This research examined how and why group membership diminishes the attribution of mind to individuals. We found that mind attribution was inversely related to the size of the group to which an individual belonged . Mind attribution was affected by group membership rather than the total number of entities perceived at once . Moreover, mind attribution to an individual varied with the perception that the individual was a group member. Participants attributed more mind to an individual that appeared distinct or (...) distant from other group members than to an individual that was perceived to be similar or proximal to a cohesive group . This effect occurred for both human and nonhuman targets, and was driven by the perception of the target as an entitative group member rather than by the knowledge that the target was an entitative group member. Taming the power of Wall Street was a principal campaign theme for Franklin Delano Roosevelt in the 1932 election. Roosevelt's election bore fruit in the Securities Act of 1933, which regulated the public offering of securities, the Securities Exchange Act of 1934, which regulated stock markets and the securities traded in those markets, and the Public Utility Holding Company Act of 1935 (PUHCA), which legislated a wholesale reorganization of the utility industry. The reform effort was spearheaded by the newly created (...) Securities and Exchange Commission, part of the new wave of experts brought to Washington to rein in business. PUHCA also marked the federal government's first significant incursion into corporate governance, with a corresponding reduction in the traditional role of investment bankers. The SEC's ascendance over the investment bankers was reinforced during FDR's second term by the Chandler Act of 1938, which provided the agency with a broad role in the bankruptcy reorganization of troubled companies.Enacting those statutes was only the beginning, as the scope and effectiveness of the SEC's regulatory efforts depended critically on navigating these new statutes past an initially hostile Supreme Court. After substantial delay in the lower courts, the securities statutes eventually got a friendly hearing in the Supreme Court, where a number of Justices came to the Court after serving as the "Founding Fathers" of the federal securities laws. Roosevelt's Supreme Court nominees were involved in drafting the new legislation, securing its passage in Congress and implementing a litigation strategy that successfully stalled final determination of the constitutionality of the securities laws until New Deal appointed justices were in place. Felix Frankfurter played an important role in shaping the Securities Act and PUHCA, and was a key advisor on litigation strategy to the Roosevelt administration. Hugo Black led the legislative battle to enact PUHCA against the utility companies. Stanley Reed and Robert Jackson were key courtroom advocates arguing PUHCA's constitutionality. William O. Douglas headed the study of Protective Committees that led to the Chandler Act and was Chairman of the SEC. In this article, we explore the role of the New Deal justices in enacting the securities laws, litigating the challenges brought against them and then interpreting these laws in securities cases before the Supreme Court. We show the important role that these New Deal justices played in ensuring a broad scope for the federal securities laws through generous interpretation. Once constitutional questions had faded, securities cases proved to be a critical testing ground for newly emerging theories of administrative law. We demonstrate the split over the importance of judicial review versus deference to the rule of experts that emerged among these Roosevelt appointees. Finally, we explore the relative lack of influence of Douglas and Frankfurter in these cases, despite their familiarity and experience with the securities laws. (shrink)

