After examining some of the most fundamental aspects of the general concept of ‘neuroright’ in the current discussion, this paper analyzes the concept of ‘the mental’ contained in the very first law of neurorights in the world currently under discussion in the Senate of the Republic of Chile (Bulletin 13.828-19 of the Chilean Senate). It is claimed that the lack of specificity of the target notion might not only posit difficulties for the creation of specific legal frameworks for the protection (...) of subjects from potential misuses of neurotechnologies with access to neural data, but it might also make very difficult the process of decision-taking when interpreting the law. Nas últimas décadas, discussões sobre interculturalidade efetivaram-se no cenário intelectual latino-americano, relacionando os temas mais diversos a partir de diferentes interlocutores e pensadores. Muitos desses fizeram emergir a realidade latino-americana denunciando o parasitismo colonial (Manoel Bonfim), anunciando que a Nuestra America pode libertar-se da dominação Ibérica (José Marti) quando os princípios universais como a justiça, o reconhecimento do outro e a comunicação forem porta-vozes de mudanças (Raul Fornet-Betancourt; Ricardo Salas). A educação possui papel fundamental nesse processo (Catherine Walsh; Fidel Tubino). (...) Por isso, neste artigo fruto de aulas, leituras, pesquisas e dedicação ao curso oferecido pela PUC Minas, na disciplina: Educação, Interculturalidade e Espiritualidade, temos como objetivo identificar os principais pressupostos para se pensar e desenvolver uma educação escolar, de víeis Intercultural Latino-Americana, a partir de uma metodologia qualitativa, documental e pesquisa bibliográfica desenvolvida com base em material publicado como livros, artigos periódicos e entrevistas. De que maneira este diálogo e pressupostos contribuem para a educação escolar? Nestes tempos, em que se discute novos paradigmas para educação escolar, acredita-se que a interculturalidade crítica coopera para desvelar os projetos hegemônicos. (shrink)

1964 fue un año resolutivo en el arranque del proceso aplicativo de la reforma litúrgica. Aunque estos inicios han sido ampliamente estudiados por liturgistas e historiadores del concilio, el acceso a nuevas fuentes documentales pone a disposición de los investigadores un material que sirve para completar, complementar, enriquecer y abrir nuevas pistas a los trabajos realizados hasta la fecha. Es el caso del archivo personal de Jorge Medina, en el que se encuentran catalogados diversos documentos, los que contienen material relativo, (...) tanto al complejo trayecto de la actuación de la reforma litúrgica como a la primera recepción y aplicación de la constitución Sacrosanctum concilium en Chile. A la luz de esta documentación inédita, este trabajo, que tiene como telón de fondo la publicación del motu proprio Sacram Liturgiam, estudia las propuestas que, en materia litúrgica, el episcopado chileno elevó a la santa sede para poner en marcha la reforma en el país. Many believe the existence of a moral right to some good should lead to recognition of a corresponding legal right to that good. If, for instance, there is a moral right to healthcare, it is natural to believe countries should recognize a legal right to healthcare. This article demonstrates that justifying legal rights to healthcare is more difficult than many assume. The existence of a moral right is insufficient to justify recognition of a corresponding justiciable constitutional right. Further conditions on (...) when it is appropriate to recognize constitutional rights are rarely satisfied in the healthcare case. And focusing on aspirational or statutory rights presents costs for those seeking to justify legal rights on the basis of corresponding moral ones while maintaining empirical challenges for justifying constitutional rights. This suggests movement from a moral right to a corresponding legal one is far from straightforward and justifies examining alternative means of realizing moral socio‐economic rights such as the proposed moral right to healthcare. Edward Nieznański developed two logical systems to deal with the problem of evil and to refute religious determinism. However, when formalized in first-order modal logic, two axioms of each system contradict one another, revealing that there is an underlying minimal set of axioms enough to settle the questions. In this article, we develop this minimal system, called N3, which is based on Nieznański’s contribution. The purpose of N3 is to solve the logical problem of evil through the defeat of a (...) version of religious determinism. On the one hand, these questions are also addressed by Nieznański’s systems, but, on the other hand, they are obtained in N3 with fewer assumptions. Our approach can be considered a case of logic of religion, that is, of logic applied to religious discourse, as proposed by Józef Maria Bocheński; in this particular case, it is a discourse in theodicy, which is situated in the context of the philosophy of religion. Robert Kilwardby on the Human Soul examines Kilwardby’s role in conciliating Aristotelian and Augustinian views on the soul, soul-body relation, and cognition.

