Jean-Paul Sartre, novelist, playwright, biographer, was undoubtedly one of the greatest philosophers of the 20th century. Above all, however, he was an embodiment of the engagé intellectual, active in a variety of political causes, as well as an individual who attempted to live his life in accordance with the philosophy he professed. These interviews take Sartre on a wide-ranging tour of his philosophy and politics. Here we have Simone de Beauvoir challenging Sartre on his own attitude towards machismo and feminism; (...) and Sartre responding thoughtfully to questions which range from Freud, Marx, and the drama of Bertolt Brecht to the Cultural Revolution, Stalinism, the May 'Events' and of course, the US war on Vietnam. These excellent volumes show both the strengths and weaknesses of contemporary and serious Dworkin scholarship . Mostly the articles are new, although Susan Hurley's paper in the Hershowitz volume was first published in 1990. As to be expected with work on Dworkin, the division between political and legal theory is not distinct because – as is well-known – he integrates moral problems of politics both into the choice of legal theory and legal argument itself. But, some issues may be separated (...) and since there are excellent essays on both equality of resources and the relevance of ‘intrinsic’ values, I have separated my discussion into the two heads of ‘legal theory’ and ‘political theory’. Work on his political theory is not as advanced as it is on his legal theory and so I have largely directed my attention to the latter. I conclude that the most profitable work with Dworkin's legal theory lies in exploring the idea of the ‘interpretive concept’ and its connection with moral ideals, and in assessing the moral weight of integrity, particularly against the ideals of justice and fairness. Almost all the essays on legal theory show awareness of difficulties concerning these two issues although no one takes on interpretivism directly . However, Stephen Perry and Dale Smith in the Hershowitz volume and Sanford Levinson in the Ripstein volume push the boundaries some way with integrity. (shrink)

Efforts to counter software piracy are an increasing focus of software publishers. This study attempts to develop a profile of those who illegally copy software by looking at undergraduate and graduate students and the extent to which they pirate software. The data indicate factors that can be used to profile the software pirater. In particular, males were found to pirate software more frequently than females and older students more than younger students, based on self-reporting.

This article addresses the implications of rapid and uncertain ecological change, and global climate change in particular, for reserve oriented and restoration oriented ecosystem management. I argue for the following conclusions: (1) rapid and uncertain ecological change undermines traditional justifications for reserve oriented and restoration oriented ecosystem management strategies; (2) it requires rethinking ecosystem management goals, not just developing novel strategies (such as assisted colonization) to accomplish traditional goals; (3) species preservation ought to be deemphasized as an ecosystem management goal; (...) (4) reserve oriented ecosystem management remains well justified, but the goals for it must be revised. (shrink)

Nowhere has H.L.A. Hart's influence on philosophical jurisprudence in the English-speaking world been greater than in the way its fundamental project and method are conceived by its practitioners. Disagreements abound, of course. Philosophers debate the extent to which jurisprudence can or should proceed without appeal to moral or other values. They disagree about which participant perspective—that of the judge, lawyer, citizen, or “bad man”—is primary and about what taking up the participant perspective commits the theorist to. However, virtually unchallenged is (...) the view that jurisprudence is fundamentally interpretive or “hermeneutic”; that it takes for its subject a certain kind of social practice, constituted by the behavior and understandings of its participants; that its task is to explain this practice and its relations to other important social practices; and that it can properly be explained only by taking full account of participant understandings. It is, perhaps, some measure of the hegemony of Hart's influence that Ronald Dworkin mounts his fundamental challenge to Hart's positivism squarely from within this jurisprudential orthodoxy. Dworkin may have exceeded the limits of the method as Hart conceived it, but, as Stephen Perry has argued, “the seeds of Dworkin's strong version of inter-pretivism were sown by Hart himself.”. From the perspective of cognitive science, it is illuminating to think of much contemporary scientific research as taking place in distributed cognitive systems. This is particularly true of large-scale experimental and observational systems such as the Hubble Telescope. Clark, Hutchins, Knorr-Cetina, and Latour insist or imply such a move requires expanding our notions of knowledge, mind, and even consciousness. Whether this is correct seems to me not a straightforward factual question. Rather, the issue seems to be how best to develop (...) a theoretical understanding of such systems appropriate to the study of science and technology. I argue that there is no need to attribute to such systems as a whole any form of cognitive agency. We can well understand the importance of such systems while restricting agency to the human components. The implication is that we think of these large-scale distributed cognitive systems not so much as unified wholes, but as hybrid systems including both physical artifacts and ordinary humans. Husserl has finally begun to be recognized as the precursor of current interest in intentionality — the first to have a general theory of the role of mental representations in the philosophy of language and mind. As the first thinker to put directedness of mental representations at the center of his philosophy, he is also beginning to emerge as the father of current research in cognitive psychology and artificial intelligence.

