The problem considered in the article that follows has a long and complicated history. The many different solutions proposed reflect the process of development, deepening, and broadening of knowledge as a whole. They correspond to particular levels of knowledge, determining the character of thought both of the times and of particular individuals. Specifically, it is the understanding of the essence of contradiction that governs the entire theoretical exposition that follows, its substance and approximation to truth. Here we shall consider for (...) analysis only one aspect of this fundamental theme — dialectical contradiction in the evolution of knowledge. Thus, for the most part the discussion will be of the laws of thought; only when necessary will we turn to analysis of contradictions in the objective world. It is quite understandable that the process of thought should occur according to the same, more general laws that are operative in the objective world; nevertheless, the manifestation of these laws has its own special features. Therefore, the questions posed by philosophers of antiquity concerning the degree to which reality itself corresponds to the understanding thereof in terms of the exactness, comprehensiveness, and depth of reflection of the objective world by a subject have not lost their timeliness. Such questions include those associated with the phenomenon of contradiction. For example, is contradiction in thought adequate to the contradictions among things ? How does contradiction in thought take shape, and what are its forms and structures? Is the relationship between opposites always a contradiction? Is it possible to solve antinomies, and so forth? An extensive literature has been published on these subjects. There is hardly a philosopher who can avoid them and not express his attitude toward them. As it is impossible, within the confines of an article, to adduce a full list of published works on contradictions, the authors, with an eye to what has been achieved in this sphere, also regard it as undesirable to analyze the diversity of points of view, and will confine themselves to presenting their own understanding of the problem under consideration. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. In some applications, researchers using the synthetic control method (SCM) to evaluate the effect of a policy may struggle to determine whether they have identified a “good match” between the control group and treated group. In this paper, we demonstrate the utility of the mean and maximum Absolute Standardized Mean Difference (ASMD) as a test of balance between a synthetic control unit and treated unit, and provide guidance on what constitutes a poor fit when using a synthetic control. We explore (...) and compare other potential metrics using a simulation study. We provide an application of our proposed balance metric to the 2013 Los Angeles (LA) Firearm Study [9]. Using Uniform Crime Report data, we apply the SCM to obtain a counterfactual for the LA firearm-related crime rate based on a weighted combination of control units in a donor pool of cities. We use this counterfactual to estimate the effect of the LA Firearm Study intervention and explore the impact of changing the donor pool and pre-intervention duration period on resulting matches and estimated effects. We demonstrate how decision-making about the quality of a synthetic control can be improved by using ASMD. The mean and max ASMD clearly differentiate between poor matches and good matches. Researchers need better guidance on what is a meaningful imbalance between synthetic control and treated groups. In addition to the use of gap plots, the proposed balance metric can provide an objective way of determining fit. (shrink)

Background Regulations on research ethics in France have evolved considerably over the past four years: the implementation of the Jardé law and of the General Data Protection Regulations have changed the landscape of research ethics for research involving or not involving human persons. In a context of creation of an Institutional Review Board at the University of Bordeaux, France, we sought to explore research ethics practices and perceptions in the medical community of our University Hospital. Methods A short questionnaire was (...) sent to all physicians of the University Hospital of Bordeaux. The questionnaire included closed questions and main topics were: physicians’ education in research ethics, ethics practices concerning researches non implying human persons, and physicians’ perceptions about current regulations. Results 86 questionnaires were sent back. If a majority of physicians have validated Good Clinical Practices trainings, there was a low rate of specific training on fundamental references in research ethics and a high proportion of responders do not consider themselves as educated in research ethics after completion of GCPs. Regulations on research ethics have many implications on medical research, especially by inducing changes in protocols in order to alleviate ethical requirements. Malpractices were acknowledged like false mention of positive opinion from an ethics committee. If If a majority of responders considers regulations as a positive answer to research ethics, a large majority considers it as a constraint and a complexification of research process. For 58%, regulations in research ethics are perceived as a hindrance for research initiatives. Conclusion Because of their impact on research process, regulations seem to constitute a scarecrow for physicians. Lack of training, bad representations and questionable practices highlight the need to improve education and to propose concrete guidance for medical researchers. (shrink)

