Chinese translation courtesy of Zhuanxu Xu. We want to know what gender is. But metaphysical approaches to this question solely have focused on the binary gender kinds men and women. By overlooking those who identify outside of the binary–the group I call ‘genderqueer’–we are left without tools for understanding these new and quickly growing gender identifications. This metaphysical gap in turn creates a conceptual lacuna that contributes to systematic misunderstanding of genderqueer persons. In this paper, I argue that to better (...) understand genderqueer identities, we must recognize a new type of gender kind: critical gender kinds, or kinds whose members collectively resist dominant gender ideology. After developing a model of critical gender kinds, I suggest that genderqueer is best modeled as a critical gender kind that stands in opposition to `the binary assumption', or the prevalent assumption that the only possible genders are the binary, discrete, exclusive, and exhaustive kinds men and women. Questions concerning mediated causal effects are of great interest in psychology, cognitive science, medicine, social science, public health, and many other disciplines. For instance, about 60% of recent papers published in leading journals in social psychology contain at least one mediation test (Rucker, Preacher, Tormala, & Petty, 2011). Standard parametric approaches to mediation analysis employ regression models, and either the “difference method” (Judd & Kenny, 1981), more common in epidemiology, or the “product method” (Baron & Kenny, 1986), more common (...) in the social sciences. In this article, we first discuss a known, but perhaps often unappreciated, fact that these parametric approaches are a special case of a general counterfactual framework for reasoning about causality first described by Neyman (1923) and Rubin (1924) and linked to causal graphical models by Robins (1986) and Pearl (2006). We then show a number of advantages of this framework. First, it makes the strong assumptions underlying mediation analysis explicit. Second, it avoids a number of problems present in the product and difference methods, such as biased estimates of effects in certain cases. Finally, we show the generality of this framework by proving a novel result which allows mediation analysis to be applied to longitudinal settings with unobserved confounders. (shrink)

Despite striking similarities, the connection between Madhyamaka Buddhism and Richard Rorty’s philosophy has been almost entirely ignored. This article aims to correct this oversight by suggesting that much could be gained by exploring their connection. It does so, first, by establishing the similarities and differences between Rorty and Madhyamaka, and second, by demonstrating that Madhyamaka vocabulary can solve significant problems in Rorty’s thought. In particular, the article will argue that Madhyamaka can alleviate the tension between irony and liberalism, by showing (...) that internalisation of anti-essentialism induces liberal sentiments. This allows us to conceive of irony and solidarity as existing in harmony and mutual dependence, without attempting to reconcile them theoretically. In doing so, this article provides the basis for a cross-cultural conception of anti-essentialist ethics. (shrink)

Recent work in psychology on ‘cultural cognition’ suggests that our cultural background drives our attitudes towards a range of politically contentious issues in science such as global warming. This work is part of a more general attempt to investigate the ways in which our wants, wishes and desires impact on our assessments of information, events and theories. Put crudely, the idea is that we conform our assessments of the evidence for and against scientific theories with clear political relevance to our (...) pre-existing political beliefs and convictions. In this paper I explore the epistemological consequences of cultural cognition. What does it mean for the rationality of our beliefs about issues such as global warming? I argue for an unsettling conclusion. Not only are those on the ‘political right’ who reject the scientific consensus on issues like global warming unjustified in doing so, some of those on the ‘political left’ who accept the consensus are also unjustified in doing so. I finish by addressing the practical implications of my conclusions. (shrink)

Many have rejected contextualism about ?knows? because the view runs into trouble with intra- and inter-contextual disagreement reports. My aim in this paper is to show that this is a mistake. First, I outline four desiderata for a contextualist solution to the problem. Second, I argue that two extant solutions to the problem fail to satisfy the desiderata. Third, I develop an alternative solution which satisfies the four desiderata. The basic idea, put roughly, is that ?knowledge? ascriptions serve the function (...) of recommending good informants, and disagreement over ?knowledge? ascriptions is a matter of conflicting recommendations. The upshot is that intra- and inter-contextual disagreement reports provide little?if any?reason to reject contextualism. (shrink)

