In paediatric oncology, research and treatments are often closely combined, which may compromise voluntary informed consent of parents. We identified two key scenarios in which voluntary informed consent for paediatric oncology studies is potentially compromised due to the intertwinement of research and care. The first scenario is inclusion by the treating paediatric oncologist, the second scenario concerns treatments confined to the research context. In this article we examine whether voluntary informed consent of parents for research is compromised in these two (...) scenarios, and if so whether this is also morally problematic. For this, we employ the account of voluntary consent from Nelson and colleagues, who assert that voluntary consent requires substantial freedom from controlling influences. We argue that, in the absence of persuasion or manipulation, inclusion by the treating physician does not compromise voluntariness. However, it may function as a risk factor for controlling influence as it narrows the scope within which parents make decisions. Furthermore, physician appeal to reciprocity is not controlling as it constitutes persuasion. In addition, framing information is a form of informational manipulation and constitutes a controlling influence. In the second scenario, treatments confined to the research context qualify as controlling if the available options are restricted through manipulation of options. Although none of the influences is morally problematic in itself, a combination of influences may create morally problematic instances of involuntary informed consent. Therefore, safeguards should be implemented to establish an optimal environment for parents to provide voluntary informed consent in an integrated research-care context. (shrink)

Background In the coronavirus disease 2019 era, doctors have tried to decrease hospital visits and admissions. To this end, telemedicine was implemented in a non-systematic manner according. The objective of this study was to assess the current knowledge and attitudes of physicians in Alexandria, Egypt, and Punjab, India, toward telemedicine and its ethical and medico-legal issues. Method A cross-sectional study was implemented using an anonymous self-administered questionnaire carried out over two months (July and August 2020). A four-point Likert scale was (...) used to collect data about background knowledge, training in telemedicine and ethical and medico-legal issues in telemedicine practice. Results The questionnaire was completed by 175 Egyptian and 51 Indian physicians from different specialties. A significantly higher percentage of Indian physicians practiced telemedicine than Egyptian physicians during the coronavirus disease 2019 era. Although most physicians had no specific training or licensing to practice telemedicine, most of them practiced telemedicine through their social media accounts. Ethical violations involving waiving patient consent were detected. Significant ethical violations to doctors, for example, blackmail, defamation, hate speech, accusations in a court and violations of privacy, were observed. Indian physicians (39.2%) and Egyptian physicians (24%) thought the penalties should be lower in telemedicine than in traditional practice. Finally, most participants would like to continue using telemedicine after the coronavirus disease 2019 era but with improvements. Conclusions Coronavirus disease 2019 changed the acceptance of telemedicine by physicians. Many ethical and legal issues need to be addressed and clarified using formal training before implementation and standardization of telemedicine services. (shrink)

