Chung Kuo, Cina, a documentary film by Michelangelo Antonioni, aroused fierce criticism both in China and in Europe when it was released in 1973. While these objections contradicted one another, they all share a conceptual core : the notion of realism understood in a Marxian sense as a critical representation of reality. Yet by refusing to grant a coherent and essentialist meaning to its images, Chung Kuo, Cina problematizes the presuppositions of such an understanding of realism. A well-known objection to divine simplicity holds that the doctrine is incompatible with God’s contingent knowledge. I set out the objection and reject two problematic solutions. I then argue that the objection is best answered by adopting an “extrinsic model of divine knowing” according to which God’s contingent knowledge, which varies across worlds, does not involve any intrinsic variation in God. Solutions along these lines have been suggested by others. This paper advances the discussion by developing and offering partial defenses (...) of three such models. (shrink)

Experientialism in aesthetics is the view that the artistic merit or the aesthetic value of something is determined by the final value of certain experiences of it. These are usually specified as experiences of it with understanding and appreciation. Until recently, experientialism was the dominant view. Not anymore. Experientialists are now subject to a barrage of objections, many of which they have not answered. Here I argue that all of these objections fail. I develop a new form of experientialism that (...) is immune to them. It also has an independent rationale. It incorporates an account of the value of art appreciation that is plausible in its own right. And it endorses many of the core insights of anti-experientialists, especially concerning the final value of good art. Those of us unconvinced by experientialism need to take this form of it seriously. I conclude by identifying some genuine problems it faces. Even these aren’t clearly insoluble. (shrink)

Euripides’ Alcestis (1959) raises the issue of ethical duties within families and exposes the romantic postures and rhetoric that can dominate such discussions. Should anybody be asked to sacrifice themselves or even undergo significant health risks for members of their own family? (An issue that is also relevant in considering our duties to future generations in terms of the earth we leave to them.) The issue that is dramatized to a heroic level in Alcestis arises in live organ and tissue (...) donation within a family and challenges the idea that families should be trusted to sort out solutions that they can all live with. Alcestis intensifies the debate because the sacrifice of one life for another is its topic but, in doing so, it exposes many traps lying in wait for ethicists and medical jurists who boldly enter such debates (where emotions create shifting ground on which angels fear to tread). Neuroscience has begun to elucidate the mechanisms of volition, decision-making, and action. Some have taken the progress neuroscience has made in these areas to indicate that we are not free to choose our actions . The notion that we can consciously initiate our behavior is a crucial tenet in the concept of free will, and closely linked to how most individuals view themselves as persons. There is thus reason to inquire if the aforementioned inference drawn by some might be too (...) hasty. While there is much evidence appearing to indicate that consciousness does not influence behavior—including evidence indicating that neural activity precedes a decision by several seconds, neural activity predicts what action an individual will perform, and that individuals infer when they decided to act after an action was performed—this evidence seems to suffer methodological issues. Additionally, there are empirically supported interpretations of the aforementioned data consistent with the idea that individuals can consciously control their actions. This paper therefore concludes that neuroscience does not currently substantiate the idea that we cannot consciously initiate or control our actions. (shrink)

Elective ventilation (EV) is ventilation applied, not in the interest of patients, but in order to secure transplantable organs. It carries with it a small risk that patients who would otherwise have died will survive in a persistent vegetative state. Is EV ever justifiable? We argue: (1) The only thing which can justify exposing patients to risk not taken for their benefit is their consent, and we cannot rely on implied consent or third party consent in the case of EV. (...) Thus, absent explicit consent of patients, EV is not justifiable. (2) It is not clear that explicit consent should be sought, or where it is offered honoured, given the potential EV has for deterring organ donors and causing stress to staff and families. (shrink)

