We provide new evidence that the prosocial attitudes of local residents play a significant role in determining a firm’s corporate social responsibility engagement. We show that firms are more likely to engage in CSR initiatives when they are headquartered in areas with large senior citizen populations and where a large fraction of the population makes charitable donations. In contrast, we find that firms are less likely to engage in CSR initiatives when they are headquartered in areas with large religiously affiliated (...) groups. After establishing the local demographic roots of CSR demand, we then examine the relationship between the firm’s CSR activities and its market valuation. Our results suggest that CSR initiatives create value when they are properly aligned with local residents’ prosocial attitudes. Overall, our study stresses the role of local residents’ CSR preferences in mediating the relationship between CSR and market valuations. (shrink)

Food refusal occurs for a variety of reasons. It may be used as a political tool, as a method of exercising control over others, at either the individual, family or societal level, or as a method of self-harm, and occasionally it indicates possible mental illness. This article examines the motivation behind hunger strikes in prisoners. It describes the psychiatrist's role in assessment and management of prisoners by referring to case examples. The paper discusses the assessment of an individual's competence to (...) commit suicide by starvation, legal restraints to intervention, practical difficulties and associated ethical dilemmas. Anecdotal evidence suggests that most prisoners who refuse food are motivated by the desire to achieve an end rather than killing themselves, and that hunger-strike secondary to mental illness is uncommon. Although rarely required, the psychiatrist may have an important contribution to make in the management of practical and ethical difficulties. (shrink)

Making mistakes is the key to making progress. There are times, of course, when it is important not to make any mistakes--ask any surgeon or airline pilot. But it is less widely appreciated that there are also times when making mistakes is the secret of success. What I have in mind is not just the familiar wisdom of nothing ventured, nothing gained. While that maxim encourages a healthy attitude towards risk, it doesn't point to the positive benefits of not just (...) risking mistakes, but actually of making them. Instead of shunning mistakes, I claim, you should cultivate the habit of making them. Instead of turning away in denial when you make a mistake, you should become a connoisseur of your own mistakes, turning them over in your mind as if they were works of art, which in a way they are. You should seek out opportunities to make grand mistakes, just so you can then recover from them. (shrink)

I join the growing ranks of theorists who reject the terms of traditional debates about the nature of emotion, debates that have long focused on the question of whether emotions should be understood as either cognitive or somatic kinds of states. Here, I propose and defend a way of incorporating both into a single theory, which I label the “Integrated Representational Theory” of emotion. In Section 2 I begin to construct the theory, defining and explaining emotions in terms of three (...) pieces of content: representations of the emoter’s body, something in the world, and a relevance relation between the objects of these first two pieces of content. I describe four general advantages I think the IRT offers. Finally, in Section 3, I elucidate and defend my account by contrasting it with another, similar proposal: Barlassina and Newen’s Impure Somatic Theory. In so doing, I explain two additional advantages of my view: first, it supports a unified explanation of all types of emotional response; and second, it offers the best framework for explaining how the representational contents of an emotion are integrated. In most children’s hospitals, there are very few ethics consultations, even though there are many ethically complex cases. We hypothesize that the reason for this may be that hospitals develop different mechanisms to address ethical issues and that many of these mechanisms are closer in spirit to the goals of the pioneers of clinical ethics than is the mechanism of a formal ethics consultation. To show how this is true, we first review the history of collaboration between philosophers and physicians (...) about clinical dilemmas. Then, as a case-study, we describe the different venues that have developed at one children’s hospital to address ethical issues. At our hospital, there are nine different venues in which ethical issues are regularly and explicitly addressed. They are ethics committee meetings, Nursing Ethics Forum, ethics Brown Bag workshops, PICU ethics rounds, Grand Rounds, NICU Comprehensive Care Rounds, Palliative Care Team case conferences, multidisciplinary consults in Fetal Health Center, and ethics consultations. In our hospital, ethics consults account for only a tiny percentage of ethics discussions. We suspect that most hospitals have multiple and varied venues for ethics discussions. We hope this case study will stimulate research in other hospitals analyzing the various ways in which ethicists and ethics committees can build an ethical environment in hospitals. Such research might suggest that ethicists need to develop a different set of “core competencies” than the ones that are needed to do ethics consultations. Instead, they should focus on their skills in creating multiple “moral spaces” in which regular and ongoing discussion of ethical issues would take place. A successful ethicist would empower everyone in the hospital to speak up about the values that they believe are central to respectful, collaborative practice and patient care. Such a role is closer to what the first hospital philosophers set out to do than in the role of the typical hospital ethics consultant today. (shrink)

