This chapter provides a historical account of the transformation of pregnancy through philosophical theory and legal practice. What has remained seemingly consistent across history, though, is the lack of rights a pregnant woman can enjoy. Whilst it may manifest differently across time and place, unfortunately misogynistic attitudes persist, and this is reflected in the continual degrading of the gestator (and gestation), which is reinforced by certain philosophical theorising and technological advancement. We thus urge caution in making philosophical claims about the (...) epistemic transformation in pregnancy, given the epistemic (and other) injustices already faced by pregnant people. We recognise that there are transformations that occur because of pregnancy, but we argue that there ought not be with respect to the pregnant person's autonomy, agency, and control over their bodies. Through an analysis of legal cases, we can see that the practice falls out of line with the theory regarding how pregnant people are treated. But perhaps it is both the theory and the practice that need to change so as to bring them in line. How we theorise about pregnancy is intertwined with our cultural views, our technological advancements, and our medical and legal practices, requiring multi-disciplinary study for a more holistic overview. In this chapter, we contribute to this endeavour by bringing some such strands together, regarding the transformation that pregnancy is, that pregnancy makes, and that pregnancy has had historically, in philosophy, and in legal practice. Bioethics needs an expanded moral vision. It is now time for bioethics to take full account of the problems of health disparities and structural injustice that are made newly urgent by the COVID-19 pandemic and the effects of climate change. Textbook descriptions of the foundations of Genetics give the impression that besides Mendel’s no other research on heredity took place during the nineteenth century. However, the publication of the Origin of Species in 1859, and the criticism that it received, placed the study of heredity at the centre of biological thought. Consequently, Herbert Spencer, Charles Darwin himself, Francis Galton, William Keith Brooks, Carl von Nägeli, August Weismann, and Hugo de Vries attempted to develop theories of heredity under an evolutionary perspective, (...) and they were all influenced by each other in various ways. Nonetheless, only Nägeli became aware of Mendel’s experimental work; it has also been questioned whether Mendel even had the intention to develop a theory of heredity. In this article, a short presentation of these theories is made, based on the original writings. The major aim of this article is to suggest that Mendel was definitely not the only one studying heredity before 1900, if he even did this, as may be inferred by textbooks. Although his work had a major impact after 1900, it had no impact during the latter half of the nineteenth century when an active community of students of heredity emerged. Thus, textbooks should not only present the work of Mendel, but also provide a wider view of the actual history and a depiction of science as a social process. (shrink)

This paper aims to provide a starting point for a non-representational approach to language. It will do so by undoing some of the reifying tendencies that are at the heart of the ontology of scientific psychology. Although non-representational theories are beginning to emerge, they remain committed to giving explanations in terms of ontological structures that are independent of human activity. If they maintain this commitment it is unlikely that they will displace representationalism in domains such as language. By following some (...) of Wittgenstein’s remarks on language, I explain the phenomenon of reification by carefully considering the formative, situational flow of language—thus without invoking representations. In this way, the paper sketches a direction of approach for a non-representational theory of language, undercutting the most important assumptions that justify an explanatory ontology devoid of human activity. In this book, Jana S. Ros̆ker offers the first comprehensive overview and exegesis of the work of Li Zehou, who is one of the most significant and influential Chinese philosophers of our time. Ros̆ker shows us how Li's complex system of thought seeks to revive various Chinese traditions, and at the same time attempts to harmonize or reconcile this cultural heritage with the demands of the dominant economic, political, and axiological structures of our globalized world. Variously characterized as 'neo-traditional,' 'neo-Kantian,' (...) 