Este trabajo examina el Contrato social de Rousseau como exposición de los principios de derecho político de la “república legítima” (Estado), que están en la base de la comprensión de los cuerpos políticos modernos. Tomando en cuenta el campo agonístico de la teoría del contrato y de la tradición republicana en que se inserta, el interés recae en la identificación y sistematización de los principios formales que subyacen a su concepción de la república como un todo compuesto y complejo, así (...) como al enunciado de sus principios constitutivos. A partir de ello, el artículo identifica el modelo de la república en estado de equilibrio, que le permite dar el paso para el desarrollo de su teoría sobre el funcionamiento del Estado y el papel del gobierno. Este artículo describe tres usos del concepto de la nada. Primero, en el ámbito de la mística cristiana, analizamos el tratamiento que de esta categoría hace el monje dominico del siglo XIII Meister Eckhart; luego, dentro del ámbito filosófico-político, revisamos los usos que de esta noción hacen el filósofo de la liberación argentino Enrique Dussel y el poeta y teórico cultural norteamericano Fred Moten. Nuestra intención es investigar posibles influencias del empleo de la nada en la mística cristiana sobre el (...) ámbito filosófico-político. Postulamos que en los tres casos se da una dinámica de la nada que concluye con una inversión, en la cual se pasa desde la experiencia de la nada como defecto o privación hacia la nada como exceso, es decir, de lo sub-ontológico a lo trans-ontológico. By reading mainly Heidegger’s “What Is Metaphysics?,” the aim of this paper is to illuminate the ontological revelatory function of the nothing that occurs in anxiety. The two parts of this paper describe the same night of anxiety. While the first part shows this night from the point of view of the movement or sweep of anxiety, the second studies this same night from the point of view of the ontological revelatory role of the nothing and its negative logic of (...) disclosure. It is crucial for my analysis to keep apart two different meanings of the nothing. There is the nothing as being’s totally other (nihil negativum), on the one hand, and the nothing as Being, on the other. While with this second meaning one dwells in the realm of the ontological, it is the first meaning-which is the focus of this paper-that secures our access to it. Resumen Mediante la lectura principalmente del texto “¿Qué es metafísica?” de Heidegger, el objetivo de este artículo es iluminar la función reveladora ontológica de la nada que ocurre en la angustia. Las dos secciones de este artículo describen la misma noche de la angustia. Mientras que la primera sección muestra esta noche desde el punto de vista del movimiento o vaivén de la angustia, la segunda estudia esta misma noche desde el punto de vista del papel revelador ontológico de la nada y su lógica negativa de desvelamiento. Para nuestro análisis es crucial mantener separados dos sentidos distintos del concepto de nada: por un lado, está la nada como lo totalmente otro con respecto al ente (nihil negativum); y por el otro lado, la nada como Ser. Si bien con este segundo significado uno habita en el ámbito de lo ontológico, es el primer significado, el cual es el tema central de este artículo, el que asegura nuestro acceso a él. (shrink)

El pensamiento ético de Averroes apenas ha sido estudiado y ello a pesar de que es el único filósofo islámico medieval del que se conserva un Comentario a la principal obra aristotélica sobre el tema, la Ética nicomáquea. El eje del presente trabajo es precisamente un nuevo análisis de ese Comentario a través de los conceptos de eudaimonía o felicidad, philía o amistad y tò díkaion o justicia.

This study focuses on latent inhibition, a mechanism behind selective attention, as the biological basis of creativity in schoolchildren. The main objective of this study is to know if low levels of attention positively affect the levels of creativity manifested in students between the ages of nine and 12. The design of this study is non-experimental with an explanatory-correlational cross-sectional quantitative approach. In order to achieve the objective suggested, several education centers located in Murcia were selected, in which 476 students (...) took part in a creativity test, an attention test, and another test about intelligence depending on the educational level. The results obtained showed that selective attention was negatively correlated with graphic creativity, understanding that behind it lies the latent inhibition, and that when certain levels of intelligence are present, this negative correlation increases. In this way, the simultaneous existence of creative and inattentive subjects is demonstrated. (shrink)

Our conversations about punishment have been constrained by the presumption that crimes ought to be punished. This presumption does not entail that crimes must be punished, but rather that punishment occurs as a natural response to wrongdoing instead of as a conventional creation. As a consequence, the challenges for punishment’s justification have been reduced to the problems of purpose, opportunity and form, leaving unaddressed the question of the authority of a certain polity to impose this form of treatment on a (...) given individual. In order to present and criticize this presumption, the article traces its origins by revisiting the debate about the nature of punishment that took place during the emergence of liberal political philosophy. After evaluating the main arguments of this debate the article concludes by arguing that liberal theories of punishment should give up this presumption. (shrink)

Does the board of directors influence cost of debt financing? This study of a sample of Spanish listed companies during the period 2004-2007 provides some evidence about the question. The results suggest that two board attributes - director ownership and board activity - appear to influence in the risk assessment of debtholders because of their ability to reduce agency cost and information asymmetry. We also find a non-linear relationship between board size and cost of debt, suggesting that from certain levels (...) the benefits of large boards may be outweighed by the cost of poorer communication and increased decision-making time. The recently published book Theism, Atheism, and Big Bang Cosmology 1 has had quite an impact on the ongoing debate about the existence of God.

