The author of this text argues that the methodological issues in bioethics mirrors the experience of moral pluralism in a secular society. The different methods that have been used in the field reflect the different moral views found in a pluralistic society.

In 1994, the National Conference of Catholic Bishops revised the "Ethical and Religious Directives for Catholic Health Care Services." A goal of the Directives is to maintain the moral integrity of Catholic health care institutions and to address controversies in bioethics and health care. The Directives represent a shift to an exclusively principle-based approach to moral reason. This shift threatens to undermine the very tradition that the bishops seek to protect.

The changing world of health care finance has led to a paradigm shift in health care with health care being viewed more and more as a commodity. Many have argued that such a paradigm shift is incompatible with the very nature of medicine and health care. But such arguments raise more questions than they answer. There are important assumptions about basic concepts of health care and markets that frame such arguments.

The advent of moral pluralism in the post-modern age leads to a set of issues about how pluralistic societies can function. The questions of biomedical ethics frequently highlight the larger issues of moral pluralism and social cooperation. Reflection on these issues has focused on the decision making roles of the health care professionals, the patient, and the patient's family. In the last 25 years, Roman Catholic moral theology has debated issues ranging from the sources of moral theology to the role of ecclesiastical authority in moral theology. In 1993, Pope John Paul II issued his encyclical letter Veritatis Splendor, which addresses issues in fundamental moral theology. The encyclical must be understood against the background of ongoing debates since Pope Paul VI's 1968 encyclical on birth control (Humanae Vitae). It is not clear what the impact of Veritatis Splendor will be. (...) This book explores an undeveloped area in postmodern thought: organizational ethics. Ethical debates and analyses usually focus on a particular act or action, an actor, and/or how a secular society should address any of those particular persons or events. In the Post Modern age, ethical decisions and policies are characterized by moral and cultural pluralism. However, there is a second factor that complicates ethical and policy decisions even further. This book argues that in the postmodern age ethical decisions often need (...) to be understood as part of the decision making of organizations and bureaucracies. Organizational decisions often have direct bearing on the choices made by individuals. Two areas that exemplify postmodern issue are the areas of health care and education. For example the decision making of Admissions Officers in American higher education, are influenced by decisions that have been made by the university about the size of the class and the diversity of the class. Health Care organizations make policy decisions that affect every aspect of a patient’s care from admission to treatment and the types of care that are or are not offered. Both education and health care are the object of the significant investment of resources, both areas are value laden in postmodern, pluralistic societies, and yet we do not have a comprehensive method to understand them or evaluate them. Ford has written an engaging book that puts this fundamental moral position about persons and prenatal life in conversation with critics of the position, common morality, the Christian tradition, and many of the complex clinical problems of contemporary medicine. The book is a timely contribution to bioethics and many of the controversies surrounding embryonic (...) stem cell and cloning research. This article seeks to explain how it was possible that, until the first century BC, the Roman dictatorship was never abused and turned against the constitution itself. The traditional explanation is that, contrary to its first century imitations, the dictatorship was subject to formal restrictions, such as the six months' tenure, which were strictly applied. By contrast, this article suggests that informal constraints on the dictator's powers, such as moral and religious norms, were as important as formal constraints. But in attempting to follow some of the steps of Mr. Barber's later argument, and in examining some of the conclusions to which they lead, I have found myself confronted with difficulties which seem sufficiently important to warrant the critical attention of Mr. Barber and the readers of this Review. These difficulties fall into three groups concerning: 1) preliminary arguments; 2) apparent inconsistencies between certain conclusions; and 3) inadequacies in basic ontology.

I review Adrian Moore’s lucid account of Fichte’s contribution to the Evolution of Modern Metaphysics. I support Moore’s contention that Fichte should indeed be considered a metaphysician, but I propose an adjustment to Moore’s interpretation, guided by Fichte’s own claim that the infinite I is an unattainable ideal, rather than a fact about the constitution of reality as it actually is. The resulting position embeds Fichte’s metaphysics firmly within his ethics and politics. In reconstructing Fichte’s position I demonstrate the centrality (...) of work in Fichte’s proposed resolution of Kant’s third antinomy. (shrink)

