Droit et complexité. Le rapprochement de ces deux mots pourrait passer pour incongru. L'idéal du droit ne tend-il pas, en effet, à la rigueur et à la clarté garantes de certitudes et d'efficacité? Cet ouvrage, tiré des travaux du colloque tenu à Brest en mars 2006 a pris un parti inverse en faisant le choix, d'une certaine façon pascalien, de dialoguer avec l'incertitude dans des échanges très ouverts qui ont confirmé l'ampleur du changement de perspectives sur le droit. Un changement (...) que traduit bien le vocabulaire : régulation, pluralisation des ordres normatifs, dissémination dans des réseaux, internormativité, droit de coordination, procéduralisation, ajustement, négociation, expérimentation, flexibilité d'un droit devenu " droit souple ", voire " droit soluble "... Le système semble s'être converti à la modestie en perdant non de sa massivité comme l'a récemment souligné le Conseil d'Etat, mais en perdant de sa monumentalité pyramidale intimidante au profit d'un plasma de normes de plus en plus imbriquées dans des rapports de complémentarité, de négociation, de synergie déployés dans la dimension horizontale. La frontière entre les différentes catégories de normes persiste certes, mais elle se brouille, vire au " flou ". Si bien que là où prévalaient des distinctions nettes et des normes chimiquement pures, stables, s'imposent désormais des alliages, des rapports d'interdépendance analogues aux fils de trame d'un tissu. Edgar Morin aime à rappeler que le mot complexe signifie " tisser ensemble " et il définit la complexité comme " un tissu [...] de constituants hétérogènes inséparablement associés ". (shrink)

Enfants nés de mères maintenues en vie artificiellement, commercialisation de cellules tirées du corps humain, rémunération de mères porteuses, demandes de suicide assisté : où en est aujourd’hui le droit français face à ces situations extrêmes, liées aux manipulations du vivant, qui défraient régulièrement la chronique? Les avancées de la technologie biomédicale ont bouleversé les seuils longtemps intangibles de l’existence humaine, modifiant de façon radicale notre regard sur la procréation, la gestation, la vie, la mort. La transgression inhérente à l’avancée (...) de ces connaissances doit-elle comporter des limites quand elle touche à l’intégrité du corps humain et de la personne? Installée au cœur de nos sociétés contemporaines, la biomédecine fascine et inquiète. Pour certains, elle fait de l’homme un objet technique qui risque de se retourner contre lui-même en sabordant sa propre espèce. Pour d’autres, elle apporte progrès, qualité de vie, liberté individuelle, atténuation de la souffrance. Peut-on envisager que, dans quelques années, chacun dispose librement d’éléments de sa personne aussi essentiels que sa naissance et sa mort? This paper argues that one can advocate a moral imperative to pursue enhancement technologies while at the same time rejecting the historical reality of progress and holding a pessimistic view of the future. The first half of the paper puts forth several arguments for why progress is illusory and why one has good reason to be pessimistic about the future of humanity (and posthumanity). The second half then argues that this is entirely consistent with also championing the futurological vision of (...) transhumanism. The claim is that, relative to the alternatives proposed, this vision actually offers the safest route into the future, even if it also entails an increase in the probability of self-annihilation. Emotions are traditionally considered to be brief states that last for seconds or a few minutes at most. However, due to pioneering theoretical work of Frijda and recent empirical studies, it has become clear that the duration of emotions is actually highly variable with durations ranging from a few seconds to several hours, or even longer. We review research on determinants of emotion duration. Three classes of determinants are identified: features related to the (a) emotion-eliciting event (event duration and event (...) appraisal), (b) emotion itself (nature of the emotion component, nature of the emotion, and emotion intensity), and (c) emotion-experiencing person (dispositions and emotion regulatory actions). Initial evidence on the psychological and neural mechanisms that underlie their effects is discussed. (shrink)

In the ordinary modal language, KD is the modal logic determined by the class of all serial frames. In this paper, we demonstrate that KD is nullary.