Flamm examines a dominant theme in Santayana’s philosophy: the spiritual life. He puts Santayana’s philosophy in dialogue with the novella Soul (Dzhan) by Andrey Platonov and examines the various ways Santayana associates crying with a materialist conception of the spiritual life.The association of crying and spiritual life is conspicuous enough in Santayana’s writings to merit exploration. In an astonishing variety of rhetorical modes Santayana writes of the various “cries” of spirit, of psyche, of soul, and of the human heart, emphasizing (...) the idea that it is through moral suffering that humans come to spiritual understanding (Some examples: “An impetuous spirit when betrayed by the world will cry …” (LR2, Chapter VIII, “Ideal Society,” p. 121); “the universal need and cry of human souls …” (LR3, Chapter XII, “Charity,” pp. 130–31); “spirit is physically the voice of the soul crying in the wilderness” (RB/RE, “The Nature of Spirit,” p. 568); “our very soul begins to cry for help” (RB/RE “On Cosmic Animism,” p. 576); “pain,” the “first form of distraction” in the psyche causes it to “awake with a sharp cry, a conscious protest” (RB/RE, “Distraction,” p. 679)). Santayana goes so far in one context to suggest that crying experiences testify to the existence of matter (“The more ecstatic or the more tragic experience is, the more unmistakably it is the voice of matter.” “Cross Lights,” SE, p. 25). In this chapter I link the various ways Santayana associates crying and spiritual life with the novella Soul (Dzhan) by Andrey Platonov (Andrey Platonov (1899–1951) was a Russian author whose works during the Stalinist era were heavily censored and banned and have only recently (relative to their importance, as of the late 1990s) begun appearing in approved English translations. I am a lover of Russian literature and no expert, but am prepared to agree with poet-translator Robert Chandler, who claimed (before he died in 2007) that Russians will come one day to recognize Platonov as their “greatest prose writer” (Chandler’s exquisite co-translation of Platonov’s Soul was chosen in 2004 as “best translation of the year from a Slavonic language” by the American Association of Teachers of Slavic and East European Languages)). Santayana in dialogue with Platonov offers a radiant picture of the materialist conception of spiritual life. (shrink)

An exploration of the theories, histories, practices, and contradictions of liberalism today. What does it mean to be a liberal in neoliberal times? This collection of short essays attempts to show how liberals and the wider concept of liberalism remain relevant in what many perceive to be a highly illiberal age. Liberalism in the broader sense revolves around tolerance, progress, humanitarianism, objectivity, reason, democracy, and human rights. Liberalism's emphasis on individual rights opened a theoretical pathway to neoliberalism, through private property, (...) a classically minimal liberal state, and the efficiency of “free markets.” In practice, neoliberalism is associated less with the economic deregulation championed by its advocates than the re-regulation of the economy to protect financial capital. Liberalism in Neoliberal Times engages with the theories, histories, practices, and contradictions of liberalism, viewing it in relation to four central areas of public life: human rights, ethnicity and gender, education, and the media. The contributors explore the transformations in as well as the transformative aspects of liberalism and highlight both its liberating and limiting capacities. The book contends that liberalism—in all its forms—continues to underpin specific institutions such as the university, the free press, the courts, and, of course, parliamentary democracy. Liberal ideas are regularly mobilized in areas such as counterterrorism, minority rights, privacy, and the pursuit of knowledge. The charge of treason and the judgment of insanity have left questions that invariably intrude on an assessment of Pound’s life and work. Critics frequently adopt a strategy of separating the life and the work, but tactical review is often necessary. There is a lightness in Pound’s writing that speaks of a being detached from the concerns of the world. Yet with his economic theory of social credit, his political and racial views, as well as his concern for other writers, (...) he is of the world—in the world and part of it. He was decidedly not tied to geography. He had no region or period, and he was as comfortable in Confucian China as in Dante’s Florence or twentieth-century Rome. He could work anywhere. He wrote The Pisan Cantos while jailed in Italy. The Cantos were published while he was in a mental wart at St. Elizabeths, yet a court found that he could not understand the charges against him. Can such an impairment and such achievement occur at the same time? If you say no, then what of the treason? Did he feign madness to escape punishment? Could Pound have been convicted of treason?In this paper, I intend to examine what has been loosely referred to as “the trial of Ezra Pound” and to show that Pound’s case should have been brought to trial within one or two years after his commitment to St. Elizabeths because he had a reasonable chance of being found not guilty of treason; even if found guilty, the circumstances in mitigation of a long prison term would have been so evident that he would have likely spent considerably less time in prison than he spent locked up at the mental institution. I will do this, in part, by reviewing the similarities and differences between Pound’s case and three other treason cases that came to trial within the first years after World War II. The English case, Rex v. Joyce, was tried shortly after the close of the war and well before Pound’s competency hearing on 13 February 1945.3 The law applied in Joyce would have led Pound’s lawyer to seek some postponement of trial until the American courts decided whether to follow the English lead. The other two cases involve the Americans, Douglas Chandler and Robert Best, employees of German radio, who were indicted with Pound in 1943. 3. William Joyce was an American who came to be known as “Lord Haw Haw.” He was hanged at Wandsworth, England, 3 Jan. 1946. He was the best known of the “radio traitors.” He began his programs, “This is Jairmany calling,” and would then prophesy the destruction of English towns and cities. The name “Lord Haw Haw” was created by the English journalist, Jonah Barrington, to ridicule Joyce and to make him appear idiotic. Conrad L. It is well known that classical, aka ‘sharp’, Bayesian decision theory, which models belief states as single probability functions, faces a number of serious difficulties with respect to its handling of agnosticism. These difficulties have led to the increasing popularity of so-called ‘imprecise’ models of decision-making, which represent belief states as sets of probability functions. In a recent paper, however, Adam Elga has argued in favour of a putative normative principle of sequential choice that he claims to be borne out (...) by the sharp model but not by any promising incarnation of its imprecise counterpart. After first pointing out that Elga has fallen short of establishing that his principle is indeed uniquely borne out by the sharp model, I cast aspersions on its plausibility. I show that a slight weakening of the principle is satisfied by at least one, but interestingly not all, varieties of the imprecise model and point out that Elga has failed to motivate his stronger commitment. Spinoza’s attitude toward nonhuman animals is uncharacteristically cruel. This essay elaborates upon this ostensible idiosyncrasy in reference to Hasana Sharp’s commendable desire to revitalize a basis for animal ethics from within the bounds of his system. Despite our favoring an ethics beginning from animal affect, this essay argues that an animal ethic adequate to the demands of our historical moment cannot be developed from within the confines of strict adherence to Spinoza’s system—and this is not yet to speak of a (...) more robust animal ethics which would advocate actual care and compassion for the animals themselves. We argue that on the assumption of Spinoza’s ontological biocentrism, in the presence of Spinozist determinism and the absence of an axiological biocentrism, an anthropocentric axiology necessarily follows. Any Spinozist animal ethic must fall back, therefore, upon appeals to the maximization of human pleasure and power; hence Spinoza’s ruthless injunction to “use (the animals) at our pleasure.” These are the very ontological and ethical assumptions which have incited human self-exaltation in the modern period, in pursuit of power and pleasure even despite the destructive long-term consequences for all the living. We suggest that an adequate animal ethic would require either an abandonment of Spinoza’s ontological biocentrism or the adoption of an axiological biocentrism. (shrink)