The COVID-19 pandemic generated overflow of healthcare systems in several countries. As the ethical debates focused on prioritisation for access to care with scarce medical resources, numerous recommendations were created. Late 2021, the emergence of the Omicron variant whose transmissibility was identified but whose vaccine sensitivity was still unknown, reactivated debates. Fears of the need to prioritise patients arose, particularly in France. Especially, a debate began about the role of vaccination status in the prioritisation strategy. The Ethics Committee (EC) of (...) the University Hospital of Bordeaux (UHB), France, identified prioritisation criteria in the literature (some recommended, such as being a healthcare worker (HCW) or having consented to research, while others were discouraged, such as age with a threshold effect or vaccination status). A survey was sent within the institution in January 2022 to explore frontline physicians' adherence to these prioritisation criteria. The decision making conditions were also surveyed. In 15 days, 78/165 (47.3%) frontline physicians responded, and more widely 1286/12946 (9.9%) professionals. A majority of frontline physicians were opposed to prioritising HCWs (54/75, 72%) and even more opposed to participating in research (69/76, 89.6%). Conversely, the results were very balanced for non-recommended criteria (respectively 39/77, 50.7% and 34/69 49.3% in favour for age with a threshold effect and for vaccination status). Decisions were considered to be multi-professional and multi-disciplinary for 65/76, 85.5% and 53/77, 68.8% of frontline physicians. Responders expressed opposition to extending decision-making to representatives of patients, civil society or HCWs not involved in care. Prioritisation recommendations in case of scarce medical resources were not necessarily approved by the frontline physicians, or by the other HCWs. This questions the way ethical recommendations should be communicated and discussed at a local scale, but it also questions these recommendations themselves. The article explores theoretical and practical aspects of evidence collection, examination and assessment in cases of administrative offences, which have been little analyzed as yet. In the article, evidence collection refers to the search for evidence, its discovery and consolidation in a material object. Evidence examination is defined as the establishment of actual data on the circumstances relevant to the case, which are recorded in the evidence, and an additional examination of certain circumstances. Evidence assessment means thinking activities to analyze (...) evidence collected and examined in the case and to establish the truth in the case, according to appropriate criteria. Referring to the opinions of various scientists and the case law of the Supreme Administrative Court of Lithuania, the article reveals elements of evidence in cases of administrative offences, thoroughly explores each stage of the averment process and provides practical examples and makes suggestions for solving problems. The article substantiates a conclusion that early examination and assessment of evidence should also be carried out during the process of drawing up a record of administrative offence. (shrink)

È possibile continuare a vivere in pienezza la propria vita nel tempo della malattia, del dolore e della sofferenza? Oppure il tempo personale invece si ferma, si paralizza, si frantuma quando irrompe nella vita la malattia? A partire da alcune riflessioni del filosofo tedesco Martin Heidegger è possibile intraprendere un breve confronto interdisciplinare con tali complessi interrogativi. Dinnanzi all’apparire della malattia e al non-manifestarsi della salute nel tempo della cura, la situazionalità emotiva dell’angoscia, tratteggiata in un’accezione del tutto particolare dall’autore (...) tedesco sulla scia della riflessione filosofica kierkegaardiana, non può tuttavia aprire l’esserci autenticamente alla propria temporalità, alla propria esistenza e alla propria vita. Occorre così favorire la risorsa fondamentale della speranza, così come quella dell’amore. Solo nella capacità trasformativa e concreta dell’amore la speranza che sorge anche oggi da relazioni interpersonali autentiche connesse alle pratiche dell’aver cura della vita e della salute può infatti emergere fiduciosa e creativa in tutta la sua profondità e aprire il cuore del tempo e