In this paper we trace the historical exclusion of women from the legal profession in Canada. We examine women’s efforts to gain entry to law practice and their progress through the last century. The battle to gain entry to this exclusive profession took place on many fronts: in the courts, government legislature, public debate and media, and behind the closed doors of the law societies. After formal barriers to entry were dismantled, women continued to confront formidable barriers through overt and (...) subtler forms of discrimination and exclusion. Today’s legal profession in Canada is a contested one. Women have succeeded with large enrolments in law schools and growing representation in the profession. However, women remain on the margins of power and privilege in law practice. Our analysis of contemporary official data on the Canadian legal profession demonstrates that women are under-represented in private practice, have reduced chances for promotion, and are excluded from higher echelons of authority, remuneration, and status in the profession. Yet, the contemporary picture of the legal profession also reveals that women are having an important impact on the profession of law in Canada by introducing policy reforms aimed at creating a more humane legal profession. Current literature suggests that the adversarial legal system may undergo some changes or may even be transformed by a recent influx of women lawyers into the profession. Such research indicates that women may approach ethical problems differently than men. This paper examines the responses of family law lawyers in Vancouver, British Columbia and the surrounding Lower Mainland to a hypothetical case which requires an assessment of professional responsibilities in light of potential conflicts in personal moral values.

Contrary to standard assumptions, reasoning is often an emotional process. Emotions can have good effects, as when a scientist gets excited about a line of research and pursues it successfully despite criticism. But emotions can also distort reasoning, as when a juror ignores evidence of guilt just because the accused seems like a nice guy. In _Hot Thought_, Paul Thagard describes the mental mechanisms -- cognitive, neural, molecular, and social -- that interact to produce different kinds of human thinking, (...) from everyday decision making to legal reasoning, scientific discovery, and religious belief, and he discusses when and how thinking and reasoning should be emotional. Thagard argues that an understanding of emotional thinking needs to integrate the cognitive, neural, molecular, and social levels. Many of the chapters employ computational models of various levels of thinking, including HOTCO models and the more neurologically realistic GAGE model. Thagard uses these models to illuminate thinking in the domains of law, science, and religion, discussing such topics as the role of doubt and reasonable doubt in legal and other contexts, valuable emotional habits for successful scientists, and the emotional content of religious beliefs. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. This paper uses the economic crisis of 2008 as a case study to examine the explanatory validity of collective mental representations. Distinguished economists such as Paul Krugman and Joseph Stiglitz attribute collective beliefs, desires, intentions, and emotions to organizations such as banks and governments. I argue that the most plausible interpretation of these attributions is that they are metaphorical pointers to a complex of multilevel social, psychological, and neural mechanisms. This interpretation also applies to collective knowledge in science: scientific (...) communities do not literally have collective representations, but social mechanisms do make important contributions to scientific knowledge. My schedule appeared lighter than usual and I even envisioned leaving work a bit early. Maybe a challenging bike ride before dinner. I was sitting in the chairman’s office having our weekly meeting. One of our junior faculty members called... he needed help. He was on call and a 32–year–old pregnant (...) woman with a displaced femoral neck fracture had just been transferred to our emergency department (ED). Ms. B tripped in her kitchen last evening. She was unable to stand and was brought to the local ED by ambulance.My colleague was concerned that he wouldn’t be able to successfully reduce the fracture. The long–term prognosis of the hip joint depended on a successful reduction of the femoral neck fracture. In addition, there was an ongoing debate in the orthopaedic literature related to the urgency of operative care to prevent osteonecrosis of the femoral head. I reviewed the x–rays, didn’t anticipate a problem and let him know that I would come to the operating room (OR) to assist. “No”, he responded, “I am not comfortable caring for this patient”. I immediately left the office, went to the hospital and assumed care of the patient. Clearly, my plans for a bike ride were gone, but I had the opportunity to help a woman in need of expert orthopaedic care.Ms. B had been admitted to the obstetrical service. She was a 32–year–old woman of Haitian descent who had recently immigrated to the United States. She had very limited English comprehension and her primary spoken languages were French and Creole. She was alone, in a hospital in a foreign country. She was 24 weeks pregnant with her first child and had no other co–morbidities. Her pregnancy had ben progressing uneventfully.When I first met Ms. B she was lying on a stretcher in an observation unit on the obstetrical floor. She appeared frightened. Two orthopaedic residents were present and obtaining consent for surgical repair of the hip. In their minds there was nothing to discuss, the patient had a displaced femoral neck fracture and needed to have surgery immediately. In their minds, no other options were available and obtaining consent would be straightforward. I introduced myself, sat down on a lab stool by the bed and began a conversation. I needed to meet the patient, understand who she was and discuss treatment. I am not sure that obtaining an informed consent is ever “straightforward” when [End Page 14] a doctor is explaining to a patient that they require emergency surgery. This discussion surely would not be easy