decision-making in clinical practice became increasingly indispensable, respect for the patients’ autonomous wishes regarding how to end their lives has a significant role in deciding how death is diagnosed. Brain death, as a fully technologically controlled death, may require a different ethical framework from the old one for traditional cardiac death. With emerging and proliferating options in end-of-life care for those who suffer from catastrophic brain injury, the traditional reasoning that ‘death gives no choice, hence no consent’ requires another examination. Patients facing imminent brain death now have options other than undergoing the diagnostic workup for brain death, such as donation after circulatory death and withdrawal of life-sustaining treatment with maximum comfort measures for death with dignity. Nevertheless, just as in the debate over opt-in versus opt-out organ donation policies, informed consent before the diagnosis of brain death faces fierce opposition from consequentialists urging the expansion of the donor pool. This essay examines these objections and provides constructive replies along with a proposal to accommodate this morally required consent. (shrink)

Nakamura proposed two three-valued temporal logics. We present two extended Gentzen-type formulations of these logics. Then we prove the soundness as well as the completeness theorem.

The Japanese comparative adverb motto has two different uses. In the degree use, motto compares two individuals and denotes that there is a large gap between the target and a given standard with a norm-related presupposition. On the other hand, in the so-called ‘negative use’ it conveys the speaker’s attitude toward the utterance situation. I argue that similarly to the degree motto, the negative motto is a comparative morpheme, but unlike the degree motto it compares a current situation and an (...) expected situation at the level of conventional implicature /expressive. I argue that the speaker’s negative evaluation of the utterance situation in question comes from the large gap between the expected degree and the current degree. The theoretical implications of this paper are that there is a natural extension from semantic comparison to expressive comparison and that there is a type in natural language that can be called an ‘indirect expressive’, as opposed to ‘direct expressives’ like bastard and man. In fact, the text quoted by Bayle is not taken from Sarasin's Discours sur Epicure, but, as Bayle explicitly points out ("Xénophanes," K, note 124), from a "Discours des ennuis et des déplaisirs." This "Discours" is chapter 5 of De l'usage de la vie, a text published in many editions of Saint-Evremond's works (see the Barbin 1692 in-4° ed., Seconde Partie, p. 326). The paternity of De l'usage de la vie is doubtful and controversial, but it possibly contains some passages taken from Saint-Evremond's unpublished manuscripts, especially in chapters 3-6, as reported by an important source quoted by Ternois in Saint-Evremond, Œuvres en prose, IV, 3-4, note 1.2) Lennon's text (pp. 338-39): "The significance of two of the other texts advanced by Mori is fully vitiated, for in them Bayle makes the same mistake."In my article, I did not fail to state that these texts (OD I, 158 and Dict., "Epicure," M) are taken from an apocryphal source. There are two contrasting views on the decision-making for life-sustaining treatment in advanced stages of dementia when the patient is deemed incompetent. One is to respect the patient's precedent autonomy by adhering to advance directives or using the substituted judgement standard. The other is to use the best-interests standard, particularly if the current judgement on what is best for the incapacitated patient contradicts the instructions from the patient's precedent autonomy. In this paper, I argue that the protracted clinical course of (...) dementia over many years requires the extended perspective of a progressive decision-making process—extended in both social space and time. The ongoing debate between these two competing views has missed this perspective by focussing on an exclusive disjunction between the competent former self and the incompetent current self. Drawing on theories of situated cognition in cognitive science, I will show that the cognition of a demented patient can be viewed as extended and embodied by her supportive social environment. As the disease progresses, the content of the mind of a demented person becomes partially constituted by such external resources along with her diminishing intrinsic mind. With this understanding, medical decision-making for a demented patient can be construed as a temporally and socially extended practice. A collective decision-making body consisting of the patient, her family and surrogates, and the clinician, should make progressive decisions as a whole over years of the disease course. Finally, I will provide a practical example of how this proposal can be applied in clinical practice. (shrink)