After a number of decades of research into the dynamics of rational belief, the belief revision theory community remains split on the appropriate handling of sequences of changes in view, the issue of so-called iterated revision. It has long been suggested that the matter is at least partly settled by facts pertaining to the results of various single revisions of one’s initial state of belief. Recent work has pushed this thesis further, offering various strong principles that ultimately result in a (...) wholesale reduction of iterated to one-shot revision. The present paper offers grounds to hold that these principles should be significantly weakened and that the reductionist thesis should ultimately be rejected. Furthermore, the considerations provided suggest a close connection between the logic of iterated belief change and the logic of evidential relevance. (shrink)

In a recent article, Douven and Williamson offer both (i) a rebuttal of various recent suggested sufficient conditions for rational acceptability and (ii) an alleged ‘generalization’ of this rebuttal, which, they claim, tells against a much broader class of potential suggestions. However, not only is the result mentioned in (ii) not a generalization of the findings referred to in (i), but in contrast to the latter, it fails to have the probative force advertised. Their paper does however, if unwittingly, bring (...) us a step closer to a precise characterization of an important class of rationally unacceptable propositions—the class of lottery propositions for equiprobable lotteries. This helps pave the way to the construction of a genuinely lottery-paradox-proof alternative to the suggestions criticized in (i). (shrink)

