This qualitative research study, a replication of a study published in 2002, investigated the qualities of a good nurse and the role ethics plays in decision making. After reviewing the limitations of the published work, the current study implemented modifications related to the research questions, sample selection, data collection, and use of software for data analysis. The original study identified seven categories that related to being a good nurse and doing the right thing. In the present study, the use of (...) relational analysis led to the recognition of four categories: (1) personal traits and attributes; (2) technical skills and management of care; (3) work environment and co-workers; and (4) caring and caring behaviors. To understand what it means to be a good nurse and do the right thing is a complex task; however, this research adds to the small amount of empirical data that exists to describe those characteristics. The full range of Bentham's engagement with Blackstone's view of law is beyond the scope of a single article. Yet it is important to recognize at the outset, even in a more restricted enquiry into the matter, that the engagement, begun when Bentham, not quite sixteen years of age, started to attend Blackstone's Oxford lectures, was indeed a lifelong affair. Whatever Bentham had in mind when, at the age of eighty, in 1828, he began to write a work entitled ‘A (...) familar view of Blackstone: or say Blackstone familiarized’, the manuscripts at least suffice to prove that ‘Our Author’ was still in the forefront of his mind at that octogenarian but still indefatigably active stage of his career. Every aspect of Bentham's multifarious intellectual activity over the intervening decades had been touched in some measure by his response to Blackstone's ideas. It still seems true to say what was said a dozen years ago: It would be an exaggeration to say that Bentham elaborated his own conception of law by way of a constant and conscious dialectic with the views of Blackstone. But it would be an exaggeration for which the evidence would afford some excuse. (shrink)

The study of cases of illusory or unstable perception of some visual stimuli allows exploration of the psychology of perception of the surrounding world. The wired construction known as “Necker cube” is one such stimulus: it can be perceived as a cube whose front face is seen higher than the back face or vice versa. The switch can occur intentionally or spontaneously. The investigations were focused on switching parameters, relation of the switching to eye position, pre-history, and environment. Here we (...) define that the kernel of the problem is recognizing the 2D drawing as a 3D Necker cube. To this end, we have expanded Gestalt's psychology methods that allow us to recognize 2D figures in drawings for recognizing 3D figure in a flat drawing (including the Necker cube). The presented algorithm for recognizing the cube based on the imitation principle allowed the development of the model of switching between two possible perceptions of the Necker cube. The paper shows that the predictions are in conformity with previously available experimental data. The results confirm the imitation principle of perception, and suggest expanding our research on perception to a wider class of 3D figures, opening a window into the internal processes of perception. Anne Conway produced only one short treatise – The Principles of the Most Ancient and Modern Philosophy – but addressed key problems in the philosophy of religion which are still much discussed today. The most significant of these are the problem of religious diversity and the problem of evil. Although the sources of her ideas may be found in the Kabbalah of Isaac Luria and the work of the Cambridge Platonists and the Quaker George Keith, among others, she offers her (...) own unorthodox solutions to these problems. The idea of Christ as an indwelling mediator of the divine who assists us in our moral endeavours is designed to appeal to those of all religions and none, while her claim that God created creatures knowing that they would eventually be redeemed, and that suffering promotes moral development which leads to redemption offers a novel response to the problem of evil. Conway's work is also important for its influence on the work of Gottfried Wilhelm Leibniz, and some have argued that it prefigures, at least in outline, the field theory of modern physics. (shrink)

Social epidemiology has made a powerful case that health determined not just by individual-level factors such as our genetic make-up, access to medical services, or lifestyle choices, but also by social conditions, including the economy, law, and culture. Indeed, at the level of populations, evidence suggests that these “structural” factors are thepredominantinfluences on health. Legal scholars in public health, including those in the health and human rights movement, have contended that human rights, laws, and legal practices are powerfully linked to (...) health. Social epidemiology and health-oriented legal scholarship are complementary in their focus and their research needs. Legal scholarship has identified plausible ways in which legal and human rights factors could be influencing health, but empirical evidence has been limited. (shrink)

In this paper we will discuss the issue of environmental advocacy in science education in light of William Hare’s concept of open-mindedness. Although we shall assume that science teaching and learning must go beyond the scientific facts and theories and deal with the implications of science for society, we shall argue that science education should also demand an open-mindedness about environmental concerns such that all proposals for sustainability and the like are weighed against the alternatives using the best scientific knowledge (...) available. Our approach will be to describe two examples of environmental education that recommend insufficiently open-minded forms of teaching and a third example that avoids this shortcoming yet provides a sound basis in environmental education. This short essay summarizes an understanding of the trial as a medium in which law is realized or actualized, rather than imposed or enforced. It suggests that we should pay close attention to the actual practices that prevail at trial, its "consciously structured hybrid" of languages and practices, if we want to understand the nature of law.

Burns: To understand consciousness we need know its relationship to the brain, and to do that we need to know how the brain processes information. A lot of people think of brain processing in terms of individual neurons, and you're saying that brain processing should be understood in terms of dynamical states of populations?