This study examines social issues shareholder resolutions filed at S&P 500 companies in 2007. These firms received 86% of all social issues resolutions filed. Findings indicate that green resolutions were the most common single type (30% of social issues resolutions), but nearly one third (32%) of resolutions contained non-traditional content. Firms were more likely to be targeted if they were large in size and demonstrated poor treatment of employees and customers. As might be expected, the primary sponsors of social issues (...) resolutions were socially responsible investment funds, religious groups, and pension funds. Surprisingly, over half (52%) of resolutions made it onto proxy ballots in 2007, while there was sufficient dialogue between the target companies and shareholder activists for filers to withdraw only 29% of the resolutions (although 41% of green resolutions were withdrawn). Andrea Hollingsworth offers a rereading of Nicholas of Cusa's De visione Dei to demonstrate how a medieval mystical text echoes elements of contemporary neurocognitive processes of self-transformation. The final two essays center on law and religious freedom. John Burgess examines the privileging of religious freedom for canonizing martyrs in post-Soviet Russian Orthodoxy, arguing that this provides theological grounding for the legal right to religious freedom. Mary Ellen O'Connell proposes aesthetics as a more adequate modern grounding for legal authority than science. She argues that aesthetics takes us beyond the limits of self-interest, drawing us into concern for the good of others through the contemplation of beauty.What holds these essays together is the pursuit of "transdisciplinarity": "paying close attention to the other discipline(s) in a way that has a substantial and mutual impact, but at the same time retaining a clear sense of disciplinary integrity" (14–15). Lovin and Mauldin argue for humility and hope as virtues that enable us to navigate the tension between openness and integrity. While humility enables us to recognize the limits of disciplinary boundaries and assumptions, hope propels us forward, promising that however incomplete our knowledge remains, by the grace of God we will make advances in understanding our world and ourselves.Just as Christian Scharen and Aana Marie Vigen's Ethnography as Christian Theology and Ethics argues for the value of engagement with ethnography and its related disciplines to produce theology and ethics grounded in lived reality, this volume argues for the value of engagement with the natural and human sciences to produce "theological realism" that accounts for the complexity of "human personality and community" (xviii). It is unsurprising, then, that both volumes respond to objections from the neo-Radical Reformation and Radical Orthodoxy camps. In his conclusion, Douglas Ottati argues that these camps cannot account for the ways in which theological production inevitably interacts with natural and cultural processes. He argues further that insulating Christian theology is a form of cultural accommodation because it mirrors the formation of discrete modern disciplines, the very limitation these essays seek to transcend.This volume advances the live discussion in Christian ethics about the promise and risks of engaging natural and social sciences. This is an exploratory study of corporate social performance in firms with family members in executive, governance, or strong ownership positions. Family firmsdominate the economy in most countries, including the United States, and families are thought to be more concerned with personal wealth creation and risk avoidance than social performance. Although such firms have been shown to have superior financial performance, I found no evidence of superior (or inferior) social performance among family firms in the S&P 500. In a departure (...) from the methodological norm in business and society, I used KLD data as dependent variables instead of independent variables. I was able to predict KLD scores from firm size, industry, and strategy variables, but family firm status rarely played a role. (shrink)