BackgroundThis essay provides an ethical and conceptual argument for the use of informed consent prior to the diagnosis of brain death. It is meant to enable the family to make critical end-of-life decisions, particularly withdrawal of life support system and organ donation, before brain death is diagnosed, as opposed to the current practice of making such decisions after the diagnosis of death. The recent tragic case of a 13-year-old brain-dead patient in California who was maintained on a ventilator for over (...) 2 years illustrates how such a consent would have made a crucial difference.MethodsConceptual, philosophical, and ethical analysis.ResultsI first consider a conceptual justification for the use of consent for certain non-beneficial and unwanted medical diagnoses. I suggest that the diagnosis of brain death falls into this category for some patients. Because the diagnostic process of brain death lacks the transparency of traditional death determination, has a unique epistemic structure and a complex risk-benefit profile which differs markedly from case to case, and presents conflicts of interest for physicians and society, I argue that pre-diagnostic counseling and informed consent should be part of the diagnostic process. This approach can be termed as “allow cardiac death”, whose parallel logic with “allow natural death” is discussed. I also discuss potential negative impacts on organ donation and health care cost from this proposal and offer possible mitigation. I show that the pre-diagnostic counseling can improve the possibility for well-thought-out decisions regarding organ donation and terminating life-support system in cases of hopeless prognosis. This approach differs conceptually from the pluralism of the definition of death, such as those in New Jersey and Japan, and it upholds the Uniform Determination of Death Act.ConclusionsMy intention is not to provide an instant panacea for the ongoing impasse of the brain death debate, but to point to a novel conceptual ground for a more pragmatic, and more patient- and family-centered approach. By enabling the family to consent to or decline the diagnostic process of brain death, but not to choose the definition of death, it upholds the current legal definition of death. (shrink)

Lennon returns to the controversial question of Bayle's attitude towards religion. The point he debates is the particular use that, in expounding his conception of the relationship between faith and reason, Bayle makes of a passage from Saint-Evremond. In Lennon's view the correct interpretation of this point would show that (...) Bayle's fideism is to be "taken at face value" without any hint of irony and with no suspicion of dissimulation or insincerity.1 This would cast doubt on and greatly weaken the interpretation I proposed in my Bayle philosophe.2 My aim here is to respond briefly to Lennon's arguments and to clarify even more briefly what in my opinion is the right perspective in which to consider Bayle's position on this topic.The context in which Bayle quotes Saint-Evremond is to be found in the Eclaircissements he added to the second edition of his Dictionnaire historique et critique (1702) to counter the Dutch religious authorities' harsh criticism of the first edition. In particular the Walloon Consistory accused Bayle of taking a skeptical position that undermined the most important dogmas of Christian faith. In response Bayle wrote the Eclaircissement sur les Pyrrhoniens, a clumsy mosaic of quotations from the Scriptures and from patristic and profane texts, with which he sought to show that his skeptical fideism was not in the least heterodox but indeed the position that most closely reflected true Christianity. The quotation from Saint-Evremond, almost at the end of this text, is taken [End Page 323] from the Conversation du Maréchal d'Hocquincourt et du Père Canaye (written in about 1654).3 The final passage gives a clear idea of the general tone: after having disputed with a churchman the need to subject one's intellect to the yoke of faith, the marshal concludes by saying that he is ready to be crucified "without knowing why." Father Canaye replies: "No reason! That is the true religion. No reason! God has granted you a fine grace, mylord." So, and here Lennon obviously agrees (229), Saint-Evremond's is a text with no shadow of mystical inspiration, indeed strongly tending in the libertine direction, as is clear from the blatant way it pours scorn on the fideist approach.In my interpretation Bayle's use of this quotation does not at all demonstrate his atheism or unbelief, for in my view that question is undecidable. However, the quotation from Saint-Evremond is sufficient—and this is the onlyreason I mentioned it4 —to show that Bayle's approach to fideism is in no way innocent and naive as is sometimes claimed. On the contrary, his texts on this subject contain what amounts to provocations aimed at orthodox readers (to which they immediately reacted). This, together with other more important reasons, leads me to believe that Bayle's professions of Christian faith, though frequent, are generally far from being above suspicion: indeed, almost every line of them raises questions about their actual significance.The provocation contained in the quotation from Saint-Evremond appears in all its rhetorical weight if we associate this text with three other passages from Bayle's works. The first is from the Nouvelles de la république des lettres of December 1686, in which Bayle stresses the unedifying nature of the religious maxims contained in Saint-Evremond's Conversation (which, incidentally, he himself had just had printed in the collection Le Retour des pièces choisies).5 The second is taken from a letter by Jean d'Oulès to Bayle, written in 1696, in which the author deals with exactly the same passage from the Conversation that was later to be reproduced in the Eclaircissement. In this letter d'Oulès quotes the full passage which he considers to be a "naughty text" deliberately written to throw ridicule on the fanatical fideism of Pierre Jurieu.6 The third passage is from Bayle's Continuation des pensées diverses of 1704 in which, shortly after the death of Saint-Evremond, he publicly reveals the poet... Naturalistic teleological accounts of mental content rely on an etiological theory of function. Nanay has raised a new objection to an etiological theory, and proposed an alternative theory of function that attributes modal force to claims about function. The aim of this paper is both to defend and to cast a new light on an etiological theory of function. I argue against Nanay’s “trait type individuation objection,” suggesting that an etiological theory also attributes modal force to claims about function. Evolutionary theory has recently been applied to language. The aim of this paper is to contribute to such an evolutionary approach to language. I argue that Kripke’s causal account of proper names, in terms of natural selection, captures the norm of uses of a proper name, which is to refer to the same object as past others’ uses in a linguistic community. My argument appeals to Millikan’s theory of direct proper functions, which captures the norms of various functional entities in (...) terms of natural selection. (shrink)

