Trading on non-public material information is fertile ground for a discussion of ethical behavior. The long-running legal tug-of-war over what constitutes illegal insider trading delivers challenges to regulatory authorities charged with detecting and enforcing the law, and is likely one of the reasons that prosecution of insider trading events remains rather uncommon. One can observe both increased volume in the equity and option markets and run-ups in the stock price prior to the announcement of the acquisitions; however, the detection of (...) illegal or unethical insider trading can be difficult. Given the legal uncertainty around insider trading and the circumstantial evidence from the trading activity, it is almost impossible to identify unethical insider trades unless there is a whistleblower or trades are large in size and impeccable in timing. Using call option trading around two merger announcements with similar firms that resulted in different ultimate treatment from the SEC, we illustrate the struggle regulators and prosecutors have with identifying and enforcing unethical insider trades. One cue that may facilitate children's word learning is iconicity, or the correspondence between a word's form and meaning. Some have even proposed that iconicity in the early lexicon may serve to help children learn how to learn words, supporting the acquisition of even noniconic, or arbitrary, word–referent associations. However, this proposal remains untested. Here, we investigate the iconicity of caregivers’ speech to young children during a naturalistic free‐play session with novel stimuli and ask whether the iconicity of caregivers’ speech (...) facilitates children's learning of the noniconic novel names of those stimuli. Thirty‐four 1.5‐2‐year‐olds (19 girls; half monolingual English learners and half bilingual English‐Spanish learners) participated in a naturalistic free‐play task with their caregivers followed by a test of word‐referent retention. We found that caregivers’ use of iconicity, particularly in utterances in which they named the novel stimuli, was associated with the likelihood that children learned that novel name. This result held even when controlling for other factors associated with word learning, such as the concreteness and frequency of words in caregiver speech. Together, the results demonstrate that iconicity not only can serve to help children identify the referent of novel words (as in previous research) but can also support their ability to retain even noniconic word‐referent mappings. Recent results confirm that long‐term expression of therapeutic transgenes can be achieved by using a transposon‐based system in primary stem cells and in vivo. Transposable elements are natural DNA transfer vehicles that are capable of efficient genomic insertion. The latest generation, Sleeping Beauty transposon‐based hyperactive vector (SB100X), is able to address the basic problem of non‐viral approaches – that is, low efficiency of stable gene transfer. The combination of transposon‐based non‐viral gene transfer with the latest improvements of non‐viral delivery techniques (...) could provide a long‐term therapeutic effect without compromising biosafety. The new challenges of pre‐clinical research will focus on further refinement of the technology in large animal models and improving the safety profile of SB vectors by target‐selected transgene integration into genomic “safe harbors.” The first clinical application of the SB system will help to validate the safety of this approach. This article addresses a stated need within the food justice movement scholarship to increase the attention paid to the political socialization of hired farm hands in industrial agriculture. In Canada, tackling the problem of farm worker equity has particular social and political contours related to the Canadian horticultural industry’s reliance on a state-managed migrant agricultural labour program designed to fill the sector’s labour market demands. As Canada’s Seasonal Agricultural Worker Program produces relations of ‘unfree labour’, engaging migrant farm workers in (...) social movement initiatives can be particularly challenging. Critical educational interventions designed to encourage migrant farm workers’ contribution to contemporary social movements in Canada must therefore confront the socio-cultural obstacles that constrict migrant farm workers’ opportunities to participate as full members of their communities. In this article, I argue that social justice oriented approaches to community-based arts can provide a means for increasing the social movement contributions of farm workers employed through managed labour migration schema such as Canada’s SAWP. According to substantivalism, spacetime points and regions are real entities whose existence is not dependent on matter. In this paper, I motivate and defend a version of substantivalism which takes the totality of spacetime as fundamental, and show how this position avoids certain problem cases, in particular the objection from static Leibniz shifts, and better conforms to how we think about space in physics. I argue that, even though the static Leibniz shifts do not show ordinary substantivalism is committed to (...) in-principle undetectable physical structure ), they do indicate something problematic about the modal profile of space-time and its constituents. While the problem is modal, the solution cannot be solely a matter of revising the substantivalist's modal claims. Rather, I argue, the substantivalist must revise her background ontology of space-time. I show how this can be done by developing substantivalist theory that rejects this picture in favor of an alternative ontology of space-time in the spirit of priority monism. (shrink)

