This article explores the tension between an understanding of Europe as purveyor of a certain kind of cultural, spiritual or religious identity and the more or less bureaucratic project of European construction undertaken in its name. The central axis of this tension is the theoretical relationship between identity and legitimacy. The classical modern problem of nation-state building involves integrating the legitimating force of collective identity into the institutions of the state. How does the project of European construction respond to an (...) analogous challenge? This article develops this theoretical question by turning to two canonical positions concerning the relation between institutional legitimacy and its cultural, spiritual or religious under-pinnings - Montesquieu and Weber. It then returns to the founding documents of the EU in order to interrogate the legitimacy of the EU in light of the concept of European identity. (shrink)

The EDPS Ethics Advisory Group (EAG) has carried out its work against the backdrop of two significant social-political moments: a growing interest in ethical issues, both in the public and in the private spheres and the imminent entry into force of the General Data Protection Regulation (GDPR) in May 2018. For some, this may nourish a perception that the work of the EAG represents a challenge to data protection professionals, particularly to lawyers in the field, as well as to companies (...) struggling to adapt their processes and routines to the requirements of the GDPR. What is the purpose of a report on digital ethics, if the GDPR already provides all regulatory requirements to protect European citizens with regard to the processing of their personal data? Does the existence of this EAG mean that a new normative ethics of data protection will be expected to fill regulatory gaps in data protection law with more flexible, and thus less easily enforceable ethical rules? Does the work of the EAG signal a weakening of the foundation of legal doctrine, such as the rule of law, the theory of justice, or the fundamental values supporting human rights, and a strengthening of a more cultural approach to data protection? Not at all. The reflections of the EAG contained in this report are not intended as the continuation of policy by other means. It neither supersedes nor supplements the law or the work of legal practitioners. Its aims and means are different. On the one hand, the report seeks to map and analyse current and future paradigm shifts which are characterised by a general shift from analogue experience of human life to a digital one. On the other hand, and in light of this shift, it seeks to re-evaluate our understanding of the fundamental values most crucial to the well-being of people, those taken for granted in a data-driven society and those most at risk. The objective of this report is thus not to generate definitive answers, nor to articulate new norms for present and future digital societies but to identify and describe the most crucial questions for the urgent conversation to come. This requires a conversation between legislators and data protection experts, but also society at large - because the issues identified in this report concern us all, not only as citizens but also as individuals. They concern us in our daily lives, whether at home or at work and there isn’t a place we could travel to where they would cease to concern us as members of the human species. (shrink)