'post-Marxist,' 'Marxist-Confucian,' 'pragmatist,' 'instrumentalist,' 'romantic,' and more, Li's work was central to the period known as the Chinese Enlightenment in the 1980s and has helped modify and transform antiquated patterns of Chinese intellectual discourse. He is one of the rare Chinese thinkers whose work has had not only had a deep and lasting impact on Chinese intellectuals, but has acquired a broad readership outside of China as well. Seen from a broader intercultural perspective, Li's unique and imaginative approach to a wide range of basic theoretical problems has created new styles of intellectual investigation, while reminding us of our belonging to a common humanity, regardless of differences in our individual cultures, languages, preferences, and traditions. Homotopy Type Theory is a proposed new language and foundation for mathematics, combining algebraic topology with logic. An important rule for the treatment of identity in HoTT is path induction, which is commonly explained by appeal to the homotopy interpretation of the theory's types, tokens, and identities as spaces, points, and paths. However, if HoTT is to be an autonomous foundation then such an interpretation cannot play a fundamental role. Many business practices focus on maximizing material affluence, or wealth, despite the fact that a growing empirical literature casts doubt on whether money can buy happiness. We therefore propose that businesses consider the possibility of "time affluence" as an alternative model for improving employee well-being and ethical business practice. Across four studies, results consistently showed that, even after controlling for material affluence, the experience of time affluence was positively related to subjective well-being. Studies 3 and 4 further demonstrated that the (...) experience of mindàulness and the satisfaction of psychological needs partially mediated the positive associations between time affluence and well-being. Future research directions and implications for ethical business practices are discussed. (shrink)

Growing demand for broadly accessible mental health care, together with the rapid development of new technologies, trigger discussions about the feasibility of psychotherapeutic interventions based on interactions with Conversational Artificial Intelligence (CAI). Many authors argue that while currently available CAI can be a useful supplement for human-delivered psychotherapy, it is not yet capable of delivering fully fledged psychotherapy on its own. The goal of this paper is to investigate what are the most important obstacles on our way to developing CAI (...) systems capable of delivering psychotherapy in the future. To this end, we formulate and discuss three challenges central to this quest. Firstly, we might not be able to develop effective AI-based psychotherapy unless we deepen our understanding of what makes human-delivered psychotherapy effective. Secondly, assuming that it requires building a therapeutic relationship, it is not clear whether psychotherapy can be delivered by non-human agents. Thirdly, conducting psychotherapy might be a problem too complicated for narrow AI, i.e., AI proficient in dealing with only relatively simple and well-delineated tasks. If this is the case, we should not expect CAI to be capable of delivering fully-fledged psychotherapy until the so-called “general” or “human-like” AI is developed. While we believe that all these challenges can ultimately be overcome, we think that being mindful of them is crucial to ensure well-balanced and steady progress on our path to AI-based psychotherapy. The rapidly growing research on hybrid organizations in recent years suggests that these organizations may have particular abilities to facilitate institutional change. This article contributes to our understanding of change and, in particular, sustainable transformation in society by highlighting the importance of organizational forms. Looking more closely at the role of hybrid organizations in processes of path generation, we analyze the conditions under which hybrid organizations may enable path generation. A retrospective exploratory case study of the Swedish hybrid (...) organization The Natural Step confirms how hybrids can take part in- and may facilitate the early phases of path generation: assimilation and coalescence. The conclusion drawn is that hybrids have multivocal abilities that enable them to earn trust and authority to open up “neutral” spaces for orientation and connection between actors in separated sub-paths, and that this in turn may ease tensions and trigger dialogue and exchange, also between former opponents. Yet, as also seen in the case, this enabling position of the hybrid may be both fragile and temporary. (shrink)

Kant is often regarded as one of the founding fathers of modern liberal democracy. His political theory reaches its climax in the ground-breaking work, Perpetual Peace (1795), which sets out the basic framework for a world federation of states united by a system of international law. What is less well known is that two years earlier, in his Religion within the Bounds of Bare Reason (1793/1794), Kant had postulated a very different, explicitly religious path to the politics of peace: (...) he presents the idea of an “ethical community” as a necessary requirement for humanity to become “satisfactory to God”. While many recent scholars have noted the importance of Kant’s concept of the ethical community, few recognize the force of his argument that such a community is possible only if it takes the form of a church; as a result, the precise status of his proposal remains unclear and under-appreciated. He argues in Division One, Section IV, of Religion’s Third Piece that the idea of this community can become a reality only through a “church” that is characterized by four rational requirements: unity, integrity, freedom, and the changeability of all church rules except these four unchangeable marks. Prior to Section IV, Division One portrays this ethical community as having a political form, yet an essentially nonpolitical matter. He compares it with Jewish theocracy, but observes that the latter failed to be an ethical commonwealth because it was explicitly political. Whereas traditional theocracy replaces the political state of nature (which conforms to the law, “might makes right”) with an ethical state of nature (which conforms to the law that I call, “should makes good”), or attempts to synthesize them, non-coercive theocracy transcends this distinction through a new perspective: it unites humanity in a common vision of a divine legislator whose only law is inward, binding church members together like families, through the law of love. Whereas the legal rights supported by democracy and a system of international law can go a long way to prepare for world peace, Kant’s conviction is that it will be ultimately impossible without support from healthy religion. According to Conceptual Metaphor Theory, the Source-Path-Goal schema constitutes a central concept in cognition. Apart from literally structuring “movement”, SPG also shapes our understanding of “purposive activity”, including questing and story-telling. A problem in CMT, however, is that the existence of image schemas is almost exclusively postulated on the basis of verbal expressions. To examine the claim that people recruit image schemas such as SPG to make sense of life, it is essential to examine non-verbal modalities. Animation has highly (...) medium-specific opportunities to exploit SPG by its emphasis on “manner of movement” and “balance”. Three animation films exemplifying MOVEMENT, QUEST, and STORY are analyzed in terms of SPG to chart how they exploit this schema. We end the paper by positioning our findings with respect to recent discussions about image schemas in Hampe and by suggesting avenues for further research. (shrink)

Recent events around the globe reflect the tensions and ethical dilemmas of the postmodern, postcolonial and neocolonial world that have far reaching implications for health, well-being, and human suffering. As we consider what is at stake, and what this means for local lives and human relationships, we need to examine whether the theories we draw on are adequate to further our understanding of health, and the social and material conditions of human suffering. In this paper I begin to explore the (...) question, ‘Can postcolonial feminist theories provide an inclusive scholarship that would further our understanding of human suffering and open up a path to healing?’ At issue here is whether this scholarship adds another dimension to a praxis-oriented nursing science. The goal of achieving Universal Health Coverage (UHC) can generally be realized only in stages. Moreover, resource, capacity and political constraints mean governments often face difficult trade-offs on the path to UHC. In a 2014 report, Making fair choices on the path to UHC, the WHO Consultative Group on Equity and Universal Health Coverage articulated principles for making such trade-offs in an equitable manner. We present three case studies which illustrate how these principles can guide practical decision-making. These (...) case studies show how progressive realization of the right to health can be effectively guided by priority-setting principles, including generating the greatest total health gain, priority for the worse off, and financial risk protection. Drawing on biosemiotic theory and the Peircean idea of ‘abduction’, I shall propose the idea of a layered structure of bio / semiotic evolution, in which humanknowledge is systemic and recursive — and thus emergent both from what is forgotten and from earlier evolutionary strata. I will argue that abductions are those processes by which we move creatively between often unacknowledged types of knowledge which are rooted in our natural and cultural evolutionary past (e.g., unconscious, preconscious, or tacit knowledge; knowledge (...) that is experienced affectively) and the more familiar types of knowledge associated with self-conscious deductive and inductive reasoning. I shall suggest that these processes of ‘hooking back’ into the past in order to make new sense in the light of subsequent experience, are characteristic of all human inventiveness in both the arts and the sciences, and are facilitated by what Peirce called ‘The Play of Musement’.My reasons for attempting this task are that I hope to offer a semiotic and biosemiotic corrective to the widespread and culturally dominant idea that the progress ofhuman knowledge and cultural evolution depends on self rational efficiency, conceived of in terms of self-conscious deduction and induction alone — a conception which runs the risk of excluding from the account what is actually the most creative part of human knowing. Second, I will suggest that a properly semiotically informed understanding of human creativity — i.e., one which understands the Peircean semiotic as triadic and which draws on the post-Peircean theory that the semiotic drive in nature and in culture derives from the need to model the world as accurately as possible — should