It is often assumed that if the fetus is a person, then abortion should be illegal. Thomson1 laid the groundwork to challenge this assumption, and Boonin2 has recently argued that it is false: he argues that abortion should be legal even if the fetus is a person. In this article, I explain both Thomson’s and Boonin’s reason for thinking that abortion should be legal even if the fetus is a person. After this, I show that Thomson’s and Boonin’s argument for (...) legalised abortion fail; they have not given us good reason for thinking abortion should be legal.1 Finally, I argue that—if we play Boonin’s game—abortion should be illegal. When discussing the ethics and politics of abortion, whether the fetus is a person is usually central.3 4.2 However, Thomson1 long ago challenged this view. She argued that abortion is permissible even if the fetus is a person. To do so, she asks us to consider a case in which you are non-consensually taken to a hospital and hooked up to a famous violinist. The violinist, if he is to survive, needs to filter his blood through your body. After 9 months, he will be fine and you can unplug yourself and go on your way. If you unplug yourself prior to this, however, he will die. Is it permissible to unplug yourself? Thomson thinks the answer is ‘yes’. And this, she thinks, shows that abortion is permissible even if the fetus is a person. While the majority of her article focuses on the ethics of abortion, it is clear that she also aims to show that abortion should be legal if the fetus is a person; she would no doubt reject the view that the state is right to coerce you into …. P-zombies are creatures that are physically (functionally, behaviourally) like you and I and yet lack phenomenal consciousness. If such creatures are possible, it’s (typically) taken to show property dualism is true: phenomenal consciousness isn’t reducible to – nor does it supervene on – physical states. If inverted qualia are possible, it’s possible that you and I have identical physical states and yet you see tomatoes as green and I see tomatoes as red. If this is the case, then (again) property (...) dualism is (typically) taken to be true. In this article, I???ll show that p-zombies and inverted qualia – if they are actually possible – prove more than previously thought: if one thinks p-zombies or inverted qualia are possible, then one should endorse one of the four following theses: (i) substance dualism, (ii) we have even more reason to reject p-zombies and inverted qualia since they entail an even more radical conclusion than previously thought (i.e. substance dualism), (iii) eliminativism about selves, or (iv) friends of p-zombies and inverted qualia have homework: they need to show a relevant, plausible disanalogy between arguments for p-zombies and inverted qualia as traditionally stated and my parallel arguments that entail substance dualism. My purpose here isn’t to defend any of these particular options. Instead, my purpose is to highlight that these are the four options available to take. (shrink)

Say theism is the view that an omnipotent, omniscient, perfectly loving, and perfectly good being exists. And say pointless atheism occurs just in case there’s an atheist who isn’t resistant to belief in God, and no greater good comes about on account of this atheist’s non-belief. In this article, I show that if two prominent views about evil and divine hiddenness are accepted, theism is compatible with pointless atheism—a result hitherto unnoticed. Furthermore, not only is theism compatible with pointless atheism, (...) it entails pointless atheism. This is significant because many objections to the argument from divine hiddenness have tried to show that all instances of non-resistant atheism are required for a greater good. But if I’m right, given theism, there need not be a point to non-resistant atheism. Indeed, we should expect there to be pointless atheism. (shrink)

