Global Prescriptions scrutinizes the movement to export a U.S.-oriented version of the " rule of law," found in the activities of philanthropic foundations, the World Bank, the U.S. Agency for International Development, and several other developmental organizations. Yves Dezalay and Bryant G. Garth have brought together a group of scholars from a variety of disciplines--anthropology, economics, history, law, political science, and sociology--to create tools for understanding this movement. Comprised of two sections, the volume first develops theoretical perspectives key to an (...) understanding of the production and impact of new "global legal prescriptions." The second part shifts attention to the national importation of these legal orthodoxies. In a recent paper in this journal, David Chalmers introduced the meta-problem of consciousness as “the problem of explaining why we think consciousness poses a hard problem” (Chalmers, 2018, p. 6). A solution to the meta-problem could shed light on the hard problem of consciousness. In particular, it would be relevant to elucidate whether people’s problem intuitions (i.e. intuitions holding that conscious experience cannot be reduced to physical processes) are driven by factors related to the nature of consciousness, or rather (...) by factors that are independent of consciousness. Whether people hold problem intuitions, and what factors drive those intuitions, are largely empirical questions. However, there is a lack of empirical research on these issues to date. The results of four studies will show that (1) problem intuitions are not widespread, and (2) when they arise, they do so because of factors that are unrelated to the nature of consciousness. This suggests that consciousness is, after all, not so problematic. (shrink)

Emergency situations require individuals to make important changes in their behavior. In the case of the COVID-19 pandemic, official recommendations to avoid the spread of the virus include costly behaviors such as self-quarantining or drastically diminishing social contacts. Compliance (or lack thereof) with these recommendations is a controversial and divisive topic, and lay hypotheses abound regarding what underlies this divide. This paper investigates which cognitive, moral, and emotional traits separate people who comply with official recommendations from those who don't. In (...) four studies (three pre-registered) on both U.S. and French samples, we found that individuals' self-reported compliance with official recommendations during the COVID-19 pandemic was partly driven by individual differences in moral values, disgust sensitivity, and psychological reactance. Can we experience emotion without the feeling of accelerated heartbeats, perspiration, or other changes in the body? In his paper “What is an emotion”, William James famously claimed that “if we fancy some strong emotion and then try to abstract from our consciousness of it all the feelings of its bodily symptoms, we find we have nothing left behind” (1884, p. 193). Thus, bodily changes are essential to emotion. This is known as the Subtraction Argument. The Subtraction Argument is still (...) used to support Embodied theories of emotion. Proponents of Disembodied theories, however, have different intuitions regarding the role of bodily changes in the experience of emotion. In order to advance this debate, I conducted a series of studies testing people’s intuitions regarding the Subtraction Argument. Results show that, against James’ claims, most people consider that their hypothetical (Study 1) and actual (Study 2) emotions persist in the absence of bodily feelings. Furthermore, Study 1 found that participants’ responses were not related to individual differences in reflection or interoceptive awareness. These results pose a problem for Embodied theories of emotion and challenge extant explanations for the persistence of emotional experience in cases of impaired interoception. (shrink)

