This discussion paper considers how seldom recognised theories influence clinical ethics committees. A companion paper examined four major theories in social science: positivism, interpretivism, critical theory and functionalism, which can encourage legalistic ethics theories or practical living bioethics, which aims for theory–practice congruence. This paper develops the legalistic or living bioethics themes by relating the four theories to clinical ethics committee members’ reported aims and practices and approaches towards efficiency, power, intimidation, justice, equality and children’s interests and rights. Different approaches (...) to framing ethical questions are also considered. Being aware of the four theories’ influence can help when seeking to understand and possibly change clinical ethics committee routines. The paper is not a research report but is informed by a recent study in two London paediatric cardiac units. Forty-five practitioners and related experts were interviewed, including eight members of ethics committees, about the work of informing, preparing and supporting families during the extended process of consent to children’s elective heart surgery. The mosaic of multidisciplinary teamwork is reported in a series of papers about each profession, including this one on bioethics and law and clinical ethics committees’ influence on clinical practice. The qualitative social research was funded by the British Heart Foundation, in order that more may be known about the perioperative views and needs of all concerned. Questions included how disputes can be avoided, how high ethical standards and respectful cooperation between staff and families can be encouraged, and how minors’ consent or refusal may be respected, with the support of clinical ethics committees. Background: The law and literature about children’s consent generally assume that patients aged under-18 cannot consent until around 12 years, and cannot refuse recommended surgery. Children deemed pre-competent do not have automatic rights to information or to protection from unwanted interventions. However, the observed practitioners tend to inform young children s, respect their consent or refusal, and help them to “want” to have the surgery. Refusal of heart transplantation by 6-year-olds is accepted. Research question: What are possible reasons to explain (...) the differences between theories and practices about the ages when children begin to be informed about elective heart surgery, and when their consent or refusal begins to be respected? Research design, participants and context: Research methods included reviews of related healthcare, law and ethics literature; observations and conversations with staff and families in two London hospitals; audio-recorded semi-structured interviews with a purposive sample of 45 healthcare professionals and related experts; interviews and a survey with parents and children aged 6- to 15-years having elective surgery (not reported in this paper); meetings with an interdisciplinary advisory group; thematic analysis of qualitative data and co-authorship of papers with participants. Ethical considerations: Approval was granted by four research ethics committees/authorities. All interviewees gave their informed written consent. Findings: Interviewees explained their views and experiences about children’s ages of competence to understand and consent or refuse, analysed by their differing emphases on informed, signified or voluntary consent. Discussion: Differing views about children’s competence to understand and consent are associated with emphases on consent as an intellectual, practical and/or emotional process. Conclusion: Greater respect for children’s practical signified, emotional voluntary and intellectual informed consent can increase respectful understanding of children’s consent. La inteligencia artificial y la robótica son dos realidades que han venido para quedarse y cuya implicación en nuestra sociedad afecta a distintos ámbitos. El hecho de que nos encontremos ante una tecnología capaz de emular actitudes humanas como son el aprendizaje o la adaptación, convierten a la IA, y en concreto a los robots dotados de la misma, en máquinas imprevisibles. Asimismo, nos encontramos con la agravante de la posible interacción entre máquinas y sujetos de carácter vulnerable como son (...) los consumidores o los pacientes, lo que entraña un riesgo aún mayor. Desde el ámbito filosófico cada vez más autores muestran interés por abordar la reflexión filosófica de la ingeniería. Del lado de la ingeniería, existe una demanda definida por las sociedades profesionales y los organismos de acreditación de las titulaciones de ingeniería de inclusión de las ciencias sociales y humanidades en la formación de los ingenieros que, sin embargo, presenta deficiencias en su implantación. El objetivo del presente trabajo es justificar la inclusión de la reflexión filosófica en la formación de los (...) titulados en ingeniería y, para mejorar la situación actual, presentar una propuesta de asignaturas que muestre cuál pueda ser su espacio. La propuesta consiste en la inclusión de una asignatura específica que relacione la ingeniería y la sociedad, donde la reflexión filosófica juega un papel significativo, como complemento a la inclusión de la reflexión filosófica sobre problemas concretos en asignaturas específicas de corte