This article examines the views of Hegel and Alasdair MacIntyre regarding philosophical disagreements, whether or not they can be resolved and if so how. For both thinkers such a disagreement is thought of as taking place between the advocates of two theoretical positions which are opposed to one another. Each party subscribes to a way of thinking about the issue under discussion which appears to be logically incompatible with the views of the other. We seem therefore to have to make (...) an either-or choice between them. In the case of all philosophical disagreements, therefore, the same questions arise. Is the contradiction in question real, or merely apparent? Can it be resolved? If so, what exactly is involved in such a resolution? Is some form of theoretical compromise, between these two extremes possible? Is there a third-way, a both-and approach, which in some way combines the strengths of each and the weaknesses of neither, or which seeks in some way to balance their respective strengths and weaknesses of each against those of the other? The article suggests that MacIntyre differentiates between two types of philosophical disagreement. In the case of the first, the ideas associated with the two opposed positions are incommensurable. We must, therefore make an either-or choice between them. In the case of disagreements of the second type, the ideas in question are not incommensurable. In these cases, therefore, it is possible for them to be combined or synthesised. The article argues that MacIntyre’s approach to this second type of philosophical disagreement has an obvious affinity with what is often thought to be that of Hegel. In the words of Richard J. Bernstein, it is ‘quasi-Hegelian’. It is therefore fruitful to compare and contrast the views of these two thinkers on this issue. (shrink)

In this paper I give some reasons why ‘saving for future generations’ is not as straightforward as it sounds and when we might be skeptical of the permissibility of states saving for future citizens, even though such savings are often seen to be morally praiseworthy. I emerge with an account of when state savings for future citizens through sovereign wealth funds may be morally permissible. I argue that we ought to follow a modified version of Armstrong’s criteria for the moral (...) permissibility of sovereign wealth fund savings. That is, states are entitled to the full proceeds from the sale of a natural resource until their citizens’ basic rights are secured. Once they are, states are entitled only to the improved value of the resource, so long as they have not excluded others from the opportunity also to improve the resource. States may create sovereign wealth funds based on this improved value and, due to justified compatriot partiality, may choose to distribute those funds to current or future members of the state, even if non-citizens may be worse off and/or in greater need. Any residual value of the resource extraction must be redistributed globally. (shrink)

Critics of Levinas reject the notion that the abstract face of the other can ground ethics and generate specific responsibilities. To the contrary, I argue that the face does ground a practical and pragmatic ethics. Drawing on Levinas' phenomenological analyses of the enjoying subject, I show that the face communicates an imperative to the subject that obligates her or him to repair the concrete context of action in which the subject encounters the other. My elucidation takes very seriously the notion (...) that the face speaks and the face is a body. When coupled with a pragmatic account of communication, Levinas gives us a robust elucidation of the phenomenological and pragmatic dimensions of ethical responsibility. No recent scholar has ever seriously maintained the genuineness of [Andokides] Oration IV, Against Alkibiades. Against it, one need cite no more than Blass, Attische Beredsamkeit , pp. 325–31; Jebb, Attic Orators , vol. i, pp. 133–9; an, pp. 191–210. The speech is quite ‘out of character’ for Andokides, who was certainly far too young ever to have been in danger of ostrakism as an alternative victim to Nikias or Alkibiades; and there is no reasonable doubt that its ‘dramatic date’ (...) is early in 415, and its ostensible speaker Phaiax, the clever young orator of Aristophanes' Knights , ambassador to Sicily in 422 and butt of Eupolis on divers occasions . These conclusions, however, leave open certain other material questions, especially that of the real date of the composition, on which in turn depends the question how far it can be legitimately used as an historical or biographical source. Although ethics education within the business curriculum has been receiving attention, much is unknown about the effectiveness of such education, particularly when it is integrated into the curriculum. This study looks at selected short-term effects produced by one form of integrated ethics instruction in an introductory marketing course in a graduate business MBA program in the United States. Specifically, students were introduced to an examination of consumer culture as a unifying framework to explore the ethics of decision making. As a (...) consequence of taking the course, students are hypothesized to hold less favorable attitudes toward consumer culture (love of money, materialism, possession satisfaction index, prestige sensitivity) relative to the attitudes held at the start of the course. Interestingly, few attitudinal changes are observed. Where changes in attitudes are observed, the relationships are in the opposite direction to that hypothesized. (shrink)

This paper explores what could be wrong with the fact of human extinction. I first present four reasons why we might consider human extinction to be wrong: it would prevent millions of people from being born; it would mean the loss of rational life and civilization; it would cause existing people to suffer pain or death; it would involve various psychological traumas. I argue that looking at the question from a contractualist perspective, only reasons and are admissible. Locke bases his moral and political philosophy on his doctrine of the ‘law of nature’. Scholars have debated the content and grounding of this law and its relationship to Christian theology. The ambiguities of the Lockean natural law’s content are traceable to an unclear grammatical construction in a crucial passage of the Treatises of Government, which can be resolved by following out a related set of arguments in that work. The ambiguities of the Lockean natural law’s grounding can then be (...) resolved by the hypothesis, strongly supported by textual evidence, that Locke relies tacitly on the reasoning of a parallel passage in Hobbes. Lockean natural law rests on neither atheistic nor specifically Christian premises but on a hypothetical natural theology. Locke’s conclusions from that natural theology represent an attempt to follow out Hobbesian logic while also tightening it up on one important point on which Hobbes himself appears to vacillate.
