It has been argued in Dawid that physicists at times generate substantial trust in an empirically unconfirmed theory based on observations that lie beyond the theory’s intended domain. A crucial role in the reconstruction of this argument of “non-empirical confirmation” is played by limitations to scientific underdetermination. The present paper discusses the question as to how generic the role of limitations to scientific underdetermination really is. It is argued that assessing such limitations is essential for generating trust in any theory’s (...) predictions, be it empirically confirmed or not. The emerging view suggests that empirical and non-empirical confirmation are more closely related to each other than one may expect at first glance. (shrink)

If we make the basic assumption that the components of a proposition have reference on the model of proper name and bearer, we face the problem of distinguishing the proposition from a mere list' of names. We neutralize the problem posed by that assumption of we first of all follow Wiggins and distinguish, in every predicate, a strictly predicative element (the copula), and a strictly non-predicative conceptual component (available to be quantified over). If we further allow the copula itself to (...) conform to the basic assumption, a regress ( Bradley's regress') arises: the referent of the copula will be instantiation, the instantiation of instantiation etc. To avert the regress, Wiggins simply legislates that the basic assumption is to fail for the copula. But we are entitled to regard the regress as constitution not a difficulty, but the solution: the infinitism it imports (capturable in a finitistic theory of meaning) is just what the unity of the proposition "is". Recent scientific approaches to aesthetics include evolutionary theories about the origin of art behavior, psychological investigations into human aesthetic experience and preferences, and neurophysiological explorations of the mechanisms underlying art experience. Critics of these approaches argue that they are ultimately irrelevant to a philosophical aesthetics because they cannot help us understand the distinctive conceptual basis and normativity of our art experience. This criticism may seem plausible given the piecemeal nature of these scientific approaches, but a more comprehensive naturalistic framework can (...) help us understand the conceptual basis and normativity of art. In particular, the ecology of art, an understanding of how individuals interact within particular environments, can help us understand the engineered art niches in which we create and experience art. Each niche is associated with a particular deme, or set of individuals that interact within that niche, and a set of cognitive, epistemic, and pedagogical technologies that form the conceptual basis of a niche-dependent normativity. This is to be contrasted with the niche-independent normativity revealed by many of the scientific approaches. This framework, and the conflicting streams of normativity it reveals, allows us to better understand conflicts in normativity and the implausibility of unequivocal and universal normative principles. This article examines the flaw in the libertarian conception of the right to property. It argues that libertarians fail to recognize that, in a settled society, the right to amass property must be qualified and limited by the right of all people - including those without property - to have access to sufficient property for a satisfactory life.

In this essay I argue that the ethical and political position known as libertarianism is logically incoherent and, as such, cannot serve as a sound basis for either political theory or public policy. Given that the libertarian position is frequently used to provide the rationale for many of the economic (if not the social) policies of the right, a recognition of this incoherence is especially relevant to us today.

It is a pleasure to be a part of such great intellectual company in discussing Professor Stalnaker's very rich and insightful book. It is practically impossible not to be impressed by Stalnaker's breadth of knowledge, deep understanding of early Chinese texts, and keen observations about how the early Chinese philosophers offer intellectual resources still very much relevant to us today. My comments will focus on the relationship between skill and virtue. This article utilises Luhmann's functional analysis to investigate the role played by legal argumentation within the legal system. Luhmann's sociological observations on this subject suggest an alternative to jurisprudential approaches that understand legal arguments and consequent decisions in terms of the relative strengths of the justifications offered in their support. His account examines the role played by legal argumentation in allowing the legal system to evolve in response to society's increasing complexity. The concepts he employs to analyse this evolutionary capacity (...) of law, developed from their origins in information theory, are redundancy and variety. Beginning with the work of Dworkin the article opens up Luhmann's analysis to consider how legal argumentation operates both as a grounded form of communication, capable of identifying weak or unsustainable interpretations of legal texts, and a mechanism for evolving law in the direction of increasing complexity. This paper challenges two recent interpretations: one in terms of perceived resemblance, the other in terms of imagining seeing. One, in terms of six features of depiction, sets an explanatory task. The other, in terms of the experience to which depiction gives rise, promises to meet that need. Elsewhere I have offered an account of this experience that allows this promise to be fulfilled. I sketch that view, and defend it against Wollheim's claim that it cannot meet certain demands on a satisfactory account. I then turn to Wollheim's own view, arguing that it suffers from crucial obscurities. The notion of ‘bipolar’ or ‘second‐personal’ normativity is often illustrated by such situations as that of one person addressing a complaint to another, or asserting some right, or claiming some authority. This paper argues that the presence of speech acts of various kinds in the development of the idea of the ‘second‐personal’ is not accidental. Through development of a notion of ‘illocutionary authority’ I seek to show a role for the ‘second‐personal’ in ordinary testimony, despite Darwall's argument that the notion (...) of the ‘second‐personal’ marks a divide between practical and theoretical reason.
