Melissa Oliver-Powell Beyond the Spectacle of Suffering: Agnès Varda’s L’Unechante,l’autrepas and Rewriting the Subject of Abortion in France In the spring of 1971, three years after the revolutionary fervor of May 1968 in France, 343 women put their names to a courageous manifesto announcing that they were criminals of a particularly gendered nature. The authors (...) of Manifeste des 343 (Manifesto of the 343) comprised a large group of culturally eminent French women and activists declaring that they had all illegally undergone abortions, which at this point, despite growing decriminalization throughout much of Western Europe, were still outlawed within their republic. Though many of the revolutionary fires had now eased to embers, French feminists demonstrated that reproductive rights were still a vital and unresolved topic of social justice. Including names as weighty as Simone de Beauvoir, Jeanne Moreau, and Catherine Deneuve, the manifesto brought together exceptional women from the fields of academia, law, theater, film and literature, alongside grassroots activists. Their action was a bold challenge to the French authorities, daring them to arrest some of the country’s brightest thinkers and cultural innovators under a law the signatories felt was deeply unjust, sexist, and antithetical to the values of individual liberty and citizenship. It was a case of those with the broadest shoulders weaponizing their privilege to present a robust front line in the wider struggle for women’s rights. One of the signatories was filmmaker Agnès Varda. Her name, like those of several others on the list, demonstrates the symbiosis between Melissa Oliver-Powell 15 cultural production and gender politics that has often characterized French feminist thought. From the multidisciplinary writings of Beauvoir, to the novels of the écriture féminine movement, to the lyrical academic prose of Hélène Cixous, Luce Irigaray, Julia Kristeva, and others, French and Francophone feminist writers have tended to connect art and politics with a great deal of fluidity. As a committed activist and a filmmaker, Agnès Varda falls very much within this tradition, often adopting and developing feminist practices within her cinema. This article examines how Varda’s 1977 film, L’Une chante, l’autre pas (One Sings, The Other Doesn’t) interacts with and participates in the feminist political project of reproductive rights as well as the ongoing intellectual and moral debates over abortion taking place in France throughout the late 1960s and 1970s. I look particularly at the adversarial construction of abortion narratives within these debates and the location of victimhood therein. Within mainstream cultural representations in and beyond France, abortion is typically constructed as either a traumatic or a transgressive moment. The same is often true on either side of political and social debates on abortion, which have tended either to characterize the women who get abortions as irresponsible and amoral or as sympathetic victims in need of protection. Though the transgressive element persists, it is the interaction with representations of trauma that interests me here. In approaching discussions of gendered injustice, it is common for feminist writers and activists to leverage pathos as a rhetorical strategy. While suffering can be a highly effective and galvanizing expression of oppression, such discourses also run the risk of producing excessive depictions of victimhood, which can displace the capacity for action from the subject of hardship onto the privileged oppressor. This risk is particularly at stake within the cultural form of film, as its visuality and identificatory mechanics have the potential to spectacularize the female victim and make her relatable only through suffering. This was often the case in earlier French films that featured abortion such as Les Mauvaises rencontres (1955), Des gens sans importance (1956), Journal d’une femme en blanc (1965), and Une femme en blanc se révolte (1966), all of which made their subjects sympathetic by entwining them in long narratives of victimization ending in death or disgrace. A widely touted approach to involving laypeople in science and technology policy-related decisions is the consensus conference. Virtually nothing written on the topic provides detailed discussion of the many steps from citizen recruitment to citizen report. Little attention is paid to how and why the mechanics of the consensus conference process might influence the diversity of the participants in theses fora, the quality of the deliberation in the citizen sessions, the experiences of the participants and organizers, and other outcomes that (...) affect democratic decision making within the conference and more broadly over the long term. As an aid to those interested in utilizing the consensus conference format, the authors outline in detail how they set about organizing their consensus conference on nanotechnology in the spring of 2005. Book Review of Elizabeth Shakman Hurd, Beyond Religious Freedom: The New Global Politics of Religion.

