Der Streit um die Prinzipien der Theorienentwicklung hat in den Jahren seit dem Erscheinen von TH. S. KUHNS "Die Struktur wissen schaftlicher Revolutionen" mannigfache und lebhafte AufSerungen pro und contra hervorgerufen. Die Gegenposition wird im wesent lichen durch die Namen POPPER und LAKATOS charakterisiert. Die Kontroverse erweist sich als eine solche zwischen synchronischer und diachronischer, zwischen systematischer und historischer Betrach tungsweise. 1st die Entwicklung der Wissenschaften, wie man es nach KUHN glauben kann, in entscheidendem MafSe aufSeren Einfliissen und Zufalligkeiten ausgesetzt, (...) oder gibt es nicht doch rationale, rein wissenschaftsimmanente Kriterien, auf Grund derer eine Entwicklung im Sinne eines Fortschrittes zu immer besseren, richtigeren und lei stungsfahigeren Theorien moglich ist? Eine wesentliche Schwierigkeit, um dabei weiterzukommen, besteht darin, dafS es keine Moglichkeit zu geben scheint, eine Theorie zu bewerten, zu entscheiden, welche von zwei Theorien "wahrscheinlicher, richtiger, besser oder leistungs fahiger" ist. Wenn es geiange, eine numerische Bewertung von Hypothesen und Theorien in dieser Richtung zu finden, so ware damit auch ein Weg gewiesen, die Entwicklung der Theorien nicht nur zu rekon struieren, sondern vielleicht auch zu lei ten. Die Bewertung einer Theorie im Sinne ihrer Richtigkeit ist bisher nicht gelungen. Wenn POPPER, insbesondere in seinen spaten Arbeiten ("Objective Knowl edge"), die Auffassung vertritt, dafS die Entwicklung der Wissen schaften im Sinne einer immer grofSeren Wahrheitsahnlichkeit von statten gehe, so ist das bei ihm ein reiner Glaube, der auf Grund seines Modells von Versuch und Irrtum postuliert wird. The meaning of the word shaman (of Tungus origin) has become obscured by numerous, increasingly different interpretations. The term has also been applied to practitioners who live outside Siberia, and are actually called by different names in their respective countries: bomoh in Malaysia, ma khi in Thailand, and tany-di in Singapore.Because I did not want to rely on secondary sources, I went to Southeast Asia to find contemporary shamans. Having started my research in 1960 I was able to witness, over (...) a thirty-one year period (during visits lasting from several months to a year), the continuation of shamanic traditions among different groups living in multiethnic and multi-religious societies. First, I discuss the importance of recognizing different states of consciousness. Knowing how these states differ from each other and recognizing their specific qualities determines their use, increases our self‐knowledge, balances our behavior and adjusts our course of action. Second, 1 report on workshops conducted in the United States, Russia, Lithuania, and Estonia. The examples illustrate the nature of material retrieved during different states of consciousness. The Logic of Liberal Rights uses basic logic to develop a model of argument presupposed in all disputes about civil rights and liberties. No prior training in logic is required, as each step is explained. This analysis does not merely apply general logic to legal arguments but is also specifically tailored to the issues of civil rights and liberties. It shows that all arguments about civil rights and liberties presuppose one fixed structure and that there can be no original argument (...) in rights disputes, except within the confines of that structure. Concepts arising in disputes about rights, like 'liberal' or 'democratic', are not mere abstractions but have a fixed and precise character. This book integrates themes in legal theory, political science and moral philosophy, as well as the philosophy of logic and language. For the advanced scholar, the book provides a model presupposed by leading theoretical schools . For the student it provides a systematic theory of civil rights and liberties. Examples are drawn from the European Convention in Human Rights but no special knowledge of the Convention is assumed, as the issues analysed arise throughout the world. BackgroundDespite its ubiquity, it is often not clear what organizations and services mean by well-being. Visual impairment has been associated with poorer well-being and well-being has become a key outcome for support and services for adults living with VI. A shared understanding of what well-being means is therefore essential to enable assessment of well-being and cross-service provision of well-being support.ObjectivesTo provide an overview of the ways in which well-being has been conceptualized in research relating to adults living with VI.Eligibility criteriaArticles (...) were included in the review if the article discussed well-being in the context of adults living with VI, was available in English and as a full text.Data sourcesA systematic search using search terms relating to VI and well-being was conducted in EBSCOHost and Ovid.ChartingA team of three reviewers screened titles, abstracts and full-texts articles and extracted data. Ambiguous articles were referred to the research group and discussed.ResultsOf 10,662 articles identified in the search, 249 were included in the review. These referred to 38 types of well-being. The most common types were general well-being emotional well-being and psychological well-being. Most articles referred to one type only, with a maximum of 9 listed in one article. A large number of articles did not clearly define well-being. A wide range of indicators of well-being related to the domains of hedonia, mood, positive and negative affect, quality of life, mental health, eudaimonia, self/identity, health, psychological reactions to disability and health problems, functioning, social functioning and environment, were extracted, many of which were used just once.ConclusionsThere remains a lack of consensus on how well-being is conceptualized and assessed in the context of adult VI. A standardized multi-domain approach derived with input from adults with VI and practitioners working with them is required to enable comparison of findings and cross-organizational provision of support. Over the years, researchers of numerous fields have suggested different criteria and conventions for the transcription of oral samples. Current practice by workers who carry out transcriptions in the Spanish legal system is not standardized and does not follow any general criteria. Indeed, the standards followed by professionals in this context are characterized by their heterogeneity. This contribution highlights the benefits of adhering to a particular set of criteria and conventions agreed upon by 115 transcribers to make the transcription process (...) more efficient, improve its comprehension and add to the value of transcriptions as key documents within the legal system that may have a direct impact on the right of the parties involved. Legal scholars’ interest in Shakespeare has often focused on conventional legal rules and procedures, such as those of The Merchant of Venice or Measure for Measure. Those plays certainly reveal systemic injustice, but within stable, prosperous societies, which enjoy a generally well-functioning legal order. In contrast, Shakespeare's first historical tetralogy explores the conditions for the very possibility of a legal system, in terms not unlike those described by Hobbes a half-century later. The first tetralogy's deeply collapsed, quasi-anarchic society lacks any (...) functioning legal regime. Its power politics are not, as in many of Shakespeare's other plays, merely latent, lurking beneath the patina of an otherwise functioning legal order. They pervade all of society. Dissenting from a long critical tradition, this article suggests that the figure of Henry VI does not merely represent antiquated medievalism or inept rule. Through Henry's constant recourse to legal process, arbitration and anti-militarism, the first tetralogy goes beyond questions about how to establish a functioning legal order. This article explores the extent to which the decision to invade Iraq in 2003 coheres with the normative precepts of liberalism as an international political theory. Beginning with a Lockean liberal theory of the state, this article first examines the evolution of international liberalism in order to identify the fundamental normative postulates of liberal theory as it pertains to international relations, especially regarding the use of military force. The article then advances two interrelated arguments: First, that the underpinnings of the (...) decision to invade Iraq embodied in the Bush Doctrine draw heavily from the liberal tradition, though still depart from it in important ways. Second, that the Bush Doctrine as manifested in the Iraq war reflects in many ways the liberal thinking that prevailed during the interwar years and is therefore susceptible to a similar charge of ‘utopianism’ that was leveled against interwar liberalism by E. H. Carr in his Twenty Years' Crisis. (shrink)

