It is fundamental that, in philosophy, we make sure that we are not mistaking merely verbal disputes, or “conceptual” disputes, for substantive ones. This essay presents a tripartite framework that is useful for clarifying cases where it is difficult to tell whether we are engaged in substantive or non-substantive disputes. For this purpose, the essay offers some combinatorial possibilities between the following levels: verbal, conceptual, and objectual. We need to distinguish whether we are arguing about the world, concepts, or words (...) to avoid talking at cross-purposes and to recognize when our disputes are not worth the time. Distinguishing between these three levels can also throw light and guide research on conceptual engineering, metalinguistic negotiations, metaontology, and so on. (shrink)

This paper examines ethical violations committed by Certified Public Accountants in Puerto Rico in the 2002–2010 period and the related disciplinary actions taken by the local regulatory bodies. The institutional settings for the accounting profession in PR are different from those of the United States. Ethical complaints are investigated by the PR Society of CPAs and evaluated based on the Code of Professional Conduct of the American Institute of Certified Public Accountants, although most CPAs in PR are not affiliated with (...) the AICPA. Our study is based on data provided by the PR Society of CPAs that is not publicly available. We examine the association between the occurrence of the ethical violations and certain variables such as gender, type of practice performed by the CPA, and whether the CPA participates in a peer review program. Results of a multiple correspondence analysis suggest that not being a member of the AICPA, practicing as a sole practitioner, and not participating in a peer review program seem to be more associated with the occurrences of ethical violations by CPAs. We compare our findings with prior research on ethical infractions committed by CPAs in the United States and find some differences attributable to the institutional settings in PR. Overall, our results suggest the importance of codes of conduct in the accounting profession and compliance with such ethical guidelines by practicing accountants. (shrink)

Colemanand Shapiro have recently advanced a second at- tempt to reconcile Hart’s practice theory of rules and the idea of the normativity of law; i.e., the idea that legal rules qua social rules give reasons for actions and, in some circumstances create and impose duties and obligations. Their argumentative strategy is to resort to elements in Bratman’s work on shared agency and planning, though they introduce important and substantive modifications to Bratman’s own explanation. Bratman describes his own theory as a (...) modest theory of the will where the notion of planning plays a fundamental role. Both Shapiro’s and Coleman’s application of Bratman’s planning theory of agency to an authority structure such as law is impressive, but a number of objections can be levelled, with the intention of grasping both the nature of authority structures and the normativity of law. Although I have referred to Shapiro’s and Coleman’s applica- tions as being similar to one another, the differences are sub- stantive and important. I will scrutinise both Shapiro’s and Coleman’s explanations of ‘shared agency’ and discuss the objections that can be raised against each application. (shrink)

Ziel dieses Aufsatzes ist es zu zeigen, daß das ontologische Grundschema von Leibniz eine eigenstandige Erneuerung der Aristotelischen Einteilung des Seienden ist. Die Erklärung der genauen Entsprechung zwischen beiden kategorialen Systemen soil dazu dienen, gewisse, heute weit verbreitete MiBverstandnisse zu korrigieren. Die Originalität von Leibniz in dieser Sache liegt darin, daß die von Aristoteles am Anfang der Kategorien aufgestellte vierfache Gliederung des Seienden im Lichte einer doppelten Unterscheidung zu sehen ist: in der ontologischen Unterscheidung zwischen konkreten und abstrakten Sachen und (...) in der logischgrammatikalischen Unterscheidung zwischen konkreten und abstrakten Termini. Als Konsequenz dieser Neuheit kann die Leibnizsche Klassifikation der Dinge einige Ungenauigkeiten vermeiden, in welche die Aristotelische Kategorienlehre verfällt. (shrink)

I argue that knowing and having points of view are fundamentally different epistemic states if we assume that having justified true beliefs is necessary for knowledge. Knowers necessarily possess justified true beliefs, but persons holding points of view may, for example, lack justification, have false beliefs, or both. I examine these differences and expose other crucial differentiating patterns between the structure of knowledge and points of view that make the latter more likely to lead to disagreements. I hypothesize that these (...) patterns remain invariant in alternative views of knowledge like contextualism as long as we preserve the classical structure. Yet there is much research to be done on the multiple and contrasting properties that emerge if we consider non‐classical analyses of knowledge and points of view. (shrink)