Situation Theory grew out of attempts by Jon Barwise in the late 1970s to provide a semantics for 'naked-infinitive' perceptual reports such as 'Claire saw Jon run'. Barwise's intuition was that Claire didn't just see Jon, an individual, but Jon doing something, a situation. Situations are individuals having properties and standing in relations. A theory of situations would allow us to study and compare various types of situations or situation-like entitles, such as facts, events, and scenes. One of the central (...) themes of situation theory of meaning and reference should be set within a general theory of information, one moreover that is rich enough to do justice to perception, communication, and thought. By now many people have contributed by the need to give a rigorous mathematical account of the principles of information that underwrite the theory. (shrink)

"Thinking like a lawyer" is a phrase familiar to every law student, and the development of these analytical skills are, of course, essential. In this essay, however, I reflect on the value of a more expansive approach to professional formation. I argue that legal education best serves students, the bar, and the society when it takes seriously the importance of moral imagination, interpersonal relationships, and personal wellness.

Alasdair MacIntyre described the late modern West as driven by two moral values: efficiency and effectiveness. Regardless of whether you accept MacIntyre's overarching story, it seems clear that efficiency and effectiveness have achieved a zenith in institutional health care structures, such that these two aspects of care become the final arbiters of what counts as “good” care. At the very least, they are dominant in many clinical contexts and act as the interpretative lens for the judgments of successful health care (...) managers. The drive of efficiency can also be seen in “lean” management methods (originally imported from the automotive manufacturing industry) increasingly deployed in the intensive care unit. This drive gives us pause. The high stress of the ICU is exacerbated by the enormous complexity of technological interventions designed to maintain physiological functioning as the body heals, as well as the ever‐present concerns related to cost, effectiveness, and efficiency. The ICU, therefore, provides an illustrative view of the challenges facing clinicians, as well as resource managers, in terms of delivering care. In short, the goal of technocratic efficiency often ends up at odds with humane purposes. To better understand these contemporary health care dynamics, we conducted a limited series of focus group discussions and interviews with residents experienced in the challenges of delivering care in the ICU environment. In what follows, we highlight some narrative observations drawn from these focus groups. We found a recurrent and disconcerting refrain among our informants that has not been adequately described or addressed in the literature: technocratic management techniques have crept into and bifurcated clinical care strategies in the ICU. Specifically, we highlight the influence of concerns around efficiency and effectiveness and the ways in which these foci have contributed to a bifurcation in care in the ICU along two trajectories: either compassionate care or curative care. In Jorge Luis Borges’ short story, “Borges and I,” one character, referred to in the first person, complains about his strained and complex relation with another character, called “Borges.” But the characters are both presumably the author of the short story. I try to use ideas from the philosophy of language to explain how Borges uses language to express complex thoughts, and then discuss two interpretations of the story.

Quantities are properties and relations which exhibit "quantitative structure". For physical quantities, this structure can impact the non-quantitative world in different ways. In this paper I introduce and motivate a novel distinction between quantities based on the way their quantitative structure constrains the possible mereological structure of their instances. Specifically, I identify a category of “properly extensive” quantities, which are a proper sub-class of the additive or extensive quantities. I present and motivate this distinction using two case studies of successful (...) physical measurements.. I argue that the best explanation for the success of the length measurement requires us to adopt a notion of proper extensiveness, which is distinct from mere additivity, which is exhibited by inertial mass. I further discuss the consequences of this distinction, sketching an application of proper extensiveness for the project of producing a non-mathematical and non-metrical reductive metaphysics of quantity. The latest trend in ethics, sometimes dismissed as a fad, is the effort to connect ethics to empirical science. Two different versions of this “latest thing” can be found in the work of Jonathan Haidt and Joshua Greene. Their projects are, at least partly, unwitting recoveries of eighteenth-century Christian moral sense theory. Such similarities need not worry Christian ethicists but should instead inspire a careful retrieval of sentimentalism. RECENT STUDIES OF CHRISTIANITY'S RELATION TO LIBERAL POLITICS HAVE recognized the importance of specifying clearly what type of liberalism is being considered. Jeffrey Stout's critique is one such example. Unfortunately, Stout fails to engage the one thinker who arguably is the most influential in how Americans relate Christianity and politics: John Locke. Political arguments of today's Christians are premised, often unconsciously, on rival interpretations of Locke's political theology.