A full understanding of emotions and emotion characteristics can only be reached when their dynamic nature is taken into account. As such, a primary objective of the present study is to describe and account for variability in temporal profiles of experienced emotional intensity. Participants were asked to make detailed drawings of intensity profiles of recently experienced episodes of anger, sadness, joy and affection. Functional data analysis revealed three features that together accounted for 84% of the total variability: (i) steepness at (...) onset; (ii) skewness; and (iii) the number of peaks. Emotions differed with regard to the first two features, with the rise at onset being steeper for sadness and joy and affection being the most negatively skewed emotion under study. Individual differences regarding each of the three features were found, however, they did not strongly generalise across emotions. (shrink)

This volume handles in various perspectives the concept of function and the nature of functional explanations, topics much discussed since two major and conflicting accounts have been raised by Larry Wright and Robert Cummins’s papers in the 1970s. Here, both Wright’s ”etiological theory of functions’ and Cummins’s ”systemic’ conception of functions are refined and elaborated in the light of current scientific practice, with papers showing how the ”etiological’ theory faces several objections and may in reply be revisited, while its counterpart (...) became ever more sophisticated, as researchers discovered fresh applications for it. Relying on a firm knowledge of the original positions and debates, this volume presents cutting-edge research evincing the complexities that today pertain in function theory in various sciences. Alongside original papers from authors central to the controversy, work by emerging researchers taking novel perspectives will add to the potential avenues to be followed in the future. Not only does the book adopt no a priori assumptions about the scope of functional explanations, it also incorporates material from several very different scientific domains, e.g. neurosciences, ecology, or technology. In general, functions are implemented in mechanisms; and functional explanations in biology have often an essential relation with natural selection. These two basic claims set the stage for this book’s coverage of investigations concerning both ”functional’ explanations, and the ”metaphysics’ of functions. This study aims at justifying one of Gilbert Durand’s postulates according to which all imaginaire (as a result of mental imagery) is anchored in our physiology but by directing it rather now towards our neurophysiology. New advances in neurobiology, connectome and neurogenomics lead to rethinking the framework of psychic activity and the induction of neural images.

Dans cet article, on montre que l’hypothèse de la « matière pensante » introduite spéculativement dans le livre IV de l’Essai sur l’Entendement humain, n’est pas seulement l’instrument d’une critique épistémologique destinée à souligner les limitations de notre connaissance, elle est aussi révélatrice des inclinations métaphysiques réelles de Locke. S’il est impossible de s’assurer par la connaissance de la nature de la substance pensante, il est permis néanmoins d’entretenir à son égard une opinion fondée sur des arguments probables. La croyance (...) est en effet aux yeux de Locke un champ d’exercice légitime de la rationalité, un champ qu’il sera particulièrement nécessaire de cultiver lorsque la connaissance manquera et qu’il s’agira de se déterminer sur des questions cruciales – au nombre desquelles il faut compter assurément celle de la substance et de la destination de l’âme. On examine ici les textes et les arguments qui ont conduit la plupart des interprètes de Locke à lui prêter une croyance « dualiste » de type cartésien, favorisant l’opinion de l’immatérialité de l’esprit humain. On montre que ces textes et ces arguments non seulement ne sont pas concluants mais peuvent même être mis au service de la thèse adverse. Que Locke ait cru en la probable matérialité de l’âme humaine est d'autant plus plausible que les arguments donnés dans la troisième lettre à Stillingfleet en faveur de la concevabilité de l'hypothèse, fonctionnent aussi tacitement comme des arguments de probabilité : l'hypothèse ne contredit pas le message scripturaire, elle permet une meilleure conception de l'analogie générale du vivant, elle est mieux conforme aux requisits ontologiques de l'existence et de l'identité. We present here a new method for bioethics: systemic modelling. In this method, the complex phenomenon being studied (e.g. personalized medicine, genetic testing, gene therapy, genetically modified organisms) is modelled as a whole, to shed light on its organization and functioning, and major (bio)ethical issues and solutions for their resolution are then identified. This systemic modelling method is ideal for use in the identification of solutions, rather than their validation, with other methods then used to test the solutions found. We (...) provide a description and reproducible instructions for the application of systemic modelling in bioethics, together with a brief example of the application of this method to the study of the impact of personalized medicine on French society. The unification problem in a normal modal logic is to determine, given a formula.