Despite the centrality of the topic for the debate on sustainability, future generations have largely been ignored by business ethics. This neglect is in part due to the enormous philosophical challenges posed by the concepts of future generations and intergenerational duties. This article reviews some of these difficulties and defends that much clarity would be gained from making a distinction between future generations and the next generations. It also argues that the concept of next generations offers a better starting point (...) for business ethics to incorporate the topic in its research agenda. We then suggest four potential pathways to explore this territory. The four approaches build on the notion of organizations as communities with memory and vision, on the narrative shape of organizational life, on the affinity of stakeholders with the next generation, and on systems of indirect reciprocity. These first two approaches are connected to communitarian approaches to business ethics, and the last two engage in a dialog with contractarian views and stakeholder theory. Sin embargo, en ésta se revela, también, el olvido de aquella función esencial y de la reducción de la filosofía a una labor de exégesis de textos que no se articulan con el acontecer histórico. Ao longo da história da filosofia, John Locke tem sido frequentemente associado à tradição do liberalismo político, o que decorre, invariavelmente, de um modo peculiar de interpretação da noção de liberdade para o filósofo, que estaria estruturada em torno da ideia de não-interferência. Derivada frequentemente de propostas analíticas realizadas em um “vácuo histórico”, em que as ideias de Locke são tomadas como uma estática coleção, tal conclusão expressa uma perspectiva que não considera o caráter essencialmente discursivo da filosofia política e (...) o “campo problemático” em que os conceitos foram pensados pelo filósofo. Diante dessa perspectiva, o propósito deste artigo é o de realçar, na linguagem política utilizada pelo filósofo, os elementos contextuais que permitem a compreensão dos argumentos desenvolvidos pelo autor como parte de uma _performance_ – na acepção proposta por John Pocock –, a fim de destacar os aspectos que indicam a possibilidade de aproximação do conceito de liberdade de Locke da ideia de liberdade republicana, descrita por Philip Pettit a partir da ideia de não-dominação, sem descuidar da análise das evidências textuais que indicam a presença de argumentos na obra do autor que compõem o cerne da concepção republicana de liberdade. Este artículo tiene por objeto explicar cuándo en el estado de necesidad la distinción entre un mal mayor o menor responde al universo ético consecuencialista y desde qué consideraciones no lo haría; segundo, explicar por qué es posible desde el principio del doble efecto la ponderación de la vida humana, aceptando la objetivización de sus parámetros según los efectos de una acción. Por ello, a continuación trataremos en la primera sección el concepto de mal en clave consecuencialista y, posteriormente, moral (...) absolutista. Se trata de un análisis sobre la materia que reconoce, en la segunda sección, la importancia de la existencia de estos universos en la ponderación de males. Luego, contrastaremos nuestros razonamientos con las soluciones que, para casos semejantes, se proponen desde el doble efecto para algunas situaciones de estado de necesidad. Finalmente, en la tercera sección, entregaremos los criterios de una política criminal para distinguir y no encubrir exigencias deónticas en el estado de necesidad. (shrink)

Despite its many virtues it has at least one major difficulty: it implies a sharp separation between experience and language. This essay aims to bridge this gap, while preserving the positive aspects of Ankersmit’s theory. To do this, I will first present the ontological and epistemological implications of Ankersmit’s notion of historical experience. Next, I will present my (...) objections to his idea. Finally, I will propose two modifications to his notion of historical experience: first, in the epistemological sense by considering historical experience as a form of Louis Mink’s configurational comprehension and, second, in the ontological sense by relating historical experience with the _vitalist_ ontology of José Ortega y Gasset. Axel Honneth considers the contemporary political scenario in terms of a struggle for recognition among different individual or collective identities. But if recognition is based on a normative framework of intelligibility, then it can only be sensitive to those political claims that are already identified by that framework. Then the recognition paradigm is limited in terms of the possibility of making visible claims that are not intelligible. This paper discusses Honneth’s conception of recognition through two different authors and traditions: on (...) the one hand the paper uses Judith Butler's conceptions of ‘recognizability’ and ‘apprehension’ in order to re-think recognition in the political domain and, on the other hand, it uses Lacan’s conception and criticism of the recognition paradigm to argue with Honneth in the psychoanalytical domain. So, the main hypothesis of this paper is that a certain re-reading of Gorgio Agamben’s conception of testimony through Judith Butler’s criticism of the recognition paradigm can produce a new approach to exclusion in the political field as well as in psychoanalytical practice. In this sense, the act of witnessing would be a type of recognition that, instead of confirming the intelligibility framework, performs and offers to the excluded the limit of the framework. The paper introduces a new problem for fallibilist and infallibilist epistemologies – the diachronic threshold problem. As the name suggests, this is a problem similar to the well–known threshold problem for fallibilism. The new problem affects both fallibilism and infallibilism, however. The paper argues that anyone who worries about the well known problem for fallibilism should also worry about this new, diachronic version of the problem.

O artigo analisa a contribuição original da obra “A Condição Humana” para a redefinição do significado político da liberdade em suas determinações democráticas fundamentais e para a crítica da desmundanização como a base comum sobre a qual se fundam as nossas mais recentes experiências políticas: a destruição inédita do mundo comum no totalitarismo e a hegemônica despolitização liberal das atuais democracias formais de massa e mercado que atrofiam a esfera política da ação e do discurso.