More and more cities develop urban food strategies to guide their efforts and practices towards more sustainable food systems. An emerging theme shaping these food policy endeavours, especially prominent in North and South America, concerns the enhancement of social justice within food systems. To operationalise this theme in a European urban food governance context we adopt Nancy Fraser’s three-dimensional theory of justice: economic redistribution, cultural recognition and political representation. In this paper, we discuss the findings of an exploratory document analysis (...) of the social justice-oriented ambitions, motivations, current practices and policy trajectories articulated in sixteen European UFSs. We reflect on the food-related resource allocations, value patterns and decision rules these cities propose to alter and the target groups they propose to support, empower or include. Overall, we find that UFSs make little explicit reference to social justice and justice-oriented food concepts, such as food security, food justice, food democracy and food sovereignty. Nevertheless, the identified resources, services and target groups indicate that the three dimensions of Fraser are at the heart of many of the measures described. We argue that implicit, fragmentary and unspecified adoption of social justice in European UFSs is problematic, as it may hold back public consciousness, debate and collective action regarding food system inequalities and may be easily disregarded in policy budgeting, implementation and evaluation trajectories. As a path forward, we present our plans for the RE-ADJUSTool that would enable UFS stakeholders to reflect on how their UFS can incorporate social justice and who to involve in this pursuit. This qualitative study examines the expectations and beliefs parents, students, and teachers have about the teaching of heritage histories in public high schools. Students from three heritage groups, as well as their parents and teachers, were interviewed to shed light on this complex, often silent, relationship. This study is grounded in literature about the purposes of history education, historical distance, and collective memory/heritage, which give shape to and help to explicate some of the more complex issues inherent in the teaching (...) of heritage histories. Participants included four Hmong students, three of their parents, and their teacher in St. Paul, Minnesota; eight Chinese students, nine of their parents, and their teacher in Elmdale, California; and five Jewish students, five of their parents, and their teacher in Maple Lake, Illinois. Findings indicate that the three stakeholder groups believe that the public school history classroom is an appropriate and desired place for heritage histories to be taught. This is complicated, however, by several factors: the placement of the heritage history narratives within larger curricular and mainstream narratives, how the teachers choose to incorporate the heritage narratives into the formal classroom curriculum, and the changing nature of historical and generational distance. Stakeholder management devices (SMDs) are the mechanisms through which organizations respond to stakeholder concerns. Given that SMDs serve as organizational control systems for employees and managers, this research investigates the internal rather than the external effects of a firm's SMDs. Unlike most previous research, I examined the effects of these formal structures, processes, and procedures in the aggregate, rather than focusing attention on a single type of device. The study investigates the effects of a firm's stakeholder management devices, in the (...) aggregate, on three factors that influence individual behavior in organizations: expectations, attitudes, and perceived organizational climates. Respondents were managers in 112 for-profit businesses located throughout the United States. Results suggest that a firm's stakeholder management devices affect the perceived moral climates in the firm, and affect managers' expectations about the consequences of good corporate social performance, but do not affect organization members' attitudes about corporate social responsibility. A national survey of CEOs of manufacturing firms was conducted to identify factors explaining CEOs' intentions to engage in two questionable business practices: soliciting a competitor's technological secrets and making payments to foreign government officials to secure business. Drawing on research in corporate misconduct, ethical decision making, and strategic management, the authors analyzed ethical intentions by looking at hostile environmental conditions, opportunity-rich situations, and/or personal characteristics. Based on responses to scenarios, their findings suggest that the ethical intentions of CEOs may (...) be more affected by the decision maker's predisposition than by environmental pressures or organizational/situational characteristics. This essay explores an increasingly popular genre of organized group travel in white mainline and emerging evangelical US Christianity I call “journeys to the margins”: trips centered on learning from marginalized persons for the traveler’s ethical formation. Drawing on ethnographic research with one case study, “Come and See Tours” to Israel/palestine, I interrogate how the commodified form of these trips shape possibilities for ethical subjectivation. First, I demonstrate ways in which journeys to the margins market ethical transformation to American Christian (...) consumers in the form of packaged moral narratives. Second, I focus on the paradoxical nature of journeys to the margins as simultaneously packaged commodities and ethical encounters. Finally, I use reformulations of freedom emerging from the anthropology of ethics to argue that possibilities for ethical subjectivation occur in moments when tour ideals come into tension with lived realities. In the current American iconoclash, certain monuments are subject to vandalism and municipal removal from their pedestals. Phrases such as “the erasure of history” and “damnatio memoriae” point to concerns that iconoclasm is an attempt to censor history or even remove certain individuals from public memory altogether. Because these phrases beckon the past, this wave of iconoclasm calls for a close examination of previous image-breaking to establish motives. Drawing first from art history, we analyze Byzantine iconoclasm and anxieties over the (...) nature of icons’ power, before contextualizing these findings within image destruction from the Paleolithic to the present day. Each comparison is suggestive of an enduring aesthetic principle: that what appears inanimate is not always inert. Next, drawing from cultural anthropology, we argue that principles of sympathetic magic are at the heart of contemporary iconoclasms, but not in the way media outlets often suggest. Instead, the fear of history’s erasure betrays a deeply rooted equivalence between the representation and the represented. In perceiving their fates as shared, sympathetic magic is seen to persist in the way humans create, interpret, and desecrate images. We conclude with the speculative realist proposition that iconoclasm can produce new, original artworks, which carries implications for the autonomy of art and its distribution between artist and artwork. Jones (1991) has proposed an issue-contingent model of ethical decision making by individuals in organizations. The distinguishing feature of the issue was identified as its moral intensity, which determines the moral imperative in the situation. In this study, we adapted three scenarios from the literature in order to examine the issue-contingent model. Findings, based on a student sample, suggest that (1) the perceived and actual dimensions of moral intensity often differed; (2) perceived moral intensity variables, in the aggregate, significantly affected (...) an individual''s moral judgments; and (3) some dimensions of moral intensity (namely, perceived social consensus and perceived magnitude of consequences) mattered more than others. Anthropology’s “ethical turn” opens space for dialogue with Christian ethicists engaged in the “ethnographic turn” using a common virtue-inflected language and set of concerns. While moral theologian Michael Banner has called for such a dialogue, there has been a lack of cross-pollination between Banner’s account and the broader ethnographic turn, which has turned to the practice theory of Pierre Bourdieu as its main social scientific interlocuter. In this essay, I argue that the limits of practice theory call for a diversification (...) of social scientific conversation partners in the ethnographic turn. I demonstrate how the anthropology of ethics offers one auspicious way forward in its ability to account for moral agency in everyday life. (shrink)

