This book investigates context-sensitivity in natural language by examining the meaning and use of a target class of theoretically recalcitrant expressions. These expressions-including epistemic vocabulary, normative and evaluative vocabulary, and vague language -exhibit systematic differences from paradigm context-sensitive expressions in their discourse dynamics and embedding properties. Many researchers have responded by rethinking the nature of linguistic meaning and communication. Drawing on general insights about the role of context in interpretation and collaborative action, Silk develops an improved contextualist theory of CR-expressions (...) within the classical truth-conditional paradigm: Discourse Contextualism. The aim of Discourse Contextualism is to derive the distinctive linguistic behavior of a CR-expression from a particular contextualist interpretation of an independently motivated formal semantics, along with general principles of interpretation and conversation. It is shown how in using CR-expressions, speakers can exploit their mutual grammatical and world knowledge, and general pragmatic reasoning skills, to coordinate their attitudes and negotiate about how the context should evolve. The book focuses primarily on developing a Discourse Contextualist semantics and pragmatics for epistemic modals. The Discourse Contextualist framework is also applied to other categories of epistemic vocabulary, normative and evaluative vocabulary, and vague adjectives. The similarities/differences among these expressions, and among context-sensitive expressions more generally, have been underexplored. The development of Discourse Contextualism in this book sheds light on general features of meaning and communication, and the variety of ways in which context affects and is affected by uses of language. At the heart of some of the most influential strands of philosophical, political, and aesthetic modernism lies the conviction that modernity is fundamentally nihilistic. This book offers a wide-ranging critical history of the concept of nihilism from its origins in French Revolutionary discourse to its place in recent theorizations of the postmodern. Key moments in that history include the concept's appropriation by political activists in mid-nineteenth-century Russia, by Nietzsche in the 1880s, by the European avant-garde and 'high' modernists in the (...) early decades of the twentieth century, by conservative revolutionaries in Germany in the interwar years, and by major theorists in the post-Holocaust period. Focusing in particular on the abiding impact of Nietzsche's claim that art is the 'only superior counterforce' to nihilism, Weller argues that an understanding of modernism (and, indeed, of postmodernism) is impossible without a reflection upon the decisive role played by the concept of nihilism therein. While the focus on business ethics is increasing in business school curricula, there has been little systematic scholarly research on the forces which bring about ethical behavior. This article is intended as a first step toward that research by creating a catalogue of hypotheses concerning the efficacy of corporate codes of ethics. The hypotheses are drawn from studies of compliance with law and court decisions and theories of legitimacy, authority, public policy making and individual behavior. This book combines insights from philosophy and linguistics to develop a novel framework for theorizing about linguistic meaning and the role of context in interpretation. A key innovation is to introduce explicit representations of context — assignment variables — in the syntax and semantics of natural language. The proposed theory systematizes a spectrum of “shifting” phenomena in which the context relevant for interpreting certain expressions depends on features of the linguistic environment. Central applications include local and nonlocal contextual dependencies with (...) quantifiers, attitude ascriptions, conditionals, questions, and relativization. This paper argues that a standard analysis of modals from formal semantics suggests a solution to the detaching problem — the problem of whether un-embedded 'ought'-claims can "detach" (be derived) from hypothetical imperatives and their antecedent conditions. On a broadly Kratzerian analysis, modals have a skeletal conventional meaning and receive a particular reading (e.g., deontic, epistemic, teleological) only relative to certain forms of contextual supplementation. I argue that 'ought'-claims can detach — subject to an important qualification — but only as (...) long as the 'ought's in the conditional premise and conclusion are interpreted relative to the same ordering sources. Although modus ponens can be shown to fail with hypothetical imperatives, the cases in question do not constitute a failure of detachment in the sense that ethicists have cared about. Rival wide-scoping accounts are proven to be linguistically problematic. They make incorrect predictions about the meanings of hypothetical imperatives, and founder in response to quantificational variants of the detaching problem. (shrink)