tecnológico. Unsolicited email campaigns remain as one of the biggest threats affecting millions of users per day. During the past years several techniques to detect unsolicited emails have been developed. This work provides means to validate the hypothesis that the identification of the email messages’ intention can be approached by sentiment analysis and personality recognition techniques. These techniques will provide new features that improve current spam classification techniques. We combine personality recognition and sentiment analysis techniques to analyse email content. We enrich (...) a publicly available dataset adding these features, first separately and after in combination, of each message to the dataset, creating new datasets. We apply several combinations of the best email spam classifiers and filters to each dataset in order to compare results. (shrink)

Drawing inspiration from a well-attested historical tradition, I propose an account of cognition according to which knowledge is not only prior to belief; it is also, and crucially, not a kind of belief. Believing, in turn, is not some sort of botched knowing, but a mental state fundamentally different from knowing, with its own distinctive and complementary role in our cognitive life. I conclude that the main battle-line in the history of epistemology is drawn between the affirmation of a natural (...) mental state in which there is a contact between ‘mind’ and ‘reality’ (whatever the ontological nature of this ‘reality’) and the rejection of such a natural mental state. For the former position, there is a mental state which is different in kind from belief, and which is constituted by the presence of the object of cognition to the cognitive subject, with no gap between them. For the latter position, all our cognition is belief, and the question becomes how and when belief is permissible. (shrink)

Since March 2020, many countries throughout the world have been in lockdown in response to the COVID-19 pandemic. In Italy, the quarantine began on March 9, 2020, and containment measures were partially reduced only on May 4, 2020. The quarantine experience has a significant psychological impact at all ages but can have it above all on adolescents who cannot go to school, play sports, and meet friends. In this scenario, this study aimed to provide a general overview of the perceived (...) risk related to COVID-19 and the psychological experience of quarantine in a large sample of Italian adolescents. 978 adolescents (males = 339; females = 639) living in 13 Italian regions and attending upper secondary school (age range: 13–20, M = 16.57, SD = 1.20), responded to an internet-based questionnaire about perceived health risk related to COVID-19, knowledge and information on measures to control the pandemic, beliefs and opinions on stage two of the quarantine, and psychological experiences related to quarantine. 31.1% of the participants lived in "red zones," which are places where the government has imposed stricter measures of containment due to exponential and uncontrolled growth in contagion cases compared to other areas in Italy. According to our results, Italian adolescents had a low perception of risk of COVID-19. Perceived comparative susceptibility and perceived seriousness were also very low. However, they were aware of the restriction measures necessary to contain the spread of the virus, and they agreed with the limitations imposed by the government. Females and adolescents living in a “red zone” showed more significant psychological negative feelings about the quarantine experience. However, no significant differences were found about the regions where the teenagers of our sample live and the other variables related to the COVID-19 experience. This is very interesting data, leading us to hypothesize that the participants' negative feelings may be more related to the adolescent period than to the pandemic itself. (shrink)

This paper proposes a formal top-level model of explaining the outputs of machine-learning-based decision-making applications and evaluates it experimentally with three data sets. The model draws on AI & law research on argumentation with cases, which models how lawyers draw analogies to past cases and discuss their relevant similarities and differences in terms of relevant factors and dimensions in the problem domain. A case-based approach is natural since the input data of machine-learning applications can be seen as cases. While the (...) approach is motivated by legal decision making, it also applies to other kinds of decision making, such as commercial decisions about loan applications or employee hiring, as long as the outcome is binary and the input conforms to this paper’s factor- or dimension format. The model is top-level in that it can be extended with more refined accounts of similarities and differences between cases. It is shown to overcome several limitations of similar argumentation-based explanation models, which only have binary features and do not represent the tendency of features towards particular outcomes. The results of the experimental evaluation studies indicate that the model may be feasible in practice, but that further development and experimentation is needed to confirm its usefulness as an explanation model. Main challenges here are selecting from a large number of possible explanations, reducing the number of features in the explanations and adding more meaningful information to them. It also remains to be investigated how suitable our approach is for explaining non-linear models. (shrink)