We also establish the consistency of this system, applying the strong normalization theorem.

In lowland South America, breath animates human and non-human bodies, pulsating through the materialities of organisms. Humans, however, should manage their bodies to recast and reconfigure breath in its most life-enhancing manifestations: singing and smoking. These are the specialized domains of those able to manage their vitalities in such a way as to produce potent effects in themselves and in the world around them, including influencing atmospheric conditions, the lives of animals and plants and the harming and healing of others. (...) In these relational onto-epistemologies, intersubjectivity, intercorporality and states of non-cognitive interaffection find new depths. Breath, properly managed, can make and unmake worldly forms, including bodies and the societies they come together in. Focusing on two Amerindian communities, the Warekena of northwestern Rio Negro, Brazil and the Shipibo-Konibo of the Ucayali valley in Eastern Peru, this article examines the interface between human and non-human subjectivities, and how resonant interaffective atmospheric conditions are induced to promote health. The social and cultural causes behind the widespread use and acceptance of robots in Japan are not yet completely understood. This study compares humans and robots in images gathered through Google searches in Japanese and in English. Numerous pictures obtained by the search in Japanese were found to have a human and a robot looking together at something else (“third item”), whereas many of the images acquired by search in English show a human and a robot facing each other. This (...) is similar to the composition of mother and child in paintings: in _ukiyo-e_ that was painted mainly in the Edo period of Japan, the mother and child are often depicted together viewing something other than themselves, whereas this is not the case in Western paintings of mother and child. It has also been pointed out that, in modern Western paintings, the world inside the picture is separated from the outside world, forming an independent microcosmos, whereas the inside and outside are continuous in Japanese paintings. These may indicate that, in Japanese society, robots are to a certain extent regarded as fellow human beings who can share the third item. In Western society, on the other hand, no code is embedded that can fix robots’ superiority or inferiority to humans, which would easily trigger an antagonistic view toward artificial intelligence (AI)/robots as threatening entities, as shown in most of Western literature and movies. We suggest that such cultural characteristics of Japanese society can contribute to enhance coexistence with AI/robots. (shrink)

This paper investigates the semantics of measure phrases in Japanese. Based on new data, we argue that the interpretation of measure phrases in Japanese is sensitive to scale structure such that (i) measure phrases are introduced by a degree morpheme that selects only for gradable predicates whose scale contains a minimal element (i.e., a lower closed scale) and (ii) violations to this restriction are repaired via coercion, which forces a comparative interpretation with a contextually determined standard and hence a minimal (...) element. We compare the Japanese facts to data in other languages and argue that the requirement of having a minimal element is not specific to Japanese, but universal. We show that languages may vary in how they deal with potential violations of this universal constraint, including coercion of a contextually recoverable derived minimal element (Japanese), ungrammaticality (e.g., Spanish, Korean, Russian), and a hybrid system of ungrammaticality for some adjectives and allowed constraint violation for others (e.g., English, German, Italian). The paper critically discusses the proposal of identifying the subject of human rights by means of the concept of moral person, reflecting on the inherent connection between the concept of person and that of human rights in their moral dimension, that is, in the light of an ethics of human rights, an ethics in which human rights represent fundamental moral values. The thesis defended is that the concept of moral person lends itself more than any other to the role of (...) subject of human rights, if conceived as a relational, communicative and representative social value, that is as “the concept of an individual human being whose features enable him to join some segments of his life with others”.