This paper develops an account of the meaning of `ought', and the distinction between weak necessity modals (`ought', `should') and strong necessity modals (`must', `have to'). I argue that there is nothing specially ``strong'' about strong necessity modals per se: uses of `Must p' predicate the (deontic/epistemic/etc.) necessity of the prejacent p of the actual world (evaluation world). The apparent ``weakness'' of weak necessity modals derives from their bracketing whether the necessity of the prejacent is verified in the actual world. (...) `Ought p' can be accepted without needing to settle that the relevant considerations (norms, expectations, etc.) that actually apply verify the necessity of p. I call the basic account a modal-past approach to the weak/strong necessity modal distinction (for reasons that become evident). Several ways of implementing the approach in the formal semantics/pragmatics are critically examined. The account systematizes a wide range of linguistic phenomena: it generalizes across flavors of modality; it elucidates a special role that weak necessity modals play in discourse and planning; it captures contrasting logical, expressive, and illocutionary properties of weak and strong necessity modals; and it sheds light on how a notion of `ought' is often expressed in other languages. These phenomena have resisted systematic explanation. In closing I briefly consider how linguistic inquiry into differences among necessity modals may improve theorizing on broader philosophical issues. (shrink)

End-of-life decisions concerning euthanasia, stopping life-support machines, or handling advance directives are very complex and highly disputed in industrialized, democratic countries. A main controversy is how to balance the patient’s autonomy and right to self-determination with the doctor’s duty to save life and the value of life as such. This chapter develops an account of the meaning and use of various types of legal claims, and uses this account to inform debates about the nature and normativity of law. The account draws on a general framework for implementing a contextualist theory, called 'Discourse Contextualism' (Silk 2016). The aim of Discourse Contextualism is to derive the apparent normativity of claims of law from a particular contextualist interpretation of a standard semantics for modals, along with general principles of interpretation and conversation. Though the semantics is descriptivist, it avoids Dworkin’s influential criticism of so-called “semantic theories of law,” and elucidates the nature of “theoretical disagreements” about the criteria of legal validity. The account sheds light on the social, interpersonal function of normative uses of language in legal discourse. It also gives precise expression to Hart’s and Raz’s intuitive distinctions among types of legal claims (internal/external, committed/detached), while giving them a uniform type of analysis. The proposed semantics and pragmatics of legal claims provides a fruitful framework for further theorizing about the nature and metaphysics of law, the relation between law and morality, and the apparent practical character of legal language and judgment. Discourse Contextualism provides a solid linguistic basis for a broader account of legal discourse and practice. (shrink)

Purpose: Empirical studies suggest that corporate social responsibility (CSR) impacts young job seekers’ choices of an employer. Values seem to affect CSR preferences, influencing the felt fit between the person and the organization and hereby the valence of working for that company. This article aims to research in more detail the preference structure of young graduate job seekers. In particular, it seeks to understand whether CSR is important when there is a trade-off between CSR and non-CSR attributes and whether basic (...) value orientations of job seekers have a moderating effect on their employer preferences. Design/methodology/approach: This article used a quantitative approach with a survey sample of 577 German students who were in their last year of study. To gain information on the relative impact of CSR- and non-CSR-related employer characteristics on employer attractiveness, an adaptive conjoint analysis was applied. Correlation analysis and a two-step hierarchical regression were conducted to detect the effects of individual value orientations. Findings: Only a few CSR attributes are relevant for young job seekers compared with other traditional employer attributes. Specific value orientations can be identified as having a moderating effect on CSR preferences. This is particularly the case for value orientations indicating a concern for the welfare of others and the environment positively affect the importance of most CSR attributes while more selfish value orientations have a negative effect. Originality/value: This study sheds light on the relative importance of CSR attributes when compared with non-CSR attributes. Moreover, it relates employee-related preferences to individual value orientations and shows that selected values have a modifying effect on the importance of CSR for job choice. (shrink)

This paper applies Paul Grobstein's theory of science as story telling and story revising to history. The purpose of drawing such links is to show that in our current age when disciplinary borders are becoming increasingly blurred, what may be effective research practice for one discipline, may have some useful insights for another. It argues that what Grobstein advocates for science makes just as much sense for history and that historians have long recognised in their own discipline many of the (...) points Grobstein raises. It examines the changing role of stories dependant upon their cultural context and the emergence of global stories due to advances in technology. Such advances also challenge traditional methods of telling the story. It suggests that we may be entering a period which demands a new discourse on the relationship between human knowledge, understanding, and culture. (shrink)