Friedrich Nietzsche and Albert Schweitzer end up defending radically similar, yet critically opposed conclusions about the human animal and its place in nature, particularly with regard to the ethical awareness that does or does not follow from this situatedness. Arthur Schopenhauer’s notion of the will accounts for their similar foundational assumptions. But what accounts for the fact that their shared desire to affirm the will to life leads to fundamentally opposed ethical conclusions? What keeps Schweitzer’s ascetic ethic of reverence for (...) life from evolving into Nietzsche’s anti-ascetic vision of a second innocence beyond good and evil? We argue that situating the notion of reverence for life within an environmental virtue ethics, as one environmental virtue among many, aiming at ecological conversion, better articulates and motivates the disposition demanded by the ethics of reverence for life. As the ongoing literature on the paradoxes of the Lottery and the Preface reminds us, the nature of the relation between probability and rational acceptability remains far from settled. This article provides a novel perspective on the matter by exploiting a recently noted structural parallel with the problem of judgment aggregation. After offering a number of general desiderata on the relation between finite probability models and sets of accepted sentences in a Boolean sentential language, it is noted that a number (...) of these constraints will be satisfied if and only if acceptable sentences are true under all valuations in a distinguished non-empty set W. Drawing inspiration from distance-based aggregation procedures, various scoring rule based membership conditions for W are discussed and a possible point of contact with ranking theory is considered. This article provides a discussion of the principle of transmission of evidential support across entailment from the perspective of belief revision theory in the AGM tradition. After outlining and briefly defending a small number of basic principles of belief change, which include a number of belief contraction analogues of the Darwiche-Pearl postulates for iterated revision, a proposal is then made concerning the connection between evidential beliefs and belief change policies in rational agents. I outline four competing probabilistic accounts of contrastive evidential support and consider various considerations that might help arbitrate between these. The upshot of the discussion is that the so-called 'Law of Likelihood' is to be preferred to any of the alternatives considered.

X: The Problem of the Negro as a Problem for Thought offers an original account of the African American as an object of discourse, knowledge, and general social practice, conceiving the focus of such a concern -- with W.E.B. Du Bois -- as forms of social and historical problems on an epochal scale, above all the global-level "problem of the color line," as the mark of both historical limit and possibility.

It appears to have gone unnoticed in the literature that Pollock's widely endorsed analysis of evidential defeat entails a remarkably strong symmetry principle, according to which, for any three propositions D, E and H, if both E and D provide a reason to believe H, then D is a defeater for E's support for H if and only if, in turn, E is a defeater for D's support for H. After illustrating the counterintuitiveness of this constraint, a simple, more suitable, (...) alternative to the Pollockian account is offered. (shrink)

I have been told that for some twenty minutes after reading this paper Kripke believed I had shown that proper names could be non-rigid designators. (Then, apparently, he found a crucial error in the set-up.) I take great pride in this (alleged) fact.