A compromise is an agreement that involves mutual concessions. Each party gets less than it feels entitled to, but agrees to it because the situation it anticipates under the deal is better than the one it expects in the absence of a deal: conflict, exit or arbitration by a third party. Some compromises, however, are bad, and others are good. This article discusses three conjectures about what it is that makes a compromise good. Is a good compromise an honourable compromise, (...) one that enables each party to save face? Is it rather a fair compromise, one that contributes to the progress of justice independently defined? Or is it a Pareto-improving compromise, one that changes things in such a way that it ends up making everyone better off than under the status quo? A compromise is never as good as a consensus, but it is generally better than nothing, and often achievable when a consensus is not. And when it is, trying to make it as good as possible in each of the three ways described is always worthwhile. © 2012 Government and Opposition Ltd. (shrink)

Ecology in principle is tied to evolution, since communities and ecosystems result from evolution and ecological conditions determine fitness values. Yet the two disciplines of evolution and ecology were not unified in the twentieth-century. The architects of the Modern Synthesis, and especially Julian Huxley, constantly pushed for such integration, but the major ideas of the Synthesis—namely, the privileged role of selection and the key role of gene frequencies in evolution—did not directly or immediately translate into ecological science. In this paper (...) I consider five stages through which the Synthesis was integrated into ecology and distinguish between various ways in which a possible integration was gained. I start with Elton’s animal ecology, then consider successively Ford’s ecological genetics in the 1940s, the major textbook Principles of animal ecology edited by Allee et al., and the debates over the role of competition in population regulation in the 1950s, ending with Hutchinson’s niche concept and McArthur and Wilson’s Principles of Island Biogeography viewed as a formal transposition of Modern Synthesis explanatory schemes. I will emphasize the key role of founders of the Synthesis at each stage of this very nonlinear history. (shrink)

The Powers of the Sacred is an opportunity for Hans Joas to return to the dynamogenic character of religion highlighted by William James and Émile Durkheim, in order to propose a reflection on the process of sacralisation of values. The present contribution enters into a pragmatist dialogue with Joas’s proposals, based on investigations carried out in an evangelical context. The aim is to show how certain spiritual practices encouraged on the horizon of collective celebrations participate in the creation of values (...) configured by religious entrepreneurs anxious to capture the religious energy of the faithful for the benefit of conservative political mobilizations. These empirical cases shed new light on the notion of the sacred proposed by Joas, and allow us to identify certain methodological knots, notably in the relationship between Joasian concepts and the notions through which social actors confer meaning on their individual or collective experiences. The challenges posed by chronic illness have pointed out to epidemiologists the multifactorial complex nature of disease causality. This notion has been referred to as a web of causality. This web extends theoretically beyond risk markers. It includes determinants of emergence/non-emergence of disease. This web of determinants is a form of complex system. Due to its complexity, the determinants within such system are not linked to each others in a linear, predictable manner only. Predictability is possible only on a short-term (...) basis, and unpredictability sets in over the long run. Understanding such a system of determinants calls for articulation and testing of complex models which synthesize our knowledge of multiple determinants at many scales, both biological and otherwise. Given the complexity of this web and existing knowledge about the nonlinearity of such systems, the following question is posed: Can the challenge of studying causality be adequately addressed if emphasis continues to be placed on using tools and methods that are geared towards looking at such system from a linear paradigm? Or is it time to add to the epidemiologic research agenda the notion of nonlinearity and its relevant form of analytical approaches that are being tested in other disciplines? Furthermore, the question posed here applies as well to the study of determinants of health. Addressing determinants of heath adds further complexity to our task. (shrink)

In recent years, the methods of formal semantics and pragmatics have been fruitfully applied to the analysis of primate communication systems. Most analyses therein appeal to a division of labor between semantics and pragmatics which has the following three features: calls are given referential meanings, some calls have a general meaning, and the meanings of calls in context are enriched by competition with more informative calls, along the lines of scalar implicatures. In this paper, we develop highly simplified models to (...) independently assess the conditions under which such features would emerge. After identifying a sufficient condition for, we find a range of conditions under which and are not evolutionarily stable, and discuss the consequences for both modeling and empirical work. (shrink)

The sense of shared values is a specific aspect of human sociality. It originates from reciprocal social exchanges that include imitation, and empathy, but also negotiation from which meanings, values and norms are eventually constructed with others. Research suggests that this process starts from birth via imitation and mirroring processes that are important foundations of sociality providing a basic sense of social connectedness and mutual acknowledgment with others. From the second month, mirroring, imitative and other contagious responses are bypassed. Neonatal (...) imitation gives way to first signs of reciprocation (primary intersubjectivity), and joint attention in reference to objects (secondary intersubjectivity). We review this development and propose a third level of intersubjectivity, that is the emergence of values that are jointly represented and negotiated with others, as well as the development of an ethical stance accompanying emerging theories of mind from about 4 years of age. We propose that tertiary intersubjectivity is an ontogenetically new process of value negotiation and mutual recognition that are the cardinal trademarks of human sociality. (shrink)