Epistemic contextualists think that the extension of the expression ‘knows’ depends on and varies with the context of utterance. In the last 15 years or so this view has faced intense criticism. This paper focuses on two sorts of objections. The first are what I call the ‘linguistic objections’, which purport to show that the best available linguistic evidence suggests that ‘knows’ is not context-sensitive. The second is what I call the ‘disagreement problem’, which concerns the behaviour of ‘knows’ in (...) disagreement reports. These may not be the only objections to epistemic contextualism, but they are probably the most influential. I argue that the best current epistemic contextualist response to the linguistic objection is incomplete, and I show how it can be supplemented to deal with the full range of linguistic objections. I also develop a new solution to the disagreement problem. The upshot is that neither sort of objection gives us any reason to reject epistemic contextualism. This conclusion is, in a sense, negative—no new arguments for epistemic contextualism are advanced—but it’s a vital step towards rehabilitating the view. (shrink)

This article proposes an analytical approach to algorithms that stresses operations of folding. The aim of this approach is to broaden the common analytical focus on algorithms as biased and opaque black boxes, and to instead highlight the many relations that algorithms are interwoven with. Our proposed approach thus highlights how algorithms fold heterogeneous things: data, methods and objects with multiple ethical and political effects. We exemplify the utility of our approach by proposing three specific operations of folding—proximation, universalisation and (...) normalisation. The article develops these three operations through four empirical vignettes, drawn from different settings that deal with algorithms in relation to AIDS, Zika and stock markets. In proposing this analytical approach, we wish to highlight the many different attachments and relations that algorithms enfold. The approach thus aims to produce accounts that highlight how algorithms dynamically combine and reconfigure different social and material heterogeneities as well as the ethical, normative and political consequences of these reconfigurations. Within the sporting landscape much has changed from the proliferation and integration of new technologies, for example, the practice of mixed martial arts (MMA) has developed on the fringes of modern sport. It combines several martial arts, is practised in a cage, and allows ground strikes. MMA is presented here within a framework inspired by Norbert Elias’s theory of civilizing of aggressive impulses through sport. This essay concerns the disputed nature of the telos in Stoicism and argues that Michel Foucault’s description of the Stoic telos plausibly constitutes an accurate characterization, despite the frequent criticism it has received and the fact that it apparently neglects the important role of nature or physics in Stoicism. To advance this claim, the essay draws upon a neglected set of observations made by Foucault inThe Hermeneutics of the Subject, in which the telos is characterized in terms of the elimination (...) ofstultitia, or “indecision.” Once we analyze indecision and its causes from the perspective of physics, we can see that indecision is incompatible with the Stoic telos as standardly described, for example as “life in accord with nature.” It can be concluded that the Foucault’s view is not only plausible but is in fact supported by Stoic physics. Nanotechnology is a subject about which we know less than we should, but probably more than we think we do at first glance. Like Defense Secretary Donald Rumsfeld's “known unknowns,” we have learned enough to know what we should be concerned with. Glimmers of risk cropped up recently when German authorities recalled a bathroom cleansing product, “MagicNano,” that purported to contain nanosized particles and was on the market for only three days. More than one hundred people suffered severe respiratory problems (...) – six of whom were hospitalized with pulmonary edema. Although a subsequent analysis of MagicNano found that the nanoliquid ingredient morphed in the production into “supersized” particles, the recall nonetheless turned a white hot spotlight on the risk of NSPs. Latching onto the risks posed to workers producing materials using nanotechnology, the Washington Post has labeled nanotechnology a “seat-of-thepants occupational health experiment.”. (shrink)

This article teases out the relationship between family form and the state's social safety nets around healthcare, showing the deep unfairness of measuring social safety nets by whether a couple marries. By continuing to tie healthcare benefits to specific family structures, we perpetuate the “galloping” inequality marking America today.This article concludes that, whatever happens with the thousands of benefits given to married couples in other domains, social policy should move beyond marriage with respect to healthcare. Delinking support for healthcare coverage (...) and services from family form is just, better assists struggling families, and is in our collective self-interest. (shrink)