provide a very stern warning against the dangers of confusing the map with the territory. For creative artists and scientists (and life-livers, in general) progress, I shall suggest, inasmuch as they ignore the utilitarian dogma in practice. A biosemiotic understanding of human reasoning as an evolutionary semiotic process should thus contribute to a removal of the impediments of modernity which lie in the failure to properly grasp both what language (and semiosis in general) is, as well as the historical and prehistorical evolution that makes such semiosis possible. What is called legal pragmatism today is very different from the older style of legal pragmatism traditionally associated with Oliver Wendell Holmes; and there is much that is worthwhile on the conception of the law revealed by reading Holmes's The Path of the Law in the light of the classical pragmatist tradition of Peirce, James, and Dewey. Here, reflections on the varieties of pragmatism - philosophical and legal, old and new - will be wrapped around an exploration of Holmes's (...) legal philosophy and the strengths and weaknesses of his arguments. This article provides a historical, philosophical, and psychological analysis of the recent discovery that reoviruses are oncolytic, capable of infecting and destroying many kinds of cancer cells. After describing Patrick Lee's very indirect path to this discovery, I discuss the implications of this case for understanding the nature of scientific discovery, including the economy of research, anomaly recognition, hypothesis formation, and the role of emotion in scientific thinking. Lee's discoveries involved a combination of serendipity, abductive and deductive inference, and (...) emotional cognition. (shrink)

In an accompanying paper Gomes, we have put forward an interpretation of quantum mechanics based on a non-relativistic, Lagrangian 3+1 formalism of a closed Universe M, existing on timeless configuration space \ of some field over M. However, not much was said there about the role of locality, which was not assumed. This paper is an attempt to fill that gap. Locality in full can only emerge dynamically, and is not postulated. This new understanding of locality is based solely on (...) the properties of extremal paths in configuration space. I do not demand locality from the start, as it is usually done, but showed conditions under which certain systems exhibit it spontaneously. In this way we recover semi-classical local behavior when regions dynamically decouple from each other, a notion more appropriate for extension into quantum mechanics. The dynamics of a sub-region O within the closed manifold M is independent of its complement, \, if the projection of extremal curves on \ onto the space of extremal curves intrinsic to O is a surjective map. This roughly corresponds to \, where \ is a linear projection. This criterion for locality can be made approximate—an impossible feat had it been already postulated—and it can be applied for theories which do not have hyperbolic equations of motion, and/or no fixed causal structure. When two regions are mutually independent according to the criterion proposed here, the semi-classical path integral kernel factorizes, showing cluster decomposition which is the ultimate aim of a definition of locality. C.H. Waddington’s concepts of ‘chreods’ (canalized paths of development) and ‘homeorhesis’ (the tendency to return to a path), each associated with ‘morphogenetic fields’, were conceived by him as a contribution to complexity theory. Subsequent developments in complexity theory have largely ignored Waddington’s work and efforts to advance it. Waddington explained the development of the concept of chreod as the influence on his work of Alfred North Whitehead’s process philosophy, notably, the concept of concrescence as a self-causing process. Processes were (...) recognized as having their own dynamics, rather than being explicable through their components or external agents. Whitehead recognized the tendency to think only in terms of such ‘substances’ as a bias of European thought, claiming in his own philosophy ‘to approximate more to some strains of Indian, or Chinese, thought, than to western Asiatic, or European, thought.’ Significantly, the theoretical biologist who comes closest to advancing Waddington’s research program, also marginalized, is Mae-Wan Ho. Noting this bias, and embracing Whitehead’s and Waddington’s efforts to free biology from assumptions dominating Western thought to advance an ontology of creative causal processes, I will show how later developments of complexity theory, most importantly, Goodwin’s work on oscillations, temporality and morphogenesis, Vitiello’s dissipative quantum brain dynamics, Salthe’s work on hierarchy theory, biosemiotics inspired by Peirce and von Uexküll, Robert Rosen’s work on anticipatory systems, together with category theory and biomathics, can augment while being augmented by Waddington’s work, while further advancing Mae-Wan Ho’s radical research program with its quest to understand the reality of consciousness. Russian translation of Brandom R. From Truth to Semantics: A Path through «Making It Explicit» // Philosophical Issues. – 1997. – Vol. 8. Translated by Inna Byshevskaya and Renata Sukhorukova.