This paper aims to show that a proper understanding of what Leibniz meant by “hypercategorematic infinite” sheds light on some fundamental aspects of his conceptions of God and of the relationship between God and created simple substances or monads. After revisiting Leibniz’s distinction between (i) syncategorematic infinite, (ii) categorematic infinite, and (iii) actual infinite, I examine his claim that the hypercategorematic infinite is “God himself” in conjunction with other key statements about God. I then discuss the issue of whether the (...) hypercategorematic infinite is a “whole”, comparing the four kinds of infinite outlined by Leibniz in 1706 with the three degrees of infinity outlined in 1676. In the last section, I discuss the relationship between the hypercategorematic infinite and created simple substances. I conclude that, for Leibniz, only a being beyond all determinations but eminently embracing all determinations can enjoy the pure positivity of what is truly infinite while constituting the ontological grounding of all things. Criticisms of the “container” model of pregnancy picturing female and embryo as separate entities multiply in various philosophical and scientific contexts during the last decades. In this paper, we examine how this model underlies received views of pregnancy in evolutionary biology, in the characterization of the transition from oviparity to viviparity in mammals and in the selectionist explanations of pregnancy as an evolutionary strategy. In contrast, recent evo-devo studies on eutherian reproduction, including the role of inflammation and new maternal cell (...) types, gather evidence in favor of considering pregnancy as an evolved relational novelty. Our thesis is that from this perspective we can identify the emergence of a newhistoricalindividual in evolution. In evo-devo, historical units are conceptualized as evolved entities which fulfill two main criteria, their continuous persistence and their non-exchangeability. As pregnancy can be individuated in this way, we contend that pregnant females are historical individuals. We argue that historical individuality differs from, and coexists with, other views of biological individuality as applied to pregnancy (the physiological, the evolutionary and the ecological one), but brings forward an important new insight which might help dissolve misguided conceptions. Aristotle’s influence on D’Arcy Thompson was praised by Thompson himself and has been recognized by others in various respects, including the aesthetic and normative dimensions of biology, and the multicausal explanation of living forms. This article focuses on the relatedness of organic forms, one of the core problems addressed by both Aristotle’s History of Animals (HA), and the renowned chapter of Thompson’s On Growth and Form (G&F), “On the Theory of Transformations, or the Comparison of Related Forms.” We contend that, (...) far from being an incidental inspiration stemming from Thompson’s classicist background, his translation of HA played a pivotal role in developing his theory of transformations. Furthermore, we argue that Thompson’s interpretation of the Aristotelian method of comparison challenges the prevailing view of Aristotle as the founder of “typological essentialism,” and is a key episode in the revision of this narrative. Thompson understood that the method Aristotle used in HA to compare animal forms is better comprehended as a “method of transformations,” leading to a morphological arrangement of animal diversity, as opposed to a taxonomical classification. Finally, we examine how this approach to the relatedness of forms lay the foundation for a causal understanding of parts and their interconnections. Although Aristotle and Thompson emphasized distinct types of causes, we contend that they both differ in a fundamental sense from the one introduced by Darwin’s theory of natural selection, which was formulated as a solution to the species problem rather than the form problem. We conclude that Thompson’s interpretation of Aristotle’s approach to form comparison has not only impacted contemporary scholarship on Aristotle’s biology, but revitalized a perspective that has regained significance due to the resurgence of the problem of form in evo-devo. Pere Alberch played a pivotal role in shaping the field of evolutionary developmental biology during the 1980s and 1990s. Whereas initially his contributions were sidelined by the empirical advancements of the molecular revolution in developmental and evolutionary biology, his theoretical insights have left a lasting impact on the discipline. This article provides a comprehensive review of the legacy and evolvability of Alberch's ideas in contemporary evo-devo, which included the study of morphogenesis as the proper level of developmental causation, the interplay (...) between developmental constraints and natural selection, the epistemic role of teratologies, the origin of evolutionary novelties and the concept of evolvability. From its beginning, Critical Theory aimed to explore the laws governing social life as a formational totality and the forces shaping and driving its historical evolution. So