Moral agency is limited, imperfect, and structurally constrained. This is evident in the many ways we all unwittingly participate in widespread injustice through our everyday actions, which I call ‘structural wrongs’. To do justice to these facts, I argue that we should distinguish between summative and formative moral criticism. While summative criticism functions to conclusively assess an agent's performance relative to some benchmark, formative criticism aims only to improve performance in an ongoing way. I show that the negative sanctions associated (...) with summative responses are only justifiably imposed under certain conditions when persons exercise their agency wrongly — conditions that do not always hold for structural wrongs. Yet even in such cases we can still use formative responses, which are warranted whenever agents fall short of moral ideals. Expanding our repertoire of moral criticism to include both summative and formative responses enables us to better appreciate both the powers and limitations of our agency, and the complexity of moral life. The first principle of chemical composition is that elements are actually present in their compounds. It is a golden thread running through the history of compositional thinking in chemistry since before the chemical revolution. Opposed to this principle, which I call Actually Present Elements (APE), is the idea that elements are merely potentially present in their compounds: although not actually present, it is possible to recover them. In this paper I follow that golden thread, and then discuss the status of (...) APE itself: is it true? What arguments were there for it, and when? I argue that APE is a metaphysical principle, albeit at a lower level of generality and abstraction than the term ‘metaphysical’ usually suggests. I critically examine a range of different views on how metaphysical principles might be involved in research programmes in empirical science, and conclude by endorsing Elie Zahar’s view that metaphysical principles such as APE are to be found at the very heart of science. Moreover, they can be recipients of empirical support just like other parts of scientific theory. (shrink)

This paper investigates whether gender affects ethically sensitive decisions of a personal or business nature. Data from 51 practicing accountants from both public accounting and private industry suggest that while differences exist between female and male accountants in responses to specific situations, overall responses are quite similar. Statistically significant differences were found for only five of the sixteen ethically sensitive situations. Further, when personal and business situations of a similar nature were paired together, two of the eight differences between personal (...) and business responses were significantly different between females and males. Taken as a whole, the results refute the suggestion that the ethical decision making of organizations may be enhanced as more women enter the business field. (shrink)

One of the most important students of Franz Brentano was Anton Marty, who made it his task to develop a philosophy of language on the basis of Brentano’s analysis of mind. It is most unfortunate that Marty does not receive the attention he deserves, primarily due to his detailed and distracting polemics. In the analysis presented here his philosophy of language and other aspects of his thought, such as his ontology , are examined first and foremost in their positive rather (...) than critical character. The analysis is moreover supplemented by translations of four important works by Marty, including his entire work On the Origin of Language. These are in fact the first English translations of any substantial writings by him. The resulting picture that emerges from the analysis and translations is that Marty has much to say that proves to be of enduring interest for the philosophy of language on a range of topics, especially the meanings of statements, of emotive expressions, and of names as regards both their communicative and their ontological aspects. For sociologist Emile Durkheim, the “sacred” constitutes all those things “set apart and forbidden.” Within Evangelical Christianity, and to a lesser degree Protestantism in general, the sacred has arguably centered on the individual believer and her/his personal relationship with God and scripture. Recently, however, a growing movement within Evangelical Christianity has emphasized the sacred nature of relationships and community, culminating in the mantra “God is love.” This shift has set community above the personal in the hierarchy of sacred Evangelical things, (...) and is reminiscent of earlier progressive forms of Evangelicalism, such as Social Gospel Christianity. Rob Bell, an Evangelical author, pastor, and Oprah Network star, possibly best exemplifies this change and its ramifications, which extend from a postcolonial critique of mission work and evangelism to a move to more inclusive and even Universalist soteriology. The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

To address longstanding workforce shortages, increase efficiency and control the costs associated with the modern health-care provision, there has been a worldwide policy to promote increased flexibility within the health-care workforce. This is being done primarily by extending the ‘scope of practice’ of existing occupational roles into what is referred to as ‘advanced’ practice. The development of the advanced practice nurse (APN) has occurred within the context of a shortage of medical staff, and the need to control cost. However, the (...) means by which substantially repurposed occupational groups such as these, are incorporated into complex, hierarchical organisations such as the UK national health service (NHS) remains poorly understood. Using modern sociological theory, the development of the APN role has been examined in terms of power, control, professional identity and gender relations. Each of the theoretical approaches used adds to the quality of the discussion, although none provide a comprehensive picture. However, when synthesised, they do provide an enhanced insight into the evolution of the role. It is argued here that by critically examining the development of the APN role, this will enable both a better understanding of, and the means to influence, its future direction of travel. (shrink)