Reification, fetishism, alienation, mastery, and control – these are some of the key concepts of modernity that have been battered and beaten by postmoderns and nonmoderns alike, with Bruno Latour, a nonmodern, discarding them most recently. Critical of this approach, which creates a rift between moderns and nonmoderns, the author engages in dialogue with modern thinkers – particularly Peter Berger, Thomas Luckmann and Stanley Pullberg – with a view to recycling and redefining the concept of reification from a nonmodern perspective. (...) Marxian scholars associate reification with an attitude of detachment and passivity. Drawing on two years of ethnographic fieldwork in a Luvale-speaking region of northwest Zambia, Africa, the author seeks to convert the negative and asymmetrical Marxian reading of reification, which places subjects above objects, to a positive symmetry. Marx explained the capitalist economy through the lens of religion. Reversing the direction of symmetrical comparison, the author considers the northwestern Zambian universe of ancestors and their different mahamba manifestations in the form of spiritual beings, diseased bodies and material objects through the lens of Marxian concepts, mainly reification and fetishism. Three aspects of reification understood as a human universal come to light: first, reification and animation entail each other both in the realms of materiality (human bodies and material objects) and immateriality (concepts and spirits), being best perceived as a form of fetishism. Reifacts are fetishes and fetishes are reifacts. Second, because fetishes are animated and do things, reification is a form of engagement with the world, a means to action and a tool for transformation. Third and last, and without contradiction, reification entails engagement and detachment, action and withdrawal, control and surrender. There is much to gain from recycling the old concept of reification. In a non-partisan symmetrical perspective, the redefinition of reification as fetishism yields a new, positive understanding of the place of material and immaterial things in social life and the ways in which we humans apprehend the world and implicate those things in our projects and struggles. O artigo aborda a relação entre crianças de terreiro e os seus etnosaberes produzidos no universo dos cosmosentidos do candomblé. Enquanto religião de matriz africana onde a biointeração é um dos princípios basilares, o candomblé e seu universo apresentam uma extensa gama de saberes tradicionais que são construídos e vividos no cotidiano. Compreender como as crianças de terreiro produzem seus conhecimentos traz consigo o intento de pensar a infância e seu poder criativo através de uma afroperspectiva onde a multidimensionalidade, multirreferencialidade (...) e a polissemia do saber se mostram a todo momento, nas ideias nascentes vividas, por exemplo, quando as crianças exploram o território do terreiro com a astúcia de quem conhece o que nós, adultas e adultos, não conhecemos. Na produção desenhística das crianças e nas suas narrativas é possível aprender sobre etnosaberes, cultura e ancestralidade através de itans, orikis e neolinguagens próprias dos seus universos simbólicos onde imagens e rituais didáticos unem teoria e prática, sensível e racional. Ademais, as crianças apresentam um caleidoscópio inventivo de saberes como guias para outros caminhos e possibilidades educacionais a luz das relações étnicas. (shrink)

This text presents some elective affinities and differences between the works of two powerful media theoreticians of the 20th century: Water Benjamin and Vilém Flusser. Both authors have shaped original perspectives on the relationship between art and technology. While holding a special place for the theory of photography, both have reflected upon the history of writing and its transformations during Modernity. In addition, both Benjamin and Flusser dedicated important texts to the question of translation and the philosophy of language. The usual distinction in quantum mechanics between pure states and mixtures is shown not to be independent of the interpretation adopted. Thus, in a causal theory, certain states should be regarded as sharing the nature of both pure states and mixtures and, as a result, important questions in the theory of measurement must be considered in a different light.