The translators have been conscious, perhaps overly conscious, of the linguistic difficulties involved in their task, and have provided the reader with a glossary of German terms, an exhaustive index, and an elaborate series of footnotes, largely devoted to linguistic and grammatical considerations, which are found on almost every page. Neither space, nor time, nor energy has been spared in working out this apparatus which is sometimes, as in the indication of the original German paging on the margin, genuinely helpful (...) to the reader. It would have been well if they had been equally concerned and equally careful to deal with the difficulties involved in interpreting this pioneering text, which struggles to describe phenomena hitherto unnoticed through new concepts and new uses of language for which dictionary definitions are a wholly inadequate guide. There is no question that the translators know their dictionaries. But to anyone who has seriously studied Heidegger's text in the original, serious questions arise at many critical points as to whether they understand the text. As a result of such failures to follow the meaning, the version now before us is a sadly imperfect and often misleading rendition of Heidegger's thought. In order to assist those who read this article in avoiding misunderstandings of the text, let me first comment briefly on a few mistranslations of basic points. While the questions of death and dying have a long history (Wildes 1996), the attempt to address them as secular questions is an element of what established (...) bioethics as a field of inquiry.The controversies of death and dying are not only formative of bioethics, but also are among the most persistent bioethical controversies. Today, almost 30 years after the Harvard Ad Hoc Committee’s definition of death and 20 years after the Quinlan decision, the questions of death and dying are still with us. Recently, the question of physician-assisted suicide once again gained national [End Page 378] attention with the trials of Dr. Kevorkian and the decisions of the Ninth and Second Circuit Courts on the constitutionality of the Washington and New York state laws prohibiting physician-assisted suicide. At the same time, questions and controversies about the appropriate extent of treatment and the determination of death in relationship to treatment continue to be problematic in health care.As I reviewed the literature in the area of death and dying, one central question emerged: Why, after so much reflection, energy, and discussion, do the problems around death and dying continue to persist? There is a recurring character to these questions that is indeed a wonder. In reviewing these moral controversies, one might ask what these controversies and their persistent character tell us about bioethics that can help us to understand the issues and the field.Some might blame the development of medical technology for the persistence of these issues of death and dying. The development and use of technological resources certainly is an important element of these continuing controversies. The use of medical technologies at the end of life allows us the possibility to sustain lives that would have been lost just a few decades ago. However, while medical technology certainly opens new horizons and possibilities, the development and deployment of technology does not sufficiently explain why these issues are so difficult and persistent. The question underlying the use of medical technology at the end of life is the question about which criteria are to be used to make judgments about the appropriate use of such technology. If the use of medical technology depends on the moral views one holds about death, suffering, and the appropriate use of resources, then such issues will be morally controversial in a society that is morally pluralistic.To address these questions, it is important to remember what is all too obvious and yet often forgotten. Death is not only a medical event. In this century, particularly in the last 40 years, we have reduced death to a medical event, yet, the medical meanings do not exhaust the event (see Engelhardt 1996, pp. 189–238). Death is also a social, cultural, and often religious event and the medical realities of death must be interpreted within these different contexts. As such, death will be the locus of different meanings and interpretations. The aim of this paper is to explore the connection between moods and meteors or atmospheric phenomena in Heidegger’s thinking. The idea of the weather as something affecting our emotional state is not new but goes all the way back to Homer. However, the ontological basis of this connection is missing. In this paper, I argue that Heidegger provides exactly such an ontological account of moods and meteors not as two separate spheres but as a common atmosphere of attuned elementality—a (...) dynamic interface where beings bend into being. Bruno Latour’s work, today becoming increasingly influential in philosophical circles, represents a clear challenge to prevailing philosophical accounts of the relation between human subjectivity and the natural world. The ‘political ecology’ which Latour sets out in works such as We Have Never Been Modern and more extensively in The Politics of Nature is a call to arms to rethink concepts of nature taken for granted ever since the time of Kant. Yet despite its apparent novelty, and despite its apparent break (...) with post-Kantian continental philosophy, Latour’s thinking often unwittingly reworks philosophical moves made within that tradition, even during Kant’s lifetime, specifically in the movement known as Naturphilosophie. Bringing to light the elective affinities between Latour’s ideas and those of Naturphilosophie, this article suggests that the former unconsciously rehearses key tenets of the latter, in particular the claims made by Schelling against Kant. Moreover, Latour will be seen to succumb to the problems which a subsequent developer of Naturphilosophie—Hegel—would identify in Schelling’s own conception of nature. Finally, whilst Latour offers an apparently compelling alternative to notions of subject and object, free-will and mechanism, along with the conceptual separation of humans from the natural world, his thought often fails to achieve the genuine critique that would be adequate to comprehending these oppositions, and to explaining the ecological crisis in which both humans and nonhumans are caught up. The relationship between traumatic experiences and subsequent distress is not well understood, and little research focuses on the lived experience of psychological trauma. I draw on Louis Sass’s phenomenological taxonomy to address this lacuna. I present his differentiation between relations of phenomenological causality and implication and demonstrate that his taxonomy can be applied to experiences of trauma. Relations of phenomenological causality and implication can be identified in the genesis and constitution of post-traumatic distress. My adaptation of Sass’s taxonomy will furthermore (...) offer an extension and development of his account, applying it to the study of post-traumatic experiences and elaborating it in the process. I shall demonstrate that whether experiences occur synchronically or diachronically is not essential to their categorization in terms of phenomenological implication and causality, respectively. I will show that an alteration in perception or behavior post trauma might temporally succeed the traumatizing event while, at the same time, being implied in the experience of the event. Thereby, I demonstrate how phenomenology may contribute to a detailed understanding of experiences of trauma. Scrutiny of traumatic experiences furthermore promises to contribute to the philosophical discourse on causality, implication, and temporal experience. (shrink)