In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

Background: Dignity experience in the daily lives of people living with dementia is influenced by their relational interactions with others. However, literature reviews show that knowledge concerning crucial interactional qualities, preserving their sense of dignity, is limited. Aim: The aim of this study was to explore and describe crucial qualities of relational interactions preserving dignity experience among people with dementia, while interacting with family, social network, and healthcare professionals. Methodology: The study was founded upon Gadamer’s philosophical hermeneutics, and an exploratory (...) design employing qualitative research interviews was conducted. Participants and research context: A total of 11 individuals diagnosed with mild to moderate dementia, living in their own homes, were recruited from two Hospital Memory Clinics in Norway. Ethical considerations: In recruiting persons with dementia as study participants, sensitivity toward their life history, autonomy, integrity, relationships, and dignity is essential. These standards, and the ethical principles of moral sensitivity to their vulnerability, doing no harm, showing justice, and respecting their personal utility, guided our research. Results: Three main interactional qualities preserving the participants’ dignity experience were found: Experiencing love and confirmation; experiencing social inclusion and fellowship; experiencing humane warmth and understanding within a caring culture, while being met as an equal human being. A total of 10 sub-qualities were identified within these 3 main qualities. Discussion and final considerations: Dignity experience among the participants was preserved when certain interactional qualities were present in their interactions with family, social network, and healthcare professionals. While supporting some of the findings of previous studies, this study adds new knowledge on the subject. Knowledge of relational interactions toward preserving dignity experience should be a fundamental part of future dementia care practice. Based on the results of this study, an empirical–theoretical model was developed for this purpose. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. One of the main problems of Lewis' approach to the conventionality of language is the so-called "probLem of the meaning without use". In this paper I consider the possible solutions to this problem and I conclude that in order to avoid this objection Lewis' proposal must be substantially modified.

Research indicates the essentiality of dignity as a vital component for quality of life, reconfirming the emphasis on dignity preservation in the international code of nursing ethics. Applying Noblit and Hare’s meta-ethnography, the aim of the study was to develop a theory model by synthesizing 10 qualitative articles from various cultural contexts, exploring nurse and allied healthcare professional perception/practice concerning dignity-preserving dementia care. “Advocating the person’s autonomy and integrity,” which involves “having compassion for the person,” “confirming the person’s worthiness and (...) sense of self,” and “creating a humane and purposeful environment,” was identified as a primary foundation for dignity-preserving dementia care. “Balancing individual choices among persons no longer able to make sound decisions, against the duty of making choices on behalf of the person,” which involves “persuasion” and/or “mild restraint,” was considered a crucial aspect in certain situations. “Sheltering human worth—remembering those who forget” was identified as a comprehensive motive and core value within dignity-preserving dementia care. Many people think we should refrain from intervening in nature as much as possible. One of the main reasons for thinking this way is that the existence of nature is a net positive. However, population dynamics teaches us that most sentient animals who come into existence in nature die shortly thereafter, mostly in painful ways. Those who survive often suffer greatly due to natural causes. If sentient beings matter, this gives us reasons to intervene to prevent such harms. This counterintuitive (...) conclusion can be opposed by arguing that we should not care about nonhuman animals; that other values, such as the existence of certain ecosystemic relations or of untouched wild areas, count for more than the interests of sentient beings; or that intervention in nature cannot succeed. There are, however, strong reasons to reject these claims and to support significant intervention in nature for the sake of animals, despite our deep-rooted intuitions to the contrary. (shrink)

The paper outlines the model of controversy spaces. The model of controversy spaces integrates two different elements of the dialectical tradition. On the one hand, dialectics in its ancient meaning: the practice of controversial dialogue. On the other hand, the model incorporates dialectics understood as a pattern of change in intellectual history, based on the confrontation between opposite standpoints. I will be argued in this paper, the dialectical tradition was almost completely left aside in modernity and substituted by a monolectic (...) approach. The model that will be outlined below aims at overcoming this view by focusing on the emergence, development and transformation of controversy spaces. (shrink)