During the last 25 years, rape law has undergone a profound transformation, as the articles in this symposium clearly show. To mention just three of the more striking doctrinal reformations: All states have repealed the most egregious aspects of die marital rape exception; most have abandoned the “utmost resistance” requirement; and all have enacted rape shield laws to protect complaining witnesses from intrusive inquiries into their sexual history. All three reforms were the product of feminist agitation, all three were aimed (...) toward the general end of redirecting rape law toward the protection of women's, rather than men's, interests, and all three did, to some degree, broaden and democratize the scope of the law's protection: Wives, prostitutes, promiscuous girls, and women not inclined to risk their deaths by fighting off their rapists “to the utmost” are now protected by the law of rape against sexual assault, at least in theory, and at least to the same degree as non-wives and non-prostitutes, fighters, and virgins. All of this, virtually every contributor to this symposium agrees, is very much to the good. (shrink)

Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

WHEN ON AN ordinary Sunday morning in any Catholic church, women sign themselves with the cross, eciting the Trinitarian names of Father, Son, and Holy Spirit as they do it, are they unwittingly, or perversely, conspiring in their own oppression and suffering? What of their prayers to God the Father, (...) or to Jesus their Lord and brother, or their communion with him in the sacrament of the Eucharist? Or what of their salutation and veneration of Mary, called the Blessed Mother? She Who Is begs these particular questions because its author has neglected to consider the import of the Christian sacramental life as she forms a theology which primarily aims to benefit women. But the ·entire direction of the work makes it hard to conclude anything but that the answer to the above would be "yes." Women who profess and practice a Catholicism unreformed by feminist theory must by implication be deluded (at best) or malicious (at worst) because they have failed to realize the connection, personal and communal, between a " classical theism " which has produced masculinized language for God supported by a consonantly oppressive institution, and the worldwide political and economic domination which has yielded massive human suffering, most notably among women. Of course, this connection is only hinted at in the book; references to political realia are allusions only, such as in the following evocation of a feminine God's revolutionary power: [The theological symbol of] She Who Is challenges every structure and attitude that assigns superiority to ruling men on the basis of their supposed greater godlikeness. If the mystery of God is no longer spoken about exclusively or even primarily in terms of the dominating male, a forceful linchpin holding up structures of patriarchal rule is removed (p. 243). The book's actual purpose is to promote a revisionist theological (or thealogical) language in order to repair the damage purportedly done to women by centuries of the other. If the pretended area of discussion is the language we employ to designate the mystery of the Godhead, the actual theater of operations is the language used in the church to communicate the faith and to evangelize. Johnson's book wishes to promote, not primarily theological reflection, but a program of revision in which-based on the premise that since God is unknowable, one set of terms is as good as another-" masculine " language for God will give way to feminized language, in which the deity appears in the image of the female human being. As opposed to the projected imago viri who presides over creation as a remote and unresponsive God, the mother God of Johnson's proposal is essentially a manifestation of the eternal feminine : in a panentheistic theology, She Who Is both plays and suffers with her wounded creatures. When She is recognized, Johnson asserts, " theology will have come of age." Not only that, but justice is more likely to be accomplished on earth. But will the faith of those women, not all of whom are subservient, who live and thrive within the Catholic tradition, have been counted? This is unlikely, because those who have not experienced the feminist "awakening" are in the view of this book primarily missionary objects who remain to be converted. Women who are unaware of their oppression by " classi- SHE WHO IS 325 cal theism " are presumably afflicted by the " false consciousness " with which leftists of this century have characterized those potentially liberated souls who have not yet realized their enslavement. Chalmers is right: we should expect our civilization to, within centuries, have vastly increasedmental capacities, surely in total and probably also for individual creatures and devices.We should also expect to see the conflicts he describes between creatures and devices with more versus less capacity. But Chalmers' main prediction follows simply by extrapolating historical trends, and the conflicts he identifies are common between differing generations. There is value in highlighting these issues, but once one knows of such simple extrapolations and standard (...) conflicts, it is hard to see much value in Chalmers' added analysis. (shrink)

A formal system for Ł ${}_{\infty}$ , based on a "game-theoretic" analysis of the Łukasiewicz propositional connectives, is defined and proved to be complete. An "Herbrand theorem" for the Ł ${}_{\infty}$ predicate calculus (a variant of some work of Mostowski) and some corollaries relating to its axiomatizability are proved. The predicate calculus with equality is also considered.

