The present paper deals with the idea of understanding Vedic ethics as a code of righteous living, in the light of Mīmāṁsā philosophy. The paper also intends to reflect upon the possibility of such methods as a means of attaining liberation. In other words, the Vedas provide us with prescriptive codes of right and wrong actions. It commands us about duties and non-duties, through the performance of rituals, in order to lead a good life. We know that human endeavours are (...) primarily based on attaining the desired, and to prevent the unwanted ends. Hence, the entire effort of human actions lies in the fact that we want to attain the cessation of sufferings. This paves the way for studies in Soteriology, and the question arises that, could the Vedas be considered as a literature on Soteriology. The paper consists of a number of sections. The initial ones involve the linguistic analysis of the Vedic statements based on Sanskrit grammar and semantics. These are aimed at depicting the manner in which Vedic sentences act as prescriptive ethical codes. The latter ones deal with the questions raised by the opposing schools, namely Sāṁkhya-Yoga, against the idea of considering Vedas as a supreme sanction of means, leading beings to their salvation from empirical sufferings, and their plausible responses. This paper presents an attempt to bridge the gap between logical and cognitive treatments of strategic reasoning in games. There have been extensive formal debates about the merits of the principle of backward induction among game theorists and logicians. Experimental economists and psychologists have shown that human subjects, perhaps due to their bounded resources, do not always follow the backward induction strategy, leading to unexpected outcomes. Recently, based on an eye-tracking study, it has turned out that even human subjects who (...) produce the outwardly correct ‘backward induction answer’ use a different internal reasoning strategy to achieve it. The paper presents a formal language to represent different strategies on a finer-grained level than was possible before. The language and its semantics help to precisely distinguish different cognitive reasoning strategies, that can then be tested on the basis of computational cognitive models and experiments with human subjects. The syntactic framework of the formal system provides a generic way of constructing computational cognitive models of the participants of the Marble Drop game. (shrink)

The literature on the democratic legitimacy of judicial review and also on institutionalizing deliberative democracy neglects the possibility of employing juries rather than judges to determine bill-of-rights matters. This neglect is unfortunate, for there are findings emerging especially from deliberative polling that support the feasibility of such juries. Such feasibility would raise a new countermajoritarian concern with judicial review. The argument supporting this new concern also casts fresh light on the traditional countermajoritarian concern.

How do people reason about their opponent in turn-taking games? Often, people do not make the decisions that game theory would prescribe. We present a logic that can play a key role in understanding how people make their decisions, by delineating all plausible reasoning strategies in a systematic manner. This in turn makes it possible to construct a corresponding set of computational models in a cognitive architecture. These models can be run and fitted to the participants’ data in terms of (...) decisions, response times, and answers to questions. We validate these claims on the basis of an earlier game-theoretic experiment about the turn-taking game “Marble Drop with Surprising Opponent”, in which the opponent often starts with a seemingly irrational move. We explore two ways of segregating the participants into reasonable “player types”. The first way is based on latent class analysis, which divides the players into three classes according to their first decisions in the game: Random players, Learners, and Expected players, who make decisions consistent with forward induction. The second way is based on participants’ answers to a question about their opponent, classified according to levels of theory of mind: zero-order, first-order and second-order. It turns out that increasing levels of decisions and theory of mind both correspond to increasing success as measured by monetary awards and increasing decision times. Next, we use the logical language to express different kinds of strategies that people apply when reasoning about their opponent and making decisions in turn-taking games, as well as the ‘reasoning types’ reflected in their behavior. Then, we translate the logical formulas into computational cognitive models in the PRIMs architecture. Finally, we run two of the resulting models, corresponding to the strategy of only being interested in one’s own payoff and to the myopic strategy, in which one can only look ahead to a limited number of nodes. It turns out that the participant data fit to the own-payoff strategy, not the myopic one. Automatic summarization of legal case judgements, which are known to be long and complex, has traditionally been tried via extractive summarization models. In recent years, generative models including abstractive summarization models and Large language models (LLMs) have gained huge popularity. In this paper, we explore the applicability of such models for legal case judgement summarization. We applied various domain-specific abstractive summarization models and general-domain LLMs as well as extractive summarization models over two sets of legal case judgements – from the (...) United Kingdom (UK) Supreme Court and the Indian Supreme Court – and evaluated the quality of the generated summaries. We also perform experiments on a third dataset of legal documents of a different type – Government reports from the United States. Results show that abstractive summarization models and LLMs generally perform better than the extractive methods as per traditional metrics for evaluating summary quality. However, detailed investigation shows the presence of inconsistencies and hallucinations in the outputs of the generative models, and we explore ways to reduce the hallucinations and inconsistencies in the summaries. Overall, the investigation suggests that further improvements are needed to enhance the reliability of abstractive models and LLMs for legal case judgement summarization. At present, a human-in-the-loop technique is more suitable for performing manual checks to identify inconsistencies in the generated summaries. (shrink)

