Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. In this article, I address the various objections raised by Simone Chambers, Stephen White and Lea Ypi concerning my version of a critical theory of politics. I explain the basic assumptions that inform my account of a critique of relations of justification, its particular method and aims.

In this article I challenge Rainer Forst’s model of critical theory from the point of view of democratic theory. I suggest that his approach is too abstract and hypothetical to address the real world challenges facing democratic polities today.

Scholars disagree about the proper justification of human rights and which rights qualify as human rights. While some argue for a very limited set of human rights, others defend more comprehensive accounts. In this paper I suggest that a defence of a comprehensive set of human rights can be strengthened by combining constructivist deontological and well-being based teleological justifications. To this end, I discuss two prominent proponents of constructivism and the well-being approach: Rainer Forst and Simon Caney. Forst (...) criticises teleological justifications for grounding human rights in non-universalizable conceptions of the good, such as autonomy, that can reasonably be rejected by others. Constructivism, in contrast, does not rest on any particular idea of the good life and thus allows for greater ethical plurality. I reject this specific criticism, arguing that Caney’s approach ultimately allows for the same plurality. I also highlight that constructivism on its own cannot justify rights of people who are not (yet) able to reason. The well-being approach provides substantive arguments for the rights of these individuals. However, these arguments are made with the framework provided by constructivism. I hold, contra Caney, that Forst’s right to justification is primary in that it is the unavoidable basis from which justice issues can be dealt with in a reasonable way and that the main function of human rights is to protect the equal moral status of persons. I conclude that Forst’s constructivist and Caney’s well-being approach are complementary rather than rivalrous: when combined they provide a more robust justification for a comprehensive set of human rights than considered separately. This paper examines what agents should do when others fail to comply with their responsibilities to prevent dangerous climate change. It distinguishes between six different possible responses to noncompliance. These include what I term (1) 'target modification' (watering down the extent to which we seek to prevent climate change), (2) ‘responsibility reallocation’ (reassigning responsibilities to other duty bearers), (3) ‘burden shifting I’ (allowing duty bearers to implement policies which impose unjust burdens on others, (4) 'burden shifting II’ (allowing some to (...) protect peoples rights in ways which impose otherwise unjustified burdens on the duty bearers, (5) 'compromising moral ideals' (permitting agents to compromise non-justice ideals that they are otherwise bound by); and (6) ‘promoting compliance (implementing policies and creating institutions which reduce noncompliance). It concludes by outlining a methodological framework for evaluating these options, and by setting out my tentative and provisional evaluation of which responses are the least bad. (shrink)

Positive mental health involves not the absence of mental disorder but rather the presence of certain mental goods. Institutions, practitioners, and theorists often identify positive mental health with well‐being. There are strong reasons, however, to keep the concepts of well‐being and positive mental health separate. Someone with high positive mental health can have low well‐being, someone with high well‐being can have low positive mental health, and well‐being and positive mental health sometimes conflict. But, while positive mental health and well‐being are (...) not identical, there is an informative conceptual connection between them. Positive mental health usually contributes instrumentally to the living of a good human life, where a good human life includes (but is not limited to) well‐being. (shrink)

Simon Glendinning explains the mysteries of phenomenology.

Empirical research on human–robot interaction has demonstrated how humans tend to react to social robots with empathic responses and moral behavior. How should we ethically evaluate such responses to robots? Are people wrong to treat non-sentient artefacts as moral patients since this rests on anthropomorphism and ‘over-identification’ —or correct since spontaneous moral intuition and behavior toward nonhumans is indicative for moral patienthood, such that social robots become our ‘Others’?. In this research paper, I weave extant HRI studies that demonstrate empathic (...) responses toward robots with the recent debate on moral status for robots, on which the ethical evaluation of moral behavior toward them is dependent. Patienthood for robots has standardly been thought to obtain on some intrinsic ground, such as being sentient, conscious, or having interest. But since these attempts neglect moral experience and are curbed by epistemic difficulties, I take inspiration from Coeckelbergh and Gunkel’s ‘relational approach’ to explore an alternative way of accounting for robot patienthood based on extrinsic premises. Based on the ethics of Danish theologian K. E. Løgstrup I argue that empathic responses can be interpreted as sovereign expressions of life and that these expressions benefit human subjects—even if they emerge from social interaction afforded by robots we have anthropomorphized. I ultimately develop an argument in defense of treating robots as moral patients. (shrink)

