Since the onset of the SARS-CoV-2 pandemic, an array of off-label interventions has been used to treat patients, either provided as compassionate care or tested in clinical trials. There is a challenge in determining the justification for conducting randomised controlled trials over providing compassionate use in an emergency setting. A rapid and more accurate evaluation tool is needed to assess the effect of these treatments. Given the similarity to the Ebola Virus Disease (EVD) pandemic in Africa in 2014, we suggest (...) using a tool designed by the WHO committee in the aftermath of the EVD pandemic: Monitored Emergency Use of Unregistered and Investigational Interventions (MEURI). Considering the uncertainty around SARS-CoV-2, we propose using an improved MEURI including the Plan–Do–Study–Act tool. This combined tool may facilitate dynamic monitoring, analysing, re-evaluating and re-authorising emergency use of unproven treatments and repeat it in cycles. It will enable adjustment and application of outcomes to clinical practice according to changing circumstances and increase the production of valuable data to promote the best standard of care and high-quality research—even during a pandemic. In this article I argue that we should distinguish two characterizations of objectivism: Mind Nongroundedness Objectivism and Mind Independence Objectivism. I focus on the debate in metaethics, although the distinction may generally apply to others. According to Mind Nongroundedness Objectivism, moral standards are not grounded in any mind, while according to Mind Independence Objectivism, moral standards hold independently of any mind. Despite its importance, this distinction has so far not been noticed in the literature. I argue that this distinction helps (...) elucidate otherwise puzzling metaethical positions. (shrink)

The aim of this paper is to argue for some useful distinctions in the theory of grounding. I do so by first introducing the notion of grounding, discussing some of its features, and arguing that grounds must play some role in bringing about what they ground (sec.1). I then argue that there are various distinct roles a fact may play in bringing about another, and more particularly that we should distinguish between three such roles; enablers, partial grounds, and facts that (...) partly ground (sec. 2). Finally, I present two theoretical advantages to incorporating these distinctions into our theory of grounding. Namely, that it reframes, and arguably dissolves, the contingentist-necessitarian debate (sec. 3), and that it helps to elegantly deal with the purported counterexamples to the transitivity of grounding and thus maintain the plausible elements of the assumption that grounding is a transitive relation (sec.4). Assuming the existence of God and divine commands, it makes sense to ask to what end God issues commands. This question has been raised in recent philosophical literature in the context of whether there can be a divine command to believe in, or to worship, God. In this article, I argue that the answers proposed to this question fail to appreciate the wide range of possible purposes of divine commanding. Being and Time's fundamental ontoogy and existentialism both rest on the A Potiori Claim, which states that originary temporality is, although non-sequential, a genuine and basic concept of time from which we derive our more ordinary, sequential concept of time. In this paper, I develop a new reading and defense of this claim against the readings of William Blattner, which ties originary temporality too tightly to the particular roles and identities we live out and must therefore find Heidegger's project a (...) failure, and Tony Fisher, who implies that our various roles and identities hang together in time in a merely accidental and non-rational way. On my reading, originary temporality is the structure of Dasein's characteristic activity of existential commitment. Through this activity, we each work out, in our own case, what it takes to embody the capacity for sense-making, at all. Here, the non-sequentiality of originary temporality reflects the way in which commitments are revised and sustained through time, while the sequence of nows derives from our need to embody our commitment in a single life that negotiates among the practical demands that our various identities make of us. ABSTRACT A new phenomenon in the philosophical discipline, philosophical practice—or counselling—is introduced to the reader through the description of three different approaches to philosophical practice. What is common to these approaches is that an academically trained philosopher philosophises together with a ‘sane’person—the visitor—on questions and problems relevant to the visitor. The essential difference between this and psychological counselling is that philosophers do not use therapeutic methods or make diagnoses. The philosophical practitioner triggers in his dialogue partner a didactic philosophical process, (...) which enables the visitor to become an authentic thinker and eventually to arrive at philosophical answers by her/himself. The effectiveness of the language used in philosophical practice is not so much in applying philosophical ideas or theories as in the philosophical knowledge, skills and attitudes attained by the visitor. Moral disagreements often revolve around the issue of harm to others. Identifying harms, however, is a contested enterprise. This paper provides a conceptual toolbox for identifying harms, and so possible wrongdoing, by drawing several distinctions. First, I distinguish between four modes of human vulnerability, forming four ways in which one can be in a harmed state. Second, I argue for the intrinsic disvalue of harm and so distinguish the presence of harm from the fact that it is instrumental to or (...) constitutive of a valued act, practice or way of life. Finally, I distinguish between harm and wrongdoing, arguing that while harm is a normative concept requiring justification, not all harmed states are automatically unjustified. The advantage of this view is that it refocuses the moral debate on the normative issues involved while establishing a common basis to which both sides can agree: the presence of harm to others. There is a well‐established asymmetry in our judgments of performance enhancing drugs (PEDs) in sports and in other competitive activities. When an athlete is found using such drugs, it is a scandal that prompts public outrage, fan disappointment, and even loss of title. It seems that we judge enhanced results cannot be genuinely attributed to athletes. There is no similar reaction to use of PEDs in art, science, music, literature, business, and other human endeavors. The question I tackle in this (...) paper is whether this disanalogy is justified: Is there some underlying difference in virtue of which PEDs should be thus stigmatized in sports but not elsewhere? I survey a couple of potential justifications that I find lacking. I then consider the difference in our judgments of the participation of superman‐like characters in sports (which we censure) and in other activities (which we endorse). I argue that the fact that the athlete is human is relevant to the value of sports—and by extension, the status of the effort involved—while this fact plays no significant role with regard to the value of other activities and that this difference in the value of activities ultimately justifies our differing judgments here. I then return to my initial question and examine whether similar appeal to what is human can justify the varying judgments of the use of PEDs. I argue that it can but only under certain assumptions. Drawing from Marx’s 18 th Brumaire of Louis Bonaparte and the work of Carl Schmitt, this article proposes a framework that critically diagnoses the plebiscitary, executive-centered conception of democratic representation as a species of political theology. I reconstruct Marx’s comments on plebiscitarianism in The 18 th Brumaire through his earlier critique of political theology in ‘On the Jewish Question’, in order to contrast two modes of representation. The first, ‘ theological’ representation, is a symbolic incarnation of the unity of the (...) people in the person of the executive. The second, ‘ agonistic’ representation, develops only in the legislative assembly as a forum for translating social antagonisms and divisions into political ones. Turning from Marx to the writings of Carl Schmitt on plebiscitarianism, and to more recent analyses of populism, I show how these logics of political-theological versus antagonistic representation can function in different political contexts than the one Marx diagnosed. In conclusion, I argue that plebiscitarian democracy is neither an innocuous feature of institutions, nor a decisionist democratic alternative to liberal parliamentarism. Rather, it is a contemporary expression of political theology, premised upon depoliticization and the exclusion of social antagonisms from the sphere of democratic representation. (shrink)