In 2017, British shock-artist Damien Hirst released a coffee-table book with photographs from his Venice Biennale exhibition, Treasures from the Wreck of the Unbelievable, featuring artifacts retrieved from a Roman-era shipwreck in the Indian Ocean. The following year, a “documentary” was released on Netflix featuring the backstory of the wreck's excavation, showing how all those coral-encrusted antiquities made their way from the seafloor to the art scene. At this same time and elsewhere in Britain, a practitioner of art history, art, (...) and maritime archaeology was in the process of developing the concept of “hauntography” as an object-oriented artistic method that represents (visually or otherwise) the ontological absent-presence of shipwrecks, that is, as objects that defy complete phenomenological access, while inspiring speculation into the uncanniness of being a thing of anthropogenic origin, but which persists beyond anthropos. Because both hauntography and Hirst's project make claims regarding epistemological and phenomenological limits pertaining to underwater wreckage, this article answers the question first posed by the author's students as to whether Hirst's satirical take on shipwreck archaeology ought to be considered the first hauntograph. By examining the relationships between two contemporary art projects, underwater archaeology, and object-oriented philosophies, this article considers how art objects might nudge epistemological limits without resorting to a post-truth dismissal of objective reality. There is increasing evidence to suggest that cytoplasmic tyrosine kinases of the Src family have a pivotal role in the regulation of a number of cellular processes. Members of this family have been implicated in cellular responses to a variety of extracellular signals, such as those arising from growth factors and cell‐cell interactions, as well as in differentiative and developmental processes in both vertebrates and invertebrates. A better understanding of the regulation and of the structure‐function relationships of these enzymes might (...) aid in the development of specific ways to interfere with their action, as well as serving as a paradigm for regulation of other protein tyrosine kinases that have SH2 and SH3 domains. In this review we will first discuss the regulation of Src family protein tyrosine kinases, with particular emphasis on their SH2 and SH3 domains. This study investigates financial correlates of corporate philanthropy in Fortune 1000 companies using structural equation modeling. The results suggest that cash flow (one of the most discretionary types of organizational slack) has a significant impact on a firm’s cash donations to charitable causes, but monetary donations do not affect firm financial performance. These findings support the accepted view of corporate philanthropy as a discretionary social responsibility and the traditional thinking about firm giving in the business and society literature—that doing well (...) enables doing good. Contrary to some contemporary thinking, the findings imply no significant effect on profits from corporate generosity. (shrink)

Although corporate decision makers may justify charitable contributions on strategic grounds, extremely large corporate philanthropic contributions may beperceived by shareholders as unnecessary. If stockholders attempt to limit corporate philanthropy, then governance mechanisms should put a cap on giving amounts. Using a matched-paired sample to control for industry and company size, theauthors compared big givers and small givers. The authors find that blockholders and institutional owners limit corporate philanthropy. Although compelling and insightful, the proposal by Uchiyama et al. largely neglects within-person change over time, arguably the central topic of interest within their framework. Longitudinal behavioural genetics modelling suggests that the heritability of trajectories is low, in contrast to high and increasing cross-sectional heritability across development. Better understanding of the mechanisms of trajectories remains a crucial outstanding challenge.