The trans-jurisdictional discourse on criminal justice is often hampered by mutual misunderstandings. The translation of legal concepts from English into other languages and vice versa is subject to ambiguity and potential error: the same term may assume different meanings in different legal contexts. More importantly, legal systems may choose differing theoretical or policy approaches to resolving the same issues, which sometimes – but not always – lead to similar outcomes. Demgegenüber wird in diesem Buch die Überzeugung vertreten, dass es gewinnbringend ist, die spezifischen Kompetenzen aus der Kultursoziologie und Populärkulturforschung, aus der Theorie des Kulturmanagements und der Medienkultur sowie aus der Kulturphilosophie zusammenzubringen, um zu (...) zeigen, dass es trotz und gleichsam unterhalb der notorischen Vieldeutigkeit des Wortes „Kultur“ einen gemeinsamen Sachzusammenhang namens Kultur gibt, von dem die einzelnen Fachdisziplinen jeweils bestimmte Faktoren in den Blick nehmen und kraft ihrer eigenen Methoden erhellen. The development of personal technologies has recently shifted from devices that seek to capture user attention to those that aim to improve user well-being. Digital wellness technologies use the same attractive qualities of other persuasive apps to motivate users towards behaviors that are personally and socially valuable, such as exercise, wealth-management, and meaningful communication. While these aims are certainly an improvement over the market-driven motivations of earlier technologies, they retain their predecessors’ focus on influencing user behavior as a primary metric (...) of success. Digital wellness technologies are still persuasive technologies, and they do not evade concerns over whether their influence on users is ethically justified. In this paper, we describe several ethical frameworks with which to assess the justification of digital wellness technologies’ influence on users. We propose that while some technologies help users to complete tasks and satisfy immediate preferences, other technologies encourage users to reflect on the values underlying their habits and teach them to evaluate their lives’ competing demands. While the former approach to digital wellness technology is not unethical, we propose that the latter approach is more likely to lead to skillful user engagement with technology. (shrink)