Na história educacional, em particular nos PCNS (1997), a ética adquire o status de tema transversal para uma educação básica de qualidade, quando são inseridos os conceitos de justiça, dialogo, afetos e emoções, reciprocidade, diálogo e racionalidade enquanto conteúdos comuns para as práticas pedagógicas e para os conhecimentos específicos das disciplinas. Na BNCC, a referência exata a esse conceito se faz nas competências gerais 6, 7, 9 e 10, como também, na menção do termo formação que está presente na introdução (...) dos tópicos que propõe bases para o pensar educativo das ciências humanas e sociais. Desta forma, a intenção é propor, pela filosofia de Jürgen Habermas, uma nova abordagem conceitual sobre ética presente na BNCC. A pesquisa se constitui por uma análise bibliográfica e interpretativa da Base Nacional Comum Curricular (BNCC), das obras de Jürgen Habermas e de artigos referentes à educação e agir comunicativo. Logo, no campo educacional, o conceito de ética, na BNCC, pode ter uma estruturação com indicações racionais e comunicativas, conteúdos possibilitados pelo filosofar brasileiro, e mobilização de conhecimentos a partir de princípios e lógicas de ordem geográfica e simbólica. Esta ordem tem como base procedimentos, conceitos e entendimentos intersubjetivos, dimensões que são conduzidas através de aprendizagens construídas pelo discurso, tanto em sua forma multidimensional como concordante entre os atores sociais. O artigo de Keith S. Donnellan “Reference and Definite Descriptions” (1966) foi escrito com a intenção de mostrar que as teorias de Bertrand Russell e Peter F. Strawson falham por igual em capturar o uso linguístico efetivo das descrições definidas. Contudo, situação se complica para Donnellan à luz do fato de que muitos usos concebíveis de descrições definidas não parecem caber em nenhuma das duas categorias. Há usos que devem ser entendidos antes como motivados pela deferência do que como atributivos, (...) assim como há usos em que variadas falências referenciais cometidas pelos falantes têm como consequência situações em que a descrição simplesmente não dá conta da variedade de possibilidades, vale dizer, casos em que não cabe falar nem em uso referencial nem em uso atributivo. A razão para tanto parece ser a de que dificilmente há um uso atributivo “puro”. As descrições usadas nos exemplos corriqueiros contêm normalmente elementos referenciais, como nomes e indexicais. Quando estes são mal empregados, a insuficiência da distinção de Donnellan é exposta. A segunda tese aqui apresentada é a de que os usos atributivos previstos no artigo clássico de Donnellan se caracterizam por sua natureza inferencial distintiva, com a consequência de que o seu uso atributivo é em geral menos natural e plausível do que o uso referencial. In this article, we seek to analyze some of the methodological assumptions that contribute to the understanding of Foucault’s nominalism, as well as some of the theoretical consequences of this nominalism. With this intent, in the first part, we deal with his “refusal” of universals, emphasizing the distinction, made in the first volume of the History of Sexuality, between sex and sexuality. Recent decades have seen a considerable and progressive increase in historical claims. Within the context of colonialism criticism, but also outside this sphere, numerous politicians, collectives and intellectuals have emerged to denounce certain acts of the past, demanding recognition and repentance that would compensate for these past affronts. In this article we will analyze one of these cases: the demand for an apology from Spain and the Vatican by the President of Mexico, López Obrador. Taking as a guide the debate (...) around the ethical problem of non-identity, we will see what ethical and metaphysical assumptions serve as the basis for these claims. We will also assess whether the claims of the so-called «historical victims» are consistent and ethically acceptable. (shrink)