One of the most significant ways in which much late-nineteenth- and early twentieth-century literature and philosophy may be distinguished from their predecessors is in their reliance upon the notion of ‘inexpressibility’ and the limits of the sayable. In this article, I seek not only to chart the history of this tradition, but also to reflect critically upon the use it makes of the concept of ‘the nothing’. For all their differences, in both Wittgenstein and Heidegger one encounters deployments of this (...) concept in ways that determine these thinkers’ conceptions of language and literature. My aim here is to initiate a new critical reflection upon the fate of the concept of ‘the nothing’ in modern philosophy and literary theory. (shrink)

This paper investigates how inquiry into normative language can improve substantive normative theorizing. First I examine two dimensions along which normative language differs: “strength” and “subjectivity.” Next I show how greater sensitivity to these features of the meaning and use of normative language can illuminate debates about three issues in ethics: the coherence of moral dilemmas, the possibility of supererogatory acts, and the connection between making a normative judgment and being motivated to act accordingly. The paper concludes with several brief (...) reflections on the theoretical utility of the distinction—at least so-called—between “normative” and “non-normative” language and judgment. Clarifying the language we use in normative conversation and theorizing can help us diagnose problems with bad arguments and formulate better motivated questions. This can lead to clearer answers and bring into relief new theoretical possibilities and avenues to explore. (shrink)

It is common to think that what theory of linguistic vagueness is correct has implications for debates in philosophy of law. I disagree. I argue that the implications of particular theories of vagueness on substantive issues of legal theory and practice are less far-reaching than often thought. I focus on four putative implications discussed in the literature concerning (i) the value of vagueness in the law, (ii) the possibility and value of legal indeterminacy, (iii) the possibility of the rule of (...) law, and (iv) strong discretion. I conclude with some methodological remarks. Delineating questions about conventional meaning, the metaphysics/metasemantics of (legal) content determination, and norms of legal interpretation and judicial practice can motivate clearer answers and a more refined understanding of the space of overall theories of vagueness, interpretation, and law. Today many scholars seem to agree that citizens should be involved in expert deliberations on science and technology issues. This interest in public deliberation has gained attraction in many practical settings, especially in the European Union, and holds the promise of more legitimate governance of science and technology. In this article, the authors draw on the European Commission’s report ‘‘Taking the European Knowledge Society Seriously’’ to ask how legitimate these efforts to ‘‘democratize’’ scientific expertise really are. While the report borrows (...) from deliberative democrats’ normative accounts of legitimacy, the authors identify a tension between the principles for legitimate rule prescribed by deliberative democratic theory and the report’s celebration of diversity and dissent. While this inconsistency suggests that the legitimacy of deliberative governance arrangements is justified on empirical rather than normative grounds, it remains an open question whether studies of science and technology offer enough empirical support for such a justification. Kolodny and MacFarlane have made a pioneering contribution to our understanding of how the interpretation of deontic modals can be sensitive to evidence and information. But integrating the discussion of information-sensitivity into the standard Kratzerian framework for modals suggests ways of capturing the relevant data without treating deontic modals as “informational modals” in their sense. I show that though one such way of capturing the data within the standard semantics fails, an alternative does not. Nevertheless I argue that we have (...) good reasons to adopt an information-sensitive semantics of the general type Kolodny and MacFarlane describe. Contrary to the standard semantics, relative deontic value between possibilities sometimes depends on which possibilities are live. I develop an ordering semantics for deontic modals that captures this point and addresses various complications introduced by integrating the discussion of information-sensitivity into the standard semantic framework. By attending to these complexities, we can also illuminate various roles that information and evidence play in logical arguments, discourse, and deliberation. (shrink)

Current literature on ethical leadership and unethical leadership reflects a Western-based private sector perspective, pointing toward a compliance-oriented understanding of ethical and unethical leadership. As today’s executives increasingly have to ethically lead across different cultures and sectors, it becomes vitally important to develop a more holistic picture how ethical and unethical leadership is perceived in the Western and Eastern cultural cluster and the private and the public/social sector. Addressing this issue, the present study aims to identify cross-cultural and cross-sectoral commonalities (...) and differences in international executives’ perceptions of ethical and unethical leadership. Findings from in-depth interviews (N = 36) with executives from Western and Eastern cultures working in the private or the public/social sector reveal collectively held perceptions of ethical leadership (including leader honesty, integrity, concern for responsibility/sustainability, and people orientation) and of unethical leadership (referring to leader dishonesty, corruption, egocentrism, and manipulation). Results indicate limited support for a compliance-oriented perspective on ethical and unethical leadership but yield a much greater trend toward a value-oriented perspective. Concrete practice examples illustrate these different perspectives. Cultural and sectoral particularities of executive perceptions of ethical and unethical leadership are discussed. (shrink)