Given the ubiquity and centrality of social and relational influences to the human experience, our conception of self-governance must adequately account for these external influences. The inclusion of socio-historical, externalist considerations into more traditional internalist accounts of autonomy has been an important feature of the debate over personal autonomy in recent years. But the relevant socio-temporal dynamics of autonomy are not only historical in nature. There are also important, and under-examined, future-oriented questions about how we retain autonomy while incorporating new (...) values into the existing set that guides our interaction with the world. In this paper, we examine these questions from two complementary perspectives: philosophy and neuroscience. After contextualizing the philosophical debate, we show the importance to theories of autonomous agency of the capacity to appropriately adapt our values and beliefs, in light of relevant experiences and evidence, to changing circumstances. We present a plausible philosophical account of this process, which we claim is generally applicable to theories about the nature of autonomy, both internalist and externalist alike. We then evaluate this account by providing a model for how the incorporation of values might occur in the brain; one that is inspired by recent theoretical and empirical advances in our understanding of the neural processes by which our beliefs are updated by new information. Finally, we synthesize these two perspectives and discuss how the neurobiology might inform the philosophical discussion. (shrink)

Transcranial direct current stimulation (tDCS), a simple means of brain stimulation, possesses a trifecta of appealing features: it is relatively safe, relatively inexpensive and relatively effective. It is also relatively easy to obtain a device and the do-it-yourself (DIY) community has become galvanised by reports that tDCS can be used as an all-purpose cognitive enhancer. We provide practical recommendations designed to guide balanced discourse, propagate norms of safe use and stimulate dialogue between the DIY community and regulatory authorities. We call (...) on all stakeholders—regulators, scientists and the DIY community—to share in crafting policy proposals that ensure public safety while supporting DIY innovation. (shrink)

Nancy Cartwright relies upon an inference pattern known as inference to the best causal explanation (IBCE) to support a limited form of entity realism, according to which we are warranted in believing in entities that purportively cause observable effects. IBCE, as usually understood, is valid, even though all other forms of inference to the best explanation (IBE) are usually understood to be invalid. We argue that IBCE and IBE are in the same boat with respect to their ability to support (...) realist conclusions. Either rule can be interpreted as valid, this is a matter of semantic convention. However, doing so deprives the rule of the empirical content the realist needs, requiring the realist to find independent warrant for a strong (theoretical or causal) premise. We then examine the proposed means of obtaining this warrant, and find them as inadequate in the case of IBCE as they are in the case of IBE. (shrink)