The concept of evil is one of the most powerful in our moral vocabulary, and is commonly used today in both religious and secular spheres to condemn ideas, people, their actions, and much else besides. Yet appeals to evil in public debate have often deepened existing conflicts, through corruption of rational discourse and demonization of the other. With its religious overtones and implied absolutism, the concept of evil seems ill-suited to advancing public discourse and pro-social relations in a liberal democracy, (...) as evidenced by its use in the abortion debate. International relations have also suffered from references to an ¿axis of evil.¿ Recently, however, philosophers have begun reconceptualising evil within a secular, moral framework, using the idea of evil as the worst kind of immorality to inform and shape our responses to issues like torture, genocide and rape as a weapon of war. This book continues this trend, exploring a constructive role for the concept of evil in practical ethics. Part I of the book begins with two examinations of the concept itself, one focusing primarily on its secular manifestations and the other on evil in its religious context. Individuals are perhaps the primary focus of attributions of evil, and Part II looks at two particular manifestations of evil, in bullying and in mass killing, before considering the nature of evil as an immoral character trait. Part III moves beyond the individual to issues of collective evildoing, evil environments, and political evil. The final part considers responses to evil: can some evil be unforgiveable, and to what extent should we ¿enhance¿ ourselves morally so as to prevent future evildoing? These essays, written by leading philosophers from around the world, including the late Claudia Card, will take the philosophical debate on moral evil in practical ethics to a new level. (shrink)