How important is it for managers to have the “nice” virtues of modesty, civility, and humility? While recent scholarship has tended to focus on the organizational consequences of leaders having or lacking these traits, I want to address the prior, deeper question of whether and how these traits are intrinsically morally important. I argue that certain aspects of modesty, civility, and humility have intrinsic importance as the virtues of relational equality – the attitudes and dispositions by which we relate as (...) moral equals. I provide a novel account of the normative grounds of the virtues of relational equality and develop a corresponding framework for how these virtues can be enacted by managers. The virtues are grounded in the value of opposing objectionable forms of social hierarchy, which requires social norms that grant all persons the same personal authority over their lives and interactions. I show how this view of virtue contrasts with prevailing Aristotelian, Personalist, and Smithian views in business ethics. I then explain how, for managers, sustaining and enacting the virtues of relational equality involves a distinctive cluster of role-specific traits: respect for employees’ equal personal authority, a commitment to express such respect, and a disposition to give equal weight and deference to employees’ relevant interests. The interpretation of character motivations is a crucial part of the understanding of many narratives, including those found in video games. This interpretation can be complicated in video games by the player performing the role of a player-character within the game narrative. Such performance finds the player making choices for the character and also interpreting the resulting character actions and their effect on the game's narrative. This can lead to interpretative difficulties for game narratives and their players: if a decision (...) to act is made by the player, is it that the player's own imaginative reasons for acting warrant some narrative interpretations and exclude others? To answer this I argue that we need to investigate the interactive ontology of video game narratives, the notion of game playing as interpretative performance, and the player-character, an artifact through which performance is focused in narrative games. Doing so shows there to be at least two problems with the notion of the correct interpretation of narrative games. Neither of these problems entirely negates the normativity of game narratives, however, and so players are left with the problem of how they might decide which of the possible playings are warranted. I end by making some practical suggestions for the thoughtful and narratively interested game player. (shrink)

What does it mean to re-conceptualize pornography as a material practice rather than as speech? Sidestepping the legal debates over their civil ordinance, and drawing on phenomenology of the lived body, Mason-Grant returns to the innovative core of the Dworkin-MacKinnon critique of mainstream pornography. She develops a "practice paradigm" that captures and extends their insights, showing how the use of mass-market heterosexual pornography contributes to the cultivation of troubling forms of sexual know-how.

Focusing on computational studies of pericyclic reactions from the late twentieth century into the twenty-first century, this paper argues that computational diagnostics is a key methodological development that characterize the management and coordination of plural approximation methods in computational organic chemistry. Predictive divergence between semi-empirical and ab initio approximation methods in the study of pericyclic reactions has issued in epistemic dissent. This has resulted in the use of diagnostics to unpack computational greyboxes in order to critically assess the effect of (...) specific misrepresentations on predictive accuracy given that approximations and idealizations must be made to render computational models tractable. Furthermore, benchmarking is used to determine the applicability of approximation methods depending on how accurate the results need to be in a given research context. The epistemology of benchmarking consists of the co-generation of data sets in a hybrid computational–experimental form used to standardize computational methods but does not determine a unique quantitative method to be used across computational organic chemistry. This article presents a philosophical account of the nature of crime. It argues that the criminal law contains both fault-based crimes and strict liability offences, and that these two represent different paradigms of liability. It goes on to argue that the gist of fault-based crimes lies in their being public wrongs, not (as is often thought) because they wrong the public, but because the public is responsible for punishing them, i.e. because they merit state punishment. What makes wrongs deserving of (...) punishment is that they are seriously blameworthy, inasmuch as they evince a disrespect for the values violated. But they only merit state punishment when they violate important values, not simply due to the well-known pragmatic considerations against the use of the criminal law, but to the intrinsic expressive force of criminal conviction. Finally, the analysis of fault-based crimes points to a role for strict liability in regulating actions that are not seriously blameworthy but do increase the risk of values being damaged. (shrink)

Recent scientific advances have indicated that it may be technically feasible to sustain human embryos in vitro beyond 14 days. Research beyond this stage is currently restricted by a guideline known as the 14-day rule. Since the advances in embryo culturing there have been calls to extend the current limit. Much of the current debate concerning an extension has regarded the 14-day rule as a political compromise and has, therefore, focused on policy concerns rather than assessing the philosophical foundations of (...) the limit. While there are relevant political considerations, I maintain that the success of extension arguments will ultimately depend on the strength of the justifications supporting the current 14-day limit. I argue that the strongest and most prevalent justifications for the 14-day rule—an appeal to individuation and neural development—do not provide adequate support for the limit of 14 days. I instead suggest that an alternative justification based on sentience would constitute a more defensible basis for embryo protection and that a consideration of such grounds appears to support an amendment to the current limit, rather than the retention of it. While these conclusions do not establish conclusively that the current limit should be extended; they do suggest that an extension may be warranted and permissible. As such, this paper offers grounds on which a reassessment of the 14-day rule may be justified. (shrink)