We are grateful for the thoughtful attention the commentators and editors have given our paper. They raise many substantive points that warrant a response, but for reasons of journal space our reply must be brief. In our paper, we argue for an amended hybrid account of ‘disease’ in human medicine that takes normative ethics seriously, guards against pernicious classifications of disease and reconnects the concept with the goals of healthcare institutions in which disease diagnosis is embedded. Carel and Tekin, in (...) their respective pieces, raise issues about the objectivity and effective operationalisation of our account, Agar makes an ‘evolutionary’ case for disease concept eliminativism in mental health, and Wakefield and Conrad contend that our proposed modification to the harmful dysfunction account is unnecessary and undesirable. We will respond to each in turn. The rational moral justification component of our account raises difficult moral epistemological questions regarding which reasons are the weightiest ones and who should be allowed to participate in the rational justification process (though so too, we would note, does much bioethical inquiry). Carel suggests that inevitable disagreement on this point undermines the alleged objectivity of our proposal. We agree with Tekin, however, that this is a feature of our account rather than a bug. What constitutes a good reason in moral deliberation is a question that goes to the very philosophical foundation of ethics (see1 for a recent discussion); but disagreement over which reasons are the weightiest ones does not prevent ethicists and policy makers from objectively assessing the strength of moral arguments by evaluating their empirical adequacy and logical structure, and this can take us a long way toward adjudication. The fact that rational justification has been used to support immoral practices and institutions does not warrant abandoning a reason-based approach to ethics any more than …. (shrink)

Training in the responsible conduct of research (RCR) is required for many research trainees nationwide, but little is known about its effectiveness. For a preliminary assessment of the effectiveness of a short-term course in RCR, medical students participating in an NIH-funded summer research program at the University of California, San Diego (UCSD) were surveyed using an instrument developed through focus group discussions. In the summer of 2003, surveys were administered before and after a short-term RCR course, as well as to (...) alumni of the courses given in the summers of 2002 and 2001. Survey responses were analyzed in the areas of knowledge, ethical decision-making skills, attitudes about responsible conduct of research, and frequency of discussions about RCR outside of class. The only statistically significant improvement associated with the course was an increase in knowledge, while there was a non-significant tendency toward improvements in ethical decision-making skills and attitudes about the importance of RCR training. The nominal impact of a short-term training course should not be surprising, but it does raise the possibility that other options for delivering information only, such as an Internet-based tutorial, might be considered as comparable alternatives when longer courses are not possible. Skuce et al., responding to Powell, title their article, “Does It Matter if the Consensus on Anthropogenic Global Warming Is 97% or 99.99%?” I argue that the extent of the consensus does matter, most of all because scholars have shown that the stronger the public believe the consensus to be, the more they support the action on global warming that human society so desperately needs. Moreover, anyone who knows that scientists once thought that the continents are fixed in place, (...) or that the craters of the Moon are volcanic, or that the Earth cannot be more than 100 million years old, understands that a small minority has sometimes turned out to be right. But it is hard to think of a case in the modern era in which scientists have been virtually unanimous and wrong. Moreover, as I show, the consensus among publishing scientists is demonstrably not 97%. Instead, five surveys of the peer-reviewed literature from 1991 to 2015 combine to 54,195 articles with an average consensus of 99.94%. (shrink)

I intend, here, in reflecting on my life to see if, by taking what appear to me in retrospect to be three critical points of vantage from which to describe my situation, my intentions and the thought, if any, which lay behind them, I can be of service.