While Hermann Lotze's philosophy was widely received all over the world, his views on abstraction and Platonic ideas are of particular interest because they were to a large extent adopted by one of the most eminent philosophers of the twentieth century, namely Edmund Husserl. In this paper these views are examined in three distinct aspects. The first of these aspects is to be found in Lotze's thesis that there is a mental process, prior to abstraction, whereby "first universals" are apprehended. (...) The second one lies in his view that there is yet a higher level of apprehension, as found in the process of abstraction itself. According to Lotze, abstraction is not to be identified with the mere removal of particular features, but rather the replacement of these with first universals, resulting in "general images" and ultimately concepts. In addition to Lotze's analysis of the cognition of universals, there is finally a third thesis (an ontological one) which is examined in this paper, namely that the universals are Platonic Ideas in the sense that they have "validity" (Geltung) independently of their corresponding particulars and also of the mind which grasps them. The three claims in question are examined here in detail. Also, an attempt is made to point out some of the connections between Lotze and Husserl on the topic under discussion. (shrink)

The concept of sustainable development of the Brundtland Report and the related one of the Rio Declaration are interpreted differently by United Nations agencies, NGOs and business corporations. What should really be sustained includes quality of life; this requires sustainable natural systems and social systems. Living within our carbon budget is a prominent example. The management of resources on others’ behalf should share with ‘stewardship’ characteristics of care for what is intrinsically valuable, and responsibilities not only to owners but also (...) towards present and future people and other creatures. Reasons are considered for holding capitalist companies and capitalism itself to be unsustainable, such as its inbuilt imperative of growth. Sustainability cannot wait for a different system, as by then serious climate change will be irreversible. Carbon footprints need to be limited now. Practical measures include not blocking transitional steps, and finding innovative ways to reduce one’s company’s carbon footprint. (shrink)

