Die Beitrage dieses Bandes gingen aus der interdisziplinaren Fachtagung -Was sind Regeln und was leisten sie?- hervor, die im Herbst 2009 im Alfried Krupp Wissenschaftskolleg Greifswald stattfand. Ziel der Tagung war es, die Begriffe Regel, Norm und Gesetz und verwandte Konzepte zu klaren und eine Ubersicht uber die unterschiedlichen Rollen und Funktionen dieser Begriffe in den verschiedenen Wissenschaftsdisziplinen zu gewinnen. Die unterschiedlichen Perspektiven der beteiligten Disziplinen auf das Thema -Regeln- - Philosophie, Psychologie, Soziologie, Wissenschaftstheorie, Entscheidungsforschung, Rechts-, Sozial-, Sprach- und Musikwissenschaft (...) - konnen dazu beitragen, traditionell festgefahrene Einseitigkeiten innerhalb der Disziplinen durch wechselseitige Korrektur und Inspiration zu uberwinden. A mechanism-based approach was developed focusing on the psychodynamic, psychological and neuronal mechanisms in healthy and depressed persons. In this integrative concept of depression, the self is a core dimension in depression. It is attributed to negative emotions (e.g., failure, guilt). The increased inward focus in depression is connected with a decreased environmental focus. The development of neuropsychodynamic hypotheses of the altered self-reference is based on the investigation of the emotional-cognitive interaction in depressed patients. It may be hypothesized that the (...) increased negative self-attributions—as typical characteristics of an increased self-focus in depression—may result from altered neuronal activity in subcortical-cortical midline structures in the brain, especially from hyperactivity in the cortical-subcortical midline regions and hypoactivity in the lateral regions. The increased resting state activity in depression is especially associated with an increased resting state activity in the default mode network (DMN) and a dysbalance between DMN and executive network (EN) activity. Possible therapeutic consequences of the neuropsychodynamic approach to depression involve the necessary emotional attunement in psychotherapy of depressed patients and the adequate timing of therapeutic interventions. The hypotheses which have been developed in the context of the neuropsychodynamic model of depression may be used for more specific psychotherapeutic interventions, aiming at specific mechanisms of compensation and defence, which are related to the increased resting state activity and the disturbed resting state-stimulus-interaction. The D-CTC condition, introduced by David Deutsch as a condition to be fulfilled by analogues for processes of quantum systems in the presence of closed timelike curves, is investigated for classical statistical bi-partite systems. It is shown that the D-CTC condition can generically be fulfilled in classical statistical systems, under very general, model-independent conditions. The central property used is the convexity and completeness of the state space that allows it to generalize Deutsch’s original proof for q-bit systems to more general (...) classes of statistically described systems. The results demonstrate that the D-CTC condition, or the conditions under which it can be fulfilled, is not characteristic of, or dependent on, the quantum nature of a bi-partite system. (shrink)

Wherever people are shaken by the experience of being exposed to violence and destruction, disease and death, and also when staring into the abyss of the human soul, questions of cause and responsibility arise. The contributions in this volume trace the continuing quest for answers, drawing on mythical narratives, philosophical reflection, psychological, social and political rationalization or scientific hypotheses in the (...) literature of the 1st to the 4th century AD. The documents covered illustrate a desire to understand the conditions of human existence and to get to the bottom of man's experience of suffering. A desire that is present in the history of thought, philosophy and religion and is driven by the hope that evil can be finally eliminated or at least intellectually domesticated. German description: Die Frage nach der Herkunft des Bosen hat philosophische wie religiose Denker seit jeher beschaftigt. Unde malum? Wo immer die Erfahrung des Ausgeliefertseins an Gewalt und Zerstorung, Krankheit und Tod, aber auch die Erfahrung der Abgrundigkeit der Seele Menschen erschuttern, drangt sich die Frage nach Ursache und Verantwortlichkeit auf. Die fortgesetzte Suche nach Antworten, durch mythisches Erzahlen, durch philosophische Reflexion, durch psychologische, soziale sowie politische Rationalisierung oder durch naturwissenschaftliche Hypothesenbildung wird in den Beitragen des vorliegenden Bandes in der Literatur des 1.