This essay argues that Merleau-Ponty’s concept of nature as a “privileged expression” of ontology provides the conceptual support for a more responsible attitude toward humans and nature. Furthermore, this concept of nature needs to be viewed in the light of a more profound concept that opens a new vision of the human being’s place in the world, namely Merleau-Ponty’s fields of perception. Shiva’s writings pertaining to the environment gain a more profound, yet critical, understanding when viewed in this way. Similarly, (...) Merleau-Ponty’s attempts “to reconcile the old world and the new” (MP 1964, 4) through implementation of his phenomenology to political and ethical questions is reviewed anew. (shrink)

At the close of this psychotherapeutic century, an alternative to psychotherapy has begun to emerge: the use of philosophy as guidance in order to ameliorate everyday life situations. This new approach to so?called psychological problems, consisting of various forms of open?ended dialogue and reflection on life, may prevent or resolve many of the ?illnesses? for which people seek psychiatric or psychological treatment. If successful, philosophical counseling would mark not only a radical shift in the direction of psychological care, but a (...) radical return to the original, practical purposes of philosophy. A comparative method of studying the biological bases of personality compares human trait dimensions with likely animal models in terms of genetic determination and common biological correlates. The approach is applied to the trait of sensation seeking, which is defined on the human level by a questionnaire, reports of experience, and observations of behavior, and on the animal level by general activity, behavior in novel situations, and certain types of naturalistic behavior in animal colonies. Moderately high genetic determination has been (...) found for human sensation seeking, and marked strain differences in rodents have been found in open-field behavior that may be related to basic differences in brain neurochemistry. Agonistic and sociable behaviors in both animals and humans and the trait measure of sensation seeking in humans have been related to certain common biological correlates such as gonadal hormones, monoamine oxidase (MAO), and augmenting of the cortical evoked potential.The monoamine systems in the rodent brain are involved in general activity, exploratory behavior, emotionality, socialization, dominance, sexual and consummately behaviors, and intracranial self-stimulation. Preliminary studies have related norepinephrine and enzymes involved in its production and degradation to human sensation seeking. A model is suggested that relates mood, behavioral activity, sociability, and clinical states to activity of the central catecholamine neurotransmitters and to neuroregulators and other transmitters that act in opposite ways on behavior or stabilize activity in the arousal systems. Stimulation and behavioral activity act on the catecholamine systems in a brain–behavior feedback loop. At optimal levels of catecholamine systems activity (CSA) mood is positive and activity and sociability are adaptive. At very low or very high levels of CSA mood is dysphoric, activity is restricted or stereotyped, and the organism is unsocial or aggressively antisocial. Novelty, in the absence of threat, may be rewarding through activation of noradrenergic neurons. (shrink)

Achenbach, British theologian Chad Varah, (...) and the French philosopher Marc Sautet these ideas for specific application situation. Achenbach, the (...) founder of the international philosophical practice movement. Is a generalized positive incentive motivation a construct appropriate to the human level of behavior or would sensation or novelty seeking be a more appropriate one? Is positive incentive motivation, or susceptibility to signals of reward, a mechanism related only to extraversion traits including sociability, activation, social potency, and positive affect? Research shows that susceptibility to reward is related to impulsive sensation seeking and aggression as well as sociability and an aroused type of positive affect. Comparative and indirect human correlates (...) suggest an involvement of dopaminergic reactivity in sensation seeking and sociability. (shrink)

In the last two decades, prizes in the sciences have proliferated and, in particular, rich prizes with large honoraria. These developments raise several questions: Why have rich prizes proliferated? Have they greatly changed the reward system of science? What effects will such prizes have on scientists and on science? The proliferation of such prizes derives from marked limitations on the numbers and types of scientists eligible for Nobel prizes and consequent increases in the number of uncrowned laureate-equivalents. These would-be surrogates (...) for Nobel prizes extend the reward system of science in its upper reaches but this change is not fundamental. The spread of rich prizes to new fields provides added incentives to potential winners, which has its own disutilities; it reinforces competitiveness, concern for priority and attendant secrecy, all this amplifying ambivalence toward the reward system in science. There may also be modest positive effects of such new awards in the form of heightened popular esteem for science and interest in it. (shrink)

Examines philosophical autobiography as a literary genre and an alternative to Freudian psychoanalysis.

In this analysis of Yalom’s account of philosophical counseling I show that his perception of it is largely informed by his own ideas about existential psychotherapy and group therapy. Additionally I find that When Nietzsche Wept, and The Schopenhauer Cure comply with Yalom’s personal development and struggles in psychotherapy with philosophy, religion, and boundary violations. Conflicting ideas and attitudes concerning the formerly mentioned are traced also in other works by Yalom.