the attempt to develop a comprehensive conception of ‘society’ encompassing both its structural as well as its cultural components can be considered one of the defining hallmarks of Critical Theory through all its theoretical and generational variations. But what, then, is Critical Theory’s conception of society? To answer this question, the authors make use (...) of a three-tiered heuristic model distinguishing synthesis (what is society?), dynamis (what are the driving forces of social change?) and praxis ((how) can social change be motivated or influenced by social actors?). In this way, they are able to reconstruct not only the divergences and controversies between the different versions and approaches in Critical Theory across the four generations of authors writing in this tradition, but also four core points of convergence which can serve to differentiate between Critical Theory in the Frankfurt School tradition and other critical theories. These four points, we suggest, should be seen to form the backbone of any valid conception of society in contemporary Critical Theory. (shrink)

The importance of socio-economic impacts from the introduction and use of genetically modified crops is reflected in increasing efforts to include them in regulatory frameworks. Aiming to identify and understand the present knowledge on SEI of GM crops, we here report the findings from an extensive study of the published international scientific peer-reviewed literature. After applying specified selection criteria, a total of 410 articles are analysed. The main findings include: limited empirical research on SEI of GM crops in the scientific (...) literature; the main focus of the majority of the published research is on a restricted set of monetary economic parameters; proportionally, there are very few empirical studies on social and non-monetary economic aspects; most of the research reports only short-term findings; the variable local contexts and conditions are generally ignored in research methodology and analysis; conventional agriculture is the commonly used comparator, with minimal consideration of other substantially different agricultural systems; and there is the overall tendency to frame the research upon not validated theoretical assumptions, and to over-extrapolate small-scale and short-term specific results to generalized conclusions. These findings point to a lack of empirical and comprehensive research on SEI of GM crops for possible use in decision-making. Broader questions and improved methodologies, assisted by more rigorous peer-review, will be required to overcome current research shortcomings. (shrink)

ABSTRACT Educating in a convulsed political context demands a detailed analysis of the new circumstances of our times, especially the current democracy crisis. According to the latest reports issued by international evaluation organisations, one of the greatest challenges for democratic citizenship is the emergence and rise of authoritarianism within the framework of the so-called post-democracy, and also in the manifestations known as illiberal democracy. Moral and civic education has to respond to this challenge. With this in mind, we propose revitalising (...) a participative and deliberative democracy model, rethinking the basic values in citizens' education, redefining the relation between what is public and what is private, and empowering sensitivity and free creation in the new maker culture. This contribution discusses Leibniz’s conception of the Christian church, his life-long ecumenical efforts, and his stance toward religious toleration. Leibniz’s regarded the main Christian denominations as particular churches constituting the only one truly catholic or universal church, whose authority went back to apostolic times, and whose theology was to be traced back to the entire ecclesiastical tradition. This is the ecclesiology which underpins his ecumenism. The main phases and features of his work toward reunification of Protestants and Roman Catholics, and (...) unification of Protestant churches are briefly explored, before turning to the issue of religious toleration. It is argued that a remarkably inclusive conception of toleration can be gleaned from a broad sample of Leibniz’s writings and correspondence. It is thanks to the philosophical and theological grounds of this conception that toleration can in principle be extended, for Leibniz, to all men and women of good will, including non-Christians, pagans, and atheists. While the notion of chance has been central in discussions over the probabilistic nature of natural selection and genetic drift, its role in the production of variants on which populational sampling takes place has received much less philosophical attention. This article discusses the concept of chance in evolution in the light of contemporary work in evo-devo. We distinguish different levels at which randomness and chance can be defined in this context, and argue that recent research on variability and evolvability demands (...) a causal understanding of variational probabilities under which development acquires a creative, rather than a constraining role in evolution. We then provide a propensity interpretation of variational probabilities that solves a conceptual confusion between causal properties, variational probabilities and extant variation present in the literature, and