Stephen Jay Gould argued that the shape of animal life as we know it is a radically contingent accident of history determined more by fortune than comparative functional merit. Acknowledging the formative role of contingency in macroevolution is crucial, Gould believed, to vanquishing the lingering vestiges of progressivism that continue to buttress anthropocentric views of life. Gould’s contingency thesis has come under fire in recent years by proponents of convergent evolution who argue that not only is replication ubiquitous in evolution, (...) but also that it indicates an evolutionary process charging inexorably toward ever more complex and human-like outcomes. We argue here that although convergentist approaches are widely seen as inimical to the Gouldian view of life, in fact the two are indispensable allies in the anti-progressivist crusade, particularly in relation to the evolution of mind. We illustrate this by examining the progressivist foundations of comparative cognition science and the ongoing resistance to attributions of convergent minds. (shrink)

Ethical lapses associated with the first facial transplant included breaches of confidentiality, bending of research rules, and film deals. However, discussions of the risk-benefit ratio for face transplantation are often deficient in that they ignore the needs, experience, and decision-making capability of potential recipients.

The concept of disease remains hotly contested. In light of problems with existing accounts, some theorists argue that the disease concept ought to be eliminated. We answer this skeptical challenge by reframing the discussion in terms of the role that the disease concept plays in the complex network of health-care institutions in which it is deployed. We argue that while prevailing accounts do not suffer from the particular defects that critics have identified, they do suffer from other deficits, and this (...) leads us to propose a new account that satisfies the desiderata for a concept of disease in human medicine. Liberal proponents of genetic engineering maintain that developing human germline modification technologies is morally desirable because it will result in a net improvement in human health and well-being. Skeptics of germline modification, in contrast, fear evolutionary harms that could flow from intervening in the human germline, and worry that such programs, even if well intentioned, could lead to a recapitulation of the scientifically and morally discredited projects of the old eugenics. Some bioconservatives have appealed as well to the value of (...) retaining our “given” human biological nature as a reason for restraining the development and use of human genetic modification technologies even where they would tend to increase well-being. In this article, I argue that germline intervention will be necessary merely to sustain the levels of genetic health that we presently enjoy for future generations—a goal that should appeal to bioliberals and bioconservatives alike. This is due to the population-genetic consequences of relaxed selection pressures in human populations caused by the increasing efficacy and availability of conventional medicine. This heterodox conclusion, which I present as a problem of intergenerational justice, has been overlooked in medicine and bioethics due to certain misconceptions about human evolution, which I attempt to rectify, as well as the sordid history of Darwinian approaches to medicine and social policy, which I distinguish from the present argument. This short article argues that an adequate response to the implications for governance raised by ‘Big Data’ requires much more attention to agency and reflexivity than theories of ‘algorithmic power’ have so far allowed. It develops this through two contrasting examples: the sociological study of social actors used of analytics to meet their own social ends and the study of actors’ attempts to build an economy of information more open to civic intervention than the existing one. The article concludes with (...) a consideration of the broader norms that might contextualise these empirical studies, and proposes that they can be understood in terms of the notion of voice, although the practical implementation of voice as a norm means that voice must sometimes be considered via the notion of transparency. In May, 2016 the Diet passed a law on the “Promotion of efforts to eliminate unfair discriminatory speech and behaviour against people originating from outside Japan”, widely referred to as ヘイトスピーチ法 (_Heito Supiichi Hō_ /Hate Speech Law). For some residents of Japan it had been a long time coming. Without any laws specifically prohibiting racially discriminatory speech or writing, aggrieved parties had hitherto been forced to resort to indirect lines of protection. In 1999, for example, a Brazilian national ejected from (...) a jewelry shop displaying a poster saying “No foreigners allowed” obtained a favourable ruling citing Japan’s ratification of the International Convention on the Elimination of All Forms of Racial Discrimination; and in 2013 an injunction for defamation and obstruction of business was granted on behalf of a school for children of North Korean descent repeatedly subjected to provocative demonstrations. But others questioned the need to reinforce limits on freedom of expression even in the face of aggressive taunts, with some claiming that incidents of racial discrimination in Japan lacked the historical, entrenched and violent dimensions that had prompted hate speech laws in Europe and elsewhere. When the text of the proposed law became public there was also debate about its utility as such an abstract measure seemed inapplicable to many potential victims and lacked punitive sanctions. Against this criticism it could be argued that the law went about as far as the government could expect to go if it were to get it passed; that it appears to be curtailing a particularly aggressive form of hate speech; and that it has ushered in a number of more specific initiatives, especially at local level. This study will begin with the 2016 text itself, drawing on the