In a departure from the traditional studies of corporate philanthropy that focus on board composition, advertising, and social networks, the authors investigate the financial correlates of corporate philanthropy. The research design controls for firm size and industry while observing firms from a variety of industries. The sample contains matched pairs of generous and less generous corporate givers. The authors find, as hypothesized, a positive relationship between a firm''s cash resources available and cash donations, but no significant relationship between corporate philanthropy (...) and firm financial performance, regardless of whether corporate philanthropy is measured as cash payouts or the aggregate contributions that charities actually receive, and regardless of whether financial performance is gauged using accounting measures or market measures. Whereas the link between available resources and corporate philanthropy is well accepted in the literature on corporate social responsibility, it has been rarely tested and never so definitively found as in this research. The global COVID-19 pandemic has created a crisis of suffering. We conceptualize suffering as a deeply existential issue that fundamentally changes people indelible ways and for which there are no easy solutions. To better understand its effects and how people can flourish in the midst of this crisis, we formally introduce and elaborate on an Existential Positive Psychology Model of Suffering (EPPMS) and apply that to the COVID-19 global pandemic. Our model has three core propositions: (a) suffering reveals existential concerns, (...) (b) existential anxiety impairs one's ability to find meaning, and (c) cultivating meaning is the primary way to address suffering and allay existential anxiety, eventually leading to flourishing (and potentially growth). We apply this model to the COVID-19 pandemic, including how to build meaning, and discuss clinical implications. (shrink)

Self-regulation in early childhood is an important predictor of success across a variety of indicators in life, including health, well-being, and earnings. Although conceptually self-regulation has been defined as multifaceted, previous research has not investigated whether there is conceptual and empirical overlap between the factors that comprise self-regulation or if they are distinct. In this study, using a bifactor model, we tested the shared and unique variance among self-regulation constructs and prediction to pre-academic and social-emotional skills. The sample included 932 (...) preschool children, their parents, and their teachers in the United States. Children’s self-regulation was assessed using measures of executive function, behavioral self-regulation, and emotion regulation. The bifactor model demonstrated a common overarching self-regulation factor, as well as distinct executive function and emotion regulation factors. The common overarching self-regulation factor and executive function predicted children’s pre-academic and social-emotional skills. The emotion regulation factor predicted children’s social-emotional skills. Identifying the shared and unique aspects of self-regulation may have important implications for supporting children’s regulatory skills as well as their success in school. (shrink)

Repetitive negative thinking (RNT) describes a recursive, unproductive pattern of thought that is commonly observed in individuals who experience anxiety and depression. Past research on RNT has primarily relied on self-report, which fails to capture the potential mechanisms that underlie the persistence of maladaptive thought. We investigated whether RNT may be maintained by a negatively biased semantic network. The present study used a modified free association task to assess state RNT. Following the presentation of a valenced (positive, neutral, negative) cue (...) word, participants generated a series of free associates, which allowed for the dynamic progression of responses. State RNT was conceptualised as the length of consecutive, negatively valenced free associates (i.e. chains). Participants also completed two self-report measures that assessed trait RNT and trait negative affect. Within a structural equation model, negative (but not positive or neutral) response chain length positively predicted trait RNT and negative affect, and this was only the case for positive (but not negative or neutral) cue words. These results suggest that RNT tendencies may be reflected in semantic retrieval and can be assessed without self-report. (shrink)

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. This paper presents a comprehensive study of argumentation frameworks with necessities (AFNs), a bipolar extension of Dung Abstract argumentation frameworks (AFs) where the support relation captures a positive interaction between arguments having the meaning of necessity: the acceptance of an argument may require the acceptance of other argument(s). The paper discusses new main acceptability semantics for AFNs and their characterization both by a direct approach and a labelling approach. It examines the relationship between AFNs and Dung AFs and shows the (...) gain provided by the former in terms of concision. Finally, the paper shows how to represent an AFN as a normal logic program (LP) and vice versa and in both cases establishes a one-to-one correspondence between extensions under the main acceptability semantics (except for semi-stable semantics where the correspondence is not completely full) of an AFN and particular cases of 3-valued stable models of normal LPs. The global distribution of laboratory mouse strains is valued for ensuring the continuity, validity and accessibility of model organisms. Mouse strains are therefore assumed mobile and able to travel. We draw on the concept of ‘animal mobilities’ to explain how attending to laboratory mice as living animal, commodity and scientific tool is shaping how they are transported through contemporary scientific infrastructures and communities. Our paper is framed around exploring how animal strains travel, rather than animals, as we show that it (...) is only through understanding strain mobility that we can explain how and why live animal movement can be replaced by germinal products. The research is based on qualitative fieldwork in 2018 and 2019 that included 2 weeks ethnography and interviews with key informants involved in the movement of laboratory animals. The empirical analysis discusses practices that relate to managing biosecurity and animal welfare concerns when moving laboratory animal strains. In closing we reflect more broadly on the contemporary ‘ethico-onto-epistemological’ entanglement that shapes who or what travels to support laboratory science data-making practices, and the intensity of care ‘tinkering’ practices that facilitate the movement. We explain how a laboratory animal strain exceeds its value solely as a mobile and thus exchangeable commodity, illustrated in how values that relate to animal sentience and infection-risk supports its material transformation. Consequently, it is becoming increasingly common for non-sentient germinal products – embryos and gametes - to replace live sentient animals when being moved. (shrink)