In her paper “Democracy, Public Policy, and Lay Assessments of Scientific Testimony” Elizabeth Anderson (2011) identifies a tension between the requirements of responsible public policy making and democratic legitimacy. The tension, put briefly, is that responsible public policy making should be based on the best available scientific research, but for it to be democratically legitimate there must also be broad public acceptance of whatever policies are put in place. In this chapter I discuss this tension, with a strong focus on (...) the issue of climate change. My aims are twofold. First, I argue that the tension is harder to resolve than Anderson supposes because some ways of securing acceptance for science-based policies will themselves be democratically illegitimate. Second, I take a closer look at the role intellectual autonomy plays in the tension. Many think that what I call “science marketing” methods for securing broad(er) acceptance of scientific claims are illegitimate because they infringe on our intellectual autonomy. I argue that it is less clear that this is true than many suppose. This is because, put roughly, judicious use of targeted science marketing methods need not stop us from developing the ability to think about scientific issues for ourselves. In fact, they may even aide us in developing this ability. While this doesn’t quite resolve the tension identified by Anderson, it does some of the necessary groundwork for resolving it. (shrink)

Incluso aquellas teorías rivales que descuentan algunos intereses necesitan una clara comprensión de la naturaleza de los intereses que están dispuestos a desechar. 2. Los intereses afectados incluyen los intereses futuros de (...) personas actuales y de fetos humanos, además de aquellos relativos a criaturas actuales no humanas, y también los de personas futuras y otras criaturas que no pueden ser reconocidos todavía. Las acciones humanas jugarán un importante rol a la hora de determinar no sólo qué humanos existirán, sino incluso qué no-humanos; podemos incluso influir considerablemente en la calidad de vida de todos ellos, y asumir así responsabilidades en relación a los impactos previsibles resultantes de nuestras acciones. 3. Las emisiones requeridas para el desarrollo del Tercer Mundo necesitan ser contrapesadas con la reducción de emisiones en los países desarrollados. El consecuencialismo biocéntrico genera así políticas defendibles. También, como Brown subraya, los países desarrollados tienen obligación de apoyar un estricto acuerdo internacional sobre el cambio climático, con cuotas nacionales basadas en habilitaciones a una igual cantidad de emisiones per capita para todo planeta. Necesitamos urgentemente un acuerdo global y amplio sobre cambio climático que disponga sobre adecuación medioambiental, equidad y justicia tanto en lo relativo a la adaptación como a la mitigación. Sin embargo, los obstáculos para conseguirlo siguen siendo muy considerables y la satisfacción de dichos criterios éticos superó el ámbito de lo posible en la Conferencia de Cancún de 2010, incluso para quienes lucharon por ello. En estas circunstancias, no deja de ser impresionante tanto lo que se ha conseguido como la (...) restauración de la deriva hacia un eventual acuerdo tras el fracaso de la Conferencia de Copenhague en 2009. Si lo evaluamos de acuerdo a criterios éticos relevantes, la Cumbre de Cancún fue muy deficiente y algunos de los participantes en la misma merecen desaprobación moral. No obstante, aquellos participantes que fueron con el propósito de conseguir un acuerdo satisfactorio ecológicamente y también en términos de justicia distributiva, no tendrían por qué recriminarse nada a si mismos. Particularmente en cuanto han restaurado la esperanza de lograr más progresos en la Conferencia de Durban en 2011, o donde fuere, en el futuro inmediato. (shrink)

The validity of the fruit‐fly as a model of human disease has been confirmed in a striking way by Green and colleagues.1 They show that the mutations causing a necrotic disease phenotype in Drosophila, precisely mirror those resulting in a group of well‐studied but perplexing diseases in the human. These diseases, ranging from thrombosis to dementia, arise from mutations causing a conformational instability of serpin protease inhibitors. The findings provide clues as to the unusual severity and variable onset of such (...) conformational diseases and demonstrate the potential of Drosophila as a model for their future study. Saltman and Goodman show how corporate-produced curricula, films, and corporate-promoted books often use depictions of family love, childhood innocence, and compassion in order to sell the public on policies that ironically put the profit of multinational corporations over the well-being of people. In doing so, the authors reveal the extent to which globalization depends upon education and also show how battles over culture, language, and the control of information are matters of life, death, and democracy.
