Philosophers use historical case studies to support wide-ranging claims about science. This practice is often criticized as problematic. In this paper we suggest that the function of case studies can be understood and justified by analogy to a well-established practice in biology: the investigation of model organisms. We argue that inferences based on case studies are no more problematic than inferences from model organisms to larger classes of organisms in biology. The essay opens with some background information about the period in which J.S. Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as ‘blasphemous’ amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section 2 presents the (...) Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section 3 analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. This paper analyses J.S. Mill's theory on the relationships between individual autonomy and State powers. It will be argued that there is a significant discrepancy between Mill's general liberal statements aimed to secure individual largest possible autonomy and the specific examples which provide the government with quite wide latitude for interference in the public and private spheres. The paper outlines the boundaries of government interference in the Millian theory. Subsequently it describes Mill's elastic paternalism designed to prevent people from inflicting (...) harm upon others as well as upon themselves, from soft paternalism on issues like compulsory education to hard paternalism on very private matters such as marriage, having children, and divorce by consent. This paper reflects on the articles submitted for the Symposium Confronting the Internet’s Dark Side. I discuss some of the criticisms of the book’s theory and my treatment of hate speech. The responsibilities of Internet Service Providers and Web-Hosting Services are in the fore, arguing that as they are the gatekeepers, they need to be proactive far more than they are now. This paper, like my book, strives to suggest an approach that harnesses the strengths and capabilities of the public (...) and the private sectors in offering practical solutions to pressing problems. In recent years there has been an increase in the number of requests formercy killings by patients and their relatives. Under certain conditions,the patient may prefer death to a life devoid of quality. In contrast to thosewho uphold this quality of life approach, those who hold the sanctity oflife approach claim that life has intrinsic value and must be preservedregardless of its quality. This essay describes these two approaches,examines their flaws, and offers a golden path between the two extremepositions.We discuss (...) the halachic and the secular views, arguing for a balancebetween the sanctity of life and the quality of life. I develop a theodicy (Non-Identity Theodicy) that begins with the recognition that we owe our existence to great and varied evils. I develop two versions of this theodicy, with the result that some version is available to the theist regardless of her assumptions about the existence and nature of free will. My defense of Non-Identity Theodicy is aided by an analogy between divine creation and human procreation. I argue that if one af rms the morality of vol- untary human procreation, (...) one should af rm the morality of divine creation; conversely, deny- ing the morality of divine creation commits one to denying the morality of human procreation. The article deals with the Dawson College Massacre, focusing on the story of Kimveer Gill, a 25-year-old man from Laval, Montreal who wished to murder young students in Dawson College. It is argued that the international community should continue working together to devise rules for monitoring specific Internet sites, as human lives are at stake. Preemptive measures could prevent the translation of murderous thoughts into murderous actions. Designated monitoring mechanisms of certain websites that promote violence and seek legitimacy as well (...) as adherents to the actualization of murderous thoughts and hateful messages have a potential of preventing such unfortunate events. Our intention is to draw the attention of the multifaceted international community to the shared interest and need in developing monitoring schemes for certain websites, in order to prevent hideous crimes. It is common to note that social environment and cultural formation shape mental disorders. The details of this claim are, however, not well understood. The paper takes a look at the claim that culture has an impact on psychiatry from the perspective of metaphysics and the philosophy of science. Its aim is to offer, in a general fashion, partial explications of some significant versions of the thesis that culture and social environment shape mental disorders and to highlight some of the (...) consequences social constructionism about psychiatry has for psychiatric explanation. In particular, it will be argued that the alleged dependence of facts about particular mental disorders and about the second order property of being a mental disorder on social facts amounts to a robust form of constructivism, whereas the view that clinician–patient interaction is influenced by cultural facts is perfectly compatible with an anti-constructivist stance. The agents of a jury have to decide between a good and a bad option through simple majority voting. In this paper the jury consists of N independent couples. Each couple consists of two correlated agents of the same competence level. Different couples may have different competence levels. In addition, each agent is assumed to be better than completely random guessing. We prove tight lower and upper bounds for the quality of the majority decision. Background Most jurisdictions that allow euthanasia and assisted suicide (AS) regulate it through the medical profession. However, the extent and nature of how medicine should be involved are debated. Swiss AS practice is unusual in that it is managed by lay AS organizations that rely on a law that permits AS when done for nonselfish reasons. Physicians are not mentioned in the law but are usually called upon to prescribe the lethal medications and perform capacity evaluations.Methods We analyzed in-depth interviews (...) of 23 Swiss AS experts including ethicists, lawyers, medical practitioners, and senior officials of AS organizations for their views on AS.Results Although there was agreement on some issues (e.g., need for better end-of-life care), the interviewees’ preferred model for AS, and the nature of preferred medical involvement, varied, which we categorized into five types: preference for AS practice as it occurred prior to lay AS organizations; preference for the current lay model; preference for a modified lay model to increase autonomy protections while limiting medical AS normalization; preference for various types of more medicalized models of AS; and, ambivalence about any specific model of medical involvement. The rationales given for each type of model reflected varying opinions on how medicine’s role would likely impact AS practice and demonstrated the experts’ attitudes toward those impacts.Conclusion The dynamics within the Swiss AS regime, as reflected in the varying views of Swiss AS experts, shed light on the dilemmas inherent to medical scope and involvement in AS, which may have implications for debates in other jurisdictions. This paper addresses the concepts of moral and social responsibility on the Internet in considering the most troubling phenomenon of cyberbullying that results in loss of life. Specifically, I probe the moral and social responsibilities of Internet users (agents), of the education system in fighting cyberbullying, and of Internet intermediaries. Balance needs to be struck between freedom of expression and social responsibility. The tragic story of Megan Meier serves as an illustrative example and some further incidents in which this ugly (...) phenomenon of cyberbullying had cost young life are mentioned. It is argued that all relevant stakeholders need to think of the consequences of their conduct, that Internet abusers should be accountable for their wrongdoing, and that people who have the ability to stop or at least reduce the risk of cyberbullying should take proactive steps, exhibiting zero tolerance to cyberbullying. There is disagreement as to the ontological status of works associated with an original. Some hold that works like paintings are identical to the concrete particular the artist worked on while creating the artwork. Others suggest that works of this sort cannot be instantiated more than once. In this paper, it is argued that, even if artworks like paintings cannot be instantiated in reproductions, they are nevertheless possibly instantiated more than once. Moreover, it is tentatively suggested that the same holds (...) for improvisations in music. Therefore, even the best candidates on offer do not allow for an identification of the work with a particular or for an identification of the work with a type that is instantiated maximally once. The argument rests on thought experiments, and an inference to the ‘best’ explanation. This inference is, of course, defeasible. Four alternatives, three of which are potentially fruitful, will be identified, and it will be argued that, on balance, these alternatives should be dismissed. (shrink)