In this paper, I will develop a nontrivial interpretation of Feyerabend's concept of a hidden anomalous fact. Feyerabend's claim is that some anomalous facts will remain hidden in the absence of alternatives to the theories to be tested. The case of Brownian motion is given by Feyerabend to support this claim. The essential scientific difficulty in this case was the justification of correct and relevant descriptions of Brownian motion. These descriptions could not be simply determined from the available observational data. (...) An examination, however, of this case shows that no alternative theory is or historically was thought to be necessary in order to justify descriptions of Brownian motion that "directly" refute thermodynamics. While Feyerabend's appraisal of this case therefore is incorrect, a sense is developed in which successful alternatives lend inductive support to the correctness of refuting experimental descriptions. Crucial though to the explanation of this support is the notion of arguments that show the possibilities for improving experimental fit. (shrink)

Until now it has been impossible to read the full story of the relationship between Albert Camus and Jean-Paul Sartre. Their dramatic rupture at the height of the Cold War, like that conflict itself, demanded those caught in its wake to take sides rather than to appreciate its tragic complexity. Now, using newly available sources, Ronald Aronson offers the first book-length account of the twentieth century's most famous friendship and its end. Albert Camus and Jean-Paul Sartre first met in (...) 1943, during the German occupation of France. The two became fast friends. Intellectual as well as political allies, they grew famous overnight after Paris was liberated. As playwrights, novelists, philosophers, journalists, and editors, the two seemed to be everywhere and in command of every medium in post-war France. East-West tensions would put a strain on their friendship, however, as they evolved in opposing directions and began to disagree over philosophy, the responsibilities of intellectuals, and what sorts of political changes were necessary or possible. As Camus, then Sartre adopted the mantle of public spokesperson for his side, a historic showdown seemed inevitable. Sartre embraced violence as a path to change and Camus sharply opposed it, leading to a bitter and very public falling out in 1952. They never spoke again, although they continued to disagree, in code, until Camus's death in 1960. In a remarkably nuanced and balanced account, Aronson chronicles this riveting story while demonstrating how Camus and Sartre developed first in connection with and then against each other, each keeping the other in his sights long after their break. Combining biography and intellectual history, philosophical and political passion, _Camus and Sartre_ will fascinate anyone interested in these great writers or the world-historical issues that tore them apart. This paper offers a restatement of the basic project of Hannah Arendt's Lectures on Kant's Political Philosophy, tries to trace its theoretical motivation, and presents some criticisms of Arendt's interpretation of Kant's Critique of Judgment. Arendt's political philosophy as a whole is an attempt to ground the idea of human dignity on the publicly displayed 'words and deeds' that con stitute the realm of human affairs. This project involves a philo sophical response both to Plato's impugning of the dignity of (...) the polis and to Hegel's founding of modern historicism. The Kant Lectures bring this philosophical project to its completion because the enact ment of public deeds presupposes a company of judging spectators who draw meaning from the spectacle by judging and appreciating what is enacted. But this conception, precisely because it relates so deeply to Arendt's own theoretical impulse, leads to a sometimes onesided and misleading reading of Kant. Consider a physical system for which a mathematically rigorous geometric quantization procedure exists. Now subject the system to a finite set of irreducible first class (bosonic) constraints. It is shown that there is a mathematically rigorous BRST quantization of the constrained system whose cohomology at ghost number zero recovers the constrained quantum states. Moreover this space of constrained states has a well-defined Hilbert space structure inherited from that of the original system. Treatments of these ideas in the physics literature are (...) more general but suffer from having states with infinite or zero "norms" and thus are not admissible as states. Also BRST operators for many systems require regularization to be well-defined. In our more restricted context, we show that our treatment does not suffer from any of these difficulties. (shrink)

Using the emerging technology of large-scale textual analysis, this study examines the use of the term ‘customer satisfaction’ and its variants in the annual reports issued by publicly traded U.S. corporations and filed with the Securities and Exchange Commission as Form 10-K. We document the frequency of the term’s occurrence in 10-Ks over the 1995–2013 period and the differences in usage across industries. We then relate the term’s usage in 10-Ks to subsequent scores from the American Customer Satisfaction Index to (...) determine whether management’s discussion of customer satisfaction in financial disclosures is credible. The commitment of management to shareholders versus, more broadly, stakeholders is a central question in business ethics, and the integrity of management communication is a fundamental construct in the American Marketing Association’s Statement of Ethics. We document a complex relation between management’s discussion of customer satisfaction and subsequently reported satisfaction. We find that the general use of customer satisfaction in 10-K documents is negatively correlated with subsequent ACSI scores. However, for retail firms, when the phrase is located near words indicating measurement or monitoring of the phenomenon, the empirical relation is reversed and becomes positive. (shrink)

Reviewing the first twenty years of publication of the "Journal of Religious Ethics", the author examines the journal's pattern of growth, its niche in the array of scholarly journals, and its prospects. The author argues that JRE coincided with and stimulated the emergence of religious ethics as an independent scholarly field. He notes that it has been a valuable resource for philosophical analyses of religious ethics, has virtually created the field of comparative religious ethics, and has provided considerable impetus for (...) historical research. On the negative side, JRE has not done as well as it might in bringing political theorists, psychologists, sociologists, and interpreters of the aesthetic into the dialogue with religious ethicists, nor has it succeeded as well as was hoped in overcoming its Christian and Western bias.