The Moral Conscience principle claims that a conflict between the demands of a law and the demands of an individual’s sincere moral conscience provides her with a defeasible moral entitlement to an exemption. This chapter argues that this principle is vulnerable to an unfairness objection. There is nothing special about moral conscience that would justify granting an exemption, it claims, that is not shared by a variety of non-moral projects. Thus, there is no principled moral reason for a defeasible entitlement (...) to moral conscience-based exemptions that is not an equally good reason for a defeasible entitlement to non-moral project-based exemptions. Since the chapter assumes that people are not defeasibly entitled to such project-based exemptions, it advocates scepticism about the Moral Conscience principle. (shrink)

A heuristic comparison is made of relativistic and non-relativistic quantum theory. To this end the Segal approach is described for the non-specialist. The significance of antimatter to the local and microcausal properties of the fields is laid bare. The fundamental difference between relativistic and non-relativistic (complex) fields is traced to the existence of two kinds of complex numbers in the relativistic case. Their relation to covariant and Newton-Wigner locality is formulated.

Yves R. Simon (1903-1961) was one of this century’s greatest students of the virtue of practical wisdom. Simon’s interest in this virtue ranged from ultimate theoretical and foundational concerns, such as the relationship between practical knowledge and science, to the most concrete and immediate questions regarding the role of practical wisdom in personal and social decision-making. These concerns occupied Simon from his earliest published writing to the final notes and correspondence he was working on at the moment (...) of his untimely death. Throughout his life, practical wisdom and its related philosophical ramifications emerge time and again at critical junctures, throwing into bold relief some of the deeper dimensions of questions as diverse as the nature of democracy, the concept of law, and the theory of work. Practical knowledge constitutes a unifying motif of Simon’s entire encyclopedic effort. This volume reconstructs what would have been Simon’s final sustained writing on practical knowledge. It includes reworking of some previously published material, especially the landmark 1961 essay, "Introduction to the Study of Practical Wisdom," possibly the best treatment of the concept of "command" in recent philosophical writing. But it also reproduces, in a form closely corresponding to Simon’s intention, material drawn from notes and schemata, concerning issues such as the relationship between moral science and wisdom, the nature of practical judgment, and the relationship between practical knowledge and Christian moral philosophy. Also included are previously unpublished letters to Jacques Maritain on the controversy surrounding the theoretical-practical and practico-practical syllogisms, as well as Maritain’s responses. The volume concludes with applications of Simon’s general theory to a critique of the concept of a social science and to the notion of Christian humanism. This volume will appeal to moral philosophers interested in a range of normative issues, as well as social scientists and readers concerned with the philosophical foundations of modern culture. Virtue moralist, in particular, will find in Simon one of the profoundest commentators on this tradition in normative ethics. (shrink)