This paper explores the plausibility of Alain Badiou's ahistorical theory of politics. By insisting that the events of egalitarian politics are radically subtracted from social and historical conditions Badiou imagines a form of political action that effectively comes out of nothing. However, in order to establish the very prospect of an event's occurrence Badiou is forced to ground the possibility of political intervention in his theory of "evental recurrence", which effectively enables the subjects of political action to draw on the (...) consequences of a preceding event in order to act in the here and now. The paper argues that by introducing the social dimensions of evental recurrence it is possible to construct an alternative account of political action that resolves a number of inconsistencies in Badiou's otherwise miraculous vision of politics. Consequently, rather than a militant activist that comes out of nowhere, evental recurrence implies that the militants of political action are saturated in their immediate social and political circumstances and in the memory of past struggles. Remodel[l]ing Reality is an inquiry into Wittgenstein's notion of übersichtliche Darstellung and the phenomenon of installation in visual art. In a sense, both provide a perspicuous overview of a particular part of our complex world, but the nature of the overview differs. Although both generate knowledge, philosophy via the übersichtliche Darstellung gives us a view of how things stand for us, while the installation shows an unexpected, exiting point of view. The obvious we tend to forget and the ambiguity of (...) reality are related to each other in a dynamic way. It is in this reflexive dynamics that we constantly remodel our reality. Tools we use are our creative abilities and our powers of imagination. In our choices and solutions we show which aspects of reality we find important and how we communicate these values. The outcome of this investigation is a new perspective on the art of installation and a new insight in Wittgenstein's notion of übersichtliche Darstellung. While the concept of place remains undertheorized in Kierkegaard research, this study argues that place is at the center of Kierkegaard's thinking. The first part of the book shows that Kierkegaard's notion of situatedness as being-placed in a socio-historical situation conditioned by a situation prior to situatedness points to a realist position and a flat ontology. Secondly, the book develops a detailed analysis of the ontological structure of the existential place (the place we ourselves are) and concrete places (the places (...) where we are). Place opens a qualified space within bounds (the existence-sphere), an atmosphere of elemental attunement and attuned elementality. Finally, the book collects the dots from part one and two in a topological realist approach to Kierkegaard's theology and three main definitions of God: God is love, God is that everything is possible, and God is the middle term. The book concludes that Kierkegaard's existential topography reveals a realist position: where we are is never exhausted by being the place where we are. (shrink)

Analyzing writings ranging from the Puritans to the present day, Loving God's Wildness traces the effects of Christian theology on America's ecological imagination, revealing the often conflicted ways in which Americans relate to and perceive the natural world.

Carpendale & Lewis's (C&L's) theory falls in with an existing set of theories that children's understanding of mind is collaboratively constructed in linguistically mediated social interaction. This social constructivist view needs to be clear about the complementary contributions of the child and of the social environment. I distinguish between the child's individual linguistic ability and the dyad's social communication, proposing that each makes a contribution to theory-of-mind development, differently balanced in different individuals.

Pereboom’s ‘wild coincidences’ argument against agent-causal libertarianism is based on the claim that in a world governed by statistical laws, the dovetailing of indeterministic physical happenings with the free actions of agent causes would be a coincidence too wild to be credible. In this paper it is shown that the conclusion is valid for deterministic laws, but that it fails for statistical laws. Therefore, the ‘wild coincidences’ argument does not provide the promised empirical refutation of agent-causal libertarianism.

Jean-Jacques Rousseau devoted an important chapter of his Social Contract to the dictatorship. Carl Schmitt interpreted Rousseau’s chapter as marking the transition from ‘commissarial’ to ‘sovereign dictatorship’. This article argues that Schmitt’s interpretation is historically and conceptually inaccurate. Instead of paving the way for sovereign dictatorship, Rousseau carefully distinguished the dictatorship from the people’s sovereign authority. Taking position in the ‘debate’ between Bodin and Grotius on the relation between dictatorship and sovereignty, he argued that the dictator could provisionally suspend the (...) people’s sovereign authority, but not abolish it. More particularly, the dictator did not possess the power to make generally binding laws, which had to remain the exclusive authority of the popular assembly. However, this did not prevent Rousseau from recognizing the dictatorship as a means for democratic reform. Rousseau thus conceived of the dictatorship as a time-limited and revocable commission to protect the constitution and to provide for a more stable and effective state organization based on the principle of popular sovereignty.
