Since Flexner's (1910) report over a century ago, we have observed the growth of medical education as a specialty (Donini-Lenhoff and Hedrick 2000). Of late, we have seen a strong move towards outcome-based education driven by educationalists and national bodies alike (GMC 1993; Harden, Crosby, and Davis 1999; Spady 1988). As medical educators, our understanding has grown considerably. However, there is an area that remains relatively unexplored. Few people will easily admit to taking pleasure in the misfortunes of others. But who doesn't enjoy it when an arrogant but untalented contestant is humiliated on American Idol, or when the embarrassing vice of a self-righteous politician is exposed, or even when an envied friend suffers a small setback? The truth is that joy in someone else's pain--known by the German word schadenfreude--permeates our society. In The Joy of Pain, psychologist Richard Smith, one of the world's foremost authorities (...) on envy and shame, sheds much light on a feeling we dare not admit. Smith argues that schadenfreude is a natural human emotion, one worth taking a closer look at, as it reveals much about who we are as human beings. We have a passion for justice. Sometimes, schadenfreude can feel like getting one's revenge, when the suffering person has previously harmed us. But most of us are also motivated to feel good about ourselves, Smith notes, and look for ways to maintain a positive sense of self. One common way to do this is to compare ourselves to others and find areas where we are better. Similarly, the downfall of others--especially when they have seemed superior to us--can lead to a boost in our self-esteem, a lessening of feelings of inferiority. This is often at the root of schadenfreude. As the author points out, most instances of schadenfreude are harmless, on par with the pleasures of light gossip. Yet we must also be mindful that envy can motivate, without full awareness, the engineering of the misfortune we delight in. And envy-induced aggression can take us into dark territory indeed, as Smith shows as he examines the role of envy and schadenfreude in the Nazi persecution of the Jews. Some theorists who accept the existence of global justice duties to alleviate the condition of distant needy strangers hold that these duties are significantly constrained by special ties to fellow countrymen. The patriotic priority thesis holds that morality requires the members of each nation-state to give priority to helping needy fellow compatriots over more needy distant strangers. Three arguments for constraint and patriotic priority are examined in this essay: an argument from fair play, one from coercion, another from coercion and (...) autonomy. Under scrutiny, none of these arguments qualifies as successful. (shrink)

Abstract: I argue that for psychological and social reasons, the traditional “Conflict Model” of science and religion interactions has such a strong hold on the nonexpert imagination that counterexamples and claims that interactions are simply more complex than the model allows are inadequate to undermine its power. Taxonomies, such as those of Ian Barbour and John Haught, which characterize conflict as only one among several possible relationships, help. But these taxonomies, by themselves, fail to offer an account of why different (...) relationships prevail among different communities and how they succeed one another within particular communities—that is, they contain no dynamic elements. To undermine the power of the “Conflict Model,” we should be seeking to offer alternative models for science and religion interactions that can both incorporate the range of stances articulated by scholars like Barbour and which can offer an account of the process by which differing attitudes succeed one another. As a step toward this goal, I propose a general “interacting subcultures model” and illustrate its applicability in a small number of mini-case studies from Early Modern Britain and France and with glances toward contemporary America. If you focus your charitable giving on global causes where it will do the most good, how should you feel about passing by the local soup kitchen? Would the ideally virtuous agent have their (local) empathy still activated, but simply overridden by the recognition that distant others are in even greater need, leaving the agent feeling torn? Or would their empathetic impulses be wholeheartedly redirected towards the greatest needs? Comparative concepts such as greener than or higher than are ways of ordering objects. They are fundamental to our grasp of gradable concepts, that is, the type of meanings expressed by gradable general terms, such as "is green" or "is high", which are embeddable in comparative constructions in natural language. Some comparative concepts seem natural, whereas others seem gerrymandered. The aim of this paper is to outline a theoretical approach to comparative concepts that bears both on the account of naturalness (...) for comparative concepts and on the theory of gradable concepts. The approach is novel in that it carries some basic assumptions from Peter Gärdenfors' conceptual spaces account of categorical concepts over to comparative concepts. The offered approach is more general than Gärdenfors' account in that it supplies a framework of graded categorisation that includes his categorisation rule as a limiting case. Importantly, it provides also a new argument for adopting Gärdenfors' particular model of categorisation. (shrink)

Its origins in pragmatist philosophy are traced, and it is compared with the law and economics movement in American law and the formalist style of Continental legal theory. The essay argues that the inevitability of legal pragmatism in America, and its dispensability in Europe, reflect fundamental institutional and cultural differences rather than mere accidents of history or legal thought.