Precedent is a central feature of legal practice, requiring courts to follow decisions reached in earlier cases, thereby transforming the decisions in individual cases into a source of law. This article examines two major questions associated with precedent: (a) how to characterise the way that precedent operates as a source of law; and (b) how to justify the requirement that courts follow earlier decisions regardless of the merits of those decisions. Precedents are often thought to create general legal rules, but (...) it is controversial whether this is the best way to understand their role in legal reasoning. Between 1100 and 1600, the emphasis on reason in the learning and intellectual life of Western Europe became more pervasive and widespread than ever before in the history of human civilization. Of crucial significance was the invention of the university around 1200, within which reason was institutionalized and where it became a deeply embedded, permanent feature of Western thought and culture. It is therefore appropriate to speak of an Age of Reason in the Middle Ages, and to view it as (...) a forerunner and herald of the Age of Reason that was to come in the seventeenth century. The object of this study is twofold: to describe how reason was manifested in the curriculum of medieval universities, especially in the subjects of logic, natural philosophy and theology; and to explain how the Middle Ages acquired an undeserved reputation as an age of superstition, barbarism, and unreason. Grant Gillett argues that it is consciousness which makes a human or other being the 'locus of ethical value'. Since cortical functioning is, in Gillett's view, necessary for conscious activity, an individual whose neocortex is permanently non-functional is no longer a locus of ethical value and cannot be benefited or harmed in a morally relevant sense. This means that there is no obligation to continue treating those who have suffered neocortical death.

The aim of this paper is to explain why creativity is an artistic merit. Artworks and non-artworks can both be creative. But creativity does not help make many other creative things good of their kind. A creative explanation is not a better explanation in virtue of being creative. Why, then, is a creative artwork a better artwork in virtue of being creative? Understanding this will give us a better understanding of the nature of artistic merit. The approach adopted in this (...) paper is as follows. First, I say what creativity is and what an artistic merit is. Second, I identify reasons to doubt that creativity is an artistic merit. A good explanation of the merit of creativity should address these doubts. Third, I develop a theory of artistic merit that appeals to the final value of acting excellently – for example, virtuously or skilfully. Finally, I argue that this enables us to explain why creativity is an artistic merit. This account also enables us to argue that artistic merits give some things final value, and not merely instrumental value. It also provides reason to believe that ethical qualities of artworks enhance their artistic merit for the same reason creativity does. (shrink)

Grammatical Evolution (GE) has a long history in evolutionary computation. Central to the behaviour of GE is the use of a linear representation and grammar to map individuals from search spaces into problem spaces. This genotype to phenotype mapping is often argued as a distinguishing property of GE relative to other techniques, such as context-free grammar genetic programming (CFG-GP). Since its initial description, GE research has attempted to incorporate information from the grammar into crossover, mutation, and individual initialisation, blurring the (...) distinction between genotype and phenotype and creating GE variants closer to CFG-GP. This is argued to provide GE with the "best of both worlds", allowing degrees of grammatical bias to be introduced into operators to best suit the given problem. This paper examines the behaviour of three grammar-based search methods on several problems from previous GE research. It is shown that, unlike CFG-GP, the performance of "pure" GE on the examined problems closely resembles that of random search. The results suggest that further work is required to determine the cases where the "best of both worlds" of GE are required over a straight CFG-GP approach. (shrink)