Business ethics and firm economic performance have traditionally often been regarded as mutually exclusive ends. We challenge this “either-or” belief and analyze when and how ethical firm leadership and firm performance may harmonize well. In extension of earlier research on ethical leadership and performance at the individual and team level, we study the context–dependency of the organization level relationship between CEO ethical leadership and firm performance. We propose a moderated mediation model of the link between CEO ethical leadership and firm (...) performance, identifying mediating and moderating variables unique to the organization-level of analysis. CEO ethical leadership is argued to work through organizational ethical culture which promotes firm performance under the condition that there is a strong corporate ethics program in place. Results from a multisource cross-sectional study, in which we surveyed 145 participants from 32 organizations and validated organizational performance ratings by objective performance data, showed support for our conceptual model. The development of abstract schemas and productive rules in language is affected by both token and type frequencies. High token frequencies and surface similarities help to discover formal and functional commonalities between utterances and categorize them as instances of the same schema. High type frequencies and diversity help to develop slots in these schemas, which allow the production and comprehension of novel utterances. In the current study we looked at both token and type frequencies in two related constructions in German (...) child-directed speech: simple transitive and complement-clause constructions. Both constructions contain high frequency verbs, which potentially support the development of verb-specific schemas. However, only the frequent verbs in the transitive constructions occur with a variety of subject types, which also supports the development of a slot in the subject position. We then used an elicited production task to compare 4- and 5-year-old German-speaking children's productivity with simple transitive constructions and complement-clause constructions. The children were prompted to change the subjects of high and low frequency simple transitive verbs, such as essen ‘eat’ and naschen ‘nibble’, mental-state complement-taking verbs, such as denken ‘think’ and vermuten ‘presume’, and communication complement-taking verbs, such as sagen ‘say’ and berichten ‘report’. In accordance with earlier findings, children had less difficulty producing new utterances with high frequency transitive verbs than with low frequency transitive verbs. For the other verb classes, however, we found either reverse frequency effects or no frequency effects. For these verb classes, children's productivity can be determined by diversity rather than simple token frequency. Outsourcing clinical trials sponsored by pharmaceutical companies from industrialized countries to low- -income countries – summarized as transnational biomedical research – has lead to many concerns about ethical standards. Whether study participants are particularly vulnerable is one of those concerns. However, the concept of vulnerability is still vague and varies in its definition. Despite the fact that important international ethical guidelines such as the Declaration of Helsinki by the World Medical Association or the Ethical Guidelines for Biomedical Research Involving Human (...) Subjects by the Council of International Organizations of Medical Sciences refer to vulnerability as ethical principle, each of their approaches are different. To overcome these shortcomings, we analyze and unite different approaches of vulnerability and develop practical criteria in order to operationalize the concept especially for the context of TBR. These criteria refer to the context of a study as well as the characteristics and the current living situation of study participants. Based on a case study of an HIV-vaccine-trial conducted in India we demonstrate how those criteria can be applied in a retrospective way to identify potential ethical conflicts. The criteria can also indicate a prospective function for ethical pre-assessment. For this, we provide an outlook for three major topics: 1. Vulnerability as a normative concept: Different ways of protection; 2. The relevance of transparency and 3. Vulnerability as an instrument to increase decision participation of human subjects. Expressivism promises an illuminating account of the nature of normative judgment. But worries about the details of expressivist semantics have led many to doubt whether expressivism's putative advantages can be secured. Drawing on insights from linguistic semantics and decision theory, I develop a novel framework for implementing an expressivist semantics that I call ordering expressivism. I argue that by systematically interpreting the orderings that figure in analyses of normative terms in terms of the basic practical attitude of conditional weak preference, (...) the expressivist can explain the semantic properties of normative sentences in terms of the logical properties of that attitude. Expressivism's problems with capturing the logical relations among normative sentences can be reduced to the familiar, more tractable problem of explaining certain coherence constraints on preferences. Particular attention is given to the interpretation of wide-scope negation. The proposed solution is also extended to other types of embedded contexts—most notably, disjunctions. (shrink)