Abortion restrictions are particularly good for black women—at least in the United States. This claim will likely strike many as outlandish. And numerous commentaries on abortion restrictions have suggested otherwise: many authors have lamented the effects of abortion restrictions on women, and black women in particular—these restrictions are bad for them, these authors say. However, abortion restrictions are clearly good for black women. This is because if someone is prevented from performing a morally wrong action, it’s good for her. For (...) example, it’s good for Sarah if she’s prevented from driving home drunk. However, since abortion is morally wrong, it follows that it’s good for women when they are prevented from getting an abortion. And since black women get abortions at disproportionately high rates, abortion restrictions are good in particular for black women. Legitimate political authority is often said to involve a “right to rule,” which is most plausibly understood as a Hohfeldian moral power on the part of the state to impose obligations on its subjects (or otherwise to change their normative situation). Many writers have taken the state’s moral power (if and when it exists) to be a correlate, in some sense, of an obligation on the part of the state’s subjects to obey its directives. Thus legitimate political authority is said (...) to entail a general obligation to obey the law, and a general obligation to obey the law is said to entail legitimate political authority. With some version of this idea in mind, many writers attempt to establish full (or partial) legitimate political authority by first arguing for the intermediate conclusion that there exists a general (or partial) obligation to obey the law. This article argues that such a strategy is fundamentally mistaken, because while legitimate authority does indeed entail an obligation to obey the law, an obligation to obey the law does not, in and of itself, entail legitimate authority. This can be referred to as “the reverse entailment problem.” To avoid this problem, a theory of political authority must argue directly for the existence of the appropriate kind of moral power on the part of the state. This article argues for the “value-based” conception of a moral power, which states, very roughly, that one person holds a power over another if there is sufficient value in the former possessing the capacity intentionally to impose an obligation on the latter (or otherwise to change her normative situation). This seemingly simple understanding of a moral power gives rise to surprisingly strong adequacy conditions on what can count as an acceptable theory of legitimate political authority, and these conditions decisively rule out most of the standard theories in the literature. I’ve argued that those who endorse the argument from divine hiddenness must give up all pure de jure objections to theism, and this means that endorsing the argument is costly for atheists. Benjamin Curtis claims that this isn’t a significant cost for atheists. I show that—contrary to Curtis—there is a significant cost, and spell out why this is so. In this paper we1 assess the potential for research on nonhuman animals to address questions about the phenomenology of painful experiences. Nociception, the basic capacity for sensing noxious stimuli, is widespread in the animal kingdom. Even rel- atively primitive animals such as leeches and sea slugs possess nociceptors, neurons that are functionally specialized for sensing noxious stimuli (Walters 1996). Vertebrate spinal cords play a sophisticated role in processing and modulating nociceptive signals, providing direct control of some motor responses to noxious (...) stimuli, and a basic capacity for Pavlovian and instrumental conditioning (Grau et al. 1990; Grau 2002). Higher brain systems provide additional layers of association, top-down control, and cognition. In humans, at least, these higher brain systems also give rise to the conscious experiences that are characteristic of pain. What can be said about the experiences of other animals who possess nervous systems that are similar but not identical to humans? (shrink)

We describe a formal framework for analyzing how statistical properties of natural environments and the process of natural selection interact to determine the design of perceptual and cognitive systems. The framework consists of two parts: a Bayesian ideal observer with a utility function appropriate for natural selection, and a Bayesian formulation of Darwin's theory of natural selection. Simulations of Bayesian natural selection were found to yield new insights, for example, into the co‐evolution of camouflage, color vision, and decision criteria. The (...) Personal life events of a chief executive officer can generate tensions between the CEO’s right to personal privacy and the desire of shareholders for information. Such circumstances can create information asymmetry between the executive management and the shareholders of a firm, a situation likely to produce unfavorable pressures on an organization’s stock price. Failure to fully disclose material personal life events can impact the decision-making actions of the CEO, causing the stock price of the firm to vacillate as a result (...) of rumors and other informational uncertainties. These vacillations in stock price may impact a firm’s liquidity, increase the cost of capital, and affect long term returns to shareholders. We draw upon the ethical leadership and signaling theory literatures to demonstrate how a firm can reduce stock price volatility through a CEO making non-required disclosures that reduce information asymmetry. The question "What is pleasure?" has been a thorn in the side of philosophy since the time of Socrates. David L. Perry attempts to arrive at a satisfactory answer in the form of a definition of pleasure. In the end, he offers two definitions, turning on two radically different notions of pleasure--that of enjoyment and that of being pleased about. Perry is best when dealing with the cognitive aspects of pleasure and with pleasure as a reason for acting. (...) He discusses the extent to which belief is involved in pleasure, the notion of a "false pleasure," the relation between taking pleasure in something and thinking it a good thing, one's knowledge of one's own pleasure, and the ways in which pleasure can be given as a reason for acting. In the end, it appears there can be no single definition of pleasure, and this problematic concept remains to be satisfactorily elucidated by philosophers. (shrink)