-4. The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an (...) expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration. _Contexts of Justice,_ highly acclaimed when it was published in Germany, provides a significant new intervention into the important debate between communitarianism and liberalism. Rainer Forst argues for a theory of "contexts of justice" that leads beyond the narrow confines of this debate as it has been understood until now and posits the possibility of a new conception of social and political justice. Forst makes a four-part distinction to decipher the debate between communitarianism and liberalism. Evidence on the coherence between emotion and facial expression in adults from laboratory experiments is reviewed. High coherence has been found in several studies between amusement and smiling; low to moderate coherence between other positive emotions and smiling. The available evidence for surprise and disgust suggests that these emotions are accompanied by their “traditional” facial expressions, and even components of these expressions, only in a minority of cases. Evidence concerning sadness, anger, and fear is very limited. For sadness, one study (...) suggests that high emotion–expression coherence may exist in specific situations, whereas for anger and fear, the evidence points to low coherence. Insufficient emotion intensity and inhibition of facial expressions seem unable to account for the observed dissociations between emotion and facial expression. (shrink)

Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously. The existence of predatory animals is a problem in animal ethics that is often not taken as seriously as it should be. We show that it reveals a weakness in Tom Regan's theory of animal rights that also becomes apparent in his treatment of innocent human threats. We show that there are cases in which Regan's justice-prevails-approach to morality implies a duty not to assist the jeopardized, contrary to his own moral beliefs. While a modified account of animal rights that (...) recognizes the moral patient as a kind of entity that can violate moral rights avoids this counterintuitive conclusion, it makes non-human predation a rights issue that morally ought to be subjected to human regulation. Jennifer Everett, Lori Gruen and other animal advocates base their treatment of predation in part on Regan's theory and run into similar problems, demonstrating the need to radically rethink the foundations of the animal rights movement. We suggest to those who, like us, find it less plausible to introduce morality to the wild than to reject the concept of rights that makes this move necessary to read our criticism either as a modus tollens argument and reject non-human animal rights altogether or as motivating a libertarian-ish theory of animal rights. Seit dem revolutionaren Gestaltwandel, den die Na turwissenschaften seit dem 17. Jahrhundert durchgemacht haben, sind immer mehr Menschen von der Frage beunruhigt worden, in wiefern die Wissenschaften uberhaupt zur Aufklarung beitragen konnen. Immerhin war die staatliche Forderung der wissenschaft lichen Lehre und Forschung im organisatorischen Rahmen von Universitaten seit der Wende zum 18. Jahrhundert Teil einer op timistischen Antwort auf diese Frage. Der politisch institutionalisierte Optimismus der Erwartung, daB die Aufklarung durch Wissenschaft moglich sei, hat wahrend der vergangenen drei Jahrhunderte mancherlei Bewahrungspro ben durchgemacht. Pavel Florenskij's (1882-1937/summarily executed in GULAG) conception of the personality is connected to considerations of antinomies. The personality remains trapped in contradictions and gains completion only in relation to the Absolute, whereas the individual, the sociological entity, is metaphysically neutral. Florenskij attempts to link the individual and the personality by means of the concept of substance (ousia). "In man oύσiα and ύπόστασις exist together. Ousia (...) posits the Individual and in society endows him with form as a selfsufficient centre. The (...) hypostasis, by contrast, is the personal idea of Man". For Florenskij personality evinces an epistemological analogy to other central terms in his philosophy, in particular Truth and Love as well as to his theory of language and symbols. For him, each personality comprises a distinctive principle growth (a notion evidently taken from the idealistic morphology of the eighteenth and nineteenth centuries) that determines