della vita. This article examines the current problems and tension that characterize the idea of the right to have rights, considered as a cornerstone of the European Union's project. The systemic deficit matter is discussed as the main problematic to achieve the entirety of the previous concept, and some systemic deficit profile are identified. Moreover through the example of the Greek experience the article shows a possible way of common action to solve the systemic deficit. Il processo di riconoscimento delle cure palliative quale diritto umano individuale di base ha recentemente riscontrato una proficua quanto attesa accelerazione. Parimenti allo sviluppo tecnico dei nostri giorni non si esauriscono infatti le forme dell’umano sentire e sperare, l’esigenza e l’impeto dell’aver-cura autentico dell’altro, la risposta multidisciplinare, comunitaria e sociale che ne consegue doverosa. È quanto attesta e promuove la recente Dichiarazione di Astana sull’assistenza sanitaria primaria, nel riconoscere le cure palliative tra le forme di cura primarie oggi possibili e (...) dovute ad ogni individuo, espressione di un diritto alla salute non riconducibile a mere forme di assistenzialismo tecnico-burocratico, lontane dall’uomo e dalla vita, ma segno e presenza concreta e tangibile dell’umanità inalienabile da cui esso proviene. Ciò che accomuna in questo percorso di riscoperta e ridestazione è l’essenza della nostra umanità, il desiderio di non cadere intrappolati in una in-umanizzazione collettivizzata, assurda quanto brutale, l’umanità di un diritto alla vita, alla salute e alla sua tutela che nasce rinnovato nel cuore di ogni generazione, la consapevolezza originaria di una determinazione ontologico-esistenziale comune e condivisibile. Il problema della reciprocità del riconoscimento personale fra gli esseri umani nelle pratiche dell’aver-cura e la necessità di un’instancabile promozione di forme di presa in carico realmente globali ed affidabili permea profondamente lo stesso processo di un autentico, efficace e quanto più conforme possibile sviluppo sociale, in una comunità di uomini e di popoli che stenta a riconoscersi come tale e dove occorre innanzitutto curare la speranza affinché ne venga abitata la cura di ogni persona. Il volume raccoglie i contributi della giornata di studi in onore di Filippo Bartolone (1919-1988), tenutasi il 12 dicembre 2018, per celebrare il trentennale della sua scomparsa. Al pensatore siciliano hanno reso omaggio allievi, studiosi e amici che, a diverso titolo, hanno potuto apprezzare le sue doti intellettuali e spirituali. Distribuiti nelle quattro sessioni che hanno contraddistinto la ricorrenza, i saggi percorrono, nella prima sessione, alcuni temi della sua filosofia per aprirsi, nella seconda sessione, alle toccanti testimonianze dei suoi allievi (...) circa il suo personale stile di insegnante ed educatore. Nella terza sessione è messa in luce la ricca spiritualità di Bartolone, nutrita di una profonda meditazione religiosa, mentre nella quarta e ultima sessione viene tratteggiata la peculiarità del suo impegno etico-politico, entro e oltre il suo lavoro accademico e in alcuni temi della sua opera. Schrödinger averred that entanglement is the characteristic trait of quantum mechanics. The first part of this paper is simultaneously an exploration of Schrödinger’s claim and an investigation into the distinction between mere entanglement and genuine quantum entanglement. The typical discussion of these matters in the philosophical literature neglects the structure of the algebra of observables, implicitly assuming a tensor product structure of the simple Type I factor algebras used in ordinary Quantum Mechanics . This limitation is overcome by adopting the (...) algebraic approach to quantum physics, which allows a uniform treatment of ordinary QM, relativistic quantum field theory, and quantum statistical mechanics. The algebraic apparatus helps to distinguish several different criteria of quantum entanglement and to prove results about the relation of quantum entanglement to two additional ways of characterizing the classical versus quantum divide, viz. abelian versus non-abelian algebras of observables, and the ability versus inability to interrogate the system without disturbing it. Schrödinger’s claim is reassessed in the light of this discussion. The second part of the paper deals with the relativity-to-ambiguity threat: the entanglement of a state on a system algebra is entanglement of the state relative to a decomposition of the system algebra into subsystem algebras; a state may be entangled with respect to one decomposition but not another; hence, unless there is some principled way to choose a decomposition, entanglement is a radically ambiguous notion. The problem is illustrated in terms a Realist versus Pragmatist debate, the former claiming that the decomposition must correspond to real as opposed to virtual subsystems, while the latter claims that the real versus virtual distinction is bogus and that practical considerations can steer the choice of decomposition. This debate is applied to the fraught problem of measuring entanglement for indistinguishable particles. The paper ends with some remarks about claims in the philosophical literature that entanglement undermines the separability or independence of subsystems while promoting holism. (shrink)