The latter half of nineteenth-century England was rife with the evolution question. As English imperialism also reached its pinnacle during this time, racial gradations and superiority of the white race in the newly formed human chain loomed large culturally. In 1849, Thomas Carlyle anonymously published his anti-emancipationist perspective in “The Occasional Discourse on the Negro Question,” followed by John Stuart Mill’s divergent response to him in 1850 titled, “The Negro Question.” In 1878, The Westminster Review also published a woman’s perspective, (...) “The Importance of Race and Its Bearing on the Negro Question” by Alice Bodington, which resembled the Carlyle essay in various ways. Although Mill’s essay was a direct attack on Carlyle’s explosive article and is overtly against Carlyle and Bodington’s ideas, this paper argues that an imperialist agenda underlies Mill’s views and in fact poses the same theories of Carlyle and Bodington. The paper first proceeds to interrogate Mill’s hegemonic subtext through a comparison of these three essays by situating them within the scientific discourse of the era, arguing that science, especially phrenology and evolution theories, didn’t exist in a vacuum, but was used to perpetrate the normative racial ideologies of the period. The paper also uses Edward Said’s theory of ‘Othering the Orient’ in Culture and Imperialism to show that while Mill seemingly diverges from Carlyle’s stance, this ‘othering’ is in fact present in all three writers’ works. Since the conceptualization of unethical pro-organizational behavior ten years ago, scholarly interest in exploring this phenomenon has multiplied. Given a burgeoning body of empirical research, a review of unethical pro-organizational behavior literature is warranted. This study, therefore, systematically reviews the extant literature on unethical pro-organizational behavior and presents a comprehensive theory-based review of the past developments in this field. We classify previous studies based on their underlying theoretical perspectives and discuss the antecedents and consequences of unethical pro-organizational behavior in work (...) context. We also explicate the boundary conditions under which the influence of these antecedents gets accentuated or alleviated. Overall, this study synthesizes past knowledge to elucidate why, how, and when unethical pro-organizational behavior unfolds in the workplace. In the domain of legal information retrieval, an important challenge is to compute similarity between two legal documents. Precedents play an important role in The Common Law system, where lawyers need to frequently refer to relevant prior cases. Measuring document similarity is one of the most crucial aspects of any document retrieval system which decides the speed, scalability and accuracy of the system. Text-based and network-based methods for computing similarity among case reports have already been proposed in prior works but (...) not without a few pitfalls. Since legal citation networks are generally highly disconnected, network based metrics are not suited for them. Till date, only a few text-based and predominant embedding based methods have been employed, for instance, TF-IDF based approaches, Word2Vec and Doc2Vec based approaches. We investigate the performance of 56 different methodologies for computing textual similarity across court case statements when applied on a dataset of Indian Supreme Court Cases. Among the 56 different methods, thirty are adaptations of existing methods and twenty-six are our proposed methods. The methods studied include models such as BERT and Law2Vec. It is observed that the more traditional methods that rely on a bag-of-words representation performs better than the more advanced context-aware methods for computing document-level similarity. Finally we nominate, via empirical validation, five of our best performing methods as appropriate for measuring similarity between case reports. Among these five, two are adaptations of existing methods and the other three are our proposed methods. (shrink)

The article starts from an examination of the authorship of the ‘Geleitwort’, the programmatic statement which appeared in the Archiv für Sozialwissenschaft when it came under new editors in 1904. Recently scholars have begun to view it as an important text by Max Weber recovered from obscurity, but this is a mistake. Examination of major contemporary works by Weber and Werner Sombart – the obvious co-author – as well as the first public disclosure of an entirely new MS. by Weber, (...) show that in all probability the text was drafted by Sombart and then revised fairly lightly by Weber. This story of a combined, if unequal, authorship leads into two broader seams of intellectual history: the relationship between Weber and Sombart, and the history of the Archiv as a journal. An unusual starting point thus casts fresh and unexpected light on some of the most central figures and episodes in German social science at the beginning of the 20th century, not least Weber's seminal essay on “Objectivity” in social science. ☆ This paper relies on intellectual interchange and the generosity of colleagues to a quite unusual degree. This paper is about the uses of language which the Oxford philosopher of language, J.L. Austin excluded from theoretical consideration in his William James Lectures delivered in 1955 and posthumously published as How to Do Things with Words. Uses of language, such as dramatic, poetic or comedic, are said by Austin to be non-serious, deviant and parasitic upon the everyday normal ordinary language. This leaves literature out of consideration as an etiolation. Derrida, who is not merely a trained philosopher but (...) also one of the finest literary critics of our day, fails to agree with Austin. In his “Signature, Event, Context”, and Limited Inc, he criticizes Austin of “totalization” and “idealization” of the norm or the standard; his inability to see that the parasitic is necessarily inbuilt in the standard. This paper is an attempt at seeing how far Derrida is justified in his critique as there is much that is common between his and Austin’s approaches towards language. (shrink)

The present paper shows whether there is cognition without any content. Generally, “cognition” means “cognition of something.” But in the Advaita Vedanta system of philosophy there is pure knowledge having no content called contentless cognition leading to certain philosophical problems.

In a Common Law system, legal practitioners need frequent access to prior case documents that discuss relevant legal issues. Case documents are generally very lengthy, containing complex sentence structures, and reading them fully is a strenuous task even for legal practitioners. Having a concise overview of these documents can relieve legal practitioners from the task of reading the complete case statements. Legal catchphrases are (multi-word) phrases that provide a concise overview of the contents of a case document, and automated generation (...) of catchphrases is a challenging problem in legal analytics. In this paper, we propose a novel supervised neural sequence tagging model for the extraction of catchphrases from legal case documents. Specifically, we show that incorporating document-specific information along with a sequence tagging model can enhance the performance of catchphrase extraction. We perform experiments over a set of Indian Supreme Court case documents, for which the gold-standard catchphrases (annotated by legal practitioners) are obtained from a popular legal information system. The performance of our proposed method is compared with that of several existing supervised and unsupervised methods, and our proposed method is empirically shown to be superior to all baselines.