This paper develops an interpretation of Nietzsche’s ethics and metaethics that reconciles his apparent antirealism with his engagement in normative discourse. Interpreting Nietzsche as a metaethical constructivist—as holding, to a first approximation, that evaluative facts are grounded purely in facts about the evaluative attitudes of the creatures to whom they apply—reconciles his vehement declarations that nothing is valuable in itself with his passionate expressions of a particular evaluative perspective and injunctions for the free spirits to create new values. Drawing on (...) Nietzsche’s broader epistemological and psychological views, I develop a distinctive, and genuinely Nietzschean, version of constructivism. On this account, evaluative properties are grounded in affective valuations of the new philosophers. In doing so, we discuss the role played by various forms of algorithmic transparency in the process of trust repair, including explanations of algorithms, uncertainty estimates, and performance metrics.

In Cervantes, the Novel, and the New World, Diana de Armas Wilson describes and analyzes the link between the birth of the New World in European consciousness and the expression (...) of that consciousness in the novels of Cervantes. Those of us whose teaching includes works from both Peninsular and Spanish American literature have long felt the need for a study that goes beyond a cataloging of Cervantes's references to the world beyond Europe, and those Cervantine scholars among us have variously hinted at and side-stepped the fullness of this issue. As it was with those exemplary figures of the age of exploration she examines, it is to Professor de Armas Wilson's great credit that she has risen to the challenge. Her analysis is well-organized, reasoned, thoughtful, and readable.De Armas Wilson's knowledge of previous and current research in Cervantine studies as well as genre, colonial and postcolonial, and gender studies is impressive. She also admits to participating "in the kinds of critique currently associated with cultural studies, although not without reservations regarding the alleged presentism of that discipline or its tendency to turn primary texts into commodities." I would respond that de Armas Wilson's concerns and techniques in this study are precisely the tools we need to help us define "cultural studies" to our students and to ourselves as scholars of various literatures and cultures.To begin her study, de Armas Wilson mentions many of Cervantes's literary and personal references to geographies, customs, and other contacts with the [End Page 376] world outside Spain. The first chapter, "The Americanist Cervantes," focuses on that material and includes a brief review of recent research--the latest "grande escrutinario" (Don Quijote, Part I, Chapter VI)--regarding what works might have been in Cervantes's library and/or the texts potentially available to him. Professor de Armas Wilson looks at Cervantes's references and the texts available to him through three lenses: imitation, influence, and intertextuality. She sees these methodologies as interdependent and argues that: "the intertextual practices in this book--based on a revised concept of intertextuality that includes the notion of agency and participates in a historical project--are as American as its central topic." (Finding myself in the process of completing this review on the morning of Sept. 11, 2001, I can only wonder what texts will not be influenced by the "historical project" of this day.)In the second chapter, "The Novel about the Novel," de Armas Wilson surveys Cervantes's status in Continental and Anglo-American criticism, reminding her readers of the polemic between scholars of the ancient novel and those who, bent on refusing to accept the Greco-Roman works as novels, designate them "romances." De Armas Wilson's contention that the Persiles is a "long exemplary novel," is convincingly depicted. Her arguments are based on the fact of the fictional time of the Persiles being within fifty years of the time when Cervantes wrote it, "its self-conscious theorizing, its rationalizing of 'miracles,' and its avowed imitation of Heliodorus' Aethiopica." She is not alone in arguing that Heliodorus' novel is the antithesis of a romance of chivalry. On these bases de Armas Wilson speaks not only to those who may not have recognized the importance of the Persiles because it has been called a romance (an often "despised or despicable" genre), but also to those of us who view consideration of the Persiles essential to an understanding of Don Quijote, if not a key to comprehending the major goals of all of Cervantes's works and his expression of the consciousness of his day.De Armas Wilson continues by arguing for "coevolutionary histories of the novel as alternatives to evolutionary ones."