Parkinson´s disease (PD) is a neurodegenerative disorder characterized by motor symptoms following dopaminergic depletion in the substantia nigra. Besides motor impairments however, several non-motor detriments can have the potential to considerably impact subjectively perceived quality of life in patients. Particularly emotion recognition of facial expressions has been shown to be affected in PD, and especially the perception of negative emotions like fear, anger or disgust is impaired. While emotion processing generally refers to automatic implicit as well as conscious explicit processing, (...) the focus of most previous studies in PD was on explicit recognition of emotions only, while largely ignoring implicit processing deficits. Deep brain stimulation of the subthalamic nucleus (STN-DBS) is widely accepted as therapeutic measure in the treatment of PD and has been shown to advantageously influence motor problems. Among various concomitant non-motor effects of STN-DBS, modulation of facial emotion recognition under subthalamic stimulation has been investigated in previous studies with rather heterogeneous results. While there seems to be consensus regarding the processing of disgust which significantly deteriorates under STN stimulation, findings concerning emotions like fear or happiness report heterogeneous data and seem to depend on various experimental settings and measurements. In the present review, we summarized previous investigations focusing on STN-DBS influence on recognition of facial emotional expressions in patients suffering from PD. In a first step, we provide a synopsis of disturbances and problems in facial emotion processing observed in patients with PD. Secondly, we present findings of STN-DBS influence on facial emotion recognition and especially highlight different impacts of stimulation on implicit and explicit emotional processing. (shrink)

Although the use of arbitration has become commonplace in the organizational world, the ethical issues surrounding arbitration have never been fully explored. The paper reviews ethical issues in arbitration, particularly in terms of forensic bias parallels, that may affect decision-making and make the arbitrator''s decision questionable. Finally, the maintenance of fairness in the arbitration process, and the importance of an ethically acceptable system of organizational justice are also discussed.

Advances in psychology and neuroscience have elucidated the social aspects of human agency, leading to a broad shift in our thinking about fundamental concepts such as autonomy and responsibility. Here, we address a critical aspect of this inquiry by investigating how people consider the socio-relational nature of their own agency, particularly the influence of others on their perceived control over their decisions and actions. Specifically, in a series of studies using contrastive vignettes, we examine public attitudes about when external influences (...) on everyday decisions are perceived as " undue " – that is, as undermining the control conditions for these decisions to be considered autonomous – vs. when they are perceived as appropriate and even supportive of autonomous decision-making. We found that the influence of preauthorized agents – individuals and institutions with whom we share a worldview – was judged to be less undue than non-preauthorized agents, even after controlling for the familiarity of the agent. These effects persisted irrespective of the extent to which respondents identified as communitarian or individualistic, and were consistent across two distinct scenarios. We also found that external influences that were rational were perceived as less undue than those that were arational. Our study opens new avenues of inquiry into the " folk conception " of autonomy, and we discuss the implications of our findings for the ethics of public policies designed to influence decisions and for information sharing in social networks. In this commentary on an article by Jennifer Blumenthal-Barby (AJOB 16:5-15, 2016), we discuss how external influences on decisions affect personal autonomy. Specifically, we introduce the idea of “pre-authorization” as an evaluative stance by which an individual gives a certain agent preferential access to influencing her decision-making processes. Influences arising from pre-authorized agents may then be seen as promoting, rather than infringing upon, autonomy. While the idea that an external influence can be autonomy-promoting may be inconsistent with individualistic conceptions of (...) autonomy, it aligns well with more relational conceptions that recognize the social milieu in which decisions are made. We suggest that pre-authorization provides a framework for thinking about how relational accounts of autonomy might work mechanistically. (shrink)