In this engrossing double volume, the work and thought of Nicolas Malebranche is examined through the eyes of Simon Foucher and Dortous de Mairan. Part 1 consists of Richard A. Watson’s translation of the first published critique, by Simon Foucher, of Malebranche’s main philosophical work, _Of the Search for the Truth. _In the second part, Marjorie Grene presents a meticulous translation of the long correspondence between Malebranche and Jean-Jacques Dortous de Mairan that ended shortly before Malebranche’s death. Both Watson (...) and Grene provide insightful introductions to their translations. The influence of the works of Malebranche has been extensive, as has the influence of the lesser works of his first critic, Simon Foucher. Although Foucher was a minor philosopher of the seventeenth century, he provided arguments that led to a crucial turning point in modern philosophy. Listened to with care and treated with respect by Leibniz, Foucher’s arguments were utilized by Bayle, Berkeley, and Hume toward the destruction not only of Cartesian metaphysics but of substance philosophy as well. In this translation of Foucher’s work, it is now possible for readers of Malebranche’s _Of the Search for the Truth _to evaluate the immediate response of a young philosopher about town to one of the most important philosophical works of his day. The correspondence between Jean-Jacques Dortous de Mairan, an obscure provincial, and Nicolas Malebranche has usually been viewed as a small addendum to the works of Malebranche. Marjorie Grene, however, in her translation of this correspondence, considers it not only a contribution to the Malebranchian corpus but also an example of a reaction to Spinoza. Born at Béziers in the south of France in 1678, Mairan went to Paris in 1698, where he studied mathematics with Malebranche. Their correspondence began four years later when Mairan returned to Béziers to accept a position with the local bishop. In his letters to Malebranche, Mairan reveals himself to be one of no more than a handful of known readers of Spinoza who, in the early eighteenth century, admitted fascination with Spinoza’s presentation of his thoroughly unorthodox God and his equally unorthodox nature. Adams famously suggested that the acceptability of any indicative conditional whose antecedent and consequent are both factive sentences amounts to the subjective conditional probability of the consequent given the antecedent. The received view has it that this thesis offers an adequate partial explication of Ramsey’s test, which characterizes graded acceptability for conditionals in terms of hypothetical updates on the antecedent. Some results in van Fraassen may raise hope that this explicatory approach to Ramsey’s test is extendible to left-nested conditionals, that (...) is, conditionals whose antecedent is itself conditional in form. We argue that this interpretation of van Fraassen’s results is to be rejected. Specifically, we provide an argument from material inadequacy against a generalization of Adams’ thesis for left-nested conditionals. (shrink)

John MacFarlane has recently presented a novel argument in support of truth- relativism. According to this, contextualists fail to accommodate retrospective reassessments of propositional contents, when it comes to languages which are rich enough to express actuality. The aim of this note is twofold. First, it is to argue that the argument can be effectively rejected, since it rests on an inadequate conception of actuality. Second, it is to offer a more plausible account of actuality in branching time, along the (...) line of Lewis (1970/1983). (shrink)

Neurophenomena such as central sensitisation, hyperalgesia and allodynia, speak of a brain that is anything but hardwired. The brain's ability to self-organise in staggeringly complex ways forces us to look beyond what turn out to be perceptions of a body-mind reference, ie the idea of a mind is more a story than an actuality. There are mounting criticisms of body-mind dualism, , but with poor understanding of what philosophical narrative can replace it. Clearly, our human condition and pain's unique role (...) in it, is much more unpredictable than we had hitherto thought. This unpredictability dictates that we at least attempt to advance the philosophical debate in the interests of the pain sufferer. Richard Hamilton will investigate other roads of pain from Spinoza to Wittgenstein and Merleau-Ponty. Richard, Horst Ruthrof and David Buchanan will look at how the theory of language has long contended its place beyond the body-mind problem. (shrink)