L’ambiguïté qui existe entre l’interprétation du principe de différence par le maximin ou par le leximin est reconsidérée. Le maximin satisfait seulement le principe de Pareto-faible (x>y ssi chaque composante de x > la composante correspondante de y), tandis que le leximin satisfait le principe de Pareto-fort. À la différence du maximin, le leximin n’est pas représentable par des courbes d’indifférence. Dans la position originelle, le choix leximin l’emporterait sur le choix maximin ((2, 4) > (2,3)), qui semble plus proche (...) des formulations de Rawls. Plusieurs solutions de l’ambiguïté sont évoquées, notamment celle que propose Alain Boyer, qui consiste à distinguer le maximin et le principe de différence en précisant que le second est le premier couplé à une règle tierce, la minimisation de l’inégalité. Cette solution, qui s’appuie par ailleurs sur un raisonnement suspect de Rawls sur la possibilité de trouver un troisième vecteur en enlevant n au plus riche, ce qui semble présupposer, comme le fait Boyer, que l’existence du fisc redistributeur est reconnue comme une possibilité dans la position originelle, est jugée insuffisante, en ce qu’elle ne vaut que pour le cas de deux individus (même si Rawls parle de deux classes). On suggère d’utiliser, pour les cas où le nombre des individus ou des classes est >2, un critère tel que la variance. Mais cela s’avère toujours insuffisant, et non justifiable dans la position originelle, et l’on fait appel à la théorie de la décision proposée par Gilboa et Schmeidler (1989 ; 1997) pour suggérer, par exemple, que le choix juste à faire entre (1, 2, 3) et (0, 3, 3) se porte sur le second état (où le plus pauvre a moins que dans l’autre cas). Cette règle demeure cependant plus proche du maximin (généralisé) que du leximin, peut être rapprochée de ce que l’on appelle le prioritarisme, et peut donc conserver une coloration appréciablement rawlsienne. The pervasive use of computer simulations in the sciences brings novel epistemological issues discussed in the philosophy of science literature since about a decade. Evolutionary biology strongly relies on such simulations, and in relation to it there exists a research program (Artificial Life) that mainly studies simulations themselves. This paper addresses the specificity of computer simulations in evolutionary biology, in the context (described in Sect. 1) of a set of questions about their scope as explanations, the nature of validation processes (...) and the relation between simulations and true experiments or mathematical models. After making distinctions, especially between a weak use where simulations test hypotheses about the world, and a strong use where they allow one to explore sets of evolutionary dynamics not necessarily extant in our world, I argue in Sect. 2 that (weak) simulations are likely to represent in virtue of the fact that they instantiate specific features of causal processes that may be isomorphic to features of some causal processes in the world, though the latter are always intertwined with a myriad of different processes and hence unlikely to be directly manipulated and studied. I therefore argue that these simulations are merely able to provide candidate explanations for real patterns. Section 3 ends up by placing strong and weak simulations in Levins’ triangle, that conceives of simulations as devices trying to fulfil one or two among three incompatible epistemic values (precision, realism, genericity). In standard quantum mechanics, a state vector \ may belong to infinitely many different orthogonal bases, as soon as the dimension N of the Hilbert space is at least three. On the other hand, a complete physical observable A is associated with a N-dimensional orthogonal basis of eigenvectors. In an idealized case, measuring A again and again will give repeatedly the same result, with the same eigenvalue. Let us call this repeatable result a modality \, and the corresponding eigenstate \. (...) A question is then: does \ give a complete description of \? The answer is obviously no, since \ does not specify the full observable A that allowed us to obtain \; hence the physical description given by \ is incomplete, as claimed by Einstein, Podolsky and Rosen in their famous article in 1935. Here we want to spell out this provocative statement, and in particular to answer the questions: if \ is an incomplete description of \, what does it describe? is it possible to obtain a complete description, maybe algebraic? Our conclusion is that the incompleteness of standard QM is due to its attempt to describe systems without contexts, whereas both are always required, even if they can be separated outside the measurement periods.