Many philosophers hold that moral agency is defined by an agent’s capacity for rational reflection and self-governance. It is only through the exercise of such capacities, these philosophers contend, that one’s actions can be judged to be of distinctively moral value. The moral phenomenology of the Danish philosopher and theologian K. E. Løgstrup, currently enjoying a revival of interest amongst Anglo-American moral philosophers, is an exception to this view. Under the auspices of his signature theory of the ‘sovereign expressions of (...) life,’ Løgstrup provides a rich moral phenomenology aimed at establishing the ethical value of ‘spontaneous,’ non-deliberative actions, such as those exemplified in the showing of trust and acts of mercy. In this thesis, my aim is to investigate what mode of moral agency, if any, is compatible with Løgstrup’s phenomenology of the sovereign expressions of life. I argue that Løgstrup’s moral phenomenology is compatible with a distinctive medio-passive mode of agency. According to this conception of moral agency, the subject’s agency is constituted not through her capacity to stand back and make a judgment on how to act, but rather in the way the subject comports herself in relation to situations and encounters that are experienced first-personally as overwhelming and encompassing. I will proceed by providing detailed analyses of the core aspects of Løgstrup’s moral phenomenology and his theory of the sovereign expressions of life. In the process, I will elucidate the decisive influence that thinkers such as Martin Heidegger, Martin Luther and Søren Kierkegaard had on Løgstrup’s way of thinking about ethics. Thus, in this thesis my aim is to contribute both to Løgstrup scholarship and to central on-going debates in moral philosophy and the philosophy of action. (shrink)

The paper is an attempt to show how a theory of morality which sees moral judgements as essentially expressions of personal attitude, can nevertheless explain and justify the way in which morality seems objective, and authoritative. It explores the genesis of notions of improvement, and correctness, and truth, in moral matters, thus trying to explain our right to these concepts, which other theories, such as realism, take too much for granted.

This paper argues that even the most extensively refined comparative cost/benefit analysis must be supplemented by other factors, irreducible to it, if we are to develop an adequate framework to guide policy decisions affecting technological design and innovation.

I address the problem of reconciling environmental holism with the intrinsic value of individual beings. Drawing upon Madhyamaka Buddhism, the later philosophy of Martin Heidegger, and deep ecology, I present a distinctly holistic conception of nature that, nevertheless, retains a commitment to the intrinsic worth of individual beings. I conclude with an examination of the practical implications of this “thing-centered holism” for environmental ethics.

We should be suspicious of the idea that experiencing pain could enable animals to trade off different motivations in a common currency. It is not even clear that humans have a common motivational currency reflected in evaluative experience. Instead, pain may capture attention, inhibiting attention to competing motivations and needs, thereby making genuine trade-offs harder. Our criteria for pain in invertebrates should be part of a more subtle theory of the relationship between pain and decision-making.

The Gibbs Paradox is essentially a set of open questions as to how sameness of gases or fluids are to be treated in thermodynamics and statistical mechanics. They have a variety of answers, some restricted to quantum theory, some to classical theory. The solution offered here applies to both in equal measure, and is based on the concept of particle indistinguishability. Correctly understood, it is the elimination of sequence position as a labelling device, where sequences enter at the level of (...) the tensor product of one-particle state spaces. In both cases it amounts to passing to the quotient space under permutations. ‘Distinguishability’, in the sense in which it is usually used in classical statistical mechanics, is a mathematically convenient, but physically muddled, fiction. Towards a Posthuman Theory of Educational Relationality critically reads the intersubjective theories on educational relations and uses a posthuman approach to ascribe agency relationally to humans and nonhumans alike. The book introduces the concept of ‘educational relationality’ and contains examples of nonhuman elements of technology and animals, putting educational relationality and other concepts into context as part of the philosophical investigation. Drawing on educational and posthuman theorists, it answers questions raised in ongoing debates regarding the roles of students and teachers (...) in education, such as the foundations of educational relations and how these can be challenged. The book explores educational relations within the field of philosophy of education. After critically examining intersubjective approaches to theories of educational relations, anthropocentrism and subject-centrism are localized as two problematic aspects. Post-anthropocentrism and intra-relationality are proposed as a theoretical framework, before the book introduces and develops a posthuman theory of educational relations. The analysis is executed through a diffractive reading of intersubjective theories, resulting in five co-concepts: impermanence, uniqueness-as-relationality, proximity, edu-activity, and intelligibility. The analysis provided through educational examples demonstrates the potential of using the proposed theory in everyday practices. Towards a Posthuman Theory of Educational Relationality will be of great interest to researchers and postgraduate students in the fields of philosophy of education, early childhood education, research methodology and curriculum studies.