Dopo aver brevemente spiegato le modalità dell'insegnamento dell'Etica a Nicomaco nella Vienna del XV secolo, l'A. si sofferma ad indagare l'influsso esercitato dal commento di Buridano sulla produzione di commenti che fiorì in quel contesto. La maggior parte di tali commenti prodotti nei primi decenni del sec. XV seguivano infatti lo schema delle sue quaestiones: i commenti secundum Buridanum. Nella seconda metà del secolo furono i commenti di Corrado de Susato e le Quaestiones di Johannes Versor a rappresentare un importante (...) punto di riferimento nell'elaborazione filosofica. Si distingue poi tra i commenti più vicini al testo aristotelico e i compendi e le somme di filosofia morale: tra i primi si segnalano in particolare le Quaestiones super libros Ethicorum secundum mentem Henrici de Frimaria di Thomas Teufl ; tra i secondi si ricordano il Compendium philosophiae moralis di Heinrich Plattenberger di Norimberga e la Summa di Michael Lochmair de Haideck . Infine, una tavola riporta la datazione, la tipologia e i mss. contenenti i commenti prodotti a Vienna nel XV secolo. (shrink)

Dopo aver considerato i caratteri generali dei prologhi di Tommaso ai commenti aristotelici, ed in particolare i proemi alla Fisica e al De sensu et sensato, l'A. dimostra come Pietro di Alvernia utilizzi queste due fonti tomiste nel suo proemio al De sensu. Del proemio, diviso in sette sezioni esaminate singolarmente, viene data anche una edizione critica in appendice , che si basa sull'unico manoscritto che tramanda il testo, conservato a Oxford, Merton College, 275. Nell'ultima parte del saggio l'A. propone (...) alcune considerazioni finali, ribadendo che la fedeltà di Pietro al testo di Tommaso non può considerarsi «tomismo», ma rivela piuttosto il bisogno avvertito da Pietro di una guida all'interpretazione dei testi aristotelici. Dopo aver svelato parte della storia e dell’attività di Giulio Sambon (1837-1921) con la sua «Impresa di Vendite in Italia» a Milano, Firenze, Roma e Napoli,1 si propone un approfondimento sul suo incontro con il mercante d’arte Francesco Molinari (1813-1866). Quest’ultimo, attivo in Italia e probabilmente anche in Europa, si colloca nel panorama del collezionismo milanese della seconda metà dell’Ottocento con una particolare attenzione alle opere d’arte lombarda, configurandosi un crocevia ancora non indagato del secolo dei conoscitori. L’occasione che ha (...) portato i due mercanti ad avvicinarsi è stata la chiusura del negozio che Molinari aveva a Milano, per la cui occasione questi chiama Sambon per allestire un’asta con quanto ancora in esposizione. L’episodio diventa l’inizio della dispersione di una raccolta che conta più di 350 opere, documentata attraverso cataloghi d’asta e certificati d’esportazione che mischiano informazioni di carattere storico-artistico e di gusto. The longstanding debates aver how to enforce codes of ethics reflect a serious flaw in understanding the nature of ?accountability.?; Fuzziness aver that basic notion has allowed the quantity of codes to expand, without any improvement in their quality or in media behavior. The essay maintains that we repeat the same arguments today that moralistic journalists did in the 1920s, because we lack intellectual precision aver such issues as internal vis a vis external controls, ethics vis a vis First Amendment (...) freedoms, and different forms and degrees of accountability to government, to fellow professionals, and to the general public. Dopo aver affermato che non è più possibile ridurre il pensiero sartriano a degli schemi ermeneutici semplificatori, il saggio individua il tema della singolarità quale filo rosso che percorre quegli scritti nei quali Sartre dichiara di voler definire l’ambito e il metodo di un’antropologia marxista. Sono gli scritti che hanno come fulcro la Critica della ragione dialettica, in particolare il testo che ne diventerà l’Introduzione, cioè le Questioni di metodo, dove Sartre chiarisce quale funzione può giocare l’esistenzialismo nel conferire al (...) marxismo un rigore metodologico che gli permetta di costituirsi come un rigoroso materialismo storico. Il cuore dell’ontologia di L’essere e il nulla è rappresentato dalla nozione di «realtà umana», la versione «antropologizzata» del Dasein heideggeriano. Ispirandosi a Heidegger, ma mutandone l’orientamento di pensiero, Sartre attribuisce alla «realtà umana» il tratto del bisogno come mancanza organica. Così, gli schemi marxisti di intelligibilità dei processi storici e materiali sono rivisitati alla luce della natura contingente e finita della «realtà umana». È ciò che spinge Sartre a una revisione della dialettica, con lo scopo di aprirla alla comprensione della singolarità di ciascun uomo e a un sapere storico che possa finalmente ambire alla concretezza.