its growth potential. Colour has long been a source of fascination to both scientists and philosophers. In one sense, colours are in the mind of the beholder, in another sense they belong to the external world. A new experimental paradigm involving a computerised quiz was used to examine, on an intra-individual level, the strength of association between four components of the surprise syndrome: cognitive (degree of prospectively estimated unexpectedness), experiential (the feeling of surprise), behavioural (degree of response delay on a parallel task), and expressive (the facial expression of surprise). It is argued that this paradigm, together with associated methods of data analysis, effectively controls for most method factors that could in previous studies have lowered the (...) correlations among the components of emotion syndromes. It was found that (a) the components of the surprise syndrome were all positively correlated; (b) strong association existed only between the cognitive and the experiential component of surprise; (c) the coherence between syndrome components did not increase with increasing intensity of surprise; and (d) there was also only moderate coherence between the components of the facial expression of surprise (eyebrow raising, eye widening, mouth opening), although in this case, coherence tended to increase with intensity. Taken together, the findings support only a weakly probabilistic version of a behavioural syndrome view of surprise. However, the component correlations seem strong enough to support the existence of strong associations among a subset of the mental or central neurophysiological processes engaged in surprise. Le norme e le istituzioni che seguono si basano su narrazioni di giustificazione storicamente date che, nel loro insieme, costituiscono un ordine normativo, dinamico e ricco di tensioni. Superando l’alternativa tra teorie “ideali” e teorie “realiste”, Rainer Forst dimostra in questo libro come i concetti di normatività e potere siano strettamente correlati: il potere si basa, infatti, sulla capacità di influenzare, determinare ed eventualmente restringere lo spazio delle giustificazioni. Three main versions of cognition-arousal theory are distinguished depending on how they interpret the theory’s basic postulate, that an emotion is a function of cognition and arousal: objectivist causal theories, attributional theories, and fusion theories. The objectivist causal and attributional theories each comprise a causal-functional and a part-whole version, and the fusion theory subsumes in particular a categorization and a perceptual integration version. In addition, the attributional version of cognition-arousal theory can be reinterpreted as a theory of emotion self-ascription. Although (...) arousal may in fact not be necessary for emotions, a modified cognition-feeling theory that replaces arousal with intrinsically affective feelings, seems still viable. Je weiter die Verwissenschaftlichung unserer Lebenswelt fortschreitet, desto dringender stellt sich die Frage nach dem Status und dem sinnvollen Umgang mit Wissenschaft. Buchstaben-Folgen rekonstruiert das Projekt abendländischer Wissenschaft vor dem Hintergrund der Differenz von Mündlichkeit und Schriftlichkeit. Die Reflexion auf das komplizierte Verhältnis zwischen gesprochener Sprache und Schrift sowie auf die entsprechenden - medial unterschiedlichen - Darstellungsformen von Wissen ermöglicht ein angemesseneres Verständnis der ambivalenten Rolle von Wissenschaft in unserer Kultur. Eine in ihrem Status und ihrer Reichweite mißverstandene Wissenschaft kann (...) leicht zur Ideologie werden. Das Buch führt zwei Debatten zusammen, die bisher noch kaum verknüpft worden sind: die interdisziplinäre Debatte der 80er und 90er Jahre um die kulturellen Auswirkungen von Schrift und Schriftlichkeit einerseits und die von Heidegger wesentlich angestoßene und bis heute anhaltende philosophische Diskussion um Status und Reichweite wissenschaftlicher Weltdarstellungen andererseits. In einer doppelten - medienhistorischen und medien-phänomenologischen - Perspektive erläutert der Autor, welche praktischen Entstehungsbedingungen und welchen Status wissenschaftliche Aussagen als >verdauerte sprachliche Handlungen haben, was bestimmte Mißverständnisse von Wissenschaft sind und wie diese Mißverständnisse gerade durch die schriftliche Form der Wissensdarstellung evoziert werden. Der erste Teil des Buches zeigt im Anschluß an Arbeiten von Jan Assmann, Christian Stetter und anderen, wie die Erfindung und Verbreitung der Alphabetschrift in Griechenland die Ausprägung