This paper explores Hegel’s perspective on development within nature, his supposed rejection of evolution, and his concept of nature as a “system of stages.” It argues that interpreting Hegel through the lens of emergentist thinking provides a more accurate understanding of his conception of nature and its development, as well as his critique of evolution. The paper is structured in three parts. First, we introduce emergentist theory, exploring its contemporary and historical meanings to establish where Hegel fits within this framework. (...) Second, we carefully examine Hegel’s critique of evolution, particularly his opposition to simple causal chains, and clarify what “evolution” meant in his time. Finally, we argue that viewing Hegel through emergentist theory not only rehabilitates his ideas but also resolves lingering concerns about his understanding of development within nature. Not all intellectual property rights grant the right to exclude that is indicative of “property rules,” as that term was used by Guido Calabresi and A. Douglas Melamed in their seminal article. Some intellectual property rights are “liability rules,” in which the right holder has an entitlement to compensation for use of the protected invention, not a right to preclude the use. Although patent laws normally grant a right to exclude others from use of the protected invention as a (...) default, most countries’ laws allow the government to convert the patent property rule into a liability rule through a compulsory license. It has been noted, for example, that by the end of the 1950s, the U.S. had issued compulsory licenses covering 40 to 50 thousand patents, including substantial portions of the patent portfolios of AT&T, General Electric, IBM, and Xerox. The U.S. Supreme Court recently expressed a willingness to accept liability rules over injunctions in some patent infringement cases. (shrink)

Sean B. Carroll’s new book, The Serengeti Rules: The Quest to Discover How Life Works and Why it Matters, is a well-written mix of history of science and philosophy of biology. In his book, Carroll articulates a set of ecological generalisations, the Serengeti Rules, which are supposed to make salient the structures in ecosystems that ensure the persistence of those ecosystems. In this essay review, I evaluate Carroll’s use of the controversial concept of regulation and his thesis that ecosystems (...) have a natural balance comparable to that of human bodies. My conclusion is optimistic. Carroll’s generalisations provide a tool-kit for building relatively simple models that are accurate enough to be widely applied in experimental ecology and conservation science, guiding interventions upon unhealthy ecosystems. In the wake of the Stoneman Douglas School shooting, Republican and Democratic leaders—like the American electorate they represent—remain sharply divided in their responses to gun violence. They are united in their condemnation of these mass shootings, but they disagree about whether stricter or looser gun control laws are the answer. Those on the right side of the political aisle suggest that the issue is one of mental illness rather than gun control. Conversely, those who are more liberal or progressive (...) in their political learnings are quick to condemn attempts to reframe the issue of mass shootings as a mental health problem. Both sides are wrong. Mass shootings are indeed partially a mental health problem, albeit one poorly addressed by our current laws and policies. But the solution to mass shootings also needs to consider strategies that may reduce gun violence in general. (shrink)

A new pragmatic approach, based on the latest developments in argumentation theory, analyzing appeal to expert opinion as a form of argument. Reliance on authority has always been a common recourse in argumentation, perhaps never more so than today in our highly technological society when knowledge has become so specialized—as manifested, for instance, in the frequent appearance of "expert witnesses" in courtrooms. When is an appeal to the opinion of an expert a reasonable type of argument to make, and when (...) does it become a fallacy? This book provides a method for the evaluation of these appeals in everyday argumentation. Specialized domains of knowledge such as science, medicine, law, and government policy have gradually taken over as the basis on which many of our rational decisions are made daily. Consequently, appeal to expert opinion in these areas has become a powerful type of argument. Challenging an argument based on expert scientific opinion, for example, has become as difficult as it once was to question religious authority. Walton stresses that even in cases where expert opinion is divided, the effect of it can still be so powerful that it overwhelms an individual's ability to make a decision based on personal deliberation of what is right or wrong in a given situation. The book identifies the requirements that make an appeal to expert opinion a reasonable or unreasonable argument. Walton's new pragmatic approach analyzes that appeal as a distinctive form of argument, with an accompanying set of appropriate critical questions matching the form. Throughout the book, a historical survey of the key developments in the evolution of the argument from authority, dating from the time of the ancients, is given, and new light is shed on current problems of "junk science" and battles between experts in legal argumentation. Analysis and case studies show that including different orientations toward the natural world makes for more effective scientific practice and science education.