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Merleau-Ponty suggests in his Nature lectures that myth provides the best way into thinking the relation of strange kinship between humanity and animality. He goes on to refigure Husserl’s paradigm of the two hands touching to extend beyond merely human-to-human relations, invoking in the process the myth of Narcissus. By carefully examining Merleau-Ponty’s late refiguration of that paradigm, alongside the revised conception of narcissism that it helps him to develop, we find that while human-animal empathy is made possible by a (...) ground of intercorporeal kinship, human-animal estrangement makes possible the emergence of an ethical relation to other animals, contingent upon the sublimation of animal desire. Holding human-animal kinship and estrangement in tension reveals a nascent ideal present implicitly in the early stages of childhood development: a vision of the possibility of interspecies harmony, rooted in the bodily reciprocity that drives the process of self-maturation. As persons we are irreducibly unique and essentially relational. In many contexts individual uniqueness has been accentuated at the expense of communal relationality. Our age has been marked by the loss of deep and meaningful relations to one another, and still more dramatically to the earth and its living creatures. The cosmological dimension of human personhood, that is, has been largely obscured. This chapter argues that our age has been marked increasingly by anesthetizing, alienating, and anonymizing tendencies. It proposes three (...) commensurate responses: aestheticization, or embodied philosophical knowing that remains faithful to the earth; anacarnation, or willful return to the wonders of embodied life, purged of romantic sentimentality; and attestation, or speaking up on behalf of the haecceitas or thisness of living creatures systematically instrumentalized for profit and pleasure. Together these responses help us to regain touch with animality by embracing the earth that hosts us, thus becoming more gracious guests, and to become more fully human by becoming better hosts to the multitude of earth's creatures, whose lives hang in the balance. In a recent pair of publications, Richard Bradley has offered two novel no-go theorems involving the principle of Preservation for conditionals, which guarantees that one’s prior conditional beliefs will exhibit a certain degree of inertia in the face of a change in one’s non-conditional beliefs. We first note that Bradley’s original discussions of these results—in which he finds motivation for rejecting Preservation, first in a principle of Commutativity, then in a doxastic analogue of the rule of modus ponens —are problematic (...) in a significant number of respects. We then turn to a recent U-turn on his part, in which he winds up rescinding his commitment to modus ponens, on the grounds of a tension with the rule of Import-Export for conditionals. Here we offer an important positive contribution to the literature, settling the following crucial question that Bradley leaves unanswered: assuming that one gives up on full-blown modus ponens on the grounds of its incompatibility with Import-Export, what weakened version of the principle should one be settling for instead? Our discussion of the issue turns out to unearth an interesting connection between epistemic undermining and the apparent failures of modus ponens in McGee’s famous counterexamples. (shrink)

Post-traumatic stress disorder is a “young” disorder formally recognized in the early 1980s, although the symptoms have been noted for centuries particularly in relation to military conflicts. PTSD may develop after a serious traumatic experience that induces feelings of intense fear, helplessness or horror. It is currently characterized by three key classes of symptoms which must cause clinically significant distress or impairment of functioning: persistent and distressing re-experiencing of the trauma; persistent avoidance of stimuli associated with the trauma and numbing (...) of general responsiveness; and persistent symptoms of hyper-arousal. One of the possible symptoms within the second class is difficulty in remembering an important aspect of the traumatic event.PTSD is not an uncommon condition, with an estimated lifetime prevalence of about 7-9% based on studies conducted in the United States and Canada, with women at higher risk than men. While not everyone who experiences a significant trauma will go on to develop PTSD, about a third will do so. Sexual assault, along with other forms of assaultive violence, pose a comparatively high risk of PTSD. (shrink)