Adorno unquestionably loved opera music as much as he hated opera as a cultural institution. His take on opera in the twentieth century led him to write its socio‐political obituary, while recognizing at the same time that opera continued to attract a steady stream of would‐be onlooker‐auditors. Paradoxically for Adorno, opera continued to appeal to audiences, and – from his dialectical reckoning – characteristically for precisely the wrong reasons. His opera analyses address the sociology of musical theater, performance hermeneutics, and (...) the direct consideration of music itself (though given his typical writing mode this writing is perhaps best characterized as criticism rather than analysis, as the latter term is commonly employed within musicology). Adorno's interests principally revolve around modern opera (Schoenberg, Berg, Strauss, Weill, especially) but also, if to a lesser extent, canonic works from Mozart to Verdi. Wagner, Wagnerian music drama, and cultural Wagnerism more generally were special cases for Adorno, and subjects he returned to repeatedly throughout his adult life, coinciding with the rise and fall of National Socialism and the Wagner cult, which in the 1930s and 1940s war years comfortably accommodated fascist proclivities. Adorno recognized the socio‐cultural agency of opera as a still‐prestigious cultural leftover of nineteenth‐century bourgeois triumphalism, which he vigorously opposed. In its place, he labored to promote what he regarded as a more socially responsible musico‐operatic practice to supplant the aesthetic and social complacency of the established order, ideas that after his death have found considerable currency, nowhere more evident than in late‐modern opera productions throughout the world. This paper contrasts the morally suspect elements in Marx's comments on relations between men and women in the 1844 Manuscripts with the more sensible and liberal tone of Marx's remarks on the same topic in post-1844 writings. The contrast is used to illustrate the claim that an important moral shift occurs in Marx's thought around 1844, a shift away from the early concern to overcome bourgeois egoism and with it the antagonism between state and civil society, and toward the mature (...) concern to eliminate what are perceived to be unfair inequalities of power among economic agents in a capitalist economy.The concept of alienation articulated in the Manuscripts attempts to combine these disparate concerns, and in consequence Marx's discussion there founders interestingly. In this paper the authors present a description and reflective analysis of an underdeveloped aspect of legal ethics education: judicial ethics. Part I provides an introduction to Canada's National Judicial Institute and its early attempts to design and deliver judicial ethics education programmes. Part II then suggests that in the last few years a second generation of judicial ethics education has emerged, generating a more systemic and contextually sophisticated pedagogical agenda. When the meaning is representational, what is the nature of the appropriate experience? If there is agreement that the experience is to be described as seeing-in, disagreement breaks out about how seeing-in is to be understood. This paper challenges two recent interpretations: one in terms of perceived resemblance, the other in terms of imagining seeing. Neither view (...) gives a correct account of how the spectator distributes his attention between the marked surface and the represented object. /// [Robert Hopkins] I offer two, complementary, accounts of the visual nature of representational picturing. One, in terms of six features of depiction, sets an explanatory task. The other, in terms of the experience to which depiction gives rise, promises to meet that need. Elsewhere I have offered an account of this experience that allows this promise to be fulfilled. I sketch that view, and defend it against Wollheim's claim that it cannot meet certain demands on a satisfactory account. I then turn to Wollheim's own view, arguing that it suffers from crucial obscurities. Problems of Rationality is divided into three parts. The first four essays defend the claim that judgments of value are objectively true. The next six expound what Davidson called "a unified theory of thought, meaning, and action". The last four discuss the problems that weakness of will and self-deception raise for Davidson's claim that ascription of intention and belief is possible only if we assume the agent's rationality. I shall discuss the three parts in sequence.

The notion of ‘bipolar’ or ‘second‐personal’ normativity is often illustrated by such situations as that of one person addressing a complaint to another, or asserting some right, or claiming some authority. This paper argues that the presence of speech acts of various kinds in the development of the idea of the ‘second‐personal’ is not accidental. Through development of a notion of ‘illocutionary authority’ I seek to show a role for the ‘second‐personal’ in ordinary testimony, despite Darwall's argument that the notion (...) of the ‘second‐personal’ marks a divide between practical and theoretical reason.