(Wide) pro-theism is the view that the world is better overall if theism is true. (Wide) anti-theism is the view that our world would be better overall if atheism is true. Arguments for pro-theism and anti-theism typically make use of traditional theism (the view that an omni-God exists) and generic atheism (the view that an omni-God doesn’t exist). In my view, when the debate between pro-theists and anti-theists makes use of traditional theism and generic atheism, pro-theism clearly comes out on (...) top. In this paper, I consider whether this result (i.e. pro-theism’s advantage over anti-theism) changes if we bring axiarchism into the mix: I compare axiarchistic theism and axiarchistic atheism. General axiarchism is the view that the world exists because it is good that it exists, and extreme axiarchism is the view that the world exists because it is the best possible world. When we take general axiarchistic theism and general axiarchistic atheism as our worldviews for comparison, I argue that there is no significant change with respect to anti-theism and pro-theism: neither position is able to capture goods that are traditionally associated with the other position, and so pro-theism still wins out. However, if we instead compare extreme axiarchistic atheism with extreme axiarchistic theism there is a significant change: while the case for pro-theism remains the same (because, I argue, it is not able to capture any of the goods of anti-theism), the case for anti-theism is greatly strengthened, because it is able to capture nearly all of the goods of pro-theism (e.g. the good of an afterlife, of cosmic justice, of there being no gratuitous evil). In other words, given extreme axiarchism, atheistic worlds can (and will) house goods that are traditionally associated with theistic worlds (e.g. those listed prior). This means that, given extreme axiarchism, pro-theists can’t appeal to those goods as favoring their position: they obtain whether our world is atheistic or theistic. Thus, they don’t favor pro-theism over anti-theism; the case for anti-theism has been strengthened. (Alternatively, we may say that the case for pro-theism has been weakened.) Ultimately, there is one good that extreme axiarchistic atheism does not enable anti-theism to capture—namely, God’s intrinsic unlimited goodness—and I argue that this shows that there is still a gap between pro-theism and anti-theism; while the gap has been substantially narrowed, it has not been eliminated. Thus, I suggest that the best route forward for anti-theists is to cast doubt on the view that God’s intrinsic goodness is unlimited. (shrink)

To understand H.L.A. Hart's general theory of law, it is helpful to distinguish betweensubstantiveandmethodologicallegal positivism. Substantive legal positivism is the view that there is no necessary connection between morality and the content of law. Methodological legal positivism is the view that legal theory can and should offer a normatively neutral description of a particular social phenomenon, namely law. Methodological positivism holds, we might say, not that there is no necessary connection between morality and law, but rather that there is no (...) connection, necessary or otherwise, between morality and legal theory. The respective claims of substantive and methodological positivism are, at least on the surface, logically independent. Hobbes and Bentham employed normative methodologies to defend versions of substantive positivism, and in modern times Michael Moore has developed what can be regarded as a variant of methodological positivism to defend a theory of natural law. All of culture, philosophy included, is a huge trick on nature, and nature will eventually catch on and reassert itself. But for right now, if one lives in a free society, it's a wonderful time to be a philosopher: so much to read, so much to think and write about.

The hospital's clinical ethics committee sought to gauge health-care professionals’ level of knowledge and usage of the Mental Capacity Act 2005 within the hospital trust. The hospital's personnel were asked to complete a 10 part questionnaire relating to the basic contents of the Act. Four hundred questionnaires were distributed and 249 (62%) were returned completed and valid for analysis. A ‘pass-mark’ of 70% (7/10) was assumed; the results showed that 48% of respondents scored ≤50% (≤5/10), 74% of respondents scored <70% (...) (<7/10) and only 24% of respondents scored ≥70% (≥7/10). It was concluded that the Mental Capacity Act 2005 was not being effectively implemented within the Trust. Measures to increase the awareness and usage of the Act have subsequently been instigated. We believe that these measures will improve the awareness and knowledge of the Mental Capacity Act 2005 within the hospital Trust lead to its better utilization. (shrink)