Austin introduces the idea of securing the uptake in the context of dealing with the illocution-perlocution distinction. In recent times, the notion is employed by some neoaustinian scholars to argue that the uptake is what triggers the deontic effects (rights, duties, obligations, permissions, etc.) associated to an illocution. Here, a distinction is made between two kinds of uptake: uptake-as-understanding and uptake-asaccepting, and the stance that the second is the one needed for a plausible theory of speech action inspired by Austin’s (...) original ideas is defended. When that notion is adopted, some old problems about speech action can be clarified. (shrink)

Conceptual analysis has been a traditional methodology within analytic philosophy, but it also has been the target of numerous attacks. On the other hand, explication has been undergoing a revival as a methodological alternative due to the revisionary element associated with it. This allows for a scientific reconstruction of our ordinary notions, which would share virtues associated with scientific concepts. However, there is now a popular variant of conceptual analysis which resembles closely the explicative methodology: the two-step methodology advanced by (...) the advocates of the Canberra Plan. Although explication is a wider and more ambitious program, I will argue that both methodologies can be regarded as attempts to bring philosophical methodology and its products closer to scientific ones. However, I will also point out that, although the goal is advantageous, there still remain some theoretical problems. (shrink)

In this paper I propose to conceive of forgiveness as a process of eliminating punitive reactive attitudes, which makes up part of the offended person’s willingness to reestablish a certain type of reciprocal relationship with the offender. Distinguishing among types of reciprocity allows us to realize that forgiveness is a more varied phenomenon than is usually assumed in the philosophical literature, as well as to understand why the dispute concerning the gratuitousnessconditionality of forgiveness is meaningless.

Venezuelan media present corruption as a major problem of the country and a research conducted by the author shows managers perceive it as business ethics' main issue. The corruption type addressed to in this article is the collusion between public officials and private managers for illegal or undue profits. Corruption in this form is related to the long-standing policy of State intervention and overregulation of the economy in order to industrialize the country. The issue analyzed is the perception of corruption (...) as a major political and social problem. Corruption is pervasive in many societies but it is not perceived as a central problem. The explanation for this perception in Venezuela is the increased impoverishment of people as a consequence of present economic crisis (the corrupt person is perceived as taking from my pocket) and the openness and pluralistic character of the political system. Moral indignation and scandal is the result of this new feature of Venezuelan society. Changes in the economic policies and the awareness of corruption seem to establish the basis to overcome the perception of corruption as the paramount problem it is now. (shrink)

This study proposes a revised interpretation of Foucault’s views on literature. It has been argued that the philosopher’s interest in literature was limited to the 1960s and of a mostly depoliticized nature. However, Foucault’s previously unpublished later works suggest a different reality, showing a sustained interest in literature and its politics. In the light of this new material, the book repositions Foucault's ideas within recent debates on the politics of literature.

At work a characterization of the sins of word, i.e., those transgressions in which predominated orality, to understand what was the place that was assigned occurs within a legal framework that tended to control activities individuals and the reason why he was persecuted. At first, it shows what modifications of Christian thought that allowed for specific classifications of sins were, as a result of the emergence of Thomism, and the predominance of an ethical supported by the Decalogue, he began to (...) speak of sins in thought, word, and deed. In researching the mechanisms that the Catholic Church used to control the use of the word they are also presented. The aim was to have strict control of the word to avoid misconceptions, ideas that could break the building and doctrinal belief system from spreading. Freedom of thought, doubt or disbelief were not permissible in a scheme that sought to impose their world view and, therefore, could not allow dissent or questioning of paradigms. (shrink)

In the first part of this paper, I discuss the different kinds of objectivity; general and legal objectivity more specifically. In the second part, I endeavour to explain the two main views that have been advanced to answer four core questions on legal objectivity. The first is whether moral and legal values are objective. Second, what is the nature of the relationship between legal and moral values? The third is whether, due to the specific nature of law, we should consider (...) a domainspecific conception of objectivity for legal values. The fourth concerns whether there is a correspondence between legal values and legal facts. What is the explanation of the platitudes about the nature of law such as that law is reasongiving, normative or authoritative in character? In other words, do legal facts have a place in our 'disenchanted' or naturalistic (in the scientific sense) understanding of the world. In the final section of this paper, I evaluate naturalism and nonnaturalism in law and consider the future of the debate and its relevance for understanding the connection between law, morality and legal normativity. This paper has three aims. First, to show Kant’s originality in using the celebrated example of the hundred thalers as a criticism of the ontological proof, despite being inspired by a 1780 booklet by Johann Bering. Second, to assess Bering’s and Kant’s different reasons for supporting the truth meant to be illustrated by the case of the thalers. Third, to point out that the debate on the example demands a discussion of the problem of universals. Indeed, the value and scope (...) of Kant’s (and Bering’s) critique of the ontological argument is decisively determined by his position on this problem. (shrink)