Classical neo-Darwinian explanations do not fully account for changes in biological forms, and new theories have emerged, primarily in maths and physics, that offer new approaches to the problem of the origin of life and phenomena of order in evolution. This volume focuses on the role of closure at various hierarchical levels as the catalyst between self-organization and selection. Participants addressed special areas of the closure problem such as autopoiesis and autocatalysis and function and selection, and semiosis. Presentations on physical (...) and mathematical modelling are included. The book seeks to clarify the role closure plays in explaining the emergence, development and evolution of structurally stable systems at the thermodynamic, chemical and biochemical, biological, psychological and cultural levels. One of the ethical issues that has been raised recently regarding emerging neurotherapies is that people will be coerced explicitly or implicitly in the workplace or in schools to take cognitive enhancing drugs. This article builds on this discussion by showing how the law may pressure people to adopt emerging neurotherapies. It focuses on a range of private law doctrines that, unlike the criminal law, do not come up very often in neuroethical discussions. Three doctrines—the doctrine of mitigation, the standard (...) of care in negligence, and child custody determinations in family law—are addressed to show how the law may pressure people to consent to treatment by offering a choice between accepting medical treatment and suffering a legal disadvantage. The doctrines considered in this article apply indirect pressure to submit to treatment, unlike court-ordered medical treatment, which applies direct pressure and is not addressed here. The outcome of this discussion is to show that there is a greater range of social pressures that may encourage the uptake of novel neurotherapies than one might initially think. Once treatments that were developed and offered with therapeutic benefits in mind become available, their existence gives rise to unintended legal consequences. This certainly does not mean we should cease developing new therapies that may be of tremendous benefit to patients, but it does raise some questions for physicians and for legal policy-makers. How should physicians, who are required by medical ethical principles to obtain valid consent to treatment, react to a patient’s reluctant consent that is driven by legal pressure? From the legal policy perspective, are our legal doctrines satisfactory or should they be changed because, for example, they unduly promote the collective interest over individual freedom to reject medical treatment or because they channel us toward economically efficient treatments to the detriment of more costly but potentially superior approaches of dealing with behavioural problems? Discussions of the issue of iterated belief revision are commonly accompanied by the presentation of three “concrete” operators: natural, restrained and lexicographic. This raises a natural question: What is so distinctive about these three particular methods? Indeed, the common axiomatic ground for work on iterated revision, the AGM and Darwiche-Pearl postulates, leaves open a whole range of alternative proposals. In this paper, we show that it is satisfaction of an additional principle of “Independence of Irrelevant Alternatives”, inspired by the literature (...) on Social Choice, that unites and sets apart our three “elementary” revision operators. A parallel treatment of iterated belief contraction is also given, yielding a family of elementary contraction operators that includes, besides the well-known “conservative” and “moderate” operators, a new contraction operator that is related to restrained revision. The field of iterated belief change has focused mainly on revision, with the other main operator of AGM belief change theory, i.e. contraction, receiving relatively little attention. In this paper we extend the Harper Identity from single-step change to define iterated contraction in terms of iterated revision. Specifically, just as the Harper Identity provides a recipe for defining the belief set resulting from contracting A in terms of (i) the initial belief set and (ii) the belief set resulting from revision (...) by ¬A, we look at ways to define the plausibility ordering over worlds resulting from contracting A in terms of (iii) the initial plausibility ordering, and (iv) the plausibility ordering resulting from revision by ¬A. After noting that the most straightforward such extension leads to a trivialisation of the space of permissible orderings, we provide a family of operators for combining plausibility orderings that avoid such a result. These operators are characterised in our domain of interest by a pair of intuitively compelling properties, which turn out to enable the derivation of a number of iterated contraction postulates from postulates for iterated revision. We finish by observing that a salient member of this family allows for the derivation of counterparts for contraction of some well known iterated revision operators, as well as for defining new iterated contraction operators. Thus she has argued, in effect, that Steerforth is the hero of David Copperfield, and Heathcliff the most admirable character in Wuthering Heights. Here I discuss her more or less explicit claim that Alcibiades is the hero, (and Socrates the villain) in Plato’s Symposium. -/- .