What inductive biases must be incorporated into multi-agent artificial intelligence models to get them to capture high-fidelity imitation? We think very little is needed. In the right environments, both instrumental- and ritual-stance imitation can emerge from generic learning mechanisms operating on non-deliberative decision architectures. In this view, imitation emerges from trial-and-error learning and does not require explicit deliberation.

Normativität hat in den Sozialwissenschaften noch immer etwas Anrüchiges, fast Abschreckendes. Es gibt eine lange Traditionslinie in den Sozialwissenschaften, die versucht, ihre Disziplin gegenüber normativen Argumenten „sauber“ zu halten. Das wird in der Regel damit begründet, dass im wissenschaftlichen Erkenntnisprozess Gesinnungsmotive nicht hilfreich sind und im Extremfall Ergebnisse verzerren. Befürworter normativer Sozialwissenschaften halten dagegen, dass die fehlende Thematisierung etwa von sozialen Ungleichheits- und Herrschaftsverhältnissen die Welt, so wie sie gerade ist, einmal mehr bestätigt – und das ist eben auch nicht (...) normfrei und kann es auch nicht sein, weil, so eine zentrale These des vorliegenden Bandes, Theorien notwendig mit normativen Bezügen behaftet sind. Damit ist das Spektrum der Positionen angedeutet, die in diesem Sammelband zu finden sind. Er hat einerseits das Ziel, normative Verwicklungen auch in den sozialwissenschaftlichen Ansätzen aufzuspüren, die stärker auf die Idee einer wertfreien Wissenschaft verpflichtet sind. Andererseits werden Ansätze, die explizit herrschaftskritische Positionen vertreten, auf die Plausibilität ihrer normativen Setzungen hin überprüft. Die normativen Hintergründe sozialwissenschaftlicher Theoriebildung aufzuzeigen und eine Debatte über die normativen Bezüge der Sozialwissenschaften anzuregen ist das Anliegen dieses Bandes. This paper examines two models of thinking relating to the issue of the right to die in dignity: one takes into consideration the rights and interests of the individual; the other supposes that human life is inherently valuable. I contend that preference should be given to the first model, and further assert that the second model may be justified in moral terms only as long as it does not resort to paternalism. The view that holds that certain patients are not (...) able to comprehend their own interests in a fully rational manner, and therefore ‘we’ know what is good for these patients better than ‘they’ do, is morally unjustifiable. I proceed by refuting the ‘quality of life’ argument, asserting that each person is entitled to decide for herself when it is worth living and when it is not. In this connection, a caveat will be made regarding the role of the family. (shrink)