This paper challenges the conventional methodological tendencies of current monistic treatments of subjective consciousness (SC). I argue that it is highly unlikely that any one position will ‘solve’ the SC problem, as monism supposes. Instead, I argue for treating theories of SC akin to scientific models, that (like models) theories only apply under certain empirical conditions, where each simply explains a necessary aspect of SC. Hence, a pluralistic, rather than monistic, approach is preferable to the literature as a whole. In (...) lieu of conventional metaphysics, I advocate applying a form of scientific realism to models of SC, scientific perspectivism. As authors must rely on some intuitive and/or experiential description of what is problematic about SC, theories are better treated as models deriving from a plurality of interpretive perspectives. The ethical theories employed in health care today assume, in the main, a modern Western philosophical framework. Yet the diversity of cultural and religious assumptions regarding human nature, health and illness, life and death, and the status of the individual suggest that a cross-cultural study of health care ethics is needed. This paper addresses a recent wave of criticisms of liberal peacebuilding operations. We decompose the critics’ argument into two steps, one which offers a diagnosis of what goes wrong when things go wrong in peacebuilding operations, and a second, which argues on the basis of the first step that there is some deep principled flaw in the very idea of liberal peacebuilding. We show that the criticism launched in the argument’s first step is valid and important, but that the second (...) step by no means follows. Drawing a connection between liberal peacebuilding and humanitarian intervention, we argue that the problems that the critics point to are in fact best addressed within the framework of liberal internationalism itself. Further, we argue that the development of the notion of human security marks a dawning awareness within liberal internationalism of the kinds of problems that the critics point to, however difficult it may still be to embody these ideas in practice. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories (...) and On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Previous research has shown that short-term fasting in healthy individuals is associated with changes in risky decision-making. The current experiment was designed to examine the influence of short-term fasting in healthy individuals on four types of impulsivity: reflection impulsivity, risky decision-making, delay aversion, and action inhibition. Participants were tested twice, once when fasted for 20 hours, and once when satiated. Participants demonstrated impaired action inhibition when fasted; committing significantly more errors of commission during a food-related Affective Shifting Task. Participants also (...) displayed decreased reflection impulsivity when fasted, opening significantly more boxes during the Information Sampling Task (IST). There were no significant differences in performance between fasted and satiated sessions for risky decision-making or delay aversion. These findings may have implications for understanding eating disorders such as Bulimia Nervosa (BN). Although BN has been characterised as a disorder of poor impulse control, inconsistent findings when comparing individuals with BN and healthy individuals on behavioural measures of impulsivity question this characterisation. Since individuals with BN undergo periods of short-term fasting, the inconsistent findings could be due to differences in the levels of satiation of participants. The current results indicate that fasting can affect performance on the IST, a measure of impulsivity previously studied in BN, whilst performance on other impulsivity measures were unaffected. However, the results from the IST were contrary to the original hypothesis and should be replicated before specific conclusions can be made. (shrink)

In 1936, G. Birkhoff and J. v. Neumann published an article with the title The logic of quantum mechanics'. In this paper, the authors demonstrated that in quantum mechanics the most simple observables which correspond to yes-no propositions about a quantum physical system constitute an algebraic structure, the most important proper ties of which are given by an orthocomplemented and quasimodular lattice Lq. Furthermore, this lattice of quantum mechanical proposi tions has, from a formal point of view, many similarities with (...) a Boolean lattice L8 which is known to be the lattice of classical propositional logic. Therefore, one could conjecture that due to the algebraic structure of quantum mechanical observables a logical calculus Q of quantum mechanical propositions is established, which is slightly different from the calculus L of classical propositional logic but which is applicable to all quantum mechanical propositions. This calculus has sometimes been called 'quan tum logic'. However, the statement that propositions about quantum physical systems are governed by the laws of quantum logic, which differ from ordinary classical logic and which are based on the empirically well-established quantum theory, is exposed to two serious objec tions: Logic is a theory which deals with those relationships between various propositions that are valid independent of the content of the respective propositions. Thus, the validity of logical relationships is not restricted to a special type of proposition, e. g. to propositions about classical physical systems. (shrink)