We studied children’s (5–12 years of age) individual differences in how they played a strategic game by analyzing the strategies that they applied in a zero, first, and (...) second-order reasoning task. For the zero-order task, we found two subgroups with different accuracy levels. For the first-order task, subgroups of children applied different suboptimal strategies or an optimal strategy. For the second-order task only suboptimal strategies were present. Strategy use for all tasks was related to age. The 5- and 6-year old children were additionally tested on theory of mind understanding and executive functioning. Strategy-use in these children was related to working memory, but not to theory of mind after correction for age, verbal ability and general IQ. (shrink)

This paper outlines the background development of “intelligent“ technologies such as speech recognition. Despite significant progress in the development of these technologies, they still fall short in many areas, and rapid advances in areas such as dictation are actually stalled. In this paper we have proposed semi-automatic solutions — smart integration of human and intelligent efforts. One such technique involves improvement to the speech recognition editing interface, thereby reducing the perception of errors to the viewer. Other techniques that are described (...) in the paper are batch enrollment, which allows the user to reduce the amount of time required for enrollment, and content spotting, which can be used for applications that have repeated content flow, such as movies or museum tours. The paper also suggests a general concept of distributive training of speech recognition systems that is based on data collection across a network. (shrink)

In this article the authors challenge the hegemonic masculinity of the dominant football discourses on intra-Christian sectarianism in Scotland through a pilot study on women’s everyday experiences of sectarianism. The authors argue that dominant constructions of sectarianism often erase the standpoints of different kinds of women by minimising their roles both as agents for change and/or subjects who also reproduce sectarianism in their own right. The findings offer alternative narratives which problematise sectarianism as a white, male-only, working-class issue. This highlights (...) the need to legitimise different gendered manifestations of sectarian bigotry at the micro-social level of family and kinship networks particularly in relation to the seemingly feminised role of policing ethno-religious identities in marriage and the socialisation and upbringing of children. The explosion of data grows at a rate of roughly five trillion bits a second, giving rise to greater urgency in conceptualizing the infosphere and understanding its implications for knowledge and public policy. Philosophers of technology and information technologists alike who wrestle with ontological and epistemological questions of digital information tend to emphasize, as Floridi does, information as our new ecosystem and human beings as interconnected informational organisms, inforgs at home in ambient intelligence. But the linguistic and conceptual representations of (...) Big Data—the massive volume of both structured and unstructured data—and the real world practice of data-mining for patterns and meaningful interpretation of evidence reveal tension and ambiguity in the bold promise of data analytics. This paper explores the tacit epistemology of the rhetoric and representation of Big Data and suggests a richer account of its ambiguities and the paradox of its real world materiality. We argue that Big Data should be recognized as manifesting multiple and conflicting trajectories that reflect human intentionality and particular patterns of power and authority. Such patterns require attentive exploration and moral appraisal if we are to resist simplistic informationist ontologies of Big Data, and the subtle forms of control in the political ecology of Big Data that undermine its promise as transformational knowledge. This study investigates the relative roles of frequency and transparency in native speakers’ comprehension of Spanish object relative sentences by comparing performance with two variants of the construction that differ in these properties. Experiment 1 suggests that seven- to eight-year-old children’s processing of object relative sentences is consistently facilitated by variant frequency and likely relies on separate representations for each variant as two different, although related constructions. Experiment 2 turns to adult comprehension of the two variants, showing similar accuracy and (...) reaction time patterns for both variants for this population. This second outcome could be interpreted as a decrease in frequency effects over time, in line with the power law of practice, as an experience-based increase in the ability to make use of redundant markers, or both. The European Union is making increased efforts to find simpler and more effective ways to function adequately in the eyes of its citizens by using ‘soft law’ instruments such as recommendations. Although they have no