Several diagrams and tables from review articles during the Ox-Phos Controversy serve as an occasion to assess the nature of competition in models of theory choice in science. Many models follow "Super-Bowl" principles of polar, either-or, winner-take-all competition. A significant alternative highlighted by this episode, however, is the differentiation of domains. Incommensurability and the partial divergence of overlapping domains serve both as signals and context for shifting frameworks of competition. Appropriate strategies may thus help researchers diagnose the status of competition (...) and shape their research accordingly. (shrink)

Partly due to the influence of Tarski's work, it is commonly assumed that any good theory of truth implies biconditionals of the sort mentioned in Convention T: instances of the T-Schema "s is true in L if and only if p" where the sentence substituted for "p" is equivalent in meaning to s. I argue that we must take care to distinguish the claim that implying such instances is sufficient for adequacy in an account of truth from the claim that (...) doing so is necessary. The claim that doing so is sufficient is a common component of deflationary theories of truth, while the claim that it is necessary, though often assumed, must be denied by proponents of rival inflationary theories of truth. I discuss the clarification of the debate between these views of truth that results from distinguishing the necessity and the sufficiency claims, and examine the prospects for its resolution. Effective Field Theory (EFT) is the successful paradigm underlying modern theoretical physics, including the "Core Theory" of the Standard Model of particle physics plus Einstein's general relativity. I will argue that EFT grants us a unique insight: each EFT model comes with a built-in specification of its domain of applicability. Hence, once a model is tested within some domain (of energies and interaction strengths), we can be confident that it will continue to be accurate within that domain. Currently, the Core (...) Theory has been tested in regimes that include all of the energy scales relevant to the physics of everyday life (biology, chemistry, technology, etc.). Therefore, we have reason to be confident that the laws of physics underlying the phenomena of everyday life are completely known. (shrink)

I highlight a category of experiment-what I am calling 'demonstrations'-that differs in justificatory mode and argumentative role from the more familiar 'crucial tests'. 'Tests' are constructed such that alternative results are equally and symmetrically informative; they help discriminate between alternative solutions within a problem-field, where questions are shared. 'Demonstrations' are notably asymmetrical (for example, "failures" are often not telling), yet they are effective, if not "crucial," in interparadigm dispute, to legitimate questions themselves. We describe here an interdisciplinary lab science course for non-majors using the history of science as a curricular guide. Our experience with diverse instructors underscores the importance of the teachers and classroom dynamics, beyond the curriculum. Moreover, the institutional political context is central: are courses for non-majors valued and is support given to instructors to innovate? Two sample projects are profiled.

It is frequently remarked that Merleau-Ponty did not write about race, gender, or anti-Semitism. Overall, this is true, but the relatively recent re-publication of his Sorbonne lectures, along with some new materials, shows that his lectures did address the issues of racism, sexism, and anti-Semitism. In addition, Emily Lee’s framing of Merleau-Ponty’s theory of the human body provides a useful way to understand its relationship to race and gender. While humans are fundamentally the same biologically, “secondary biological characteristics” such as (...) skin color (and gender), situated in various social contexts, have a significant impact on the formation of one’s personal and social identity. What I seek to do here is find in Merleau-Ponty’s work the philosophical roots of Lee’s claim. I also seek to find the moral recognition of the other in Merleau-Ponty’s treatment of time and how his treatment of time relates to the two-dimensionality of the human body. It is this treatment that allows us to recognize the sameness of the other but that also allows us to recognize and respect differences. (shrink)

This chapter puts Sellars' project of unifying his two images in conversation with that of understanding how the two truth, the conventional and ultimate truth, are related in Buddhism, and in Madhyamaka in particular.

He addresses three main issues: first, the historical means by which economics has consciously surrendered its original association with ethical categories and criteria; second, the need to articulate the appropriate thoughtforms and vocabulary of ethical theory; and third, the illustration of areas in economics where ethical awareness is desirable and should be allowed to exert influence.