What is childhood? This basic but not less intriguing question guides the present philosophical exercise. However, along the journey, that first question inevitably leads us to some other indispensable queries: What are we able to know about children through the way they behave? Is it ‘what’ they are indeed? If behaviours show us some things, cannot they, at the same time, hide others from us? What is it they are showing or hiding? What is at stake here? Returning to our (...) first and guiding question and paying a little more attention to it, we may realise a very important detail there, which consists in just two letters: the use of the verb be. Most of the times, we ask ‘What is childhood?’ and, a moment later, we turn away and forget what we were primarily looking for. Completely lost and without even noticing it, we eagerly begin our saga in order to produce theories and more theories about childhood. But what have become of the children themselves? Now they are nothing more than objects of our systematic and empirical scientific researches. We have been treating them as machines of behaviour and – with the help of cutting-edge technology – products of our manipulation. This way, we abandon who they are. We ignore their being. If we are truly willing to help them discover their ownmost potentiality-for-being (eigenstes Seinkönnen), that is, their possible authenticity (Eigentlichkeit), then we must face the challenge of receiving them as the Dasein they are. O presente trabalho tem por finalidade analisar, a partir do livro V da obra Ethica Nicomachea, se a justiça poderia ser tomada como um meio que irá auxiliar os cidadãos a desenvolver plenamente as suas virtudes. Buscar-se-á fundamentar que é através da justiça que os bons cidadãos seriam formados, bem como o bom caráter seria cultivado. Analisar-se-á, também, ainda que minimamente, o que Aristóteles entende de fato por justiça, de que o justo seria dar a cada um o que lhe (...) é devido, o que merece, haja vista que essa afirmação traz consigo um peso muito grande, pois nos faz indagar sobre o que seria o devido de cada indivíduo, bem como quais seriam as bases relevantes do mérito. Isto é, se o justo é dar a cada um o que lhe é devido, cabe a nós nos perguntarmos de que forma e critério seria usado na distribuição. De certa forma, ao raciocinarmos sobre justiça e direitos, consequentemente temos de raciocinar sobre a finalidade, o objetivo, o telos das atividades que circundam a vida social na Pólis. Buscar-se-á discutir sobre os temas apresentados, porém não se tem por finalidade propor medidas para pôr um fim na discussão. (shrink)

Cybercrime has increased significantly, recently, as a result of both individual and group criminal practice, and is now a threat to individuals, organisations, and democratic systems worldwide. However, cybercrime raises two main challenges for legal systems: firstly, because cybercriminals operate online, cybercrime spans beyond the boundaries of specific jurisdictions, which constrains the operation of the police and, subsequently, the conviction of the perpetrators; secondly, since cybercriminals can operate from anywhere in the world, law enforcement agencies struggle to identify the origin (...) of the communications, especially when obfuscation strategies are used, e.g. dark web fora. Nevertheless, cybercriminals inherently use language to communicate, so the linguistic analysis of suspect communications is particularly helpful in deterring cybercriminal practice. This article reports the potential of forensic translation in the fight against cybercrime. Although the term ‘forensic translation’ is typically understood as a synonym of ‘legal translation’, it is argued that the implications of forensic translation span beyond those of legal translation, to include analyses of language rights, of the right to interpretation and translation in legal procedures (in the EU), or even investigative and intelligence practices. Translation is a pervasive activity that is conducted, not only by professional translators, but also by lay speakers of language, often using machine translation systems. The ease of use of the latter makes it particularly suitable for cross-border criminal (e.g. extortion or fraud) and cybercriminal communications (e.g. cybertrespass, cyberfraud, cyberpiracy, cyberporn or child online porn, cyberviolence or cyberstalking). This article presents the results of the analysis of cybercriminal communications from a forensic translation perspective. It demonstrates that translation is frequently used to spread cybercriminal communications, and that reverse-engineering the translational procedure will assist law enforcement agencies in narrowing down their pool of suspects and, consequently, deter cybercriminal threats. In recent years, images of climate catastrophe have become commonplace. However, Black visions of the confluence of the Anthropocene and the apocalypse have been largely ignored. As we argue in this article, Black social thought offers crucial resources for drawing out the implicit exclusions of dominant representations of climate breakdown and developing an alternative account of the planet’s future. By reading a range of critical race theorists, from Frederick Douglass and W. E. B. Du Bois to Octavia Butler and Ta-Nehisi (...) Coates, we propose a rethinking of the climate apocalypse. The African American theoretical and cultural tradition elaborates an image of the end of the world that emphasises the non-revelatory nature of climate catastrophe, warns against associating collapse with rebirth, and articulates a mode of maroon survivalism in which the apocalypse is an event to be endured and escaped rather than fatalistically expected or infinitely delayed. ABSTRACT The presence of truth and honesty is a permanent demand, and becomes vital the more committed and intimate a relationship is. Medical practice is relevant to this discussion when one questions whether or not a physician should always tell their patient the truth in the face of a progressive or potentially fatal disease, regarding the diagnosis, outcome, therapy and evolution of the specific disease. From this discussion we aim, with the present report, to look at the truth applicable to (...) the patient‐physician relationship, and its ethical and moral implications; and also to look at where the Brazilian Code of Medical Ethics (BCME) and the medical literature stand regarding this issue. One concludes that there are only two moments not to tell a patient the truth: when the patient does not want to be informed, and when the truth could be iatrogenic. The question now is, when would the truth be iatrogenic? Physicians, in our opinion, would not be able to judge solitarily when the truth might be deleterious to their patient. Alternatively, we propose the appointment of a multidisciplinary commission to help the doctor with such a decision. (shrink)