semiotic framework of Systemic Functional Grammar to explore how it prioritises general principles over specific regulations. This textual analysis will be followed by a contextual account of why the Law was constructed as it was, how it has influenced awareness of hate speech, and where it fits in with an existing genre of non-coercive legislation in Japan. Photography began almost 150 years ago with the nearly simultaneous invention of two types of photographic processes, the daguerreotype and the Talbotype or calotype. On January 7, 1839, Louis Daguerre announced his discovery of a way to reproduce images on coated copper plate. Shortly thereafter, on January 31, William Talbot explained how shadows of objects could be chemically recorded on salted paper sensitized with silver nitrate. With the advent of photography, the people, architecture, and natural beauty of Chester County, Pennsylvania, (...) made worthy subject matter for many professional and amateur photographers. Photographers in Chester County, many of whom were also skilled artisans and craftsmen, were fortunate in that they lived near Philadelphia, a center of photographic activity. The first photographers in the county were itinerant tradesmen who traveled from place to place, taking photographs, portraits mainly, for a fee. Later, as photography developed and became more widely known, many photographers opened their own studios. Reflected Light: A Century of Photography in Chester County offers an overview of the development of the photographic medium and traces the progress of photography by examining the work of ten Chester County photographers. Steven Pinker has said that one of the most important questions humans can ask of themselves is whether moral progress has occurred or is likely to occur. Philosophers disagree, with some rare exceptions. One of those exceptions is the broadest-brush account of what language is. Language is a system of signs used for the communication of --well, and here the agreement begins to break down--thoughts, ideas, messages, propositions or propositional contents, intentions, and a host of technical terms offer themselves to chink the cracks. A list of philosophers subscribing would be impossible to complete. Locke, Carnap, Augustine, Hobbes, Fodor, Katz, Chomsky, Derrida, --well, and on and on. Easier (...) would be to list those who dissent. Heraclitus, Wittgenstein, maybe J.L. Austin, Frank Ebersole, and NOT on and on. The first chapter lays out the view that language is a system of signs in sympathetic terms. The second provides a selection of what are usually called “ordinary language” arguments against the view--reminders about how the view requires us to think in terms which are not consistent with how we think about language and signs when we are not doing philosophy. Those arguments have been unpersuasive among philosophers, and Chapter Three begins the work of investigating separate pieces of the view in detail. Chapter Three takes up an argument for the view which is familiar among philosophers, using Jerry Fodor’s formulation: we cannot be thinking in a public, natural language, because animals and preverbal infants think with no such language. I show this argument is not an argument at all but is rather an expression of the view in question. Chapter Four takes up the argument that the relations between particular words and their meanings is arbitrary or conventional rather than natural or necessary, otherwise there would be only one language among mankind. I argue that the alternatives (conventional vs. natural or necessary) are both generated by taking the division between words and their meanings to be the division between signs and signified--in other words, the question is a result of adopting the view of language as signs. Attempts to argue for the legitimacy of the question without taking the view for granted only serve to call it into question more. In Chapter Five I investigate whether we talk in order to communicate something which is otherwise hidden and invisible. We are tempted to think that you and I talk because I cannot read your mind or you mine. Though Wittgenstein has a famous set of comments on the notion of a private language, it remains a strong temptation to think that language gives public form to something (thoughts, ideas, intentions, feelings, content, meaning) which without language would be unknowable to all but the person whose something it is. Examples help point to the incoherence of this view and show that even if it were not incoherent, remedying the invisibility of those internal whatnots would still leave us with a need for language. Chapter Six takes up a hoary question about boundaries of effability--the possibility that there are limits to what can be said which are more restrictive than what can be thought or felt. The account of language as signs provides one easy way to make sense of this idea, but investigation into examples shows the problem is not one that makes sense unless we just grant that account. Chapter Seven investigates how to make sense of the notion that there are things which are in language and other things which are not. I spell out how the view of language as signs gives us a way to think this, and then show how one reaction to finding problems with the notion resonates with Wittgenstein’s early work and with some work of Jacques Derrida, who bite similar bullets and agree that everything is language, that the limits of language are the limits of our world. I then subject that reaction to critical investigation using examples, which reveals their reaction as a rear-guard attempt to save the view of language as signs. Chapter Eight uses examples as guides toward alternative views of language, feeling our way toward what language might be if it is not a system of signs. Finally, the appendix takes up what I take to be the serious arguments against the methods I use in this work, the first two articulated by John Searle (“the assertion fallacy”) and H. P. Grice (“conversational implicature”), and another the generally unspoken belief that philosophical work is like scientific work. (shrink)