explore some metaphysical consequences that follow from our interpretation, specifically with regards to the nature of developmental types. Despite the radical importance of embryology in the development of organi- cism, developmental biology remains philosophically underexplored as a theoretical and empirical resource to clarify the nature of organisms. This paper discusses how embryology can help develop the organisational definition of the organism as a differentiated, function- ally integrated, and autonomous system. I distinguish two conceptions of development in the organisational tradition that yield two different conceptions of the organism: the life- history view claims that organisms can be considered as (...) such during their whole ontogeny; the constitutive view distinguishes two periods in the life history, a period of generation and a period of self-maintenance of a constitutive organisation. Arguing in favour of the con- stitutive view, it will be claimed that the organisational criteria for the definition of organ- ism (i.e., differentiation, functional integration, and autonomy) can only be applied to the developmental system when it has entered the period of self-maintenance of a constitutive organisation. under the light of current research in developmental biology, it is possible to make explicit how organisms come to be as organisms. To this end, I explore key onto- genetic events that help us clarify the core aspects of animal organisation and allow us to identify the developmental stage that marks the ontological transition between an organism in potency and an organism in actuality. The structure of this ontogenetic unfolding paral- lels the conceptual structure of the very notion of organism; the generation of the being of a particular organism parallels its definition. The construct of autonomy appears in the literature associated with individual psychological wellbeing. In Ryff's model, autonomy is presented as one of the dimensions of wellbeing, along with self-acceptance, positive relationships with others, environmental mastery, purpose in life, and personal growth. The present study compared the levels of autonomy and psychological wellbeing between Spanish and Colombian young people. Ryff's Scale of Psychological Wellbeing and the Transition to Adulthood Autonomy (EDATVA according to its initials in Spanish) scales were used on a (...) sample of 1,146 young people aged between 16 and 21; 506 Spanish and 640 Colombian. Results showed differences in autonomy and in two of the four dimensions proposed by the EDATVA: self-organization and critical thinking. Similarly, important differences were observed in the subscales of positive relations and purpose in life. The importance of contextual factors in the development of psychological well-being and autonomy in young people in transition to adulthood is discussed. (shrink)

The purpose of the present paper is to reply to a misleading paper by M. Sachs entitled “Einstein's later view of the Twin Paradox” (TP) (Found. Phys. 15, 977 (1985)). There, by selecting some passages from Einstein's papers, he tried to convince the reader that Einstein changed his mind regarding the asymmetric aging of the twins on different motions. Also Sachs insinuates that he presented several years ago “convincing mathematical arguments” proving that the theory of relativity does not predict asymmetrical (...) aging in the TP. Here we give a definitive treatment to the clocks problem showing that Sachs' “convincing mathematical arguments” are non sequitur. Also, by properly quoting Einstein, we show that his later view of the TP coincides with the one derived from the rigorous theory of time developed in this paper. (shrink)

While niche construction theory and developmental approaches to evolution have brought to the front the active role of organisms as ecological and developmental agents, respectively, the role of agents in reproduction has been widely neglected by organismal perspectives of evolution. This paper addresses this problem by proposing an agential view of reproduction and shows that such a perspective has implications for the explanation of the origin of modes of reproduction, the evolvability of reproductive modes, and the coevolution between reproduction and (...) social behavior. After introducing the two prevalent views of agency in evolutionary biology, namely those of organismal agency and selective agency, I contrast these two perspectives as applied to the evolution of animal reproduction. Taking eutherian pregnancy as a case study, I wonder whether organismal approaches to agency forged in the frame of niche construction and developmental plasticity theories can account for the goal-directed activities involved in reproductive processes. I conclude that the agential role of organisms in reproduction is irreducible to developmental and ecological agency, and that reproductive goals need to be included into our definitions of organismal agency. I then explore the evolutionary consequences of endorsing an agential approach to reproduction, showing how such an approach might illuminate our understanding of the evolutionary origination and developmental evolvability of reproductive modes. Finally, I analyze recent studies on the coevolution between viviparity and social behavior in vertebrates to suggest that an agential notion of reproduction