This article seeks to discuss Martin Heidegger's philosophy regarding the theme of presence and freedom from the work Being and Time. The presentation of our research takes place in order to understand the theme of the meaning of being and its ontological structure in order to apprehend the question of being as an opening of a comprehensive power-being. At a later time, we resumed the ontological structure of being from the horizon of temporality, which is demonstrated as the horizon in (...) which the meaning of being takes place. Next, we deal with the freedom of being in the world, which is presence, as a free and responsible power-being that assumes its project of being in its own way of being, being-for-death. The free presence will show itself as the one that assumes its own possibility and takes responsibility for its project of being. (shrink)

Defendemos que o recurso à metafísica é inevitável para a pesquisa científica e a elaboração de teorias e modelos. Estes devem partir de pressupostos metafísicos acerca da natureza da realidade e do conhecimento. Primeiro, apresentamos a metafísica, tanto em sentido histórico quanto filosófico. Em seguida, oferecemos uma definição breve, mas clara, do que entendemos por metafísica no escopo desse trabalho. Por último, recorremos a diversos filósofos naturais (...) e físicos para discorrer sobre o tema da inevitabilidade da metafísica nas ciências naturais, sobretudo na física teórica. (shrink)

A questão que se tenta construir neste texto é a da convergência entre filosofia, história da filosofia e formação. Tal pergunta se desdobra primeiramente na elucidação das relações entre história e historicidade da filosofia, que remonta à constatação óbvia, mas nem sempre lembrada, de que o fundamento da história da filosofia é o caráter histórico da própria filosofia. A idéia de formação está presente em toda filosofia, já que, antes de ser sistema ou concepção cristalizada da realidade, cada filosofia é (...) sempre um exercício de síntese das possibilidades e das circunstâncias da vida humana, inclusive sob o aspecto do trabalho da reflexão. Nesse sentido, o texto remete a algumas idéias de Bergson acerca de formação e processo, e à noção sartriana de práxis como formação e superação contínua dos momentos estruturais do curso da história. Assim compreendida, a relação entre história da filosofia e filosofia contém inevitavelmente o compromisso com a atualidade, isto é, com a formação atual do pensamento. (shrink)

O presente artigo tem como objetivo apontar a metafísica da época das imagens de mundo em Heidegger, sua consumação no mundo tecnológico e sua possível superação através da experiência do pensamento afinado na serenidade enquanto relação do homem com a Região do ser. Observar-se que a época das imagens de mundo se fundamenta na noção de sujeito, que é a ascensão moderna do homem ao posto de subjectum da realidade. Enquanto subjectum, o homem representa o mundo como objeto passível de (...) análise, pesquisa, cálculo e exploração. Além disso, vê-se como essa concepção de mundo se consuma na época dominada pela tecnologia, mais precisamente pela essência da técnica. Nesta época, o homem, enquanto subjectum, tem disponibilizado tão demasiadamente o mundo como objeto, que ele, como parte do mundo, tem sido também objetificado. Assim, o homem é dominado pela essência técnica, onde sua essência corre um grande perigo, que é o de perder de vista outras formas de compreender o mundo e o serque não seja Gestell. Por isso, é preciso haver uma resistência ao mundo tecnológico, e esta não pode se dar à maneira humanista, já que o homem está inserido em um destino que não responde mais à sua vontade. A resistência contra a essência da técnica deve advir da experiência do pensamento, a partir da meditação da verdade do ser, que se revela na sua Região, com a qual o homem somente se relaciona genuinamente na serenidade. Na serenidade, o homem enfim poderá visualizar os objetos tecnológicos sem ser dominado por eles, deixando-os repousarem em si mesmos, em virtude do essencial que se abre ao pensamento. (shrink)

