Is there an explanation of why the state of x's bearing the non-symmetric binary relation R to y is different from its differential opposite, the state of y's bearing R to x? One traditional view has it that the explanation is that non-symmetric relations hold of objects in an essentially directional way, ordering the relevant relata. We call this view ‘directionalism’. Kit Fine has suggested that this approach is subject to significant metaphysical difficulties, sufficient to motivate seeking an alternative analysis. (...) He considers two such alternative explanations, which he labels ‘positionalism’ and ‘anti-positionalism’. Of these he endorses the latter. We argue that anti-positionalism fails to provide a coherent explanation of the distinction between differential opposites, and that one should simply hold the minimalist position that there is no explanation for this metaphysical difference. Bioethics and feminist scholarship has explored various justice implications of nonmedical sex selection and family balancing. However, prospective users’ viewpoints have been absent from the debate over the socially acceptable bounds of nonmedical sex selection. This qualitative study provides a set of empirically grounded perspectives on the moral values that underpin prospective users’ conceptualizations of justice in the context of a family balancing program in the United States. The results indicate that couples pursuing family balancing understand justice primarily in individualist (...) and familial terms rather than in terms of social justice for women and girls or for children resulting from sex selection. Study participants indicated that an individual’s desire for gender balance in their family is ethically complex and may not be inherently sexist, immoral, or socially consequential, particularly given the social context in which they live. Our findings suggest that the social conditions that contribute to prospective users’ desires for gender balance in their families may direct them away from recognizing or engaging broader social justice concerns relating to sexism and stratified reproduction. Disputes regarding the ethics of work by children have intensified in recent years, with little resolution. The impasses stem from failure to recognize the diverse forms of child work and a lack of empirical research regarding its causes and consequences. We report on data gathered in Brazil’s export-oriented shoe industry, which is notorious for the employment of children. Central findings are: 1) the causes of child work have less to do with backwardness and more to do with how shoe workers (...) are integrated into the global order; 2) local employers and children regard this work as benign, but the U.S. government sees it as hazardous to children and unfair to U.S. producers; 3) efforts to remove children from the shoe industry have been frustrated by local resistance and raise ethical questions; and 4) in certain circumstances, efforts to eliminate hazards from the workplace are morally superior to campaigns to remove childworkers from employment. How may emergent biotechnologies impact upon our relations with other animals? To what extent are any changes indicative of new relations between society and nature? This paper critically explores which sociological tools can contribute to an understanding of the technologisation of animal bodies. By drawing upon interview data with animal scientists I argue that such technologies are being partly shaped by broader changes in agriculture. The complexity of genomics trajectories in animal science is partly fashioned through the deligitimisation of the (...) productivist paradigm but continue to sit in tension around particular conceptions of sustainability in farm animal production.In spite of this deligitimisation process genomics is now being framed in the context of a new productivism (termed the livestock revolution) bound up in projected global changes in animal consumption during the first half of the 21st century. This potentially jars against both social trends that seek to re-enchant animal life and sustainability discourses which include social and environmental contexts. Nevertheless the possibility of a new productivism is supported by various interconnected trends including the emergence of a discourse of the 'bioeconomy' and a liberal regulatory apparatus for farm animal breeding technologies. Ultimately an understanding of the possibility of emerging new bio-capitalisations on animal life should be set in a broader context of competing agricultural paradigms as well as ongoing tensions over 'naturalness' in human/animal relations. This article offers a theoretical and doctrinal solution to a vexing question in public law: how to determine the justifiability of Charter rights-limiting administrative decisions. The jurisprudence suggests three approaches, or modes of reasoning: minimal impairment analysis, ‘interest balancing’, and ‘values-advancing reasoning’. Like Cerberus, the guard dog of Hades, Canadian public law has become three-headed. While scholars and courts argue about which mode of reasoning is categorically best, the culture of justification compels us to ask instead which provides the most (...) compelling explanation for each rights-limiting decision. Just as cutting off one of Cerberus’s heads would diminish his effectiveness as a guard dog, rejecting either of the modes of reasoning would limit decision makers’ capacity to explain their decisions and undermine a culture of justification. The article makes a theoretical case for retaining all three modes of reasoning and sets out a doctrinal approach to determining when each is applicable. (shrink)