Dionísio Exíguo, monge de Cítia, compôs em meados do século VI um conjunto de textos sobre o cálculo da Páscoa, depois reunidos numa obra intitulada De Paschate, na qual apresentou o calendário egípcio e a importância da “lua eclesiástica”. O De Paschate é constituído de uma tradução de textos, de uma tabela pascal e de um manual de argumentos sobre como saber a data do domingo de Páscoa. A pesquisa mostra a relação entre a epistemologia neoplatônica e as práticas litúrgicas (...) de Alexandria, a partir do termo “lua eclesiástica”, em meio às complexas relações entre as Igrejas Orientais, Roma e o Império, conforme a proposta metodológica da História da Ciência. A pesquisa encontra o significado desta lua perfeita, ou seja, livre das irregularidades do curso lunar ordinário, e apresenta a razão da escolha do calendário egípcio para a contagem pascal de todo o Império. Junto à pesquisa, foi elaborado uma tradução original do texto dionisiano para a língua portuguesa, com notas explicativas, de modo que favoreça o debate sobre a ciência medieval, sua epistemologia na História da Ciência. With this book we want to illustrate the way we philosophers think that public argument and debate should be. Our goal is not to present a collection of academic texts. Although most of us are part of the academy, we want to present to the lay public shorter, more essay-like texts, originally published on an Internet page called Refutations. The page is not, of course, an academic journal; it is a digital magazine with opinion texts that share simplicity, rigor and (...) total accessibility to anyone not initiated to the philosophers' way of thinking. And although the magazine's columnists are friends, they actively disagree on the most diverse topics, such as politics, economics, ethics and art. The reader, therefore, has before him a book with the most varied opinions on some of the main contemporary themes. Naturally, we do not expect to have the last word on any matter. Our intention is much more modest, but also very important: to show that it is possible, even without putting an end to the debates, to think in a creative, clear and civilized way. / Com este livro queremos ilustrar a maneira como nós, filósofos, pensamos que a argumentação e o debate públicos devem ser. Nosso objetivo não é apresentar uma coletânea de textos acadêmicos. Embora a maioria de nós seja parte da academia, queremos apresentar ao público leigo textos mais curtos e ensaísticos, originalmente publicados em uma página na Internet chamada Refutações. Un universo de críticas y encomios, diálogos constantes que se retroalimentan en respuestas y réplicas que podemos rastrear desde las mismas Acusaciones contra Sócrates de Polícrates y las respuestas de Jenofonte y Platón en sus sendas apologías. Es en esos intersticios en donde podemos reconstruir no solo a la figura de Sócrates, sino a la dinámica de su círculo, un grupo (...) extenso y variopinto signado tanto por las diferencias entre sí como por la devoción a su amigo y maestro. Esta cuestión es, precisamente, la que atraviesa el dossier. This article analyses some of the main aspects that characterize the genealogy of thought proposed by the so-called decolonial turn. The article focuses on a specific case: Walter Mignolo’s interpretation of the work of Guamán Poma de Ayala, Primer nueva corónica y buen gobierno (S. XVII). In this context, I will present a critique of the reduction made of Guamán to a frontier thinker whose hallmark would be to introduce the question of the coloniality of power. I will propose as (...) an alternative approach the study of Primer nueva corónica as a cultural product of the Euro-American archive. (shrink)

This paper offers a reflection on the complicated relationship between Derrida and Heidegger, particularly as concerns the issue of difference in their respective thoughts. Taking one of Geschlecht III’s most stunning passages as my point of departure, I walk the reader through some of Derrida’s own remarks on his relationship to Heidegger, before arriving at the différend that seems to exist between them as regards the notion of difference itself. I argue that the margins of Heidegger’s text inscribe a quite (...) radical thinking of difference not at all incompatible with Derridean différance. In conclusion, I turn to Heidegger’s “Anaximander Fragment” where, in the margins of Heidegger’s text, we find a marginal note that, given its content, could surely have been written by Derrida himself. Neste trabalho, pretendemos avaliar criticamente algumas das teses de John McDowellsobre a natureza da virtude, tal como expostas em seu artigo “Virtue and Reason” e, ao fazê-lo,expor algumas de suas limitações. Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. This article attempts to read the very concept of reading as articulated and problematized by Derrida’s newly discovered Geschlecht III. I argue that Derrida enacts a reading of Heidegger in Geschlecht III in ways that help us understand the strong sense Derrida gives this word. In the article’s first part, I dwell on Derrida’s—and Heidegger’s—methodological precautions that problematize the traditional concept of reading so as to open the way for a reading of Heidegger that does not bank on the metaphysical (...) presuppositions the very same Heidegger warns us against time and again. In the second part, I turn to Derrida’s topotypological examples that show us what traditional methodology problematically presupposes when “reading” Heidegger. The article ends by turning to the Derridean notion of “overprinting”—and the uncanny effects of doubling it implies—as a way to think about what it means to read and countersign Heidegger’s text. Entrevista con la filósofa argentina Silvia Schwarzböck.

Esta es una investigación cualitativa de tipo exploratorio, que tiene como objetivo examinar las Representaciones sociales acerca de la adopción en parejas sin hijos y con posibilidades de adoptar, para lo cual se aplicará una entrevista semiestructurada a 50 parejas, además de una ficha de caracterización sociodemográfica elaborada para esta investigación. Se concluye que las parejas tienen una representación sesgada de la adopción, y prejuicios respecto a la edad, la salud, la historia de los niños y niñas, que determinan las (...) resistencias y representaciones respecto a la adopción. Asimismo, las parejas anteponen el proyecto de vida personal, la estabilidad económica, dificultades en los procesos adoptivos, y supuestas preferencias por familias extranjeras, como criterios que dan forma a la resistencia a adoptar, aun cuando identifican que la adopción es un proceso necesario en la sociedad que debe ser fortalecido y asumido por más personas.