The relationship between kinetochores and nuclear pore complexes (NPCs) is intimate but poorly understood. Several NPC components and associated proteins are relocated to mitotic kinetochores to assist in different activities that ensure faithful chromosome segregation. Such is the case of the Mad1‐c‐Mad2 complex, the catalytic core of the spindle assembly checkpoint (SAC), a surveillance pathway that delays anaphase until all kinetochores are attached to spindle microtubules. Mad1‐c‐Mad2 is recruited to discrete domains of unattached kinetochores from where it promotes the rate‐limiting (...) step in the assembly of anaphase‐inhibitory complexes. SAC proficiency further requires Mad1‐c‐Mad2 to be anchored at NPCs during interphase. However, the mechanistic relevance of this arrangement for SAC function remains ill‐defined. Recent studies uncover the molecular underpinnings that coordinate the release of Mad1‐c‐Mad2 from NPCs with its prompt recruitment to kinetochores. Here, current knowledge on Mad1‐c‐Mad2 function and spatiotemporal regulation is reviewed and the critical questions that remain unanswered are highlighted. (shrink)

We present a categorical/denotational semantics for the Lambek Syntactic Calculus , indeed for a λlD-typed version Curry-Howard isomorphic to it. The main novelty of our approach is an abstract noncommutative construction with right and left adjoints, called sequential product. It is defined through a hierarchical structure of categories reflecting the implicit permission to sequence expressions and the inductive construction of compound expressions. We claim that Lambek's noncommutative product corresponds to a noncommutative bi-endofunctor into a category, which encloses all categories of (...) such hierarchical structure. A soundness theorem for LSC is shown with respect to this semantical framework. (shrink)

O objetivo do artigo consiste em analisar, a partir dos parágrafos 34 a 38 da obra Kant e o problema da metafísica e segundo a exegese heideggeriana, o sentido e pertinência da inserção da problemática antropológica anteposta às três questões fundamentais expostas na Crítica da razão pura. Heidegger converte um rol exaustivo, delimitado pelas três perguntas, em um rol exemplificado, ao colocar a indagação da antropologia filosófica como pressuposto e consequência necessária das três interrogações kantianas. Heidegger recorre ao conceito de (...) finitude, para validar a importância e para fundamentar a primazia da questão antropológica sobre as demais: a interrogação “que é o homem” transforma-se na primeira que dispensa, a partir de si, as três restantes. Catulo (século I a.C.), o primeiro grande autor lírico romano, traz a elegia grega com temática variada, inclusive amorosa. Assim a poesia elegíaca latina desenvolve-se e ganha contorno de um gênero autônomo em Roma, com temática própria, a elegia erótica romana. O tema do amor passa a ser fundamental, nos autores do século de Augusto (século I a.C.), Tibulo, Propércio e Ovídio, que escrevem livros inteiros para uma amada. Contudo, unida à temática do amor encontramos também o tema morte, constante (...) em Propércio e encontrado também em Ovídio na esfera mítica. Através de fragmentos de poemas dos autores elegíacos, veremos como os temas amor e morte encontram-se unidos na elegia latina. (shrink)

A EDUCAÇÃO PÚBLICA COMO INSTRUMENTO PARA O DESENVOLVIMENTO SOCIAL E ECONÔMICO SUSTENTÁVEL DO BRASIL.

The main concern of this paper is the justification of the axioms of Zermelo-Fraenkel set theory, either as true statements about a concept of set or, alternatively, as true statements about abstract objects . I want to argue here that, in either case, set theory can be seen as a body of knowledge largely built on intuitive foundations . I call this inquiry “phenomenological” for it approaches its subject from the perspective of the intentional acts that originate sets as doubly (...) dependent objects . Such an inquiry, I believe, brings to light the essential characters of sets as objects or, alternatively, the concept of set, which the axioms of the theory express. (shrink)