Martin Heidegger is widely regarded as one of the most influential philosophers of the twentieth-century, and his seminal text Being and Time is considered one of the most significant texts in contemporary philosophy. Yet his name has also been mired in controversy because of his affiliations with the Nazi regime, his failure to criticize its genocidal politics and his subsequent silence about the holocaust. Now, according to Heidegger's wishes, and to complete the publication of his multi-volume Complete Works, his highly (...) controversial and secret 'Black Notebooks' have been released to the public. These notebooks reveal the extent to which Heidegger's 'personal Nazism' was neither incidental nor opportunistic, but part of his philosophical ethos. So, why would Heidegger, far from destroying them, allow these notebooks, which contain examples of this extreme thinking, to be published? In this revealing new book, Peter Trawny, editor of Heidegger's complete works in German, confronts these questions and, by way of a compelling study of his theoretical work, shows that Heidegger was committed to a conception of freedom that is only beholden to the judgement of the history of being; that is, that to be free means to be free from the prejudices, norms, or mores of one's time. Whoever thinks the truth of being freely exposes themselves to the danger of epochal errancy. For this reason, Heidegger's decision to publish his notebooks, including their anti-Jewish passages, was an exercise of this anarchical freedom. Edited book on the prospects of non-Platonist realism in the philosophy of mathematics. Physicalism holds that mathematics studies properties realised or realisable in the physical world. This collection of papers has its origin in a conference held at the University of Toronto in June of 1988. The theme of the conference was Physicalism in Mathematics: Recent Work in the Philosophy of Mathematics. At the conference, papers were read by Geoffrey Hellman (Minnesota), Yvon Gauthier (Montreal), Michael Hallett (McGill), Hartry Field (USC), (...) In this short book Peter Sloterdijk offers a genealogy of the concept of freedom from Ancient Greece to the present day. This genealogy is part of a broader theory of the large political body, according to which Sloterdijk argues that political communities arise in response to a form of anxiety or stress. Through a highly original reading of Rousseaus late Reveries of a Solitary Walker, Sloterdijk shows that, for Rousseau, the modern subject emerges as a subject free of all (...) stress, unburdened by the cares of the world. Most of modern philosophy, and above all German Idealism, is an attempt to reign back Rousseaus useless and anarchical subject and anchor it in the cares of the world, in the task of having to produce both the world and itself. In the light of this highly original account, Sloterdijk develops his own distinctive account of freedom, where freedom is conceptualized as the availability for the improbable. This important text, in which Sloterdijk develops his account of freedom and the modern subject, will be of great interest to students and scholars in philosophy and the humanities and to anyone interested in contemporary philosophy and critical theory. A major problem with the Christian doctrine of the Incarnation is that Jesus is meant to be both God and man. What are the differences between philosophy and science, or between the methods of philosophy and the methods of science? Unlike some philosophers we do not find philosophy and the methods of philosophy to be sui generis. Science, and in particular neuroscience, has much to tell us about the nature of the world and the concepts that we must use to understand and explain it. Yet science cannot function well without reflective analysis of the concepts, methods, and practices that constitute it. (...) For example, experimental methods and their resulting empirical data are essential for understanding the world, yet such data is not a-conceptual. Understanding how and what theoretical assumptions, conceptual assumptions, and practical knowledge guide the use of experimental methods is relevant to understanding the results of that use. In this way, philosophy – whether done by philosophers or scientists – has a role to play in understanding the world. Neuroscience is typically individualistic in focus; nonetheless, the mechanisms of learning and linguistic ability that some neuroscientists study also have a role to play in understanding communication. Philosophy cannot offer adequate understanding, even conceptual clarity, in isolation from empirical investigation. Yet, this does not require that science or scientific concepts will replace or reduce philosophical concepts, let alone those of ordinary language. (shrink)

Midcentury America was governed from the center, a bipartisan consensus of politicians and public opinion that supported government spending on education, the construction of a vast network of interstate highways, healthcare for senior citizens, and environmental protection. These projects were paid for by a steeply progressive tax code, with a top tax rate at one point during the Republican Eisenhower administration of 91 percent. Today, a similar agenda of government action would be portrayed as dangerously left wing. At the same (...) time, radically anti-government and anti-tax opinions are considered part of the mainstream. In _Take Back the Center_, Peter Wenz makes the case for a sane, reality-based politics that reclaims the center for progressive policies. The key, he argues, is taxing the wealthy at higher rates. The tax rate for the wealthiest Americans has declined from the mid-twentieth-century high of 91 percent to a twenty-first-century low of 36 percent--even as social programs are gutted and the gap betweeen rich and poor widens dramatically. Ever since Ronald Reagan famously declared that government was the problem and not the solution, conservatives have had an all-purpose answer to any question: smaller government and lower taxes. Wenz offers an impassioned counterargument. He explains the justice of raising the top tax rates significantly, making a case for less income inequality, and he offers suggestions for how to spend the increased tax revenues: K-12 education, tuition relief, transportation and energy infrastructure, and universal health care. Armed with Wenz's evidence-driven arguments, progressives can position themselves where they belong: in the mainstream of American politics and at the center of American political conversations, helping their country address a precipitous decline in equality and quality of life.