Abstract In this paper, I pursue an interpretive goal and a critical goal. My interpretive goal is to offer a clear restatement of Nagel's argument for a requirement of altruism (as found in The Possibility of Altruism). My critical goal is to explain why this argument is unsuccessful, and to make a case for the thesis that any argument of its kind must fail.

Despite several decades of debate, the concept of disease remains hotly contested. The debate is typically cast as one between naturalism and normativism, with a hybrid view that combines elements of each staked out in between. In light of a number of widely discussed problems with existing accounts, some theorists argue that the concept of disease is beyond repair and thus recommend eliminating it in a wide range of practical medical contexts. Any attempt to reframe the ‘disease’ discussion should answer (...) the more basic sceptical challenge, and should include a meta-methodological critique guided by our pragmatic expectations of what the disease concept ought to do given that medical diagnosis is woven into a complex network of healthcare institutions. In this paper, we attempt such a reframing, arguing that while prevailing accounts do not suffer from the particular defects that prominent critics have identified, they do suffer from other deficits—and this leads us to propose an amended hybrid view that places objectivist approaches to disease on stronger theoretical footing, and satisfies the institutional-ethicaldesiderataof a concept of disease in human medicine. Nevertheless, we do not advocate a procrustean approach to ‘disease’. Instead, we recommend disease concept pluralism between medical and biological sciences to allow the concept to serve the different epistemic and institutional goals of these respective disciplines. Although molecular biology has meant different things at different times, the term is often associated with a tendency to view cellular causation as conforming to simple linear schemas in which macro-scale effects are specified by micro-scale structures. The early achievements of molecular biologists were important for the formation of such an outlook, one to which the discovery of recombinant DNA techniques, and a number of other findings, gave new life even after the complexity of genotype–phenotype
relations had become apparent. Against this (...) background we outline how a range of scientific developments and conceptual considerations can be regarded as enabling and perhaps necessitating contemporary systems approaches. We suggest that philosophical ideas have a valuable part to play in making sense of complex scientific and disciplinary issues. (shrink)

The dominant view in the cognitive science of religion (the ‘Standard Model’) is that religious belief and behaviour are not adaptive traits but rather incidental byproducts of the cognitive architecture of mind. Because evidence for the Standard Model is inconclusive, the case for it depends crucially on its alleged methodological superiority to selectionist alternatives. However, we show that the Standard Model has both methodological and evidential disadvantages when compared with selectionist alternatives. We also consider a pluralistic approach, which holds that (...) religion or various aspects of religion originated as byproducts of evolved cognitive structures but were subsequently co-opted for adaptive purposes. We argue that when properly formulated, the pluralistic approach also has certain advantages over the Standard Model. (shrink)