legally binding force, recommendations have practical and legal effects occurring partly due to their normative content in which a course of action is prescribed and further supported by arguments intended to persuade the addressees of a political position. Although recommendations function as persuasive instruments due to (...) their argumentation, the characteristics of argumentation and how it is employed to convince the addressee to comply with certain measures have not been investigated at all. The main goal of the paper is to explain how arguments are used by the European Commission when recommending Member States to follow a new course of action. First, we will unravel the justificatory reasons employed by the Commission in order to make Member States comply with new measures and we will show how these reasons are combined into an argumentative pattern : 1–23, 2016; J Argum Context 6: 3–26, 2017). This pattern basically prescribes a course of action to Member States, which is further supported by arguments in which the necessity and advantages of following the proposed course of action are justified. Second, we will explain how and why the way in which the arguments are combined in this complex pattern could be potentially persuasive for the Member States despite the legally non-binding character of recommendations. We will show that the European Commission tries to persuade the Member States to take new measures by evading the burden of proof imposed by the legislative framework. At a more specific level of analysis, we will delve into the implicit premises in the argumentation, which enable us to identify cases of evasion of the burden of proof due to the Commission’s use of implicit starting points which might not be accepted by the Member States. Building on critical approaches that understand algorithms in terms of communication, culture and organization, this paper offers the supplementary conceptualization of algorithms as organizational figuration, defined as material and meaningful sociotechnical arrangements that develop in spatiotemporal processes and are shaped by multiple enactments of affordance–agency relations. We develop this conceptualization through a case study of a Danish fintech start-up that uses machine learning to create opportunities for sustainable pensions investments. By way of ethnographic and literary methodology, we provide an in-depth (...) analysis of the dynamic trajectory in and through which the organization gives shape to and takes shape from its key algorithmic tool, mapping the shifting sociotechnical arrangements of the start-up, from its initial search for a viable business model through the development of the algorithm to the public launch of its product. On this basis, we argue that conceptualizing algorithms as organizational figuration enables us to detail not only what algorithms do but also what they are. (shrink)

Little literature has looked at the role of universities promoting and supporting grassroots social innovations. This paper addresses this gap by examining how universities contribute to social innovation in Colombia. In seeking to develop a good understanding of how universities can contribute to the development of social innovation niches, we draw upon the Strategic Niche Management theory and the three areas of activity which constitute effective niche-building: social networks, expectations and visions and learning. We explore this phenomenon with the Parque (...) Científico de Innovación Social, founded by Uniminuto University in 2012, using video case study research methodology. Findings suggest the important role played by Uniminuto University influencing the current higher education system regime by enhancing the development of social innovation niches. These results have implications for advancing the debate on the role of higher education institutions in contributing to the development of social innovation processes.Poca literatura ha analizado el papel de las universidades promoviendo y apoyando las innovaciones sociales de base. Este documento aborda esta brecha al examinar cómo las universidades contribuyen a la innovación social en Colombia. Al tratar de desarrollar una buena comprensión de cómo las universidades pueden contribuir al desarrollo de nichos de innovación social, recurrimos a la teoría de Gestión Estratégica de Nichos y las tres áreas de actividad que constituyen la creación efectiva de nichos: redes sociales, expectativas y visiones y aprendizaje. Exploramos este fenómeno con el Parque Científico de Innovación Social, fundado por la Universidad de Uniminuto en 2012, utilizando la metodología de investigación de estudios de casos de video. Los hallazgos sugieren el importante papel desempeñado por la Universidad de Uniminuto que influye en el régimen actual del sistema de educación superior al mejorar el desarrollo de nichos de innovación social. Estos resultados tienen implicaciones para avanzar en el debate sobre el papel de las instituciones de educación superior en la contribución al desarrollo de los procesos de innovación social. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)