In this paper I describe and analyze the need for an alternative, non-clinical approach to counseling, i.e., philosophical counseling. Throughout the first part of this paper. I aim to prove pragmatically the truth or validity of this new non-clinical approach to counseling by describing its effectiveness in a case-study. In the second part, I suggest that many philosophers have made use of philosophical self-diagnosis and self-help to improve their own well-being, although for their private practice of philosophy they did not (...) use the words I have chosen here. I exemplify this by analyzing the representative life narrative of Jean-Jacques Rousseau as a case study. (shrink)

By what right, or under whose authority, do you try me? This is a common challenge raised by defendants standing trial in front of international criminal courts or tribunals. The challenge comes from the fact that traditionally criminal law is justified as a response of the state to wrongdoing that has been identified by the state as a crime. Nevertheless, since the early 1990s we have seen the development of international criminal tribunals that have the authority to judge certain crimes. (...) This article examines the moral foundation for the authority of international tribunals, arguing that it can be grounded on delegation of powers from the states with primary jurisdiction. The first part of the article examines whether there is any problem, as a matter of principle, in founding the courts’ jurisdictional authority on delegation of powers. It will argue that contrary to David Luban’s view, there is no inherent problem with states delegating their power to punish to other states or to international tribunals. Nevertheless, in making such a decision the ability of the court to provide fair process—a necessary requirement for the court’s ability to issue authoritative decisions—should be taken into account. The second part of the article takes the ICC as a case study and examines whether its jurisdiction can be grounded on delegation of powers. It will be shown that the court’s jurisdiction can indeed be founded on both direct and indirect delegation of jurisdiction from states with primary jurisdiction. This conclusion suggests that other international tribunals created by either multilateral treaties or by Security Council decisions may also be founded on similar grounds. (shrink)

The emergence of the genetic counseling profession has allowed laypeople to understand and benefit from biological advances, and to make critical decisions about their application. The discipline of genetic counseling has been criticized from its very beginning, in particular because of its early association with the eugenics movement. This paper presents a critical and reflective overview of how genetic counseling is implicitly embedded in the history of eugenics but also counteracts past eugenic practices and ideas. After World War II, attempts (...) were made to distance genetic counseling from eugenics. The first definition of genetic counseling did not position this field as a medical encounter but "as a kind of genetic social work aimed primarily to provide people with an understanding of their family's genetics problems." This approach was a reaction to the genetic and social evolutionary ideas that informed eugenic theories during the first half of the 20th century. Professionals engaged in genetic counseling during the 1940s and1950s rejected eugenic practices, but there was still support for eugenics’ goals of improving heredity and eliminating disease. From the 1960s, genetic counseling underwent professionalization alongside feminization and a definition of core values. Among these values were nondirectiveness counseling and the autonomy of the counselee. The dark shadow of Nazi ideology and other eugenic practices, attempts to employ the historical responsibility of geneticists, and the dynamic medical, social, political, and educational changes of the 1960s and 1970s helped to frame approaches and delineate the goals and limits of the new profession of “genetic counseling.”. Being and Time argues that we, as Dasein, are defined not by what we are, but by our way of existing, our “existentiell possibilities.” I diagnose and respond to an interpretive dilemma that arises from Heidegger's ambiguous use of this latter term. Most readings stress its specific sense, holding that Dasein has no general essence and is instead determined by some historically contingent way of understanding itself and the meaning of being at large. But this fails to explain the sense (...) in which Being and Time is a work of fundamental ontology, concluding in Heidegger's claim to have found the meaning of Dasein's being in the concept of originary temporality. On the other hand, readings that stress the general sense of “existentiell possibilities” find Heidegger on a fruitless quest for the transcendental conditions necessary for Dasein's existence, which seems to founder on the claims that Dasein is constitutively thrown, factical, and “in-each-case-mine” [jemeinig]. Both readings are problematic and, I contend, result from a failure to disambiguate and explain the ontologically unique relationship between the specific and general aspects of Dasein's essence. I argue that we can better explain this relationship, Heidegger's method for investigating it, and the sense in which Dasein has an essence that is open to philosophical investigation, if we read Being and Time's ontology of Dasein in terms of what Anton Ford calls “categorial” genus-species relationships.