In lieu of an abstract, here is a brief excerpt of the content:Socrates' Trial and Conviction of the Jurors in Plato's ApologyDougal BlythI am going to argue in this paper that, in the three speeches constituting his Apology of Socrates, Plato presents the judicial proceedings that led to Socrates' execution as having precisely the opposite significance to their superficial legal meaning. This re-evaluation will lead to some reflections on the politics of Socrates' defence, and, similarly, on Plato's own aims in (...) writing the Apology. I want to show not only that the trial as portrayed demonstrates an inevitable dereliction of duty by the democratic jury, but also, more interestingly, that throughout the proceedings Socrates understands the meaning of the trial precisely in terms of his anticipation of the jurors' judicial incapacity.In the prooimion to his defence speech, Socrates requests that the jurors ignore his manner of speaking and concentrate on whether his case is just, "since this is a judge's virtue (), while that of a rhêtôr is to speak the truth" (18a5-6, cf. 35c2-5). We can gloss the expression "a judge's aretê" in this context as his function, or responsibility.1 Socrates claims that he, himself, fulfills his own responsibility as a defendant to tell the truth (17b4-c4, 33c1-2, cf. 34b5, 35b9-c2) in a speech that asserts his exemplary piety in Apollo's service and his beneficial influence on the Athenian youth. But if, in claiming that he is innocent of the charge, Socrates does tell the truth, then those jurors who thereupon convict him of impiety and corruption, and subsequently sentence him to death, have failed in their duty to judge rightly.My claim is that Socrates sees the trial as a test of the jurors' abilities. It is characteristic of Socrates to test people regarding their concern for virtue and justice, a habit to which he devotes extended discussion during his defence, even dramatising it provocatively in a central passage (29d7-e5) that I aim shortly to analyse in detail. Moreover, Socrates specifically withholds from the jury the title of dikastai or judges; he does finally award the title in his address following the sentence, but only to those who have voted [End Page 1] to acquit him (40a2-3).2 The possibility thus emerges that Socrates has treated the legal proceedings all along as a moral (and intellectual) test, or trial, of the empanelled jurors themselves, to see whether they are capable of the legal function to which they have been allotted. In that case, Socrates is putting on trial, not just those individual citizens, but the very legal system of democratic Athens.Socratic irony and truthfulnessBefore considering Socrates' own explicit judgement during those final remarks on the jurors' moral offence and punishment, I should first address briefly the issue of Socrates' irony. In the past, some writers have asserted that this irony involves him in not telling the truth about himself during his defence, in which case the jury might well have been justified in convicting him. Actually, there does seem to be a consensus among the more extended treatments of the Apology that have emerged during the last decade, at least on the point that Plato presents Socrates as committed to making as sincere an attempt at a defence of his case as is consistent with his philosophical commitment to virtue, and so to telling the truth.3I shall not re-argue this point in detail, but shall take it to be secured by two basic considerations: consistency with the Crito would require Socrates to recognise a legal obligation to make a sincere attempt at defence while his obligation to Apollo to continue his mission in Athens if possible would motivate that attempt with the goal of acquittal.4 Instead, I want to show what role irony does have in Socrates' defence, given that his principled law-abidingness requires him to attempt to persuade the jury, in accordance with truth and justice, that he is innocent (cf. 19a6-7, 18a7-b1, 18e5).Where Socrates acknowledges the obligation to defend himself, he remarks on the difficulty he faces, a difficulty that has resulted from the slander to which he has long... In this paper I will provide a brief summary of Merleau-Ponty’s philosophy as it is relevant to the concept of reason. Merleau-Ponty’s position comes between the two now dominant views of reason: the traditional view that relies on principles of rationality (identity and noncontradiction) that are supposedly preexistent, either in a realm of ideas or in nature in itself, and the postmodem/deconstructionist view that claims that language is a system of differences with no positive terms, that the concepts of identity (...) and presence are simply a creation of a “deferring” language. For Merleau-Ponty the principle of identity (presence) is neither pregiven nor an arbitrary creation of language but has its roots in a bodily blending of lived perceptual perspectives, of the individual’s within his or her won body and of the individual’s with the perspectives of others. Merleau-Ponty’s thesis thus allows us to escape the traditional error of accepting principles of reason as absolute and pregiven, for the blending of perspectives always remains to be accomplished, and it allows us to avoid the postmodemist claim that the principles of rationality are simply a creation of language, for in Merleau-Ponty’s philosophy, language is a sublimation of the body’s openness unto the world and others. Unhappily, most writers who seek to relieve the present "dreary" situation in aesthetics offer us either verbal pettifogging or nineteenth century "systems." We are, therefore, indebted to Harold Osborne for publishing a brave, bold, wise, and defective book in the field. Despite their defects, these essays clarify some important issues in important ways. They deserve the serious attention of everyone seriously interested in art.

Pesticides remain an integral part of development efforts to renew economic growth in Central America and lift the region out of a severe economic crisis. This paper analyzes the implications of the continued reliance on pesticides for heightening economic and ecological problems in the agrarian sector.Relying on a case study of export melon production in Choluteca, Honduras, the author argues that current development strategies, which rely heavily on pesticides, are generating ecological disruption that creates conditions biased against small producers. Lack (...) of knowledge of the hazards inherent in the technology and the resulting emergence of pesticide resistant pests, crop losses, environmental contamination, and public health problems, pose serious obstacles to the survival of small-scale producers. Meanwhile transnational and other flexible, large scale operations often adapt to such conditions, and on occasion may even turn such problems to their benefit. The author concludes that economic growth may only be sustainable when questions of social equity and ecological viability are brought to the forefront of U.S. development strategies. (shrink)