The first mention of the concept of an inconsistency measure for sets of formulas in first-order logic was given in 1978, but that paper presented only classifications for them. The first actual inconsistency measure with a numerical value was given in 2002 for sets of formulas in propositional logic. Since that time, researchers in logic and AI have developed a substantial theory of inconsistency measures. While this is an interesting topic from the point of view of logic, an important motivation (...) for this work is also that some intelligent systems may encounter inconsistencies in their operation. This research deals primarily with propositional knowledge bases, that is, finite sets of propositional logic formulas. The goal of this paper is to extend the concept of inconsistency measure in a formal way to sets of formulas with the modal operators “necessarily” and “possibly” applied to propositional logic formulas. We use frames for the semantics, but in a way that is different from the way that frames are commonly used in modal logics, in order to facilitate measuring inconsistency. As a set of formulas may have different inconsistency measures for different frames, we define the concept of a standard frame that can be used for all finite sets of formulas in the language. We do this for two languages. The first language, AMPL, contains formulas where a prefix of operators is applied to a propositional logic formula. The second language, CMPL, adds connectives that can be applied to AMPL formulas in a limited way. We show how to extend propositional logic inconsistency measures to such sets of formulas. Finally, we define a new concept, weak inconsistency measure, and show how to compute it. (shrink)

With the advent of Web 2.0, numerous social software applications allow people to publish and share information on the Internet. Two of these types of applications – collaborative workspaces and social network sites – have a number of features in common, which are explored to provide a basis for comparative analysis. This basis is extended with a suitable definition of privacy, a sociological perspective and an applicable adversary model in order to facilitate an investigation of similarities and differences with regard (...) to privacy threats. Practical examples are derived from the use of Wikipedia and Facebook. Analysis suggests that a combination of technical, legal, and normative solutions should be considered to counter privacy issues. A number of potential solutions that may mitigate these issues are proposed. (shrink)

This article offers a response to Michael J. Monahan's engagement with and criticism of Grant Silva's article “Racism as Self-Love.” So as to demonstrate how Monahan's idea of “ur-contempt” fits alongside the author's project and supplements his attempt to challenge the variety of forms of moral obfuscation employed by white nationalists and other racists today, this response begins with an overview of the central critique of moral responsibility for racism that Silva's work offers. At stake is the attempt, by (...) unabashed white supremacist and others, to bank on historical acts of racial oppression and reap the benefits of elevated social status while evading responsibility for that past. The goal in this project is thus to demonstrate the entanglement of interpersonal and structural forms of racism while also describing how racism unfolds in the present in order to challenge the types of moral evasion for racism that Monahan and Silva are concerned with. There is general agreement among sustainability professionals that sustainability needs to be implemented for all and not selectively for just a few. We argue that it is time to urgently act on sustainability and climate change. We suggest plausible actions by businesses, governments, consumers investors, and others. Not acting now risks the closing of a window of opportunity and potential social and economic instabilities.

This essay uses Derrida's concept of autoimmunity to critique Homeland, a television show that deals with an American prisoner of war who has been ‘turned’ into an operative for an al Queda-like movement. Autoimmunity is critical to thinking the ways in which the existence of a turned POW within the state, who belongs visibly to the state, presents a particularly heteronomic challenge to how the distinction between Self and Other operates. This Self who has taken up the cause of the (...) Other presents, this essay argues, an infinitely greater threat to the state precisely because it cannot be identified as Other, precisely because bears no ostensible traces of the Other. (shrink)

This essay considers James Baldwin's The Fire Next Time as a philosophical contemplation on love. Drawing on sources such as the Bible, Jacques Derrida, and a host of Baldwin critics, this essay understands the Christian love of The Fire Next Time as asymmetrical. The asymmetry of love derives from its understanding of love as the responsibility to Self and Other that demands no reciprocation. Asymmetrical love makes itself vulnerable before the Other and, most importantly, it is a love that risks (...) itself absolutely by offering love to those who will do violence to the subject who gives love. This book probes the cultural forces and legacies at play in three events in sports history, exploring how racial, national, sporting, and personal identities overlap and conflict. The author taps into a deep well of Western philosophy and literature to read the resonances in these three moments.

In this paper, we distinguish two different approaches to cultural evolution. One approach is meme-centered, the other organism-centered. We argue that in situations in which the meme- and organism-centered approaches are competing alternatives, the organism-centered approach is in many ways superior. Furthermore, the organism-centered approach can go a long way toward understanding the evolution of institutions. Although the organism-centered approach is preferable for a broad class of situations, we do leave room for super-organismic or sub-organismic explanations of some cultural phenomena.