The aims of this essay are (A) to examine the extent to which Marx, Engels and Lenin believed in revolution by peaceful means and what was their attitude towards the phenomenon of war, and (B) to reflect on the different interpretations of their writings, discerning between three schools of thought. It is argued that Marx and Engels considered violence only as an instrument of secondary importance and desirable insofar as there is no other alternative to change the system. It is (...) further contended that while they, in the course of years, adopted a more moderate position regarding the use of violence, Lenin's viewpoint radicalized as the possibility of a revolution in Russia became real. As years went by Lenin affirmed not only the use of violence but also the resort to terrorist activities. Unlike Marx and Engels he became an ardent supporter of all types of terror. (shrink)

The aim of this paper is to ponder the intricate issue of the right to die in dignity by focusing attention on the role of the patient's beloved people. I first provide critical examination of some of the arguments advanced by Ronald Dworkin. I proceed by contemplating relevant scenarios and examining three American court decisions: Saikewicz, Spring and Gray. The first case, Saikewicz, concerns a patient who had no family or other beloved people. I observe that this fact had a (...) significant bearing on the court's ruling not to provide him treatment. The second case, Spring, involves a patient whose family wanted to withhold treatment from him. I argue that we should be cautious of incidents in which the best interests of the patient's beloved people come at the expense of the best interests of the patient. Spring is an example of such a case. The third case, Gray, serves as an example whereby the best interests of the patient coincide with the best interests of her beloved people. I conclude by arguing that attention has to be given to the question of whether the patient's close-ones demonstrate a unified position in regard to the destiny of the patient. Gegenstand des Beitrags ist es, das schwierige Problem des Rechts, in Würde zu sterben, im Hinblick auf die Rolle der Personen zu überdenken, die dem Patienten nahestehen. Der Autor setzt sich zunächst kritisch mit einigen von Ronald Dworkin vorgetragenen Argumenten auseinander. Dann stellt er die relevanten Fallgestaltungen dar und untersucht drei Entscheidungen amerikanischer Gerichte: die Fälle Saikewicz, Spring und Gray. Der erste Fall, Saikewicz, betrifft einen Patienten ohne Familie oder andere ihm nahestehende Personen. Dieser Umstand hatte einen wesentlichen Einfluß auf die Entscheidung des Gerichts, von der Anordnung einer Behandlung des Patienten abzusehen. Im zweiten Fall, Spring, wünschte die Familie, daß der Patient nicht behandelt würde. Der Autor mahnt für alle die Fälle zur Vorsicht, bei denen die Umstände so beschaffen sind, daß das wohlverstandene Interesse der Angehörigen und das des Patienten kollidieren. Der Fall Spring ist ein Beispiel für eine solche Kollisionssituation. Der dritte Fall, Gray, dient als ein Beispiel, in dem sich das wohlverstandene Interesse des Patienten und das der ihm nahestehenden Personen decken. Zuletzt geht es um die Frage, ob die Angehörigen und andere dem Patienten nahestehende Personen in ihren Vorstellungen über das weitere Schicksal des Patienten übereinstimmen oder nicht. This article reviews the history of press self-regulation in Britain, from the 1947 Ross Commission to the 2012 Leveson Inquiry Commission. It considers the history of the Press Council and the Press Complaints Commission, analysing the ways they developed, their work, and how they have reached their current non-status. It is argued that the existing situation in Britain is far from satisfactory, and that the press should advance more elaborate mechanisms of self-control, establishing a new regulatory body called the Public (...) and Press Council that will be anchored in law, empowering the new regulator with greater and unprecedented authority, and equipping it with substantive sanctioning abilities. The Public and Press Council should be independent and effective, with transparent policies, processes and responsibilities. Its adjudication should be made in accordance with a written, detailed Code of Practice. (shrink)

This discussion is about the neglected concepts of trust and social responsibility on the Internet. I will discuss and explain the concepts and their implications to people and society. I then address the issue of moral and social responsibilities of ISPs and web-hosting companies. I argue that ISPs and web-hosting companies should aspire to take responsibility for content and that they should respect and abide by their own terms of conduct.