IN THIS CHARMINGLY DISARMING FASHION Quine got us off on the wrong foot. No ontologist is interested in the attempt to give a complete inventory of the things which are. He is, indeed, interested in the sorts of things which are, but not just any list of sorts of things would interest him. There are, one might well say, white dogs, brown dogs, and brown and white dogs. Clearly these are some of the sorts of things there are. But such (...) a list is of profound disinterest to ontologists because, I take it, such things are all of a more general sort, and it is the more general sorts of things which interest them. But, of course, dogs and frogs are more general sorts of things and ontologists are not interested in them either. There is something radically uninteresting even about the more general sorts of things so long as they are not in some sense ontologically basic or ultimate. The ontologist, we might say, is very much interested in providing, among other things, a list of the ultimate sorts of things. And here there is much room for disagreement. But, unfortunately, the ontologist’s interest can now no longer be said to be simple or clear, for it is by no means obvious what might be meant by such a phrase as "ontologically basic." It is the aim of this paper to get a little closer than has Quine to an understanding of what this phrase might come to. (shrink)

We present data on historical changes in violent crime contradicting that perspective, and discuss recent evidence showing how an evolutionary perspective predicts sex similarities and differences responding in a flexible and functional manner to adaptively relevant triggers across different domains.

MikkelsonComparative studies of Christianity and Buddhism have the potential to draw on a wide array of dialogic partners from their respective histories. Two promising candidates are Thomas Aquinas (1225–1274) and Dōgen (1200–1253). Aquinas was the angelic doctor whose theological thinking became normative for Roman Catholicism; Dōgen was the prominent Zen master whose influence on the intellectual development of Zen (...) Buddhism is unsurpassed. As it happens, both men "entered into the religious life," and within their respective collected works we see considerable attention to the topic. If we seek to explore what they had to say on the subject, we might benefit by identifying some texts from both thinkers that could serve as focal points for a comparative analysis. Of the massive accumulated writings of both men, the largest are Aquinas's Summa Theologiae and Dōgen's Shōbōgenzō. So it seems logical to start our search by turning our attention to these monumental works.Let us begin with the Summa Theologiae. In the secunda secundae Aquinas addresses a total of 189 topics presented in a question-and-answer format. The first 170 topics concern "themes related to all stations of life"; questions 171–189 explore "details related to particular callings" (2a2ae, Prologus). Question 189, hereinafter identified as 2a2ae q. 189, is specifically devoted to the topic of "entering the religious life" (de ingressu religionis).1When we turn to the Shōbōgenzō, we find a work titled Shukke Kudoku. "Kudoku" means "merit"; "shukke," commonly translated as "leaving home," denotes a person who has renounced home and family in order to enter monastic life. Thus "Shukke Kudoku" can be rendered in English as "The Merit of Entering the Religious Life."2Given that these texts are relatively accessible and substantive presentations of comparable length on issues pertaining to the religious life, they seem to be good focal points for this discussion. At the same time, both thinkers addressed the subject in other venues also, and we can briefly refer to this material as well. But in this article I will primarily concentrate on how a comparative analysis of these two texts illuminates the subject. Defining the discussion in this fashion has the advantage of presenting Aquinas's and Dōgen's views in a particular time and place, leaving aside the more complex issue of how their views may have changed over time. [End Page 109]Let us begin with Aquinas. Aquinas begins 2a2ae q. 189 by outlining ten points of inquiry to be pursued, in effect dividing the question into ten subquestions. The first on the list is "whether those alone should enter religious life who are practiced in keeping the commandments." The commandments he means, of course, are the precepts of the decalogue, the Ten Commandments of Exodus 20:17 and Deut. 5:6–21.Aquinas's standard modus operandi was to first entertain arguments leading to aconclusion opposing his own. In this question he outlines five lines of argument, and in each instance the arguments lead to the assertion that one should not practice the counsels "until one is practiced in keeping the commandments" (nisi prius sit exercitatus in praeceptis); by "counsels" Aquinas means the observance of poverty, chastity, and obedience that are undertaken by those who enter the religious life. As he had explained previously, "The difference between a counsel and a precept lies in this, that a precept implies necessity, while a counsel is left to the choice of the one to whom it is given" (1a2ae q. 108.4).3 Precepts such as the commandments, in other words, enjoin an obligation; counsels are optional.We will discover Aquinas's own answer soon, but we should first note how Aquinas begins his discussion of entrance into the religious life. He begins by posing a question about whether or not one practiced in keeping the commandments should enter the religious life. In the course of answering his own question, he essentially reframes it, seeking to explore whether or not one should practice the counsels before one has become adept at keeping the commandments.