This paper provides a new interpretation of the three natures theory of Yogācāra-Vijñānavāda thought by means of an examination of the path theory associated with it, which has not been previously examined in scholarly literature. The paper first examines this path theory in a number of foundational texts to show that the widely accepted pivotal model is not in fact the three natures model that predominates in foundational Yogācāra-Vijñānavāda literature. Second, the paper offers a new interpretation of the (...) three natures theory as providing a new causal model of the arising of suffering, and a corresponding theory of its cessation. This new causal model both makes possible the continued use of the kind of dharma analysis that Abhidharma thought employs to provide a causal analysis of the arising of suffering, and also couches such dharma analysis within the Mahāyāna framework of the emptiness of dharmas. At the outset of The Possibility of Altruism Thomas Nagel charts two paths out of the fundamental dilemma confronting metaethics. The first path rejects the claim that a persuasive account of the motivational backing of ethical judgments must involve an agent’s desires. But it is the second path, a path that Nagel charts but does not himself take, that is the focus of this essay. This path retains the standard account, upon which all motivation involves desire, (...) but denies that desires are given prior to reason. Instead, these attitudes that motivate are themselves open to rational assessment. One reason for this focus is that many philosophers, including Quinn, Raz, and Scanlon, have come to reject the claim Nagel takes to block this path – that desires are somehow given prior to reason, hence are not in the relevant way proper objects of rational assessment. A second reason is that unlike the first path, this second does not require the rejection of the belief-desire theory, only the rejection of one assumption about the nature of conative attitudes. Unlike Nagel’s chosen path, then, the second holds out the prospect of reconciling ethical objectivity, internalism, and the belief-desire theory within a unified account. I argue that the account of desire found in Quinn, Raz, and Scanlon, augmented by aspects of Davidson’s account of propositional attitudes, yields a coherent account of the involvement of reason even in basic desires, an account that is well suited to Nagel’s intriguing path not taken. An organismic viewpoint is a welcome alternative to modern mechanistic consciousness, with the latter’s excessive epistemic reliance on analysis, its ontological presumption of atomism, and its value commitments to competition, quantification, reduction, and predictability. These ideas have had negative social and environmental consequences and require replacement. Organismic ethics, grounded in the “wisdom of life”--especially the dialectical triad of creativity, homeostasis, and holism-is far healthier. But organicism alone has serious defects sometimes overlooked by environmental enthusiasts (earlier including this author): life’s creativity (...) wastes individual organisms, and life’s holism neglects the unique value of parts in favor of larger unities. Is it possible to work out a genuinely personalistic organicism? Traditional personalistic idealism will not do, but insights into essential personal qualities may enrich the concepts of creativity, homeostasis, and holism enough to offer a start toward a more adequate ethic. One of the more striking, surprising, and optimism-inducing features of the contemporary international system has been the decline of interstate war. The key question for students of international relations and comparative politics is how this happy state of affairs came about. In short, was this a universal phenomenon or did some regions play a more important and pioneering role in bringing about peaceful change? As part of the roundtable “International Institutions and Peaceful Change,” this essay suggests that Western Europe generally (...) and the European Union in particular played pivotal roles in transforming the international system and the behavior of policymakers. This helped to create the material and ideational conditions in which other parts of the world could replicate this experience, making war less likely and peaceful change more feasible. This argument is developed by comparing the experiences of the EU and the Association of Southeast Asian Nations and their respective institutional offshoots. The essay uses this comparative historical analysis to assess both regions’ capacity to cope with new security challenges, particularly the declining confidence in institutionalized cooperation. This article assesses the significance of Baker et al., Equality: from Theory to Action from the perspective of current concerns occupying legal equality scholars in the UK, focusing in particular on the practical relevance of equality studies to the kinds of issues arising from the debate over the new Commission for Equality and Human Rights (CEHR). The article highlights and considers key issues, including the delineation of the sphere of inequality protection, the normative content of the concept of equality espoused (...) by law and the potential of law to reach beyond its current limits to embrace the broader dimensions of (in)equality identified in Baker et al.’s account. David Errington brings the Book of Proverbs into discussion with two significant accounts of the nature and foundation of practical reason in Christian ethics: Thomas Aquinas and Oliver O'Donovan. Aiming to set out a coherent account of the structure of Christian moral reasoning, this book provides the first scholarly engagement with Oliver O'Donovan's moral theology. Errington argues that the way the Book of Proverbs conceives of wisdom presents an important challenge to the way practical reason has been understood in the (...) Western theological and philosophical tradition, and that instead a perfection of speculative knowledge, wisdom in the Book of Proverbs is a practical knowledge of how to act well, grounded in the reality of the world God has made.