Abstract:In this paper we develop a categorization scheme for stakeholder research based on differences in studies’ primary level of analysis (managerial agency, organizational, or societal) and use this scheme to review and critique genres of stakeholder-based accounting research. We draw three primary conclusions: 1) stakeholder research in accounting should more clearly incorporate the business ethics stakeholder literature, 2) ethical issues are much less likely to be considered in stakeholder-based accounting research when a managerial agency level of analysis is adopted, and (...) 3) the accounting discipline can learn from debates within the business ethics literature concerning shareholder dominance and stakeholder legitimacy. These conclusions, taken together, demonstrate the need for accounting researchers to become more focused on ethical considerations in the design of accounting information systems, performance measurement criteria, and financial reporting models. Jenkins and Sherman hold that belief in the value of work is artificially inculcated and that a ‘leisure society’ is desirable and possible, as well as being necessitated by the introduction of microprocessors. After distinguishing between meaningful work and labour (first section), I reply obliquely to their case by contending that meaningful work affords most people their best chance of the necessary good of self-respect (second section), and that it constitutes the exercise of an essential human capacity, the development of (...) which is necessary to human wellbeing (third section). Because of the contingent connections between employment on the one hand and meaningful work and self-respect on the other, we should recognise the value of work and plan for full employment (fourth section). La théorie du jugement était une des préoccupations de Husserl depuis la toute première période de sa carrière. Ses premières recherches dans ce domaine se trouvent dans deux manuscrits rédigés en 1893 et 1893-1894 et publiés dans le volume XL des Husserliana . Dans cet article, j’examinerai la théorie du jugement dans ces manuscrits en relation aux questions suivantes : 1) les jugements en relation aux représentations ; 2) les assomptions comme des actes qui se déroulent parallèlement aux jugements ; (...) 3) les jugements impropres en tant que distincts des jugements propres ; 4) les jugements objectifs ; 5) les états de choses en tant que corrélatifs des actes de juger. Nous verrons que, tandis que Husserl se libère à maints égards de la théorie du jugement de Brentano qu’il avait apprise à Vienne puis à Halle, ses positions sont en même temps tout à fait représentatives de la phénoménologie autrichienne dans la mesure où elles impliquent à la fois une psychologie descriptive et une théorie de l’objet, bien que sans aucune prétention d’établir une nouvelle méthode en philosophie.The theory of judgment was one of Husserl’s concerns from a very early period of his career onward. His early investigations in this area are to be found in two manuscripts which he wrote in 1893 and 1893/94, which have been published as Text Nr. 1 and Text Nr. 2 of Husserliana XL. In this paper I examine the theory of judgment in these manuscripts with regard to the issues of 1) judgments in relation to presentations, 2) assumptions as acts which run parallel to judgments, 3) improper judgments as distinct from improper ones, 4) objective judgments, and 5) states of affairs as correlatives of judging acts. While we see Husserl freeing himself in many respects from the Brentanian theory of judgment which he had learned in Vienna and again in Halle, it is at the same time seen that Husserl’s views are quite representative of Austrian phenomenology insofar as they involve both descriptive psychology and object-theory, though without any pretense of establishing a novel method of philosophy. Why do feminist philosophers read Kant? Because of his misogyny and his disdain for the body, Barbara Herman has described Kant as the modern moral philosopher whom feminists find most objectionable. But that unhappy status alone would not justify a separate entry on Kant in this volume. Immanuel Kant is the figure in modern philosophy who most clearly articulates the Enlightenment program that reason is the vehicle for humanity's progress towards emancipation from unjust authority, a program that epitomizes the self‐understanding (...) of the Western culture of modernity. Kant's paradigm of objectivity, which formalizes the universal and necessary conditions for knowledge, provides a philosophical justification for the view that cognitive and moral judgments must be disinterested and impartial. This assumption about the impartiality of knowledge is deeply entrenched in academic disciplines. The quest for objectivity undergirds prevailing methodologies in the natural and social sciences as well as in philosophy. The assumption that knowledge is impartial informs the practices of daily life as well – e.g., in how one evaluates newspaper reporting or jury decisions. Feminist philosophers seek to come to terms with these features of modernity. They debate whether Enlightenment conceptions of progress and rationality offer tools for women's emancipation and empowerment, or whether this philosophical inheritance itself has contributed to the historical subordination of women in Western society. We use these games to show, for γ ≥ 5 and any class K of relation algebras satisfying RaRCAγ ⊆ K ⊆ ScRaCA₅, that K is not closed under subalgebras and is not elementary. For infinite γ, the inclusion RaCAγ ⊂ ScRaCAγ is strict. For infinite γ and for a countable relation algebra A we show that A has a complete representation if and only if A is atomic and Ǝ has a winning strategy in F(At(A)) if and only if A is atomic and A ∈ ScRaCAγ. What emerges in Fischer’s phenomenological aesthetics is clearly the view that empathy is absolutely crucial not only to the apprehension of the aesthetic object, but also to the enjoyment of it. While this position certainly has merits, I have argued that in some ways his phenomenological description leaves something to be desired. This was particularly seen in his claim that empathy can never be described as an intuitive presentation of feeling. Perhaps another criticism which can be added here is be (...) found in a consideration of abstract works of art. In the case of these it would seem that empathy plays a much smaller role than it does in the apprehension of other aesthetic objects, especially works of art of other kinds. This is not to say that empathy could play no role at all in the apprehension of abstract works of art, for we may keep in mind that Fischer formulates the notion of mechanical empathy whereby one empathetically grasps power and other phenomena which are analogues of the will. It remains to be seen in the further development of a phenomenological aesthetics whether the notion of empathy can be applied in any other way in such cases. (shrink)

Foucault has been criticized for overlooking the similarities among Platonism, Christianity and Stoicism, and overstating Stoicism’s distinctness. However, an examination of Stoic theories of truth shows that the Stoics sought out a particular kind of knowledge, and that this knowledge was necessarily sought by means of a certain circular process, to which Foucault himself vaguely alludes. This accounts for many of Foucault’s observations, and explains why, even when Stoics speak about such topics as self-knowledge and self-renunciation in ways that recall (...) Platonism and Christianity, their approach is rightly characterized as differing from that of their Platonic and Christian counterparts. Ultimately, this sheds light on Stoicism’s import for politics. In short, only by the Stoic will the search for truth be carried out in such a way that the individual’s identity will neither reinforce, nor be reinforced by his or her grasp of the truth; and this will uniquely prepare the Stoic to enter the political domain and to be recognized there as someone who speaks the truth.