From Descartes to Hume, philosophers in the seventeenth and eighteenth centuries developed a dialectic of radically conflicting claims about the nature of the self. In the Paralogisms of The Critique of Pure Reason, Kant comes to terms with this dialectic, and with the character of theexperiencing self. Powell seeks to elucidate these difficult texts, in part by applying to the Paralogisms insights drawn from Kant's Transcendental Deduction. His reading shows that the structure of the Paralogisms provides an essential key (...) to understanding both Kant's critique of "rationalpsychology" and his theory of self-consciousness. As Kant realized, the ways in which we must represent ourselves to ourselves have import not only for epistemology, but for our view of persons and of our own immortality, and for moral philosophy as well. Kant's theory of self-consciousness is alsoshown to have implications for contemporary discussions of the problem of other minds, functionalism, and the problem of indexical self-reference. (shrink)

Stephen Jay Gould argued that replaying the “tape of life” would result in a radically different evolutionary outcome. Some biologists and philosophers, however, have pointed to convergent evolution as evidence for robust replicability in macroevolution. These authors interpret homoplasy, or the independent origination of similar biological forms, as evidence for the power of natural selection to guide form toward certain morphological attractors, notwithstanding the diversionary tendencies of drift and the constraints of phylogenetic inertia. In this paper, I consider the implications (...) of homoplasy for the debate over the nature of macroevolution. I argue that once the concepts of contingency and convergence are fleshed out, it becomes clear that many instances of homoplasy fail to negate Gould’s overarching thesis, and may in fact support a Gouldian view of life. My argument rests on the distinction between parallelism and convergence, which I defend against a recent challenge from developmental biology. I conclude that despite the difficulties in defining and identifying parallelism, the concept remains useful and relevant to the contingency controversy insofar as it underscores the common developmental origins of iterated evolution. ABSTRACT:Translational ethics is a practice that aims to apply bioethics insights and process to the real-world contexts of clinical medicine, but also government policy, systems issues, and public health. This work has been a career focus for a relatively small number of bioethicists over the years, but it has drawn greater attention due to the pandemic and a greater realization of the impact of health inequities and systemic injustice. This essay discusses the pathway, rewards, and challenges of translational bioethics as (...) experienced by one bioethicist working with state and national groups on a range of translational ethics issues, often related to public health disasters. Daniel Taylor and Dawn Goodwin present a case study of the Morecambe Bay Inquiry (MBI), which examined the high rate of maternal and neonatal deaths over a period of 9 years (2004–2013), within the small maternity unit of Furness General Hospital (FGH), one of the three hospitals comprising Morecambe Bay Hospitals Trust.1 They examine this through a conceptual lens, and provide a solution involving changes in medical education. This commentary explores both these elements. First, they use the lens of ‘Normalisation (...) of Deviance’ (NoD) to explain organisational failure. However, other available lenses such as ‘Sociology of Disasters’, ‘Organisational Silence’ and ‘Comfort-seeking Behaviour’ may point to different problems and solutions. More justification for their choice of the lens of NoD would have been useful. Similarly, more justification for their focus on a cluster of five ‘serious untoward incidents’ (SUIs) occurring in 2008 would also have been useful. They suggest that before 2008, the perinatal mortality rate was low, patient satisfaction was high and recent level 2 accreditation of maternity services by the Clinical Negligence Scheme for Trusts all suggested standards of care within the obstetric department were adequate. This stream of positive signals is likely to have contributed towards a genuine belief of safe operation within the maternity unit by staff and board members. For earlier attempts at emendation, see Brink's note . Most of those who have tried to emend the passage concentrate on longus, and are reluctant to relinquish spe: this is largely due to the (...) parallel with Aristotle's account of the character of old men in Rhetoric 2. 13. 1389b 13ff., in which they are said to be, among other things it seems to me that this parallel should not be pressed too far. There is much in Aristotle that is not in Horace, and nothing to suggest close and detailed dependence. The parallel can only be relevant if spe longus can be turned into a reasonable Latin equivalent for Otherwise there is no good reason to suppose that spe is any less likely to be corrupt than longus.