Over the last century and a half, appeals to “privacy” have become common in American law. The result is a rather chaotic mix of concepts, which philosophers might be able to help bring into some kind of order. But I want to discuss one kind of privacy that isn’t discussed much in the law literature, what I call “natural privacy.” I strongly suspect that unlike cricket or checkers or bridge with respect to our concept of game (Wittgenstein’s example) there is (...) something very basic about natural privacy that can illuminate, at least to a certain extent, part of the web of concepts for which we have come to use the term “privacy.” The basis of this hunch is that two aspects of natural privacy, imagination and contemplation, seem to be a very important part of what it is to be a human being. The privacy we seek by building houses, fences and private offices seems to bear a close kinship with the kind of privacy with which nature endows us. And so does the sort of privacy we seek to provide, often in vain, for things we do with the help of modern technology, from the printing press to the internet. (shrink)

In the half decade following the 2007 financial crisis, the reform of global financial governance was driven by two separate policy debates: one on the substantive content of regulations, the other on the organizational architecture of their governance. The separation of the two debates among policymakers has been mirrored in academia, where postcrisis analyses of financial governance have remained detached from reinvigorated discussions about the nature of financial markets. We argue that this separation is deeply flawed. Presenting an analysis of (...) interactions between standards for banking, credit rating, accounting, and derivatives trading, this article demonstrates why the appropriateness of the organizational architecture of global financial governance is necessarily contingent upon one’s understanding of how financial markets work. In particular, if financial markets are not anchored to external “economic fundamentals” but instead exhibit reflexivity, then the reciprocal interactions between different regulatory arenas demand considerably more organizational coordination than presently exists. A comparative analysis of pacifism, just/limited war and total/indiscriminate war in Judaism, Christianity and Islam.

This paper will focus on two textual articulations that emerged in the Immanuel “Beis-Yaakov” school segregation case. The first is a declaration of the Admor from Slonim that was published when the ultra-Orthodox fathers who refused to send their daughters to an integrated school were imprisoned. The second is a letter to the Supreme Court that was written by an Ashkenazi mother whose daughter attended the “Beis Yaakov” school. A semiotic reading of the articulations reveals several opposing characteristics. The Admor’s (...) audience is determined by his choices of medium and rhetoric, which guarantee hegemonic reading, corresponding with the textual code of his interpretive community. The letter, on the other hand, represents an attempt to break through communal borders, and therefore its writer cannot expect hegemonic reading. Yet, she makes a considerable effort to employ signifiers denoting her ultra-Orthodox affiliation. In light of the hindrances that usually prevent ultra-Orthodox women from contesting the authority of the community, the letter presents a rare feminine voice, which is vigorous enough to attempt subverting under the authoriality of the Admor, and might have a long run affect on the quest for equality. The founder of modern linguistics, Ferdinand de Saussure inaugurated semiology, structuralism, and deconstruction and made possible the work of Jacques Derrida, Roland Barthes, Michel Foucault, and Jacques Lacan, thus enabling the development of French feminism, gender studies, New Historicism, and postcolonialism. Based on Saussure's lectures, _Course in General Linguistics_ traces the rise and fall of the historical linguistics in which Saussure was trained, the synchronic or structural linguistics with which he replaced it, and the new look of diachronic linguistics that (...) followed this change. Most important, Saussure presents the principles of a new linguistic science that includes the invention of semiology, or the theory of the "signifier," the "signified," and the "sign" that they combine to produce. This is the first critical edition of _Course in General Linguistics_ to appear in English and restores Wade Baskin's original translation of 1959, in which the terms "signifier" and "signified" are introduced into English in this precise way. Baskin renders Saussure clearly and accessibly, allowing readers to experience his shift of the theory of reference from mimesis to performance and his expansion of poetics to include all media, including the life sciences and environmentalism. An introduction situates Saussure within the history of ideas and describes the history of scholarship that made _Course in General Linguistics_ legendary. Perry argues that certain sorts of indexicals are 'essential', in the sense that they cannot be eliminated in favor of descriptions. This paper also introduces the influential idea that certain sorts of indexicals play a special role in thought, and have a special connection to action.

Philosophers and logicians use the term “indexical” for words such as “I”, “you” and “tomorrow”. Demonstratives such as “this” and “that” and demonstratives phrases such as “this man” and “that computer” are usually reckoned as a subcategory of indexicals. (Following [Kaplan, 1989a].) The “context-dependence” of indexicals is often taken as a defining feature: what an indexical designates shifts from context to context. But there are many kinds of shiftiness, with corresponding conceptions of context. Until we clarify what we mean by (...) “context”, this defining feature remains unclear. In sections 1–3, which are largely drawn from [Perry, forthcoming(a)], I try to clarify the sense in which indexicals are context-dependent and make some distinctions among the ways indexicals depend on context.