In a 1793 essay, J. Ch. Schwab claimed that Kant's distinction between analytic and synthetic judgments was already known to the Megarian philosopher Stilpo. Schwab's essay was criticised as early as 1794 by J. F. Ch. Gräffe. In a 1789 essay, J. A. Eberhard had also denied the originality of Kant's division of judgments and made certain indications suggesting that Aristotle was aware of the distinction. In this paper, I propose a fresh examination of why Schwab is wrong to attribute (...) knowledge of Kant's division of judgments to Stilpo – a second look which, however, does not disregard Gräffe's contributions to the discussion. Second, I argue that, in a precise sense, Kant's division of judgments is indeed original, but that the analytic – synthetic distinction was nevertheless in a sense known to Aristotle. The assessment of these alleged precedents sheds light no only on the novelty of Kant's philosophical project but also on what may be called the "the paradox of the discovery of an evident philosophical distinction". Para llevar a cabo este propósito, se toman en consideración contribuciones antiguas y recientes a la llamada “free will defense”. El examen se centra en las siguientes cuestiones: ¿Explica realmente el argumento la condición de posibilidad del mal? ¿Justifica adecuadamente la compatibilidad de esta condición tanto con el querer como con el poder de Dios? ¿Puede dilucidar también (...) el argumento la existencia de todas las clases de mal? Exploramos las actitudes de los españoles hacia las herramientas digitales propuestas por los actores políticos durante las elecciones generales españolas de 2008. Analizamos seis grupos de discusión organizados según las dimensiones de edad, identificación ideológica y nivel de institucionalización a la hora de participar en política. Exploramos hasta qué punto la brecha digital generacional de los usuarios de Internet, la auto-ubicación ideológica o la pertenencia a partidos políticos y movimientos sociales influye en la percepción de la ciberpolítica. Los resultados son (...) complejos. La ciudadanía percibió como la igualdad de las prácticas digitales no se correspondía con las potencialidades de una ciberdemocracia distorsionada. (shrink)

El jesuita morisco P. Ignacio de las Casas colaboró en la traducción de algunos de los libros plúmbeos encontrados en Granada a fines del siglo XVI. Inicialmente se manifestó partidario de su autenticidad, pero pronto se convenció de que eran una falsificación. Desarrolló entonces una activa lucha para conseguir que la Iglesia evitara su divulgación. En el artículo se pasa revista a su intervención como traductor y a los argumentos que utilizó para criticar la doctrina de los libros plúmbeos. El (...) P. Las Casas, además de señalar la presencia de elementos islámicos, ve en ellos claras muestras de antiguas herejías antitrinitarias. Aunque no los considera obra de moriscos, señala el atractivo que el mesianismo y milenarismo contenidos en la doctrina de los libros plúmbeos tenía para los moriscos. (shrink)

Desde su nacimiento bajo la pluma de Arthur Conan Doyle, Sherlock Holmes ha sabido adaptarse a los nuevos tiempos; en la actualidad, existen series, películas, videojuegos, e incluso, experiencias virtuales basadas en las obras originales. Este artículo lleva a cabo un análisis evolutivo del concepto de interactividad -desde la previrtualidad literaria de Gil González (2020) hasta la cultura participativa de Jenkins et al. (2015), el lectoespectador de Mora (2012), el interactor de Murray (1997) o el operador de Gubern (1996)-, en (...) los medios de la literatura, el cine y el videojuego en el corpus holmesiano. Para ello, se realiza una amplia revisión bibliográfica desde la perspectiva de la literatura comparada y los estudios intermediales, así como un abordaje crítico-analítico de algunas obras del universo del popular detective especialmente significativas en diferentes medios.