The Dutch experience has influenced the debate on euthanasia and death with dignity around the globe, especially with regard to whether physician-assisted suicide and euthanasia should be legitimized or legalized. Review of the literature reveals complex and often contradictory views about this experience. Some claim the Netherlands offers a model for the world to follow; others believe the Netherlands represents danger rather than promise, that the Dutch experience is the definitive answer to why we should not make active euthanasia and (...) physician-assisted suicide part of our lives.Given these contradictory views, fieldwork is essential to develop a fully informed opinion. Having investigated the Dutch experience for a number of years, in the summer of 1999 I went to the Netherlands to visit the major centres of medical ethics as well as some research hospitals, and to speak with leading figures in euthanasia policy and practice. This essay reports some of the main findings of my interviews and provides detailed accounts of the way in which some of the Netherlands’ leading experts perceive the policy and practice of euthanasia in their country. These accounts are quite fascinating.The discussion begins with background information on the guidelines for euthanasia. Next, explanation about the research methodology is outlined and then I discuss the interviewees’ views about the guidelines for euthanasia. I conclude by indicating that the Dutch guidelines on the policy and practice of euthanasia do not provide ample mechanisms against abuse. Virtually every guideline has been breached or violated. This finding reiterates Hendin’s finding. I recommend that the Netherlands amend its policy and remedy its troubling practice. (shrink)

The article discusses the way people wish to die, analyzing the legal situation in countries that permit either euthanasia or physician-assisted suicide. While criticizing the Dutch, Belgian and Swiss models, I argue that the Oregon model is the one with apparently little abuse. Building on the experiences of Oregon, the Netherlands, Belgium, Switzerland, and the Northern Territory of Australia, the article ends with a set of guidelines to improve the conduct of PAS.

The north-east outskirts of the agora of Thasos III. 1 : the sculptures. The seventy fragments of sculpture – mostly carved on Thasos in the local marble – published here provide a representative selection of the finds made during excavations on the north-east outskirts of the agora of Thasos. Since a protobyzantine mansion has been built with materials taken from the ruins of the nearby agora, portraits-statues and offerings are the kinds of sculpture most represented. Except for a few better (...) preserved pieces, these fragments are of mainly archaeological interest, offering many insights into the techniques of ancient sculpture at different periods, especially regarding the initial stages of the sculptors’ work, indications as to the various tools used, the practice of piecing and repairs. Les spécialistes de l’archéologie des médias défendent une conception non-linéaire de l’histoire du cinéma, en analysant la façon dont les avancées technologiques et les dispositifs concrets contribuent activement à modifier nos modes de perception. Meurtre dans un jardin anglais de Peter Greenaway constitue un exemple remarquable de « métacinéma » mettant en pratique l’archéologie des médias dans le corps même du film, par le biais de citations visuelles renvoyant à d’autres médias ou d’autres pratiques artistiques, comme la peinture de la (...) Renaissance italienne ou la peinture hollandaise. Le présent essai offre donc une analyse détaillée de Meurtre dans un jardin anglais comme archéologie du cadre cinématique. Le cadre est pour Derrida « la structure décisive de l’enjeu » en ce qu’il renvoie au parergon, marquant ainsi les limites de l’œuvre d’art. Nous nous attacherons donc à décrire les différents types de cadrages appliqués aux nombreux médias présents ou « cités » dans le film : pellicules cinématographiques, écrans, dessins de paysages, miroirs plats ou convexes, tableaux, etc. Ces différents « cadrages » nous fourniront autant de clés de lecture pour comprendre les transformations que subit un médium artistique donné quand il est « re-présenté » par un autre. Despite the recent progress in the description of the molecular mechanisms of proliferation and differentiation controls in vitro, the regulation of the homeostasis of normal stratified epithelia remains unclear in vivo. Computer simulation represents a powerful tool to investigate the complex field of cell proliferation regulation networks. It provides huge computation capabilities to test, in a dynamic in silico context, hypotheses about the many pathways and feedback loops involved in cell growth and proliferation controls.Our approach combines a model of cell (...) proliferation and a spatial representation of cells in 2D using the Voronoi graph. The cell proliferation model includes intracellular (cyclins, Cyclin Dependent Kinases - CDKs, Retinoblastoma protein - Rb, CDK inhibitors) and extracellular controls (growth and differentiation factors, integrins). The Voronoi graph associates a polygon with every cell and the set of these polygons defines the tissue architecture. Thus, the model provides a quantitative model of extracellular signals and cell motility as a function of the neighborhood during time dependent simulations. (shrink)