Probability theory promises to deliver an exact and unified foundation for inquiry in epistemology and philosophy of science. But philosophy of religion is also fertile ground for the application of probabilistic thinking. This volume presents original contributions from twelve contemporary researchers, both established and emerging, to offer a representative sample of the work currently being carried out in this potentially rich field of inquiry. Grouped into five parts, the chapters span a broad range of traditional issues in religious epistemology. The (...) first three parts discuss the evidential impact of various considerations that have been brought to bear on the question of the existence of God. These include witness reports of the occurrence of miraculous events, the existence of complex biological adaptations, the apparent 'fine-tuning' for life of various physical constants and the existence of seemingly unnecessary evil. The fourth part addresses a number of issues raised by Pascal's famous pragmatic argument for theistic belief. This article seeks to analyse the rise of ‘resilience ethics’, in terms of the shift in ethical approaches away from the hierarchical liberal internationalist constructions of the 1990s and towards broader and more inclusive understandings of ethical responsibility for global problems. This shift in ethical attention away from the formal international politics of inter-state relations and towards the unintended consequences of both institutional structures and the informal market choices of individuals has diversified understandings of global ethical responsibilities. It is argued (...) that the recasting of ethical responsibility in the increasingly sociological terms of unintended and indirect consequences of socio-material embeddedness constructs new ethical differentials and hierarchies of responsibility. These framings have facilitated new policy practices, recasting interventionist policy-making in terms of the growing self-awareness and reflexivity of Western actors, reframing ethical foreign policy as starting with the choices of individual citizens, and, at the same time, operating to reify the relations of the market. Suicide is complex; yet suicide research is dominated by ‘psy’ disciplines which can falter when seeking to explain social patterning of suicide rates, and how this relates to individual actions. This article discusses a multidisciplinary report which aimed to advance understandings of socioeconomic inequalities in suicide rates in the UK. Contrasts are drawn between health psychology and sociology. Important intersections are highlighted, including a lack of attention to socioeconomic inequalities, and an emphasis on adverse life experiences and emotions to understand (...) inequalities and suicide. There are also curious disconnects, both within and between relevant psychological and sociological perspectives. The article argues that there are significant gaps in existing theorization regarding suicide, which can only be addressed through meaningful inter-disciplinary collaborations between sociologists, psychologists and others. Current theorization in mainstream suicide research is limited by its failure to engage with enduring, yet vitally important sociological debates regarding structure and agency, nature and culture. The traditional Bayesian qualitative account of evidential support (TB) takes assertions of the form 'E evidentially supports H' to affirm the existence of a two-place relation of evidential support between E and H. The analysans given for this relation is $C(H,E) =_{def} Pr(H\arrowvertE) \models Pr(H)$ . Now it is well known that when a hypothesis H entails evidence E, not only is it the case that C(H,E), but it is also the case that C(H&X,E) for any arbitrary X. There is (...) a widespread feeling that this is a problematic result for TB. Indeed, there are a number of cases in which many feel it is false to assert 'E evidentially supports H&X', despite H entailing E. This is known, by those who share that feeling, as the 'tacking problem' for Bayesian confirmation theory. After outlining a generalization of the problem, I argue that the Bayesian response has so far been unsatisfactory. I then argue the following: (i) There exists, either instead of, or in addition to, a two-place relation of confirmation, a three-place, 'contrastive' relation of confirmation, holding between an item of evidence E and two competing hypotheses H₁ and H₂. (ii) The correct analysans of the relation is a particular probabilistic inequality, abbreviated C(H₁, H₂, E). (iii) Those who take the putative counterexamples to TB discussed to indeed be counterexamples are interpreting the relevant utterances as implicitly contrastive, contrasting the relevant hypothesis H₁ with a particular competitor H₂. (iv) The probabilistic structure of these cases is such that ∼C(H₁, H₂, E). This solves my generalization of the tacking problem. I then conclude with some thoughts about the relationship between the traditional Bayesian account of evidential support and my proposed account of the three-place relation of confirmation. (shrink)

Roughly speaking, Augustine claims that ‘Immutable Truth’ is superior to the human mind and, consequently a legitimate candidate for the role of God. Clearly there is such a thing as Immutable Truth. So either that is God, or there is something superior to Immutable Truth, and that superior thing is God. I spell out this argument, and offer some objections to it.

Fleur Johns argues that the contraposition of a ‘bottom-up’ approach of politics of prototypical technique rather than the ‘top-down’ politics of the master plan or normative principle no longer seems as straightforwardly radical as it appeared when James C Scott posited the value of local knowledge or métis against grand plans of high modernization, just over 20 years ago. This paper seeks to follow Johns’ call, ‘to capture and probe some of the effects of sensibility, rationality or style widely reproduced (...) in the details of development work’. It draws upon fieldwork in Nairobi to open up a discussion of a shift in sensibility from a ‘bottom-up’ or ‘postliberal’ approach to a framing of open-ended encounter. The paper critiques this imaginary of relational encounter by engaging contemporary work in critical black studies. It suggests that the problem of critique is that it reproduces the problems of governing imaginaries, continually seeking to rework the human subject via adaptive capacities, sensitivities to difference and openness to alterity, while leaving intact the coloniality of being, the antiblack world.