can provide unforeseen links between developmental and ecological agency. In the age of neoliberalism, feminists strongly disagree on the ideal legal status of prostitution while the pro-prostitution lobby endeavours to keep their male-dominated business running smoothly. Feminist debates should be concerned with the sex buyers' belief system about women, which is likely to have practical consequences in the way they behave with women (prostituted and non-prostituted) in terms of sexuality and, therefore, for feminist purposes of equality, on a broader scale. A Critical Discourse Analysis of buyer-authored online reviews of (...) prostituted women provides the opportunity to verify whether the relationship they establish with them is based on democratic mutual equality or gendered power relations driven by domination and subordination.En la era del neoliberalismo, no hay consenso entre las feministas acerca del estatus legal que debería tener la prostitución; mientras, el lobby pro-prostitución intenta proteger tan lucrativo negocio. Los debates feministas deben abordar críticamente el sistema de creencias de los sujetos prostituyentes, en tanto que afecta a cómo actúan con las mujeres (prostituidas y no prostituidas) dentro del marco de la sexualidad y, por tanto, al potencial logro de la igualdad fáctica a nivel social. El análisis crítico del discurso online de los sujetos prostituyentes sobre las mujeres prostituidas permite comprobar si las relaciones que establecen con ellas están basadas en términos igualitarios o en la dicotomía dominación-subordinación característica de las relaciones de poder de género. This article presents research on the scale of the phenomenon of sexual violence against students at selected 33 universities across Poland, the mechanisms used to combat the problem and the awareness of students on the subject. The study focuses on the practical dimension of combating sexual violence against students in the Polish academic environment. It looks at the existence and functioning of both specialised bodies and the procedures used to help the victims and punish the perpetrators. Additionally, the paper describes (...) how the diversity of available legal measures to address the problem by both helping the victims and holding perpetrators accountable creates the issue of the coexistence of two systems—criminal and intra-university. Presenting preliminary results of gathered opinions of universities’ officials regarding functioning of the bodies specialised in combating sexual violence shows not only the most dominant observations and conclusions the professionals have regarding the functions they hold at their home universities, but also main challenges that have to be considered in both creating sufficient policies in order to deal with sexual violence and conducting comprehensive research on said phenomenon. Em discussões sobre justiça, diferentes perspectivas geralmente compartilham princípios morais, mas chegam a conclusões distintas sobre justiça, porque discordam sobre fatos. Argumento que o raciocínio motivado, a injustiça epistêmica e as ideologias de injustiça apoiam instituições injustas ao consolidarem representações distorcidas do mundo. Partindo de uma concepção naturalista de justiça como um tipo de contrato social, sugerirei algumas estratégias para descobrir o que a justiça demanda, neutralizando esses vieses. Sentimentos morais oferecem recursos essenciais para esse fim.

Una novedad relevante en la LOMLOE es la introducción de la memoria democrática como una nueva dimensión de la Educación para la Ciudadanía, con el objeto de promover la participación ciudadana en la vida pública. Sin embargo, el trabajo de Navarro-Medina, De Alba-Fernández y Pérez-Rodríguez (2023), señalando la ausencia en el actual currículo de conceptos clave como dictadura, franquismo, régimen totalitario, persecución, exilio o sublevación, nos sitúa en la tesitura de valorar las interpretaciones que han realizado de la actual ley (...) de educación el conjunto de comunidades autónomas del estado español. El problema de investigación del que partimos intenta valorar en qué medida ha influido el signo político de cada una, en la interpretación realizada de las indicaciones ministeriales. A tal fin, acometemos un estudio descriptivo-interpretativo de los decretos que establecen la ordenación del currículo en la etapa de Educación Primaria en las comunidades autónomas. (shrink)

The planet seems to be heading into an ecological catastrophe, in which the earth will become uninhabitable for many species, including human beings. At the same time we humans are beset by appalling injustices. The Rio Declaration which addressed both these sets of problems contains conceptual contradictions about ‘development and ‘nature’. This paper addresses the issue of whether it is logically possible to work for both global justice and ecological sustainability. The article proposes a way of responding to the spirit (...) of the Rio Declaration without reinstating its contradictions; considers a posthuman perspective on the issue; and proposes a phenomenological approach to ethics and justice which would include both the human and more-than-human parts of the world. In section the implications for education are drawn out, in terms of ‘learning to mind’. Finally, links are drawn to the Journal theme of translation. (shrink)