eines formalen Sprachumgangs, die Entstehung von formaler Logik und logisch-enzyklopädischer Wissenschaft als episteme zugleich ermöglicht und herausgefordert hat. Im zweiten Teil des Buches werden zentrale Texte Heideggers im Kontext schriftphilosophischer Überlegungen neu gedeutet. Heideggers kritische Diagnose, daß die Geburtsstunde der okzidentalen Wissenschaft zugleich die Geburtsstunde der abendländischen Wissenschaftsmetaphysik ist, wird verständlich, wenn man sie mit der unreflektierten konstitutiven Schriftlichkeit des Wissenschaftsprojektes in Zusammenhang bringt. Seinsvergessenheit wird im Kern als Schriftvergessenheit verstehbar. Die Darstellung bewegt sich in einem spannungsreichen Verhältnis zu den schriftphilosophischen Thesen von Jacques Derrida und dessen Projekt einer Grammatologie. The Justification of Basic Rights: A Discourse-Theoretical Approach In this paper, I suggest a discourse theory of basic legal rights that is superior to rival approaches, such as a will-based or an interest-based theory of rights. Basic rights are reciprocally and generally justifiable and binding claims on others (agents or institutions) that they should do (or refrain from doing) certain things determined by the content of these rights. We call these rights basic because they define the status of persons as (...) full members of a normative order in such a way that they provide protection from severe forms of legal, political and social domination. The very ground of these rights is the status of persons as free and equal normative authorities within the order they are subject to. In other words, these rights are grounded in a fundamental moral right to justification. (shrink)

The ability of predicting upcoming events or conditions in advance offers substantial selective advantage to living beings. The most successful systematic tool for fairly reliable prognoses is the use of dynamical causal models in combination with memorised experience. Surprisingly, causality is a fundamental but rather controversially disputed concept. For both models and memory, symbol processing is requisite. Symbols are a necessary and sufficient attribute of life from its very beginning; the process of their evolutionary emergence was discovered by Julian Huxley (...) a century ago. In behavioural biology, this universal symmetry-breaking kinetic phase transition became known as ritualisation. Symbol use for predicting future dynamical processes has culminated in the unprecedented complexity of mental models used in science and technology, coining the historical ascent of modern humans. Observation and measurement transform structural information of physical exchange processes into symbolic information from which state quantities are derived by means of mental models. However, phylogenetically inherited models such as naïve realism do not necessarily explain the sophisticated insights revealed by modern experiments with, say, entangled quantum states. It is suggested to carefully distinguish observed exchange quantities from predicted unobservable state quantities, and physical reality from mental models thereof. (shrink)

In this paper, I focus on Kant’s doctrine of figurative synthesis. Figurative synthesis is the result of the activity of productive transcendental imagination. This is the chief problem of the so-called “second proof step” in Kant’s deduction of the categories according to the second edition of the Critique of Pure Reason. The pure original synthetic apperception forms in the inner and outer sense - i. e. in time and space - by self-affection structures of order that make it possible to (...) cognize empirical objects. The order of space and time through figurative syntheses must be distinguished on the one hand from space and time as forms of intuition and on the other hand from the order of the manifold given in space and time. According to a diverse and widely popular family of moral theories, there is a class of individuals – typically humans or persons – who have the very same, full moral status. Individuals not falling into that class count for less, or not at all, morally speaking. In this article, I identify two problems for such theories, the mapping problem and the problem of misgrounded value, and argue that they are serious enough to be decisive. I will then propose an alternative (...) account of full and equal moral status that avoids those problems. In grounding full moral status in phenomenal consciousness, it preserves the idea that you and I are equal, but at the same time radically expands the community of moral equals.