or straightforward.We utilized a telephone interpretation service. Every question and response required the transfer of the handset between the patient and physician. Ms. B was in pain and frightened. She immediately expressed concern about her pregnancy and her baby. I arranged for her to meet all of the physicians who would possibly be involved in her care and the care of her baby. Each consultant could explain their area of expertise and potential involvement in the care of Ms. B and her child. She met and had an opportunity to talk with the obstetrician on call, a maternal fetal medicine (MFM) fellow and a neonatologist. I supplied the orthopaedic information. I explained the severity of the injury, the risks of osteonecrosis either with or without surgery as well as concerns over non–union and traumatic arthritis of the hip. Undoubtedly, in a healthy 32–year–old woman who wasn’t pregnant, early surgical intervention would be the most appropriate management in hopes of preserving a normal hip joint. We also discussed the possibility of treating her without surgery. She would be administered pain medication, which were known to be safe during pregnancy, and allowed to begin to ambulate with a walker or crutches. Nuechterlein Emmaus Lutheran Church, Racine, WI The title spells out the alternative I would like the reader to consider: Is Holy Communion more appropriately considered the "table sacrament" or, as is more commonly accepted, the "altar sacrament "? I will make my preference clear. In Holy Communion, (...) I believe Jesus Christ to be offering nourishment for a different way to live —namely, the way offreely chosen service to others, as opposed to violent domination over others. "Table sacrament" more appropriately conveys the sense of nourishment toward a new life. I will support this positive reasoning in favor of "table sacrament" through an appeal to Christian scripture. I will also suggest a negative reasoning against "altar sacrament," by questioning whether the very reference to "altar" betrays a link to violence, with its base in the blood ofsacrifice. For this negative argument, the support will come primarily from the brilliant and far-reaching theories ofRené Girard regarding the relation between religion and violence. I would like us to consider whether the most obvious point of the relation between religion and violence—namely, rituals ofsacrifice—has been precariously intermingled with the church's practices and experiences of the "altar sacrament." Girard's theories force us to ask: Is not the altar ofsacrifice essentially the site for a ritualized form of collective violence? 202Paul J. Nuechterlein Girard contends that there are overwhelming cultural and anthropological forces that make it difficult for religions to free themselves from such violent underpinnings. He considers that all religions, in fact, are cultural manifestations ofa generative mimetic scapegoating mechanism, a natural human/social mechanism which contains an all-against-all, communitywide violence by means ofan all-against-one act of violence, i.e., a scapegoating. Religion is, according to this theory, the primary cultural institution that forms in the aftermath ofwhat Robert Hamerton-Kelly summarily calls the "Generative Mimetic Scapegoating Mechanism, or "GMSM" event (1994). Institutionalized religion fortifies the relative peace that the event has accomplished through a three-fold structure: (1) laws and prohibitions, established to prevent further outbreaks ofmimetic violence; (2) mythical stories of the GMSM event, told from the perspective of the perpetrators as a means to justify their violence and disguise it behind the veil of the sacred; and (3) ritual reenactments ofthe GMSM event, most commonly in the form of blood sacrifice, that channel any continuing violent impulses into structured, contained releases. We must be bold to ask of each religion, then, the ways in which it manifests and perpetuates the GMSM. This includes Christianity. To the extent that Christians practice religion, we can expect to find effects ofthe GMSM in essential aspects of the church, such as its practice ofthe "altar sacrament." Girardian support for my argument, however, does not end with this negative thesis regarding the "altar sacrament." Nor does Girardian criticism leave us with a wholly negative assessment of the Christian tradition. In fact, Girard himself experienced a conversion of sorts (see Golsan 129-30), as he began to see his basic premises and theories already revealed in the Judeo-Christian Scriptures, especially the gospel narratives of Jesus Christ. He came to view the Christian faith—in spite of its susceptibility to the violent forces of religion—as unique in its core message ofrevealing the one true God. Contrary to the gods ofmythology, the Christian message, through Jesus Christ, reveals the true God to be on the side ofthe GMSM's victims. As such, the Gospel ofJesus Christ stands in opposition to the three-fold structure of religion: (1) it frees people from the oppressive systems oflaws and prohibitions;1 (2) it demythologizes the mythical stories told from the perspective of the perpetrators;2 and (3) it 1 A theme of St. Paul and his criticism of the Law? Although it is designed to be “a guide to philosophy of religion for nonspecialists”, it will certainly engage “the specialist” as well. Quinn and Taliaferro have collected succinct essays from leading thinkers on the philosophy of religion—Ninian Smart, Scott MacDonald, Merold Westphal, Brian Hebblethwaite, Roger Trigg, Alvin Plantinga, Terence Penelhum, Paul Helm, Eleonore Stump, George Mavrodes, William Craig, Jonathan Kvanvig, Basil (...) Mitchell—to name only some of them. Each essay—seventy-eight in all—is cross-referenced with the volume’s other essays and is followed by a modest bibliography. I explore some of the ways that assumptions about the nature of substance shape metaphysical debates about the structure of Reality. Assumptions about the priority of substance play a role in an argument for monism, are embedded in certain pluralist metaphysical treatments of laws of nature, and are central to discussions of substantivalism and relationalism. I will then argue that we should reject such assumptions and collapse the categorical distinction between substance and property.