Traditional spiritual literature contains rich anecdotal reports of spontaneously arising experiences occurring during meditation practice, but formal investigation of such experiences is limited. Previous work has sometimes related spontaneous experiences to the Indian traditional contemplative concept of kundalini. Historically, descriptions of kundalini come out of Tantric schools of Yoga, where it has been described as a “rising energy” moving within the spinal column up to the brain. Spontaneous meditation experiences have previously been studied within Buddhist and Christian practices and within (...) eclectic groups of contemplative practitioners. Prior explorations of kundalini have emphasized extreme experiences, sometimes having clinical consequences. We conducted a first such investigation of kundalini-related experiences within a sample of meditators from a single Tantric Yoga tradition (known as Ananda Marga) that emphasizes the role of kundalini. We developed a semi-structured questionnaire to conduct an exploratory pilot investigation of spontaneous sensory, motor and affective experiences during meditation practice. In addition to identifying the characteristics of subjective experiences, we measured quantity of meditation, supplemental practices, trait affect and trait mindfulness. We administered it to 80 volunteers at two Ananda Marga retreats. Among reported experiences, we found the highest prevalence for positive mood shifts, followed by motor and then sensory experiences. The frequency of spontaneous experiences was not related to the quantity of practiced meditation or trait measures of mindfulness and affect. Self-reports included multiple descriptions of rising sensations, sometimes being directly called kundalini. Experiences with rising sensations were complex and many included references to positive affect, including ecstatic qualities. There were also reports of spontaneous anomalous experiences. These experiences of rising sensations resemble prior clinical descriptions that were considered kundalini-related. The individuals who reported rising sensations could not be distinguished from other participants based on the incidence of experiences, quantity of meditation practice, or trait measures of mindfulness and affect. In contrast, greater amount of Tantric Yoga meditation practice was associated with greater positive affect, less negative affect and greater mindfulness. Further study of these exploratory findings and how they may be related to spiritual and well-being goals of meditation is warranted along with scientific investigation of purported kundalini phenomena. In this paper, we reconstruct the debate between Zhuangzi 莊子 and Hui Shi 惠施 that took place on the bridge over the Hao River 濠水 as a substantive debate concerning the epistemic other‐mind skepticism according to which no one mind knows the mental states of the other. We demonstrate how this reconstruction leads to substantive conclusions of the viability of Hui Shi’s position in particular and of the other‐mind skepticism in general. This demonstration is accomplished by means of the contemporary (...) philosophical development regarding, for example, whether asserting a proposition implies that the asserter knows the proposition, whether the closure principle of epistemic logic should be held, and whether knowing something is a mental state. We hold that this debate’s resolution is substantively entangled with contemporary philosophical concerns. (shrink)

The central question of this paper is if philosophical inquiry is possible on the Internet. I will therefore investigate both subjects, try to come to a conclusion and to some recommendations. To get a better idea of the relevance of this question, I will:• elaborate briefly on the history of the Internet, discuss its possibilities and technical aspects,• elaborate briefly on philosophical inquiry and its main characteristics,• try to find some common aspects in both,• discuss the history and the evolution (...) of the existing electronic discussion list (the [email protected]) and expand on the results of a questionnaire I sent to every member on the list.I will try to show that real philosophical inquiry is primarily a matter of communication, both verbal and non-verbal. Internet is obviously a matter of communication, hut the question remains if technology truly creates new possibilities of communication. (shrink)

Moral responsibility requires free will in the sense of agents having the power to choose independently of all the causal influences acting on them. Various forms of compatibilism, and also incoherentism, are rejected.

In their excellent book Disadvantage, Jonathan Wolff and Avner de-Shalit (hereafter: the Authors) state that their aim “is to provide practical guidance to policy makers by providing a version of egalitarian theory which can be applied to actual social policy.”1 This is a worthy project and their execution of it is full of insight. However, I doubt that they succeed in fulfilling their stated aim.
